  Przewodniczący. Kolejnym punktem porządku dziennego jest sprawozdanie sporządzone przez Janelly Fourtou w imieniu Komisji Petycji w sprawie domniemanych nadużyć przy stosowaniu walencjańskiej ustawy o działalności urbanistycznej (LRAU) oraz jej oddziaływania na obywateli europejskich (petycje 609/2003, 732/2003, 985/2002, 1112/2002, 107/2004 i inne) [2004/2208(INI)] (A6-0382/2005).

  Janelly Fourtou (ALDE), rapporteur. – Monsieur le Président, Monsieur le Commissaire, chers collègues, la douceur du climat, la beauté du paysage, ainsi que des prix attractifs et l'accueil chaleureux des habitants incitent depuis des années des milliers d'Européens à devenir propriétaires dans la région de Valence, en Espagne.

Pour faire face à la demande très croissante et lutter contre la spéculation, le gouvernement autonome de Valence a adopté une loi d'urbanisation en 1994, la LRAU. Or, c'est justement contre l'application de cette loi que des milliers de pétitions arrivent au Parlement européen. Les pétitionnaires se plaignent de la remise en cause abusive, pensent-ils, de leur droit de propriété en raison d'aménagements et de développements urbains. Les critiques portent tant sur le fond - légitimité judiciaire, économique et environnementale de tel projet - que sur la forme - manque d'information, de transparence, délai de contestation trop court et montant d'indemnisation trop bas. Ils se sentent démunis face à une situation par ailleurs fort complexe, puisque - il faut le rappeler - la responsabilité juridique et politique est dans ce cas partagée entre le gouvernement espagnol, en ce qui concerne la loi du sol, la communauté autonome de Valence, en ce qui concerne la législation locale relative aux règles d'urbanisme, et les municipalités qui, en s'appuyant sur la législation, à la fois espagnole et régionale, mettent en œuvre les programmes qu'elles jugent légitimes.

Pour être plus au fait de la situation sur le terrain, la commission des pétitions a envoyé par deux fois, en 2004 et en 2005, une délégation pour s'informer auprès de toutes les parties concernées. En tant que rapporteur, j'ai fait partie de la seconde délégation et j'ai été très impressionnée par le nombre important de pétitionnaires et touchée par leur discours mais aussi par leur confiance dans la réaction européenne. J'ai aussi apprécié l'écoute des autorités de Valence et leur désir de coopération.

La Communauté de Valence, consciente des problèmes, est d'ailleurs en train de travailler à une nouvelle loi, la LUV, qui prendra en compte les revendications soulevées par les pétitionnaires. Dans un souci d'ouverture, le gouvernement valencien a d'ailleurs invité le Parlement européen à lui proposer les suggestions qui lui sembleront nécessaires.

On reproche très souvent à l'Europe d'être loin des citoyens et nous avons là l'occasion de démontrer le contraire: le Parlement européen, au travers de sa commission des pétitions, est à l'écoute du citoyen. Le problème, c'est que nous ne pouvons cependant pas outrepasser nos compétences car il faut absolument éviter de créer chez les citoyens une attente qui ne pourrait être que déçue. En ce qui concerne les faits et la compétence communautaire, nous demandons donc à la Commission européenne de continuer à veiller au respect de la procédure d'appel d'offres et à surveiller tout manquement aux directives environnementales. Elle a d'ailleurs commencé à répondre à nos attentes en ouvrant, le 21 mars dernier, une procédure d'infraction à l'encontre du royaume d'Espagne pour non-respect de la directive sur les marchés publics.

Nous insistons auprès du gouvernement régional et auprès des municipalités pour qu'ils fournissent à toutes les personnes concernées par la LRAU une assistance leur permettant d'envisager un éventuel processus de correction et d'indemnisation. Nous lançons un appel pour que la question environnementale qui s'avère cruciale pour l'avenir européen soit prise en compte dans tous les projets.

Je remercie mes collègues qui se sont passionnés pour ce sujet et qui ont enrichi mon rapport initial, mais je leur rappelle que nous ne pouvons agir que dans la limite de nos compétences communautaires et que notre marge de manœuvre est étroite. Nous réagissons et nous avons tous réagi en fonction de notre tempérament et de nos engagements. Certains ont tendance à en faire beaucoup, d'autres pas assez, j'ai essayé, pour ma part, d'adopter une attitude médiane et c'est dans cet esprit que le groupe ALDE présentera quelques amendements destinés uniquement à recentrer notre action.

