O meu voto favorável neste relatório justifica-se pelo facto de que, em primeiro lugar, forma plenamente respeitadas as regras em vigor, que asseguram a necessária e conveniente participação dos Estados Membros neste processo. E, por outro lado, porque também a apreciação que o Parlamento Europeu fez da candidatura aprovada é favorável.

  Goudin, Lundgren och Wohlin (IND/DEM), skriftlig. Vi motsätter oss dagens gemensamma jordbrukspolitik och vänder oss emot förändringar av ringa principiell betydelse inom det rådande systemet. Vi kräver en samlad översyn och omprövning av hela den gemensamma jordbrukspolitiken och då är det svårt att bryta ut enskilda områden som det ärende som nu är uppe till omröstning.

Vår mening är att kvotsystemet för potatisstärkelse, som nu är uppe till omröstning, absolut inte bör förlängas utan EU måste avskaffa kvotsystem av alla slag inom jordbruket.

  Figueiredo (GUE/NGL), por escrito. Foi hoje aprovada a posição comum sobre a proposta de directiva que a Comissão Europeia apresentou em 2002. Entretanto, foi percorrido um longo caminho, que permitiu incluir vários aspectos que não constavam na proposta inicial.

Na actual versão, estão incluídas muitas situações: profissões assalariadas e liberais, prestação temporária de serviços e as chamadas profissões "regulamentadas (médicos, enfermeiros, arquitectos, etc), embora com diferentes abordagens.

Há, também, um conjunto de alterações cujo objectivo é definir o papel das associações profissionais ligados ao reconhecimento das qualificações, a criação de um comité único responsável pelo reconhecimento, embora defenda que os representantes das profissões sejam representados no novo órgão, sugerindo, igualmente, que seja criado um certificado profissional individual que contenha informações sobre a evolução profissional do trabalhador.

  Goudin, Lundgren och Wohlin (IND/DEM), skriftlig. Vi stödjer strukturer och regler som förhindrar diskriminering på arbetsmarknaden för medborgare från andra länder. Vi är varma anhängare av en rörlig och öppen inre marknad i EU. Vi anser dock att respektive medlemsland skall bedöma vilka yrkeskvalifikationer som ömsesidigt skall erkännas. Direktivet tar tyvärr inte tillräcklig hänsyn till nationella förutsättningar och behov. Utbildningssystemen varierar mellan medlemsländerna och det är därmed svårt att ömsesidigt erkänna praktiskt taget samtliga yrkeskvalifikationer. Vi stödjer det ändringsförslag som förordar att direktivet inte skall gälla notarius publicus.

  Lambsdorff, Weiler und Wuermeling (PPE-DE), schriftlich. Allerdings löst die Richtlinie ein Problem deutscher Berufsqualifikationen noch nicht befriedigend. Nach Änderungen im deutschen Recht führt die Richtlinie zu einer Einstufung von deutschen Gesellen und Meistern in die gleiche Qualifikationsstufe, obwohl der Meister eine langjährige und anspruchsvolle zusätzliche Ausbildung durchläuft.

Eine Höherstufung lässt sich aber noch nachträglich durch die Aufnahme der Berufe in den Anhang II der Richtlinie erreichen. Wir haben dem Kompromiss in der Erwartung zugestimmt, dass der dafür zuständige "Ausschuss für die Anerkennung von Berufsqualifikationen" (Art. 58 der Richtlinie) einen entsprechenden Antrag noch während der Umsetzungsfrist stattgibt.

  Le Pen, Marine (NI), par écrit. – La reconnaissance des qualifications professionnelles au sein de l'Union serait un réel progrès si elle ne s'inscrivait pas dans une stratégie plus large visant à l'élimination des frontières nationales qui sont considérées comme autant d'obstacles à la libre circulation des biens et des personnes. Le nomadisme est désormais promu au rang de valeur communautaire en faisant de la mobilité géographique et professionnelle, l'alpha et l'oméga, du nouvel homme européen.

