  Richard Howitt (PSE), rapporteur. – Mr President, the job of the European Parliament is to scrutinise and hold to account the institutions of the European Union, yet every year since 1988 in this Parliament’s annual human rights report, we have scrutinised the record of governments across the world, but never asked the hard questions about what impact the EU itself has had in promoting compliance with international human rights law abroad. This year we are doing so.

I would like to thank colleagues from the Austrian Presidency who have agreed with us an enhanced role for Parliament, as the Council prepares its annual human rights report on behalf of the Union as a whole. This is not so much a question of institutional sensitivities: it is more that a unified and strengthened EU human rights report can provide a stronger voice for Europe and our commitment to human rights in the world. I hope our proposal for an annual EU list of countries of concern will be considered in that context.

I would like to thank the Commissioner, too, for her support for this approach and for listening and responding to Parliament by agreeing to a separate legal instrument for human rights. This will allow us to continue funding human rights projects, despite opposition from governments responsible for oppression and abuse. It is the right choice.

Of course Parliament will, this year and every year, offer constructive criticism. Why does the Council support UN reform which puts human rights onto an equal footing, yet itself have a part-time working group, compared to other foreign policy working groups which are staffed by permanent Brussels-based officials? Human rights are not a part-time occupation. When UN troops in Liberia stand accused of rape and torture, how can Europe launch its own ESDP mission in Aceh, Indonesia, without any human rights monitoring? Why do the EU’s human rights consultations allow Russia to exclude human rights NGOs and why does our human rights dialogue with China not even benefit from simultaneous language interpretation? And does Europe really apply human rights consistently when it fails to support criticisms of the abuse in both China and Russia, but is prepared to do so for less strategically important countries like Nepal or North Korea?

Explain to the families of 99 trade unionists murdered last year in Colombia, which has the worst record in the world, why Europe actually offers trade preferences to that country for its supposed protection of internationally agreed workers’ rights. Why have nine Member States, including Germany, Ireland, and Portugal, failed to sign the UN optional protocol against torture? Eleven EU countries refuse to sign the Council of Europe Convention on Action against Trafficking in Human Beings, including Britain, France and Spain.

Why have seven of our members considered signing so-called immunity agreements in opposition to the jurisdiction of the International Criminal Court? When human rights defenders face death threats for upholding their rights, how can evidence show that in Zimbabwe – scene of political imprisonment, mass evictions and the persecution of journalists – the European Commission delegation itself said that it was not aware of the EU’s guidelines for human rights defenders? We can do better.

We must stop the navel-gazing by EU representatives in international forums and, for the first time, genuinely link multilateral and bilateral negotiations in the EU so that abusive countries know they will face adverse consequences in the EU’s diplomatic trade and development policies.

We must use a more sophisticated sliding scale of sanctions and make it easier to find political agreement in the EU to apply them. We should ensure that one staff member in every Commission delegation, in 118 countries worldwide, is responsible for reporting and promoting human rights obligations. We must make the UN and its international human rights conventions a contractual obligation of the stabilisation, association and accession process, starting with ourselves.

Finally, as far as we ourselves are concerned, let me refer to the debate raging this week in my own country, the United Kingdom, on how human rights can be reconciled, given the changed threats of terrorism, people trafficking and organised crime. It is time to say that the threats might change, but that human rights are inviolable.

When the last generation saw Nelson Mandela labelled a terrorist, when former East Germans smuggled themselves across the Berlin Wall, when the Holocaust represented one of the worst ethnic genocides in world history, the threats of terrorism, trafficking and racial hatred were a cue to agree human rights, not to tear them down. So if our generation is sincere in seeking the freedom of political prisoners like Aung San Suu Kyi, tackling the despicable trade in women and children for sexual exploitation and bringing the perpetrators of ethnic cleansing in Darfur and in the Balkans to justice, we have to defend the concept of human rights at home as well as abroad. Europe must practice what it preaches.

  Hans Winkler, President-in-Office of the Council. Mr President, let me begin on a personal note: this is my third opportunity to speak in this House about the broad issues of human rights. As far as the Austrian Presidency is concerned, this issue is very dear to our hearts and we want to deal with it in a way that corresponds to what the rapporteur has just said. We want the European Union as a whole to be perceived by our partners and by the outside world as speaking with one voice and conveying the values of the European Union. As Mr Howitt said, we have to practise what we preach. This is very much what the Presidency is trying to do.

I should like to begin by thanking the European Parliament for its cooperation and we should also like to thank the Commissioner and the Commission for their contributions.

We are grateful this year that, for the first time, Parliament has adopted a comprehensive approach. It has not just listed one human rights violation after another in a given country but has adopted a comprehensive approach and policy, which the Council very much appreciates.

Es ist für die, die Frau, den Mann, die als Menschenrechtsverteidiger bedroht werden, die gefoltert werden, nicht von Bedeutung, ob die Europäische Union jetzt als Parlament, als Rat oder als Kommission spricht. Das Wesentliche ist, dass wir als Europäische Union sprechen. Die Menschen zählen auf die Hilfe der Europäischen Union, unabhängig von den Institutionen, daher ist die Zusammenarbeit zwischen den Institutionen besonders wichtig.

Ich möchte an dieser Stelle auch auf etwas hinweisen, was vielleicht nicht unmittelbar im Zusammenhang mit dem Bericht steht, was mir aber auch sehr wichtig ist. Die österreichische Präsidentschaft bemüht sich, die Grundrechteagentur wenn möglich noch während unserer eigenen Präsidentschaft einzurichten und endgültige Einigung darüber zu erzielen. Wir haben heute Vormittag eine sehr konstruktive Sitzung mit Parlament und Kommission gehabt, wo wir uns auf die Gründzüge dieser zukünftigen Grundrechteagentur geeinigt haben. Ich bitte Sie alle, hier mitzuwirken, dass diese wichtige Institution, die die Europäische Union als Ganzes nach außen vertreten soll, möglichst bald Wirklichkeit werden kann. Die Präsidentschaft wird sich sehr darum bemühen.

Wir haben den Bericht sorgfältig geprüft, und wir danken dem Berichterstatter und allen Abgeordneten, die hierbei mitgewirkt haben. Ich möchte auf einige Punkte besonders eingehen. Zunächst zur Frage der Menschenrechtsleitlinien. Diese Menschenrechtsleitlinien, die auch der Bericht richtigerweise hervorhebt, haben eine große Bedeutung für die verstärkte Umsetzung der Unionspolitik. Die weltweite Abschaffung der Todesstrafe und der Folter sowie der Schutz von Menschenrechtsverteidigern und von Kindern in bewaffneten Konflikten sind das Herzstück unseres Einsatzes, und ich möchte erwähnen, dass die österreichische Außenpolitik auch unter der Leitung der jetzigen Kommissarin Benita Ferrero-Waldner gerade diesen Themen in den vergangenen Jahren besonders Augenmerk geschenkt hat.

Wir begrüßen die Arbeit dieses Hauses, insbesondere des Unterausschusses für Menschenrechte, für die verbesserte Umsetzung der Leitlinien gegen Folter und Ihr traditionelles Engagement für den Schutz vor Menschenrechtsverletzungen. Es ist dies ein Anliegen, das auch die Ratsvorsitzende Ursula Plasnik ganz besonders ernst nimmt. Im Vorfeld des EU-Lateinamerika-Karibik-Gipfels hat Ursula Plasnik Menschenrechtsverteidiger aus der Region empfangen und ihnen auch die Unterstützung der Europäischen Union zugesichert.

Zum Thema Leitlinien zur Folter: Immer wieder hören wir, dass die Europäische Union in Einzelfällen nicht genügend interveniert. Wir sind uns natürlich dessen bewusst, dass oft Stunden entscheiden können, ob Menschen, die sich in Polizeigewahrsam befinden, menschlich behandelt werden. Das ist richtig, aber wir müssen auch ehrlich zu uns selbst sein und sagen: Unsere Möglichkeiten sind leider sehr oft begrenzt. Die Europäische Union äußert sich im Rahmen ihrer Möglichkeiten sehr deutlich gerade in Fällen, wo Folter und unmenschliche Behandlung drohen. Leider können wir nicht immer Folter und unmenschliche Behandlung verhindern.

