  Le Président. – Nous poursuivons donc le débat sur le rapport de MM. Corbett et Méndez de Vigo sur le traité établissant une Constitution pour l'Europe.

  Costa, António (PSE). Senhor Presidente, Senhor Vice-Presidente da Comissão, o novo Tratado é um avanço positivo do ponto de vista institucional, como todos têm sublinhado. Com o novo Tratado teremos uma União mais forte, mais eficaz, mais democrática e mais próxima dos cidadãos. Mas uma Constituição é, antes de mais, uma comunhão de valores e um projecto político. Desde logo com a constitucionalização da Carta dos Direitos Fundamentais, visando uma sociedade que se vê como uma economia social de mercado e onde se visa o pleno emprego.

Não são meras palavras. São os novos objectivos da União consagrados no artigo 3° da parte primeira do Tratado e que devem enquadrar todas as suas acções e políticas. Assim, por exemplo, no artigo 185° da Parte III sobre a política monetária, expressamente se consagra que, sem prejuízo do objectivo da estabilidade dos preços, o Sistema Europeu de Bancos Centrais apoia as políticas económicas gerais da União para contribuir para a realização dos seus objectivos tal como definidos no artigo 3° da Parte I.

Especial destaque justificam as cláusulas de aplicação horizontal que enquadram as acções e políticas da União previstas na Parte III do Tratado. Nos artigos 115° a 122° da Parte III, as diferentes políticas da União devem respeitar a promoção da igualdade entre os homens e as mulheres, a protecção do ambiente e dos consumidores, os direitos sociais, nomeadamente o emprego, bem como assegurar as condições necessárias para os serviços públicos ou de interesse económico geral desempenharem as suas missões.

Estes exemplos ilustram como o novo Tratado reforça o modelo social europeu, não consagrando qualquer recuo quanto ao adquirido e consagrando novos e importantes avanços. É, por isso, uma boa notícia para a reafirmação da vontade que temos de viver na sociedade com elevada protecção social e elevados valores ambientais.

  Malmström (ALDE). Herr talman! Fru kommissionär, kära kolleger! För fem år sedan var vi några i detta hus som ville återuppväcka Spinellis Crocodile Club. Vi startade då en federalistisk tvärpolitisk grupp med syfte att arbeta för en europeisk författning.

Det var många som log lite överseende då. Hemma i mitt land, Sverige, blev jag klappad på huvudet när jag talade om behovet av en gemensam text som tydligt slår fast vad vi står för, varför vi gör det och hur vi arbetar. Idag är det ingen som skrattar längre och att tala om en europeisk författning är inte särskilt kontroversiellt. De flesta är för.

Genom konventet och hårt arbete, inte minst här i Europaparlamentet, har vi idag ett förslag till europeisk författning. Det är ett fantastiskt framsteg och det gör EU mer öppet, mer demokratiskt, mer handlingskraftigt, sätter medborgaren i centrum och förenklar beslutsfattandet. Richard Corbetts och Íñigo Méndez de Vigos resolution redogör på ett mycket bra och pedagogiskt sätt för fördelarna med den nya författningen och är ett dokument som faktiskt kan användas i kampanjen, då det är så pedagogiskt skrivet.

Visst kunde mycket ha varit bättre, många kolleger har talat om det här. Personligen hade jag gärna sett en tydligare avgränsning av EU:s befogenheter. Det hade varit rimligt att med så många medlemmar koncentrera sig på något färre frågor på EU­nivå, för att kunna vara effektivare där. Jag hade också gärna sett att den permanenta ordföranden inte var placerad i rådet utan i kommissionen.

Slutligen beklagar jag att konventet inte diskuterade frågan om Europaparlamentets säte. Vi måste upphöra med detta pendlande mellan Strasbourg och Bryssel. Det är dyrt och ineffektivt och så länge det pågår kommer medborgarna aldrig fullt ut att känna förtroende för denna institution.

Det kommer att komma nya tider, vi kommer att kunna få in nya reformer och kunna gå ytterligare steg i framtiden för nästa konvent och nästa författning. Först skall denna ratificeras och på det stora hela är det ett mycket bra förslag. Det är ett framsteg för europeisk demokrati och för våra medborgare.

Motståndarna skall betänka att alternativet är Nicefördraget, som på inget sätt ökar demokratin inom EU. Det gör det heller inte lättare för oss att samarbeta med så många medlemmar. Jag ser därför med stor entusiasm fram emot den debatt som nu kommer och redan pågår i de olika medlemsländerna och emot att vara ute på gator och torg tillsammans med er och försvara den europeiska författningen.

  Staes (Verts/ALE). Voorzitter, collega's, mevrouw de Commissaris, samen met de Vlaamse Groenen zal ik de komende maanden campagne voeren voor een Belgische ratificatie van de grondwet in het federale, het Vlaamse en het Brusselse parlement. Morgen stemmen wij echter niet over de grondwet, maar over het verslag van de collega's Corbett en Méndez de Vigo en wat mij betreft, is dit een ontgoochelend verslag. Het is een apologie, een te eenzijdige opsomming van de vele pluspunten van de grondwet. Wat een gemiste kans, mijnheer Corbett!

Hadden we niet beter rekening gehouden met de kritiek, die nu ook ter linker zijde wordt geuit? Waarom, bijvoorbeeld, mag niet worden gezegd dat we nog op weg zijn naar een volwaardige Europese democratie, dat de rol van de constitutionele regio's ondergesneeuwd is, dat nog teveel beleidsterreinen worden overgelaten aan intergouvernementele samenwerking, dat op nog teveel gebieden het veto geldt? Waarom mag niet worden gezegd dat het de Europese Unie nog teveel ontbreekt aan een sociale orde en dat zij te neoliberaal georiënteerd is?

Daarom, collega's, vraag ik jullie om de amendementen van de Fractie de Groenen, met name de amendementen 4, 9, 15 en 16, nog eens goed te bekijken en tijdens de stemming morgen wellicht te ondersteunen.

  Figueiredo (GUE/NGL). Senhor Presidente, das diversas razões da nossa oposição a este novo Tratado destaco o reforço do centralismo, do federalismo e da burocracia europeia, a insistência em políticas que se tornam únicas para todos os Estados que são membros da União, independentemente das suas situações concretas, o aprofundamento do neoliberalismo e da militarização da Europa.

As imposições cegas do Pacto de Estabilidade, do Banco Central Europeu e das políticas monetária e cambial únicas nos países da zona euro, independentemente da situação de cada país, têm como resultado o agravamento da situação social, o aumento das desigualdades decorrentes das privatizações de sectores estratégicos e de serviços públicos, acompanhadas de ataques sérios aos direitos de quem trabalha.

Também conhecemos a prática destas políticas neoliberais na agricultura, nas pescas e na política de comércio externo, com retrocessos económicos, o desemprego e a destruição da produção de cada vez mais vastos sectores dos países de economia mais frágil. Mas não podemos igualmente estar de acordo com uma campanha de promoção do novo Tratado, pouco democrática e nada pluralista, baseada nos argumentos dos apoiantes, esquecendo as razões dos que são contra, porque lutam por uma Europa social mais democrática, baseada no princípio de Estados soberanos e iguais em direitos e empenhada na paz.

  Lundgren (IND/DEM). Herr talman! Ärade ledamöter! En författning skall fastlägga politikens spelregler och de rättigheter som tillkommer medborgarna i en demokrati. En författning skall inte fastslå politikens innehåll. Socialpolitik, skatter, energipolitik, polisväsende, alkoholfrågor skall medborgarna utforma tillsammans i den demokratiska processen i varje land. När folkviljan ändrar sig skall dessa förhållanden kunna ändras i landet.

Det förslag vi nu ställs inför är något helt annat. Det är ett uttryck för den politiska klassens egna ambitioner för det europeiska projektet. Det reglerar i detalj, det behandlar turism och jordbruk, det legitimerar ett korporativt samhälle, det tvingar in varje medlemsland i en valutaunion, det pekar mot maktkoncentration och ett teknokratstyrt Europa.

Det som här presenteras som en författning är ett försök av det politiska etablissemanget att usurpera de europeiska folkens demokratiska rätt att forma sin egen framtid. Därför säger Junilistan nej till detta förslag.

  Toubon (PPE-DE). Monsieur le Président, mes chers collègues, l'entreprise de construction européenne a créé le plus grand espace de droit et de liberté économique qui existe au monde, mais l'organisation de notre continent ne peut s'en tenir là. L'Europe doit devenir un acteur politique, une entité politique dotée de pouvoir démocratique et de puissance diplomatique. Nous voulons une Europe des États et des peuples et, par conséquent, renforcer la confiance des citoyens dans l'Union européenne. C'est bien ce que propose la Constitution signée à Rome.

Je félicite de nouveau nos rapporteurs, MM. Corbett et Méndez de Vigo, en soulignant les progrès réalisés par le nouveau traité. Les rapporteurs adressent à nos concitoyens un message clair: la Constitution est bonne, c'est le meilleur texte possible. Elle propose une Europe plus intégrée, plus efficace, plus politique, plus à l'écoute des citoyens, plus forte à l'intérieur et à l'extérieur. La Constitution, pour autant, n'augmente pas les compétences de l'Union. Elle empêche l'émergence d'un super État centralisé; elle consacre la personnalité juridique de l'Union; elle se donne un visage, un président pour une longue durée et un ministre des affaires étrangères; elle garantit à tous nos concitoyens la protection de la Charte des droits fondamentaux. Le Parlement européen gagne du terrain sur la scène politique européenne et enfin, la Constitution facilite le recours aux coopérations renforcées qui permettent de faire face aux enjeux de l'avenir.

Aujourd'hui, le destin d'un pays de l'Europe est inscrit désormais dans l'affirmation de sa personnalité européenne. La Constitution représente la meilleure façon pour nos États d'affronter, dès aujourd'hui, l'avenir. Être unis sur un texte qu'ils ont tous approuvé est d'une grande ambition. C'est maintenant la volonté des hommes politiques et d'abord de nous­mêmes qui concrétisera cette ambition.

  Van den Berg (PSE). Voorzitter, voor de Nederlandse PSE-delegatie gaat het debat over de grondwet, het gaat er niet om of we voor of tegen Europa zijn. Wij zeggen kritisch ja, omdat het ons om de voordelen van de nieuwe grondwet ten opzichte van het verdrag van Nice gaat. Het Europa van Nice is onduidelijk over de reikwijdte van Europa. Het nieuwe verdrag garandeert echter de invloed van het regionale, het decentrale en zet het nationale parlement neer als waakhond, zonder dat er sprake is van een superstaat, wel van effectieve en grensoverschrijdende samenwerking tegen misdaad en veilig voedsel.

Daarnaast worden in de nieuwe grondwet meer dan dertig soorten besluiten vervangen door enkele voor de burgers goed herkenbare termen zoals wet en kaderwet. De grondwet brengt dus meer helderheid over het soort Europa dat wij willen en de besluitvorming die wij daarvoor gebruiken. Ook brengt de grondwet ons meer effectiviteit door een uitbreiding van het aantal terreinen waarop via gekwalificeerde meerderheid wordt besloten, zodat niet één land de hele zaak kan blokkeren. Er komt meer democratische verantwoording, doordat veel besluitvorming wordt weggehaald uit de achterkamertjes en de besluitvormende vergaderingen van Raad openbaar worden.

Tot slot brengt de grondwet ons meer rechten voor de burgers: sociale dialoog, de opname van het Handvest van de grondrechten en natuurlijk het burgerinitiatief. Wie deze belangrijke stap in het Europees integratieproces niet steunt, wordt wel verantwoordelijk voor het handhaven van het huidige, meer bureaucratische, tragere, onduidelijkere, en op veel punten ondemocratische verdrag van Nice.

Voorzitter, ons jaar is er wel een met een kritische kanttekening, want Europa met één stem ontbreekt nog te veel. Het sociaal Europa is nog te zwak verankerd, daarom een kritisch ja. Kortom, Voorzitter, de Nederlandse PSE-delegatie zegt kritisch ja tegen de grondwet. Die houding zullen we, gesteund door Johan Cruijff, Catalaans Nederlander of Nederlands Catalaan in Spaanse actie, rond het referendum in het voorjaar van harte uitdragen. Zo hopen we in Nederland steun voor dit nieuwe project, de nieuwe grondwet, te krijgen.

  Harkin (ALDE). Mr President, Ireland held two referenda on the Nice Treaty: in the first we voted 'No' and in the second we voted 'Yes'. There were many reasons for this, but an overriding one was that our government took its citizens for granted. The Irish had always voted 'Yes' to Europe, so this time they thought it would be the same. However, on this occasion, the politicians got it wrong. We have to learn from our mistakes and ensure that, this time, citizens have easy access to all the information they require.

I would go so far as to suggest that every household should receive a copy of the draft Treaty – certainly every household that requests one. This will be expensive, but it is well worth paying that price. Furthermore, I would very strongly support a suggestion to publish a document outlining, on the one hand, what is already in place in the existing Treaties and, on the other, outlining what is new, changed or different. Unlike the assertions from some speakers in this House today, this is not telling people what to do or how to think; it is giving our citizens a choice.

If you were sitting a public examination in Ireland, you might be asked to compare and contrast. This is what we need to do: to assess if what we now have is an improvement or otherwise. In spite of the scathing references of many eurosceptics, I do not claim this draft Constitution to be the Holy Grail or the Second Coming, but it is a positive step forward for Europe and one that I will support.

I have many reasons for saying this, but time allows me to mention just one today. This Treaty brings the EU closer to its citizens. For example, a million citizens' signatures can prompt the Commission to draft a proposal. That is people power! Just imagine the possibilities: citizens from Latvia, Spain, Ireland or Sweden, for example, finding common cause and demanding action. Surely, that is the possibility of a citizens' Europe!

  Smith, Alyn (Verts/ALE). Mr President, there are some things to admire in this Constitution but there are also many things to dislike. On balance my party has decided that it cannot recommend it to the people of Scotland, and accordingly will not be voting for the report.

We have a number of objections to the Constitution itself, but in the seconds remaining I will simply mention the inadequate subsidiarity provisions. Scotland is not independent yet, but the Scottish Parliament is already the only body responsible for justice, the environment, education, health and many other areas of Scottish life. The provisions in this Treaty for incorporating it into the EU law-making process are inadequate.

