  Předseda. Dalším bodem pořadu jednání je zpráva Dariusze Rosatiho za Hospodářský a měnový výbor o návrhu směrnice Rady, kterou se mění směrnice 92/12/EHS o obecné úpravě, držení, pohybu a sledování výrobků podléhajících spotřební dani (KOM(2004)0227 - C6-0039/2004 - 2004/0072(CNS)) (A6-0138/2005).

  Dariusz Rosati (PSE), sprawozdawca. Panie Przewodniczący! Przedmiotem naszych obrad jest propozycja dyrektywy Rady zmieniającej art. 7, 8, 9, 10 w dyrektywie 92/12 EWG. Przypomnę, że dyrektywa ta zawiera ogólne przepisy dotyczące obrotu i przechowywania produktów objętych podatkiem akcyzowym, przede wszystkim produktów alkoholowych i tytoniowych, ale także i paliw płynnych. Przypomnę również, że art. 27 tej dyrektywy z 1992 r. zobowiązywał Komisję do przedłożenia sprawozdania Radzie na temat działania i zastosowania art. 7, 8, 9 i 10 w okresie do 1997 r. Z różnych powodów wyjaśnionych przez Komisję to sprawozdanie z zastosowania wymienionych artykułów omawiane jest dopiero dzisiaj z kilkuletnim opóźnieniem.

Przypomnę, że art. 7 dotyczy obrotu towarami akcyzowymi przez przedsiębiorstwa w celach handlowych, art. 8 dotyczy obrotu towarami akcyzowymi przez osoby indywidualne do celów osobistych, art. 9 określa moment zaistnienia zobowiązania podatkowego oraz określa limity indykatywne, które mają służyć do określenia, czy przewożone towary akcyzowe mają charakter handlowy, czy są przeznaczone do użytku indywidualnego. Wreszcie art. 10 określa sposób i miejsce powstania obowiązku podatkowego, określa obowiązki pośredników podatkowych, a także określa warunki sprzedaży na odległość, czyli tak zwane warunki dla distance sales.

Ustalenia i zastosowania tych artykułów w praktyce budziły cały szereg wątpliwości, zarówno osób indywidualnych, podróżnych, turystów, jak i przedsiębiorstw zajmujących się profesjonalnie handlem i obrotem towarami akcyzowymi. Dlatego Komisja postanowiła zaproponować pewne zmiany do brzmienia wyżej wymienionych czterech artykułów, przede wszystkim mając na celu dwie zasadnicze zasady.

Po pierwsze, Komisja chciała w sposób konsekwentny zastosować zasadę jednolitego rynku, taką mianowicie, że dla obrotu handlowego podatek akcyzowy płacony jest w kraju przeznaczenia towaru. Natomiast dla obrotu przez osoby kupujące towary akcyzowe na własny użytek, podatek akcyzowy miał być pobierany w kraju pochodzenia towaru.

W konsekwencji Komisja proponuje zmiany: w art. 7 głównie zmierzające do określenia, czym jest obrót handlowy i według definicji Komisji, każdy obrót, który nie jest przeznaczony do osobistego użytku, jest obrotem handlowym. Dalsze zmiany w art. 7 dotyczą uproszczenia języka i zastosowania bardziej precyzyjnych sformułowań. Wreszcie w art. 7 także Komisja proponuje jasno określić, na kim spoczywa obowiązek podatkowy.

W art. 7 Komisja wprowadza bardzo ważną zmianę, mianowicie proponuje, aby zakup towarów przez osoby prywatne niekoniecznie musiał dokonywać się w postaci przewożenia tych towarów osobiście przez osoby zainteresowane i żeby można było także umożliwić osobom prywatnym zamawianie na odległość towarów akcyzowych z dostawą do miejsca zamieszkania. Odnosi się to także do tak zwanych prezentów. Zatem jest to wprowadzenie zasady, że obrót dla osobistego użytku jest możliwy nie tylko wtedy, kiedy podróżny przewozi towary ze sobą, ale także kiedy ktoś przewozi towary w jego imieniu i na jego koszt.

W art. 9 Komisja proponuje ważną zmianę, mianowicie zlikwidowanie limitów ilościowych, które do tej pory były wykorzystywane niezgodnie z ich intencją. I wreszcie w art. 10 Komisja znowu proponuje dokonanie określonych zmian mających na celu uproszczenie procedury.