Die Umsetzung der Antifolterkonvention der Vereinten Nationen, und überhaupt die Zusammenarbeit mit dem Menschenrechtssystem der Vereinten Nationen war während unserer Präsidentschaft – und das ist nur eine Fortsetzung der traditionellen Politik der Europäischen Union – ein wesentlicher Bestandteil unserer Menschenrechtspolitik, und wir haben insgesamt in über 25 Ländern entsprechende Demarchen durchgeführt.

Natürlich ist gerade das Thema Folter und unmenschliche Behandlung ein wichtiges Thema, das wir in unseren Menschenrechtsdialogen mit Drittstaaten immer wieder aufgreifen. Ich selbst kann anlässlich meines Besuches in Kasachstan, wo wir politische Gespräche mit den zentralasiatischen Ländern geführt haben, sowie anlässlich meines kürzlichen Besuches im südkaukasischen Raum sagen, dass die Europäische Union das Thema Folter und unmenschliche Behandlung wie überhaupt das Thema Menschenrechte stets sehr deutlich angesprochen hat.

Wir haben vor wenigen Tagen die Wahl zum UN-Menschenrechtsrat erlebt. Im Großen und Ganzen können wir wohl zufrieden sein, denn es hat sich gezeigt, dass doch einige Staaten, die notorische Menschenrechtsverletzer sind, nicht gewählt wurden. Dies entspricht auch der Verpflichtung, die die Europäische Union abgegeben hat, nämlich nicht für Länder zu stimmen, die für Menschenrechtsverletzungen bekannt sind.

Die erste Sitzung des Menschenrechtsrates wird am 19. Juni, also noch unter unserer Präsidentschaft, stattfinden. Wir wollen, dass dieses neue Organ der Vereinten Nationen in Zukunft einen konstruktiven und wesentlichen Beitrag für eine weltweite Arbeit im Bereich der Menschenrechte gewährleistet.

Abschließend möchte ich noch einmal unterstreichen, wie wichtig der Austausch zwischen den Institutionen für die Wirksamkeit unserer Bemühungen in Menschenrechtsfragen ist. Nur eine einheitliche, umfassende Menschenrechtspolitik der Europäischen Union wird gehört werden und letztlich Erfolg haben.

Die Präsentation des Jahresberichts der Europäischen Union zur Menschenrechtspolitik vor dem Plenum dieses Hauses im Dezember, in dessen Rahmen Sie mit der Verleihung des Sacharow-Preises traditionell einen Menschenrechtsschwerpunkt setzen, und Ihre Antwort auf diesen Bericht leisten dazu einen wichtigen Beitrag.

Unser gemeinsames Ziel ist eine wirksame und sichtbare Menschenrechtspolitik der Europäischen Union, das Eintreten für unsere Werte. Das Europäische Parlament leistet dazu einen bedeutenden Beitrag, der auch im Jahresbericht 2005 der Europäischen Union gewürdigt wurde. Die Leistungen des Europäischen Parlaments sollen und werden auch im kommenden Jahresbericht, der unter finnischem Vorsitz vorbereitet wird, gebührend anerkannt werden. Ich möchte mich noch einmal auch beim Berichterstatter sehr herzlich für diesen ausgezeichneten Bericht bedanken.

  Benita Ferrero-Waldner, Member of the Commission. Mr President, I very much welcome this opportunity for a human rights debate. I thank Mr Howitt for his excellent report. I also welcome the comprehensive analysis of action. As the President said, both the Commission and the Council have to work very closely together in order to have a comprehensive human rights policy. Let me make a few comments and raise a few issues.

First, I acknowledge the strong support of Parliament for the European Initiative for Democracy and Human Rights, and its continued interest. I assure you that all the elements that contribute to the success of this initiative will be maintained for the period 2007 to 2013, for instance independence from government approval and support for civil society organisations. I share the concern to make our actions in the area more flexible and in tune with the needs of the grassroots organisations. This year we are already trying out concrete improvements in our procedures, notably in the calls for proposals. We also need to better adapt the programme to the sensitive situations and restrictions often faced by civil society organisations. I will certainly continue to rely on your support to carry through those changes.

Secondly, I am grateful for the recognition of the effectiveness of the EU election-monitoring activities. They clearly demonstrate the commitment of the European Union to the democratic process and the sustainable resolution of conflicts. That is clearly reflected in the significant increase in the number of observation missions over the last two years, particularly in post-conflict and transition situations. The professional and independent approach of EU electoral observers is highly regarded and enjoys credibility and leverage. I am sensitive to the need to ensure that any further increase in that area does not squeeze resources from other priorities and I can assure you that I will do my best in that regard.

Thirdly, I welcome your positive comments on the human rights work of the EU in multilateral fora. Great efforts go into consolidating EU positions in such fora, which are often instrumental in achieving progress. As the President has already said, that leadership role of the European Union was clearly visible in the negotiations establishing the Human Rights Council. I should like to pay tribute to the Austrian Presidency, which capably steered through somewhat difficult waters.

Now that elections to the Council have taken place, the real work of this new body at the helm of the international and human rights system begins. I am confident that it will prove more efficient than the old Commission on Human Rights.

Fourthly, I should like to pay tribute to the work leading to the report on gender equality and women’s rights. The mainstreaming of women’s as well as children’s rights remains a priority for this Commission and for me personally. The ongoing work on a comprehensive communication on children’s rights encompassing the internal, as well as the external, affairs of EU action is testimony to that.

I welcome the recommendations made by the rapporteur on the format of this and future reports. I hope that it will be possible to make the 2006 EU Human Rights Report a truly interinstitutional report. In that respect, my services have already suggested to the Member States that, as suggested by Parliament, the 2006 report should include a section on human rights guidelines, more emphasis on the use and impact of human rights clauses, and it should also aim to cover the activities of all three institutions – the Council, the Commission and Parliament.

That should not in any way be interpreted as impinging on the prerogatives of Parliament to scrutinise the work of the Council and Commission. But there will be space and need for a separate report by Parliament on the European Union’s human rights policy.

I agree with Mr Howitt that a reinforced effort should be made by the European Union as a whole to address human rights concerns more systematically and to mainstream human rights considerations in EU policies. In that task, cooperation between Parliament, the Council and the Commission is crucial. You can be sure that we are a partner in it.

  Raül Romeva i Rueda (Verts/ALE), Ponente de opinión de la Comisión de Derechos de la Mujer e Igualdad de Género. – Señor Presidente, como ponente de opinión de la Comisión de Derechos de la Mujer e Igualdad de Género, me complace saludar el contenido del informe del colega Howitt, especialmente la sensibilidad que ha demostrado a la hora de abordar la perspectiva de género de forma transversal.

Tal y como señalamos en nuestra opinión adjunta al informe, entendemos que las normas jurídicas internacionales, que apoyan y protegen los derechos de las mujeres, deberían convertirse sistemáticamente en la piedra angular de toda relación bilateral y, en particular, en lo que se refiere a terceros países con los que la Unión Europea ha firmado acuerdos de asociación y de cooperación.

Asimismo, aprovechando que acaba de tener lugar la Cumbre entre la Unión Europea y América Latina, en el informe también hemos querido lamentar el dramático fenómeno llamado feminicidio, consistente en torturar y asesinar a mujeres por el simple hecho de serlo, y recordar la necesidad de acabar con la impunidad con respecto a este hecho.

Por último, quisiera también recordar que hemos de constatar una vez más que las mujeres son las principales víctimas de los conflictos armados y que, al mismo tiempo, desde una perspectiva positiva, hay que destacar el papel crucial que desempeñan a la hora de trabajar en favor de la construcción de la paz.