Le système de reconnaissance des qualifications devra s'adapter aux changements qui pourraient se produire dans le monde du travail ou dans les systèmes d'enseignement, conformément à la philosophie ultralibérale qui anime les institutions européennes. Dans cet esprit, la Commission a défini une politique sociale très particulière qui encourage la qualification et la mobilité des travailleurs sur des conditions minimales de formation censées permettre une meilleure adaptabilité aux marchés du travail.

D'autre part, des organismes réglementaires et professionnels ont exprimé de nombreuses préoccupations concernant l'avenir de certaines professions et la qualité des formations dispensées selon les pays, notamment en matière de santé publique.

Enfin, la directive sur la reconnaissance des qualifications professionnelles est la conséquence de celle sur la libéralisation des services. Autant dire que la directive Bolkestein est plus que jamais d'actualité !

  Lulling (PPE-DE), par écrit. – Nous avons besoin d'une directive relative à la reconnaissance des qualifications professionnelles pour assurer la liberté d'établissement et la libre prestation de services dans le marché unique sans discrimination en ce qui concerne le niveau de qualifications professionnelles. Ce principe n'est pas contesté. Il faut éviter de faire un amalgame avec la fameuse proposition de directive "Bolkenstein" dont l'objectif est de créer un véritable marché unique des services et dont nous discuterons ici-même au cours des prochains mois pour l'amender là où elle doit l'être.

Pour ce qui est des amendements qui nous sont soumis dans le cadre du projet de recommandation pour la deuxième lecture, je partage la préoccupation des milieux artisanaux de mon pays, qui redoutent une dévalorisation des qualifications professionnelles exigées au niveau de l'établissement, non compatible avec la stratégie de Lisbonne et l'importance de la formation y soulignée. Le souci légitime de faire fonctionner un véritable marché unique ne doit jamais conduire à un nivellement par le bas. Il est dans l'intérêt bien compris des entreprises et des consommateurs d'assurer des produits et des services qualifiés. Voilà pourquoi j'ai voté pour les amendements qui ont justement pour but de renforcer la sécurité juridique des agents économiques.

Votámos favoravelmente este relatório, dado que se propõe melhorar o funcionamento das organizações de produtores, pela introdução de um sistema de gestão de crises e pela promoção dos frutos e produtos hortícolas e suas variedades locais, tendo em conta que o seu consumo contribui eficazmente para a saúde pública.

Relativamente às organizações de produtores, sublinho a proposta da relatora sobre a necessidade de fomentar a criação de organizações de produtores em zonas com reduzido nível de associativismo, como é o caso de Portugal. Sublinho, igualmente, a importância que é atribuída à garantia da segurança jurídica das organizações de produtores e à simplificação dos procedimentos de controlo, com o estabelecimento de critérios homogeneizados para a execução dos referidos controlos, efectuados pelas várias instâncias nacionais e comunitárias sobre os programas operacionais.

Sobre a gestão de crises, "a introdução de um sistema eficaz de gestão de crises de mercado para impedir a vulnerabilidade do sector face às fortes quedas dos preços", é um outro aspecto que importa referir como positivo. Já em relação à sua aplicação prática e à referida "caixa de segurança", a mesma deveria ser constituída exclusivamente por fundos comunitários, tendo em conta que essa seria a forma mais equitativa de resolver a situação.

A matéria agrícola é, reconhecidamente, de grande importância para Portugal, devendo o nosso país procurar nestas questões defender um interesse que mais do que específico de uma classe profissional, é ele próprio interesse nacional. Assim, por considerar que a proposta do Parlamento Europeu vai de encontro ao que são os interesses atendíveis das organizações de produtores, e por defender um modelo adequado quanto ao regime de ajuda quanto aos produtos transformados, o meu voto neste relatório foi favorável.

Fuq dan hemm konsensus bejn l-imsieħba soċjali kollha f'pajjiżna.

