European Parliament resolution on Djibouti

(2013/2690(RSP))

The European Parliament,

–   having regard to Rule 122 of its Rules of Procedure,

A.  Whereas Djibouti's human rights record remains alarming where arbitrary detention, denial of fair trial, partiality of the judiciary, violation of freedom of speech and assembly, absence of political pluralism are among other common practices,

 

B.  Whereas Djibouti women are confronted with diverse form of violence, including rape, Female Genital Mutilation, domestic violence, sexual harassment , early marriage, which have a far reaching consequences on physical and psychological destruction of women

 

C.  Whereas the 1992 Constitution recognises fundamental liberties and basic principles of good governance,

 

D.  Whereas in 2010, the Djibouti parliament amended the constitution in order to allow President Guelleh, to stand for the presidential election by removing the term limit,

 

E.  Whereas the recent legislative elections which were held in February 2013 has resulted in an overwhelming victory of president Goulleh party, Union pour la majorité présidentielle” (UMP), who e won over 80% parliamentary seats,

 

F.  Whereas a coalition of opposition parties , Union for National Salvation, decided to put an end to their policy of boycotting elections, after agreement was reached in November 2012 that 20% of parliamentary seats would be selected by proportional representation,

 

G.  Whereas the result of the February elections has not yet been published despite the EU election observation mission, which is suspicious about the manipulation,

H.  Whereas the political climate, which has prevailed in Djibouti since the February’s elections, which were held against a backdrop of significant public protests against the regime of Ismail Omar Guelleh,

 

I.  Whereas Djibouti is signatory of the International Covenant on civil and political rights as well as Covenant on Economic, Social and Cultural Rights,

 

1.  Calls upon the Djiboutian authorities to respect for human rights and fundamental freedoms of its citizens, in compliance with their regional and international commitments,

 

2.  Calls also on the authorities to respect and promote political pluralism in the parliament and the independence of justice to exercise equitably its duty,

 

3.  Invite the government of Djibouti to open dialogue with opposition in order to reach a national consensus on the post election disputes,

 

 

4.  Believes that building democratic society require above all strong political will and ambitious vision of political leaders, governments as well as opposition, aiming at building political institutions to guarantee human, social, economic and environmental rights of the population,

 

5.  Strongly condemns the acts of sexual violence against women and reminds that the government of Djibouti has the responsibility to put an end to impunity by bringing those responsible for sexual and other violence against women to court,

 

6.  Considers it is vital to conduct an impartial and in-depth investigation of human rights violations and bring those responsible to an impartial court to put an end to impunity, which is the only way of ensuring the right of victims to fair justice,

 

7.  Instructs its president to forward this resolution to the government of Djibouti, the African Union , the IGAD, the EU council and commission,