Sprawozdawca jest zdania, że wszystkie zmiany w zakresie prawa podatkowego w Unii Europejskiej powinny spełniać cztery kryteria; powinny spełniać logikę jednolitego rynku, czyli powinny zapobiegać dyskryminacji. Po drugie, powinny być proste i przejrzyste tak, aby były łatwo stosowane. Po trzecie, nie powinny prowadzić do drastycznych naruszeń poziomu dochodów budżetowych w poszczególnych krajach. Po czwarte, powinny też spełniać pewne normy polityki zdrowotnej, jeżeli taka polityka w poszczególnych krajach jest spełniona.

Sprawozdawca uważa, iż propozycje Komisji idą w tym kierunku i spełniają te kryteria i dlatego generalnie popieram te zmiany, natomiast poprawki, które proponujemy, dotyczą przede wszystkim poprawek językowych i lepszego sformułowania poszczególnych zapisów, zastosowania bardziej precyzyjnych terminów, oraz także proponujemy, aby w wykonywaniu tych postanowień na władzach administracyjnych poszczególnych Państw Członkowskich spoczywał obowiązek udowodnienia, czy towary przeznaczone są do użytku handlowego. W dotychczasowych zapisach ten obowiązek zbyt często spoczywał na podróżnych i uważamy, że jest to niezgodne z zasadami wspólnego rynku.

Generalnie poprawki, które są stosowane, są poprawkami, które tylko porządkują i w pewnym sensie wyjaśniają dodatkowo tekst, natomiast wszystkie propozycje Komisji są popierane.

  László Kovács, Member of the Commission. Mr President, I should like to compliment the rapporteur, Mr Rosati, for his very clear and accurate analysis of the Commission proposal. I am very pleased to note that this report strongly supports the proposal of the Commission, the aim of which is to improve the functioning of the internal market in this area, both for citizens and for trade.

The proposal concerns the so-called ‘duty paid movements’ of excise products between Member States. While it is true that this type of intra-Community movement represents only a small proportion of the total intra-Community movements of excisable products, it must nevertheless be stressed that they mainly involve the European citizens and small and medium-sized companies.

For the European citizens the proposal aims to clarify the existing rules on the movement of goods from one Member State to another. Indeed, from the number of questions that the Commission receives daily on this issue, it clearly appears that the present rules, including the value of the ‘indicative limits’, cause some confusion. The proposal provides clarification on this issue and also enhances the possibilities for citizens to purchase duty-paid goods in the Member States of their choice, without having to declare those goods and pay duty on them in their own Member State. That will better align the system to the principles of a real internal market.

For goods moved for commercial purposes, the Commission proposes to maintain the basic principle that excise duty is payable in the Member State of destination, but to harmonise and simplify the procedures to be followed in that Member State. That will especially benefit small and medium-sized companies such as small wine traders who try to commercialise their products directly in other Member States. Today, the complex rules, which differ considerably between Member States, often deter those companies from doing business in other Member States.

Having regard to the importance of these issues for both citizens and traders, I hope that the positive tone of the report on the table today will be reflected in the vote tomorrow.

  Astrid Lulling, au nom du groupe PPE-DE. Monsieur le Président, Monsieur le Commissaire, dans sa grande majorité, mon groupe devrait approuver le rapport de M. Rosati. Je ne vous cacherai pas cependant que le texte voté par la commission économique et monétaire soulève bon nombre de difficultés. L'expression d'intérêts divergents a débouché sur une construction d'ensemble un peu bancale présentant certaines incohérences, voire des contradictions. Une nouvelle fois, on voit à quel point, dans l'Union européenne, les dossiers fiscaux demeurent particulièrement délicats. Voilà pourquoi il serait souhaitable que nous les traitions en respectant rigoureusement les principes que nous ne cessons de proclamer.

L'objectif de la proposition de la Commission est de progresser vers la réalisation du marché intérieur, de favoriser la libre circulation des produits soumis à accise et, finalement, d'aller dans le sens du consommateur en lui permettant de se fournir là où bon lui semble. Dans ces conditions, je ne peux que m'étonner des propositions de certains de mes collègues qui conduiraient à une donne contraire à cette logique en revenant même à une situation antérieure à celle qui prévaut depuis 1993.