Jien favur li nillimitaw il-ħin tax-xogħol u li jinħoloq bilanċ aħjar bejn il-ħin tax-xogħol u l-familja. Madankollu tridu tifhmu li f'pajjiżna ma jeżistix suq tal-kera, filwaqt li l-art hija skarsa u tiswa ħafna. Kull nukleu familjari, speċjalment iż-żgħażagħ, jiddejnu eluf kbar ta' liri biex ikollhom post fejn jogħqodu. Jintrabtu b'self għal snin twal fejn iħallsu flejjes kbar, u parti kbira mid-dħul kollu tagħhom inkluż l-'overtime', biex jifdu l-appartament jew id-dar fejn joqogħdu.

  John Attard-Montalto (PSE). Mr President, I wish to explain why I did not vote in accordance with the party line on most of the amendments to the Cercas report. The reason was that, after taking into account informal meetings with the largest trade unions in my country, it emerged that, at present, Malta is not in an economic position to be able to implement the directive on working time.

As explained by my colleague who has just addressed this House, the lower-income social classes would be unable to honour their commitments unless their incomes were supplemented through overtime and other allowances.

Signor Presidente, onorevoli colleghi, ho chiesto a un campione rappresentativo dei venti milioni di pensionati che dall'Italia in buona parte hanno votato perché fossi qui, parlamentare europeo per rappresentarli, come dovevo votare sulla riduzione dell'orario di lavoro. Il campione mi ha risposto: "C'è qualcuno che vuole farci lavorare tutta la vita, tutti gli anni della nostra vita di lavoro, più tanti mesi, più tante settimane, più tanti giorni, più tante ore al giorno possibili e immaginabili, come se non bastasse, vogliono anche farci riscuotere la pensione meno anni possibile, meno mesi possibile, la misura minore possibile. Non abbiamo altro da sperare che di potere, almeno, lavorare il meno possibile durante la giornata lavorativa", pertanto ho votato a favore della relazione Cercas e degli emendamenti che riducono il tempo di lavoro.

  Allister (NI), in writing. I voted against the report on the Working Time Directive because individual workers should lose their right to opt out of the maximum 48 hour working week. This proposal is an intolerable interference with personal freedom of choice and liberty and typifies Brussels' mindset of wishing to dictate every facet of our socio-economic life.

Unfortunately, the amendment to preserve the opt-out clause was defeated and thus the rest of Europe is lining up to foist upon us a Working Time Directive which is largely unsupported within the United Kingdom. This is one of the insufferable burdens of EU membership and a salutary warning against the increasing Brussels' control which the new Constitution would bring upon us, given the socio-economic dogma which it contains in Part III.

  Clark (IND/DEM), in writing. UKIP MEPs voted AGAINST Amendment 37 because the Working Time Directive is already operating and will continue. We therefore aim to mitigate its worst aspects. Currently it is possible to opt-out of the 48-hour week by way of either an individual, or a group, signing an agreement with the employer. The European Commission wishes to retain the opt-outs, the CERCAS report eliminates them.

Amendment 37 was listed as, "Proposal to reject the Commission proposal". By voting against this amendment UKIP was seeking to restore the commission position, hence retaining opt-outs.

  De Keyser (PSE), par écrit. – A l'heure où le Traité constitutionnel exige de la gauche un OUI de combat, je considère que les amendements que le rapport CERCAS a su imposer à la directive sur le temps de travail sont une victoire, tant la pression de la droite était forte. Mais cette victoire ne peut masquer le recul social qui persiste dans le texte voté aujourd'hui. En particulier:

1) l'opt out est maintenu pendant trois ans

2) l'annualisation du temps de travail ne sera plus négociée par les partenaires sociaux. C'est donc un recul sur un thème capital, celui du contrôle de la flexibilité.

3) certes, les périodes de temps "improductif" - garde,...- restent comptabilisées dans le temps de travail, mais des exceptions pourront permettre de les calculer de manière spécifique.