We have seen in the field of fisheries the disastrous consequences of EU legislation being inadequately sensitive to reality on the ground within the Member States or territories of the Union, and this Constitution will not sufficiently improve EU law-making for Scotland. More to the point, it does not take account of the dignity of my country. We cannot recommend it to the people of Scotland and will not be voting for it.

  Sinnott (IND/DEM). Mr President, I am from a country with a constitution that enshrines the truth about fundamental human rights: the truth that they are part of human nature and essential to human dignity; the truth that a supreme being, not a mere human institution, gave these rights to us – all of us without exception. In Ireland we have had governments which have neglected or even denied our rights, but under the shelter of our constitution, even the most vulnerable of us can demand them.

The EU Constitution expounds the false position that the EU creates all rights, even fundamental rights. Here, the EU is not the guardian of rights, but the giver.

I would not dream of supporting this Constitution. It has not grasped the simple and important truth of fundamental human rights. History tells us that when human institutions become the giver of rights, rights become gifts. They can be bestowed selectively, denied, or even take back. I will support the truth that the fundamental rights of the human person are from God. I will defend the Irish constitution against usurpation.

  Δημητρίου (PPE-DE). Κύριε Πρόεδρε, πρώτα απ' όλα πιστεύω ότι θα πρέπει να εκφράσουμε την ευγνωμοσύνη μας στα μέλη της Συνέλευσης για το Μέλλον της Ευρώπης που έχουν ετοιμάσει αυτό το Σύνταγμα και να συγχαρούμε ταυτόχρονα και τους αρχηγούς των κρατών μελών που προσυπέγραψαν το Σύνταγμα στις 29 Οκτωβρίου του 2004. Επίσης θα πρέπει να μην ξεχάσουμε τον Πρόεδρο της Συνέλευσης, τον κ. Ζισκάρ Ντ' Εστέν, τον οποίο πρέπει να ευχαριστήσουμε.

Δεν προτίθεμαι να επαναλάβω τα όσα έχουν λεχθεί υπέρ του Συντάγματος και ταυτόχρονα να πω τα όσα γράφονται στην έκθεση των εισηγητών και τα όσα έχουν πει οι εισηγητές. Υιοθετώ πλήρως τα όσα έχουν πει και τους συγχαίρω για την εξαιρετική έκθεση που έχουν καταθέσει. Συγχαίρω πραγματικά και τον κ. Corbett και τον κ. Méndez de Vigο.

Το συνταγματικό κείμενο για το οποίο συζητούμε οπωσδήποτε δεν είναι τέλειο. Αυτό έχει λεχθεί από όλους. Είναι όμως το καλύτερο που μπορούσε να υπάρξει με τα σημερινά πολιτικά δεδομένα. Δημιουργεί μια Ένωση πιο δημοκρατική και πιο λειτουργική και την καθιστά πιο αξιόπιστη και έγκυρη και στο εξωτερικό και στο εσωτερικό. Η Ευρωπαϊκή Ένωση καταγράφεται στην παγκόσμια ιστορία ως μια ένωση κρατών που αποσκοπεί στην εξυπηρέτηση αξιών. Επίκεντρο των συνταγματικών ρυθμίσεων ο άνθρωπος, ο Ευρωπαίος πολίτης, το άτομο. Η ανθρωπιστική αλληλεγγύη μεταφέρεται και σε κρατικό επίπεδο με τη διάταξη της υπεράσπισης κράτους μέλους σε περίπτωση επίθεσης εναντίον του. Αυτήν ακριβώς την αλληλεγγύη τονίζω στην τροπολογία που έχω καταθέσει και σας καλώ να την υπερψηφίσετε.

Η θέσπιση του Συντάγματος για την Ευρώπη είναι ένα μεγάλο βήμα μπροστά. Είναι ένας σταθμός στην πορεία προς το μέλλον. Εκείνοι που δεν πιστεύουν στην Ευρωπαϊκή Ένωση είναι φυσικό να βρίσκουν νομικίστικες αφορμές και πολιτικές προφάσεις για να απαξιώσουν το Σύνταγμα. Δικαιώμά τους! Οφείλουν όμως να σεβαστούν ένα πράγμα: ότι οι κυβερνήσεις τους, όλες οι κυβερνήσεις έχουν υπογράψει αυτό το Σύνταγμα. Γι' αυτό ανεξάρτητα από τις επιφυλάξεις και τις επί μέρους ενστάσεις που έχουμε, όλοι πρέπει να ενεργήσουμε και να εργαστούμε για την έγκριση αυτού του Συντάγματος, για την επικύρωσή του από όλα τα κράτη μέλη

  Pahor, (PSE). S podporo temu zares odličnemu poročilu ima Evropski parlament, prvič, veliko priložnost in, drugič, veliko odgovornost, da s tega mesta nagovori naše evropske sodržavljane k podpori evropske ustavne pogodbe. Naše sporočilo državljanom Evrope, ki jih tukaj predstavljamo, je, da je sprejetje evropske ustavne pogodbe zares izjemen korak naprej v razvoju našega skupnega evropskega doma, da je pravzaprav predpogoj njegovega vsestranskega napredka.

Gre za korak od evropske diplomacije k evropski demokraciji. Če bi se na žalost zgodilo, da zaradi teh ali drugačnih razlogov ta pogodba ne bi bila ratificirana, to za Evropo ne bi pomenilo samo stopicanja na mestu, temveč velik in nevaren korak nazaj. Ogrozilo bi naše stremljenje k taki in tisti prihodnosti, ki nima za cilj samo miru, ampak tudi gospodarski in socialni napredek, ki ima za svoj cilj, da demokratična Evropa ostane dejavna in vplivna članica mednarodne politike.

Danes imamo torej priložnost, da pošljemo to ohrabrujoče sporočilo o nenadomestljivem pomenu evropske ustavne pogodbe za bolj demokratično, bolj uspešno in bolj enotno skupnost državljanov in držav, ki je prvič v vsej zgodovini po mirni poti združila skupaj skoraj pol milijarde ljudi in v kateri je mesto tudi za majhne narode, kot je moj, slovenski, zato da lahko razvijejo svojo identiteto in v pogojih različnosti združijo moči z ostalimi, da skupaj ustvarimo naše cilje, na katerih želimo skupaj graditi to evropsko prihodnost.

  Wallis (ALDE). Mr President, I also wish to congratulate the rapporteurs. However, I would like to ask for more noise and excitement over the small clause, under 'participatory democracy', that deals with the citizens' right of initiative. This, above all, makes a reality of bringing Europe closer to its citizens. It builds on the right to petition, but much more than that it is a positive right that allows our citizens to begin to set the agenda.

In my own country, in comparison, citizens have no right of initiative, petitions languish on shelves, legislative initiatives rely on parliamentarians winning a ballot – it is a sort of game of chance – and even then the initiative will probably be talked out by colleagues, with the citizens having no real place. I am very proud that this nascent EU right offers much more: a real opportunity for our citizens to participate in and to move Europe. Let us therefore have a loud fanfare for this step towards direct democracy, European-style.

  Wierzejski (IND/DEM). Panie Przewodniczący! Wiemy, że Traktat Konstytucyjny jest zły. Jest to prawny bubel, przegadany, zideologizowany. Grube tomiszcze na kilkaset stron nie do przeczytania dla przeciętnego obywatela państw europejskich, przy tym napisany w duchu Rewolucji Francuskiej. Oświeceniowy, rewolucyjny, laicki. Nie ma w nim miejsca dla Pana Boga, nie ma w nim miejsca dla wartości tradycyjnych, europejskich, chrześcijańskich, rzymskich, greckich, łacińskich. Nie ma w nim miejsca dla tych wartości, które są dla nas cenne, takich jak naród, rodzina, życie ludzkie, wiara, tradycja. Są za to jakieś wartości laickie, socjalistyczne, durne, udziwnione jak cześć dla Matki Ziemi, chyba Gai. Prawa dla homoseksualistów, władza dla biurokracji brukselskiej. Na to naszej zgody nie ma i nie będzie.

Sprawozdanie, nad którym obradujemy, to sprawozdanie bałamutne, nieobiektywne, zwodnicze, propagandowe. Same pozytywy z Traktatu. A gdzie prawda? Wstyd! Za pieniądze obywateli państw członkowskich produkuje się i upowszechnia sprawozdanie tendencyjne, propagandowe - wyrzut sumienia Parlamentu Europejskiego. Wstydźmy się. Jak daleko musiała zajść rewolucja, żeby tak sponiewierać prawdę. Na szczęście Polska odrzuci ten Traktat. Mam nadzieję, że inne kraje również. Liga Polskich Rodzin i Grupa Niepodległość i Demokracja są przeciw przyjęciu sprawozdania. „Nie” dla Traktatu Konstytucyjnego.

  Schwab (PPE-DE). Herr Präsident! Zunächst einmal möchte ich sagen, dass ich mich meinem Vorredner nicht anschließen kann. Ich möchte den Konventsmitgliedern – und zwar allen – sehr herzlich für ihre Arbeit danken. Ich freue mich als junger Abgeordneter, dass der Beitrag der EVP-Fraktion in diesem Europäischen Konvent besonders stark war. Ich darf da vor allem Erwin Teufel, Elmar Brok und Joachim Wuermeling nennen, aber ich möchte ausdrücklich allen Beteiligten sehr herzlich für ihre Arbeit bei diesem wichtigen Schritt für die Zukunft Europas danken.

Als umso unerfreulicher habe ich es empfunden, dass der Rat relativ schnell nach dem Ende dieser demokratischen Arbeit im Konvent deren Ergebnis in einem Schnellverfahren nochmals in seinem Sinne überarbeitet hat. Ich finde es schade, dass der demokratische Charakter der Konventsarbeit dadurch etwas beschädigt wurde. Nichtsdestotrotz unterstütze ich die Verfassung und glaube nicht, dass sie aufwändige Erläuterungen benötigt, wie der Vorredner gesagt hat, sondern dass sie ein klares, transparentes Europa schafft, das näher an die Bürgerinnen und Bürger heranrückt.

Ich glaube – wenn Sie mir erlauben, auf einen Punkt genauer einzugehen –, dass ein Aspekt der Verfassung, der einen wichtigen Fortschritt darstellt, darin besteht, dass uns die Zusammenarbeit zwischen dem Europäischen Parlament einerseits und den nationalen Parlamenten andererseits auch näher mit den nationalen Parlamenten zusammenbringen wird und wir hier genauer sehen können, wie die Gesetzgebung, für die wir oftmals nur den Rahmen vorgeben, in den Nationalstaaten direkt umgesetzt wird. Hierfür ist besonders hilfreich, dass wir eine klare Kompetenzverteilung zwischen der nationalen und der europäischen Ebene haben, und das Frühwarnsystem im Hinblick auf die Subsidiaritätskontrolle wird auch hier positive Konsequenzen mit sich bringen.

Ich hoffe also, dass wir durch diese Regelungen der klareren und transparenteren Kompetenzstruktur sowie durch das Frühwarnsystem zur Subsidiaritätskontrolle zu einer effektiveren und noch besseren Zusammenarbeit mit unseren nationalen Kollegen kommen, um damit die Gesetzgebung in Europa noch transparenter zu gestalten.

  Carnero González (PSE). Señor Presidente, toda comunidad en la que no esté estipulada la separación de poderes y garantizada la seguridad de derechos necesita una Constitución. Lo decía la Declaración de Derechos del Hombre y del Ciudadano de 1789.

Hemos querido seguir la senda que hace más de dos siglos condujo a la libertad de los pueblos y de las gentes y, por eso, con esta Constitución europea vamos a tener más y mejor Europa. Gracias, sobre todo, al esfuerzo de la Convención y, finalmente, al acuerdo de la Conferencia Intergubernamental, contaremos con una Constitución que significará una refundación jurídica y sobre todo un relanzamiento político de la Unión, con lo que ésta estará en condiciones de responder a los tres grandes retos del siglo XXI: intervenir en la globalización para democratizarla, contribuir a la construcción de un orden internacional justo y democrático y, desde luego, responder a las demandas de la gente.

Con esta Constitución recuperamos el impulso del Tratado de Maastricht, superamos el fracaso del Tratado de Niza y ponemos al mismo nivel, en tiempo real, ampliación y profundización.

Desde luego, con esta Constitución la Unión tendrá más legitimidad, más valores, más derechos, más democracia y más eficacia en la Política Exterior y de Seguridad Común; en la Política Europea de Seguridad y Defensa; en el Espacio de libertad, seguridad y justicia; y, también, en la Europa social. Quiero subrayar aquí el apoyo de la Confederación Europea de Sindicatos a la Constitución europea, que me parece verdaderamente fundamental e importante.

Habrá que mejorar y, desde luego, aplicar y desarrollar ambiciosamente esta Constitución en su momento. No hay Constitución perfecta, pero no es mejorable ninguna Constitución que no entre en vigor. Por eso tenemos que conseguir su ratificación en tiempo y forma, correctamente. Y todo eso lo haremos con mayorías suficientes para seguir avanzando.

Esta es una Constitución ciudadana que debe ser sentida como tal. En España, el día 20 de febrero tenemos una cita con un referéndum, con dos buenas amigas: Constitución y Europa. No faltaremos a la cita.

  Ludford (ALDE). Mr President, we face many myths and red herrings as we try to promote the debate on the EU Constitution. Mr Corbett and Mr Méndez de Vigo have done an excellent job in their clear and straightforward explanation and advocacy of its merits. Mr Corbett, I shall probably borrow your wording for a pamphlet in my constituency, but this is in a common good cause.

One of the red herrings put around is whether to call the document a 'constitutional treaty' or a 'constitution', but, as the authors say, this is a sterile debate. It is a treaty in form, but a constitution in substance. Why are so many people, at least in my own country, Britain, so frightened of the word constitution? Every club, every society has one. In fact the UK itself has one, even though it has never been written down all in one place – unfortunately!

The greatest benefits of the new Constitution are that, on the one hand, it constrains the EU, but on the other, it liberates it. The powers of the European Union will be constrained by strengthened rules on limits to competence, on parliamentary scrutiny, on democratic accountability and the definition of citizens' rights vis-à-vis the administration. But the Union will also be freed up to act more effectively on the domestic and external challenges we face. Domestically, this is most striking in the case of justice and home affairs. We will be able to act more decisively to manage our borders and immigration and to tackle serious crime, as our citizens want us to do.