  Simon Coveney, on behalf of the PPE-DE Group. – Mr President, firstly, I welcome the change in the scheduling of debates to allow the human rights report to be debated this afternoon in the primetime slot. I want to thank the chairmen of the various groups for that. It is recognition of the importance of this report.

This year, we have a very different report, in style and in content. We are essentially undertaking an experiment. Parliament has agreed to change the format of its human rights report to have a much tighter focus on issues where the EU has a direct impact or influence and to focus on EU human rights policy, in particular on guidelines that have been set out and the performance of the three institutions in implementing those guidelines.

We are doing this on the understanding that the Council will work closely with us to produce a common and unified human rights report for the EU. That report will provide the general assessment of human rights across the globe and of many of the broader questions and challenges, as well as the more local challenges. In the past, as you know, Parliament and the Council have both essentially duplicated each other’s work to a certain extent by producing similar reports. Certainly, as rapporteur last year, I saw a huge amount of duplication between the report produced by Parliament and the one the Council produced.

However, if the Council does not significantly consult and include Parliament when putting its report together in the coming year, we will have to revert to our previous approach. I appeal to the Council, therefore, to make the new formula work so that we can have a common, strong, unified human rights report, representing a European view on human rights, that we can send to all corners of the world. Parliament can then focus on the job that it was elected to do: assessing the performance of the Council and the Commission on behalf of the people.

Finally, I want to congratulate Mr Howitt on doing an excellent job this year under new and different circumstances. The fact that we only have 14 amendments to the report tomorrow is a reflection on the work he has done. I can assure him that he is unlikely to get the kind of shock that other rapporteurs have received the night before or on the day of the vote on the human rights report.

  Elena Valenciano Martínez-Orozco, en nombre del Grupo PSE. – Señor Presidente, deben todos leer y estudiar con atención el excelente informe de mi colega y compañero Richard Howitt, porque en él encontrarán retos y respuestas.

En este momento en el que el gran debate es la seguridad —y, sin duda, la seguridad es un gran tema— no deben agitarse los miedos para cuestionar principios básicos en cuanto a la defensa de los derechos humanos. Porque no hay proyecto político europeo posible sin hacer de los derechos humanos una prioridad.

Bajar la guardia ante los derechos humanos —y puede que lo estemos haciendo— significa renunciar a la ética democrática y a los mejores valores de la Unión Europea. La realpolitik no puede seguir imponiendo este doble rasero, insostenible muchas veces, porque, con ello, sufre enormemente la credibilidad de nuestra democracia.

Las personas que sufren persecución, tortura, discriminación, miedo y muerte esperan de nosotros una acción decidida y coherente en favor de sus derechos. Y, por cierto, hablar con una sola voz en los ámbitos internacionales —como ya ha expuesto la Comisaria y también el representante del Consejo—, defender los derechos humanos con la voz de veinticinco países detrás, con la energía que la Unión debe desarrollar en este momento, nos reforzará a todos y hará posible finalmente que no volvamos a pensar, como estamos haciendo en este momento, a qué llamamos tortura, a qué llamamos asesinato, a qué llamamos seguridad y a qué llamamos defensa ineludible de los derechos fundamentales.

  Johan Van Hecke, namens de ALDE-Fractie. – Voorzitter, mevrouw de commissaris, collega's, dit mensenrechtenverslag is duidelijk, volledig en ambitieus. Het is een pleidooi voor meer coördinatie en meer coherentie in het mensenrechtenbeleid van de EU en van de lidstaten. Wij weten allemaal dat de rapporteur droomt van één gemeenschappelijk mensenrechtenverslag, dat een weerspiegeling is van de standpunten van Raad, Commissie en Parlement. Die droom kan en zal ooit werkelijkheid worden, op voorwaarde dat de Raad op korte termijn het advies van het Parlement ernstig neemt en op langere termijn ook economisch-commerciële overwegingen ondergeschikt maakt aan het principe dat mensenrechten universeel en ondeelbaar zijn.

Ik onderschrijf de stelling van de rapporteur dat het Europees initiatief voor democratie en rechten van de mens een uiterst belangrijk instrument is in de mensenrechtenstrategie van de Europese Unie. Ik deel ook de mening van commissaris Ferrero-Waldner dat er meer middelen zouden moeten kunnen worden uitgetrokken voor verkiezingswaarnemingsmissies, die zeker in postconflictsituaties cruciaal zijn in het versterken van de democratie en de mensenrechten. Ik verwacht ook veel van het opnemen van mensenrechtenclausules in alle overeenkomsten van de EU.

Goede instrumenten opzetten is één zaak, ze consequent en moedig toepassen is een andere zaak. En zo is het toch onbegrijpelijk dat de Commissie blijft aarzelen om artikel 96 van de Cotonou-overeenkomst toe te passen in bepaalde gevallen van flagrante schending van de mensenrechten in ACS-landen, zoals nu bijvoorbeeld in Ethiopië. Een politiek van twee maten en twee gewichten dreigt de geloofwaardigheid van het EU-mensenrechtenbeleid aan te tasten en moet tot elke prijs worden vermeden.

De verdienste van het verslag Howitt is dat het de casuïstiek overstijgt en dat het eindelijk perspectief biedt op een meer systematische en geïntegreerde aanpak. In die zin ondersteun ik het met heel veel enthousiasme.

  Hélène Flautre, au nom du groupe Verts/ALE. – Monsieur le Président, cette année la sous-commission a décidé de modifier la structure du rapport annuel sur les droits de l'homme. Ainsi, il ne s'agit plus d'une évaluation de la situation dans les pays, mais d'un rapport sur la mise en œuvre, par la Commission, le Conseil et le Parlement, des instruments de l'Union européenne en matière de promotion des droits de l'homme et de la démocratie. Nous y sommes parvenus même si cela a été difficile. Nous pouvons féliciter le rapporteur et les groupes politiques.

Le rôle du Parlement consiste à orienter, contrôler et évaluer la politique du Conseil et de la Commission. C'est pourquoi il est essentiel que le Parlement continue à élaborer son propre rapport. Si nous devions écrire un rapport à trois mains par exemple, nous ne pourrions pas critiquer l'action d'un État membre - ce que nous pouvons nous permettre avec le rapport actuel - car il suffirait à cet État membre d'y opposer son veto. L'amendement que nous avons présenté à l'article 8 va dans ce sens.

Le rapport de M. Howitt met en avant un certain nombre de propositions intéressantes et novatrices concernant les mécanismes de promotion des droits de l'homme. Le rapport plaide notamment pour le vote à la majorité qualifiée au sein du Conseil et d'éventuelles mesures restrictives à l'égard d'un État tiers. Il s'inscrit logiquement dans la suite du rapport adopté par le Parlement: le rapport Agnoletto.

Il propose également de veiller à ce que le Conseil des droits de l'homme des Nations unies, qui a été récemment créé, ne soit pas présidé par un État qui est responsable de violations des droits de l'homme. Par ailleurs, il suggère de mettre en place un système visant à informer les députés de façon suivie sur les démarches qui sont entreprises par le Conseil et la Commission. Le rapport insiste aussi sur la nécessité d'élaborer au sein du Parlement des politiques des droits de l'homme qui soient transversales.

C'est dans cet esprit que la sous-commission a proposé de permettre aux délégations de présenter des candidatures pour le prix Sakharov. Le rapport fait référence aux violations des droits relatifs à la tolérance qui sont pratiquées dans certains États membres, au recours à la torture, aux traitements cruels, inhumains, dégradants ou au refoulement de personnes vers des pays qui pratiquent la torture, à l'utilisation d'assurances diplomatiques ou encore à la reddition extraordinaire.

C'est pourquoi il faut étroitement lier les politiques interne et externe de l'Union européenne, et peut-être envisager de parvenir à un rapport unique du Parlement européen sur les droits de l'homme, élaboré conjointement avec la commission des libertés civiles, de la justice et des affaires intérieures, comme l'exigent les questions relatives à l'asile et à l'immigration.

