Motion for a European Parliament resolution on adding water to foods obtained from fishing

The European Parliament,

–       having regard to Article 169 of the Treaty on the Functioning of the European Union,

–       having regard to Regulation (EU) No 1169/2011 of the European Parliament and of the Council of 25 October 2011 on the provision of food information to consumers, amending Regulations (EC) No 1924/2006 and (EC) No 1925/2006 of the European Parliament and of the Council, and repealing Commission Directive 87/250/EEC, Council Directive 90/496/EEC, Commission Directive 1999/10/EC, Directive 2000/13/EC of the European Parliament and of the Council, Commission Directives 2002/67/EC and 2008/5/EC and Commission Regulation (EC) No 608/2004(1),

–       having regard to Regulation (EC) No 178/2002 of the European Parliament and of the Council of 28 January 2002 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety(2),

–       having regard to the publication of 31 January 2015 entitled ‘Questions and Answers on the application of the Regulation (EU) No 1169/2011 on the provision of food information to consumers’,

–       having regard to Directive 2005/29/EC of the European Parliament and of the Council of 11 May 2005 concerning unfair business-to-consumer commercial practices in the internal market and amending Council Directive 84/450/EEC, Directives 97/7/EC, 98/27/EC and 2002/65/EC of the European Parliament and of the Council and Regulation (EC) No 2006/2004 of the European Parliament and of the Council(3),

–       having regard to Rule 133 of its Rules of Procedure,

A.     having regard to the results of surveys in Que Choisir magazine and those conducted by the NGO foodwatch;

B.     whereas the addition to foods of water retention agents, such as polyphosphates, is perfectly permissible;

C.     whereas such practices are in breach of the rules laid down in the Treaties and in secondary legislation;

1.      Calls for a ban on adding water retention agents to foods obtained from fishing;

2.      Calls for the derogation provided for in Articles 16(4) and 44(1)(b) of and Annex V to Regulation (EU) No 1169/2011 to be repealed in respect of foods obtained from fishing;

3.      Instructs its President to forward this resolution to the Commission, the Council and the Member States.
