  Claude Moraes (PSE), rapporteur. Mr President, this report on the protection of minorities and anti-discrimination policies in an enlarged European Union is an extremely wide report. From the title, Members of this House could see almost immediately that we in the Committee on Civil Liberties, Justice and Home Affairs were dealing with two very big areas.

Firstly we were dealing with extending and deepening the definition of what it means to be a minority in the enlarged European Union. But we were also dealing with unfinished business: we were dealing with the response to the Green Paper on anti-discrimination. Both areas are extremely wide and probably required reports of their own, but we have tried to put these issues together in one report and I hope I have touched on the key issues, however difficult they have been.

Because this has been a difficult report, I want to thank at the very outset the shadow rapporteurs and other colleagues in the Chamber today for all their help in meeting the aims of this report. It has been difficult and there are one or two issues still to be sorted out before the vote tomorrow.

But let me return to the substance of this report. I care very passionately about ensuring that there is a definition of what it means to be a minority in the new enlarged European Union. We know that the protection of minorities was part of the Copenhagen criteria for enlargement of the European Union, but equally we realise that there was no real standard for minority rights in the European Union and in Community policy. And because of this gap, we wanted to ensure that this report took at least one step forward in attempting to make that definition.

That definition is a very wide one. It includes all the traditional definitions that we understood in the existing 15 Member States under Article 13 of the Treaty, where we talked about minorities which suffered from disabilities, the issue of age, religion, sexual orientation, race and ethnic origin. But in the enlarged European Union we also have to understand that we are talking about traditional minorities: linguistic minorities and national minorities.

It is also important to understand the changing nature of the European Union. A recent debate in this House on the Roma identified that minority as probably the largest in the European Union and deserving of a rapid and deep response to the problems that they face.

So this report tries to take on two areas. I shall deal with each of them. First, the response to the Green Paper and Article 13. Here in my report I find that the implementation and transposition of the existing directives which the Commission brought forward and this Parliament voted through, and the strengthening of legislation in relation to discrimination on the grounds of disability, age, religion, sexual orientation, race and ethnic origin, was far too slow. Too many Member States have failed to implement existing directives, and although the legislation is very good and some Member States have transposed it, there is insufficient will in the European Union to transpose what already exists. I hope this report will take one step further with the Commission – and I know the Commission has been making strides on this in bringing Member States to account, but I hope that Member States will see for themselves the benefit of transposing this legislation.

Article 13 legislation, the race equality directive and the employment directive are valuable because they can apply equally to the Roma minority, as they do to second or third generation ethnic minority migrants in Britain or France or Italy. And that is the beauty of this legislation: it is easy to transpose. But it needs the political will of the Member States in order to implement it.

On the definition of minorities, here we have to take seriously the question of traditional, national and linguistic minorities. We have to understand that there are many people in the European Union who want to protect their diversity, but they feel they are a minority and therefore vulnerable. This report seeks to look at those areas, not to impose solutions on Member States, but to have a standard in the European Union that says that if you are a minority you are also a European Union citizen worthy of respect and worthy of carrying on your own cultural traditions, language or whatever it may be.

Finally I want to say that this has been a difficult report but we have to identify that the way any Member State treats its minorities is a measure of how advanced that Member State really is. This is a very important test. We saw it in the Copenhagen criteria and we should see it today: that a Member State can be measured by how it protects its minorities, how it protects diversity within its population. We in the European Union already have the legislation to do this. We must use it, and we must develop a definition of minorities which everyone can accept. There have been difficulties in this report, but I hope that definition will be broadly acceptable to all Members across this House.

  Vladimír Špidla, člen Komise. Vážený pane předsedo, vážené paní poslankyně, vážení páni poslanci. Především bych rád poděkoval panu Moraesovi za vynikající zprávu a parlamentním Výborům pro občanské svobody a pro zaměstnanost za jejich cenné příspěvky.

Prosazování základních práv, boj proti diskriminaci a rovné příležitosti jsou pro Evropskou komisi prioritou. Předseda Komise Barroso ve svém podnětu zřídil skupinu komisařů, která má politický program Evropské unie v těchto oblastech rozvíjet. Váš zpravodaj, poslanec Evropského parlamentu pan Claude Moraes, nás upozornil na potřebu dalších kroků při řešení problematiky diskriminace a postavení menšin v Evropské unii. Komise řadu obav, o kterých se pan Moraes a další poslanci zmínili, sdílí.

