European Parliament resolution on the Commission delegated regulation of 15 February 2017 amending Delegated Regulation (EU) No 639/2014 as regards the control measures relating to the cultivation of hemp, certain provisions on the greening payment, the payment for young farmers in control of a legal person, the calculation of the per unit amount in the framework of voluntary coupled support, the fractions of payment entitlements and certain notification requirements relating to the single area payment scheme and the voluntary coupled support, and amending Annex X to Regulation (EU) No 1307/2013 of the European Parliament and of the Council (2017/2571(DEA))

The European Parliament,

–  having regard to Commission delegated regulation C(2017)0735,

–  having regard to Article 290 of the Treaty on the Functioning of the European Union,

–  having regard to Regulation (EU) No 1307/2013 of the European Parliament and of the Council of 17 December 2013 establishing rules for direct payments to farmers under support schemes within the framework of the common agricultural policy and repealing Council Regulation (EC) No 637/2008 and Council Regulation (EC) No 73/2009(1), and in particular Article 35(2) and (3), Article 44(5)(b), Article 46(9)(a) and (c), Article 50(11), Article 52(9)(a), Article 67(1) and (2)(a) and Article 70 thereof,

–  having regard to the motion for a resolution by the Committee on Agriculture and Rural Development,

–  having regard to Rule 105(3) of its Rules of Procedure,

A.  whereas the Commission severely undermines with the tabling of this delegated regulation the prerogatives of Parliament as co-legislator on both procedure and content;

B.  whereas bundling and presenting 14 empowerments as one single Commission delegated regulation impedes the exercise of Parliament’s right of scrutiny, as it is forced to simply accept or refuse the entire package, which leaves no room to express an opinion on each empowerment individually;

C.  whereas the Commission delegated regulation goes well beyond a pure simplification measure and will have a fundamental impact on the implementation of the common agricultural policy (CAP);

D.  whereas the prohibition of phytosanitary protection of leguminous crops on Ecological Focus Areas threatens sustainable domestic protein production in line with the EU protein strategy, when Europe already heavily depends on imports of protein;

E.  whereas the ecological benefits of leguminous plants as regards soil protection and nitrogen fixation are indisputable and far higher than those of crops undersown with grass, for example;

1.  Objects to the Commission delegated regulation;

2.  Instructs its President to forward this resolution to the Commission and to notify it that the delegated regulation cannot enter into force;

3.  Instructs its President to forward this resolution to the Council and to the governments and parliaments of the Member States.
