Motion for a European Parliament resolution on the presumed use of European countries by the CIA for transportation and illegal detention of prisoners

The European Parliament,

–  having regard to the Universal Declaration of Human Rights and to all relevant international human rights instruments,

–  having regard to Article 6 of the Treaty on European Union,

–  having regard to the Charter of Fundamental Rights of the European Union,

–  having regard to the European Convention for the Protection of Human Rights and Fundamental Freedoms,

–  having regard to UN Convention against Torture and other Cruel, Inhuman and Degrading Treatment and Punishment,

–  having regard to the Agreements on Extradition and on Mutual Legal Assistance between the European Union and the United States of America of June 2003,

–  having regard to the New Transatlantic Agenda of 22 January 2003,

–  having regard to Rule 103(2) of its Rules of Procedure,

A.  whereas continuing allegations by human rights organisations and some American media of presumed transportation and illegal imprisonment of alleged terrorist suspects by the CIA in Europe have provoked understandable concerns among the European public,

B.  whereas the governments accused of providing support for CIA operations, including ‘secret prisons’, have persistently rejected these accusations,

C.  whereas in response to the letter by Jack Straw on behalf of the EU Presidency, US Secretary of State Condoleezza Rice declared that no such activities were undertaken on the territory of the EU Member States and that the United States would implement the UN Convention against Torture and other Cruel, Inhuman and Degrading Treatment and Punishment, which was welcomed at the meeting in Brussels by ministers from the Netherlands, France and Germany,

D.  whereas the matter has legal, moral and security implications for the conduct of the war against terror that the European Union has pledged to fight and win,

1.  Underlines the importance of cooperation with the United States in the war against terrorism and emphasises that persons suspected of terrorism or criminal activity may be transferred from one State to another to answer charges; also emphasises the importance of cooperation between governments in rendition practices and stresses their sovereignty in this field of activity according to international agreements;

2.  Expresses its concern at the allegations of possible ill-treatment of detainees and the breaking of international law;

3.  Calls on all the governments concerned to make every effort to investigate the allegations and to provide all necessary information to the Commission and the European Parliament; also calls on the Council and Commission to monitor the situation closely and to clarify the press reports concerning an agreement of 2003 between the European Union and the United States giving the US access to ‘special’ transit facilities;

4.  Emphasises that accusations which are not supported by facts and solid verification expand the scale of terrorist attacks (especially against the countries whose governments allegedly cooperate in this procedure) and endanger the ways of preventing such attacks;

5.  Expresses the belief that the fight against terrorism must be fought by legal means and that this new kind of war must be won with respect for international law and with a responsible attitude on the part of governments and public opinion alike;

6.  Instructs its President to forward this resolution to the Council, the Commission, the Parliaments and Governments of the Member States, the Government of the United States of America and the UN Secretary-General.
