European Parliament resolution on forced abortion scandal in China

(2012/2712(RSP))

The European Parliament,

- having regard to its previous resolutions on China and its resolution of 18 April 2012 on the Annual Report on Human Rights in the World and the European Union's policy on the matter, including implications for the EU's strategic human rights policy,

- having regard to the Universal Declaration of Human Rights, in particular articles 5,9, 12 and 16,

- having regard to the International Covenant on Civil and Political Rights, in particular articles 6, 7, 9 and 24, ratified by China on 28 February 2001,

- having regard to the Convention on the Elimination of all forms of Discrimination against Women, in particular article 16, ratified by China on 4 November 1980,

- having regard to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, ratified by China on 4 October 1988,

- having regard to the May 2005 report on China from the UN Committee on Economic, Social and Cultural Rights and the August 2006 report on China from the UN committee on the Elimination of Discrimination against Women,

- having regard to Article 3(5) of the Treaty on European Union,

- having regard to Rule 122 of the Rules of Procedure

 

 

A.  whereas it was reported that on 30 May 2012 local family planning officials of Zengjia town, in China's Shaanxi Province abducted a 22 year old woman named Feng Jianmei who was in the seventh month of her pregnancy and forced her to undergo an abortion without her consent three days later;

B.  whereas this case of forced abortion has caused a great public outcry and a debate on coercive family planning practices in China after Ms. Jianmei's husband, Deng Jiyuan, posted images of his wife and the aborted foetus online;

C.  whereas the Chinese central authorities have apologized to the 22 year old woman;

D.  whereas however, Mr. Jiyuan has reportedly fled after having been harassed and summoned to meet with government officials, whereas Ms. Jianmei is not allowed to leave the hospital;

E.  whereas in China late and forced abortions and forced sterilizations, are prohibited by law, but occur nonetheless in practice;

F.  whereas in China sex-selective abortions and female infanticide persist, despite campaigns and incentives aimed at preventing and prohibiting these practices; and whereas these practices have led to an increasing gender imbalance with 118 newborn males for every 100 females, according to the latest census figures;

G.  whereas the EU has provided and still provides funds for organizations involved in family planning policies in China;

 

 

1.  Strongly condemns this and any other case of forced abortion by local family planning officials in China;

2.  Welcomes the apologies to Ms. Jianmei made by Chinese officials;

3.  Urges the Chinese government to review its family planning policies so that harmful and coercive elements are removed, furthermore urges the Chinese government to refrain from pressuring family planning officials to meet strict targets;

4.  Urges the Chinese authorities to protect Ms. Jianmei and her husband Mr. Jiyuan;

5.  Calls on the Commission and the External Action Service to put forced abortion and forced sterilization on the agenda of the next EU-China human rights dialogue;

6.  Expresses its concern about the gender imbalance and the resulting increased rates for forced prostitution and human trafficking;

7.  Asks the Commission to make sure the EU budget does not fund any organization or entity directly or indirectly involved in coercive family planning policies;

8.  Instructs its President to forward this resolution to the Council, the Commission, the High Representative of the Union for Foreign Affairs and Security Policy, the governments and parliaments of the Member States, and the Government of the People's Republic of China.