Již dnes patří protidiskriminační právní předpisy Evropské unie mezi nejrozvinutější na světě. V roce 2000 byly přijaty dvě významné směrnice, které zakazují diskriminaci na základě rasového či etnického původu, náboženského vyznání nebo přesvědčení, věku, zdravotního postižení nebo sexuální orientace. Tyto směrnice rozšířily rozsáhlý soubor právních předpisů Společenství v oblasti diskriminace na základě pohlaví.

Jak Váš zpravodaj správně podotkl, hlavním úkolem teď pro nás bude zajistit, aby tyto předpisy účinně fungovaly v celé rozšířené Evropě, tzn. že je potřeba završit proces provádění předpisů na vnitrostátní úrovni. Některé členské státy však stanovené lhůty dosud nedodržely. Komise chápe svou úlohu strážkyně smluv této oblasti velmi vážně a již zahájila několik řízení o nesplnění povinnosti.

Rovněž musíme zajistit, aby si lidé byli vědomi svých práv a byli schopni je využívat. Osvěta je pro Komisi prioritou a proto navrhujeme, aby Evropská unie vyhlásila rok 2007 Evropským rokem rovných příležitostí pro všechny. Tento evropský rok bude významnou příležitostí k mobilizaci všech zúčastněných subjektů a ke zdůraznění přínosu evropské rozmanitosti pro hospodářství i pro společnost jako celek. Doufám, že se můžeme v případě tohoto návrhu spolehnout na podporu Evropského parlamentu a na Vaši aktivní účast v tomto evropském roce.

V roce 2004 pořádala Evropská komise široké veřejné konzultace na základě Zelené knihy o rovnosti a nediskriminaci v rozšířené Evropské unii. Vnitrostátní orgány, subjekty zabývající se rovností, nevládní organizace, sociální partneři, ale i široká veřejnost zaslali přes 1500 reakcí. Jsme velmi rádi, že dnes v otázkách, kterými se Zelená kniza zabývala, můžeme zohlednit i stanoviska a reakce Evropského parlamentu.

V návaznosti na tuto Zelenou knihu přijala Komise sdělení o nediskriminaci a rovných příležitostech pro všechny. Toto sdělení popisuje rámcovou strategii pro budoucí činnost v této oblasti. Tato strategie sahá za hranice pouhé ochrany práv jednotlivců a zkoumá, jak může Evropská unie podpořit pozitivní opatření na podporu integrace skupin, které stojí před závažnými strukturálními překážkami, jež jim brání do zapojení se do společnosti.

Komise rovněž posoudí význam a proveditelnost případných nových opatření, která by doplnila stávající právní předpisy Evropské unie v oblasti boje proti diskriminaci. Tato studie zohlední poměrné výhody legislativních a nelegislativních opatření, náklady a přínosy různých alternativních politik, ale i potřebu dbát na to, abychom neotvírali diskuze o stávajícím právním rámci a neriskovali tak oslabení současné úrovně ochrany před diskriminací.

Komise je zejména znepokojena mimořádně vážnou situací vyloučení a diskriminací rómských komunit v oblasti celé Evropské unii, ale i v přístupových a kandidátských zemích. Evropská unie se tyto otázky již snaží řešit, a to například pomocí svých předpisů proti diskriminaci a cíleným využíváním finančních prostředků Evropské unie. Jde však o oblast, kde Unie nemůže jednat samostatně. Je zde zapotřebí společného úsilí mezinárodních organizací, vnitrostátních orgánů členských států a zástupců občanské společnosti. Souhlasím však, že bychom měli posoudit, jak lze účinněji využívat politiky a programy politické Unie k podpoře začlenění Rómů.

Jak již potvrdil pan předseda Barroso, touto otázkou se na jednom ze svých nadcházejících zasedání bude zabývat skupina komisařů pro základní práva, nediskriminaci a rovné příležitosti.

  Μαρία Ματσούκα (PSE), Εισηγήτρια της γνωμοδότησης της Επιτροπής Απασχόλησης και Κοινωνικών Υποθέσεων. Κύριε Πρόεδρε, αγαπητοί συνάδελφοι, κατ' αρχήν θα ήθελα να συγχαρώ το συνάδελφο κ. Moraes για τη γενναία του προσέγγιση στο θέμα των διακρίσεων.

Ως εισηγήτρια εκ μέρους της Επιτροπής Απασχόλησης και Κοινωνικών Υποθέσεων, θα ήμουν ευτυχής, εάν σήμερα ήμασταν σε θέση να μιλάμε για ανάπτυξη, συνεργασία, αλληλεγγύη, ανεκτικότητα, ορθολογική και δίκαιη κατανομή του παραγόμενου πλούτου.