Je suis tentée de dire aux citoyens européens concernés par cette LRAU que nous les avons entendus, que nous déplorons la situation et que nous ne sommes pas ici pour juger, mais pour essayer de faire pression pour qu'ils soient tous entendus, respectés et qu'enfin, une solution juste et équitable soit trouvée. J'espère que ce rapport aboutira, que la situation deviendra enfin équitable pour tous et que la commission des pétitions prouvera une fois de plus que nous sommes un rouage important des relations entre le citoyen et le Parlement européen.

  Charlie McCreevy, Member of the Commission. Mr President, the rapporteur, Mrs Fourtou, and her fellow members of the Committee on Petitions have worked very hard on this report, an initiative from this House in response to thousands of petitions received by the committee. I would like to thank all those involved for their work and valuable contributions to this difficult and delicate debate. This is indeed of concern to many EU citizens, as shown by the number of petitions received.

Two fact-finding missions were sent to Valencia, which gave the committee members an opportunity to meet with representatives of all those concerned and to have a first-hand experience of the situation on the ground. You know better than anyone else the issues at stake.

Mrs Fourtou’s report touches upon a number of important topics which have attracted the political attention of this House. The Commission, within the limits of its competences, has looked into this matter mainly from an internal market perspective. In concrete terms we have analysed the public procurement dimension of the Spanish law. I shall concentrate on that.

The Commission takes the view that the approval of integrated action programmes under the Valencia Land Planning Law involves the award of public work and service contracts. Early in this process the Commission considered that the Valencia Land Planning Law raised questions with respect to EU public procurement legislation. Contracts were awarded without transparency or publication of notices in the EU Official Journal. There were no objective selection or award criteria, no appropriate price clauses, and no equality of opportunity for all those interested in the business opportunity. The Commission therefore decided to launch infringement proceedings against Spain on this issue and sent a letter of formal notice on 21 March 2005.

Since then, we have been working together with the relevant authorities to correct the defects that were detected with the application of the existing law. However, the draft new law that was submitted to my services does not correct all problems identified. In addition, the practical situation has not changed. Public authorities continue to award public contracts without following appropriate tendering procedures. In view of this lack of progress, in a few days I plan to send a letter to the competent authorities in Spain asking them to take appropriate measures to remedy the situation.

Reconciling planning requirements and procurement laws can be highly complex. However, this must not be an excuse for not applying the EU procurement rules. These rules bring benefits for public authorities, by increasing competition for public contracts and lowering the price of works, supplies and services. Therefore, you can count on my commitment to ensure that EU public procurement rules are respected, both in the letter and the practice, of whatever legislation is approved in the future.

Mrs Fourtou’s report also raised a number of other issues of concern, but as they fall outside the scope of Community competence, the Commission is not in a position to address them.

  Μαρία Παναγιωτοπούλου-Κασσιώτου, εξ ονόματος της ομάδας PPE-DE. – Κύριε Πρόεδρε, ως μέλος της δεύτερης αντιπροσωπείας του Ευρωπαϊκού Κοινοβουλίου, η οποία τον Ιούνιο του 2005 επισκέφθηκε τις ισπανικές αρχές στη Μαδρίτη και τις περιφερειακές και τοπικές αρχές της αυτόνομης περιφέρειας της Βαλένθιας και συναντήθηκε με ομάδες αναφερόντων, είμαι υποχρεωμένη να διακηρύξω δημόσια ότι όλοι οι παράγοντες επέδειξαν άριστη διάθεση συνεργασίας με τους ευρωβουλευτές και βεβαίωσαν για την κατανόηση και τη φροντίδα για τα δίκαια, αλλά όχι για τα παράνομα αιτήματα των πολιτών.

Η εισηγήτρια κ. Fourtou πραγματοποίησε άθλο συνθέτοντας έκθεση εκ μέρους της Επιτροπής Αναφορών και χρησιμοποίησε με μαεστρία όλη την αφαιρετική της ικανότητα για να κρατήσει όσο γίνεται τα ουσιαστικότερα στοιχεία, που έχει νόημα να προβληθούν σε μια έκθεση που καλείται να ψηφίσει η Ολομέλεια τηρώντας τον Κανονισμό και τις νομικές υποχρεώσεις της και όχι υπερβαίνοντάς τις.

Δυστυχώς, κατά την ψήφιση της έκθεσης Fourtou στην Επιτροπή Αναφορών, παρεισέφρησαν στο κείμενο, τροπολογίες που θίγουν την αρχή της επικουρικότητας, καθώς και καταγγελίες που δεν συνοδεύονται από τις ανάλογες αποδείξεις.