Le Traité constitutionnel veut introduire davantage de dialogue social, mais la directive actuelle le réduit. De plus, cette directive touche à un des acquis fondamentaux des luttes du siècle dernier: la réduction de temps de travail, et la régulation des heures à la journée. C'est la raison pour laquelle, tout en saluant les efforts de CERCAS et du groupe socialiste pour faire reculer l'ultralibéralisme dont la directive porte l'empreinte, j'ai voté pour l'abstention.

  De Rossa (PSE), in writing. I fully support the CERCAS report as a meaningful step towards a 48-hour working week in all 25 member states, from 2010. It will eliminate the current opt-out, and introduce strict new conditions on how "on call" time can be counted towards the 48-hour week. Working time will still be calculated over a 4 month period, with exemptions available to calculate over 12-months - subject to stronger control through collective bargaining.

Proper regulation of working time is a cornerstone for social Europe. It reconciles work and family life and addresses an important health and safety issue.

It is totally wrong that an opt-out is available on health and safety law, and important that it is ended as soon as possible. The greatest risk is that this opt-out is extended to all Member States which would render regulation of Working Time redundant, resulting in a race to the bottom.

The implementation date of 2010 gives both sides of industry time to negotiate new agreements that take account of the 48-hour week. The European Trade Union Confederation (ETUC) fully supports the Report as offering a fair deal to workers across the EU.

  De Vits (PSE), schriftelijk. Ik heb mij onthouden bij de stemming over het rapport Cercas over de herziening van de arbeidstijdrichtlijn. Ook de goedgekeurde compromistekst kan niet als vooruitgang voor het sociale Europa bezien worden. Wij zullen zeer waakzaam moeten blijven om sociale verworvenheden in stand te houden.

1) Het uitgangspunt van de richtlijn is flexibiliteit, niet de gezondheid en de veiligheid van de werknemers.

2) Ook al komt er op termijn (3 jaar) een einde aan de "opt-out" die Lidstaten toestaat van de bepalingen ivm de arbeidstijd af te wijken; dit belet niet dat lidstaten die dit wensen, gedurende 3 jaar de arbeidstijd via individuele contracten kunnen doen bepalen en zo sociale garanties van onderhandelde akkoorden kunnen omzeilen.

3) De annualisering van werktijd kan ook via wetgeving worden doorgevoerd. Hierdoor wordt een exclusief recht voor het sociaal overleg doorbroken.

4) Het EP omschrijft dan wel de waaktijd (aanwezigheidsdienst) als werktijd; maar het inactieve deel van de waaktijd kan wel op een "specifieke wijze" berekend worden (via CAO of wettelijke regeling), zonder dat er garanties zijn voor de betrokken werknemers.

Bovendien dreigt de opdeling tussen actieve en inactieve waakperiode zich ook naar andere sectoren uit te breiden.

Foi positivo que a sessão plenária do parlamento Europeu não tenha aceite uma parte significativa das propostas contidas na posição da Comissão Europeia de nova directiva sobre o tempo de trabalho, dado que é uma das mais perigosas marcas dos ataques aos direitos dos trabalhadores, pondo em causa conquistas de uma luta de mais de 100 anos, afectando milhões de trabalhadores e suas famílias.

Consideramos positivo que tenha sido aprovada a abolição do opt-out três anos após a aprovação de uma nova directiva, para o qual contribuímos.

Mas consideramos negativo que aceite uma classificação de tempo inactivo e não respeite a jurisprudência estabelecida pelo Tribunal de Justiça. Está aberta a possibilidade de uma maior desregulamentação laboral e uma maior dificuldade em conciliar a vida profissional e a vida privada, em proteger a saúde e segurança dos trabalhadores. Igualmente da possibilidade de anualização das horas de trabalho. Daí o nosso voto contra.

Detta är en fråga för parlamenten och arbetsmarknadens parter i varje medlemsland att avgöra. Vi har valt att stödja de ändringsförslag som öppnar för ökat nationellt självbestämmande, men röstar nej till resolutionen i sin helhet.