Δυστυχώς όμως όλα αυτά μοιάζουν μάλλον με θεωρητική προσέγγιση της πραγματικότητας, η οποία σε κάθε της έκφραση ξεδιπλώνει ανησυχητικά ολοένα και περισσότερες μορφές διακρίσεων. Το όραμα βρίσκει παντού έναν ισχυρό αντίπαλο.

Είναι ακριβώς ο οικονομικός φιλελευθερισμός η βασικότερη αιτία που συντελεί στην όξυνση των οικονομικών ανισορροπιών, που προωθεί την ατομική δραστηριότητα σε βάρος της κοινωνικής συλλογικότητας. Είναι ο οικονομικός φιλελευθερισμός, ο βασικότερος παράγοντας, που ενισχύει τις τάσεις ξενοφοβίας, που δυναμιτίζει τις εργασιακές σχέσεις και δημιουργεί νέες στρατιές ανέργων, που ισχυροποιεί ένα ιδιότυπο κοινωνικό ρατσισμό κατά των ηλικιωμένων και των αναπήρων. Είναι λοιπόν ο οικονομικός φιλελευθερισμός ο σημαντικότερος σύμμαχος των διακρίσεων, την καταπολέμηση των οποίων οφείλουμε να θέσουμε στο επίκεντρο της πολιτικής μας πρακτικής.

Είναι εξάλλου προφανές ότι πίσω από την πρόσφατη άρνηση του γαλλικού και του ολλανδικού λαού να αποδεχθούν το σχέδιο της Συνταγματικής Συνθήκης κρύβονται αιτίες που συνδέονται στενά με κάποιες από τις υπάρχουσες μορφές κοινωνικών διακρίσεων, όπως η ανεργία, η φτώχια, η ανησυχία για το μέλλον του κράτους-πρόνοιας.

Συμπερασματικά, πέρα από τα θεωρητικά κείμενα, οφείλουμε να προχωρήσουμε στην ουσία, στην πράξη. Οφείλουμε να παραδώσουμε στις επόμενες γενιές μια κοινωνία που το χρώμα, το θρήσκευμα, το φύλο, η καταγωγή, οι σεξουαλικές προτιμήσεις δεν θα αποτελούν αιτίες διακριτικής μεταχείρισης. Οφείλουμε να παλέψουμε για μια Ευρώπη κοινωνική, ανθρωποκεντρική, μια Ευρώπη της συμμετοχής, επενδύοντας στην παιδεία, στην πλήρη απασχόληση, στην ποιότητα ζωής, στην εξάλειψη της φτώχιας. Το οφείλουμε στα παιδιά όλου του κόσμου.

  Edit Bauer, a PPE-DE képviselőcsoport nevében. A jelentéstevő az adott esetben úttörő munkát végzett, amit szeretnék neki megköszönni. Igaz, az antidiszkriminációról több jelentés is szól, a mostani azonban egy lépéssel túlhaladja az előbbieket. A kisebbségek védelme több, mint a diszkrimináció egyszerű tiltása, közelebb viszi a politikai golndolkodást az egyenlő esélyek megteremtéséhez. A két téma összekapcsolásából azonban számos probléma is adódik, így a jelentés egy kicsit túlméretezetté vált, a téma összetett, így rengeteg az új összefüggés, amelyet a jelentés vizsgál.

A jelentés először szól a kisebbségek védelméről. Mivel a kisebbségi jogok az emberi jogok szerves részét képezik, ezek pedig az európai térség vitathatatlan alapértékei közé tartoznak, nem kétséges, hogy a kérdés napirendre kerülése fontos és elkerülhetetlen. A bővülő Európában ez olyan téma, mellyel kapcsolatban méltán merül fel a kettős mérce problémája. Míg a koppenhágai kritériumok világosan megfogalmazzák az EU elvárásait a kisebbségvédelem területén, a tagországokat idáig semmi sem kötelezte a kisebbségpolitikájuk megfelelő alakítására. Fennáll az a veszély, hogy esetleg az új tagországokban, melyek kisebbségpolitikájukat európaivá formálják a csatlakozás előtt, a nacionalizmus erősödésével a folyamat nemcsak megtorpan, de felerősödhetnek a kisebbségellenes megnyilvánulások. Ezért ugyancsak hiányzik a monitorozó rendszer.

A jelentés készítése során felmerülő speciális problémák – melyek egyrészt a kisebbségek különböző helyzetéből, másrészt az emberi jogok univerzalitásából adódnak –, pedig egyértelműen azt jelzik, hogy ilyen politikára az Unión belül szükség van. Csak támogatni tudom a jelentésnek azon részét, mely kiemeli, hogy ennek a politikának az európaiság alapelvein, a szubszidiaritáson és az önkormányzatiságon kell alapulnia.

