The European Parliament,

–       having regard to Rule 133 of its Rules of Procedure,

A.     whereas the number of legal posted workers in France rose to 230 000 in 2014, an increase of 8%, to which must be added 220 000 to 300 000 illegal detached workers;

B.     whereas the recent amendment to European legislation seeking to combat unfair social competition and fraud relating to the posting of workers fails to solve anything owing to problems of implementation and lack of cooperation from some Member States, which repeatedly resort to delaying tactics and issuing ‘posting certificates of convenience’;

C.     whereas temporary employment agencies play a predominant role in this explosion in the posting of workers, since during the period 2004-2012 the number of workers posted to France by temporary employment agencies rose by 3 384% as against 965% for posted workers as a whole;

D.     whereas the posting system for workers is intrinsically impossible to reform;

1.      Calls on the Commission to abolish this system, or if not, to exclude temporary employment agencies and similar bodies from the legal posting of workers;

2.      Instructs its President to forward this resolution to the Commission.