Tout cela est surprenant et même inquiétant. Mais revenons-en aux questions de principe. La logique du marché intérieur veut très clairement que le consommateur final paie les droits d'accise dans l'État membre d'acquisition pour les produits destinés à la consommation privée. L'existence de limites indicatives fixant la quantité maximum de denrées transportables d'un État membre à un autre est devenue un obstacle trop rigide, ce qui a conduit la Commission à proposer leur suppression. C'est là une bonne suggestion, que la commission économique et monétaire, malheureusement, ne suit que partiellement, puisqu'elle est d'accord avec le principe de leur abolition, mais fait référence, dans un amendement, à ces mêmes limites comme si elles continuaient d'exister.

Autre exemple d'incohérence: le consommateur ne serait dorénavant plus obligé de transporter lui-même les produits pour pouvoir bénéficier de la règle du paiement de l'accise dans le pays d'acquisition. Il s'agit, là aussi, d'un progrès appréciable.

Pour la vente à distance, en revanche, c'est la règle du pays de destination qui continuerait de prévaloir. Le problème est que la frontière entre les deux cas n'est pas toujours claire et que leur traitement différent entraînera, j'en suis sûre, de nombreuses difficultés pratiques.

Ma réflexion m'avait donc conduite à proposer certains amendements visant à supprimer la distinction entre vente sur place et vente à distance, mais la commission économique et monétaire ne m'a pas suivie. J'ai abandonné, parce que l'on me dit que les esprits ne sont pas mûrs et qu'il s'agirait d'une révolution. Pourtant, il s'agirait simplement de rester fidèle à la logique du marché intérieur. Alors que la construction de l'Europe s'avère une entreprise des plus compliquées – et nous le vivons ces jours-ci –, nous ne pouvons continuer à encourager ces incohérences parce que les citoyens européens les jugent très sévèrement.

  Κατερίνα Μπατζελή, εξ ονόματος της ομάδας PSE. Κύριε Πρόεδρε, κύριε Επίτροπε, η αναθεώρηση του ισχύοντος νομοθετικού πλαισίου κρίνεται επιβεβλημένη, διότι οφείλουμε να παρέχουμε στους Ευρωπαίους πολίτες και επιχειρηματίες νόμους σαφείς και απλοποιημένους.

Στο πλαίσιο της προσπάθειας αυτής, θα ήθελα να τονίσω δύο σημεία, τα οποία θεωρώ ότι θα μπορούσαν να παίξουν καθοριστικό ρόλο. Πρώτον, η παρούσα πρόταση οδηγίας διαγράφει την αναφορά στα ενδεικτικά επίπεδα. Τα επίπεδα αυτά λειτουργούν σήμερα ως ενιαία ποσοτικά κριτήρια για τις εθνικές διοικήσεις των κρατών μελών, όταν αυτές καλούνται κατά την εισαγωγή προϊόντων που υπόκεινται σε ειδικό φόρο κατανάλωσης, να αξιολογήσουν τον εμπορικό ή μη χαρακτήρα του κατόχου. Η κατάργηση των ενδεικτικών επιπέδων θα επιτρέψει στις εθνικές διοικήσεις να θεσπίσουν και να εφαρμόσουν, η κάθε μία τα δικά της κριτήρια βάσει των οποίων θα αξιολογείται από τις αρμόδιες εθνικές αρχές της, ο εμπορικός ή μη χαρακτήρας της κατοχής. Αυτό, θεωρώ ότι δεν συνάδει με τις αρχές της εσωτερικής αγοράς, αλλά αντίθετα, συνιστά οπισθοδρόμηση και τάση επανεθνικοποίησης. Η διατήρηση των ενδεικτικών επιπέδων ή, εφόσον κρίνεται σκόπιμο, η πρόβλεψη μελέτης για την αξιολόγηση των υφιστάμενων ή η αντικατάστασή τους με νέα ενδεικτικά επίπεδα, κρίνω ότι θα αποτελούσε μια ορθότερη λύση.