Υποστηρίζουμε, λοιπόν, τις τροπολογίες της εισηγήτριας και της ομάδας της με τη διαγραφή ένθετων λεπτομερειών. Οι τροπολογίες αυτές αποκαθιστούν την αξιοπρέπεια του μη νομοθετικού κειμένου, το οποίο, βέβαια, δεν έχει επιπτώσεις. Άλλωστε και εμείς με μια σειρά δικών μας τροπολογιών προσπαθούμε να βελτιώσουμε τον απαράδεκτα διδακτικό και προσβλητικό για ένα κράτος μέλος, επιτακτικό χαρακτήρα, κυρίως της παραγράφου 6 και της παραγράφου 11. Ιδιαίτερα η τροπολογία της παραγράφου 11 τονίζει το γενικότερο πρόβλημα υπερβολικής πολεοδόμησης των ακτών της Μεσογείου γενικώς και προβάλλει το γενικό χαρακτήρα προστασίας του περιβάλλοντος.

Ως προς την αιτιολογική σκέψη Ι, η τροπολογία μας διορθώνει τον αόριστο χαρακτήρα του κειμένου και υπενθυμίζει την ήδη ασκηθείσα διαδικασία επί παραβάσει, σύμφωνα με το άρθρο 226 της Συνθήκης και την ευρωπαϊκή νομοθεσία, όπως αναφέρατε και εσείς, κύριε Επίτροπε, γι' αυτό και ζητούμε να υπερψηφισθούν οι τροπολογίες από όσους θα υπερψηφίσουν και την έκθεση. Τώρα, το αν θα ψηφίσουν οι συνάδελφοι την έκθεση, είναι στην ελεύθερη θέλησή τους.

  Proinsias De Rossa, on behalf of the PSE Group. – Mr President, I wish to begin by apologising for the absence of Mr Cashman, who is unable to take part in this debate this evening because of travel problems. He would have been leading for the PSE Group in this debate otherwise.

This report is extremely important for a number of reasons, because it seeks to demonstrate to the citizens of Valencia that this European Parliament is not only a law-making body – which of course it is – but also a voice of the people of Europe when their rights are threatened. I also wish to say that the PSE Group will not accept amendments to this report which seek to weaken it. The report is already a compromise report and is not as strong as I certainly would like it to be.

It is intolerable that residents of parts of Valencia face the fact that their property has been and may be expropriated by the local state with the consequent enrichment of developers. It is particularly important to insist on the application of directives which come under a Commission remit other than the internal market. I refer specifically to the 2001 directive which deals with strategic environmental impact assessments and the 2000 directive which deals with the prudent use and protection of water resources – all of which are the subject of this complaint. Indeed, it is also important that we should seek ways to press the Valencian Government to put a moratorium on new projects, pending the implementation of a satisfactory new law which meets the full requirements of the European Union.

It is also essential that citizens have the right of redress and that they are not kept in the dark as to proposals relating to their property, either when they are buying property or when they are in possession of it. It is not appropriate that any citizens should be unilaterally dispossessed of the property that they enjoy.

Let me refer to another issue. I am sure my colleague would not object to my drawing Commissioner McCreevy’s attention to the fact that last Friday 100 000 people in Ireland marched to express their anger at the Bolkestein directive for which he currently has responsibility. As he is in the Chamber tonight, I want him to appreciate that serious statement of concern by European citizens.

  Diana Wallis, on behalf of the ALDE Group. – Mr President, I congratulate my colleague Mrs Fourtou on her balanced report. We in the ALDE Group will support our own amendments, of course, but not other amendments that seek to weaken this report further.

This is about citizens’ rights. More importantly, perhaps, this is a right that goes to the centre of the European Union. Freedom of movement in the European Union has been a real success story, and when our citizens choose to exercise that right by living in – and often retiring to – another Member State, they deserve our protection and support. Many of them make the biggest financial investment they will ever make in their lives by purchasing real property.

That is what happened to citizens in one region of one Member State. They have come to us in their thousands to explain that something has gone disastrously wrong. The value of their property is being wiped out by a development control law that does not seem to be working. We have produced, I believe, a balanced report that will continue to put pressure on the authorities in Valencia.

There are three elements that we need to achieve. We need to make sure that you, Commissioner, continue to enforce EU law where you can; we need to make sure that those citizens who have come to us can benefit from some form of compensation or redress mechanism – and for that we must continue to exert pressure on the Spanish authorities.

I must also ask you this, Commissioner: we ask our citizens to move and live elsewhere, and we do not want to see this kind of scenario again. So, without interfering in Member States’ land law – which is their own affair – can we please look for some sort of advice, guidance and information for our fellow citizens who buy property in another Member State?

We do not want to see this again. We do not want to nanny our citizens, but we want to support them when they exercise the right to freedom of movement that is so precious to all of us.