We will also be able to act more effectively abroad. What an impact it would have made on our public opinion, as well as on the disaster effort, if it had been, for example, a French aircraft carrier with German helicopters and British marines assisting in Aceh in Indonesia, and not just American ones.

Some claim to see in the Charter of Fundamental Rights – which will become legally binding – a threat. I see it as an opportunity. The anti-Europeans have to understand that it will sometimes act in the sense of constraining the EU institutions and giving redress against abuse of powers by them. There is therefore no reason for people to fear and every reason to welcome the Constitution – and indeed this report.

  Sudre (PPE-DE). Monsieur le Président, Madame le Commissaire, mes chers collègues, le projet de Constitution européenne fait du citoyen européen un acteur majeur de la construction d'une Europe unie. Il sera soumis à l'approbation de nos pays; la Hongrie et la Lituanie lui ont déjà dit oui et nous nous en réjouissons.

Sous forme d'un document unique plus lisible que les traités actuels, la Constitution réaffirme la double légitimité d'une Union d'États et de citoyens. Le Conseil de ministres se prononcera à la majorité qualifiée dans un plus grand nombre de domaines. La Présidence du Conseil européen se stabilisera avec un mandat de deux ans et demi. La Commission verra le nombre de ses membres réduit et sa coordination renforcée. Au plan extérieur, la désignation d'un ministre européen des affaires étrangères permettra enfin à l'Europe de parler d'une seule voix hors de nos frontières communes. Le drame du raz-de-marée en Asie du Sud-Est illustre une nouvelle fois l'importance d'une telle visibilité et d'une coordination accrue de l'action de l'Europe dans le monde.

Le président en exercice du Conseil et Mme le Commissaire ont détaillé les progrès démocratiques représentés par le projet de Constitution européenne. La Constitution permettra également aux Européens d'outre-mer de faire valoir leurs atouts particuliers et de contribuer à l'émergence d'une nouvelle frontière active de l'Europe, vitrine avancée du progrès dans la solidarité et la diversité.

Les citoyens européens ont tout à gagner à approuver la ratification de la Constitution européenne. Ils en deviendront les acteurs majeurs et permettront à l'Union européenne de mieux fonctionner avec plus de clarté, plus de transparence, tout en établissant une répartition équilibrée et stable des pouvoirs des différents niveaux de décision: européen, national et régional.

  Hutchinson (PSE). Monsieur le Président, à l'instar de notre groupe, la délégation socialiste belge votera pour ce rapport, qui apporte son soutien à un texte qui constitue une étape importante sur le chemin de la construction européenne.

La décision que prendra le Parlement sera capitale, sur les plans démocratique et politique, pour les débats qui seront menés dans le cadre des processus de ratification.

En ce qui nous concerne, ce sera "oui", encore que ce "oui" ne sera pas définitif, mais génésiaque: en d'autres termes, un "oui" de lutte qui doit être un début et non un point final. Ce sera "oui", car comme beaucoup d'entre nous l'ont rappelé, ce traité présente des avancées significatives. Comment ne pas se réjouir en effet de ce que le traité constitutionnel accorde à notre Parlement des pouvoirs nouveaux et accrus, imposant ainsi un débat démocratique au sein de la seule institution européenne dotée de la légitimité du suffrage universel? Comment également ne pas être d'accord avec l'intégration de la Charte des droits fondamentaux dans le corps du traité constitutionnel? Ce sera un "oui", mais un "oui" initiateur et revendicatif.

En matière de prise de décisions par le Conseil de ministres, il n'aura pas échappé au lecteur attentif que si la règle de la double majorité a été étendue, celle de l'unanimité est maintenue pour certaines décisions cruciales, au nombre desquelles figurent les décisions relevant des domaines social et fiscal. De la même façon, certains d'entre nous appréhendent mal le fait qu'une Constitution contienne et fige dans son texte une partie programmatique avec laquelle nous ne pouvons pas être tous d'accord.

Ce texte n'est pas parfait. Faire avancer les choses dans certaines matières sociales ou fiscales sera difficile, mais pas plus difficile qu'aujourd'hui. L'important est de prendre conscience que cette Constitution n'est qu'une étape de la construction européenne. Elle n'a de sens que si elle est annonciatrice d'un projet d'avenir ambitieux où tous les citoyens européens, à commencer par les moins nantis, puissent entrevoir et espérer une amélioration de leurs conditions de vie. Plus que sur la Constitution, l'Union sera jugée sur les actes subséquents qu'elle posera ou ne posera pas, sur sa force et sa volonté politique de rencontrer ou de ne pas rencontrer l'espoir des Européens de réaliser ou de ne pas réaliser l'Europe sociale, l'Europe des gens. En ce qui nous concerne, c'est cela qui doit rester la priorité.

  Stubb (PPE-DE). Mr President, this is a day of celebration for Europe and for the European Parliament. It has taken over 20 years to construct this Constitution but we are getting very close.

I will vote for this report and for the Constitution for three simple reasons. Firstly, this Constitution was prepared in an open and democratic way. I have been a civil servant for ten years and I have been involved in negotiating three intergovernmental conferences, including the Amsterdam Treaty, the Nice Treaty and this one. I can guarantee that had this been an intergovernmental conference from beginning to end, we would never have had this Constitution. But because we had a Convention, we most certainly got one.

Secondly, this Constitution is a good thing. There are 448 reasons for it, all of which are in the Treaty as articles. There are three key issues: firstly, it makes the European Union more democratic; secondly, it makes it more effective and, thirdly, it makes it much more understandable.

Thirdly, I will vote for this report because it is very good. I urge anyone who has not read it from beginning to end to have a look at it, because it simplifies and clarifies the Treaty in a magnificent way. I wish to congratulate Mr Corbett and Mr Méndez de Vigo, who are both at present speaking on their mobile phones – I hope they are Nokias! – on their excellent report.

If I were to bring up just one thing from the Treaty, it would be on external relations. Just reflecting on what happened in Asia, if we had had a president, a foreign minister, a common security policy, a defence system, a better crisis management system, then together we would have got much further.

Finally, I would urge each and every Member to go home and defend this Treaty. That is most certainly what I will do.

  Beňová (PSE). Vážený pán predsedajúci, pani komisárka Wallström, milí hostia na balkóne, ctené kolegyne a kolegovia. Dnešná diskusia je z môjho pohľadu najdôležitejšou diskusiou nielen tohto volebného obdobia, ale v histórii Únie všeobecne. Ústavná zmluva je totiž historickým medzníkom a najmä emancipačným momentom Európskeho spoločenstva.

Samotný fakt, že v tomto pléne sedia zástupcovia dvadsiatich piatich národných štátov a diskutujú vo svojich národných jazykoch, je dobrým dôkazom schopnosti rovnocenného spolužitia a rešpektovania spoločných hodnôt. Prvého mája minulého roku ste nás tu, teda veľká väčšina z vás, spoločne privítali, a my sme si to, teda veľká väčšina z nás, úprimne vážili. Dnes už všetci spolu rozhodujeme o prijatí spoločného primárneho jednotného právneho rámca rešpektujúceho práve tie hodnoty, ktoré nám umožnili rozšíriť vaše rady.

Vážim si, že ste na nás počkali a je mi osobne cťou, že môžem svoj hlas pridať, pretože ústavnú zmluvu vnímam aj ako etický a morálny rámec Európanov posilňujúci našu spoločnú historickú identitu, ale zároveň rešpektujúci postavenie jednotlivých národných štátov a patriotizmus ich občanov. Aký významnejší dokument môžeme našim občanom zabezpečiť? Veď ústavou posilníme aj ich vplyv na politické rozhodnutia a zabezpečíme im možnosť výraznejšej kontroly.

Pozorne som počúvala aj výhrady odporcov a chcem veľmi úprimne povedať, že ústava je kompromisom, ale prijímanie kompromisov je veľkou prednosťou všetkých rozumných, zodpovedných a tolerantných ľudí. Európska ústavná zmluva nám otvára nové horizonty a významne emancipuje Európsku úniu aj v rámci medzinárodnej politiky. Verím, že hlasovaním o ústavnej zmluve vyšleme jasný a pozitívny signál nielen do vnútra Európy občanom národných štátov, ale aj do celého sveta, signál o našom odhodlaní žiť spoločne v mieri a solidarite.

  Andrikienė (PPE-DE). Šiame Parlamente atstovauju piliečius valstybės, kuri jau ratifikavo Europos Sąjungos Konstituciją. Lietuva pirmoji iš Europos Sąjungos valstybių narių praėjusių metų lapkričio 11 dieną, praėjus vos porai savaičių po jos pasirašymo Romoje ratifikavo šį dokumentą. Tiesa, sprendimas buvo priimtas ne piliečių referendume, o viename paskutinių kadenciją baigiančio Parlamento posėdžių. Tiesa ir tai, kad Europos Sąjungos Konstitucija Lietuvoje buvo ratifikuota be išsamių diskusijų apie šio dokumento nuostatas, kurios turėtų būti žinomos, ar bent jau nesvetimos Lietuvos piliečiams visų pirma tam, kad jie galėtų pasinaudoti Europos Sąjungos Konstitucijos teikiamomis galimybėmis. Kodėl, aš manau, reikia balsuoti už šios Konstitucijos retifikavimą Europos Parlamente?

Pirma. Taip, iki 2009 metų mes galime gyventi pagal Nicos sutartį, bet jau seniai akivaizdu, kad išsiplėtusi Europos Sąjunga negali efektyviai veikti be reikiamų institucinių pakeitimų, be naujo efektyvaus funkcijų atsakomybių pasidalijimo tarp Europos Sąjungos institucijų, o taip pat tarp Europos Sąjungos ir valstybių narių, tarp Europos Parlamento ir nacionalinių parlamentų. Europos Sąjunga negali gerai veikti be efektyvaus sprendimų priėmimo mechanizmo, be aktyvesnio piliečių dalyvavimo, be aiškios ir skaidrios Europos Sąjungos institucijų atskaitomybės piliečiams. Tai akivaizdu kaip ir tai, kas parašyta kaip Mendes de Vigo ir Corbett pranešimo moto - suaugęs žmogus negali dėvėti vaiko drabužėlių, kuriuos jis seniai išaugo.

Antra. Europos Sąjunga siekia tapti vienas konkurencingiausių ir dinamiškiausiai beisvystančių pasaulyje regionų. Manau, kad siekiant šio tikslo yra svarbu ne tik teisingai suformuluoti Europos Sąjungos plėtros prioritetus ir užtikrinti būtiną ir pakankamą jų finansavimą, bet ir pasiekti, kad Europos Sąjungoje būtų tvarka visų pirma instituciniu požiūriu.

Aš baigiu, Pirmininke. Aš taip pat norėčiau, kad Europos Sąjungos Konstitucijos preambulėje būtų įrašyta nuostata apie Europos Sąjungos krikščioniškąsias šaknis. Nepaisant to, kad tos nuostatos ten nėra, balsuosiu už šio netobulo, bet pakankamai gero dokumento ratifikavimą. Ačiū.

  Rouček (PSE). Dámy a pánové, evropská Ústavní smlouva je dalším významným krokem ve vývoji evropské integrace. Vytváří předpoklady, aby Evropská unie po svém rozšíření mohla působit jako rozhodující faktor evropského vývoje a samozřejmě také mohla účinně ovlivňovat i vývoj ve světě.

Přínos evropské Ústavní smlouvy vidím mimo jiné v tom, že přibližuje Unii občanům, rozšiřuje práva občanů Evropské unie, zařazuje do primárního práva Chartu základních práv, zjednodušuje právní systém, nahrazuje jediním textem dosavadní hlavní evropské smlouvy. Dále Ústava posiluje demokratický charakter Unie, zvyšuje mimo jiné roli Evropského parlamentu a také roli parlamentů členských států. Vytváří podmínky pro efektivní rozhodování Evropské unie a také vyjasňuje pravomoci Evropské unie ve vztahu k členským státům. A mimo jiné, což je velmi důležité i ve světle událostí v jihovýchodní Asii, posiluje rovněž schopnost Unie jednat jako soudružná a sjednocená síla v mezinárodním společenství.

Ze všech těchto i mnoha dalších důvodů, na které zde není čas je vyjmenovat, sociální demokracie včetně české sociální demokracie, kterou zde zastupuji, návrh Ústavní smlouvy v hlasování jednoznačně podpoří. Pokud jde o moji mateřskou zemi Českou republiku, situace s ratifikací evropské Ústavy nebude jednoduchá. Proti evropské Ústavě se staví nejenom komunisté, ale také konzervativní pravice, zastoupená zde v Evropské lidové straně.

Chtěl bych proto vyzvat pana Poetteringa a další předáky Evropské lidové strany, vidím zde například pana kolegu Karase, přijeďte do České republiky a pomozte proevropským českým silám ratifikovat evropskou Ústavu. Občanská demokratická strana, kterou jste si vzali do svých řad, za vás tuto práci neudělá. Děkuji.

  Esteves (PPE-DE). Senhor Presidente e Senhores Deputados, o mundo real em que vivemos está ainda longe de ser justo e exige, por isso, a alteração dos modelos políticos da tradição.

O que há de novo e fascinante na Constituição Europeia é a ligação entre o reconhecimento de um sistema comum de valores, os valores democráticos e dos direitos do Homem, e o reconhecimento de um sistema comum de autoridade; é esta notável ligação entre um projecto de justiça e um método de partilha política no preciso sentido que já assinalava o grande filósofo Immanuel Kant.

É por isso que a Constituição Europeia é, ao mesmo tempo, um acto de transformação política e um acto de transformação moral. Porque não se basta com o reconhecimento comum dos valores fundamentais, mas decide partilhá-los em acto, porque dá lugar à norma em vez da negociação permanente, porque afirma a soberania dos direitos e a sublime dignidade do Homem como razão e fim das políticas europeias, porque articula um programa de justiça global que transcende os nacionalismos e complementa a eficácia das constituições internas dos Estados, porque congrega a identidade política moderna europeia num sistema de valores universais que recebe todas as outras identidades, porque representa o sentimento de pertença a um mundo cosmopolita e antropocêntrico, porque é o sinal de partida para uma liga de povos numa ordem mundial mais racional e mais equilibrada, porque é a pátria constitucional em que nesta Europa se reconhecem todas as pátrias, no sentido de uma nova Europa.

