My point of order concerns my own question, No 69, which I tabled specifically because Mr Mandelson was scheduled to address the House and take questions this evening. It is about the WTO, yet inexplicably it seems to have been listed as a general question. Could you explain why?

Prüft die Kommission, wie sie verhindern kann, dass nationale Maßnahmen betreffend die Besteuerung des Personenflugverkehrs, wie z.B. eine Steuer auf Tickets oder Flugbenzin, zu einem Hindernis für den Binnenmarkt werden?

  Peter Mandelson, Member of the Commission. The issue of taxes on air traffic has been much debated lately, but it has been among the instruments considered in the search for new sources of funding for official aid to developing countries, in line with the UN Millennium Development Goals.

The honourable Member is no doubt aware that the Council has been actively considering the issue and that the Commission has produced several staff working papers on the technical aspects at the request of the Council. Two types of tax instruments have been considered: the taxation of aviation fuel and a levy on airline tickets, also known as a departure tax. From the internal market point of view, the legal setting is not the same for those two types of taxes.

Taxes on aviation fuel are covered by Community legislation in the form of the energy tax directive, 2003/96/EC. Although aviation fuel is, in principle, exempt from taxes, the Member States may choose to tax fuel for domestic flights. They may also tax fuel for flights between Member States, provided they agree bilaterally to do so. However, in practice there is no scope to tax fuel used by third-country carriers operating in the EC.

As regards a levy on airline tickets, there are no specific Community provisions. Member States are therefore free to apply such levies on the obvious condition that they comply with their commitments under the EC Treaty.

The honourable Member has asked whether the Commission is considering ways to prevent such taxes on air travel becoming obstacles to the internal market. I would first like to stress that the fact that a product or service is taxed does not mean that its free movement is obstructed. There is an obstacle to the internal market only if a tax is heavier on transactions between Member States than on similar transactions within a Member State. The Commission will make full use of its powers to enforce the Treaty against any discriminatory taxes on air travel, as it does for all other taxes. However, I understand that the discussions between Member States at this stage focus mainly on airline ticket levies. In this respect I must stress that, in the absence of Community rules, this is first and foremost a matter for the Member States themselves, acting within their fiscal sovereignty.

Nevertheless, the Commission has argued in its staff working papers that there are good reasons to prefer a common approach to ticket levies. The Commission has also declared that it is willing to work on the technical aspects with the Member States that intend to pursue this option. That would help to ensure compatibility with Treaty obligations.

I should like to point out that the Commission is continuously monitoring the functioning of the internal market. Taxes of the kind mentioned in the honourable Member’s question are still rare. Should the Commission identify a structural problem linked to the taxation of air travel, be it fuel taxes or ticket levies, it could ultimately make use of its right to propose appropriate legislation.

  Manuel Medina Ortega (PSE). – Señor Mandelson, aprovechando que está usted aquí, y teniendo en cuenta que es responsable del ámbito exterior de la Unión Europea, ¿es usted consciente de que a quien más perjudicaría un impuesto sobre los billetes de avión, en beneficio de la globalización, sería a los países del tercer mundo, que dependen en gran parte del turismo para salir adelante, siento este último, además, una de sus pocas actividades?

Y, en segundo lugar, un impuesto sobre los billetes de avión o sobre las gasolinas de aviación perjudicaría a aquellos Estados que tienen una estructura insular o peninsular. Dicho impuesto está pensado exclusivamente desde una perspectiva continental y, de hecho, supondría una auténtica restricción al tráfico entre las regiones continentales de la Unión Europea y las regiones y países de carácter insular, sobre todo aquellos de carácter ultraperiférico o más alejados del centro de la Unión Europea.

Espero que pueda transmitir al Comisario Kovács la preocupación de este diputado.

  Peter Mandelson, Member of the Commission. In response to your first question concerning tourism, increased taxation of air travel could in theory lead to a reduction in air travel demand. However, the increase in the price of the air ticket must be viewed in the context of the overall cost of a travel package – i.e. travel, accommodation and leisure spending – of which it is usually a minor part. The possible impact on tourism should also be set against the overall trend of a very strong growth in tourism demand. There are therefore good reasons for thinking that the overall impact on tourism will be moderate.

In answer to your second question about remote and peripheral regions, the increased cost of air travel may have a greater impact on regions that are highly dependent on air transportation. However, as air ticket taxes are primarily a matter for Member States, those who choose to apply such taxes will have latitude to design their taxes so as to provide correctives to take into account the special circumstances of remote regions and the social needs of their inhabitants.

The Commission has stated that it is prepared to work with Member States, as I have already said, on the technical aspects of airline tickets. This could include looking at various correctives for remote and peripheral regions within the framework of Community rules.

  Josu Ortuondo Larrea (ALDE). – Señor Comisario, estoy de acuerdo en que los Estados tomen medidas para que se pueda potenciar la política de desarrollo en esos países que, precisamente por no ofrecer oportunidades a sus ciudadanos, cada vez nos envían más inmigrantes, causándonos serios problemas en la Unión Europea.

Le quería preguntar al respecto si la Comisión ha analizado suficientemente otras alternativas para este mismo fin, por ejemplo, la propuesta realizada por el economista señor Tobin, quien planteaba la creación de un impuesto sobre las transacciones financieras, lo cual no afectaría al turismo.

  Peter Mandelson, Member of the Commission. The short answer to that question is that the Commission is not considering alternatives, for example the envisaged Tobin tax, which is a rather controversial proposal contested by many.

The proposals that the Commission has examined are those that have emerged from discussions amongst our Member States. They are, as I say, subject to staff working papers. They are not currently subject to the initiation of the Commission itself.

Obviously, should a so-called Tobin tax start to be canvassed or promoted by a large number of our Member States, that is no doubt something that the Commission could examine and bring forward views on.

  Agnes Schierhuber (PPE-DE). – Frau Präsidentin, Herr Kommissar! Wir alle wissen, dass die Entwicklungsländer unsere besondere Beachtung und Obsorge verdienen. Aber ich frage mich immer, warum man nicht bereit ist, Flugbenzin genauso zu besteuern wie andere Energieträger, gerade fossile Energieträger. Im Zusammenhang mit dem Thema Umweltbelastung möchte ich auf die großen Probleme hinweisen, die teilweise in den Einflugschneisen der Flughäfen entstehen.

  Peter Mandelson, Member of the Commission. The honourable Member has made a perfectly valid observation. It should be pointed out that although a fuel tax would have an impact on prices, it may in fact contribute to putting air travel on an equal footing with alternative means of transportation, such as road travel, for which taxes are currently paid on fuel, and which are often the only option for the less well-off traveller. The point made by the honourable Member will no doubt be taken into consideration by those interested in pursuing this matter.

Betrifft: Datenschutz, EU-Datenbanken

Sowohl im ersten als auch im zweiten Jahresbericht an den Rat und das Europäische Parlament (SEK(2004)0557 und SEK(2005)0839) über die Tätigkeit der Eurodac-Zentraleinheit, der Asylbewerber-Datenbank der EU, hieß es, dass diese Einheit eine überraschend hohe Anzahl von „special searches“ verzeichnet habe. Diese Kategorie ist für die Umsetzung des Artikels 18 (Absatz 2ff) der Eurodac-Verordnung vorgesehen, d. h. für Datenschutzzwecke mit dem Ziel, die Ansprüche der betroffenen Person auf Zugang zu ihren Daten zu schützen.

Diese „special searches” haben jedoch stattgefunden, ohne dass die einzelstaatlichen Kontrollbehörden bestätigen konnten, dass es sich in diesen Fällen tatsächlich um Personen handelte, die Zugang zu ihren eigenen Daten beantragt hatten. Welche Maßnahmen hat die Kommission eingeleitet, um Aufschluss über den Status dieser „special searches“ zu erhalten? Hat die Kommission ihr Versprechen eingehalten, die Anwendung der Eurodac-Verordnung in dieser Hinsicht weiterhin zu überwachen, und mit welchem Ergebnis?

  Olli Rehn, Member of the Commission. The honourable Member Baroness Ludford asks for clarification regarding special searches in relation to Eurodac and action taken by the Commission. I am glad to respond to this question, which falls within the field of responsibility of Commission Vice-President Frattini.

Firstly, a search is defined as special when it aims not to determine the Member State responsible for an asylum application, but to guarantee to each individual the exercise of his or her rights as provided for in the Data Protection Directive.

Article 18 of the Eurodac Regulation sets out the procedures for the exercise of the right to information and to access to, correction or erasing of personal data processed by Eurodac. These rights are granted by EU data protection legislation and they aim to ensure the protection of the right to privacy of the individual. Indeed, in accordance with Article 18(2) and under the Eurodac Regulation, any person residing in a Member State has the right to obtain in any Member State data relating to her or him that is recorded in the central database and that the Member State transmitted to the Central Unit. She or he can subsequently ask that Member State to correct data that was factually inaccurate or to erase data that was unlawfully recorded. It is worth noting that only a few Member States sent such searches to the Central Unit.