À ce titre, je m'inscris en faux contre le paragraphe 97 qui soutient d'une certaine façon la mise en place des programmes pilotes de protection régionaux. La Commission envisage de mettre en œuvre l'un de ces premiers programmes en Biélorussie, pays responsable de nombreuses violations des droits de l'homme, qui n'entretient aucune relation diplomatique avec l'Union et qui n'offre aucune garantie en matière de protection des migrants. Ces programmes ne me semblent pas opportuns.

  Vittorio Agnoletto, a nome del gruppo GUE/NGL. – Signor Presidente, onorevoli colleghi, la relazione Howitt rappresenta un importante passo avanti rispetto al passato in quanto in essa si è cercato di analizzare le ricadute delle politiche dell'Unione europea in materia di diritti umani e soprattutto la loro efficacia nei confronti dei paesi terzi.

La prima novità apprezzabile di questa relazione è rappresentata dalla richiesta di inserire – a partire dalla prossima relazione annuale – un esame in merito all'effettivo rispetto della clausola di democrazia, votata il 14 febbraio. Purtroppo devo però constatare che né il Consiglio né la Commissione hanno dato alcuna precisa indicazione sul modo in cui intendono recepire detta clausola sulla democrazia e i diritti nei rapporti commerciali tra l'Europa e i paesi terzi.

Per quanto riguarda il neonato Consiglio ONU per i diritti umani, il documento da votare chiede che l'Unione europea ne supporti le attività e allo stesso tempo esso promuove la ratifica universale dello statuto di Roma, istitutivo della Corte penale internazionale, in particolare da parte degli Stati Uniti, per i quali non può sussistere alcuna eccezione legale. Il documento in questione condanna altresì in modo particolare gli accordi bilaterali che alcuni paesi dell'UE hanno stipulato con gli USA per garantire l'impunità dei soldati statunitensi. Esso fa infine appello alla coerenza dell'Unione europea in materia di diritti umani, nei casi specifici della Cina, nei confronti del popolo tibetano, e di Guantánamo, per il quale chiede l'immediata chiusura di tutte le carceri speciali.

Tuttavia non posso tacere anche alcuni limiti della relazione, la quale infatti non fa alcun riferimento al mancato impegno dell'Unione europea nel sostenere i diritti umani in occasione della sesta Conferenza ministeriale dell'OMC, svoltasi ad Hong Kong. Per quanto riguarda l'Iraq, inoltre, l'articolo 38 è troppo vago: non si criticano le violazioni dei diritti umani compiuti dalle forze di occupazione, né l'uso di armi proibite quali ad esempio il fosforo bianco utilizzato a Falluja.

Infine, per quanto concerne la Colombia, l'articolo 41 non è così esplicito come invece meriterebbe la situazione dei cittadini dello Stato latinoamericano, come nel caso degli abitanti delle comunità di pace coinvolte in numerosi massacri impuniti. Manca infatti, una condanna ferma del clima di violenza esistente nel paese così come il riconoscimento di una correlazione tra tale situazione e le recenti misure legislative, come la legge "Pace e giustizia" che permettono di fatto l'inserimento delle forze paramilitari nell'esercito colombiano.

Un'ultima osservazione: sebbene condivida la richiesta che la relazione annuale dell'Unione europea sui diritti umani preveda un coinvolgimento del Parlamento europeo, ritengo comunque altrettanto necessario che il Parlamento continui a elaborare una propria specifica relazione, finalizzata a valutare e a garantire un controllo parlamentare sull'impegno concreto della Commissione europea a favore dei diritti umani.

  Γεώργιος Καρατζαφέρης, εξ ονόματος της ομάδας IND/DEM. – Κύριε Πρόεδρε, διερωτώμαι για ποια ανθρώπινα δικαιώματα μιλάμε, όταν η οικονομική μας πολιτική δημιουργεί μια εξόχως ταξική κοινωνία.

Εάν θέλουμε πράγματι να διερωτηθούμε για τα ανθρώπινα δικαιώματα, δεν θα το κάνουμε σ' αυτή την αίθουσα, αλλά ας πάμε στις τουαλέτες για να δείτε ποιες γυναίκες δουλεύουν εκεί. Δεν δουλεύει μία συγγενής μας, αλλά κάποιες αξιοσέβαστες, φτωχές γυναίκες από τη Βόρειο Αφρική.

Μιλάνε λοιπόν για ανθρώπινα δικαιώματα, ποιοί; Αυτοί οι οποίοι εξολόθρευσαν, εξαφάνισαν από το πρόσωπο της γης μια ολόκληρη φυλή. Τους Ερυθρόδερμους. Ποιοί μιλάνε για ανθρώπινα δικαιώματα; Αυτοί οι οποίοι βάσισαν τον πλούτο τους στους ιθαγενείς των αποικιών τους για πολλούς αιώνες. Μιλάνε για ανθρώπινα δικαιώματα, ποιοί; Εκείνοι οι οποίοι με μια μπύρα το βράδυ απολαμβάνουν τα κάλλη μιας ωραίας κοπέλας, αδύναμης και φτωχής, από το πρώην ανατολικό μπλοκ. Μιλάνε για ανθρώπινα δικαιώματα, ποιοί; Εκείνοι οι οποίοι συντηρούν και συνυπάρχουν με δικτάτορες που βασανίζουν το λαό τους προκειμένου να εισβάλουν σε μια άλλη χώρα. Ή δεν έγινε έτσι στο Αφγανιστάν και στο Ιράκ; Μιλάνε ποιοί; Αυτοί οι οποίοι κλείνουν τα μάτια στο τί γίνεται, τρία χρόνια τώρα, στο Ιράκ. Μιλάνε ποιοί; Εκείνοι οι οποίο δέχονται την Τουρκία μέσα στην Ευρώπη, όταν πριν ένα μήνα δολοφόνησαν εκεί έναν καθολικό ιερέα, έκαψαν το ομοίωμα του οικουμενικού Πατριάρχη των ορθοδόξων χριστιανών και έβαλαν φωτιές στις συναγωγές.

Ε, λοιπόν, εγώ δεν είμαι έτοιμος να μιλήσω για ανθρώπινα δικαιώματα. Μου το απαγορεύει η συνείδησή μου με όλα αυτά τα οποία βλέπει γύρω της να γίνονται, με όλα αυτά που όλοι μας επιτρέπουμε να γίνονται.

  Inese Vaidere, UEN grupas vārdā. – Vēlētos pateikties Howitt Richard kungam par milzīgo darbu, sagatavojot lielisko ziņojumu, kas atspoguļo Eiropas Parlamenta lomu Eiropas Savienības cilvēktiesību politikas stratēģijā.

Efektīvai cilvēktiesību politikai ir būtiski, lai Eiropas Savienības dalībvalstis īstenotu kopīgu, konsekventu un pārredzamu politiku divpusējās attiecībās ar valstīm, kuras neievēro cilvēktiesības. Ļoti svarīgas ir mūsu attiecības ar Krieviju kā stratēģisko partneri. Tāpēc ir būtiski, ka ziņojumā Komisijai un Padomei tiek prasīts sarunās ar Krieviju apspriest cilvēktiesību pārkāpumus Čečenijā. Ziņojumā paustas cerības par jaunizveidoto ANO Cilvēktiesību padomi. Taču Kubas, Nigērijas un citu līdzīgu valstu ievēlēšana rada bažas par vēlēšanu mehānismu un par to, vai Padomes darbs būs efektīvāks par Cilvēktiesību komisiju, tāpēc Eiropas Savienībai ir sistemātiski jāiebilst pret prezidentūras piešķiršanu šādām valstīm un Padomei jāpauž kopīgais Savienības viedoklis.

