MOTION FOR A RESOLUTION on the case of Nadiya Savchenko

European Parliament resolution on the case of Nadiya Savchenko

(2015/2663(RSP))

The European Parliament,

 

- having regard to its previous resolutions on the situation in Ukraine and on the Russian Federation;

 

- having regard to the Geneva convention and to the special legislative rules concerning elected parliamentarians;

 

- having regard to the resolution of the Parliamentary Assembly of the Council of Europe (PACE) of 29 January 2015 and the numerous appeals of the Verkhovna Rada of Ukraine;

 

A. whereas Nadiya Savchenko remains in pre-trial detention in Moscow, Russia, having been captured inside Ukraine on 18 June 2014 by the separatist militia and illegally transferred to the Russian Federation shortly after;

B. whereas Ms Savchenko, born 1981, has a distinguished military career behind her, having been the only female soldier in the Ukrainian peacekeeping troops in Iraq and the first female soldier to enrol at Ukraine's Air Force University;

C. whereas Ms Savchenko had volunteered to take part in the fights in the eastern parts of Ukraine, as part of the Aidar Battalion, when she was captured;

D. whereas the Russian authorities have ignored the multiple Ukrainian and international requests to hand over Ms Savchenko and instead accused her of terrorism and involvement in the killing of two Russian journalists;

E. whereas her detention has been prolonged by Russian courts, which has also ordered her to undergo forensic psychological evaluations, against her own will;

F. whereas Ms Savchenko was elected to the Ukrainian Parliament in absentia in the elections in October 2014 and became member of the Ukrainian delegation to the Parliamentary Assembly of the Council of Europe (PACE) in January 2015, having beforehand resigned from the Ukrainian army;

1. calls on the Russian authorities to immediately release Ms Savchenko based on international law and humanitarian grounds and hand her over to the Ukrainian authorities without delay;

2. reminds the Russian authorities that the health condition of Ms Savchenko remains extremely fragile and that they are directly responsible for the safety and well-being of her; calls on the Russian authorities to allow impartial international doctors access to Ms Savchenko, while ensuring that any medical or psychological examinations are done only with Ms Savchenko's consent and taking into consideration the consequences of her staying on hunger strike for a very long period;

3. underlines that Russia should present the evidence it has for the alleged crimes Ms Savchenko stands accused of, and hand these over to the Ukrainian authorities or to an international investigation team which could be composed ad hoc to examine the Russian claims; underlines that those responsible for her illegal detention in Russia may face international sanctions or legal proceedings for their actions;

4. points out that official Russian media has tried to portray Ms Savchenko in a very negative and often sexist manner;

5. points to recent exchanges of prisoners between the Ukrainian forces and the separatists as a measure to build confidence between the two sides;

6. calls on the EU and its Member States to continue to seek the immediate liberation of Ms Savchenko by the Russian authorities;

7. instructs its President to forward this resolution to the Commission, to the Council, to the External Action Service, to the Members States and to the Ukrainian and Russian authorities.