Under the system laid down by EU data protection legislation, the Member States’ data protection authorities and the European data protection supervisor are the competent authorities to monitor the lawfulness of personal data-processing activities by Eurodac. During a recent Eurodac users’ meeting, the Commission reminded Eurodac users of their legal obligations. At another meeting organised by the European Data Protection Supervisor, the Commission drew the attention of the EDPS and the national supervisory authorities to the high number of special searches noted in the Eurodac Central Unit.

The Commission is following this issue closely since it is important to clarify whether activities carried out by national authorities within the framework of Eurodac comply with our established data protection rules.

  Sarah Ludford (ALDE). – Thank you, Commissioner Rehn, up to a point. What you are saying is that the Commission knows no more than national data protection supervisory authorities why these special searches are being made. The reason that the topic is so important is that demand for access to EU databases is growing at a fast pace.

In the case of Eurodac, how do we know that these special searches were not unauthorised access by national agencies masquerading as searches on behalf of individuals checking their own data? If the Commission does not know the answer, what trust can we have in its watchdog function as data protection comes under increasing pressure? I would remind you that the Commission is responsible for the enforcement of the rules of this regulation.

  Olli Rehn, Member of the Commission. First, I will pass on your concerns to Commissioner Frattini. Second, the Commission has asked for further clarification from one Member State where a particularly high number of searches were noticed in a very short period of time.

You will understand that at this stage, without knowing the exact reasons for these numbers, I do not want to name and blame any particular Member States. I repeat that, even if we are surprised by these numbers, there is no evidence at this stage that the Eurodac Regulation has been incorrectly applied.

Betrifft: Kosovo

Ist gewährleistet, dass die Europäische Union an den Verhandlungen über den künftigen Status des Kosovo teilnimmt? Wurde ein Katalog mit Fragen und Problemen aufgestellt, zu denen die Europäische Union und insbesondere die Kommission und das Europäische Parlament einen wesentlichen Beitrag leisten können, zumal in den vorliegenden Dokumenten der Organe der EU zum Kosovo ausdrücklich dessen europäische Perspektive erwähnt wird?

  Olli Rehn, Member of the Commission. Let me start by pointing out that the ultimate responsibility in decision-making to facilitate the political process to determine Kosovo’s future status is in the hands of the United Nations Secretary-General, in line with UN Security Council Resolution 1244.

The Commission is satisfied with the UN Secretary-General’s recent recommendation and its subsequent endorsement by the Security Council that says talks on Kosovo’s future status should go ahead. The Commission is also pleased with the appointment of President Martti Ahtisaari on 1 November this year as the UN Secretary General’s special representative or status envoy to lead the talks on the future of Kosovo. The Commission fully supports the efforts of the international community and of President Ahtisaari to prepare and work out a balanced and sustainable settlement in Kosovo and we shall obviously work closely with President Ahtisaari to achieve this objective. Concerning the EU’s participation and the Commission’s role, I would like to point out four things.

First of all, we must ensure that the outcome is compatible with the European perspective for Kosovo and covers the whole western Balkans region.

Secondly, we need to empower the local authorities, our future interlocutors and, at the same time, maintain a streamlined international presence as a security guarantee in Kosovo.

Thirdly, and I am sure that the European Parliament agrees with me on this issue in particular, our common goal must be ‘status with standards’. It is of paramount importance that the rights of minorities and the protection of cultural and historical sites are ensured in order to achieve a sustainable settlement that facilitates stability and the European perspective for the whole region.

And finally, economic development is crucial for the future of Kosovo. I shall soon present a joint paper on the EU’s overall policy on Kosovo with Javier Solana. In that document we will outline how we will facilitate the status process with appropriate financial resources, something on which the Commission would like to work closely with Parliament. I count on your support for this very important endeavour.

  Γιώργος Δημητρακόπουλος (PPE-DE). – Κυρία Πρόεδρε, θέλω να ευχαριστήσω τον Επίτροπο και το επιτελείο του για την απάντηση και για τη συνεργασία και θέλω, απλώς, να υπενθυμίσω δύο πράγματα.

Πρώτον, έχει πολύ μεγάλη σημασία η στήριξη της ευρωπαϊκής προοπτικής του Κοσσυφοπεδίου. Αυτό το λέει και ο απεσταλμένος των Ηνωμένων Εθνών, ο κ. Έιντε, σε αρκετές παραγράφους της έκθεσής του.

Δεύτερον, έχει πολύ μεγάλη σημασία, δεδομένου ότι πρόκειται να εκπονηθεί κοινό κείμενο με τον κ. Solana, όπως είπε ο κ. Επίτροπος, να έχει η Ευρωπαϊκή Ένωση μια συγκεκριμένη διαπραγματευτική τακτική πάνω στα συγκεκριμένα σημεία, έτσι ώστε να μπορούμε μεν να βοηθήσουμε στην αντιμετώπιση των προβλημάτων που θα προκύπτουν αλλά, ταυτόχρονα, όλα αυτά μαζί να αποτελέσουν την ευρωπαϊκή προοπτική.

  Olli Rehn, Member of the Commission. I would like to thank Mr Dimitrakopoulos for his question and for the follow-up question. I can assure him that we have indeed a common objective in ensuring that the European perspective is the future of Kosovo.

I agree that this was very much underlined in the report by Ambassador Eide on standards in Kosovo. In my view, the Eide Report is very professional, of very high quality, is very objective and realistic. It also underlines the need to ensure both standards and status as we make progress in this negotiation process. I can also ensure that, in the joint paper with Mr Solana, we outline our objective of a balanced and sustainable settlement.

  Bart Staes (Verts/ALE). – Voorzitter, ik ben het volkomen eens met de commissaris als hij stelt dat Kosovo een Europees perspectief moet worden geboden. Ook de lokale autoriteiten zijn het erover eens dat er een militaire aanwezigheid nodig zal zijn, zodra de onafhankelijke status verworven wordt. Betekent dit, mijnheer de commissaris, dat zodra die onafhankelijke status verworven is, op termijn de KFOR-troepen zullen worden teruggetrokken en zullen worden vervangen door Europese troepen? Zo dit het geval is, hebt u al enige schatting over wat dit de Europese Unie zal gaan kosten en bestaat er de bereidheid van de Europese Unie en van de Commissie om ervoor te zorgen dat dan voldoende financiële middelen voorhanden zijn?

  Olli Rehn, Member of the Commission. President Ahtisaari has just started his work and is engaged in shuttle diplomacy in Belgrade, Pristina and with the international community. Therefore, I would not like to jump the gun and predict the proposal of the UN envoy President Ahtisaari. In my view it is better to let him work, let him consult with the different parties and then, when the time is right, try to achieve a solution with the necessary determination. Therefore I do not think it wise to take a stand at this point on whether and in which format K-For should continue in Kosovo.

I want to say two things. First of all it is necessary for there to be an international presence in the future too, as a security guarantee. Second, we are starting our needs assessment work in regard to financing in Kosovo, so that we support the work of the international community and President Ahtisaari.

Betrifft: Auswirkungen von FLEGT auf den Schutz der sozialen Rechte und der Umwelt in Entwicklungsländern

Das EU-Aktionsprogramm FLEGT gegen illegalen Holzeinschlag und Handel konzentriert sich im Wesentlichen auf den Aspekt der Legalität des Holzeinschlags, wogegen die nachhaltige Forstwirtschaft größtenteils unberücksichtigt bleibt. Der legale Holzeinschlag an sich bietet allerdings noch keinerlei Garantie für eine nachhaltige Entwicklung der betroffenen Entwicklungsländer, die Verbesserung der sozialen Lage der lokalen Bevölkerung und den Schutz der Artenvielfalt und der Umwelt. Ist die Kommission nicht auch der Auffassung, dass bei den Verhandlungen über Partnerschaften im Rahmen von FLEGT verbindliche Bedingungen im Hinblick auf Entwicklungsaspekte (im sozialen wie auch im Umweltbereich) gestellt werden sollten, damit sich die Lebensbedingungen der lokalen Bevölkerung verbessern, und meint die Kommission nicht auch, dass Legalität kein FLEGT-Ziel an sich darstellt, sondern eine Grundvoraussetzung für den Zugang zum europäischen Markt?

  Louis Michel, membre de la Commission. Madame la Présidente, chers collègues, le plan d'action de l'Union européenne baptisé FLEGT – Application des réglementations forestières, gouvernance et échanges commerciaux – s'intéresse uniquement à la notion de légalité et n'aborde pas les questions plus vastes et plus complexes relatives au développement durable de l'exploitation forestière. Il existe une différence marquée entre ces deux aspects. Du bois, d'origine légale, peut être récolté d'une manière qui porte atteinte à l'environnement, au moyen par exemple d'un défrichage autorisé. De même, du bois d'origine illégale, peut provenir d'une source durable, comme c'est le cas du bois récolté dans le cadre de systèmes de gestion indigène qui, tout en étant respectueux de l'environnement, ne se soumettent pas aux exigences juridiques officielles.