Δεύτερον, για την εναρμόνιση των εθνικών νομοθεσιών και την ολοκλήρωση της εσωτερικής αγοράς σε όλους τους τομείς, θα πρέπει η παρούσα πρόταση οδηγίας να θεωρηθεί ως ένα μεταβατικό στάδιο. Ο τελικός στόχος θα πρέπει να είναι η κατάλληλη προετοιμασία των εθνικών νομοθεσιών και της εσωτερικής αγοράς, προκειμένου να καταστεί δυνατή η εναρμόνιση των συντελεστών ειδικών φόρων κατανάλωσης που επιβάλει κάθε κράτος μέλος. Αυτό, εξάλλου, υπαγορεύει και η ελευθερία αγορών που διέπει την εσωτερική αγορά.

Θα ήθελα, όμως, να τονίσω ότι η παρούσα οδηγία, επιτυγχάνει, σε μεγάλο βαθμό,τη βελτίωση του ισχύοντος συστήματος. Ειδικότερα, οι προτεινόμενες διατάξεις για τον καλύτερο προσδιορισμό προβληματικών εννοιών, όπως ο εμπορικός σκοπός για την ένταξη της έννοιας του δώρου στα προϊόντα στα οποία οι ειδικοί φόροι καταβάλλονται στο κράτος μέλος απόκτησης, οι εξ αποστάσεως πωλήσεις και τέλος, η απλοποίηση των μηχανισμών, θεωρώ ότι συμβάλλουν στην επίλυση των σημερινών δυσχερειών.

Κύριε Πρόεδρε, κύριε Επίτροπε, θα ήθελα να δώσω συγχαρητήρια στον εισηγητή κ. Rosati για την ολοκληρωμένη πρόταση που έχει κάνει στο θέμα αυτό και θεωρώ ότι το Σώμα θα ψηφίσει αύριο την πρότασή του.

  Margarita Starkevičiūtė, ALDE frakcijos vardu. Atrodo, kad šis galbūt techninis klausimas, kurį mes dabar naktį svarstome, iš tiesų yra susijęs su vyriausybės politikos problema. Kaip suderinti valstybės kontrolę su laisvos rinkos elementais taip, kad būtų sudarytos geriausios sąlygos ekonomikos plėtrai? Akivaizdu, kad paprasto atsakymo nėra, tačiau mūsų, naujų šalių, ekonomikos reformų patirtis liudija, kad geriausius rezultatus galima pasiekti tuomet, kai į problemą žvelgiama kompleksiškai. Komisijos pasiūlymas panaikinti indikatyvius kokybinius limitus, kuriuos dabar naudoja šalių muitinių darbuotojai, kad būtų nustatytas lestinas įsivežti akcizinių prekių, skirtų asmeniniam naudojimui, kiekis, yra sveikintinas, nes tokia tvarka prieštaravo bendros rinkos funkcionavimo esminėms nuostatoms. Iš tiesų, apie kokią bendrą rinką galime kalbėti, jeigu asmenys negali pervežti asmeninio naudojimo prekių? Tačiau reikia nepamiršti su tuo susijusių problemų.

Visų pirma, tai problema yra, kad pasienio šalys, ypač rytinio pasienio šalys, gali susidurti su didėjančiu kontrabandos srautu, nes alkoholis yra daug pigesnis tiek Rusijoje, tiek Baltarusijoje, ir sprendimas nėra tiktai stiprinti pasienio apsaugą, kad būtų kovojama su kontrabanda. Labai prašyčiau Komisijos atkreipti dėmesį į tai, kad būtina pasiekti susitarimus su kaimyninėmis Rytų valstybėmis tam, kad jos irgi bendradarbiautų mums kovojant su kontrabanda.

Kita problema, su kuria susidursime, yra ta, kad atsiras mažas sluoksnis prekiautojų, kurie vežios alkoholį iš vienos šalies į kitą, pavyzdžiui, iš Estijos, kur nedidelis akcizas, į Suomiją, kur akcizas yra didesnis ir atitinkamai didesnės kainos. Sunku spręsti šią problemą be kompleksinio požiūrio į pasienio regionų vystymą, į naujų darbo vietų atsiradimą siekiant, kad būtų sudarytos galimybės tiems žmonėms užsidirbti kitokiu būdu.

Vadinasi visada yra ekonominių priemonių, kurios gali padėti išvengti neigiamų pasekmių. Juolab, kad mokslininkų yra įrodyta, jog bendros rinkos sukūrimas suteikia daug daugiau privalumų, t. y. ,BVP vienam Europos Sąjungos gyventojui yra 20 proc. didesnis dėl to, kad yra bendra rinka. Taigi privalumai nusveria kai kurias problemas, kurios iškils taikant šio nutarimo nuostatas.