  Luca Romagnoli (NI). – Signor Presidente, onorevoli colleghi, ho l'impressione che nella relazione si plauda con eccessiva enfasi al ruolo che l'UE svolge sulla scena mondiale in merito ai diritti umani, tanto da sottolineare la non sistematicità degli interventi nei confronti dei paesi terzi.

L'invito al Consiglio di individuare quei paesi che destano particolare preoccupazione a proposito delle violazioni dei diritti umani, avrebbe significato se, contestualmente, producesse interventi nei confronti di questi Stati; soprattutto se avesse il coraggio di attuare queste politiche anche nei confronti di grandi Stati come la Cina e gli Stati Uniti. Sicuramente si deve dare priorità al rispetto degli obblighi in materia dei diritti umani nell'ambito dei negoziati di adesione con la Turchia e la Croazia e ugualmente dicasi per i negoziati di stabilizzazione e associazione dei paesi dell'ex Repubblica iugoslava. Pertanto la Commissione deve dimostrare in proposito che non ci siano ombre.

Prendo atto che la lotta contro il traffico di esseri umani, che sottende l'immigrazione clandestina, soprattutto dall'est europeo, dall'Africa a dalla Cina, è oggi considerata una priorità ampiamente condivisa dalle Istituzioni comunitarie.

Per quanto riguarda le preoccupazioni espresse dal collega Howitt sull'Iran – con riferimento ai primi mesi del mandato del Presidente Ahmadinejad – trovo francamente simili preoccupazioni semplicistiche e demagogiche, così come trovo appiattita e controproducente la posizione di sostegno dell'UE alla politica degli USA in Iraq e alle violazioni di Guantánamo.

In conclusione, ritengo prioritaria la definizione di una scala progressiva di misure e sanzioni da applicare per la violazione dei diritti umani. Arresti per motivi politici, persecuzioni delle minoranze, torture, repressione della libertà di religione, di parola e di espressione, sono fatti che, ovunque si registrino nel mondo, necessitano concreti atti dell'Unione.

  José Ignacio Salafranca Sánchez-Neyra (PPE-DE). – Señor Presidente, esta cita anual pone claramente de manifiesto el compromiso inderogable e indeclinable que tiene nuestro Parlamento con la causa de los derechos humanos en el mundo, que no se tiene que predicar de una región, de un país o de un continente, sino que ha de tener un carácter planetario o universal.

Y hay que celebrar la perspectiva de crítica constructiva desde la que lo hace el informe del señor Howitt, sabiendo que, muchas veces, antes de lanzarnos a la labor de arreglar el mundo, tenemos que dar una vuelta por nuestra propia casa.

Nuestro Parlamento lleva a la práctica su compromiso con la causa de los derechos humanos a través de sus resoluciones, a través del Premio Sájarov a la Libertad de Conciencia y a través de las posiciones contundentes que ha manifestado en lo que se refiere al Tribunal Penal Internacional y a la pena de muerte.

Yo creo que tenemos que apoyar los esfuerzos de la Comisión Europea y del Consejo para introducir la dimensión de derechos humanos en la acción exterior de la Unión Europea con los países candidatos, señor Presidente; con los países vecinos, dentro de la política de vecindad, señora Comisaria; a través de la cláusula democrática que tenemos con los terceros países; a través del instrumento para la defensa de la democracia y de los derechos humanos; y, sobre todo, y muy particularmente, a través de la iniciativa que la Comisión ha puesto en marcha bajo la forma de misiones de observación de elecciones en terceros países, que es un instrumento privilegiado que realza la marca de imagen y de respeto a los derechos humanos que la Unión Europea debe tratar de transmitir en el mundo.

Se trata, en definitiva, señor Presidente, de que las tres instituciones de la Unión —el Consejo, la Comisión y el Parlamento Europeo— movilicen de consuno todos sus esfuerzos para que este siglo XXI sea el siglo de los derechos humanos y que el respeto a los derechos humanos y a las libertades fundamentales se enseñoree en todas las regiones del planeta.

  Józef Pinior (PSE). – Panie Przewodniczący! Polityka Unii Europejskiej w zakresie praw człowieka powinna kształtować europejską politykę sąsiedztwa oraz stać się skutecznym narzędziem we współczesnej cywilizacji globalnej w obronie ludzi zagrożonych ludobójstwem i zbrodniami wojennymi, w obronie osób walczących o demokrację i podstawowe swobody, w obronie wszystkich dyskryminowanych ze względu na przynależność etniczną, wyznanie religijne, płeć, upośledzenie lub orientację seksualną.

Polityka praw człowieka nie może stosować podwójnych standardów – innych w stosunku do państw małych i innych w stosunku do państw o znaczeniu strategicznym dla Unii Europejskiej. Polityka ta powinna być skuteczna. W tym kontekście szczególnego znaczenia nabiera Europejska Inicjatywa na rzecz Demokracji i Praw Człowieka oraz zwiększenie budżetu tej instytucji. Parlament Europejski musi wziąć na siebie odpowiedzialność za podniesienie rangi obrony praw człowieka w UNII Europejskiej, musi się stać miejscem, w którym będą wykluwały się nowe inicjatywy w tym zakresie, oraz instytucją koordynującą działania na rzecz praw człowieka różnych instytucji unijnych.

  Elizabeth Lynne (ALDE). – Mr President, I would like to thank the rapporteur for all his hard work on this report. I am pleased that we have moved away from just a list of countries where human rights abuses are a problem and I welcome the new measures we are taking in this report. I hope we continue in this way.

Having said that, I am pleased that the situation in Kashmir has been included. I hope we will eventually find a just solution involving the Kashmiri people that will end human rights abuses from all sides. I am also glad that we call in this report for the Americans to close down Guantanamo Bay. I think it is very important that we do this and that detainees have a fair trial. Again, that is included in this report. I am sorry, however, that my amendment on CIA flights was not accepted by the committee, but I note Amendment 5, which seeks to rectify this situation. It is very important that we include CIA flights in this report.

I would have liked a stronger statement on people with mental health problems, as the rapporteur knows, but I am pleased that they have been included. I am equally pleased that disabled people have been included generally, with a particular emphasis on the United Nations Convention on the Rights of People with Disabilities. As many of you know, I was Parliament’s rapporteur on that issue.

I am glad that there is a strong mention of trafficking in human beings. I, along with Mr Coveney and various other Members, have been campaigning on this subject for quite some time.

I am sorry, however, that we are told repeatedly in our committee that we cannot mention human rights abuses within the European Union. That, I believe, takes away from the strength of our argument when we are talking about human rights abuses in other parts of the world.

  Feleknas Uca (GUE/NGL). – Herr Präsident! Ich begrüße den Bericht zum Jahresbericht 2005 zur Menschenrechtslage in der Welt und der Menschenrechtspolitik der EU. Er findet meine Zustimmung und Unterstützung. Die Wirksamkeit der Menschenrechtsdialoge der EU wurde darin selbstkritisch beleuchtet und ausgewogen bewertet. Trotz der Fortschritte, die erzielt wurden, wie zum Beispiel durch die Initiativen des Unterausschusses Menschenrechte oder die Ernennung eines persönlichen Beauftragten für Menschenrechte bestehen weiterhin Defizite, vor allem in den Menschenrechtsdialogen der EU mit Drittländern.

Ich möchte an dieser Stelle noch einmal auf die eminente Bedeutung der Menschenrechte hinweisen. Eine stärkere Berücksichtigung dieser universalen Rechte und die dauerhafte Integration in sämtliche Politikbereiche sind unerlässlich. Die weltweite Verfolgung von Menschenrechtsverletzungen, die Förderung sowie der Schutz der Menschenrechte sind wesentliche Aufgaben des Europäischen Parlaments. In Zukunft würde ich es gutheißen, wenn gerade auch auf die Menschenrechtssituation in den Ländern der EU-Beitrittskandidaten ein verstärktes Augenmerk gerichtet würde.