Dirijo hoje uma carta ao Presidente do Parlamento Europeu e à Senhora Comissária para as relações institucionais no sentido da criação de um canal de TV que transmita a tempo inteiro, para todos os países da União Europeia, os trabalhos do Parlamento e os futuros trabalhos públicos do Conselho Europeu.

Finalmente a minha homenagem aos relatores de Vigo e Corbett.

  Kristensen (PSE). Hr. formand. De beslutninger, der er blevet truffet af stats- og regeringscheferne på Laeken-topmødet, har vist sig at få endnu større betydning, end nogen havde forudset på daværende tidspunkt. Hele debatten i dag har ganske tydelig vist det. Hvad var det, der drev regeringscheferne på Laeken-topmødet? Det var i realiteten to ting. Dels ønskede de et EU, der fungerede bedre, og dels ønskede de et EU, som kunne sikre, at vi også kunne fungere, når udvidelsen var blevet en realitet. Når vi har ændret samarbejdsmetoderne i det europæiske, er det normalt foregået i en lukket proces, bag lukkede døre, hvor Europas befolkning er vågnet en morgen for at konstatere, at nu havde toppolitikere endnu engang ændret samarbejdsbetingelserne. Men sådan gik det ikke denne gang. Der blev nedsat et konvent, som jeg havde selv fornøjelsen af at deltage i. Jeg synes, at arbejdet dér var spændende, men det satte også et nyt mål for, hvordan vi i fremtiden skal lave ændringer i Europa: fremover skal det ske i en åben proces.

Nu står vi så med et forslag til en ny forfatningstraktat, som vi skal diskutere med borgerne, og for mig er der i hvert fald følgende afgørende punkter, som jeg gerne vil fremhæve. For det første får vi med den nye forfatningstraktat værdier ikke blot hvad angår demokrati og menneskerettigheder, men også miljø og social ansvarlighed, skrevet ind i vores forfatningstraktat. For det andet sikrer vi med den nye forfatningstraktat, at princippet om åbenhed og demokrati, som man må forvente respekteret i et moderne samarbejde, også finder anvendelse i det europæiske samarbejde. Jeg har som medlem af ministerrådet ofte undret mig over, at den europæiske befolkning ikke måtte vide, hvad jeg stemte som minister, når vi nåede dertil, at der skulle træffes beslutninger. Nu får vi en moderne forfatningstraktat med åbenhed. Endelig sikrer vi, at de folkevalgte via Europa-Parlamentet får større indflydelse. Det er alt i alt et godt produkt, som vi har drøftet i dag og som vi skal anbefale den europæiske befolkning.

  Dionisi (PPE-DE). Signor Presidente, colleghi, la sfida che l'Europa affronterà nei prossimi mesi è fondamentale per la costruzione dell'Unione. I cittadini e i parlamentari di tutto il continente sono chiamati ad approvare un'unica Carta fondamentale che sancisce e rafforza i valori su cui questa Unione si fonda: pace, prosperità, democrazia, giustizia, libertà e solidarietà.

Il nuovo Trattato costituzionale, certo non rappresenta il massimo delle nostre aspirazioni, ma la sua stessa esistenza costituisce un evento politico e storico senza precedenti, impensabile fino a qualche anno fa.

Il testo che approveremo rafforza la legittimità democratica delle Istituzioni europee e le rende più vicine ai 450 milioni di donne e di uomini che di questa Unione fanno parte. Infatti, la Costituzione conferisce maggiori poteri ai parlamenti nazionali e al Parlamento europeo, in termini sia legislativi che politici: anche i nostri cittadini avranno più voce nel processo democratico grazie al più stretto legame fra Istituzioni comunitarie e comunità locali, parti sociali e associazioni.

Il nostro dovere, in quanto rappresentanti eletti è rendere questa partecipazione autentica, proficua e reale. L'Europa rafforzerà così il proprio ruolo come attore sulla scena globale.

Questa è la sfida fondamentale: abbiamo il dovere e la responsabilità di costruire un'Unione capace di parlare con un'unica voce sulle questioni internazionali. Infine, l'identità culturale: noi come rappresentanti dell'unione dei democratici cristiani, malgrado il rammarico per l'assenza di un riferimento alle radici cristiane su cui la nostra Unione innegabilmente si fonda, siamo strenui sostenitori della ratifica di questo testo.

Nelle prossime settimane il Parlamento italiano procederà alla ratifica; sarà un voto positivo, di stimolo verso gli altri paesi in cui il valore dell'Europa non è sentito come in Italia. Il nostro Paese, il nostro governo, il nostro partito, erede di quegli uomini che hanno segnato e fondato l'Europa contribuiranno all'esito positivo del processo di ratifica per una realizzazione piena degli ideali in cui noi democratici cristiani abbiamo sempre creduto.

  De Rossa (PSE). Mr President, I wish to begin by congratulating the rapporteurs on this report, which adds clarity and weight to the debate. I was one of the 200 parliamentarians who participated in the Convention and produced the Convention text, which the IGC subsequently took on board to a very large degree.

I doubt whether any Member State constitution has ever been prepared in such an open and democratic way. I doubt that there is a constitution in any of the Member States which achieved the kind of consensus that the Convention achieved. Of the 200 parliamentarians participating in that Convention, only eight signed an alternative text, basically arguing for the disintegration of Europe. We have heard that case being put here this morning, with Mr Allister of Northern Ireland arguing for a reversion to 19th century absolute sovereignty. If Sinn Féin had participated in the debate this morning they would – although they are the direct political opposites in Northern Ireland – have been making exactly the same case. Perhaps it is a kind of progress that they agree on 19th century absolute sovereignty, although it is unfortunate that they continue to fall out over the outcome of the Battle of the Boyne in 1690!

The fact is that this is a world in which the response to natural disasters and to man-made problems clearly requires transnational governance. Uniquely in the world, Europe is developing a democratic form of transnational governance. This Constitution will give us more democracy, more rights and more potential for a prosperous society in Europe, and indeed for solidarity with the rest of the world.

To conclude, those outcomes will not happen of their own accord. We have to work for them, using this Constitution as the basis for our work.

  Rack (PPE-DE). Herr Präsident, liebe Kolleginnen und Kollegen! 2004 war im Prozess der europäischen Integration ein besonders bemerkenswertes Jahr mit absoluten Höhepunkten und mit Tiefpunkten. Höhepunkte waren zweifellos die Erweiterung der Gemeinschaft von 15 auf 25 Staaten und die weitergehenden Signale vom Dezember dieses Jahres. Höhepunkt war auch die Unterzeichnung der Verfassung am 29. Oktober in Rom, Tiefpunkt war bekanntermaßen das Datum und das Geschehen der Europawahlen.

Die Beteiligung an den Europawahlen war so niedrig wie nie zuvor, und die Zersplitterung, die das Ergebnis dieser Europawahlen hier in dieses Haus gebracht hat – nicht zuletzt auch signalisiert durch die vielen bunten Fähnchen, die hier herumstehen, und zwar nicht nur vor dem Gebäude –, ist ein weiterer Beweis dafür.

Im Jahr 2005 müssen wir daher den Bürger wieder an das Projekt Europa anbinden, und ich meine, das ist eigentlich gar nicht so schwer. Es ist allerdings eine Kommunikationsaufgabe. Wir haben ein sehr gutes Produkt, die neue europäische Verfassung, und dafür müssen wir bei den Menschen um Zustimmung werben. Wir brauchen keine Propagandakampagnen, wir brauchen seriöse Informationen, insbesondere auch bei dem Argument, sie bringe den Menschen etwas. Wir sollten den Menschen nicht das Blaue vom Himmel versprechen, sondern wir sollten das sagen, was die Verfassung bringt und bringen kann.

Die Herren Méndez de Vigo und Corbett haben das in vier Schlüsselpunkten zusammengefasst. Die Verfassung bringt mehr Klarheit über die Europäische Union, sie bringt mehr Effizienz in der Europäischen Union, sie bringt mehr Demokratie und Verantwortlichkeit und mit den Grundrechten mehr Rechte für die Bürger.

Informieren heißt nicht, auf eine kritische Sicht der Dinge zu verzichten, aber die Kritik muss zunächst immer in den Vordergrund stellen, dass unser Produkt grundsätzlich ein gutes ist.

Ein letztes Argument: Es wird immer wieder argumentiert, eine Verfassung interessiere die Bürger nicht. Wir hatten an der Universität Graz eine Publikumsveranstaltung, und dort hat die Verfassung mehr Interesse gefunden als Giftpilze und Traumdeutung. Das sollte für uns ein Anreiz sein, die Verfassung an die Bürger heranzutragen.

  Bresso (PSE). Signor Presidente, intanto voglio esprimere il voto favorevole della delegazione socialista italiana al progetto di relazione di Corbett-Méndez de Vigo, con cui mi voglio felicitare per la qualità della relazione, in particolare delle motivazioni.

Certamente oggi il Parlamento europeo vive una tappa storica, che richiama alla mente quel 14 febbraio 1984, in cui venne approvato il progetto di trattato di Spinelli di cui la Costituzione è in qualche modo l'ideale continuazione.

Poco conta se in termini strettamente giuridici siamo di fronte ad un Trattato, ciò che importa è la sostanza: oggi siamo tutti disposti a chiamare Costituzione, un termine che solo fino a qualche anno fa era considerato spesso impronunciabile. Chi come Spinelli e il Movimento federalista, di cui mi onoro di far parte, riteneva e ritiene indispensabile la creazione di uno Stato federale vero, dotato di poche ma essenziali competenze, tali da prefigurare un ruolo nel mondo per l'Unione europea, avrebbe voluto un testo più coraggioso. Tuttavia, questa Costituzione contiene in nuce alcuni passaggi essenziali, che rappresentano un quadro stabile e duraturo, dal quale si dovrà d'ora in poi ripartire perché l'Unione possa efficacemente fare quello che i suoi cittadini si aspettano.

Mi limiterò a citare alcuni esempi che ritengo prioritari e che in alcuni casi derivano dal legame con il mio territorio, che è un territorio transfrontaliero. Prima fra tutti vorrei citare la creazione della figura del Ministro degli esteri, che sia la voce dell'Unione europea sulla scena internazionale e ne guidi la politica estera. Le procedure che, in quanto membro della Commissione, lo portano ad essere responsabile di fronte al Parlamento, devono rappresentare il presupposto per l'esistenza di una politica estera. I cittadini europei in occasione dei molti, troppi conflitti che caratterizzano questi anni, ci chiedono e si chiedono cosa fa l'Europa.

In secondo luogo l'UE deve essere un modello di sviluppo, a testimonianza tangibile del fatto che è possibile coniugare sviluppo e solidarietà. Da ultimo voglio ricordare che il principio di sussidiarietà oggi è un principio di valore costituzionale e questo lo rafforza e lo vede garantito. Questa è un'altra delle ragioni per cui io penso dobbiamo votare a favore.

Mhux għaliex naqbel ma' l-argumenti illi jressqu, anzi naħseb illi bosta mill-argumenti tagħhom huma imsejjsa fuq premessi żbaljati jew saħansitra foloz. Imma għaliex mingħajr vuċi kontra, nispiċċaw f'dibattitu monotonu fejn kulhadd ikun favur u fejn ikollna nuqqas ta' analiżi oġġettiva. M'hemmx mod aħjar ta' kif wieħed jista' jirbaħ l-argument dwar l-Ewropa jekk mhux billi jkollu l-kuraġġilli jikkonfronta l-argumenti favur ma' dawk kontra. Għandna nieħdu l-argumenti ta' min hu kontra bis-serjetŕ u nittrattawhom b'rispett. Iżda m'għandniex nibżgħu jew naħarbu mill-argumenti ta' min huwa kontra, wisq anqas ninjorawhom.

M'għandniex nistennew li nirbħu l-argument jekk ma nesponux ruħna għal dibattitu miftuħ, inkella nispiċċaw ngħidu li nkunu rbaħna l-logħba meta fil-fatt fil-logħba jkun niżel jilgħab tim wieħed biss. Wara kollox, meta wieħed jikkonfronta l-argumenti favur din l-kostituzzjoni ma l-argumenti kontra, ma jdumx wisq ma jikkonkludi li l-kostituzzjoni għandha ferm aktar dak li hu tajjeb milli ħażin u jistħoqqilha l-appoġġtaċ-ċittadini Ewropej. M'hemmx dubju illi jekk infiehmu lin-nies xi tfisser il-kostituzzjoni, in-nies se jkunu aktar favuriha milli kontriha, għaliex jifhmu kemm l-għaqda Ewropea hija pass loġiku, li jagħmel sens u li hija fl-interess tagħhom. U allura huwa kruċjali li kull min f'din il-kamra, kull min f'dan il-Parlament huwa favur din il-kostituzzjoni għandu jimpenja ruħu direttament man-nies biex jara li n-nies jifmuha u jappoġġjawha. Dan l-appoġġikun imsejjess fuq konfront ta' l-argumenti u allura jkun fuq dibattitu aktar miftuħ, aktar bilanċjat u aktar demokratiku.

  Reynaud (PSE). Monsieur le Président, une Constitution pour l'Europe est nécessaire: c'est une exigence démocratique. Profondément attachés à l'unité du parti, les socialistes français conduiront le débat national sans le moindre renoncement à nos valeurs et idées progressistes. Je considère que l'approbation du rapport est la condition pour asseoir l'autorité du Parlement sur le Traité constitutionnel, mais je regrette le rejet d'amendements déposés par certains d'entre nous.

Néanmoins, nous participerons à ce long chemin semé d'embûches qu'est la ratification du Traité constitutionnel. Nous affirmons que ce Traité constitutionnel est stable mais ajustable. Toutes les constitutions le sont et ce Traité pas moins que d'autres. Nous regrettons également qu'une grande majorité des avis émis par d'autres commissions parlementaires qui ont relevé de multiples insuffisances du projet de Traité constitutionnel aient été supprimés dans ce rapport. Nous tenons aussi à dire clairement qu'une cellule spéciale, créée sous la présidence néerlandaise, continuera son travail sous les futures présidences et étudiera à la loupe toutes les conséquences possibles d'un «non» à la Constitution.

Je souhaite que le Parlement, légitimé dans son rôle après ce vote, se saisisse des difficultés de mise en œuvre du Traité constitutionnel et utilise son droit d'initiative parlementaire. C'est là notre vocation et c'est le sens de l'amendement 17.

