European Parliament resolution on Darfur

The European Parliament,

  • having regard to all relevant UN Security Council resolutions, including Resolution 1593 of 31 March 2005 on the situation in Sudan and the report of the International Commission of Inquiry on Darfur to the UN Secretary-General (Resolution 1564 (2005)),
  • having regard to the Darfur Plan of Action agreed between the UN and the Government of Sudan on 5 August 2004,
  • having regard to the Comprehensive Peace Agreement (CPA) signed by the government of Sudan and the Sudan People's Liberation Movement/Army (SPLM/A) on 9 January 2005,
  • having regard to the its resolutions of September 2004 on the humanitarian situation in Sudan, and resolution of May 2005 on Sudan as well as the ACP-EU Joint Parliamentary Assembly Resolution ACP-EU 3777/05 of April 2005 on the situation in Sudan,
  • having regard to the United Nations Sudan Situation Report of 26 April 2005,
  • having regard to the UN Security Council Resolution of 24 March 2006,
  • A.whereas conflict between government forces, pro – governmental militias and rebels has led to the deaths of at least 180 000 people and uprooted more than 2 million others over the past three years,
  • B.whereas killings, rapes and other abuse of human rights in Darfur continue to threaten peace in Sudan as a whole,
  • C.whereas the Sudanese government have failed to protect civilians in Darfur, it is unwilling to disarm the militias it created and continue to support, and its policy of permitting militia leaders, military commanders, and government officials to enjoy impunity from prosecution constitute a fundamental obstacle to any improvement in Darfur,
  • D.whereas the signing of a humanitarian ceasefire agreement in April 2004 by the Sudanese government and the two rebel movements is welcome, but violence from all sides continues in Darfur, with the Sudan government continuing to breach the ceasefire agreement with air attacks and failing to disband the Janjaweed and bring those responsible to justice,
  • E.whereas a 7000 strong AU force which was deployed in 2004 has been suffering from poor funding and inadequate resources to contain the escalation bloodshed in Sudan’s western region,
  • F.whereas UN Security Council noted the need to deplore a peacekeeping force large enough to cover the region and strong enough to deter any attack,
  • G.whereas AU Peace and Security Council agreed in principle to hand over the peacekeeping mission to the UN,
  • 1.Expresses deep concern on increasingly violent situation development, terror and widespread rape, intimidation and harassment taking place within IDP camps in Darfur region;
  • 2.Welcomes the decision of the UN Security Council on extension of mandate of an expert panel monitoring an arms embargo against belligerents in Darfur region and calls on international organizations, AU and other interested parties to cooperate with the panel, supplying any information relevant to the arms embargo and sanctions;
  • 3.Welcomes the tentative agreement by the AU Peace and Security Council to hand over the peacekeeping mission to the UN; regrets at the same time renewed rejection for the deployment of UN forces in Darfur by the Sudanese President Omar Hassan al –Bashir just hours after the conclusion of Arab summit;
  • 4.Urges the Security Council to take all necessary measures to ensure the deployment of a UN force in Darfur on or before 1 October 2006; until UN force comes in the African Union must be bolstered with funds, equipment and other support;
  • 5.Calls on the Government of Sudan to cooperate in the handover of peacekeeping duties to UN;
  • 6.Urges the government of Sudan to refrain from conducting hostile military operations in and over the Darfur region, to implement its stated commitment to neutralize and disarm the Janjawid/armed militias, and to identify those militias over whom it has influence and ensures that these militias refrain from all attacks, harassment and intimidation;
  • 7.Calls for the government of Sudan to guarantee sufficient humanitarian assistance and relief workers' access to victims of the conflict;
  • 8.Urges the African Union to proactively and aggressively enforce the existing mandate to protect civilians;
  • 9.Regrets the decision by the government of Sudan to prevent the United Nations' top humanitarian official - UN's top humanitarian co-ordinator Jan Egelandr - from visiting the troubled Darfur region;
  • 10.Calls on the Government of Sudan to suspend from official duty, investigate, and fully prosecute all civilian and military personnel - including government officials, military and militia commanders, soldiers, police officers, and PDF members - implicated for individual or command responsibility for serious violations of international human rights and humanitarian law in Darfur;
  • 11.Calls on the government of Sudan to fully cooperate with and facilitate the International Criminal Court's investigation in Darfur, and permit investigators full and unimpeded access throughout Sudan which should include access to all potential and actual witnesses and material;
  • 12.Calls on International Criminal Court (ICC) to investigate and prosecute senior civilian officials at all levels of government, including President Omar El Bashir, as well as state governors, provincial commissioners, and individuals in the formal military chain of command, who were responsible for war crimes and crimes against humanity in Darfur;
  • 13.Calls on the EU, its member states, as well as the international community to support the African Union to guarantee the safety of the population living in rural areas and hereby enable them to return to their homelands;
  • 14.Instructs its President to forward this resolution to the Council, the Commission, the Government of Sudan, the African Union, the Governments of the EU Member States, the US, Russia, Chad, Libya, Eritrea, Egypt and China, the UN Secretary-General, the Co-Presidents of the ACP-EU Joint Parliamentary Assembly and the ACP Council.
