MOTION FOR A RESOLUTION on the adoption of children

European Parliament resolution on the adoption of children

The European Parliament,

–       having regard to Rule 133 of its Rules of Procedure,

A.     whereas, as far as the adoption of children is concerned, there are no uniform rules covering all Member States, which each apply their own rules;

B.     whereas in order to obtain information about the procedure and the conditions for adoption, and to establish who is entitled to adopt a child, it is necessary to approach the proper authorities in the country concerned;

C.     whereas the Member States have a number of shared principles laid down in international conventions;

D.     whereas it has to be ensured that adoption must be subject to the approval of a court or an administrative body and to the consent of the child’s birth parents, assuming that they are alive; and that it must be an action taken in the interest of the child;

E.     whereas in most (though not all) countries an adopted child can acquire a family name, citizenship, and the same inheritance rights as a biological child;

1.      Considers it unfortunate that the Commission very often fails to respond quickly enough to prevent problems from arising in connection with adoption, with the result that the whole process can, for example, become unnecessarily protracted;

2.      Calls on the Commission to issue guidelines in order to make the Member States harmonise adoption matters on the basis of the Convention on the Rights of the Child.
