Motion for a European Parliament resolution on sanctions imposed by the Commission on European citizens following violations of environmental directives by Member States and on the transparency of pre-infringement procedures

The European Parliament,

–       having regard to Rule 133 of its Rules of Procedure,

A.     whereas the Commission has initiated several pre-infringement procedures against Italy via the EU Pilot platform, in order to communicate problems regarding conformity of national law with EU law or the correct application of EU environmental laws;

B.     whereas requests for access to documents relating to the aforementioned cases by citizens or Members of the European Parliament have been rejected;

C.     whereas Italy’s average response time is higher than the 70-day benchmark specified in EU Pilot; in the aforementioned cases, several months have elapsed without any reply;

D.     whereas, if the Commission applies monetary sanctions for incorrect application of EU law, citizens will have to pay these fines;

1.      Calls on the Commission to submit a legislative proposal to ensure that citizens do not have to pay for violations of EU law perpetrated by Member States;

2.      Calls on the Commission to increase the transparency of pre-infringement procedures, granting citizens full right of access.