  David Hammerstein Mintz, en nombre del Grupo Verts/ALE. – Señor Presidente, estamos realmente ante una cuestión profundamente europea, una cuestión de derechos: no podemos aplicar la legislación europea sin tratar el escándalo urbanístico en el Mediterráneo. Ni siquiera podemos aplicar el Tratado en relación con los derechos humanos, ni podemos aplicar las directivas de contratación pública, la Directiva marco del agua, la Directiva de evaluación ambiental estratégica, sin enfrentarnos a lo que el Presidente del Consejo Superior de Colegios de Arquitectos ha denominado esta misma mañana un horror urbanístico: ha dicho que el litoral mediterráneo está colmatado, que el territorio está sufriendo una masificación importante y un impacto irreversible que dejará una huella ecológica demasiado dura.

Tenemos que acabar cuanto antes con este horror, que está vulnerando los derechos de las personas: miles y miles de personas —la gran mayoría son valencianos— están sufriendo esta situación.

No es compatible un medio ambiente sostenible con este modelo. Yo creo que estas vulneraciones de directivas europeas han de tener una respuesta europea fuerte y rápida.

Y, en ese sentido, hemos hecho un informe entre todos, gracias a un trabajo ejemplar de dos años de la Comisión de Peticiones, que adoptó este informe de forma unánime. Y, ahora, unas personas que votaron a favor en la Comisión de Peticiones quieren deteriorar, quieren debilitar de forma irreversible este informe. No creo que sea demasiado honesto. Yo creo que los intereses medioambientales de los ciudadanos van por delante de los intereses del ladrillo y del cemento, que quieren cubrir toda la costa del Mediterráneo.

  Graham Booth, on behalf of the IND/DEM Group. – Mr President, while we sympathise greatly with the citizens who find themselves in this invidious position, we in UKIP believe that the situation in Valencia over land grab is one which should have been dealt with by bilateral agreements between Spain and the individual countries concerned. Instead, I suspect the European Parliament is once again using a sledgehammer to miss the nut.

Town planning is a field that needs to remain at local level in order for the needs of local areas to fall on understanding ears. A centralised policy would compound, not ameliorate, the problem. We have seen that time and time again with so-called European projects. Let me remind you of a few examples.

Firstly, we have the common fisheries policy, with its seriously damaging quota system. Hailed as an environmental project, it has done near irreparable damage to fish stocks. A huge proportion of fish processing plants in the United Kingdom have been forced to close and local fishing economies have been devastated. And how can we talk about disasters without mentioning the CAP, which created wine lakes and butter mountains and is now giving Commissioner Mandelson as much of a headache as it is the farmers in the developing world? In essence, Chirac, by protecting the little French farmer, is holding the world to ransom. Instead of stabilising the prices of primary product markets, the EU is harming the very people it says it wishes to help.

The situation facing those non-Spanish nationals in Valencia, including many UK citizens, should be dealt with on a government-to-government basis. I lament the fact that the British Government has failed to reach a bilateral agreement with Spain on this issue. Instead, we see the EU octopus bureaucracy once again using private misfortune to plunder the sovereignty of Member States.

  Marcin Libicki, w imieniu grupy UEN. – Panie Przewodniczący! Najpierw chciałbym bardzo podziękować tym wszystkim, którzy mieli udział w tym sukcesie, jakim powinno się skończyć przyjęcie tego sprawozdania. Przede wszystkim cieszę się, że ci, którzy napisali petycję, mieli zaufanie do Unii Europejskiej, do Komisji Petycji, której mam zaszczyt być przewodniczącym. Bardzo się cieszę również, że przy pisaniu, przygotowywaniu i rozwiązywaniu tej sprawy pomagał Rzecznik Praw Obywatelskich rządu Walencji. Bardzo się cieszę, że członkowie naszej czerwcowej misji tak owocnie pracowali. Pod przewodnictwem pana Cashmana – wiceprzewodniczącego, była pani Fourtou, która napisała to sprawozdanie, za które jej dziękuję, była pani Panayotopoulos, której też za to dziękuję i był szef sekretariatu naszej komisji. Ta cała praca zaowocowała właśnie tym sprawozdaniem.

Można się było zastanawiać pierwotnie czy ta petycja, złożona na początku przez pana Charlesa Svobodę w imieniu związku Abusos Urbanisticos No z siedzibą w Walencji, a także państwo Schuckallów i panią Ullę-Britt Perret, a do której dołączyło się potem kilkanaście tysięcy osób, nadaje się do rozpatrywania. Aczkolwiek oczywiste było, że się nadaje z powodu tego, że naruszone zostały zasady środowiska, zasady zamówień publicznych, ale przede wszystkim zostało naruszone podstawowe prawo człowieka – prawo własności i to ludzi często bardzo skromnych, którzy chcieli tylko resztę życia spędzić w swoich małych domach, które sami sobie wybudowali.