Toutefois, dans la plupart des pays, la législation forestière repose sur des principes de développement durable. Dès lors, l'amélioration de la gouvernance et une meilleure application de la législation entraîneront une gestion des forêts plus respectueuse de l'environnement. Les accords de partenariat qui seront conclus dans le cadre du plan d'action FLEGT constitueront également un moyen de regrouper les parties prenantes afin d'aborder des aspects plus larges de la gouvernance dans le secteur forestier et, le cas échéant, de soutenir la mise en œuvre de réformes législatives réglementaires. La Commission espère que ces procédures permettront d'améliorer la législation et la gouvernance dans les États partenaires et de les rendre plus équitables. Par conséquent, j'espère que vous comprendrez que l'importance accordée, dans le plan d'action FLEGT, à la question de la légalité n'est pas une fin en soi mais plutôt un moyen de collaborer avec les États partenaires pour améliorer la gouvernance dans le secteur forestier.

Néanmoins, le plan d'action FLEGT de l'Union représente une initiative qui a pour objectif d'entraîner des changements grâce à l'engagement des parties. Il n'est donc pas souhaitable que des conditions sociales et environnementales rigoureuses soient imposées aux États partenaires potentiels. Des conditions trop strictes constitueraient un obstacle à leur engagement vis-à-vis des accords de partenariat. Il faut également savoir que, même si le plan d'action FLEGT de l'Union européenne met l'accent sur la gouvernance et la légalité, l'Union reste déterminée à encourager la gestion durable des forêts dans les pays en développement. Ces dix dernières années, l'Union européenne a alloué plus de 700 millions d'euros à la gestion durable des forêts en Asie, en Afrique centrale et en Amérique du Sud.

  Bart Staes (Verts/ALE). – Voorzitter, mijnheer de commissaris, ik dank u voor uw antwoord en een aantal van uw opmerkingen. Natuurlijk kan de samenwerking met die partnerschapslanden een goede zaak zijn, maar we weten allemaal dat niets belet dat mogelijke partnerschapslanden via derde landen, zoals bijvoorbeeld China, toch illegaal hout gaan invoeren in Europa. Greenpeace heeft zeer onlangs kenbaar gemaakt dat ze illegale netwerken vanuit Congo-Brazzaville naar Italië heeft ontdekt, vanuit Papoea-Nieuw-Guinea naar China en zo naar het Verenigd Koninkrijk. Mijn vraag is dus hoe de Commissie, hoe de commissaris van plan is dit soort praktijken een halt toe te roepen?

  Louis Michel, membre de la Commission. La Commission comprend évidemment, par exemple, le souhait – j'ai été interrogé récemment sur cette question – de voir appliquer une interdiction unilatérale des importations de bois d'origine illégale. Cependant, il faut bien admettre que, dans la pratique, cette démarche ne permettrait pas de résoudre le problème de l'exploitation clandestine des forêts. Tout d'abord, en instaurant une interdiction unilatérale d'importer du bois d'origine illégale dans l'Union, on ne doterait pas nos autorités douanières d'un instrument permettant de confirmer ou d'infirmer la légalité de l'origine du bois. En soi, cette interdiction ne suffirait donc pas à empêcher le bois d'origine illégale d'entrer dans l'Union. Pour pouvoir faire, et c'est la grosse difficulté que nous avons, la distinction entre le bois d'origine légale et celui d'origine illégale, nous avons évidemment besoin de la coopération totale des pays exportateurs.

Deuxièmement, une interdiction à l'échelle européenne ne constituera pas un point d'accès pour aborder le problème de la gouvernance dans les pays producteurs. C'est la raison pour laquelle la Commission a proposé une approche reposant sur la signature de partenariats avec les pays producteurs de bois. Cette démarche facilite la coopération exigée entre l'Union européenne et les pays producteurs afin de s'attaquer au problème de la corruption et aux lacunes constatées en matière de gouvernance, qui mènent à une exploitation clandestine des forêts. Sans efforts redoublés et concertés pour éradiquer la corruption des secteurs du bois des pays producteurs, les mesures visant à enrayer le commerce de bois d'origine illégale associé à l'exploitation clandestine des forêts, n'auront aucun impact.

Troisièmement, la démarche axée sur des partenariats est ciblée et proportionnelle. Elle permet de concentrer l'attention et les ressources sur les pays durement touchés par ce problème sans affecter les échanges commerciaux avec les pays où l'exploitation clandestine des forêts ne pose pas de problèmes majeurs. La plupart des échanges commerciaux de produits dérivés du bois ne font pas l'objet de présomptions d'illégalité.

Cela étant, nous devons nous concerter sur la manière de réagir, dès lors que les échanges avec des pays non partenaires font l'objet de présomptions d'illégalité. Cette question sera examinée de manière plus approfondie au cours d'un prochain exercice d'évaluation. Je souhaite insister sur le fait que les mesures examinées dans le cas de cet exercice d'évaluation n'ont pas pour vocation de se substituer à l'approche volontaire préconisée, exposée dans le plan d'action FLEGT, mais de la compléter le cas échéant. Je tiens également à signaler qu'il s'agit d'un exercice d'évaluation et que nous n'avons pas l'intention à ce stade de proposer de nouvelles propositions législatives.

La Commission s'engage à revoir et à analyser la faisabilité d'une législation supplémentaire de soutien au plan d'action FLEGT, comme cela m'a été demandé ici. J'ai donc transmis le message, comme je l'ai promis, au Conseil. Malheureusement, ces travaux ont été freinés par les retards liés à la confirmation de la participation active des États membres et par la décision que nous avons prise de concentrer les faibles ressources sur la mise en œuvre de l'approche volontaire énoncée dans le plan d'action. L'évaluation est en cours et se déroule en étroite collaboration avec les États membres, étant donné qu'un grand nombre de mesures potentielles relèvent de la compétence nationale.

Les options évaluées incluent la politique en matière de marché public, le blanchiment de capitaux, les marchandises volées et la législation anticorruption, en plus de la faisabilité des aspects pratiques de la nouvelle législation de contrôle des importations de bois illégalement récolté.

Enfin, pour vous donner une dernière information, j'ai eu l'occasion, pendant le peu de temps que j'ai été Commissaire à la recherche, d'aller visiter, près de Milan, le centre de recherche de la Commission, et j'y ai vu des travaux forts intéressants. Des surveillances satellitaires qui permettaient de suivre de manière très précise aussi bien les déforestations que les reforestations. Je crois donc qu'il serait peut-être utile aussi de vérifier si nous ne disposons pas là un outil permettant au moins, dans notre dialogue politique avec les pays, de les pousser à se montrer un peu plus enclins à nous aider. C'est là un moyen technologique qui nous permettrait de serrer de plus près, de suivre de plus près l'évolution de cette situation, je ne sais pas si vous avez déjà eu l'occasion d'aller visiter ce centre, d'aller voir ce qu'il peut faire, moi je puis vous assurer que j'ai été fort impressionné. Il est tout à fait possible d'exercer une surveillance relativement précise sur l'évolution, parfois dramatique, parfois un peu plus optimiste, de cette situation.

Honorable parlementaire, je ne peux malheureusement que vous faire part du caractère volontariste de mon approche et vous dire que cette question sera mise sur la table lorsque nous débattrons avec nos partenaires, mais je ne peux vous offrir que ma bonne volonté. Je souhaite deux choses. Je voudrais d'abord que les États membres, c'est-à-dire le Conseil, montrent eux aussi peut-être un comportement un peu plus volontariste sur le sujet. Je crois que cela nous aiderait si, par exemple, on n'entravait pas l'examen des demandes que nous formulons parce que je ne suis pas du tout opposé, bien au contraire, à une législation renforcée. À un moment donné, il faudra tout de même bien passer par là.

Ensuite, je vous ai indiqué une piste que je qualifierais de technique, qui permettrait au moins de faire pression sur les États partenaires et aussi bien sûr sur les États membres. Ce qu'il nous faudrait en réalité, c'est un moyen, disons scientifique, d'identifier, de qualifier l'origine du bois. On a réussi à le faire techniquement pour le diamant par exemple. Il existe aujourd'hui des moyens tout à fait précis de certifier l'origine du diamant. C'est un peu sur cette voie-là que nous devons chercher.

Dans tous nos programmes de développement, il est évident que les activités ou l'action que vous suggérez dans votre question peut évidemment relever de projets de développement, être tout à fait éligibles à pareils projets, que ce soit pour obtenir de l'aide technique, des implants, pour toute une série de mesures; nous sommes évidemment très attentifs à cet aspect. Dans les projets de développement, la question qui vous préoccupe en fait est une question qui devient de plus en plus transversale. Il est évident que, dans tous les projets de développement, là où les pays sont concernés et où certaines régions ou zones sont concernées, ce sont des projets qui sont tout à fait éligibles. Il y en a d'ailleurs pas mal qui sont mis en œuvre déjà aujourd'hui.

Betrifft: Entwicklungszusammenarbeit

Es besteht die Forderung, die öffentliche Entwicklungshilfe (ODA) der Geberländer auf jeweils 0,7 % ihres Bruttoinlandsprodukts zu erhöhen. Damit könnten die Millenniums-Entwicklungsziele fristgerecht bis 2015 erreicht werden. Hierzu sollte die nationale ODA folgende Stufen erreichen: bis 2006 "substantielle Erhöhung", bis 2009 0,5% und bis 2015 0,7% des BIP.