  James Hugh Allister (NI). – Mr President, another year, another report, but what real change? Still we trumpet human rights and democracy clauses in partnership agreements with third countries, but non-compliance largely seems to go unmarked. Apart from a single suspension in the case of relatively insignificant Uzbekistan, these clauses might as well not exist, especially with regard to major economic forces like China. There it seems to some of us that the value of trade persuades the EU to do less than it could about flagrant breaches of human rights and instances of religious persecution. Indeed, one is tempted to say that such is the EU’s apparent awe of China that it avoided an opportunity during the year to sponsor a critical motion in the United Nations. Likewise, when it came to an opportunity there to join in condemning Zimbabwe for its mass forced evictions, the EU countries also avoided that issue.

It is true that we talk the talk of human rights, but too often, it seems to me, we hold back when there are economic interests which we seem to hold dearer.

  Laima Liucija Andrikienė (PPE-DE). – Šiandieną svarstome tikrai svarbų pranešimą dėl žmogaus teisių padėties pasaulyje 2005 m. ir Europos Sąjungos politikos tuo klausimu. Noriu padėkoti pranešimo autoriui R. Howitt už bendradarbiavimą.

Pirmininke, Europos Sąjunga išlieka pirmaujanti pasaulyje žmogaus teisių srityje, o Europos Parlamentas yra stipriausias žmogaus teisių gynėjas iš Europos Sąjungos institucijų. Tačiau negerai tai, kad Europai geriau sekasi daryti pareiškimus, o ne jų laikytis. Sąjunga gali imtis kokybiško darbo dėl žmogaus teisių, tačiau daugeliu atveju keistai nesugeba integruoti sprendimų dėl žmogaus teisių į savo politikas ir programas.

Jei mes rimtai laikomės savo vertybių, norime jas apginti, tokia padėtis turi pasikeisti. Manau, kad ateina laikas metinėje ataskaitoje kiekvienais metais nurodyti ypatingą susirūpinimą keliančias šalis ir tuo būdu sukurti iniciatyvą, padedančią nustatyti prioritetus. Taryba, siekdama pateikti trumpą ir glaustą informaciją apie šalis, galinčias patekti į krizę ir skatinti bendrus Ministrų Tarybos ir valstybių narių užsienio politikų veiksmus, jau turi stebėjimo sąrašus, kurie peržiūrimi kas šeši mėnesiai.

Tokia informacija galėtų būti naudojama rengiant ypatingą susirūpinimą keliančius šalių sąrašus, siekiant, kad į jas būtų atkreiptas ypatingas dėmesys. Taip pat yra aišku, kad reikia žymiai pagerinti ataskaitos matomumą, jos sklaidą, ypač tarp žurnalistų ir nacionalinių parlamentų.

Baigdama, noriu atkreipti jūsų, Pirmininke, dėmesį į man labai svarbią pranešimo nuostatą. Cituoju: „Europos Parlamentas palankiai vertina tai, kad Jungtinės Karalystės pirmininkavimo metu svarbiausia diskusijų apie žmogaus teises buvo pasirinkta išraiškos laisvė. Susirūpinęs tuo, kad visame pasaulyje nuteisiama labai daug žurnalistų už tai, kad jie tariamai apšmeižia valstybės pareigūnus ar politikus. Prašo Tarybos pradėti propaguoti pasaulinį moratoriumą tokiam žurnalistų kalinimui.“

Mano giliu įsitikinimu, šiame kontekste mes, Europos Parlamentas, turime paminėti šalis, kuriose padėtis yra ypač bloga, t. y. Kuba, Baltarusija, Šiaurės Korėja ir Kinijos Liaudies Respublika. Ir tai turi būti įrašyta į mūsų rezoliuciją.

  Aloyzas Sakalas (PSE). – Esu patenkintas R. Howitt pranešimu, kurio išskirtiniu bruožu laikyčiau tai, kad jis nerūšiuoja valstybių į dideles ir mažas ir netaiko joms dvigubų standartų. Tačiau pastraipoje apie Kiniją man trūksta Tibeto problemos išryškinimo.

Tibetas, kaip žinia, buvo Kinijos okupuotas, bet mes kažkodėl pripažinome jį neatskiriama Kinijos dalimi. Kinija vykdo tibetiečių tautos genocidą, o mes niekur apie tai net neužsimename. Pakanka paminėti, kad kasmet iš Tibeto apie 3 tūkst. vaikų, pabrėžiu – vaikų – per Himalajus ir Nepalą pabėga į Indiją vien tam, kad galėtų mokytis savo kalbos. Tibetiečių tauta ir jos kultūra nyksta mūsų akyse. Net kultūrinė autonomija tibetiečiams yra nepasiekiama svajonė, o derybos dėl jos tarp Dalai Lamos atstovų ir Kinijos yra fiktyvios, nes vyksta tik ekspertų, o ne principiniu lygmeniu.

Manyčiau, kad mes turime pakeisti savo požiūrį į Tibetą, jei tikrai nenorime, kad tibetiečiai ir jų kultūra būtų sunaikinti.

  Sajjad Karim (ALDE). – Mr President, we find ourselves once again debating the situation of human rights in the world. I thank the rapporteur for his evident hard work in compiling this comprehensive report, for the cooperative attitude he has demonstrated throughout and his support for the inclusion of Kashmir. For this, I personally thank him.

Colleagues, we often speak of human rights in the abstract, in terms of well-rehearsed subjects and themes, but in this instance I should like to ask colleagues to imagine themselves as an 18-year old on holiday abroad. You take a taxi journey to visit your friends and family that ends in tragedy. There are no witnesses, for the taxi driver ends up dead and you go straight to the first policeman you can find. You say he pulled a gun on you and what you did was in self-defence. This leads to a legal process which finds you innocent, then finds you guilty, then starts over again until every appeal is exhausted and you are ultimately condemned to death, with due legal process having been thrown out of the equation. All this takes 18 years; half your life on death row: a cruel life sentence in itself. This is not an abstraction. This is the tale of the rough justice of a British and EU citizen, Mirza Tahir Hussain, condemned to death on 1 June – his 36th birthday – a matter of days away.

Today, we reaffirm this House’s role as a defender of human rights with a long history of opposition to the death penalty. I implore you all to live up to the responsibility this position carries and make representations to the President of Pakistan, appealing for clemency for Mirza Tahir Hussain.

  Marek Aleksander Czarnecki (NI). – Panie Przewodniczący! Podczas minionej, brytyjskiej prezydencji Unia Europejska wystąpiła z interwencjami dyplomatycznymi w 26 indywidualnych sprawach związanych z prawami człowieka i wydała 49 oświadczeń w tej kwestii. Bardzo dobrze, że tak wiele czasu w Parlamencie Europejskim poświęcamy tematyce związanej z szeroko rozumianą ochroną praw człowieka. Podczas każdej sesji w Strasburgu odbywają się debaty nad przypadkami łamania praw człowieka, zasad demokracji i państwa prawa.

Nie możemy jednak, debatując nad sytuacją w krajach afrykańskich czy azjatyckich, zapominać o państwach unijnych. Problematyka ta dotyczy wielu z nich, szczególnie tych nowych. Dbajmy zatem i walczmy o prawa człowieka na świecie, ale miejmy oczy i uszy otwarte i pamiętajmy, iż tuż obok, w sąsiednim państwie, nie zawsze są one przestrzegane. Mówię o tym z pełnym przekonaniem jako praktykujący adwokat, obserwując tego wyraźne przejawy.

  Maria da Assunção Esteves (PPE-DE). – O relatório Howitt contém uma abordagem nova sobre o modo como a Europa olha o seu combate por uma cultura global dos direitos humanos. Uma abordagem que abandona o puro método descritivo e confronta as instituições europeias com a eficácia da sua própria acção. Mais integração institucional da União, relação política, e não apenas técnica, com o Conselho da Europa, uma Carta de direitos vinculativa. Esta a base de uma frente europeia que toma os direitos a sério.

