Motion for a European Parliament resolution on the amendment of Regulation (EU) No 517/2014 of 16 April 2014 on fluorinated greenhouse gases and/or of Commission Notice No 2014/C 153/07 of 21 May 2014

The European Parliament,

–       having regard to the European Charter on Environment and Health of 8 December 1989,

–       having regard to Council and Commission Decision 98/181/EC, ECSC, Euratom of 23 September 1997,

–       having regard to Decision 1999/819/Euratom of 16 November 1999,

–       having regard to Rule 133 of its Rules of Procedure,

A.     whereas the subject of fluorinated gases is governed by Regulation (EU) No 517/2014 of 16 April 2014;

B.     whereas the Commission, by Notice No 2014/C 153/07 of 21 May 2014, pursuant to Article 16(2), third subparagraph, of the aforementioned Regulation 517/2014, has clarified the time frame for the declarations referred to in Article 16(1) and (2) of that Regulation;

C.     whereas many companies throughout the EU have reported that, often, their suppliers of hydrofluorocarbons have not been allocated quotas within the EU because the time limit given to them in order to fulfil the administrative requirements provided for in the regulation was too short, thus penalising them;

D.     whereas, in this regard, the deadline for entry in the registry for producers/importers of hydrofluorocarbons was 1 July 2014;

E.     whereas, according to the Commission notice, quotas will not be allocated to producers of pre-charged equipment, unless they operate as producers or importers of fluorinated substances in large quantities, but only to producers/importers of fluorinated gases, who may grant authorisation to use their own quotas;

1.      Calls on the Commission, by amending its Notice to producers and importers of hydrofluorocarbons and to new undertakings intending to place hydrofluorocarbons in bulk on the market in the European Union in 2015 (2014/C 153/07), published on 21 May 2014, to grant quotas for the use of fluorinated gases also to producers of equipment (including, but not limited to, commercial refrigeration systems, air conditioning systems, heat pumps, etc.) or to extend the deadline for inclusion on the register referred to in the above notice, in order to enable suppliers of hydrofluorocarbons who have not yet registered to do so.