  Martine Roure, au nom du groupe PSE. Monsieur le Président, une des premières attentes des citoyens de l'Union européenne est une meilleure protection de leurs droits. Chacun sait en effet que le droit de parler et d'écrire, de choisir ses représentants et de vivre selon son choix peut ne pas avoir de sens pour celui et celle qui, dans son existence quotidienne, ne dispose pas des moyens matériels d'assurer sa dignité.

L'insertion de la Charte des droits fondamentaux dans le traité constitutionnel constitue un progrès significatif pour les citoyens européens. Elle rappelle que la protection des droits des citoyens est au coeur de la construction européenne et le premier article rappelle la primauté de la dignité. La Charte est ainsi également dotée d'une réelle portée juridique. Espérons qu'elle le sera.

Le rapport de mon collègue, Claude Moraes, rappelle l'importance des droits fondamentaux et, en particulier, de la protection des minorités dans l'Europe élargie. Nous constatons malheureusement que l'article 13, qui fixe pour mission de la Communauté la lutte contre toutes les discriminations, et la législation européenne dans ce domaine sont mal ou partiellement mis en oeuvre par les États membres. Il est donc, avant tout, absolument nécessaire d'assurer une meilleure transposition, une meilleure application de la législation européenne dans ce domaine. Nous pensons par ailleurs qu'une lutte efficace contre les discriminations va de pair avec une politique européenne d'intégration commune et cohérente.

Enfin, la pauvreté et l'exclusion sociale constituent une forme de discrimination et l'éradication de la pauvreté doit faire partie de la politique de lutte contre les discriminations. Nous devons mettre en place des mécanismes afin que les personnes exclues et en situation de pauvreté aient un accès approprié à l'emploi, au logement et soient représentées au sein des organes politiques.

  Sophia in 't Veld, on behalf of the ALDE Group . Mr President, I should like to congratulate the rapporteur on a tremendous and at times nerve-racking job that he has been doing. He has been working on very interesting subjects. With the enlarged European Union we are looking at completely new questions. I have personally come to realise that where the United States might be a melting pot, the European Union is a very rich, colourful and beautiful mosaic of diversity. It is something to be proud of and to cherish. We have taken the first steps on the path of a very important discussion.

The European Union has to respect minority rights, but we should not forget that ultimately each citizen is also an individual and each citizen is therefore entitled to the same rights; secondly, that the European Union should respect the cultural identity of minorities and, at the same time, we must ensure that does not prevent full integration and participation in the community.

With regard to the issue of non-discrimination, unfortunately after so many years it is still necessary to have this debate. As the previous speaker said, there are still many groups, such as women, who face discrimination and who lag behind.

I should like to focus, in particular, on one paragraph that raised some concerns: the paragraph on the rights of gay people. We should be fair to ourselves here. Fundamental rights are for all citizens, not just for some groups. If we are serious about the Charter of Fundamental Rights, that says we should not discriminate on grounds of sexual orientation, then we cannot possibly vote for the amendment tomorrow that seeks to delete a paragraph on homophobia and obstacles to freedom of movement.

This morning we talked about terrorism and the right balance with fundamental rights. I would therefore hope that this House will wholeheartedly endorse this report tomorrow.

  Tatjana Ždanoka, on behalf of the Verts/ALE Group . Nowadays, when the crisis of the process of European integration has become evident, I recall the following words of Yehudi Menuhin: ‘Either Europe will become a Europe of cultures or Europe will die’. He said that in January 1999 when opening an exhibition devoted to European minorities. All of us regularly pass the room where this exhibition took place and which now bears his name.

We are discussing today and will tomorrow vote on the report on the protection of minorities and non-discrimination policies, which is absolutely essential for the future of the Union. This report, as adopted by the Committee on Civil Liberties, Justice and Home Affairs, is an excellent text showing a real ability to develop the Union as an area in which fundamental rights, including minority rights, are protected effectively. Nevertheless this report has been supported by little more than half of the Members of the Committee. Moreover it seems that the same split of opinions is taking place all over Parliament.

Why is this so? Maybe the reason is that many of us have a differing or indeed no understanding of minority rights. Surprisingly, we have a consensus when it comes to a number of resolutions telling those outside the EU how to respect human rights and develop democracy, yet we are not ready to support the text saying that these rights have to be respected inside the Union.

Why do we keep silent when the Member States ignore the spirit of the international treaties protecting human rights, for example, the Framework Convention for the Protection of National Minorities?

I believe that tomorrow the majority of Parliament will support the text as it has been accepted by the Committee and therefore will support the Europe of cultures.