O Parlamento Europeu reclama hoje a mobilização de todas as instituições políticas europeias para este grande desígnio de estender ao mundo os princípios sagrados da Humanidade e do Estado de Direito. Porque a Europa não se justifica só por si mesma. O ideal iluminista que lhe está na base impõe-lhe esta cruzada de direitos pelo mundo, impõe-lhe também coragem contra a tentação da Realpolitik porque uma política de interesses leva a uma exigência desigual sobre os Estados em matéria de direitos.

Quero dizer como é essencial uma acção coerente da União e de cada um dos Estados-Membros em matéria de direitos humanos, porque há ainda muitas contradições nesta matéria e as contradições diminuem a autoridade moral do sistema político da União no diálogo com os seus interlocutores e enfraquecem o impacto da política europeia.

É grande a responsabilidade das presidências da União em assegurar a coerência das políticas de direitos humanos da União e dos seus Estados. Uma política europeia de direitos, forte e bem concertada, enfrentaria a lista de horrores que, infelizmente, não é privativa dos países subdesenvolvidos. A pena de morte ou mesmo a exploração do trabalho que leva à deslocalização de empresas, para dar dois exemplos bem distintos, só têm resposta numa política concertada e combativa dos direitos. Para mais, uma Europa cada vez mais ambiciosa em termos de presença militar só pode ser uma Europa cada vez mais ambiciosa de uma cultura de direitos, uma Europa política que tem o Homem ao centro, porque esta é a natureza da Europa.

  Anneli Jäätteenmäki (ALDE). – Arvoisa puhemies, ihmisoikeuksien korostaminen on ollut yleiseurooppalaisten järjestöjen erityispiirre koko toisen maailmansodan jälkeisen ajan. Ihmisoikeuksien tärkeys ei ole vuosien myötä vähentynyt, vaan päinvastoin se on kasvanut. Aikana, jolloin EU:n ja kolmansien maiden välinen kaupankäynti on lisääntynyt ja EU on mukana terrorismin vastaisessa toiminnassa, on tärkeää muistaa, että ihmisoikeudet eivät ole alisteisia tai merkityksettömiä. Ihmisoikeudet eivät ole alisteisia terrorismille eivätkä vilkkaalle kaupankäynnille.

EU:lla voi olla suuri vaikutus ihmisoikeuksiin, jos se puhuu yhdellä äänellä. Aina EU ei ole siinä onnistunut, joskus kylläkin. Tällä hetkellä toivoisi, että EU voisi keskittyä nykyistä enemmän nälän ja köyhyyden poistamiseen. Nälkä ja todellinen köyhyys on yksi pahimpia ihmisoikeusloukkauksia tällä hetkellä maailmassa.

Haluan kiittää esittelijä Howittia erittäin hyvästä yhteistyöstä ja siitä, että meidän monien tekemät tarkistukset on otettu huomioon. Lisäksi panin mielihyvällä merkille sen, että esittelijä korosti nimenomaan sen seikan tärkeyttä, että mietintö syntyy parlamentin, neuvoston ja komission yhteistyössä. Vain tätä kautta erilaisia poliittisia ryhmittymiä edustavat kansalaisjärjestöt ja näkemykset tulevat esille.

  Bogusław Sonik (PPE-DE). – Panie Przewodniczący! W swoim wystąpieniu chciałbym zwrócić uwagę na trzy aspekty związane ze sprawozdaniem posła Richarda Hewitta. Po pierwsze, Unia Europejska powinna posiadać sprawny instrument finansowy na wzór amerykańskich fundacji wspierających obrońców praw człowieka na całym świecie. Należy wspierać te organizacje i stowarzyszenia, które często działając nielegalnie, budują i walczą o demokrację, wolność słowa i przestrzeganie podstawowych praw.

Tymczasem przez ubiegły rok w instytucjach unijnych toczyła się debata tylko i wyłącznie na temat powołania nowej agencji – Agencji Praw Podstawowych, która miałaby się zajmować przestrzeganiem tych praw, ale tylko w krajach Unii Europejskiej. W tym kontekście przytoczę artykuł 56 sprawozdania: „Parlament wzywa Komisję do poważnego rozważenia stanowiska Parlamentu Europejskiego, który uważa, że powinien powstać specjalny instrument na rzecz praw człowieka na lata 2007–2013, i oczekuje na otrzymanie komunikatu Komisji w tej sprawie.”

Aspekt drugi: godna potępienia jest odmowa poparcia przez Unię Europejską na 61. sesji Komisji Praw Człowieka ONZ rezolucji w sprawie Czeczenii – gdzie popełniane są zbrodnie przez armię rosyjską, gdzie zginęło bez śladu od 3 do 5 tysięcy Czeczenów: nieuzbrojonych cywilów zatrzymanych przez Rosjan. Słusznie pisze poseł sprawozdawca w swoim sprawozdaniu, że takie stanowisko Unii Europejskiej sugeruje, że Unia stosuje jedne zasady wobec małych krajów, a inne wobec dużych.

Trzeci aspekt, na który chciałem zwrócić uwagę, to krytyczna sytuacja chrześcijan żyjących w krajach islamu. Sytuacja zaostrzyła się w ostatnich miesiącach. Wojna w Iraku, a także oburzenie wywołane publikacją karykatur w europejskich gazetach, stwarzają stan ciągłego zagrożenia dla mniejszości chrześcijańskiej w świecie islamskim.

  Zita Gurmai (PSE). – Tisztelt Elnök Úr! A globalizáció folyamatára úgy kell tekintenünk, mint egy lehetőségre a szabadság és a társadalmi haladás felé. A globalizáció együtt jár az emberi szabadságjogok iránti nagyobb igénnyel, de csak ha lehetőségeit megfelelően kihasználjuk.

Elgondolkoztattak a görög köztársasági elnök mai gondolatai. Európa a humanizmus legerősebb bástyája. Fontos, hogy ezt a jövőben is elmondhassuk, és a külvilág számára is egyértelművé, követendő példává tegyük.

Az EU olyan nemzetközi szereplő, amely kulcsfontosságú küldetéssel bír az emberi jogok védelmében, a demokrácia erősítésében és abban, hogy a globalizáció valóban a társadalmi kohézió megvalósulását jelentse.

Fontosnak tartom, hogy az EU harmadik országokkal való kapcsolatában ragaszkodjon az alapvető emberi jogok érvényesítéséhez. Pragmatikusan kell alkalmaznia a politikai párbeszéd külkereskedelem adta lehetőségeit.

A jelentés erőssége, hogy figyelmeztet arra, hogy nemcsak az Unió határain kívül kell figyelnünk az emberi jogok betartására, de van mit sepernünk a saját házunk táján is. A jelentés biztos alapul szolgálhat arra, hogy a jövőben ne csak nyilatkozatokat fogadjunk el az emberi jogokra vonatkozóan, hanem azok betartásában, betartatásában is jeleskedjünk.   Benita Ferrero-Waldner, membre de la Commission. Monsieur le Président, Monsieur le Président du Conseil, chers collègues du Parlement, je dirais qu'il est naturel que le Parlement exige davantage des autres institutions et, naturellement, j'ai écouté les interventions avec beaucoup d'attention. Je crois que les critiques sont nécessaires si l'on veut faire des progrès. Mais j'ai également relevé, dans le rapport de M. Howitt tout comme dans ce débat, des éléments d'appréciation positifs à l'égard de notre politique, dont je vous remercie à nouveau.

Dans un domaine comme celui de la promotion et de la protection des droits de l'homme, le bilan est naturellement contrasté. Je voudrais vous faire part de mon analyse de la situation. Premièrement: l'Union est-elle un acteur important dans ce domaine, un acteur qui compte et sur qui l'on compte? Ma réponse est oui, sans nul doute. Nous en avons tous constamment la preuve. Nos partenaires, étatiques ou non étatiques, États ou organisations internationales, continuent de se tourner vers nous et de voir en nous un acteur majeur, voire quelquefois indispensable, en raison de notre crédibilité politique, de notre influence, de notre expertise et des instruments dont nous sommes dotés.