Nasze kontakty z petycjonariuszami – kontakty Fact Finding Mission, nasze kontakty w czasie naszych posiedzeń wskazywały na to, jak dramatyczna była sytuacja ludzi, którzy zostali pozbawieni swoich własności w znacznym stopniu. Jakże dramatyczne były ich przeżycia, kiedy okazywało się, że zabiera im się bez żadnej wiedzy część dobytku i w istotny sposób pozbawia się ich fundamentalnych praw.

Sprawozdanie, które napisała pani Fourtou zostało przyjęte w naszej komisji jednomyślnie (tylko jedna osoba się wstrzymała od głosu). Było ono wynikiem kompromisu i przedyskutowania tych poprawek, które były omawiane w komisji. Dlatego też wydaje mi się, że powinniśmy to sprawozdanie przyjąć bez takich poprawek, które mogłyby je dzisiaj zniekształcić. Skoro zostało przyjęte jednomyślnie, byłoby dobrze gdyby ta Izba to sprawozdanie przyjęła.

Proszę państwa zależy nam na tym, żeby Walencja wprowadziła nowe prawo, co już obiecała i co dowodzi skuteczności pracy Parlamentu Europejskiego i naszej komisji, które będzie uwzględniać prawa człowieka, zamówienia publiczne w sprawie środowiska. Jest też sprawa odszkodowań dla tych ludzi, którzy zostali pokrzywdzeni i w związku z tym domagamy się, żeby rząd Walencji prowadził szczegółową dokumentację każdego przypadku oddzielnie i ewentualnie zaproponował odpowiednią rekompensatę.

Mam nadzieję, że pan Komisarz McCreevy, który tu jest w imieniu Komisji Europejskiej, będzie się starał, żeby tych krzywd nie było i żeby zostały naprawione.

  Carlos José Iturgaiz Angulo (PPE-DE). – Señor Presidente, lo primero que tengo que hacer, como no puede ser de otra manera, es agradecer a la señora Fourtou la elaboración de este informe, un informe —como hemos dicho— muy debatido y trabajado; un informe que ―como también se ha dicho aquí― ha tenido, no lo olvidemos, un antecedente poco común en la Comisión de Peticiones: el hecho de que dos delegaciones parlamentarias hayan visitado la Comunidad Valenciana para hablar y tratar sobre este tema.

Pero creo que, hoy, este tema llega a su fin y, además, que, con este informe, se va a poner en entredicho el modelo urbanístico socialista que existía en la Comunidad Valenciana, que los socialistas pusieron en marcha cuando gobernaban. En mi opinión, se puede aplicar el refrán de que «aquellos polvos trajeron estos lodos». Por eso, me congratulo, como decía el señor Libicki, de que, a partir de ahora, con este nuevo informe, que, imagino, se va a aprobar en este Parlamento Europeo, éste va a aplaudir, entre otras cosas, la iniciativa de que el actual Gobierno valenciano tramite y elabore una nueva ley que sustituya a la anterior ley socialista.

Y, sobre todo, quiero subrayar y recordar que esta nueva ley, que se podrá tramitar y aplicar, va a tener, entre otros, dos puntos fundamentales: primero, que esta nueva ley se aprueba en ejercicio de las competencias que, en materia urbanística, tiene el Gobierno valenciano en exclusiva, y, segundo, que el informe también aprueba una serie de recomendaciones para que el Estado de Derecho pueda atender las reclamaciones que, por aplicación de la antigua LRAU, hubiera o haya habido, es decir, ahora se van a salvaguardar todos los derechos de los ciudadanos que se han dirigido a esta Comisión de Peticiones.

Señor Presidente, Señorías, estoy seguro de que la solución justa vendrá con la desaparición de la LRAU creada por el anterior gobierno socialista, y estoy convencido de que esa solución justa va a conseguirse con la aplicación de la nueva ley que el Gobierno del Partido Popular de la Comunidad Valenciana tiene previsto crear.

  Joan Calabuig Rull (PSE). – Señor Presidente, en primer lugar, quisiera agradecer a la señora Fourtou el trabajo que ha realizado en la Comisión. Ha tenido un talante abierto, hemos podido discutir muchas enmiendas de compromiso, y sabemos, además, que ha tenido un trabajo difícil, porque éste es un tema en el que no pueden ustedes imaginarse la cantidad de intereses que se mueven y, por tanto, las presiones que hay.

Quiero decirles y dejar claro que, en primer lugar, en la Comunidad Valenciana residen desde hace décadas miles de ciudadanos europeos, millones nos visitan cada año y que estas personas se muestran satisfechas de vivir en nuestra Comunidad y de los servicios de alta calidad que, en general, reciben en su vida diaria. Por tanto, nos referimos a una Comunidad acogedora. Para la mayoría de los que están allí y de los que quieren venir es una suerte poder compartir su vida con nosotros.

