MOTION FOR A RESOLUTION on the situation in Poland

European Parliament resolution on the situation in Poland

(2015/3031(RSP))

The European Parliament,

–  having regard to the statements by the Council and the Commission of 19 January 2016 on the situation in Poland,

–  having regard to Rule 123(2) of its Rules of Procedure,

A.  whereas the European Union does not have the capacity or entitlement to interfere in the internal policies of Member States; whereas the European Union should not threaten to impose or actually impose sanctions when democratically made choices do not follow the direction desired by the EU;

B.  whereas the Commission has already reacted inappropriately by criticising the electoral choices of European citizens after elections and referendums in other Member States and is now preparing to single out the new Polish Government;

C.  whereas the Hungarian Prime Minister, Viktor Orbán, has stated that ‘the European Union should not think about applying any sort of sanctions against Poland because this would require full unanimity, and Hungary will never support any sort of sanctions against Poland’;

1.  Recalls that the Commission is not a political body but the executive organ of the Union and must strictly comply with Article 17 of the Treaty on European Union (TEU) and Articles 234, 244-250, 290 and 291 of the Treaty on the Functioning of the European Union (TFEU);

2.  Solemnly reaffirms its attachment to the overriding principles of identity and national sovereignty, principles which form an indivisible whole with the principle of freedom;

3.  Instructs its President to forward this resolution to the Council, the Commission and the governments and parliaments of the Member States.