  Grech (PSE), in writing. In principle I do agree with the majority of views and arguments expressed in this report. However in Malta many workers work long hours because they need to do so either to make financial ends meet or to fulfil other commitments.

In certain areas the Directive is inflexible and would have adverse repercussions on our small Island economy and to all its stakeholders.

The implementation of this report could damage our attempts to try to retain and possible create jobs without eroding the social model.

Workers choice and competitiveness, on the one hand, and the effective delivery of public health care and safety on the other, are both vital for the wellbeing of the Maltese people and it is not possible to trade one of against the other.

Its crucial for Malta therefore, to retain the individual's right to choose to opt out.

This position enjoys broad consensus in Malta, including the trade unions.

A wide spectrum of our population do not see the report as being beneficial for Malta. For these reasons I feel therefore, that is not yet opportune for me to vote in favour of this report.

  Howitt (PSE), in writing. My own region - the East of England - suffers the longest working hours in the U.K., with one-in-ten of people in transport working over 60 hours per week; the same numbers of machine operatives working more than 56 hours per week, of skilled tradespeople more than 53 hours per week; and of construction and storage workers more than 50 hours per week. Just as it was right to bring in the minimum wage to combat the problem of poverty pay, it is now time to call time on excessive working hours, which see workers bullied and exploited, fuel stress and other health problems, and which damage family life. That is why I fully support the end, with necessary safeguards, to the British opt-out from EU Working Time rules.

  Lang (NI), par écrit. – Le rapport Cercas, approuvé, malgré de nombreuses lacunes, par les élus du Front National, demande la suppression de la clause "d'opt out" que la Commission européenne proposait de maintenir. Cette clause permettant à certains Etats membres de repousser la durée légale du temps de travail hebdomadaire au-delà de 48 heures aggravait le dumping social européen. En effet dans une Europe sans frontières, les entreprises françaises soumises aux 35 heures ne pourraient pas résister à leurs concurrents installés dans les pays européens, appliquant la clause "d'opt out".

Cependant ne nous faisons pas d'illusions. L'adoption du rapport de monsieur Cercas n'est qu'une étape. Aujourd'hui en première lecture, le Parlement européen a fait reculer la Commission européenne car beaucoup de députés craignaient la sanction des électeurs français le 29 mai.

  Lienemann (PSE), par écrit. – J'ai voté l'amendement 37 demandant le rejet de ce projet de directive qui conserve les points négatifs de la précédente législation comme l'opt-out et engage l'annulation du temps de travail.

Le rapporteur Monsieur Cercas cherche cependant à manifester l'intention du Parlement Européen d'obtenir l'abandon de l'opt-out d'ici trois ans, véritable poison pour l'avenir du droit social européen. Je crois nécessaire de le soutenir dans ce but. Je ne peux accepter néanmoins qu'en contre partie il permette le calcul des 48 heures maximum sur la base de 12 mois et permette le calcul et l'annualisation du temps de travail, tant exigée par le patronat ainsi qu'une réduction de la prise en compte du temps de garde.

Ce compromis n'est pas satisfaisant et ne constitue en rien une étape de progrès que nous serions en droit de l'Union Européenne. Il consacre même des reculs.

Nous sommes au début de la procédure législative et le vote en faveur du rapport Cercas n'est qu'un soutien à la démarche engagée pour l'abandon de l'opt-out. Néanmoins, à la fin de l'étape de co-décision, je n'approuverai pas un texte de travail sur une base de 48 heures.