También hay que decir que la mayoría puede resolver con normalidad los problemas que tiene ante los tribunales y ser atendida por determinadas autoridades locales en muchos sitios. Pero otros no ven solucionados esos problemas, y en estos momentos nos estamos encontrando con una cantidad muy importante de gente que no ve resueltos estos problemas. Por eso, me siento consternado por el hecho de que, en estos últimos tres años, hayan aumentado de manera muy notable las reclamaciones por abusos urbanísticos.

Como ciudadano europeo, nacido y residente en la Comunidad Valenciana, lamento sinceramente que tengamos que celebrar este debate, pero hay que recordar que, si esto es así, se debe a que las reclamaciones presentadas en este Parlamento han sido efectuadas por miles de ciudadanos europeos que se sienten víctimas de abusos urbanísticos. Estamos, y hay que decirlo claramente, ante un hecho excepcional en España y en el resto de Europa, que, además, hay que recordar, provocó la protesta formal de diecisiete embajadores de la Unión Europea.

Otras regiones españolas disponen de leyes parecidas a la LRAU; incluso la titular de la Secretaría Autonómica de Territorio y Medio Ambiente vino aquí a decir que aquella ley estaba muy bien. Pese a tener leyes parecidas, evidentemente no han tenido nunca un problema de esta magnitud.

Por tanto, quiero decirles que es justo que atendamos a los ciudadanos; además, creo que las autoridades pidieron a la delegación que fue allí que hiciera propuestas, y creo que esto es lo que ha hecho la Comisión. Me parece necesario que exijamos el respeto de los ciudadanos frente a grupos económicos que tienen un poder enorme, y ante los cuales muchas veces los ciudadanos quedan indefensos. Creo que está en nuestras manos contribuir precisamente a lo que planteaba el señor Iturgaiz: que no tengamos que repetir este debate y que podamos acabar con esta situación. Si ahora no impulsamos estas soluciones, es evidente que en el futuro, desgraciadamente, tendremos que afrontar nuevamente aquí este problema.

Y, como les decía, como ciudadano de la Comunidad Valenciana, deseo que se resuelvan esos problemas y que la incompetencia de un Gobierno regional no deteriore nuestra imagen, como lo está haciendo ante muchos ciudadanos europeos, porque nuestra Comunidad no se merece eso.

  Ignasi Guardans Cambó (ALDE). – Señor Presidente, permítame ante todo felicitar a la ponente, señora Fourtou, por el trabajo que hizo, lamentando que ese trabajo fuera después alterado en el proceso final de aprobación de determinadas enmiendas, desnaturalizando lo que era en su origen un informe razonable.

Porque, finalmente, lo que nos trae hoy aquí, Señorías, es una mezcla de populismo poco responsable por parte de diputados que quieren satisfacer, a toda costa, a sus conciudadanos residentes en España y por parte de diputados españoles que han decidido hacer política local o regional desde el Parlamento Europeo —de un lado o de otro; lo acaban de ver ahora mismo—.

Esa mezcla de populismo irresponsable de un tipo y de otro lleva a aberraciones como las que se pueden votar aquí si este texto no se modifica. Es triste ver el Parlamento Europeo convertido en legislador regional, pervirtiendo totalmente el principio de subsidiariedad y diciéndole a una Comunidad Autónoma qué es lo que tiene que hacer, cómo lo tiene que hacer, cómo tiene que legislar, cuándo puede conceder licencias urbanísticas y en qué condiciones.

Yo comprendo y comparto las críticas a esta Ley, sin duda, y comparto, por supuesto, las críticas a su aplicación por el Gobierno valenciano —a la Ley y a su aplicación—.

Pero, Señorías, el Parlamento Europeo no es el Santuario de Lourdes, al que se acude cuando se ha perdido toda esperanza en cualquier otro ámbito. Ésta es una Institución seria y lo único que se consigue trayendo aquí una resolución de este tipo es crear una falsa imagen ante los ciudadanos, puesto que se aprueban resoluciones que serán absolutamente estériles, porque es en las Cortes valencianas donde este tema será resuelto, y se crea una reputación que en nada contribuye a reforzar el trabajo de esta Cámara ni a reforzar el respeto que les pedimos a los ciudadanos por nuestro trabajo.

Por tanto, las críticas que pueda tener la situación urbanística en Valencia las hago absolutamente propias: las críticas a la Ley y las críticas al Gobierno. Su tratamiento en esta Cámara equivale a protestar aquí por los retrasos en el metro de Londres. Creo que el Parlamento Europeo no es el sitio adecuado para ello y lo que estamos haciendo, con la aprobación de un documento como éste, es pervertir el propio sistema institucional.

