MOTION FOR A RESOLUTION on Indonesia: including attacks on minorities

European Parliament resolution on Indonesia: including attacks on minorities

The European Parliament,

–      having regard to its previous resolutions on Indonesia,

 

–      having regard to the Council Conclusions on freedom of religion or belief adopted on 16 November 2009 as well as the complementary Council Conclusions on intolerance, discrimination and violence on the basis of religion or belief adopted on 21 February 2011,

 

–      having regard to the European Union's statement on the attack and killing of Ahmadis in Baten province, Indonesia on 8 February 2011,

 

–      having regard to the ASEAN Charter relating to the promotion and protection of human rights and fundamental freedoms, which entered into force on 15 December 2008, and the creation of the ASEAN Intergovernmental Commission on Human Rights on 23 October 2009,

 

–      having regard to the United Nations Declaration on the elimination of all forms of intolerance and discrimination based on religion or belief,

 

–      having regard to the EU-Indonesia Partnership and Cooperation Agreement (PCA),

 

–      having regard to Rule 122(5) of its Rules of Procedure,

 

 

A.  Whereas Indonesia was elected to the United Nations Human Rights Council in May 2011;

 

B.  Whereas there has been an increase in the number of attacks against religious minorities, but also against peaceful political dissidents,

 

C.  Whereas the rights to freedom of expression, opinion and peaceful assembly and the rights to freedom of thought, conscience and religion are guaranteed under articles 18 and 19 of the international covenant on civil and political rights to which Indonesia is a state party,

 

 

1.  Condemns all acts of sectarian violence committed in Indonesia, in particular to the religious minorities such as Christians and Ahmadiyah;

 

2.  Condemns the increase of cases of intimidation, attacks and arrests against human rights defenders, journalists and political activist,

 

3.  Condemns all acts of torture or ill-treatment by police on peaceful political activists, and urges measures to ensure that those responsible are brought to justice in fair trials and the victims receive reparations;

 

4.  Calls on the Indonesian authorities to conduct investigations on those acts, according to the principles of the rule of law, as enshrined in the EU-Indonesia Partnership and Cooperation Agreement (PCA);

 

5.  Encourages the Indonesian government and law enforcement agencies to hold accountable extremist and violent individuals according to due process and the rule of law, believes it is essential for Indonesia's development that its domestic processes of accountability and justice serve all Indonesian citizens without discrimination.

 

6.  Underlines the progress Indonesia has achieved on the implementation of democracy and the rule of law in recent years

 

7.  Calls upon the authorities to live up to the State ideology "Pancasila", which calls for a just and civilized society as well as respect for democracy and for the protection of pluralism, therefore welcomes the statement made by the Indonesian authorities on the 24 May 2011 and the call for a better study of this ideology at school

 

8.  Regards the creation of the ASEAN Intergovernmental Commission on Human Rights as a welcome step towards a more comprehensive approach and the more effective implementation of human rights standards across the region;

 

9.  Calls on the High Representative of the Union for Foreign Affairs and Security Policy, the Commission and the Council systematically to raise the issue of the worrying human rights situation in Indonesia in the context of its relevant political dialogues, especially in the future negotiations on the Comprehensive Economic Partnership Agreement between the EU and Indonesia;

 

10.  Instructs its President to forward this resolution to the Council, the Commission, the Governments and Parliaments of the Member States, to the Vice-President of the Commission/High Representative of the Union for Foreign Affairs and Security Policy, the Government and National Assembly of the Kingdom of Cambodia, the Government of the Kingdom of Thailand, the Governments of the ASEAN member states, the Secretary-General of the United Nations and to the UNESCO Directorate General.