In vielen Ländern wird zur Errechung dieses Prozentsatzes allerdings die Entschuldung mitberechnet, was jedoch zur Folge hat, dass kein zusätzliches Geld zur Verfügung steht, welches aber für die Erreichung der Millenniums-Entwicklungsziele (MDGs) dringend nötig wäre. Welche anderen Komponenten finden in die Berechnung dieser 0,7% Eingang, und wie kann versucht werden, eine einheitliche Berechnungsgrundlage dafür zu finden? Wie können Mitgliedsstaaten rechtlich dafür verantwortlich gemacht werden?

  Louis Michel, membre de la Commission. Madame la Présidente, chers collègues, les ressources financières pour le développement doivent de toute évidence être augmentées de façon substantielle afin que les objectifs du Millénaire pour le développement soient atteints en 2015.

Vous le savez, l'Union européenne prend très au sérieux les défis liés à la mobilisation des fonds budgétaires nécessaires à la réduction de moitié de la pauvreté d'ici à 2015. Pour cette raison, l'Union s'est déjà fixé en 2002 un premier objectif intermédiaire visant à augmenter l'aide au développement en 2006. Collectivement, l'Union veut atteindre un niveau d'aide correspondant à 0,39 % du produit national brut pour l'aide publique au développement.

En mai dernier, le Conseil a approuvé les propositions d'entamer une nouvelle étape pour atteindre conjointement 0,56 % en 2010, puis l'objectif de 0,7 % du PNB en 2015. Ces objectifs, je le sais, sont ambitieux, mais ils sont réalistes. Ils n'ont pas été évalués au hasard. Je me félicite que quatre de nos États membres aient déjà atteint ce niveau d'aide. Six autres ont indiqué vouloir l'atteindre bien avant 2015.

Il existe une définition précise des éléments couverts par le terme "aide publique au développement". Elle a été établie par l'OCDE et reconnue à l'échelle internationale. D'après cette définition, l'allègement de la dette est considéré comme aide au développement. Ceci se justifie dans la mesure où l'allègement de la dette libère des fonds réservés auparavant au service de la dette pour les mettre au service du développement des pays pauvres.

Depuis la Conférence de Monterrey sur le financement pour le développement, les flux de l'aide de l'Union européenne ont effectivement enregistré une augmentation en vue d'atteindre l'objectif intermédiaire en 2006. Une proportion notable de cette augmentation est due à des opérations d'allègement de la dette.

L'esprit du consensus de Monterrey prévoit cependant que l'initiative d'allègement de la dette des pays pauvres très endettés, je cite: "doit être financé intégralement par des ressources supplémentaires". Ainsi, en 2005, la Commission a indiqué, dans son rapport de suivi annuel des engagements de l'Union à Monterrey, qu'il convient d'examiner soigneusement les répercussions que les efforts en matière d'allègement de la dette peuvent avoir sur les flux d'aide. Nous resterons évidemment attentifs dans nos futurs rapports de suivi annuel. À cet égard, je tiens à rappeler que l'Union européenne s'est engagée à mobiliser annuellement environ 66 milliards d'euros dès 2010. Ce sont donc 20 milliards d'euros de plus que prévu pour 2006. À la lumière de ces volumes d'aide envisagés, l'effet d'allègement de la dette sur l'augmentation de l'aide publique au développement sera limité sur le moyen et le court terme.

Was sind die Konsequenzen für jene Länder, die dieses Ziel nicht erreichen? Denn wenn wir das erste nicht erreichen, werden wir auch das zweite nur schleppend erreichen. Welche zusätzlichen Projekte in Form von Kofinanzierungsprojekten der EU werden Sie zur Unterstützung dieser Ziele vorlegen und welche Schwerpunkte werden diese Projekte haben?

  Louis Michel, membre de la Commission. J'ai peut-être été un peu équivoque dans ma première intervention. Je voulais dire que, pour 2006, ce qui a été promis sera non seulement atteint mais sera dépassé: on fera un peu mieux en 2006 que ce que nous avions promis. Pour dire les choses autrement, nous sommes un peu en avance sur le tableau de marche. C'est d'ailleurs pour ne pas perdre ce dynamisme, qui est relatif, que j'ai proposé de fixer un nouvel objectif pour 2010. Je crois que je l'ai dit: il est assez réaliste de penser qu'on atteindra l'objectif de 2010. Je ne dispose malheureusement d'aucun moyen coercitif pour contraindre les États qui ne respectent pas leurs engagements à le faire.

Cela étant dit, je crois quand même qu'il existe aujourd'hui une certaine prise de conscience concernant le fait que le développement est une politique tout à fait fondamentale et qu'en tout cas, on n'a plus d'excuse pour ne pas respecter les engagements. Par rapport aux engagements qui ont été pris dans le cadre du Millénaire, on n'a plus aucune excuse. Si on le veut, on peut trouver les moyens financiers. La volonté politique, je crois, existe. Il reste à la traduire en actes.

Alors, et c'est la question que vous posez, comment faire pour trouver d'autres ressources? Vous savez qu'un certain nombre de pays ont déjà décidé d'opérer un prélèvement ou d'imposer une taxe sur les billets d'avion. Vous savez que l'on parle et que l'on a parlé de la taxe Tobin sur les transactions financières, bien qu'aucun consensus qui permette d'aller de l'avant n'ait pu être dégagé sur cette question.

Personnellement, je dois vous dire que je suis évidemment preneur de toute idée nouvelle à ce sujet. J'avais aussi lancé l'idée, à une époque, d'une taxation sur le marché de l'armement. Cependant, un petit problème moral se pose à cet égard. Le marché légal de l'armement représente mille milliards de dollars par an, tandis qu'on estime à plus de deux mille milliards le marché illégal. Un problème se pose donc: va-t-on taxer le marché légal de l'armement alors que, malheureusement, le marché illégal y échappera?

Vous savez que, dans quelques minutes, un de vos collègues, M. Rocard, devrait poser une question concernant la création d'une loterie mondiale. Je suis très ouvert à cette idée. Vous savez aussi que le fruit des amendes versées à la Commission pour non-respect des règles de la concurrence fait l'objet de discussions. Pourquoi ne pas réserver ces montants au développement? Il y a là toute une série de pistes dont on est occupé à vérifier la faisabilité technique.

Croyez bien que j'ai encore d'autres idées, mais il faut évidemment que les États membres acceptent de les mettre en œuvre. En effet, la plupart de ces idées ne seront pas utiles ou ne seront pas véritablement efficaces si seulement trois, quatre, cinq ou six pays les mettent en œuvre. Il faut que le mouvement soit beaucoup plus général. En conclusion, j'ai le sentiment qu'on devrait pouvoir augmenter substantiellement l'aide au développement dans les années qui viennent.

Betrifft: Wahlen in der Demokratischen Republik Kongo

Im Zusammenhang mit der Tatsache, dass die Abhaltung freier Wahlen in Afrika immer noch so viele Probleme aufwirft, müssen die Wahlen in der Demokratischen Republik Kongo genau beobachtet werden. Die Nachrichten über die Glaubwürdigkeit künftiger Wahlgänge sind nämlich alarmierend: Es ist nicht klar, wer wahlberechtigt ist, es findet massiver Betrug bei der Eintragung in die Wählerlisten statt, es wird eine Atmosphäre der Unsicherheit geschaffen, um den Zugang zu den Wahllokalen einzuschränken, vor allem im Osten des Landes, bedeutende Bevölkerungsgruppen, insbesondere die Kongolesen, die im Ausland leben (davon über 3 Millionen in der Europäischen Union), werden ausgeschlossen. Diese Unregelmäßigkeiten werden unweigerlich dazu führen, dass die demokratischen politischen Kräfte sich weigern werden, an den Wahlen teilzunehmen, sowie dazu, dass die Ergebnisse der Wahl mit hoher Wahrscheinlichkeit angefochten werden.

Die Europäische Union, die die Abhaltung dieser Wahlen aktiv unterstützt, muss wachsam bleiben und beobachten, was sich in der Demokratischen Republik Kongo abspielt. Kann die Kommission daher mitteilen, über welche Informationen sie in Bezug auf die Abhaltung der Wahlen in der Demokratischen Republik Kongo verfügt? Wie gedenkt sie, einen reibungslosen Ablauf der Wahlen zu unterstützen? Welche Maßnahmen würde sie im Falle massiven Betrugs ergreifen?

Madame la Présidente, la Commission, avec l'ensemble de la communauté internationale d'ailleurs, suit de très près l'évolution du processus électoral en RDC et son organisation par la commission électorale indépendante. J'ai personnellement effectué une mission de supervision de l'enregistrement des électeurs à la fin du mois d'août de cette année, pour constater dans quelles conditions cet enregistrement s'effectuait. Malgré l'état de délabrement de l'infrastructure du pays, le nombre d'électeurs enregistrés à ce jour a dépassé le chiffre de 21 millions. Ce chiffre est largement en ligne avec les projections démographiques effectuées sur la base du dernier recensement général de la population qui reste, à l'heure actuelle, la base statistique la plus fiable sur laquelle travailler.