Oui, c'est à nous, députés européens, élus du peuple européen, qu'il incombe d'être les acteurs de la mise en œuvre du Traité constitutionnel, qui régit le "vivre ensemble" de plus de quatre cent cinquante millions d'Européens. Les difficultés qu'ont fait apparaître les avis des autres commissions ressurgiront tôt ou tard. Nous devrons alors être prêts à corriger les imperfections léguées par la Conférence intergouvernementale et altérant les délicats équilibres auxquels la Convention est parvenue avec sagesse et équité.

Préparons­nous, chers collègues, à un nouveau "round": il va en effet falloir défendre notre légitimité populaire sur le Traité constitutionnel, dont nous avons l'impérieux devoir de corriger les insuffisances le moment voulu. Un certain nombre de mes collègues de la délégation française s'abstiendront sur le vote de ce rapport.

  Van Nistelrooij (PPE-DE). Voorzitter, dit grondwettelijk verdrag is het waard verdedigd te worden. Als christen-democraat doet het mij goed dat het subsidiariteitsbeginsel juist nu is uitgewerkt, verdiept en verankerd. De Europese Unie heeft nu ook de taak van de lokale en regionale overheden - de regionale dimensie - erkend en verankerd.

Een beter evenwicht tussen wat centraal en decentraal gebeurt, in Brussel, in de nationale staten en in regio´s en gemeenten, is noodzakelijk. Ik heb als bestuurder op regionaal niveau ook jarenlang gemerkt dat informatie van de Europese Unie te lang op het niveau van de Raad bleef hangen, dat regio´s en steden te laat bij het debat en de besluitvorming werden betrokken.

Vanuit de Europese organisaties heb ik ook kunnen deelnemen aan de hoorzittingen van de Conventie, met name over subsidiariteit. De verdragstekst versterkt de positie van regio´s en steden, die dicht bij de burgers staan en waar op vele terreinen belangrijke taken worden verricht.

Daarmee wordt het democratisch gat gedicht waarover ook Prodi in zijn verslag over good governance sprak. Het is een belangrijke stap dat het Europees Parlement dit nu ook ondersteunt en kritisch blijft over de invulling die in de komende jaren op decentraal niveau aan dit verdrag zal worden gegeven.

Ik stel ook voor dat wij als Parlement zowel aan de Raad als aan het Comité van de regio´s van tijd tot tijd vragen stellen als: hebben onze nationale staten nu geleerd op een open wijze te communiceren over het Europese beleid? Houden de nationale parlementen bij de subsidiariteitstoets ook rekening met de opvattingen van regio´s en steden?

Ik weet dat het Comité van de regio's ook met een dergelijke toets bezig is. Kortom, dit verdrag is echt het verdedigen waard. Daarom zullen wij ons er in de nationale staten voor inzetten, zeker als er referenda aan de orde zijn.

  Λαμπρινίδης (PSE). Κύριε Πρόεδρε, τρία είναι τα μεγάλα διακυβεύματα αυτού του Συντάγματος. Το πρώτο είναι το αν θα γίνουμε μια ομοσπονδία. Μια ομοσπονδία και στα εξωτερικά θέματα και στην άμυνα και αλλού ή θα είμαστε μια Ευρώπη χαλαρής ομοσπονδίας ανομοιογενών εταίρων, ιδιαίτερα μετά τη διεύρυνση;

Το δεύτερο: Θα είμαστε μια Ευρώπη κοινωνικής ευαισθησίας ή θα είμαστε μια Ευρώπη της ανοικτής ανεξέλεγκτης αγοράς;

Και το τρίτο: Θα είμαστε μια Ευρώπη χωρίς δημοκρατικό έλλειμμα, με δύναμη στα χέρια των πολιτών, ή θα είμαστε μια Ευρώπη όπου θα γίνονται ευρωεκλογές και θα έχουμε 30, 40 και 50% αποχή;

Κατά τη γνώμη μου αυτό το Σύνταγμα απαντά σε όλα αυτά τα ερωτήματα θετικότατα, εν πάση περιπτώσει πολύ πιο θετικά απ' ό,τι τα αντιμετωπίζουν οι υπάρχουσες συνθήκες. Όσοι είναι εναντίον του Συντάγματος αυτού, για κοινωνικούς, δήθεν, λόγους ευαισθησίας πρέπει να απαντήσουν εάν οι υπάρχουσες συνθήκες βοηθάνε τον φτωχό και τον αδύναμο στην Ευρώπη περισσότερο απ' ό,τι τον βοηθά αυτό το Σύνταγμα. Και επιτρέψτε μου ένα στοιχείο μικρής εθνικής υπερηφάνειας, ως Έλληνα και ως σοσιαλιστή: Ήταν επί των ημερών της Ελληνικής Προεδρίας, τον Ιούνιο του 2003, που έκλεισε η αρχική διαπραγμάτευση για αυτό το Σύνταγμα, και είμαι υπερήφανος γι' αυτό.

Βέβαια, απομένει πλέον η εφαρμογή του, και εκεί οι ευρωβουλευτές και οι κυβερνήσεις έχουν μεγάλη ευθύνη. Πρέπει να βεβαιωθούμε ότι οι φύτρες κοινωνικής ευαισθησίας που μπήκαν στο Σύνταγμα δεν θα μείνουν ωραία λόγια αλλά θα πραγματοποιηθούν. Η περίφημη οριζόντια κοινωνική ρήτρα με την υποχρέωση της Ένωσης να βεβαιώνεται ότι σε κάθε πολιτική της προωθούνται οι στόχοι της υψηλής απασχόλησης, της προστασίας του περιβάλλοντος, της δημόσιας υγείας, της παιδείας, της ισότητας ανδρών και γυναικών μόνο με καλούς νόμους θα εφαρμοστεί. Επίσης πρέπει να σας πω ότι για όσους ευρωβουλευτές πασχίζουν για μια πιο δίκαιη κοινωνικά Ευρώπη αυτό αποτελεί μια ιδιαίτερα επίπονη αλλά και ιδιαίτερα ευπρόσδεκτη πρόκληση.

  Brejc, Mihael (PPE-DE). Za ljudi so bruseljske institucije zelo oddaljene. Vidijo jih kot centre moči, na katerih odločitve nimajo vpliva. Ustavna pogodba sicer ni čudežno zdravilo za vse težave Evropske unije, vendar pa je priložnost, da se zmanjša demokratični primankljaj in za še hitrejši razvoj Evrope.

Zakaj? Ker nadomešča številne pogodbe in amandmaje ter s tem zmanjšuje nepreglednost ključnih dokumentov Evropske unije; ker so v enem samem dokumentu zbrani ključni ustavno-pravni temelji in politike Evropske unije; ker je podlaga za učinkovitejše delovanje evropskih institucij; ker prispeva k uresničevanju lizbonske strategije; ker odpravlja ovire, ki bi nastale, če bi še naprej uporabljali sedanje pogodbe.

Ustavna pogodba je kompromis, s katerim ni nihče popolnoma zadovoljen, a kljub vsemu predstavlja največ, kar smo lahko v konvenciji naredili. Ustavno pogodbo potrebujemo, sicer ni mogoče pričakovati učinkovitih reform niti učinkovitega delovanja razširjene Evrope. Čeprav je poglavje o politikah pogosto kritizirano, naj kot poročevalec v senci izrazim zadovoljstvo, da so na področju socialne politike in zaposlovanja določene zelo konkretne obveznosti Komisije in vlad držav članic, predvidena pa je tudi ustanovitev Odbora za socialno zaščito in Evropski socialni sklad. S sprejemom poročila o ustavni pogodbi daje Evropski parlament evropski javnosti jasen signal, da je prišel čas za pregledno in celovito ureditev ustavno-pravnih temeljev in s tem tudi zagotovilo, da Evropa postane celina miru, blaginje, solidarnosti in varnosti.

Naj na koncu še povem, da bo slovenski parlament še v tem mesecu ratificiral ustavno pogodbo. Prepričan sem, da z veliko večino.

  Záborská (PPE-DE). Pán predseda, dámy a páni, odmietam totalitné režimy. Rodina mojej starej mamy našla smrť v nacistických plynových komorách. Môj otec bol väznený komunistickým režimom. Krvou sme zaplatili našu angažovanosť za slobodu svedomia, ktorú pre nás stelesňovala Európa ako nádej na demokraciu, slobodu myslenia, náboženskú slobodu a slobodu svedomia.

Verím, že nikto z vás ma nebude pokladať za antieurópana, keď položím niekoľko otázok. Prečo sa Európsky parlament k ústavnej zmluve vyslovuje skôr ako občania jednotlivých štátov? Potrebujeme Európu usporiadanú ústavou? Zvrchovanosť členských štátov nemala byť ohrozená. Ak však ústava posilňuje úlohu Parlamentu, ale nedefinuje kompetencie Európskeho súdneho dvora, nenarúša tým rovnováhu medzi inštitúciami? Rozhodnutia tohto súdu budú priamo vnucované orgánom Únie aj členským štátom bez možnosti odvolať sa. Európsky súdny dvor bude oslobodený od akejkoľvek kritiky.

Môžeme sa tváriť, že to nevidíme? Návrh ústavy neobsahuje záruky, aby si Európsky súdny dvor neprivlastnil niektoré z výlučných kompetencií suverénnych štátov aj proti národným ústavám. Aj keby sa po voľbách zmenila väčšina v tomto Parlamente a zároveň by sa zmenilo zloženie Rady, na zmenu politiky bude potrebná dvojitá jednomyseľnosť. A ja sa pýtam: Bude takáto Únia schopná vývoja, aj keď bude jej smerovanie dané ústavou? Naša civilizácia sa rozvíjala na kresťanských koreňoch. Ak ústava odmieta uznať tento historický fakt, vnáša do spoločenského života znepokojenie. Pod maskou tolerancie vzniká nová ideológia. Máme stavať európsky dom na prekrútenej histórii? Je pravdou, že bez tejto ústavy by bola myšlienka jednotnej Európy mŕtva? Myslím si, že nie. Moji voliči mi dali dôveru a ja chcem konať v Európe tak, aby všetci, vrátane tých najmenších, najslabších a najbiednejších, v nej boli akceptovaní a našli si svoje miesto. Vážení kolegovia, v demokratickej Európe vás chcem požiadať, aby sme rešpektovali slobodu vo svedomí pri hlasovaní.

  Lehtinen (PSE). Arvoisa puhemies, huolimatta kaikista erimielisyyksistä, joita tämän asian ympärillä käyty keskustelu on tuonut esiin, olemme jälleen kerran tekemässä eurooppalaista historiaa. Tällaisenaankin tämä sopimus on tärkeä askel oikeaan suuntaan. Olen varma, että integraatioliikkeen perustajat olisivat sekä ylpeitä että iloisia, jos olisivat nyt todistamassa, kuinka monesta perustavaa laatua olevasta asiasta on päästy sellaisiin kompromisseihin, että parlamentti nyt sekä keskustelee että äänestää niistä.

On valitettavaa, että sopimuksen käsittely on eräissä maissa irronnut asiayhteyksistään ja otettu sisä- ja puoluepoliittisen riitelyn välikappaleeksi. Eurooppalaisuuden huonoimmat ominaisuudet, suvaitsemattomuus ja kansalliskiihko, ovat liian usein nähtävissä ja kuultavissa noissa puheenvuoroissa, vaikka niitä yritetään kätkeä jalompien pyrkimysten valemuotoon. Tämä sopimus ei voimaansaatettuna suinkaan johda eurooppalaisen supervaltion syntyyn – päinvastoin – sen henki ja teksti torjuvat tehokkaasti yksittäisten valtioiden, valtioryhmien tai ääriliikkeiden mahdollisia itsekkäitä pyrkimyksiä.

Taloudelle sopimus jättää edelleen sen roolin, joka sille maanosan yhteistyössä parhaiten sopii. Keskinäisen taloudellisen toimeliaisuuden luoma dynamiikka ja yhteinen rahapolitiikka ovat myös poliittisen yhteistyön edellytys. Ilman demokratiaa ei ole sosiaalista ulottuvuutta, eikä demokratiaa ole ilman markkinataloutta. Olen myös ylpeä siitä, että kotimaassani Suomessa on voitu sopia, että parlamentti saa päättää sopimuksen ratifioimisesta kansallisella tasolla.

  Paleckis (PSE). Pritardamas pateiktam pranešimui noriu dar kartą priminti, kad Lietuva Parlamento sprendimu pirmoji ratifikavo šią Konstituciją. Lietuvos socialdemokratai, buvę ir išlikę valdžioje, po nesenų rinkimų aktyviai dalyvavo Konstitucinės sutarties rengimo darbe. Kai šalys buvo pakviestos teisiškai apiforminti tai, dėl ko visos bendrai ir nelengvai sutarė, nedelsdami tai atlikome. Tam turėjome pagrindo. Prieš pusantrų metų referendume lietuviai pasakė aiškiausią "Taip" naujųjų narių tarpe narystei Europos Sąjungoje. Lietuvoje pastoviai auga narystės Europos Sąjungoje palaikymas, pasiekęs 82 %. Þmonės mato, kad viltys, susijusios su Europos Sąjunga, pildosi, todėl nori jos stiprėjimo. Referendumo dėl Konstitucijos žlugimas bet kurioje Europos Sąjungos šalyje, manau, būtų skaudus smūgis daugumos europiečių, jų tarpe ir lietuvių, viltims.

Šiandien Europos Sąjungos laivas, kuriame jau 25 valstybės, plaukia varomas aiškiai per silpno tokiam apkrovimui variklio - Nicos sutarties. Jeigus jis nebus pakeistas žymiai galingesniu - Konstitucinės sutarties varikliu - mūsų bendras laivas sulėtins greitį, gali pradėti dreifuoti. Su senuoju Nicos varikliu mes niekada nepasieksime Lisabonos strategijoje nubrėžtų tikslų, negalėsime efektyviai vykdyti naujųjų kaimynų politikos. Tai ypač aktualu naujosioms Europos Sąjungos šalims.

Žengianti pirmyn stipri demokratiška Europos Sąjunga - esminis ne tik mūsų šalies interesas. Konstitucinė sutartis - koks sudėtingas kompromisas ji bebūtų - prisideda prie to. Lietuva ryžtingai ratifikavo ją, kad naujųjų šalių energija ir optimizmas persiduotų ir Europos Sąjungos senbuviams. Ačiū.