  Giusto Catania, a nome del gruppo GUE/NGL. Signor Presidente, onorevoli colleghi voglio ringraziare il collega Moraes per il buon lavoro nella preparazione di questo testo, perché in Europa abbiamo concretamente bisogno di proteggere le minoranze e di produrre iniziative attive contro le discriminazioni. Presumo che proprio in queste ore tutti i colleghi siano stati oggetto di vere e proprie azioni di lobby da parte di cittadini dell'Unione europea, che ci chiedevano addirittura di sopprimere alcuni paragrafi della relazione Moraes.

Ci diciamo spesso difensori delle minoranze, salvo poi dimostrare tanta ipocrisia quando si tratta di libertà religiosa o di riconoscimento della libera circolazione e dei matrimoni omosessuali. Alcuni temi sono tabù: è per esempio notizia di oggi che addirittura a Catania, città civile dell'Italia, è stata negata la patente a un cittadino italiano perché omosessuale. Credo che questo fatto la dica lunga anche sul livello di garanzia che dobbiamo attivare contro le discriminazione e che sia anche utile avviare un'iniziativa volta ad assicurare che, nei confronti delle minoranze, sia garantita una vera e propria azione di cittadinanza e non solo di tolleranza.

  Johannes Blokland, namens de IND/DEM-Fractie. Voorzitter, ik ben destijds geen voorstander geweest van het opnemen van artikel 13 in het EG-Verdrag. Niet omdat ik discriminatie goedkeur, integendeel, maar omdat het onwenselijk is dat dit op Europees niveau wordt geregeld. Het is aan de lidstaten om goede regelgeving te treffen. Het verbaast mij niet dat collega Moraes in zijn verslag constateert dat de lidstaten met de uitvoering van dit beleid geen haast maken. De EU-aanpak heeft kennelijk geen meerwaarde. Het hebben van een geloofsovertuiging is geen individuele aangelegenheid. Het is eigen aan een geloofsovertuiging deze te belijden in een gemeenschap en tot uiting te brengen in je levenshouding. De wijze waarop in paragraaf 22 de suggestie wordt gedaan dat in het onderwijs discriminatie op grond van godsdienst plaats zou vinden, gaat voorbij aan de betekenis van de geloofsovertuiging voor de identiteit van het onderwijs.

Ten slotte, ik ben collega in 't Veld erkentelijk voor amendement 4. Discriminatie van christenen mag met eenzelfde intensiteit bestreden worden als andere vormen van discriminatie.

  Romano Maria La Russa, a nome del gruppo UEN. Signor Presidente, onorevoli colleghi, innanzitutto mi congratulo con la relatrice per l'impegno profuso nella stesura della relazione, che però ritengo ancora incompleta e sicuramente poco efficace. La protezione dei diritti fondamentali, che ha costituito un elemento cardine della costruzione europea, e la Carta dei diritti fondamentali, proclamata a Nizza nel 2000, ribadiscono l'importanza nonché la necessità di una politica coerente d'integrazione, volta a proteggere le minoranze e a favorire l'integrazione dei cittadini di paesi terzi, soprattutto alla luce del recente allargamento.

Noi tutti concordiamo nel dire che la discriminazione è un fenomeno da combattere, che tutti gli uomini debbono godere di uguali diritti e che nessuno debba sentirsi discriminato per motivi razziali, etnici, religiosi o altro. Tuttavia, ritengo che l'inclusione sociale degli immigrati, la protezione delle minoranze e delle diversità culturali – obiettivi prioritari della Costituzione europea – non debbano essere raggiunti sempre e comunque a qualsiasi prezzo. Consentitemi di esprimere i miei dubbi verso quelle comunità di immigrati che mostrano chiari segni di insofferenza – per non dire di disprezzo – nei confronti del paese ospitante, delle sue tradizioni, della sua storia, della sua cultura; verso coloro che rivendicano un'illegittima autonomia e ritengono loro diritto non rispettare le leggi dello Stato in cui soggiornano, spesso illegalmente. Sono loro i primi a non volersi integrare.

Occorre certamente regolarizzare gli immigrati, permettendo a chi è in regola di non essere discriminato, purché manifesti chiaramente la volontà di inserirsi e di contribuire attivamente allo sviluppo economico e sociale di chi li ospita. Garantendo, invece ad ogni costo, ogni sorta di diritto – sistematicamente e incondizionatamente – vi è il rischio che gli unici a sentirsi discriminati saranno i cittadini europei, che assolvono tutti gli obblighi fiscali e sociali nei confronti dello Stato, nel rispetto delle regole.