  Carl Schlyter, för Verts/ALE-gruppen. Herr talman! Minimiskattenivån för alkoholdrycker kan vara så låg som noll idag, men andra har valt en högre skattenivå, huvudsakligen av hälsoskäl.

Obegränsad rörlighet påtvingar, genom illojal skattekonkurrens, i princip alla länder den politik som medlemslandet med lägst skatt tillämpar. Detta skulle bli effekten om vi använder termen personligt bruk utan tidsbegränsning. Eftersom många alkoholdrycker kan lagras en livstid kan en människa hävda att en lastbil med alkohol är för personligt bruk för de närmaste 40 åren, vilket låter smugglare gå fria. Med en 120-dagarsprincip kan man ta hänsyn till skillnader i konsumtionsnivåer mellan olika länder och till exempel födelsedagsfester, men ändå ha en laglig hänvisning till vad som kan anses rimligt med personligt bruk.

Om detta ändringsförslag röstas ned innebär det i praktiken ett förbud för alla EU-länder att vidta någon som helst åtgärd mot tobaks- och alkoholkonsumtion av hälsoskäl. Det kan knappast vara kammarens åsikt, eftersom det skulle strida mot artikel 30 i fördraget.

  John Purvis (PPE-DE). Mr President, in his English Dictionary of 1755 Samuel Johnson defined excise as ‘a hateful tax’, and this tax and the way it is policed have become a hate object also for my Scottish constituents. They call me in tears to describe having their cars dismantled and their children terrified by customs officers. Okay, they are told, you can appeal to the courts – except that they cannot afford the courts against the customs’ bottomless pockets, and the burden of proof falls on them.

And what good do these exaggerated excise taxes do? They victimise honest retailers who cannot compete with personal purchases abroad, and the much more serious smuggling by organised crime which these taxes promote. They actually reduce overall tax revenue. And then there is the cost of all those extra customs inspectors.

And health. Do excise taxes really discourage smoking and drinking? No! Because the high level of personally imported and smuggled cigarettes and alcohol means that the actual cost of smoking and drinking is cheaper. Excise is not only hateful, it is also pointless, and high rates of excise tax which are out of line with those in other countries are even more pointless. All they do is distort shopping patterns absurdly and provide fertile ground for organised crime to flourish.

You, Mr Commissioner, are responsible for ensuring that the single European market functions properly, with free movement of goods and people; and clearly it does not function where there are large disparities in rates of excise duty. I, we, accept the concept of tax competition. Competition exists in income and corporate taxes, and rightly so. Why not also with excise? Perhaps it is time to abandon excise tax altogether and turn to value added tax as the only consumption tax.

  Zsolt László Becsey (PPE-DE). Egyetértek azzal, hogy a belső piac kiteljesítése végett a módosítások a jövedékiadó-köteles termékek mozgását is könnyíteni javasolják. Támogatom azt is, hogy a nemzeti adóhatóságok bizonyítási felelősségét kidomborítsák. Előrelépésnek tartom azt is, hogy a jelenlegi parlamenti határozattervezetben még a mennyiségi iránymutatások megjelennek a jövedékiadó-köteles termékek határon átnyúló mozgásakor. Az Unió azonban nem csak mélyül, hanem bővül is. Ez pedig azzal jár, hogy egy jó időre jelentősen megnő a jövedelmi és árszínvonal különbség a tagállamok között. Különösen az Unió keleti határain, így Magyarország szomszédságában, Romániában is még hosszú ideig nem ugorhatnak fel az árak és a jövedelmek a magasabb jövedelemszintű környező országokéhoz. Vagy ha ezt mégis megteszik hatósági árakkal, jövedéki adószintek meghatározásával, akkor nagy lesz az illegális termékek forgalomban lévő aránya. Ennek világos és végzetes következménye egy olyan jövedéki árumozgás, ami ugyan valójában kereskedelmi célú, mégis az egyes határátlépéseknél magáncélúnak tüntetik fel. Az eredmény a szervezett árumozgás, a belső piac mélyítésének óvatlanul alkalmazott jelszavával. Ez Magyarországon például nemcsak az állami jövedéki bevételek kiesésével jár, de kárt okoz a kiskereskedelemnek és általában a jövedéki termékek termelőinek is.