  Bernat Joan i Marí (Verts/ALE). – Mr President, I am not intending with my speech to express any sort of disrespect to the autonomy of the Valencian Country. In any case, I believe that its autonomy is insufficient considering the real need of this area of the Catalan Countries.

Having said this, I believe that it is necessary to introduce a requirement for a common European vision regarding territorial planning and environment protection. It is my assumption that real estate speculators take advantage of the feeble nature of Valencian autonomy. This is a breeding ground for large-scale corruption. A consensus is necessary in the EU in order to avoid policies that threaten rational European planning and the environment. States, regions and autonomous communities should play a role in the definition of this consensus. The failure to move towards this goal will cause areas such as the Valencian Country and the Balearic Islands, where construction is the main economic activity, to see their whole territories jeopardised. It is already a major anomaly that the building sector is the main profitable activity in our part of the world. Not putting an end to this will mean that certain business groups will become richer, bringing about massive social, environmental and economic troubles in the near future.

  Richard Seeber (PPE-DE). – Herr Präsident, sehr geehrter Herr Kommissar! Ich möchte vorausschicken, dass in dieser Sache bereits im Mai 2004 ein Bericht des Petitionsausschusses erstellt wurde, in dem schwere Verletzungen der Menschenrechte und des Gemeinschaftsrechts anhand konkreter Fälle geschildert wurden.

Eine Delegation dieses Parlaments hat im Juni dieses Jahres eine Informationsreise angetreten und mit verschiedenen Parteien, Bürgern, Gebietsansässigen, aber auch mit den Vertretern der Regionalregierungen und des Verfassungsgerichts in Valencia gesprochen.

Wir müssen wissen, dass die geltende Bodengesetzgebung in Spanien den Landeigentümern 90 % der Bebauungsrechte zubilligt und aufgrund des besonderen Charakters des gegenständlichen Gesetzes, dieses Landenteignungsgesetzes, Eigentümer – falls es ein Erschließungsprojekt einer lokalen Körperschaft gibt – zwingt, ohne Entschädigung 10 % ihres Grundes abzugeben. Wir müssen auch wissen, dass viele Eigentümer durch diese Erschließungsprozesse eindeutig geschädigt wurden. Zudem haben einige Erschließungspläne verheerende Auswirkungen auf die Umwelt und das ökologische Gleichgewicht vieler Küstengebiete und insbesondere auf die künftige Situation bei der Wasserversorgung, die auch ein Anliegen der Europäischen Union darstellt.

Ich begrüße daher sehr, dass die Region Valencia dieses Gesetz überarbeitet und bereits ein neues Gesetz vorgestellt hat. Wir müssen darauf achten, dass insbesondere eine eindeutige Definition des öffentlichen Interesses im Gesetz verankert wird, um unmissverständlich die Möglichkeit zu verhindern, dass die Rechtfertigung für Enteignungen im öffentlichen Interesse viel öfter zugunsten von privaten als von öffentlichen Interessen eingesetzt wird.

Außerdem muss es verbindliche Kriterien geben für die Berechnung einer Entschädigung bei Enteignungen auf der Grundlage von Normen und Prinzipien, die durch die Rechtsprechung des EuGH und des Europäischen Gerichtshofes für Menschenrechte anerkannt wurden. Wir müssen in diesem speziellen Fall aber auch aufpassen, dass das Europäische Parlament den Bürgern nicht zu viele Hoffnungen macht, die es dann eventuell nicht erfüllen kann.

  José Manuel García-Margallo y Marfil (PPE-DE). – Señor Presidente, quisiera realizar dos puntualizaciones previas antes de entrar a fondo en el debate.

En primer lugar, las reclamaciones que estamos examinando aquí se dirigen contra una ley legítima, aprobada por un Parlamento regional en uso de sus competencias y no invalidada por el Tribunal Constitucional.

En segundo lugar, los juicios que aquí estamos emitiendo en ningún caso se refieren a actos ilícitos: España es un país garantista, con un sistema jurisdiccional abierto, que culmina, por cierto, en los tribunales europeos, y a ellos corresponde juzgar la ilicitud moral según el principio claro del Derecho penal nullum crimen nulla poena sine lege.

Entiendo las reflexiones que ha hecho el señor Guardans y no hubiese tolerado yo una invasión de competencias ni del Parlamento regional ni del Parlamento nacional ni de los tribunales españoles.

Sí corresponde a este Parlamento, y lo ha hecho con elegancia sin par la señora Fourtou, atender las peticiones de los ciudadanos y formular recomendaciones; recomendaciones, por cierto, que con enorme generosidad e inteligencia ha recogido el Gobierno actual de la Comunidad Valenciana.