L'enregistrement des électeurs est régi par une loi spécifique qui fixe les conditions pour pouvoir s'inscrire sur une base volontaire. En outre, des dispositions étaient prises par la commission électorale afin de garantir que tous les centres d'inscription étaient traités de la même manière et qu'aucune région ou zone n'était pénalisée par une ouverture tardive du centre. Pour vous donner une simple idée de l'ampleur de la difficulté technique, je dois vous dire qu'il a fallu répartir plus de 10 000 kits d'enregistrement sur l'ensemble du territoire du Congo, en sachant que, dans certains endroits, il n'y a plus de pistes, il n'y a plus de routes, et que l'on a dû utiliser des hélicoptères. Vous vous imaginez donc l'ampleur du travail.

Par ailleurs, afin d'éviter au maximum les risques de double inscription et de fraude massive – puisque cela a été évoqué dans la question – la commission électorale a opté, avec l'aval de la communauté internationale, pour un enregistrement des électeurs sur la base de données biométriques, l'émission immédiate de la carte d'électeur, l'affichage journalier des listes d'inscrits dans chaque bureau d'inscription, l'utilisation de l'encre indélébile et le nettoyage des listes d'électeurs sur la base des données biométriques. La Commission soutient l'organisation du processus électoral par un apport substantiel de 149 millions d'euros par le biais d'un fonds fiduciaire géré par le programme des Nations unies pour le développement. À ce titre, elle participe activement au comité de pilotage du projet d'appui au processus électoral qui supervise les activités menées par la commission électorale dans le cadre du projet.

Afin de garantir la tenue d'élections conformes aux normes internationales, la Commission vient de décider l'envoi d'une mission d'observation électorale dont les travaux débuteront à partir du référendum constitutionnel du 18 décembre prochain et se dérouleront jusqu'à la fin du processus électoral.

À ce stade, rien ne laisse supposer l'existence de fraudes massives dans l'organisation et la tenue du processus électoral. Évidemment, quand je dis "massive", je précise qu'il faut se placer dans le contexte de 22 millions d'inscriptions. J'ai des chiffres, que j'ai reçus cet après-midi, qui indiquent que des fraudes ont été constatées, que certaines sont volontaires, qu'il y a des fraudes dont on ne sait pas si elles sont volontaires, que des erreurs aussi ont été commises. Les personnes qui travaillent sur ces types d'enregistrement sont en général des citoyens et des citoyennes congolais qui ont été formés par la société qui a fourni les kits et il est évident que, quand on encode des millions de personnes, il faut s'attendre à un pourcentage d'erreurs simplement techniques, d'erreurs de manipulation. Quand on se trompe dans un nom, une fois que la machine l'a enregistré, on ne peut pas l'en retirer tout de suite. En revanche, on peut opérer au niveau central. C'est donc là que l'on va éliminer les doublons de ces quelque 22 millions qui sont enregistrés aujourd'hui. On peut donc estimer que, une fois ces doublons expurgés, on va sans doute se retrouver aux alentours de 21 à 22 millions d'électeurs légalement inscrits, sans doublon.

Au cas où des irrégularités d'une importance telle qu'elles risqueraient d'entamer la transparence, la crédibilité et la représentativité du processus seraient constatées par la mission d'observation électorale, conformément aux dispositions de l'accord de Cotonou, la Commission se tient prête à engager un dialogue politique renforcé afin de trouver des mesures correctrices. Cela ce n'est déjà plus d'actualité, nous en sommes plus loin. Je vais vous donner les chiffres.

En fait les résultats du dédoublonnage – comme ils l'appellent d'un mot très vilain – concernant l'aire opérationnelle de Kinshasa ont été présentés aujourd'hui lors de la réunion du comité technique sur le processus électoral. Sur un total de 2 963 101 électeurs enrôlés à Kinshasa, 150 000 cas de doublons ont été repérés. Il y a 18 587 cas de doublons techniques – c'est ce que je viens de vous dire, des erreurs de manipulation –, 10 490 cas de fraude et 121 000 cas de fraude potentielle. Le total des doublons correspond donc à environ 5% du total des enregistrés.

Pour ce qui concerne le pourcentage des doublons frauduleux, il faut tenir compte du fait que, une fois repéré en tant que doublon, chaque cas ne correspond pas à une personne mais au moins à deux. C'est ainsi que, même en faisant la somme entre les cas de fraude et les cas de fraude potentielle, on va obtenir un maximum de 2% de fraude sur le total des cas enregistrés. Les chiffres relatifs aux cas de fraude potentielle seront connus au cours de la semaine prochaine, tout comme le résultat du dédoublonnage pour le Bas-Congo. Tout va donc être nettoyé au niveau central et on devrait donc disposer d'une liste électoral générale tout à fait correcte, sans fraude, qui permette en tout cas de dire que cette élection, si elle a lieu, se fera sur une base tout à fait correcte en termes d'électeurs inscrits.

J'ai d'ailleurs été vérifier sur place comment cela fonctionnait; je dois vous dire que c'était assez impressionnant. Toutes ces personnes qui venaient s'inscrire et qui voulaient s'inscrire, qui étaient très heureuses de le faire, avaient en fait pour la première fois l'occasion d'avoir une existence juridique par rapport à leur État. Ils recevaient pour la première fois une carte d'électeur qui leur tenait lieu aussi, dans une certaine mesure, de carte d'identité, ce qui était nouveau pour eux qui n'avaient jamais eu de véritables papiers. Tout cela était tout de même très impressionnant à voir et le fait d'avoir pu enregistrer dans les conditions que l'on connaît plus de 22 millions d'électeurs – c'est pas encore tout à fait fini, il faudra encore quelques jours – représente un très grand succès, un succès aussi pour la communauté internationale et plus particulièrement pour l'Union européenne qui a porté tout cela à bout de bras.

  Marie-Hélène Aubert (Verts/ALE). – Merci, Monsieur le Commissaire, pour ces précisions plutôt encourageantes et pour leur haute technicité. Vous savez bien que l'aide au développement ne peut pas être réellement efficace s'il ne règne pas un minimum de démocratie et d'État de droit.

Je voulais par ailleurs poser une question complémentaire concernant la liberté d'expression et la liberté de la presse. Nous constatons un certain nombre d'événements attestant l'existence de difficultés considérables dans ce domaine, lesquels impliquent des journalistes et un certain nombre d'opposants qui tentent de s'exprimer. Alors les listes électorales, c'est une chose, mais la liberté d'expression, c'en est une autre. Pourriez-vous apporter de plus amples informations sur ce que ferait la Commission en cas de dérive constatée?

  Louis Michel, membre de la Commission. Le niveau de dialogue politique que nous avons atteint avec les autorités congolaises nous permettrait, si c'était nécessaire, d'intervenir et certainement de les convaincre de changer de cap.

Pour ce qui concerne la liberté de la presse, Madame, je ne sais pas s'il vous a été donné de suivre la presse congolaise sur place. Si vous voulez, je peux vous procurer un certain nombre de journaux, même tous les journaux qui paraissent quotidiennement à Kinshasa et dans d'autres villes. Je dois vous dire que la presse congolaise est caractérisée, dans son ensemble, par une liberté de langage, une liberté de porter des accusations tous azimuts – dont parfois, d'ailleurs, il m'arrive de faire les frais – que l'on rencontre dans peu de démocraties. Alors s'il y a bien un domaine dans lequel il y vraiment eu des progrès très substantiels, c'est celui de la liberté de la presse, même s'il y a beaucoup d'autres choses à redire, et notamment sur la gouvernance. Pour les journalistes, à Kinshasa et ailleurs, c'est la liberté de parole totale. Je dois dire qu'on ne mesure pas les propos que l'on tient. On accuse absolument sans aucun fondement et donc, je ne dis pas que toute la presse est comme ça, mais je peux vous dire que la presse peut se déchaîner sur n'importe qui, que ce soit sur le Président ou sur d'autres personnalités. Donc, en ce qui concerne la liberté de presse au Congo, je pense qu'elle ne pose pas de problème. Il existe d'autres problèmes, d'énormes problèmes par ailleurs, mais très honnêtement, je n'ai pas le sentiment que, sur ce point-là en tout cas, il y ait des problèmes.

Pour ce qui est des opposants, je dois vous dire que, pour ma part, je ne connais, ici et maintenant, et depuis déjà pas mal de temps, aucun opposant qui ait été empêché de participer à des élections ou, par exemple, de créer un parti politique, si ces derniers correspondent évidemment aux critères. Je ne crois pas. Maintenant, ce que je dis là ne doit pas être considéré comme si tout était parfait. Il faut simplement mesurer le chemin parcouru.

Moi qui suis ce problème du Congo depuis de longues années, au titre notamment de mon autre fonction, je dois avouer que, jamais encore, ces dernières années, nous n'avons été aussi près d'avoir la chance de conduire ce pays vers des élections démocratiques et libres, et de lui donner de la sorte une stabilité. J'espère de toutes mes forces que la Constitution sera ratifiée fin décembre et que les élections se tiendront à partir de mars ou avril, de manière à respecter le dernier délai qui est imparti. Je n'ai pas dit que je tombais dans l'optimisme béat. Je dis simplement que, jamais encore, on n'a été aussi près de conditions minimums pour recréer la stabilité au Congo.