  Wuermeling (PPE-DE). Herr Präsident, meine sehr verehrten Damen und Herren, liebe Kolleginnen und Kollegen! Ich freue mich sehr über die Vorlage dieses gehaltvollen Berichts der Kollegen Corbett und Méndez de Vigo, und als früheres stellvertretendes Mitglied des Konvents muss ich zugeben, dass ich vielleicht dem einen oder anderen eher die Lektüre dieses Berichts als jene der Verfassung selbst empfehlen würde, weil der Bericht ausgezeichnet lesbar und in der Sache sehr überzeugend ist.

Ich möchte heute ein Wort an diejenigen richten, die sich hier auch kritisch mit der Verfassung auseinandergesetzt haben. Sie warnen vor einem europäischen Superstaat, sie prangern Missstände an, sie wenden sich gegen Fehlentwicklungen in der Vergangenheit. Ich glaube, wir sollten ihnen sehr deutlich sagen, dass genau diese europäische Verfassung ein Mittel ist, um diese Missstände abzubauen.

Die europäische Verfassung schafft Abhilfe für vieles von dem, was uns allen heute am real existierenden Europa nicht gefällt. Diese europäische Verfassung schafft eine Kompetenzordnung, sie schafft Mitwirkungsrechte der nationalen Parlamente. Europa wird so weniger zentralistisch, weniger bürokratisch. Sie schafft die volle Mitsprache des Europäischen Parlaments, Europa wird deshalb demokratischer, als es bisher gewesen ist. Sie stärkt auch die Rechte der Bürger, vor allen Dingen durch die Grundrechtecharta, weil der Bürger sich gegenüber Entscheidungen Europas unmittelbar auf die Verfassung berufen kann. Und schließlich schafft diese Verfassung eine Wertebasis für dieses Europa, sodass sie ein Mittel gegen die technokratische Herangehensweise an politische Probleme darstellt. Deswegen müssten eigentlich gerade die Europaskeptiker für diese Verfassung sein, denn nur mit der Verfassung ändert sich etwas an den Zuständen, an denen wir hier alle etwas ändern wollen.

Heute jährt sich der Geburtstag von Alexander Hamilton. Er ist einer der Väter der amerikanischen Verfassung. Heute ziert sein Bild den Zehn-Dollar-Schein. Wenn ich mir unsere Väter und Mütter der europäischen Verfassung anschaue, hoffe ich, dass man sich in 200 Jahren auch an sie so dankbar erinnern wird.

  Mikko (PSE). Austatud president, head kolleegid!

Õnnitlen esmalt lugupeetud raportööre väga läbimõeldud raporti puhul. See dokument võtab erakordselt läbimõeldult kokku kõige olulisema Euroopa põhiseaduses.

Samas sooviksin veidi teistsugust rõhuasetust põhiseadusest teavitamisel.

Tänase raporti lõppjäreldused keskenduvad põhiseadusest kirjutavatele trükistele. Kuid nii avaliku arvamuse uuringute kui loogika kaudu teame, et ka Euroopa Liidu infot ootavad ja saavad meie kodanikud ennekõike televisioonide kaudu.

Meie tänane raport toonitab vajadust põhiseaduse lepingu tekstis selgelt eristada iga kohta, mis on uus võrreldes olemasolevate lepingutega. Kuid see on pigem teadusuuringu mitte igale Euroopa kodanikule suunatud info teema. Üle 300-leheküljeline Euroopa põhiseaduse leping on niigi ülimahukas ja vastavalt keerulisem liikmesriikide põhiseadustest.

Ühtset Euroopa avalikku arvamust veel pole, kuid näiteks minu kodumaal Eestis on toetus Euroopa Liidule kasvanud iga kuuga alates sellest, kui meie riigist sai Euroopa Liidu liikmesriik. Samas on paljudes liikmesriikides märgata ka langustrendi. Ent kogu Euroopas kehtib nii ajakirjanduses kui ka teavitamisel üks reegel: tuleb vastata inimeste ootustele.

Nii uutes kui vanades liikmesriikides, nii linnas kui maal, huvitab inimesi ennekõike see, mis mõju on Euroopa põhiseadusel nende igapäevaelule. Arvan, et põhiseadusest teavitamisel tuleks keskenduda Euroopa põhiõiguste hartale. Ehk mida annab igale kodanikule näiteks hartas sätestatud õigus heale haldusele? Kuivõrd kohustab see nõue ametnikke või poliitikuid oma otsuseid põhjendama, olema avatud? Just niisugustele küsimustele vastamine olgu põhiseadusealase teavitamise lahutamatu osa.

Ning ceterum censeo: ilma televisioonita ei saa rääkida Euroopa kodanike teavitamisest. Sellega peaks arvestama ka Euroopa Parlamendi informatsiooni peadirektoraat oma töös põhiseadusest teavitamisel. Soovin neile ja kõikidele Euroopa televisioonidele edu põhiseaduse keeruliste lausete muutmisel kodanikele arusaadavaks telepildiks. Tänan tähelepanu eest.

  Βαρβιτσιώτης (PPE-DE). Κύριε Πρόεδρε, η αυριανή ψηφοφορία είναι ιστορικής σημασίας. Η σημαντική πρόοδος που σημειώνεται με το Ευρωπαϊκό Σύνταγμα καθώς και τα πλεονεκτήματα που προκύπτουν από τις θετικές διατάξεις του έχουν ήδη παρουσιαστεί τόσο στην άρτια έκθεση των συναδέλφων Corbett και Méndez de Vigo αλλά και σήμερα μέσα στην αίθουσα αυτή. Επειδή λοιπόν όλα σχεδόν τα θέματα έχουν εξαντληθεί, θα περιοριστώ στο να διατυπώσω έναν καίριο προβληματισμό.

Από αύριο αρχίζει ένας νέος μαραθώνιος για την επικύρωση από τα κράτη μέλη. Τι θα συμβεί όμως στην περίπτωση που υπάρξει κάποιο πρόβλημα με την επικύρωση σε κάποιο από τα κράτη μέλη; Το Σύνταγμα δεν περιλαμβάνει συγκεκριμένη διάταξη για την αντιμετώπιση αυτού του ενδεχομένου. Στις δηλώσεις σχετικά με τις διατάξεις του Συντάγματος ωστόσο αναφέρεται ότι, αν μετά την παρέλευση 2 ετών από την υπογραφή της Συνθήκης τα 4/5 των κρατών μελών έχουν επικυρώσει την εν λόγω Συνθήκη και ένα ή περισσότερα κράτη μέλη αντιμετωπίζουν δυσχέρειες όσον αφορά την επικύρωση αυτή, το θέμα υποβάλλεται στο Ευρωπαϊκό Συμβούλιο. Νομίζετε όμως ότι η ρύθμιση αυτή είναι ικανοποιητική; Πιστεύω ότι θα έπρεπε να υπάρχει μια διάταξη περισσότερο σαφής. Δυστυχώς όμως και η ρύθμιση αυτή προέκυψε από τη σειρά των συμβιβασμών που υπήρξαν απαραίτητοι, για να φθάσουμε στο σημείο όπου είμαστε σήμερα. Δεν αρκεί λοιπόν να λέμε και να υποστηρίζουμε ανεπιφύλακτα την επικύρωση του Συντάγματος. Πρέπει όλες οι κυβερνήσεις αλλά και όλοι μας να εργαστούμε, ώστε να αποφευχθεί μια τέτοια δυσμενής εξέλιξη, αν θέλουμε να περάσουμε σε μια νέα εποχή για την ήπειρό μας.

  Sousa Pinto (PSE). Senhor Presidente, com a aprovação do Relatório Corbett/ Mèndez de Vigo, o Parlamento Europeu dará aquela que será a sua última grande contribuição para a adopção de um texto constitucional para a Europa. A existência de um texto constitucional europeu consagra a transição histórica de uma comunidade de povos e países progressivamente unidos por laços económicos cada vez mais estreitos para uma verdadeira comunidade política unida pelo desejo de um destino comum.

Cinquenta anos de uma política de prudentes pequenos passos abriu caminho a uma nova realidade fundada em valores comuns, valores de civilização que exprimem uma identidade europeia comum, assente na paz, na democracia, nos direitos humanos e no progresso económico e social.

A Europa não se constrói contra a realidade secular das nações do nosso continente. A Europa nasce do livre e esclarecido desejo de não permitir a repetição do passado e de garantir aos seus povos a capacidade de, unidos, permanecerem senhores do seu destino num futuro carregado de desafios.

Os soberanistas que atribuem à Europa a erosão da soberania nacional e vêem nesta Constituição a materialização do seu pesadelo do super-Estado, incorrem num profundo erro de análise. A globalização económica, financeira e tecnológica, a emergência actual ou potencial de novos potentados globais, políticos e económicos, obrigam a Europa a buscar respostas que já não existem à escala nacional para defender, aprofundar e exportar o projecto humanista lançado no século passado pelo Estado social de direito do pós-guerra.

Num mundo marcado pela incerteza, pela desordem e pela desregulação, a voz e o protagonismo da Europa são cada vez mais necessários, a nós e aos outros que observam o nosso exemplo e esperam a nossa intervenção nos grandes temas da agenda internacional. Mas os soberanistas não são os únicos adversários deste Tratado, outros há que denunciam com estridência a sua insuficiência e modéstia de resultados ou falta de ambição. Esses são os que recusam reconhecer os importantes avanços alcançados porque insistem no exercício inútil de comparar o texto constitucional que temos diante de nós com as versões idealizadas dos seus sonhos em vez de o compararem com os actuais Tratados e com o processo de Nice, em particular.

Mr President, while the European Parliament has no formal role in the ratification procedure, I am pleased that, as the elected representatives of 25 Member States of the European Union, we are having this debate today, at a point in time when the ratification procedure has just got under way at parliamentary level and is just about to get under way at referendum level.

On the day when heads of state and government signed the Constitution in Rome, I happened to be in Bratislava, Slovakia, where I was privileged to participate in the opening of the House of Europe. That was the first opening of a House of Europe in one of the new Member States. It was followed by the opening in December of a House of Europe in Prague.

Procedures for establishing Houses of Europe in all Member States are under way. The principal function of these Houses of Europe is to bring the European Union closer to its citizens. They offer citizens a point of information that is centrally and visibly located in their own Member State. The concept offers education on the European Union and, by providing accommodation for the political groups, it ensures that the views of this Parliament can be conveyed to the citizens.

It is my belief that if the European Union is to work, we have to strengthen and deepen the relationships between this Parliament and the national parliaments. There is no other way in which we can achieve that cooperation in the longer term. It should not be an 'us and them' situation; it should be about everyone working together for the betterment of all people in the 25 Member States – or perhaps the 27 Member States, should that come about. That is the challenge for the future; that is the challenge that we, as democrats, have to take on board.

It takes two sides to make a debate. Because people do not necessarily agree with every word that others say, this does not mean that they have no right to say it. I believe in the rights of everyone, I believe in democracy. I believe that those who disagree with me have a right to their views. The majority will ultimately win, but those who disagree can make this a better debate, and they should be encouraged to do so and should not be disenfranchised from their position.

  Obiols i Germà (PSE). Señor Presidente, como muy bien pone de manifiesto este informe, en el proyecto de Constitución hay tres aspectos básicos: en primer lugar, los valores y objetivos de la Unión, la unidad y la igualdad de sus pueblos, así como la protección de la diversidad de sus culturas, identidades y lenguas; en segundo lugar, los derechos, intereses y deberes de los ciudadanos y ciudadanas; y, en tercer lugar, unas reglas para las instituciones y para el juego político europeo.

Los dos primeros aspectos -valores y derechos- definen la democracia europea que queremos, basada en la diversidad y libertad de los pueblos, su progreso e igualdad. El tercer aspecto -debe quedar claro: las reglas de juego- es el resultado de unos compromisos entre derechas e izquierdas, entre federalistas e intergubernamentalistas; debe quedar claro que se refiere a esas reglas, no a las políticas que deben desarrollarse.

En este sentido, la Constitución no es un punto final, sino un punto de partida, para superar la atonía económico-social de Europa, su débil capacidad de innovación, investigación y desarrollo y su insuficiente peso internacional.

Hay que avanzar hacia un Gobierno europeo superando el método actualmente dominante de coordinación intergubernamental y su impotencia, puesta de manifiesto con la no implementación de la estrategia de Lisboa o las divisiones ante la invasión de Iraq.

Con esta perspectiva de progreso futuro llamaremos a votar sí a la Constitución europea.

  Jeggle (PPE-DE). Herr Präsident! Ein langjähriger Traum dieses Parlaments und besonders auch ein Traum vieler Bürgerinnen und Bürger Europas wird Wirklichkeit. Wir haben lange und intensiv für diese Verfassung gearbeitet. Auf das jetzt Erreichte können wir stolz sein, und hier gilt mein Dank heute Herrn Méndez de Vigo und ebenso Herrn Corbett.

Als Schattenberichterstatterin meiner Fraktion im Landwirtschaftsausschuss kann ich sagen, wir stimmen diesem Verfassungsentwurf zu. Zweifellos wurde für den Landwirtschaftsausschuss ein Zugewinn erreicht. Zu Beginn der gemeinsamen Agrarpolitik 1958 waren wir nur Anhörungsinstanz. Erst der Vertrag von Amsterdam brachte uns die Mitentscheidung in den Bereichen Umwelt, Verbraucherschutz sowie Lebensmittelsicherheit. Das trotzdem immer noch bestehende Demokratiedefizit wird nun durch die Ausweitung des Mitentscheidungsverfahrens auf alle agrarpolitischen Grundsatzentscheidungen behoben.

Doch es gibt auch Schatten. Zukünftig soll der Rat über die Festsetzung von Quoten, Preisen und mengenmäßigen Beschränkungen alleine entscheiden können. Denn der Verfassungsentwurf trägt den neuen Zielen der gemeinsamen Agrarpolitik nach der Agrarreform nicht Rechnung. Dies stellt durchaus auch einen Rückschritt gegenüber dem Status quo dar und gibt uns für die Zukunft Arbeit.

Aber auch als Vertreterin meines Bundeslandes Baden-Württemberg sehe ich durchaus wichtige Ziele erreicht: Die nationalen Verfassungen werden gestärkt, Regionen und Kommunen bekommen mehr Gewicht, der Subsidiaritätsgrundsatz wird beachtet. Dieser Verfassungsentwurf ist die Grundlage eines gemeinsamen Wirtschaftens und – für mich persönlich auch ganz wichtig – wir bekommen eine gemeinsame Wertegrundlage, die uns verbindet. Vor uns liegt ein Werk, das eine Verpflichtung ist für alle, die Verantwortung für Europa tragen.

