MOTION FOR A RESOLUTION on the case of Nadiya Savchenko

European Parliament resolution on the case of Nadiya Savchenko

(2015/2663(RSP))

The European Parliament,

-    having regard to its previous resolutions on Russia and Ukraine, in particular its resolution on the murder of the Russian opposition leader Boris Nemtsov and the state of democracy in Russia of 12 March 2015, and on the situation in Ukraine of 15 January 2015,

-    having regard to the statement by the Vice-President of the European Commission/High Representative for Foreign Affairs and Security Policy (VP/HR) on the continued detention of Nadiya Savchenko of 4 March 2015,

-    having regard to the EU statement on Abduction and Illegal detention of Ukrainian citizens by the Russian Federation of 16 April 2015,

-    having regard to Rule 135 of its Rules of Procedure,

A. whereas the pro-Russian militants of the self-declared People’s Republic of Luhansk in the territory of Eastern Ukraine have illegally kidnapped the Ukranian pilot Nadiya Savchenko on the territory of Ukraine on 18 June 2014, detained and illegally transferred her to the Russian Federation,

B. whereas the Investigative Committee of Russia has brought on 24 April 2015 final charges against Nadiya Savchenko (aiding and abetting murder of two and more persons, aiding and abetting attempt of two and more persons and illegal crossing of the Russian Federation border),

C. whereas Nadiya Savchenko is a member of the Verkhovna Rada and of Ukraine’s delegation to the Parliamentary Assembly of the Council of Europe; whereas the Russian Federation rejects diplomatic immunity granted to Nadiya Savchenko as a member of Verkhovna Rada,  whereas the international community has undertaken numerous efforts to ensure the release of Nadiya Savchenko,

D. whereas the Russian Federation has agreed to the exchange of all political hostages under the Minsk agreements; whereas Nadiya Savchenko was on numerous occasions offered amnesty under the condition that she would admit her guilt;       

E   whereas Nadiya Savchenko, in sign of a protest, is already more than 110 days on hunger strike, whereas during the visits, family of Nadiya Savchenko is allowed to talk only in Russian language and have restricted access to her; whereas during all the time of her imprisonment her health condition was examined only two times by German doctors and once by Ukrainian doctors;

 

1. Condemns the Russian Federation for the illegal kidnapping, the detention and the investigation of Nadiya Savchenko in prison since nearly one year; demands that Russian authorities respect its international commitment in the framework of the Minsk agreements and in particular the agreed "Package of measures for the implementation of the Minsk agreements" and immediately release Nadiya Savchenko;

2 Considers that Russia has no legal basis nor jurisdiction to take any action against Nadiya Savchenko, like detention, investigation or bringing charges against her;

3.  Is of the opinion that her detention in a prison in Russia is a violation of the Geneva Convention; underlines that Russia bears a responsibility for Ms Savchenko’s fragile health; calls on Russia to allow international humanitarian organisations to have permanent access to her;

4.  Calls for the immediate release of all other Ukrainian citizens illegally detained in Russia;

5.  Points out that the release of Nadiya Savchenko is not only a needed step towards improvement of the relations between Ukraine and Russia, but will show a respect for recognition of fundamental human rights from the Russian authorities;

 

6.  Reminds that Nadiya Savchenko is elected as a member of the Ukrainian Parliament in the October 2014 Ukrainian general parliamentary election and is part of Ukraine’s delegation to the Parliamentary Assembly of the Council of Europe, and was granted an international immunity;

7.  Instructs its President to forward this resolution to the Vice-President of the Commission / High Representative of the Union for Foreign Affairs and Security Policy, the Council, the Commission, and the President, Government and Parliament of the Russian Federation.