Et il est vrai que je suis très engagé sur cette question parce que je considère que la stabilité en RDC constituerait évidemment un élément extrêmement fort pour la stabilité dans toute la région. Il faut tout de même se rendre compte de ce que l'Afrique centrale a quasiment la dimension d'un continent. Betrifft: Mehr Transparenz und Kontrolle bei den WTO-Verhandlungen

Für den Handel ist ausschließlich die EU zuständig. Daher ist es für die Mitglieder des Europäischen Parlaments in ihrer Funktion als gewählte Vertreter sehr wichtig, dass sie die Möglichkeit haben, die Handelspolitik der EU einer umfassenden demokratischen Kontrolle zu unterziehen. Die Hinzuziehung eines nicht gewählten, dem Ministerrat unterstehenden, verstohlen agierenden Ausschusses nach Artikel 133, der die Handelspolitik festlegt, höhlt die legitime Befugnis der MdEP aus, im Auftrag ihrer Wähler zu handeln. Angesichts von Hinweisen, dass es selbst den entschiedensten Befürwortern der in der WTO geführten Verhandlungen über den Marktzugang für Nicht-Agrarerzeugnisse (NAMA) wie der britischen Regierung schwer fällt zu beweisen, dass „freier“ Handel tatsächlich das bewirkt, was sie in ihrem Gerede über Armut und Nachhaltigkeit behaupten, sowie angesichts der Kritik des Europäischen Bürgerbeauftragten an der Transparenz der Handelsgespräche und -verhandlungen stellt sich die Frage, was die Kommission zu tun gedenkt, um den Zugang der Öffentlichkeit zu den WTO-Verhandlungen zu verbessern. Insbesondere ist zu fragen, ob die Kommission eine umfassende Folgenabschätzung in allen NAMA-Bereichen einschließlich der heiklen Bereiche Fischerei und Forstwirtschaft durchführen und über deren Ergebnisse Bericht erstatten wird.

  Peter Mandelson, Member of the Commission. The Commission is in favour of increasing the transparency and accountability of the WTO so as to reinforce the legitimacy of this institution.

On the functioning of the WTO, the EU has put forward a number of proposals for improvements, notably relating to the preparation and management of ministerial conferences, with the aim of facilitating more efficient negotiations and decision-making amongst an ever-growing membership. For instance, it should be possible to agree in the short term to a better definition of the role of the host of ministerial conferences. Equally, there is a need to improve the ability of smaller and non-resident delegations to negotiate effectively both in the Geneva process and at ministerial meetings.

Regarding parliamentary control, the Commission is in favour of granting the European Parliament more powers in terms of trade policy. It has therefore supported proposals putting the European Parliament on an equal footing with the Council in terms of trade policy-making in the Convention on the future of Europe.

Meanwhile, we are keeping the European Parliament fully informed of the conduct and conclusion of international negotiations by regularly taking part in formal and informal meetings of Parliament and transmitting policy documents to Parliament on a par with the Council, as well as consulting Parliament on the main trade policy orientations.

However, the Commission is bound to remain within the Treaty framework. The 133 Committee that is composed of representatives of the governments of the Member States is not a decision-making body, but a consultative body. Major policy decisions are taken by democratically elected ministers in the Council.

As regards transparency vis-à-vis the public in general, the Commission pursues a proactive policy of communication, amongst other things by putting relevant information on its website, through its regular dialogue with civil society and in replying to citizens’ requests for access to documents.

As far as sustainability impact assessments are concerned, they have already been conducted on the first batch of NAMA sectors in 2002/2003, i.e. textiles and clothing, pharmaceuticals and non-ferrous metals. The results have been available on the website of Manchester University since 2003, with suggestions for adjustment whenever imbalances have been revealed, both domestically or in third countries.

A study on forests has also been carried out and the results published in June 2005. A second batch of studies is currently being launched on another set of NAMA sectors and will include fisheries. The results of this second batch are likely to be published in the first half of next year.

Will he specifically commit himself to keeping Parliament’s delegation to the negotiations in Hong Kong fully informed as the WTO talks develop, so that it can play an active part in those talks and serve as a conduit for relaying information to the public to ensure full transparency?

  Peter Mandelson, Member of the Commission. That is very important. Extensive arrangements have been put in place for the European Parliament’s delegation, not only to accompany us in Hong Kong, but to meet us every day, to be regularly informed. In fact, I have just written to the Chairman of the Committee on International Trade, informing him that there will be daily briefings every morning.

It is very important to note that what we are doing in Hong Kong is not some obscure, abstract process. It is about the daily lives and employment opportunities of billions of people. Our job is to justify what we do so as to secure public understanding and support for what we are negotiating at that very important ministerial meeting.

  James Hugh Allister (NI). – Commissioner, could I ask you to focus your attention for a moment on an aspect of substance in the WTO talks, namely the perception by many that agriculture is being made the whipping boy and the sacrifice in those talks.

CAP reform was undoubtedly sold as a means to protect agricultural tariffs from future attack. We were then told agriculture would be safe in the WTO. Now we find that you have, maybe somewhat precipitately, made a unilateral offer to slice those tariffs by a further massive percentage. One really does wonder whether there is an appreciation of the dire jeopardy in which agriculture in many regions like mine, with which you are familiar, is now being placed if that is the process that is to be followed.

  Peter Mandelson, Member of the Commission. It is all too tempting to say that if you were to persuade those with whom I am negotiating in the WTO that we are slashing our agricultural tariffs, then you will have done a better job of persuading them of the weight of our agricultural offer than I have. We have, of course, made a perfectly credible and serious offer concerning agricultural tariffs linked to proposals we have made in respect of domestic subsidies and the elimination of export subsidies. Those are proportionate, and are rooted very firmly within the envelope of the existing CAP reforms and do not go outside it. They are what we are required to do. We signed up to an original Doha mandate, and we then signed up to the framework agreement last summer which invites us to introduce measures that will bring about a substantial improvement in market access in agriculture. That is what I believe we are doing. However, we are not taking risks and we are not jeopardising or threatening the livelihoods of European farmers or farming communities. That is alarmist talk to which I do not subscribe.

  Peter Mandelson, Member of the Commission. I cannot think of anything more difficult or perhaps more painful than negotiating a free trade area between the European Union and the United States of America! However, I strongly believe there is scope for attacking some of the non-tariff barriers that stand in the way of growing trade and investment across the Atlantic.

As the honourable Member knows, this is something of great interest to me. I am particularly concerned about the regulatory differences, the lack of convergence and the obstacles that are thrown up because of the differences and frequent incompatibility between the different regulatory systems in Europe and the United States. However, both of those regulatory systems are rooted in tradition, past practice, and I suspect that we in Europe would have no greater luck in telling the Americans how to reform their regulatory systems than the Americans would have if they came over here and told us how to run our regulatory systems. Nevertheless, through patient dialogue and, I hope in due course, negotiation, we should be able to make some necessary and important improvements that will be of benefit to our respective business communities and, therefore, to jobs and livelihoods on both sides of the Atlantic.

Betrifft: Zollsenkungen für thailändische Krabben

Die Kommission hat für thailändische Krabben eine Zollsenkung von 12% auf 4,2% beschlossen. Die Zollsenkung sollte ursprünglich vom 1. Juli diesen Jahres gelten, wurde aber aufgrund des verheerenden Tsunami auf den 1. April vorgezogen. Man hofft, dass die EU durch die Zollsenkung Thailand helfen kann, sich wirtschaftlich zu erholen. Der Rat hatte nun früher schon vereinbart, dass die gemeinschaftliche Hilfe für die von dem Tsunami betroffenen Länder dazu beitragen soll, die Anfälligkeit gegen etwaige künftige Naturkatastrophen zu verringern. Kritiker behaupten, dass die Zollsenkung für thailändische Krabben dieser Vereinbarung im Rat widerspricht. Begründet wird dies damit, dass die Krabbenzüchter strandnahe Mangrovenwälder roden, um Platz für Teiche zu schaffen. Mangrovenwälder sind ein wichtiger Schutz gegen Stürme, Überschwemmungen und Riesenwellen. Die schwedische Naturschutzvereinigung hat darauf hingewiesen, dass die Folgen des Tsunami geringer gewesen wären, wenn die Mangrovenwälder nicht vernichtet worden wären, um Platz für die Krabbenzucht zu schaffen.

Ist die Kommission der Auffassung, dass die Unterstützung für die Krabbenzüchter in Form von Zollsenkungen mit dem oben genannten Beschluss des Rates im Einklang ist? Hat die Kommission untersucht, welche Folgen die Zerstörung von Mangrovenwäldern im Interesse der Krabbenzucht in Thailand hat?

  Peter Mandelson, Member of the Commission. Under the current Generalised System of Preferences – GSP – the unilateral scheme of tariff concessions granted to 180 developing countries which still applies until 1 January 2006, imports of fishery products including shrimps and prawns into the EU from Thailand’s main competitors – Indonesia, Malaysia and Brazil – are benefiting from reduced duties: from 12% to 4.2%. Thailand has been excluded from GSP preferences for fishery products since 1 January 1999 on the basis of its high level of competitiveness in the EU market.