  Kreissl-Dörfler (PSE). Herr Präsident! Ich begrüße die Europäische Verfassung sehr und gratuliere den Berichterstattern zu ihrem hervorragenden Bericht. Gerade der Raum der Freiheit, der Sicherheit und des Rechts wird durch die Verfassung gestärkt. Mit ihr haben wir einen Meilenstein auf einem Weg gesetzt, der zu einem sichereren und gerechteren Europa führt. Mit ihr haben wir einen riesigen Schritt hin zu einem Europa der Bürgerinnen und Bürger gesetzt. Denn mit der Aufnahme der Charta der Grundrechte, dem Beitritt der Union zur Europäischen Konvention für Menschenrechte und dem vereinfachten Zugang zur Justiz werden die Bürgerrechte massiv gestärkt. Zudem haben wir nun bessere Möglichkeiten, koordiniert z. B. Kriminalität, Rassismus und Fremdenfeindlichkeit in Europa zu bekämpfen.

Ich begrüße es, dass die CSU-Abgeordneten hier zustimmen werden. Leider haben viele CSU-Abgeordnete im deutschen Bundestag, der ja den Vertrag noch ratifizieren muss, die Bedeutung und die Tragweite der Verfassung anscheinend nicht einmal im Ansatz verstanden, denn sie haben angekündigt, dort dagegen stimmen zu wollen. Dies zeigt wieder einmal das Doppelspiel, das die CSU so gerne spielt: Hier in Europa fortschrittlich sein und nach außen die Fahne hochhalten, doch zu Hause prophylaktisch schon einmal dagegen sein. Aber das ist die Tradition der CSU, denn bereits 1949 hat sie gegen das Grundgesetz in Deutschland gestimmt.

  Novak (PPE-DE). Spoštovani. Dosedanja obleka Evropske unije je postala v večjih okvirih in novih časih premajhna in neustrezna. Zato je prav, da bo nova ustava nadomestila sedaj veljavne pogodbe, kar bo omogočalo učinkovitejše delovanje Evropske unije. Okrepila se bo tudi vloga Evropskega in nacionalnih parlamentov in s tem tudi glas državljanov Evropske unije.

Kot članica Odbora za kulturo, izobraževanje, mladino in šport še posebej podpiram tiste člene ustave, ki se nanašajo na ta področja. Pomembno se mi zdi, da že v preambuli naglaša pomen evropskega kulturnega izročila, verske in humanistične dediščine Evrope in vrednot, ki Evropo in njene državljane kot take v njihovem bistvu tudi določajo. Med največje cilje sodi tudi spoštovanje bogate kulturne in jezikovne raznolikosti ter skrb za varovanje in razvoj evropske kulturne dediščine.

Ustava zagotavlja svobodo umetnosti in znanosti ter pravico do izobraževanja in usposabljanja, enakost med moškimi in ženskami ter pravice invalidov do vključenosti v življenje skupnosti. Dvaindevetdeseti člen zagotavlja varnost mladih pri delu, triindevetdeseti pa pravi, da družina uživa pravno, ekonomsko in socialno varstvo.

Zapisani členi so dobra podlaga za njihovo uresničitev, kljub temu pa mora Evropska unija narediti veliko več od sprejetja in ratifikacije ustave. Najprej mora ustvarjati pogoje, da bo družina priznana kot vrednota in bodo mladi zakonci imeli možnost za ustvarjanje in preživljanje družine. Če bomo demografske probleme reševali prvenstveno s priseljevanjem, potem je ogrožena naša kulturna dediščina, evropski jeziki, kultura, vera, Evropska unija in evropska civilizacija nasploh - skratka vse to, kar so naše vrednote in kar želimo z ustavo ohraniti in okrepiti. Potem ko smo se v petindvajsetih državah članicah odločili za to skupnost, je tudi prav, da naredimo vse za njeno čim boljše in čim učinkovitejše delovanje.

  Moreno Sánchez (PSE). Señor Presidente, quisiera agradecer a los ponentes su excelente trabajo y manifestar mi pleno respaldo al informe que hoy debatimos.

Mañana daremos en esta Asamblea el visto bueno al texto con el que culmina un proceso constituyente que ha permanecido abierto varias décadas. Ahora bien, nuestra labor no puede detenerse aquí. Nos queda el reto más difícil: su aprobación y ratificación por parte de los ciudadanos europeos. Sin su respaldo, la Constitución no tiene ningún sentido.

Como bien saben sus señorías, los españoles tenemos una responsabilidad particular en este proceso, dado que el primer examen ante la ciudadanía europea se celebrará en mi país el próximo 20 de febrero.

Así, pues, todos tenemos la responsabilidad de explicar el texto constitucional a los ciudadanos europeos, lo que en mi caso incluye a los españoles que residen fuera de España e incluso fuera de las fronteras de la Unión. Por ello, me complace que en mi país la mayoría de los partidos políticos, sindicatos y otros representantes de la sociedad civil nos acompañen y estén plenamente implicados en esta tarea de difusión del contenido y alcance de la Carta Magna, única vía para garantizar una participación elevada y una respuesta positiva en esta cita histórica.

  Caspary (PPE-DE). Herr Präsident! Es war ein langer und schwieriger Weg bis zu diesem Verfassungsvertrag. Einige gute Vorschläge sind dabei über Bord gegangen. Dennoch brauchen wir diese Verfassung jetzt. Sie muss in den Mitgliedstaaten schnell ratifiziert werden.

Die Gründerväter wie Schuman und Adenauer haben das Fundament des europäischen Hauses gelegt. Ihre Nachfolger haben Wände errichtet, Regale gekauft und Aktenordner hineingestellt. Mittlerweile stapelt sich das Inventar bis unter den Dachboden. Es ist die große Aufgabe, dieses Haus zu entrümpeln und fit für die Zukunft zu machen, und dazu dient die Europäische Verfassung. Sie stellt einen Kompromiss dar, der mehr Öffentlichkeit und greifbare Verbesserungen für die europäischen Bürger bringt.

Das bestehende Gemeinschaftsrecht wird in einem Vertrag festgehalten und macht Europa leichter verständlich. Die gemeinsame Handelspolitik wird künftig beispielgebend für das äußere Gesicht unseres Binnenmarktes sein. Die Verkleinerung der Kommission und der neue europäische Außenminister stärken die Handlungsfähigkeit der erweiterten Union. Es gibt mehr Rechte für die Menschen. Die unter Roman Herzog erarbeitete Grundrechtecharta wird in die Verfassung integriert. Das Europäische Parlament wird gestärkt. Der Kommissionspräsident wird von uns gewählt. Es wird künftig hoffentlich Spitzenkandidaten der europäischen Parteien für dieses Amt geben.

Über den Verfassungskonvent haben auch wir Einfluss auf die Verfassung genommen, und Europa wird kein zentralistischer Monsterstaat, sondern subsidiär aufgebaut sein. Auch die Handschrift und das Leitbild der stärksten Fraktion in diesem Haus, der EVP-ED, sind dabei durchaus zu erkennen. Leider konnten wir nicht alle Punkte durchsetzen, für die wir teilweise hart gekämpft haben. Ich bedauere außerordentlich den fehlenden Gottesbezug und die komplizierten Formeln für die qualifizierte Mehrheit im Rat, um nur zwei Beispiele zu nennen.

Ich wünsche uns allen aber, dass diese Verfassung ein Fundament ist, auf dem wir Europa weiter aufbauen können: ein Europa in Frieden, Freiheit und Wohlstand.

  Pīks (PPE-DE). Priekšsēdētāja kungs! Dāmas un kungi! Vispirms es gribu izteikt pateicību godājamiem kolēģiem Inigo Mendez de Vigo un Ričardam Korbetam par lieliski sagatavotu dokumentu - tas ir vienkārši skaidrs un izceļ būtisko.

Godājamie kolēģi, Eiropas Savienības Konstitūcijas izveidošana ir loģiska situācijai, kura vēsturiski izveidojusies mūsdienu Eiropā - situācijai, kāda šobrīd eksistē pasaulē. Neatkarīgi no mūsu gribas pasaulē notiek globalizācijas procesi, bet tie vispirms notiek preču un finanšu kustībā, tas ir, materiālo vērtību sfērā. Daudz lēnāk notiek garīgo un tikumisko vērtību apmaiņa. Es domāju, ka viens no konfliktu iemesliem daudzās vietās mūsdienu pasaulē ir tieši tas, ka pastāv milzīga disproporcija, disbalanss materiālo un garīgo vērtību globālajā apmaiņā. Jaunais Konstitucionālais līgums ir solis ceļā, lai mazinātu šo disproporciju. Šis Konstitucionālais līgums palīdzēs ne tikai mums pašiem skaidrāk saprast, kas mēs esam un kurp mēs virzāmies, bet radīs arī lielāku skaidrību mūsu partneriem globālajā pasaulē, kādi ir mūsu mērķi un kādu vērtību vadīti mēs rīkojamies. Tādēļ es atkārtoju, šī Konstitūcija ir savlaicīga un nepieciešama, neskatoties uz dažiem trūkumiem. Kā vienu es varu minēt to, ko jau teica godājamais Hans-Gerts Poetterings un vairāki citi kolēģi - nav iekļauta atsauce uz kristīgajām vērtībām.

Godājamie kolēģi, atzīstam to mēs vai nē, esam kristieši, ateisti vai musulmaņi vai citādi ticīgie. Tas, ko mēs saucam par Eiropas kopējām vērtībām, ir veidojušās gadu simtiem un balstītas kristīgajās vērtībās.

Dāmas un kungi, mums visiem, gan tiem, kas ir piedalījušies Konstitūcijas veidošanā, gan tiem, kas piedalījušies analīzē un diskusijās, ir pienākums skaidrot mūsu valstu pilsoņiem šī dokumenta būtību, jo mēs nevaram gribēt, lai katrs Eiropas Savienības pilsonis to būtu izlasījis. Diemžēl es gribu brīdināt no tendences, kas vērojama mūsu valstīs: bieži vien līgumu izmanto iekšpolitiskām īstermiņa diskusijām.

Godājamie kolēģi, atturēsimies no šī kārdinājuma, atturēsim savus partiju biedrus! Šis ir ilgtermiņa dokuments, kas vajadzīgs ir mums, mūsu bērniem un arī mūsu kaimiņiem.

  De Poli (PPE-DE). Signor Presidente, onorevoli colleghi, credo che oggi il Trattato costituzionale - la Costituzione europea - diventi una realtà. Il risultato dei lavori della Convenzione, che domani verrà sottoposto al nostro voto, indica la volontà di introdurre più democrazia, trasparenza ed efficacia nelle Istituzioni europee, rafforzandole e conferendo maggior efficacia al processo decisionale. I cittadini sono i veri vincitori, poiché la Costituzione consolida i nostri valori, i nostri principi comuni.

La Carta dei diritti fondamentali del cittadino che l'Unione europea ha pubblicato anche in miniatura - come tutti i libri più preziosi nella storia - è integrata nel Trattato costituzionale. A mio avviso ciò rappresenta una fondamentale indicazione di trasparenza, di solidarietà, di democrazia dei diritti: dei diritti della persona, dei bambini, degli anziani, dei disabili. Credo che stavolta tali principi vengano approvati proprio per portare la nostra Istituzione più vicino alla gente, in mezzo alla gente, per poter dare quelle risposte particolarmente necessarie proprio in questi giorni. Credo, quindi, che la rimozione delle barriere nella società per garantire una piena partecipazione dei cittadini alla nostra Europa unita, sia l'aspetto fondamentale della nostra attività in questi giorni.

  Hannan (PPE-DE). Mr President, the last thing I want to do is to spoil a party. Over the next 48 hours this Parliament will spend hundreds of thousands of euro on celebrating the Constitution. We shall have balloons, a laser display, an orchestra; but I cannot help feeling that all this is a touch premature. In at least ten countries there must be a referendum before ratification. We cannot call the result of those polls with certainty. Not a single ballot has yet been cast. If it were only the party that was premature, it would be rather curmudgeonly of me to object, but we are anticipating the Constitution in other more important ways. We are, for example, pushing ahead with the creation of an EU diplomatic service, a proposal which, pending formal ratification, has no legal basis. In the field of justice and home affairs we have gone even further, pre-empting many of the Constitution's clauses, in particular those to do with the creation of a pan-European legal system and a European public prosecutor. Before the Constitution had even been signed, let alone ratified, the European Court of Justice had indicated that it would treat the Charter of Fundamental Rights as justiciable.

Asked formally by this House what parts of the Constitution they intended to implement without waiting for official ratification, only five of the current Commissioners answered that it would be wrong to anticipate the results of the national referendums. The other 20 all replied in one way or another that they intended to forge ahead at once without waiting for the outcome of the national ballots.

This is meant to be a democratic chamber, but its attitude sometimes recalls Bertolt Brecht's famous couplet 'Let us dismiss the people and elect another in their place'. I hope my country will vote 'no' to the Constitution and I am campaigning to that end, but if I lose, I shall accept the result with good grace. I would urge those of you who support the Constitution to display a similar respect for the democratic process and not to try to implement large parts of this Constitution even if one or more Member States has voted against it. No means no.

  Karas (PPE-DE). Herr Präsident, Frau Kommissarin! Ich möchte mich zum ersten an die Bürger Europas wenden: Machen Sie die Verfassung zu Ihrem Thema! Wir müssen alles daran setzen, dass die Bürger Europas diese Verfassung annehmen, weil diese Verfassung Europa bürgernäher, transparenter, demokratischer, klarer und effizienter macht.

Ich habe den Eindruck, dass wir alle zu schnell wieder zur Tagesordnung übergehen. Die Verfassung liegt auf dem Tisch, aber sie ist noch nicht ratifiziert. Diese Verfassung ist ein politischer Meilenstein für die Europäische Union, ein politischer Meilenstein für mehr Bürgernähe, Transparenz und Demokratie in der Europäischen Union.

