    MOTION FOR A RESOLUTION on the case of Nadiya Savchenko

    European Parliament resolution on the case of Nadiya Savchenko


    The European Parliament,


    –       having regard to its previous resolutions on Ukraine and Russia,

    –       having regard to the conclusions on Ukraine of the European Council meeting of 19-20 March 2015,

    –       having regard to the statement by the VP/HR of 4 March 2015 on the continued detention of Nadiya Savchenko,

    –       having regard to Rule 135 of its Rules of Procedure,

    A.     whereas in June 2014 Nadiya Savchenko, Ukrainian pilot and Lieutenant in the Armed Forces of Ukraine, was illegally captured in Ukraine, transferred to Russia and currently remains in pre-trial detention;

    B.     whereas Ms Savchenko was elected to the Verkhovna Rada of Ukraine in the national elections of 26 October 2014 and became a Deputy of the Verkhovna Rada on 27 November 2014;

    C.     whereas Nadiya Savchenko is a member of the Parliamentary Assembly of the Council of Europe and is therefore fully entitled to the immunity and diplomatic privileges stemming from this;

    1.      Strongly condemns the illegal detention and imprisonment of Nadiya Savchenko in the Russian Federation;

    2.      Regrets that regardless of the ceasefire agreement reached in Minsk on 12 February 2015 which envisages an exchange of political prisoners and hostages in ‘all-for-all’ format and despite the increasing pressure from the international community, the Russian authorities refuse to free Ms Savchenko and other Ukrainian citizens;

    3.      Considers it deeply unacceptable that the representative of the people who was elected in the democratic and free elections is prevented from representing her voters in the Verkhovna Rada of Ukraine due to the illegal detention on the territory of another country;

    4.      Calls on the government and the law enforcement authorities of the Russian Federation to respect human rights as well as its international obligations and to immediately and unconditionally release Nadiya Savchenko and to enable her safe return to the homeland; reminds that any person in custody in a Council of Europe member state must fully enjoy the guarantees provided by the European Convention on Human Rights and the other relevant Council of Europe instruments;

    5.      Expresses its great concern about the health condition of Ms Savchenko and reiterates that Russia bears responsibility for the very fragile state of it;

    6.      Instructs its President to forward this resolution to the European External Action Service, the Council, the Commission, the Member States, the President, Government and Parliament of Ukraine, the Government and Parliament of the Russian Federation.