The new GSP adopted by the Council on 27 June 2005 is based on different criteria and is also more generous to all GSP beneficiaries, including, it was decided, tsunami-affected countries like Thailand. Thus, from January 2006 onwards, Thailand will again benefit from reduced duties on its fishery products under the new GSP. This is consistent with the Commission and the Council’s overall aim to help tsunami-affected countries.

The Commission is aware that concerns have been raised about the issue of prawn farming in south-east Asia and the effects of removing mangrove forests to create lagoons. The Commission therefore supports the sustainable development of coastal-zone management in Asia via the transfer of best practices and environmental solutions from Europe to Asia.

The Commission’s EuropeAid Cooperation Office has so far committed funding for three projects dealing with rehabilitation of mangrove forests in tsunami-affected areas of Indonesia, Sri Lanka and Thailand through the Asia Pro Eco post-tsunami programme. This, moreover, should help safeguard shrimp production – an eligible sector under that programme – which is to address the development of environmental management in coastal areas engaging in aquaculture.

Betrifft: Schwierigkeiten in der Schuhindustrie

Bekanntlich macht die Schuhindustrie infolge der Liberalisierung des Welthandels eine schwere Krise durch, die vor allem die wirtschaftlich schwächeren Länder wie Portugal trifft, wo es im Norden des Landes Gebiete gibt, die von hoher Arbeitslosigkeit bedroht sind und in denen die Gefahr der Drosselung der Entwicklung besteht, wie es jüngst deutlich wurde. Besonders gravierend war die Abschaffung der Quotenregelung für die Einfuhren aus China, wofür der Rückgang des durchschnittlichen Einfuhrpreises um etwa 50% eines der deutlichsten Anzeichen ist.

Daher wird die Kommission gebeten mitzuteilen, welche Maßnahmen sie derzeit ergreift, insbesondere in Bezug auf die von dem Europäischen Verband der Schuhindustrie geforderte Antidumpinguntersuchung.

  Peter Mandelson, Member of the Commission. The Commission is aware of the recent development of imports into the Community of footwear originating in China and Vietnam. In that context, the Commission received earlier this year complaints submitted by the EU footwear industry containing convincing data indicating that the EU footwear industry is suffering from adverse effects caused by dumped prices of imports of footwear into the Community.

The Commission has acted promptly by initiating two anti-dumping investigations. The first concerns imports of footwear with a protective toe-cap originating in China and India. The second concerns imports of footwear with leather uppers from China and Vietnam.

The aim of those investigations is to establish whether the imports in question are dumped and have had a negative impact on the economic situation of the Community footwear industry. The investigations will also have to assess the impact and the possible adverse effect of any measures on the other economic operators in the Community.

The investigation has made progress. The Commission is now analysing the question of market economy treatment of the exporters concerned, the definition of the different categories and models of the products involved, the question of whether there is dumping, the impact of these imports on the Community’s shoe-producing industry and the position of traders, retailers and consumers. All that is in progress. It is not a surprise that it is a highly complicated case. Given the enormous technical problems, with hundreds of economic operators and a product that consists of thousands of different models, it is too early to give any concrete indication about the possible outcome.

Se o processo não avança rapidamente pode ser tarde e, por isso, a questão que lhe ponho é a seguinte: para quando medidas concretas efectivas na aplicação de cláusulas de salvaguarda às áreas mais atingidas?

  Peter Mandelson, Member of the Commission. The investigation will be completed within the prescribed time, though I am unable to say precisely when that will be. Provisional measures can be taken by the Commission between two and nine months after initiation of the investigation.

I should stress that this really is a very complex matter indeed; much more so than was originally anticipated when we began the investigation. We have to be very careful that we assess precisely not only what the effect on the Community interest is, but what the impact would be if we were to take anti-dumping action on a variety of different producers and economic operators in this sector. Some Community producers are themselves partly producing outside the Community.

Former fully-fledged Community producers have kept their research, design and development activities within the Community, but are getting supplies from a variety of sources, like China and Vietnam, but also Romania, Bulgaria and Brazil as well as Italy, Slovakia and other Member States. Those former producers also provide a considerable amount of jobs through these other economic activities.

You can see from this – and I could also identify other issues complicating this matter – that we have to be very careful in our assessment. We do not have a single homogenous set of European producers with one set of clearly identifiable and quantifiable interests. There are a variety of different producer interests and we have to ensure, after our initial judgement on whether the alleged dumping practices have been substantiated, what the impact would be on a variety of different producer interests should any action follow.

  David Martin (PSE). – I am pleased and relieved to hear the Commissioner’s response because I have been lobbied by European retailers who have invested considerable money in Asia, have improved health and safety conditions and working conditions in Asian countries, and are bringing economic benefits both to Asian workers and to European retailers. Would the Commissioner agree that it would be quite wrong if those companies were caught up in any anti-dumping duties?

  Peter Mandelson, Member of the Commission. The honourable Member has identified one such type of European producer whose interests I have to take into account. It will clearly not be easy to find a balanced and equitable solution in this very complex situation and, frankly, the Commission will need a fair amount of ingenuity and flexibility in order to lead this case to a solution acceptable for the Member States and the economic operators.

Having said that, Member States will soon receive a proposal from my services not to grant market economy treatment to the Vietnamese exporters, since state interference, subsidies and other competitive distortions are still widespread. The Commission has not yet assembled any results on China.

Konkret i forbindelse med denne sag vil jeg gerne vide, hvorfor antidumpingundersøgelsen også omfatter sportssko, som har været undtaget fra forordning nr. 467/98 og i det hele taget har været undtaget fra alle begrænsninger i import i mange år. Det giver jo ligesom det indtryk, at Kommissionen er gået i panik over, at man får dette pres fra kræfter i EU, der frygter den fri konkurrence. Kan kommissæren afvise, at det er tilfældet?

She should not assume that anti-dumping duties will be levied on such sportswear producers. I have yet to satisfy myself that there is a direct Community competitor producing such sportswear. Betrifft: Umstrukturierungsprognosen

Welche Mittel nutzt die Kommission, um Umstrukturierungen und künftigen Entwicklungen in den einzelnen Bereichen des europäischen Binnenmarktes und in den verschiedenen Kategorien von Arbeitplätzen – insbesondere in den Inselregionen sowie den ländlichen und entlegenen Regionen der EU – zu prognostizieren?

Wie beeinflussen die bilateralen und internationalen Verpflichtungen und Verträge der EU diese Vorausschau?

Mit welchen Mechanismen wird die Kommission die nachhaltige Entwicklung dieser Regionen, die Erhaltung ihrer sozialen Struktur und insbesondere die berufliche Fortentwicklung der Arbeitnehmer und die Planung von Bildungsmaßnahmen für die junge Generation sicherstellen?

  Vladimír Špidla, člen Komise. Vážená paní předsedající, vážené poslankyně, vážení poslanci. Působení Komise v oblasti restrukturalizací je činností na celoevropské úrovni. Komise nedisponuje zvláštními mechanismy pro předjímání restrukturalizací podniků a budoucího vývoje v oblasti hospodářství a práce v každém odvětví a pro každý druh zaměstnání v ostrovních, venkovských a vzdálených regionech. Každý členský stát má k dispozici nástroje k zajištění dohledu nad jednotlivými odvětvími a nad vlastním trhem práce. Komise však může zavést zvláštní dohled v případě určitého odvětví nebo regionu. Sdělení o restrukturalizacích a zaměstnanosti z 31. března 2005 dává sociálním partnerům možnost se na Komisi v tomto směru obrátit. Také ve svém sdělení o průmyslové politice z 5. října uvádí Komise některá průmyslová odvětví, v nichž by mohlo v nejbližších letech dojít ke strukturálním změnám. V této souvislosti je třeba, aby bylo možné tyto změny předvídat a usnadnit jejich průběh na regionální, národní nebo evropské úrovni. I v terciárním sektoru se však mohou restrukturalizace projevit a je třeba, aby se jimi zabývaly podrobné studie.

Komise spolupracuje s dublinským monitorovacím střediskem a aktivně se účastní jeho projektů zaměřených na různá odvětví a na sledování restrukturalizací. Závazky a smlouvy Evropské unie uzavřené na dvoustranné a mezinárodní úrovni mají vliv na některé určující činitele restrukturalizací jako jsou míra otevření trhů, přístup na trhy, technologické inovace a jejich šíření a sociální ustanovení obsažená v těchto typech smluv. Komise má k dispozici několik nástrojů, jejichž prostřednictvím přispívá k udržitelnému rozvoji regionů, mezi něž patří zejména evropská strategie zaměstnanosti, Evropský sociální fond pro investice do lidského kapitálu, Evropský fond pro regionální rozvoj pro investice do infrastruktur, výrobní investice a rozvoj vnitřního potenciálu.