Lo que no puede este Parlamento es intentar sustituir la planificación urbanística que corresponde a las autoridades regionales, que es lo que me ha parecido entender del discurso —creo que en inglés— de mi compatriota Joan i Marí.

En segundo lugar, tampoco puede establecer una moratoria, porque eso corresponde al Parlamento regional.

En tercer lugar, no puede este Parlamento establecer indemnizaciones: no puede una autoridad administrativa pagar indemnizaciones sin una sentencia judicial o una resolución administrativa sin incurrir en el delito de malversación de fondos.

Y, por último, no puede utilizarse, como bien ha dicho el señor Guardans, — y me dirijo al señor Calabuig— este Parlamento para un juicio político.

El señor Calabuig no ha dicho que la Ley que estamos discutiendo fue decidida por la mayoría socialista a la que él pertenece, no por la mayoría a la que yo pertenezco. No ha dicho, en segundo lugar, que él es autor de una enmienda que dice que las peticiones se concentran en los últimos tres años, período que corresponde al Gobierno del señor Camps; las peticiones son muy anteriores y él tiene la intención política de cargar ese tema sobre el Gobierno regional, porque es el Gobierno que —por cierto, por ahora con poco éxito y espero que durante mucho tiempo— pretende derribar.

En eso coincido con el señor Guardans: no es lícito, no es moralmente decente utilizar este Parlamento para ensuciar el nombre de una Comunidad, un Parlamento elegido legítimamente y un Gobierno respaldado por los ciudadanos.

  Charlie McCreevy, Member of the Commission. Mr President, I wish to thank Members for their comments. The sheer number of people who have supported the petitions covered by Mrs Fourtou’s report demonstrates that the application of the LRAU law in Valencia is raising problems.

As I indicated at the beginning of this debate, most of the problems encountered fall outside the scope of Community law. While the Commission understands the concerns raised, it is not in a position to provide a solution.

Where problems of compatibility with Community law are identified, the Commission will not fail to act and will take the necessary steps aimed at rectifying the situation. This is the case for public procurement aspects of the LRAU law. We have identified a number of problems in this area, and infringement proceedings against Spain were opened. We are pursuing these procedures with a view to ensuring a correct application of Community procurement legislation.

Colleagues in various departments of the Commission have looked at the report covering areas such as environmental policy, justice and home affairs, consumer policy and regional policy. It would be wrong to raise expectations that, in these areas, the enforcement of Community law will offer the petitioners a solution to the problems they have encountered.

  Jules Maaten (ALDE). – Al meer dan twee jaar ontvangt het Europees Parlement tienduizenden verzoekschriften van Europese burgers, waaronder veel Nederlanders, over misbruik van een wet aangaande urbanisatieprojecten (LRAU) in de regio Valencia. De wet geeft projectontwikkelaars de mogelijkheid om onrechtmatig grond af te pakken van huiseigenaren, tegen geen of een lage vergoeding, en ze vervolgens ook nog eens te laten opdraaien voor de kosten van de aanleg van wegen, riolering en straatverlichting.

Dit probleem is gelukkig opgepakt door het Parlement en morgen wordt er gestemd over het desbetreffende rapport van de liberaal Fourtou. Daarbij wordt Valencia aangespoord de wet te verbeteren - een proces dat reeds in gang is gezet na een bezoek van een Europese onderzoekscommissie - en een procedure op te zetten voor het per geval beoordelen van de situatie van huiseigenaren, inclusief compenserende maatregelen.

Ik heb eerder contact gehad met Nederlanders in de regio en ben blij dat eindelijk de urgentie van de situatie wordt onderkend. Het is goed dat Valencia op aandringen van Europa reeds begonnen is met herziening van de wet, maar die woorden zullen nu ook in daden omgezet moeten worden om te voorkomen dat nog meer eigenaren ten onrechte worden benadeeld.

  Neil Parish (PPE-DE). – The right to property is a fundamental right. Property owners in Valencia have had their property and land confiscated on a massive scale and built on by often unscrupulous property developers and local authorities, acting with the connivance of the Valencian authorities under the terms of the LRAU. Petitions to the European Parliament and two fact-finding missions attest to this fact.

This is totally unacceptable in a free society.

There should be a moratorium on all current and planned urbanisation projects in the region until new legislation which fully respects property rights is adopted by the Valencian Parliament. For those that have lost land and property to development by Valencian authorities a new law should establish as a matter of urgency a legal administrative structure with the power to review development plans and to assess proper compensation for victims.

Property owners who have lost out through collusion between property developers and the local authorities in Valencia must be properly compensated.

While I welcome the Valencian authorities reviewing the policy of land appropriation, there is still a need for justice for citizens who have already lost land and property.