Het voorstel van de Europese commissie om de Arbeidstijdenrichtlijn te wijzigen betekent een reële verslechtering voor miljoenen werknemers in Europa De opt-out - blijft terwijl bewezen is dat dat leidt tot langere werkweken en een aanslag op de gezondheid van de werknemers Deze opt out moet zo snel mogelijk, liefst al in 2008, van de baan. Het compromis van Cercas voor het beëindigen van de opt out krijgt mijn steun Het verlengen van de referentieperiode van 4 maanden naar een jaar met pieken van 65 uur per week is een feodaal negentiende-eeuws fenomeen, of dat dachten we. Daarom moeten we vasthouden aan een referentieperiode van 4 maanden. Tot slot moet de uitspraak van het Europees Hof van Justitie op het punt van aanwezigheidsdiensten gevolgd worden

De Commissie komt eenzijdig tegemoet aan de wens van bedrijven om verder te flexibiliseren. In feite is de maximale 48 urige werkweek die we nu kennen al archaïsch. De actuele wekelijkse arbeidstijd is rond 40 uur en de grote meerderheid van de werknemers wil zelfs een kortere werkweek. Daarom pleit ik voor een Europese Arbeidstijden Standaard om te komen tot een verdere herverdeling van werk en een beter samengaan van arbeid, gezin, zorg en educatie.

  Lulling (PPE-DE), par écrit. – Je considère qu'il est nécessaire de modifier la directive de 1993 sur l'aménagement du temps de travail pour mieux répondre aux nouvelles réalités. Mais elle devra assurer un niveau élevé de protection de la santé et de la sécurité des travailleurs, donner aux entreprises une plus grande flexibilité dans la gestion du temps de travail, permettre une meilleure compatibilité entre vie professionnelle et vie familiale.

Cela sonne comme si l'on voulait résoudre la quadrature du cercle. J'estime que notre contribution devrait permettre un allongement des périodes de référence. Je suis pour l'annualisation qui peut aussi intéresser les travailleurs et qui permettra de faire face aux fluctuations de la demande, notamment saisonnière.

Concernant le problème du temps de garde, j'aurais pu vivre avec la proposition de la Commission qui respecte le principe de subsidiarité parce qu'elle stipule que la période inactive du temps de garde n'est pas considérée comme temps de travail, à moins que la loi nationale ou une convention collective n'en dispose autrement.

Enfin, je considère que le maintien de la clause de l'opt-out est incompatible avec l'objectif de la directive.

  Malmström (ALDE), skriftlig. Arbetstid är något som passar sig för nationell lagstiftning och som inte EU bör reglera. Nu finns det emellertid redan ett direktiv på EU-nivå som reglerar arbetstid och detta direktiv syftar till att uppdatera det befintliga direktivet. Folkpartiet har därför röstat för att enskilda regler i arbetstidsdirektivet ska bli så bra som möjligt. Vi har värnat om subsidiaritetsprincipen och om en flexibel arbetsmarknad samtidigt som arbetstagarnas hälsa skyddas.

Tyvärr röstades en massa detaljregleringar igenom som vi tror kan skada småföretag i Europa. Vi röstade därför nej till hela förslaget.

Naar aanleiding van de aanname van amendement 10 heeft de VVD-delegatie gemeend tégen het gewijzigde Commissievoorstel inzake de organisatie van de arbeidstijd te moeten stemmen. Het vanuit Europa voorschrijven dat de totale aanwezigheidsdienst, inclusief wacht- en slaapuren, als arbeidstijd beschouwd moet worden, getuigt volgens de VVD-delegatie van Brusselse bemoeienis. Dit zal het draagvlak voor Europa alleen maar verder doen afkalven, in tijden waarin versterking hiervan juist gewenst is.

He has struck an admirable compromise between the needs of a flexible labour market and the protection of individual workers from the damage long hours can do to their health and safety and work-life balance.

Annualisation of the 48 hour week will allow businesses to cope with seasonal fluctuations, sudden increases in demand or crisis situations.

The employee will be guaranteed reasonable hours over the whole of the year.

Ending the individual opt-out will give protection to those workers who under the present Directive face pressure to sign away their rights.

  Mölzer (NI), schriftlich. Wir befinden uns in schwierigen Zeiten steigender Arbeitslosenzahlen und schwächelnder Konjunktur aus der in der Vergangenheit erfolgreich eingesetzte Rezepte nicht mehr heraushelfen können.