Strukturální fondy poskytují pomoc v rámci střednědobých strategických programů s cílem předjímat a lépe řídit vývoj průmyslu a omezit na minimální míru jeho důsledky pro pracovníky. V tomto ohledu se v návrzích Komise vztahujících se k budoucímu programovému období v roce 2007 až 2013 pokládají sledování a řízení změn také za prioritu v rámci cíle konkurenceschopnost a zaměstnanost. To povede k zaměření na tři důležité otázky, značné nerovnosti v oblasti zaměstnanosti, pokračující rychlé tempo hospodářské a sociální restrukturalizace vyvolané globalizací a rozvojem hospodářství založeného na znalostech, demografické změny, jejichž důsledkem bude stárnutí pracovní síly.

Toto nařízení mimo jiné počítá s rezervou pro případ krize v rozsahu 1 % pro konvergenční regiony a 3 % pro ostatní regiony, jež členskému státu umožní využít fondů pro lepší zvládnutí hospodářských a sociálních restrukturalizací nebo důsledků otevření světového trhu. Komise navíc nedávno navrhla založení fondu pro přizpůsobení globalizace s cílem čelit případným záporným důsledkům restrukturalizací. Pokud bude tento fond ustaven, bude podporovat pracovníky dotčené krizí spojenou s globalizací.

V rámci vzdělávání budoucích generací umožňují evropské vzdělávací programy Erasmus, Sokrates a Leonardo tisícům mladých studentů studovat v zahraničí. Také rámcové programy pro výzkum financované Evropskou unií umožňují financovat velmi významné projekty na evropské úrovni zejména v oblastech práce, vzdělávání a odborné přípravy a inovace, které otevírají cestu k dalším aktivitám.

Ήθελα να ρωτήσω συγκεκριμένα αν έχετε προβλέψει από πού θα χρηματοδοτηθεί αυτό το σχεδιαζόμενο ταμείο ενίσχυσης των αναδιαρθρώσεων και αν προβλέπεται δημοσιοποίηση όλων αυτών των βοηθητικών μέτρων ώστε να ενισχυθεί η εμπιστοσύνη των Ευρωπαίων στις εξελίξεις και να μην αποθαρρύνονται μπροστά στο φαινόμενο της παγκοσμιοποίησης.

  Vladimír Špidla, člen Komise. Samozřejmě, že již současné prostředky umožňují Komisi reagovat na některé náhlé změny. Uvedu například v poslední době známý případ Rover, který během krátké doby znamenal ztrátu 5 000 pracovních míst. Evropská komise využila strukturálních fondů k tomu, aby intervenovala a tato intervence je obecně považovaná za úspěšnou. Tento případ byl ovšem zvláštní tím, že se jednalo o jednu továrnu v jedné zemi. Pokud se jedná o problém, který zasahuje více států, má síťový charakter a má charakter změny rozsáhlého systému jako např. v poslední době firma Electrolux, nyní neexistují dostatečné efektivní nástroje, proto je myšlenka onoho fondu pro zvládání následků globalizace a restrukturalizace. Jeho cílem není chránit podniky, které nejsou konkurenceschopné, nýbrž umožnit lidem, kteří jsou dotčeni touto restrukturalizací, nalézt novou životní základnu. Dovolte mi určitou metaforu „Není naším cílem zachránit loď, která už se beznadějně potápí, nýbrž zachránit posádku a převést ji na další loď nebo na pevninu, aby mohla dál pokračovat v životě.“

Podporované činnosti fondu jsou investice do lidského kapitálu a průběžné vzdělávání, uzavírání úmluv v oblasti zaměstnanosti a partnerství pro inovaci na úrovni států, regionů a obcí, rozvíjení systémů a nástrojů umožňujících předjímat sociální a hospodářské změny, zlepšení přizpůsobivosti pracovníků a podniků zasažených restrukturalizací a posílení administrativních kapacit a výkonnosti všech zúčastněných stran, např. vyškolením řídících pracovníků zabývajících se změnami. Pro zavedení fondů lze využít mechanismů, které již existují v současných členských státech, např. těch, jež se používají pro Evropský sociální fond.

Ende September äußerte sich der Kommissar für Beschäftigung, soziale Angelegenheiten und Chancengleichheit, Vladimir Spidla, bei einem Treffen mit den Sozialpartnern zu der Freizügigkeit der Arbeitnehmer. Berichten zufolge will die Kommission die Beschränkung für Arbeitssuchende aus den osteuropäischen Ländern so früh wie möglich aufheben.

Da aber gerade in den an die neuen Mitgliedstaaten angrenzenden Regionen ein extrem hohes Lohngefälle besteht, ist der Aufschub der Freizügigkeit für Arbeitnehmer und der Dienstleistungsfreiheit von zentraler Bedeutung.

Gibt es in der Kommission bereits einen konkreten Plan, die Beschränkungen für Arbeitssuchende aus den osteuropäischen Ländern aufzuheben? Wenn ja, wie und wann wird dies geschehen?

  Vladimír Špidla, člen Komise. Dámy a pánové, v době uzavírání přístupových smluv byla také formulována přechodná období 2 + 3 + 2. Koncepce těchto přechodných období, tzn. okamžiků, kdy se má ověřovat, zda tato přechodná období mají smysl, se dají interpretovat jako zájem při podepsání přístupových smluv ukončit přechodná období, která znemožňují uplatnit plně volný pohyb pracovních sil v čase, který je co nejkratší.

Komise má v současné době povinnost předložit zprávu, která vyhodnotí důsledky přechodných období v první fázi oněch dvou let. Cílem Komise je připravit věrohodnou, metodicky naprosto spolehlivou zprávu, která vezme v úvahu všechny okolnosti včetně toho, že některé země sousedí s nově přistoupivšími zeměmi. Musím říct, že je to práce, na kterou kladu mimořádný důraz, protože se jedná o zprávu, která se musí stát autoritou pro rozhodování v tak citlivé věci a současně základem pro další práci a další vyhodnocení v období následujících tří let, kdy po onom pětiletém přechodném období se bude rozhodovat opět podle smlouvy s daleko menší mírou volnosti než se rozhoduje v období dvouletém. Je naším zájmem, a to takřka absolutním, vzít v úvahu všechny relevantní faktory, které jsou spojeny s touto citlivou věcí, včetně geografické polohy jednotlivých zemí.

  Manfred Weber (PPE-DE). – Frau Präsidentin! Ich möchte mich ganz herzlich beim Kommissar für die Ausführungen und auch für den Hinweis darauf bedanken, dass es ein ausgewogener Bericht werden soll. Ich möchte die Frage anschließen, warum in den öffentlichen Äußerungen von Ihnen und von Ihrem Haus schon das Signal der Vorfestlegung ausgegangen ist und man die Freizügigkeit so schnell herstellen will.

Wir sind uns alle einig im Ziel der Freizügigkeit, und sie ist ein Grundprinzip der Europäischen Union, zu dem wir auch stehen. Es geht aber um das Ernstnehmen der Sorgen aller Seiten, die davon betroffen sind. Deswegen noch einmal die Nachfrage: Warum wurde diese Vorfestlegung von Ihnen so getroffen?

  Vladimír Špidla, člen Komise. Do jisté míry jsem již zareagoval ve svém předchozím vystoupení, ale myslím si, že je to otázka do té míry důležitá, že je třeba její odpověď upřesnit. Koncepce přístupové smlouvy tím, že rozčleňuje přechodná období na určité úseky, předpokládá vážné zhodnocení těchto úseků. Implicitní cíl těchto dílčích úseků je ukončit přechodná období, čím dříve tím lépe. Jsem pevně přesvědčen o tom, že volný pohyb pracovních sil je jedním z významných impulzů ekonomického vzestupu Evropské unie včetně tvorby pracovních míst. To je tedy obecná záležitost.

Na druhé straně jsem si naprosto vědom, že se jedná o záležitost mimořádně citlivou a znovu zdůrazňuji, že cílem bude přeložit zprávu, která bude považovaná za autoritativní, tzn. nebude možné ji z žádného metodického hlediska narušit. Jednotlivé státy budou pochopitelně rozhodovat podle smlouvy, s možností rozhodnout se na základě fakt podle toho, co považují za správné. Není záměrem Komise rozbít a vyvolat destrukci kteréhokoliv trhu práce, ale záměrem přístupových smluv je vytvořit společný trh, společný volný pohyb pracovních sil, který je jednou z hodnot z oněch základních čtyř hodnot, které se uplatňují v Evropské unii a na kterých koncepce evropské integrace stojí. V tomto směru jsem toho názoru, že je správné postupovat přiměřeně rychle, s odpovídající odvahou, po zvážení všech relevantních údajů. Je samozřejmě odpovědností vlád, jakým způsobem se rozhodnou.

  Claude Moraes (PSE). – Commissioner, thank you for restating your commitment to the principle of the free movement of workers. I very much agree.

However, I should like to ask you whether you plan to research or analyse, from the Commission point of view, the decision by the United Kingdom and other countries to open up their labour markets to free movement of labour immediately, as opposed to those countries which impose restrictions. Is this something that you plan to do and could you tell us if it is a feasible idea?

  Vladimír Špidla, člen Komise. Zkušenosti Velké Británie, Irska a Švédska jsou nepochybně důležitým zdrojem pro popsání důsledků, které má případné zrušení nebo neuplatňování přechodných období a jsou to zkušenosti, které je třeba pečlivě vyhodnotit, tzn. využít případně i určitých studií.