Infine, per quanto riguarda il paragrafo che tratta l'omofobia e le coppie omosessuali, debbo dichiarare, naturalmente, la mia totale contrarietà, ritenendo "famiglia" solo quella tradizionale: un papà maschio, una mamma femmina e i figli come vengono, maschi o femmine. Purtroppo, il tempo a mia disposizione è finito ma avrei voluto approfondire, come credo valga la pena, tali argomenti in quest'Aula.

  Csaba Sándor Tabajdi (PSE). Monsieur le Président, je voudrais féliciter M. Moraes pour son excellent rapport et si les nationalistes et les homophobes s'en prennent à vous, Monsieur Moraes, n'ayez pas peur, ce sera la preuve que vous avez préparé un très bon rapport.

En tant que président de l'intergroupe pour les minorités nationales traditionnelles, je voudrais souligner les choses suivantes. Premièrement, l'Union européenne n'a pas de système de protection des minorités nationales. Il faut établir des normes, des standards juridiques et politiques pour la protection des minorités nationales et pour un système de suivi, un monitoring system comme Mme Bauer l'a proposé dans son avis.

Deuxièmement, il faut distinguer les minorités nationales traditionnelles du rapport de M. Moraes, des minorités migrantes du Conseil de l'Europe. J'ai proposé de nommer les minorités migrantes comme nouvelles minorités. Les droits fondamentaux sont indivisibles, mais les obligations de l'État sont différentes: pour les minorités traditionnelles, il faut garantir la sauvegarde de l'identité et la langue; pour les minorités migrantes, il faut garantir l'intégration dans la société.

Troisièmement, il faut clarifier, dans l'Union européenne, le rapport entre non-discrimination et discrimination positive. Nous avons quelques clauses de non-discrimination, mais ce n'est pas clair. Quel est le rapport entre l'égalité de traitement et le traitement préférentiel? On ne peut pas garantir les droits des minorités nationales sans un traitement préférentiel ou sans une discrimination positive. Chers collègues, je vous demande de soutenir pleinement ce rapport excellent.

  Henrik Lax (ALDE). Herr talman! De nya medlemsländerna har fört med sig nya språkliga och nationella minoriteter i unionen, som alltmer präglas av språklig mångfald. Nya krav ställs på unionens minoritetspolitik, vilket berömvärt tas upp i betänkandet.

Redan nu har 46 miljoner EU-invånare ett annat modersmål än huvudspråket i deras land. Det är ett problem att antalet ledamöter per land minskar då EU får nya medlemsländer. De språkliga och nationella minoriteterna är de första som då faller ut ur Europaparlamentet. Den föregående utvidgningen medförde att fyra minoriteter föll ut, och så kommer det att fortsätta om inga åtgärder vidtas. Frågan berör demokratins fundament; alla bör få vara företrädda i och erkända av det organ vars lagstiftning de underlyder.

Föredraganden säger helt riktigt att en förutsättning för en inkluderande minoritetspolitik är en tillräcklig representation i det politiska beslutsfattandet. Som utvidgningarna nu är planerade kommer så gott som alla minoriteter att falla ut ur parlamentet. Detta är inte önskvärt.

Frågan kan lösas. EU kunde inrätta till exempel 30 parlamentsmandat öronmärkta för nationella språkliga minoriteter. Det kan så klart bli svårt att bestämma hur dessa skall definieras, men problemet skall inte överdrivas. I de flesta fall handlar det om folkgrupper som har en erkänd ställning i sitt land och inte är anonyma eller osynliga.

Europas mångfald skall få synas. Att frånta Europas minoriteter möjligheten att uppnå ens en bräcklig representation är en allvarlig sak, som gäller hur stabiliteten på vår kontinent skall kunna tryggas. Många krig i Europa har varit en följd av att majoriteter har förtryckt mindre grupper. Jag hoppas att parlamentet och kommissionen tar sig an denna fråga.

  Jean Lambert (Verts/ALE). Mr President, I too would like to thank Mr Moraes for the work that has been done on this very sophisticated report, which, as some have already said, demonstrates the growing complexity of the European Union.

At the moment we are looking at the question of whose Europe is it that we are creating; and this report, along with others tonight, is very strong on the fact that this needs to be an inclusive Europe, where people have equality of opportunity to fulfil their potential. We need to be combating the growing movements we see which are based on hatred and exclusion, something that, for many of us, is absolutely unacceptable within this European Union.

I welcome the particular recognition given in this report to the work of local authorities and others from the grassroots up, because we are looking at something of a cultural shift which broadens the European Union. I echo Mr Moraes’ statement on the Article 13 directives. I would hope that the incoming presidency makes that a priority, so that at least the legislation is in place when we come to celebrate the Year of Equalities in 2007.