Das „Normalarbeitsverhältnis“ wird im zunehmenden Maße atypisch, unsere Gesellschaft immer flexibler - was sich auch in neuer Arbeitszeitgestaltung wie Teilzeit oder Zeitkonten widerspiegelt. Wer Karriere machen will, muss einfach flexibel sein.

Zeitgleich stehen wir jedoch auch vor dem Problem eines zunehmend kinderlosen Europas. Es wäre ein katastrophaler Fehler, diese Entwicklung mittels Zuwanderer korrigieren zu wollen. Der springende Punkt wird jedoch im verstärkten Maße die Vereinbarkeit von Arbeit und Familie sein.

Berufliche und familiäre Aufgaben unter einen Hut zu bringen, befördert Eltern oft an die Grenze ihrer Belastbarkeit. Flexible Arbeitszeiten können sich für Unternehmen und Familie nur dann lohnen, wenn wir die Rahmenbedingungen wie Kinderbetreuungseinrichtungen entsprechend anpassen, um dieser Entwicklung Rechnung zu tragen. Denn wenn Väter und Mütter mit kleinen Kindern sich teilweise aus dem Berufsleben zurückziehen müssen, ist der Zug für Europa vielleicht schon abgefahren.

  Moraes (PSE), in writing. Today the European Parliamentary Labour Party voted in favour of a compromise package on working time proposed by the PES the EPP groups in the European Parliament. It will now be put to the governments in the EU Council for consideration. It is in line with our vote in 2004 and supports the principle at the heart of this directive, the health and safety of workers and the aim to reconcile work and family life and increase productivity.

The EPLP understands the adjustment difficulties faced by the United Kingdom and others, but thanks to certain flexible provisions in the report, such as the extended reference period of 12 months, these difficulties are overcome.

We recognise that on call time is the same as working time, as ruled by the ECJ in the SIMAP and JAEGER cases. These landmark rulings have implications for the NHS and member states' health care systems, but by allowing member states themselves to calculate this part of working time, the compromise package we have achieved is sufficiently flexible.

The EPLP hopes a positive vote at the first stage of the process will ensure the adoption of a report on working time that safeguards workers' health and safety, makes work-life balance a reality whilst containing the requisite degree of flexibility.

O facto de ter havido uma clara contradição entre o sentido de voto maioritário na comissão parlamentar responsável pelas matérias do emprego e na comissão parlamentar responsável pelas matérias da indústria é, por si só, sintomático do desequilíbrio que se podia encontrar na versão colocada a votação, e em muitas das emendas propostas.

Pela minha parte, confio num modelo que seja, antes de mais, fiel depositário de um princípio de subsidiariedade, deixando aos Estados Membros suficiente margem de manobra para que adaptem as regras do tempo de trabalho à realidade da sua economia. Trata-se, de defender o respeito pela adequação à economia real, e às necessidades específicas de cada país e de cada circunstância, sabendo que o essencial está assegurado, pois tal faz parte, designadamente no caso português, dos princípios orientadores da legislação nacional.

De resto, a excessiva rigidez de qualquer regulamentação nesta matéria é prejudicial para a economia, para as indústrias e os serviços e, por isso mesmo, tanto para os trabalhadores como para os que não têm trabalho e procuram tê-lo.

  Sinnott (IND/DEM), in writing. In the Working Time Report and every work related report, I look to see if the largest work force in Europe, home carers are included. They aren't.

This is particularly sad because a document that deals with the amount of hours someone works in a week applies to them more than any other group of workers in the EU. We could and should have looked at issues like "on call time" in relation to home carers. This is more than a missed opportunity. It is discrimination and exclusion of people who work long, long hours, people who are always on call.

Can we resolve that we will examine the situation of carers and that we will include them in our recommendations on work in future, and that we will no longer discriminate against this important workforce which is already discriminated in the area of pay.

  Szymański (UEN), na piśmie. Moje stanowisko jest podyktowane przekonaniem, że regulacja tak ważnego aspektu ustroju społeczno-gospodarczego państw europejskich jak tygodniowy wymiar czasu pracy nie powinna być regulowana na poziomie europejskim.