Másik megjegyzésem a jelentéssel kapcsolatban az, hogy az indirekt adókulcsok versenye és leszorítása is nehezen hozható összhangba azzal a céllal, hogy ezen adókulcsok szerepét növeljük a direkt adózással szemben a versenyképességünk javítása érdekében. Úgy vélem, a múlt heti népszavazási sokk egyik tanulsága, hogy az Unió bővítésének nemcsak távlati, szép, eszményi hatásai vannak, hanem közvetlen reálgazdasági következményei is, amelyek rövid távon lehetnek hátrányosak is. E hátrányokat nem méltányos egyedül a közvetlen szomszédokkal viseltetni a belső piac mindenhatóságának örve alatt. A nagy jövedelmi és árkülönbségeknél igenis engedni kell olyan átmeneti időszakot, amelynek során – a csatlakozási szerződések által rögzített 2009-nél bizonyítottan szükség esetén tovább is – védik a gazdagabb szomszéd országok belső piacát hatósági küszöbök fenntartásával és a küszöbök ellenőrzésének fennmaradásával.

  László Kovács, Member of the Commission. Mr President, I should like to make some comments on the amendments tabled. A number of the amendments modify or add recitals in order to emphasise the need to create an internal market for excise products also. I can assure you that is the very purpose of the Commission proposal. I feel that is already properly reflected in the recitals.

As to the amendment requesting that the Commission review and assess the ‘indicative limits’, I can only say that the Commission has assessed them in its report. That was the basis for its proposal and it has come to the conclusion that they should no longer appear in EU legislation. For this reason, and as the amendment proposed does not reinsert such indicative limits in the directive either, I do not see the need for the Commission to table another report on this issue.

Lastly, as regards the burden of proof that goods are for private use, the amendment in question seems to place that burden entirely on the administration. The Commission approach on this is somewhat different and would seem to be more neutral. It is for the citizen to provide any explanation or proof concerning the purpose of his transporting the goods in question. It is for the administration to decide on the basis of those elements. As such a decision can always be contested, it should be based on firm grounds.

  Othmar Karas (PPE-DE). Herr Präsident! Ich glaube, dass diese Debatte einfach deutlich macht, dass wir noch einen hohen Handlungsbedarf haben, wenn wir einen wirklichen Binnenmarkt für alle Bereiche unseres Lebens schaffen wollen.

Auf der einen Seite haben wir zu liberalisieren, zu vereinfachen, zu harmonisieren oder Mindeststandards zu entwickeln, auf der anderen Seite besteht natürlich auch ein Bedarf, Schutzmechanismen einzubauen, gerade im Zusammenhang mit der Gesundheit. Wir sind dabei, beides Schritt für Schritt umzusetzen. Ich sage ja zum Binnenmarkt, und jede Anstrengung, die den Binnenmarkt stärkt, geschieht im Interesse von Wachstum und Beschäftigung und für den Verbraucher.

Der zweite Punkt – das haben wir in der Debatte deutlich gehört: Wir sind nicht im Mitentscheidungsverfahren. Das Europäische Parlament muss in jeder Frage mit dem Mitentscheidungsverfahren einbezogen werden, auch in Fragen der Steuerpolitik, und wenn wir einen Binnenmarkt verwirklichen wollen, müssen wir uns stärker mit der Steuerpolitik innerhalb der Europäischen Union auseinander setzen. Ich stehe zum Steuerwettbewerb. Aber jeder Wettbewerb hat seine Grenzen. Es kann auch zu groben Wettbewerbsverzerrungen kommen, wenn die Bandbreiten zu groß sind. Aber Handlungsbedarf haben wir auch in der Steuerpolitik.

Drittens begrüße ich als Vorsitzender der interfraktionellen Arbeitsgruppe „Kleine und mittlere Unternehmen“, dass der jetzige Vorschlag mehr Klarheit für den Bürger bringt und durch die Verfahrensvereinfachung mehr Klarheit und Erleichterungen – wie der Kommissar gesagt hat – für die KMU und damit für die Händler. Wir sind jedoch mit diesem Vorschlag noch nicht am Ende, weil wir noch keinen Binnenmarkt haben und daher neue Anstrengungen notwendig sind.