  Mary Lou McDonald (GUE/NGL). Mr President, there is a gap between the EU rhetoric on equality, inclusion and diversity, and the reality of experience across the Member States. This report rightly asserts that minority rights issues have not been high enough on the EU agenda. The report also reflects the massive amount of work required in this area if we are to bridge the gap between rhetoric and reality. In my limited time I shall add my voice to two specific calls that the report makes.

A critical requirement in asserting and protecting minority rights is political will. In this regard I echo the report’s call for speedy progress on the Council framework decision on combating racism and xenophobia. Also essential is the availability of comprehensive, reliable and disaggregated data on discrimination. The report correctly identifies this area as one meriting immediate action.

I congratulate Mr Moraes and I welcome the report’s assertion that equal treatment is a basic right and not a privilege, that human rights are indivisible and cannot be bought or sold. The challenge for all of us is to put in place mechanisms, and crucially resources, to realise these goals.

Atzīstot Claude Moraes ziņojuma mērķu nozīmīgumu un atzīmējot ziņotāja parādīto personīgo atbildību, meklējot patiesību, vienlaicīgi jānorāda, ka ziņojuma tapšanas process vēlreiz skaidri apliecina patiesību, ka, īstenojot minoritāšu un antidiskriminācijas kopējo politiku Eiropā, ir absolūti svarīgi un nepieciešami ņemt vērā katras valsts īpašo, unikālo, vēsturisko un politisko situāciju, jārespektē tās identitātes saglabāšanas aktualitāte un valsts kompetence, risinot minoritāšu un pretdiskriminācijas problemātiku. Šo patiesību nerespektēšana ziņojuma tapšanas gaitā kārtējo reizi izpaudās atsevišķu nezinošu vai tendenciozi noskaņotu deputātu iesniegtajos priekšlikumos, tas ir, netaisnīgās apsūdzībās pret Latvijas un Igaunijas valstu realizēto mazākumtautību politiku. Tas ir absurdi, jo attieksme pret mazākumtautībām Latvijā uz citu valstu fona nav mazāk pretimnākoša.

Cienījamie kolēģi! Ņemot vērā šādu atklātu, nepamatotu un nepārtrauktu uzbrukumu atkārtošanos pret šīm divām no totalitārā padomju režīma visvairāk cietušajām valstīm, aicinu beidzot saprast un atzīt, ka atsevišķos gadījumos problēmu risinājums ir jāmeklē nevis standarta, bet gan tieši individuāli īstenotā minoritāšu politikā katras atsevišķas valsts gadījumā. Tā, piemēram, deputāte Tatjana Ždanoka sāka ar mēģinājumu visos iespējamos rezolūcijas formulējumos iepīt Latvijai raksturīgo nepilsoņu problemātiku, mēģināja uzsvērt un baidīt Eiropu ar Latvijas vairāk nekā 400 tūkstošiem nepilsoņu, un radīja situāciju, ka ziņojuma beigu tekstā daudzviet tiek jaukti dažādi juridiski termini un tādi saturiski atšķirīgi jēdzieni kā etniskās minoritātes, imigranti, bēgļi, bezvalstnieki un nepilsoņi, kas nav viens un tas pats. Ieguvums - mazināt ziņojuma objektivitāti un kvalitāti.

Ir laiks atcerēties, ka baltiešu pamatnācijas represēšana un iznīcināšana, ekonomisko migrantu iepludināšana ir cēlonis tam, ka Igaunijas un Latvijas okupācijas laikā ir ievērojami izmainīts šo valstu iedzīvotāju etniskais sastāvs un radīts salīdzinoši liels svešas ideoloģijas nepilsoņu skaits. Latvija ir bijusi ļoti lojāla, un likumdevējs ir devis savulaik okupācijas periodā izmitinātajām personām īpašas tiesības - tiesības naturalizēties jebkurā brīdī. Situācija, ka daudzi nav vēlējušies to izdarīt, ir jāvērtē kā to individuālu gribas izpausmi, nevis apsūdzību pret šīm valstīm. Nevis pilsoņu skaitam, bet gan to lojalitātei, cieņai pret valsti, tās valodu, tās vērtībām ir jābūt pilsonības iegūšanas un sabiedrības konsolidācijas kritērijiem. Ir jāizvairās no pārspīlējumiem, ir jāsaprot, ka, piemēram, Latvijas gadījumā ārēja spiediena ietekmēta, devalvēta pilsonības piešķiršana būtu diskriminējoša pret pamatnāciju, nopietni tiktu apdraudēta tās identitāte un valsts pastāvēšana.

