European Parliament resolution on the case of Gilat Shalit

The European Parliament,

- having regard to the 1949 Third Geneva Convention and common article 3 to 1949 Geneva convention,

 

- having regard to the 1979 International convention against the taking of hostages,

 

- having regard to the US congress resolution 921 from 18/07/2006,

 

- having regard to its resolutions of 13 November 2006, 13 June 2007, 12 July 2007, 21 February 2008 and 4 September 2008,

 

- having regard to Rule 122(5) of its Rules of Procedure,


A.  whereas Corporal Gilad Shalit was kidnapped by Hamas armed forces on 25 June 2006 from Israeli soil,

 

B.  whereas Gilad Shalit is a European (French) and Israeli citizen,

 

C.  whereas since being taken hostage Corporal Shalit is being kept in Gaza incommunicado where he does not enjoy basic rights according to 3rd article to the Geneva Convention and to the 3rd Geneva Convention,

 

D.  whereas the Hamas organization assumed responsibility for ongoing detention of Gilad Shalit and declares in response to the Goldstone report that Shalit is being held in accordance with the 3rd Geneva Convention,

 

1.  Calls for the immediate release of Gilad Shalit;

 

2.  Calls upon Hamas to comply with its declaration to award Shalit the rights and privileges in accordance with the 3rd Geneva Convention;

 

3.  Deplores the continued disregard for Gilad Shalit basic human rights and the prevention of information regarding his wellbeing from his family and the Israeli and French authorities;

 

4.  Calls upon the leaders of the Member States, the High Representative of the Union for Foreign Affairs and Security Policy, as well as the members of the European Parliament who are invited to Gaza to demand allowing Shalit his basic rights;

 

5.  Instructs its President to forward this resolution to the Council and the Commission, the Member States and the High Representative of the Union for Foreign Affairs and Security Policy.
