MOTION FOR A RESOLUTION on Venezuela

with request for inclusion in the agenda for the debate on cases of breaches of human rights, democracy and the rule of law
pursuant to Rule 122 of the Rules of Procedure

European Parliament resolution on Venezuela

The European Parliament,

- having regard to the Principle of Non-Intervention foreseen by the UN Charter of 1945,

 

- having regard to Chapter 1, Article 1, part 2 of the UN Charter that states: “To develop friendly relations among nations based on respect for the principle of equal rights and self-determination of peoples, and to take other appropriate measures to strengthen universal peace”,

 

- having regard to Article 1 in both the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights which state that “all peoples have the right of self-determination; by virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development”,

 

- having regard to Rule 122(5) of its Rules of Procedure,

 

A. Considering that the case of RCTV does not constitute a case of violation of human rights,

 

B. Considering that the Venezuelan authorities, exercising their administrative and constitutional capacities vested on them by the Venezuelan Constitution and laws, must guarantee that the regulations and laws governing all mass media are respected, as it is also the case for the EU member states,

 

C. Considering that RCTV is a national audiovisual services provider according to the Technical Regulation on National Audiovisual Production Services of Venezuela, since RCTV does not include in its weekly programming more than 70% of programs of a non-national nature,

 

D. Considering that the national service providers must register at the National Telecommunications Commission (CONATEL), which is the agency in charge of the implementation of the Law of Social Responsibility in Radio and Television in Venezuela,

 

E. Considering that on the 25th of January demonstrations took place in Mérida (Venezuela) by opposition groups and groups supporting the Government in which 2 young people died, one from each group,

 

1. States that the case of RCTV does not constitute a violation of human rights;

 

2. Reminds RCTV that compliance with Venezuelan legislation should be respected as 19 of the 24 channels have done it by registering at CONATEL, so they are already broadcasting on cable television,

 

3. Regrets the unfortunate outcome of the demonstrations on 25th January in Mérida where 2 young people died, one a supporter of the government and another one of the opposition,

 

4. Instructs its President to forward this resolution to the Council, the Commission, the Government of the Bolivarian Republic of Venezuela, the Parliament of the MERCOSUR and the EUROLAT Assembly.