  Παναγιώτης Μπεγλίτης (PSE). Κύριε Πρόεδρε, η προστασία των μειονοτήτων δεν πρέπει να αποτελεί μόνο ένα από τα βασικά πολιτικά κριτήρια της Κοπεγχάγης για τις υποψήφιες προς ένταξη χώρες, αλλά και ένα δυναμικό δείκτη του εκδημοκρατισμού και της εμπέδωσης των δημοκρατικών θεσμών. Από αυτή την άποψη η Ευρωπαϊκή Ένωση, οφείλει να είναι ο αυστηρός κριτής και ελεγκτής της συμπεριφοράς όλων των προς ένταξη χωρών. Και οφείλει να το κάνει χωρίς επιλεκτικές ευαισθησίες και υπολογισμούς, που υπαγορεύονται πολλές φορές από τα συμφέροντα και τις πολιτικής συγκυρίας σκοπιμότητες.

Το θέμα των μειονοτήτων δεν θα πρέπει να αξιοποιείται για την προώθηση εθνικών συμφερόντων ή για υπονόμευση άλλων χωρών. Η λογική της στρατηγικής της έντασης, με πολιορκητικό κριό τις θρησκευτικές και εθνοτικές μειονότητες, είναι πηγή έντασης, συγκρούσεων και καλλιέργειας αμοιβαίας δυσπιστίας, που τελικά αποβαίνει σε βάρος των ίδιων των μειονοτήτων.

Οι μειονότητες στην Ευρώπη μπορούν να παίξουν το ρόλο της γέφυρας για τη συνεργασία και την εμπέδωση της ασφάλειας. Η έκθεση Moraes επιχειρεί να δώσει ένα ορισμό της εθνικής μειονότητας με την αναφορά του σχετικού ορισμού του Συμβουλίου της Ευρώπης. Πιστεύω, όμως, ότι αυτό που θα έπρεπε να προστεθεί στην έκθεσή του, ειδικά στην παράγραφο 7 για τον ορισμό, είναι η σαφής αναφορά και στις διεθνείς Συνθήκες που ρυθμίζουν θέματα θρησκευτικών και εθνοτικών μειονοτήτων.

Μια διεθνής Συνθήκη αποτελεί τη στέρεη βάση για την προστασία των δικαιωμάτων των μειονοτήτων και το ασφαλές πλαίσιο για την αποτροπή πολιτικών εκμετάλλευσης για άλλους σκοπούς.

Με αυτή την παρατήρηση, κύριε Πρόεδρε, θα ήθελα να συγχαρώ το συνάδελφο Moraes, για την εξαιρετική έκθεση που μας παρουσίασε και πιστεύω ότι αύριο θα πρέπει να υπερψηφισθεί.

  Proinsias De Rossa (PSE). Mr President, I believe that how we treat our minorities reflects the strength of our democracy. It has to be said that no Member State is free from defects when it comes to giving substance to universal human rights.

Unity in diversity is not just a slogan. It has to be put into effect because it is essential to human progress in our Member States and, I would argue, to the very survival of the European Union. Mr Moraes has worked hard and produced a well-balanced and very good report. In Ireland we have still not achieved the progress that we need to achieve in relation to women’s equality, travellers’ and gay rights. I know too that other Member States fall far short of granting full citizenship to minorities. I know that this is a particularly sensitive issue in Latvia and Estonia. However, this report does not seek to be censorious; it attempts to approach these problems in a spirit of solidarity and indeed of seeking help for all states to comply with European values.

I would urge all Members and political groups of this Parliament to support this. I believe it is an excellent report.

  Vladimír Špidla, člen Komise. Dámy a pánové, se zájmem jsem vyslechl vaši diskuzi, a dovolte mi, abych se dotkl opravdu jenom několika bodů.

Myslím si, že je skutečně důležité, abychom podpořili a prosadili implementaci evropské legislativy v jednotlivých členských zemích. Je zřejmé, že tady je ještě mnoho co dělat, a chci jasně říci, že Komise bere svoji úlohu strážce smlouvy velmi vážně.

Chtěl bych také podtrhnout rok rovných příležitostí, který nám dá příležitost k senzibilizaci v těchto složitých a citlivých otázkách, a dovolte mi, abych na závěr konstatoval, že jsem přesvědčen o tom, že nová strategie schválená Komisí poskytuje vhodný rámec pro budoucí kroky v oblasti nediskriminace. Je i zde jednoznačně jasné, že je potřeba kombinace všech nástrojů včetně legislativních a že je velmi potřebné se soutředit zejména na ty skupiny, které, bohužel až dosud, nemají příležitost se plně zapojit do společnosti a hospodářství.

Dámy a pánové, ještě jednou gratuluji panu poslanci Moraesovi za jeho zprávu a děkuji.
