European Parliament resolution on the arrest of human rights defenders in Sudan, notably the Sakharov Prize laureate Salih Mahmoud Osman

(2018/2631(RSP))

The European Parliament,

- having regard to its previous resolutions on situation in Sudan, in particular those of 6 October 2016 and 16 November 2017,

 

-having regard to the Universal Declaration of Human Rights,

 

- having regard to the International Covenant of Civil and Political Rights,

 

-having regard to the United Nations Declaration on Human Rights Defenders, adopted by the UN General Assembly on 9 December 1998,

 

- having regards to the Open letter concerning the crackdown on peaceful protests and the wave of arbitrary arrests and continued incommunicado detentions by Sudanese government forces undersigned by the Sudanese, African and international organizations,

 

-having regard to the African Centre for Justice and Peace Studies recent reports,

 

-  having regard to its Subcommittee on Human Rights (DROI) mission to Sudan in December 2017,

 

- having regard to Reporters Without Borders World Press Freedom Index 2017,

 

- having regard to the Cotonou Agreement,

 

-having regard to the African Charter on Human and Peoples’ Rights,

 

- having regard to The Interim National Constitution of the Republic of Sudan,

 

- having regard to Rule 135 of its Rules of Procedure,

 

 

A. whereas the Sudanese authorities have carried out a crackdown on peaceful protests against the drastic increase of prices of basic commodities in Sudan since the beginning of 2018,

 

B. whereas the protests have met with excessive use of force by the security forces and nationwide repressions against human rights defenders, journalists and activists,

 

C. whereas on 7 January 2018, in El Geneina, West Darfur one student was killed and six other students were injured after joint forces of the National Intelligence and Security Services and Sudanese Police used live ammunition to disperse a peaceful student march,

 

D. whereas on 20 January 2018, at least 5 people were killed and 26 others sustained gunshot wounds when the Sudanese Armed Forces and Rapid Support Forces opened live ammunition on a crowd of peaceful protestors at Hasahisa camp for internally displaced persons in Zalingei, Central Darfur,

 

E. whereas from 6 January to 6 February 2018, the security forces have arrested and detained scores of Sudanese citizens including human rights defenders, opposition political party leaders, journalists and students for prolonged periods without charge or trial,

 

F. whereas the security forces arrested Salih Mahmoud Osman on 1 February 2018; whereas Salih Mahmoud Osman is Vice President of the Darfur Bar Association, member of the Democratic Lawyers Association, a human rights lawyer, and recipient of the 2007 Sakharov Prize,

 

G. whereas a number of the protesters remain in the custody of the Sudanese National Intelligence and Security Services despite an official announcement that “all political prisoners” would be released,

 

H. whereas several of the human rights defenders that have been detained have been subject to torture and ill-treatment,

 

I. whereas a number of newspapers were confiscated in January and February 2018 for reporting on the protests,

 

J. whereas Sudan was ranked 174th out of 180 countries in the Reporters Without Borders World Press Freedom Index 2017,

 

K. whereas Sudan’s National Intelligence and Security Service has repeatedly been accused of taking actions against the rights to freedom of expression, association and assembly, which are guaranteed by the Constitution of Sudan and international human rights treaties to which Sudan is a party,

 

L. whereas the International Criminal Court has issued arrest warrants for the Sudanese President Omar Hassan Ahmad Al Bashir on 4 March 2009 and on 12 July 2010,

 

M. whereas during the first – ever mission to Sudan by its Subcommittee on Human Rights on December 2017 Sudanese government expressed willingness to re-engage with the international community,

 

N. whereas human, civil and political, rights continue to be repressed in Sudan,

 

1. Expresses its deep concern regarding an ongoing pattern of abuse of human rights in Sudan and a lack of progress in re-engagement with the international community,

 

2. Urges the Sudanese government to stop immediately the violations of the rights to freedom of expression, association and assembly of political opposition parties and human rights defenders; Calls to respect and protect fundamental human rights of all in Sudan, including national, ethnic and religious minorities,

 

3. Condemns the arbitrary arrest of Salih Mahmoud Osman, the Sakharov Laureate and urges the Sudanese authorities to immediately release him as well as all detainees and ensure their prompt access to lawyers and to due process and fair trial before an independent and impartial court,

 

4. Strongly condemns the practice of torture and ill-treatment towards any detained person and calls on Sudanese authorities to investigate all cases, and bring perpetrators to justice,

 

5. Calls on the Sudanese government to bring its national legislation into conformity with Sudan’s international human right commitments and to ratify the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment,

 

6. Calls on the Sudanese authorities to end its arbitrary confiscation of newspapers, harassment and imprisonment of journalists, and reasserts its belief that the media has an essential role in informing the public,

 

7. Restates its demands that Sudanese President Omar al-Bashir complies with international law in accordance with the conventions and treaties to which it is party, and supports the role of the International Criminal Court in pursuing the charges of war crimes, crimes against humanity and genocide against him;

 

8. Instructs its President to forward this resolution to the Council, the Commission, the EEAS, the High Representative of the Union for Foreign Affairs and Security Policy/Vice-President of the European Commission, the parliaments and governments of the Member States, the African Union, and the President and Government of the Republic of Sudan.