Czas pracy należy zagadnień prawa pracy, które w każdym demokratycznym kraju jest przyjmowane przez parlament, reprezentujący wszystkie zainteresowane strony procesu pracy. To wystarczająca gwarancja dla poszanowania praw pracowników i pracodawców.

Dzisiejsze głosowanie to czarny dzień dla europejskiej przedsiębiorczości i dobrobytu. Parlament głosami lewicy i liberałów przegłosował zaostrzenie dyrektywy o czasie pracy, która będzie teraz jednym z najbardziej szkodliwych fragmentów prawa europejskiego. Zdecydowano się przenieść złe doświadczenia gospodarki francuskiej i niemieckiej na wszystkie kraje, także te, które jak Polska, Wielka Brytania, czy Irlandia tego nie chcą. Ograniczenia w tygodniowym czasie pracy oraz zaliczenie dyżurów do czasu pracy uderzą najszybciej w lekarzy, pielęgniarki i część dziennikarzy. Następnie odcisną się dalszym spadkiem konkurencyjności całej gospodarki europejskiej.

Przywoływanie przez Parlament Europejski strategii lizbońskiej jest w tym wypadku szczytem hipokryzji.

  Τούσσας (GUE/NGL), γραπτώς. – Η Ευρωκοινοβουλευτική ομάδα του ΚΚΕ καταψηφίζει την οδηγία για την "οργάνωση του χρόνου εργασίας", γιατί αποτελεί ρεβανσιστική επίθεση της ΕΕ, των αστικών κυβερνήσεων και του κεφαλαίου στα δικαιώματα της εργατικής τάξης.

Οι προτάσεις Επιτροπής και εισηγητή έχουν στόχο την υπονόμευση του χρόνου εργασίας με την εισαγωγή δύο νέων όρων: α)του ενεργού χρόνου εφημερίας και β)του ανενεργού χρόνου εφημερίας και την παραπέρα ελαστικοποίηση του εργάσιμου χρόνου για την αύξηση των κερδών του κεφαλαίου.

Ο χρόνος που καθορίζεται ως "ανενεργός περίοδος εφημερίας" δε λογίζεται ως χρόνος εργασίας, παρ'ότι ο εργαζόμενος θα είναι στη διάθεση του εργοδότη!

Έτσι ανοίγει το κουτί της Πανδώρας για να τιναχθεί στον αέρα το εργατικό δίκαιο. Ο ορισμός του χρόνου εργασίας και η διάρκεια της εργάσιμης ημέρας αποτέλεσαν ζητήματα πολύχρονων ταξικών συγκρούσεων εργατικής τάξης και κεφαλαίου.

Οι συνέπειες για την εργατική τάξη είναι οδυνηρές. Περισσότερη απλήρωτη δουλειά, όποτε και όπως επιβάλλουν οι ανάγκες της καπιταλιστικής παραγωγής, υπονόμευση των Συλλογικών Συμβάσεων Εργασίας, εντατικοποίηση της δουλειάς, αύξηση εργατικών ατυχημάτων, χειροτέρευση των όρων ασφάλισης και συνταξιοδότησης, δραστικός περιορισμός του ελεύθερου χρόνου για κοινωνική δράση, αποδιοργάνωση της οικογενειακής ζωής.

Το ΚΚΕ συμβάλλει στην ανασύνταξη και την ενίσχυση του ταξικού προσανατολισμού του εργατικού κινήματος για ριζικές αλλαγές, για να ικανοποιηθούν οι σύγχρονες ανάγκες της εργατικής - λαϊκής οικογένειας.

Min huvudinriktning i samband med detta direktiv är att denna typ av frågor i första hand hör hemma på medlemsstatsnivå. När därför förslaget om opt-out röstades ned - en regel som därtill ej tillämpas i Sverige - samt förslaget om att beräkna genomsnittlig arbetstid på längre tid än fyra månader förkastades, fann jag det lämpligt att rösta emot hela förslaget.