Diese Verfassung ist aber bis zur Stunde ein kommunikatives Desaster, und ich mahne daher ein: Wir benötigen ein europäisches Informations- und Kommunikationskonzept aller europäischen Institutionen, der Mitgliedstaaten und der nationalen Parlamente. Ich mahne ein: Wir benötigen eine Woche der europäischen Verfassung in allen Mitgliedstaaten. Ich mahne ein: Wir benötigen die Beseitigung der Einstimmigkeit im Rat und damit die Stärkung des gemeinschaftlichen, transparenten und demokratischen Europa im Sinne des Verfassungsvertrags.

Ich rufe den Regierungschefs zu: "Sorgen Sie dafür, dass der Geist des Konvents, der Geist der Unterzeichnungsfeier in Rom und nicht Kritik- und Sprachlosigkeit, Distanziertheit und Teilnahmslosigkeit die innenpolitischen Debatten bestimmen!" Wir benötigen eine Europäisierung der Verfassungsdebatte und keine Nationalisierung des Ratifizierungsprozesses. Die Verfassung ist nicht bloß eine Handlungsanleitung für die EU-Institutionen, sondern betrifft alle Bürger Europas.

Machen wir jedoch eines klar: Die Arbeit beginnt mit der Abstimmung morgen von Neuem; die Abstimmung muss nur ein deutliches Signal setzen.

  Ventre (PPE-DE). Signor Presidente, grazie a Corbett e Mendez de Vigo che hanno veramente fatto un capolavoro, semplificando la lettura della Costituzione.

Gli antichi giuristi romani dicevano: "ex facto oritur ius" (dal fatto nasce il diritto). Ebbene, se i padri fondatori dell'Europa dal primo giorno in cui hanno incominciato a sognare, hanno incominciato a immaginare questa entità comune. Un'entità unica che riprendeva millenni di storia, di geografia, di società e di valori comuni, ebbene, da quel momento gli stessi padri hanno pensato a regole comuni: a quella che oggi noi chiamiamo Costituzione.

Questo è il motivo per il quale stamattina sono fortemente deluso, nell'ascoltare colleghi autorevoli, di cui ovviamente rispetto la libertà di espressione, esprimere la loro contrarietà al progetto di Costituzione. Si può essere contrari a questa forma di Costituzione, ai contenuti del Trattato costituzionale, ma non a regole comuni, poiché credo che la costituzione di tali regole esalti la sovranità.

Oggi dobbiamo trovare un accordo, in un mondo in profondo mutamento anche nei suoi ordinamenti, nei nuovi dati semantici: sbaglia chi immagina la sovranità così come era concepita nel XVIII e nel XIX secolo. Oggi il nuovo concetto di sovranità sta nella sussidiarietà: è la sovranità delle identità locali, la sovranità dei cittadini, la sovranità di chi è chiamato a concorrere all'edificazione di un ordinamento giuridico per interpretare al meglio i bisogni sempre più vari e sempre più complessi di una società in evoluzione. Non possiamo immaginare di usare la terminologia che i giuristi ci hanno insegnato: Stato federale, Stato confederale, Stato sovrano: l'Europa è un'entità nuova, è un'Unione appunto, nella quale tutti quanti dobbiamo riconoscerci.

Infine vorrei esprimere il rammarico per il mancato richiamo, non soltanto alle radici cristiane, ma anche alla democrazia di Pericle - madre dell'essenza stessa della democrazia - all'impero romano, all'Europa carolingia. Speriamo che nel processo di edificazione dell'Europa queste cose saranno ricordate.

Għall-ewwel darba, 450 miljun ċittadin u ħamsa u għoxrin nazzjon ser jingħaqdu b'dan id-dokument li jiddefinixxi l-valuri u l-principji ta' din l-Unjoni Ewropea.

Ir-ratifika ta' din il-kostituzzjoni ser twassalna għal Ewropa aktar demokratika. Il-karta tad-drittijiet fundamentali tal-bniedem ġiet introdotta f'din il-kostituzzjoni u b'hekk id-drittijiet ta' kull persuna huma elenkati u kull ċittadin jista' jinvoka din il-karta kull meta jaħseb li d-drittijiet tiegħu qegħdin jiġu mkasbra.

Id-drittijiet soċjali huma wkoll prijoritŕ u b'hekk b'ordni legali, id-dritt ta' l-edukazzjoni, id-dritt li kull ċittadin ikollu aċċess għall-informazzjoni, il-protezzjoni fil-każ ta' tkeċċija inġusta u d-dritt li jiġu sanzjonati t-talbiet ta' reviżjoni f'każ ta' diskriminazzjoni fuq bażi ta' klassi kollha ġew definiti u jistgħu jiġu attwati.

  Corbett (PSE), rapporteur. Mr President, in responding to this debate I wish to begin by thanking all those who paid tribute to the work of the Committee on Constitutional Affairs and the report it produced.

It is clear that this Constitution has very broad support across the political spectrum and across Member States. I am hopeful that in the vote tomorrow there will be at least a two-thirds majority in favour of it, with more than 400 votes in favour in this Parliament, and that will send a powerful signal.

Let me also respond to the criticisms that have been made of the Constitution. They seem to be twofold. Firstly, there are those who say they oppose the Constitution because it does not go far enough. They say it will certainly make the EU more democratic, social and so on, but not enough so. My answer to them is that the choice at the moment is between the new Constitution and the old one – our current Treaties. If the new Constitution contains improvements, then it is better to take the new Constitution rather than carry on living with the old one.

That is an argument I would also put to those who complain that there is no reference to Christianity in the new Constitution. There is no such reference in the current Treaties, although they were drafted by Saint Schuman. However, the new Constitution contains a reference to our religious heritage and other heritages, and its values are Christian values and also the values of many others. They are values that Christians, non-Christians, people of other religions and of no religion share.

Many opponents of this Constitution conjure up fears of a superstate; many are opposed to the very existence of the European Union. That is illustrated by those who oppose the supremacy of Union law over the law of Member States, which is after all the current situation. What is the point of agreeing common laws across Europe if one does not want those laws to be applied across Europe? That is the whole point of agreeing common European legislation in the areas we want it, such as the environment and the common market. There is no point in having that legislation if you are against it in the first place. To those people I would say: be honest and campaign for what you really believe in, which is your country leaving the European Union, and do not hide behind attacking the Constitution. What nonsense to say that this new Constitution will create a centralised superstate! Centralised, the European Union? When it is based on a Constitution that confers powers on the European Union with the agreement of every single Member State on the ratification of treaties? That is the only power the Union has. Even in exercising its powers, the Council – i.e. the Member States – has a central role in taking decisions, while the central administration – the European Commission – has fewer employees than the City of Leeds, in my constituency. Some superstate!

Let me conclude by saying that this debate is partly one of myth against reality. I am sure that by broadcasting the facts and enabling a true analysis of the Treaty we will contribute to an honest debate which will persuade people that this Constitution is worth having.

  Schmit, Conseil. Monsieur le Président, Mesdames et Messieurs les députés, je tiens d'abord à féliciter le Parlement pour ce débat constructif et largement positif. Je peux très largement me rallier à ce qui vient d'être dit par un des rapporteurs concernant à la fois la qualité de ce débat et les conclusions qu'il faut en tirer. D'ailleurs, la paternité de ce processus constitutionnel appartient à ce Parlement. C'est d'ici qu'est parti, comme quelqu'un l'a rappelé ce matin, le processus constitutionnel et je voudrais rendre hommage, au nom de la présidence, à Altiero Spinelli qui, avec son projet de Constitution européenne en 1984, a initié et engagé ce processus avec une première étape, qui était l'Acte unique, négocié d'ailleurs sous présidence luxembourgeoise.

Je voudrais aussi dire à ceux qui ont attaqué et critiqué ce projet de Constitution, qu'évidemment, dans un débat démocratique, nous respectons leur position. Mais ce n'est pas avec des discours du XIXe siècle qu'on offre une perspective aux peuples d'aujourd'hui, non seulement européens, mais aussi du monde du XXIe siècle. Le repli sur soi et le retour à des schémas de souveraineté dépassés ne sont pas une réponse dans un monde globalisé. Ils n'offrent aucune solution pour la prospérité, la démocratie et la paix, ni aux Européens ni aux autres.

J'aimerais aussi dire à ceux qui font une distinction subtile entre un non proeuropéen et un non antieuropéen, que c'est un non tout court, puisque le rejet de la Constitution, c'est simplement une défaite de l'Europe, une défaite d'une Europe plus ouverte, plus transparente, plus démocratique, offrant des perspectives à la fois vers l'intérieur et vers l'extérieur, d'une Europe plus forte. Donc, je crois qu'il ne faut pas se perdre dans de telles subtilités. Certes, comme l'a dit le rapporteur, tout n'est pas parfait dans cette Constitution. Nous aurions tous souhaité des améliorations sur tel ou tel point. Mais est-ce que l'essence même de la démocratie, ce n'est pas d'une certaine manière l'imperfection, puisque la démocratie vit du compromis et, donc, il faut être capable d'accepter aujourd'hui un compromis de progrès, pour aller plus loin demain?

La Constitution donne un fondement solide à nos valeurs communes, cela a été dit par plusieurs intervenants. Elle offre un cadre démocratique permettant à l'Union européenne d'agir plus efficacement là où son action est nécessaire en vertu du principe de subsidiarité. La devise de l'Union, "Unis dans la diversité", caractérise, comme cela a été dit, l'essence de cette Europe. L'équilibre entre grands et petits États membres, l'égalité entre citoyens, le respect des identités nationales, qui a été relevé par plusieurs, voilà l'essence même de notre Union, que reflète très bien ce texte constitutionnel.

Il y a des avancées. Elles sont peut-être insuffisantes. Nous aurions voulu aller plus loin sur le volet JAI ou sur le volet de la politique extérieure, mais je crois que c'est une première étape extrêmement importante. Il ne faut pas non plus envisager dès à présent des révisions. Certes, chaque Constitution doit prévoir des mécanismes de révision, comme celle-ci le fait; elle en prévoit d'ailleurs de différents types. Les améliorations viendront au fil des années, à condition que cette Constitution soit adoptée, qu'on soit capable de l'appliquer et de construire, à travers elle, une véritable démocratie européenne.

Ce texte a été élaboré avec une large participation non seulement des parlementaires nationaux et européens et des représentants des États membres, mais aussi des représentants de la société civile. Il y a eu un débat, certes insuffisant, dans la société civile. Il faut encourager et soutenir ce débat, notamment grâce aux procédures de ratification, qui sont déjà achevées dans deux pays, comme cela a été souligné, et qui vont commencer dans d'autres. À cet égard, l'article 1.47, portant sur la démocratie participative est un fait novateur, à tel point qu'on ne le trouve guère dans nos Constitutions nationales. Il s'agit de lui donner vie et de lui conférer un contenu concret. Le débat sur l'adoption de la Constitution a donc commencé: il doit être amplifié. Le citoyen doit y être associé pleinement, qu'il y ait ou non un référendum.

Je rejoins tout à fait ce que la vice-présidente de la Commission a dit au sujet de la communication, de l'explication, des efforts qu'il faut déployer pour mieux faire comprendre l'Europe. La présidence fait sienne cette affirmation. Ce travail doit d'abord – j'insiste – être mené dans les États membres, car c'est là que les citoyens construisent l'Europe. Il nécessite l'engagement de tous: d'abord, des gouvernements et des parlementaires mais aussi – je le répète – des représentants de la société civile. Pendant les mois à venir, la présidence contribuera partout où elle le peut, où elle le doit, à ce processus et favorisera ce débat.

  Wallström, Vice-president of the Commission. Mr President, I would like to thank you all for this long but stimulating debate. The vast majority of the comments have rightly paid tribute to this excellent report and to the work of the co-rapporteurs. Hopefully, it will receive the overwhelming support of this House tomorrow.

I am conscious that this report and the Constitution need to be put into historical perspective. This is the first time that the European Parliament has not had a list of regrets about the result of an Intergovernmental Conference, and we can ask one of the veterans in this kind of work about this. If I compare this report to the Planas, Méndez de Vigo and Tsatsos reports, for example, it is the most positive assessment of the outcome of an Intergovernmental Conference.

I share the views of those calling for a wide and honest debate. Without debate we do not have a democracy and, without debate, we do not get closer to the truth. It is therefore our responsibility to provide examples of how the Constitution will affect the daily lives of European citizens.

The word 'perfect' has been mentioned. I have been a Commissioner for only five years and I have not yet seen the 'perfect' document. If you look around, how could we find a perfect document? We will have to continue to compromise because we are 25 Member States with different traditions, languages, political decision-making procedures and views. We will have to show the will and the capability to compromise. This is a compromise and it will have to be a compromise.

The words used this morning are worth recalling. Most of them are politically loaded – positively or negatively. Many have mentioned rights, democracy, openness, effectiveness and values. Mr Méndez de Vigo reminded us this morning that the Constitution is the unique opportunity to guarantee the values of the Union. We are united in our diversity but with a set of fundamental and social rights that brings us together. These are the values we guarantee not just for us but for our children.

Others have attempted to describe the Constitution as resulting in a European superstate, a loss of national sovereignty, or a weakening of the role of the national parliaments. They have already received a reply from Mr Corbett.

While I expect that we should have to provide concrete facts and examples of the benefits of the Constitution as compared to the Treaty of Nice, I also expect that those talking about national sovereignty or national parliaments should provide some facts. Has the role of national parliaments been weakened? Is it possible to sneak through a European law without supervision by the Member States or national parliaments? We have to be able to respond to those questions. Let us work on the basis of facts and the text of the Constitution. This should be made accessible to our citizens in all the Member States, not just scare stories or misconceptions.

We also have to ensure that we are ready for the entry into force of the Constitution when it is ratified by all Member States. We will shoulder our responsibilities and so must the Member States. It is not enough to hope that adoption in one Member State will lead to automatic acceptance in the next country. That is why in the Council I have pushed so strongly for proper national strategies to be developed.

As Mr Brok has indicated, preparatory work has already begun on the entry into force of the Constitution and the European external action service that will assist the European Minister for Foreign Affairs. We are not exactly jumping ahead, but we have to start to be prepared. We cannot simply wait and let another two years go by before we can implement the provisions. We will have to prepared in the best possible way and find the right balance. I agree that we must ensure respect for the text of the Constitution.

The speeches this morning from Members in the new Member States have illustrated the historic value of the European project and the principles and values that it guarantees. Whether we need a bigger boat, a larger bus or a larger dress size, we all recognise that we have a sense of responsibility. I look forward to joining you in that debate.
