DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the proposal for a directive of the European Parliament and of the Council on the minimum level of training of seafarers (codification)

(COM(2020)0739 – C9-0371/2020 – 2020/0329(COD))

The European Parliament,

 having regard to the Commission proposal to the European Parliament and the Council (COM(2020)0739),

 having regard to Article 294(2) and Article 100(2) of the Treaty on the Functioning of the European Union, pursuant to which the Commission submitted the proposal to Parliament (C9-0371/2020),

 having regard to Article 294(3) of the Treaty on the Functioning of the European Union,

 having regard to the opinion of the European Economic and Social Committee of 27 January 2021[1],

 having regard to the Interinstitutional Agreement of 20 December 1994 – Accelerated working method for official codification of legislative texts[2],

 having regard to Rules 109 and 59 of its Rules of Procedure,

 having regard to the report of the Committee on Legal Affairs (A9-0080/2022),

A. whereas, according to the Consultative Working Party of the legal services of the European Parliament, the Council and the Commission, the proposal in question contains a straightforward codification of the existing texts without any change in their substance;

1. Adopts its position at first reading, taking over the Commission proposal as adapted to the recommendations of the Consultative Working Party of the legal services of the European Parliament, the Council and the Commission in its opinions of 31 March 2021 and of 10 March 2022;

2. Instructs its President to forward its position to the Council, the Commission and the national parliaments.

Proposal for a Directive of the European Parliament and of the Council on the minimum level of training of seafarers (codification)

COM(2020)739 final of 18.11.2020 – 2020/0329(COD)

Having regard to the lnterinstitutional Agreement of 20 December 1994 on an accelerated working method for official codification of legislative texts, and in particular to point 4 thereof, the Consultative Working Party consisting of the respective legal services of the European Parliament, the Council and the Commission met on 15 December 2020 and 14 January 2021 for the purpose of  examining the aforementioned proposal submitted by the Commission.

 

At those meetings[3], an examination of the proposal for a Directive of the European Parliament and of the Council codifying Directive 2008/106/EC of the European Parliament and of the Council of 19 November 2008 on the minimum level of training of seafarers resulted in the Consultative Working Party's establishing, by common accord, as follows.

1. In point (d) of Article 19, in the place of the final words 'in a common working language(s)' the expression 'in (a) common working language(s)', currently contained in point (d) of Article 18  of Directive 2008/106/EC, should be reinstated.

2. In Article 23(1), the adding of the article 'a' before the words 'valid dispensation' should have been identified with adaptation arrows.

3. In Article 29(2), the reference made to 'Annex V' should be replaced by a reference to 'Annex III'.


In consequence, examination of the proposal has enabled the Consultative Working Party to conclude, without dissent, that the proposal is a straightforward codification of existing texts, without any change in their substance.

Proposal for a Directive of the European Parliament and of the Council on the minimum level of training of seafarers (codification)

COM(2020) 739 final of 18.11.2020 - 2020/0329 (COD)

 

Having regard to the Interinstitutional Agreement of 20 December 1994 on an accelerated working method for official codification of legislative texts, and in particular to point 4 thereof, the Consultative Working Party consisting of the respective legal services of the European Parliament, the Council and the Commission met on 2 December 2021 for the purpose of further examining, following up to the previous meetings held on 15 December 2020 and 14 January 2021, the aforementioned proposal submitted by the Commission.

 

At that meeting[4], an examination of the proposal for a Directive of the European Parliament and of the Council codifying Directive 2008/106/EC of the European Parliament and of the Council of 19 November 2008 on the minimum level of training of seafarers  resulted in the Consultative Working Party’s establishing, by common accord, that, in addition to points 1, 2 and 3 of the Consultative Working Party’s opinion dated 31 March 2021, a further adaptation is also considered appropriate with regard to the draft codified text.

 

As was suggested by the rapporteur of the Legal Affairs Committee of the European Parliament, recital 16 of Directive (EU) 2019/1159 of the European Parliament and of the Council of 20 June 2019 amending Directive 2008/106/EC on the minimum level of training of seafarers should be inserted into the preamble to the codified act. The following recitals should be renumbered accordingly.


In consequence, examination of the proposal has enabled the Consultative Working Party to conclude, without dissent, that the proposal is a straightforward codification of existing texts, without any change in their substance.