Deuxièmement: l'Union dispose-t-elle de bons outils pour mener son action? Ma réponse, là aussi, est positive. Nous avons à notre disposition des instruments internationaux dans le cadre des Nations unies ou du Conseil de l'Europe, pour ne citer qu'eux. Nous avons le cadre de nos accords bilatéraux qui ont été largement cités, avec les clauses de droits de l'homme, ainsi que des orientations politiques communes dans de nombreux secteurs, les dialogues politiques, les démarches de toutes sortes. Nous avons les instruments financiers, géographiques et thématiques, également.

Troisièmement, notre contribution et nos actions sont-elles suffisantes? Là, je dirais plutôt que non, notamment si la question de notre action est posée en termes globaux. Mais si nous considérons des situations particulières, comme l'adoption de la résolution portant création du nouveau Conseil des droits de l'homme ou des situations relatives à des cas très spécifiques de pays et d'individus, nombreux sont les cas où nous avons fait la différence. En tout état de cause, l'Union, États membres y compris, est certainement l'acteur dont les contributions et les actions sont les plus importantes au niveau mondial, un acteur qui est vraiment très présent, même si nous ne sommes pas toujours aussi visibles que nous le voudrions ou que vous le souhaiteriez.

Enfin, sommes-nous efficaces dans la politique des droits de l'homme que nous menons? Avons-nous un impact? Je souhaiterais, pour ma part, tout comme le Parlement, que nous gagnions en efficacité et en impact. Pour cela, nous devrions faire un saut qualitatif important, spécialement en termes de cohérence. Cohérence entre la politique suivie au niveau de l'Union et celles menées par les différents États membres, cohérence entre la volonté politique de l'Union et les intérêts nationaux qui, effectivement, se manifestent à des moments clés de certaines relations bilatérales. Et nous avons besoin de mieux réconcilier, dans certains cas, notre agenda multilatéral avec l'agenda bilatéral. Nous avons aussi besoin de mobiliser toutes les institutions de l'Union, et parmi elles, naturellement, le Parlement européen.

Comme je l'ai déjà dit, nous sommes absolument en faveur d'un rapport élaboré en commun par les trois institutions. Oeuvrons dans ce sens! Le Parlement peut effectivement compter sur moi. Je ne ménage pas mes efforts ni ceux de mes services. Vous pouvez compter sur nous pour l'évaluation, mais aussi pour la mise en œuvre de la politique des droits de l'homme, même si, souvent, nous sommes confrontés nous aussi à une réalité politique qui n'est pas facile à gérer. Mais si nous voulons améliorer l'impact de notre politique, notamment en renforçant la cohérence de nos actions entre niveau européen et niveau national et entre les différentes institutions, le rapport annuel du Parlement, comme celui de M. Howitt, doit, selon moi, inspirer nos actions.

  Hans Winkler, amtierender Ratspräsident. Herr Präsident, Frau Kommissarin, meine sehr verehrten Damen und Herren! Wie Kommissarin Ferrero-Waldner möchte auch ich am Ende dieser Debatte meiner Freude darüber Ausdruck geben, dass wir uns alle dahingehend einig sind, dass die drei Institutionen der Europäischen Union nach außen hin mit einer Stimme sprechen müssen, um wirksam zu sein.

In dieser Debatte sind sehr viele Themen angesprochen worden. Im Grunde geht es doch bei jeder Beschäftigung mit den Menschenrechten ähnlich wie beim Thema Entwicklungszusammenarbeit darum, ob wir genug tun. Die Antwort auf diese Frage ist immer „nein“, wir können immer noch mehr tun. Zu dieser Selbstkritik müssen wir alle – Parlament, Kommission und Rat – zu jeder Zeit fähig sein, denn wenn es um Menschenrechte geht, wenn Menschen gefoltert werden, wenn die Menschenrechte mit Füßen getreten werden – und das ist in vielen Ländern der Fall –, dann heißt das, dass wir, die wir die Menschenrechte verteidigen, nicht genug tun. Daher müssen wir uns stets überlegen, wie wir besser werden können. Diese Debatte hat doch dazu beigetragen, dass wir uns genau dieser Überlegung hingeben.

Es ist eine Reihe von Themen angesprochen worden. Ich möchte nur ganz kurz das eine oder andere Thema streifen. Es wurde zu Recht darauf hingewiesen, wie wichtig gerade im Bereich der Menschenrechte die Zivilgesellschaft ist. Die staatlichen Institutionen und die Regierungen sind besonders auf die Mitarbeit der Zivilgesellschaft, der nichtstaatlichen Organisationen angewiesen. Wenn ich zum Beispiel in den letzten Tagen an die Erfahrungen des EU-Lateinamerika-Karibik-Gipfels denke, dann hat es auch hier ein starkes Zeichen der Zivilgesellschaft gerade im Bereich der Menschenrechte gegeben, und die Regierungen, aber auch die Parlamentarier müssen dieses Zeichen sehr ernst nehmen.

Im Bereich der Entwicklungszusammenarbeit spielt die Frage der Menschenrechte, die Frage von good governance mehr und mehr eine Rolle. Wir sind uns wohl alle einig – ich habe das auch in meinen Gesprächen mit dem Entwicklungszusammenarbeitsausschuss gesehen –, dass die gezielte Förderung von good governance und Menschenrechten im Rahmen der Entwicklungszusammenarbeit ein sehr wesentlicher Aspekt ist. Herr Romeva i Rueda hat hier zu Recht die Frage der Gewalt gegen Frauen erwähnt. Ich möchte darauf hinweisen, dass sich gerade auch die österreichische Ratsvorsitzende Ursula Plassnik diesem Thema ganz besonders widmet.

Mr Coveney said that the Council and Parliament should not duplicate each other’s work. I fully agree with that. Of course we must respect each institution’s individual role. That is what the three institutions must do. However, at the same time, we must cooperate where necessary in order to be more efficient.

Herr Agnoletto und andere haben die Menschenrechtsklauseln sowie die Frage angesprochen, ob die Europäische Union, der Rat und die Kommission diese Menschenrechtsklauseln, die in einer Reihe von Verträgen existieren, auch tatsächlich anwenden oder ob wir uns sozusagen nur einer Realpolitik hingeben.

Ich möchte doch sagen, dass die Menschenrechtsklauseln meiner Ansicht nach sehr wichtig sind. Sie sind nicht nur Klauseln, die Sanktionen oder die Suspendierung von Verträgen vorsehen. Sie sind vor allem – und das erscheint mir das Wesentliche – ein Grund, Dialog mit den Staaten zu führen. Von diesem Dialogrecht, das uns die Menschenrechtsklauseln in den verschiedenen Verträgen geben, machen wir auch Gebrauch. Das tun wir unabhängig davon, ob es sich um große oder kleine Staaten handelt.

Ich kann Herrn Vaidere nur Recht geben: Wir hoffen alle, dass der Menschenrechtsrat effizienter wird als die Menschenrechtskommission. Das war ja der Grund, warum sich die Europäische Union so eingesetzt hat. Ich würde aber bitten, dass man nicht schon jetzt, noch bevor die erste Tagung des Menschenrechtsrates begonnen hat, die Flinte ins Korn wirft und sagt: Wenn ich mir anschaue, wer alles gewählt wurde, dann kann das nichts Besseres werden. Hier muss man doch bei aller Treue zu den Grundsätzen einen gewissen Realismus an den Tag legen. Ich glaube, dass die Chancen letztlich durchaus intakt sind, dass aus diesem Menschenrechtsrat ein wirksames Instrument wird.

Herr Salafranca und andere haben die Rolle der Europäischen Union in der Welt unterstrichen, auch im Zusammenhang mit den Beitrittsverhandlungen, auch im Verhältnis zu den Balkanstaaten. Ich möchte daran erinnern, dass nach wie vor die Kriterien von Kopenhagen die wichtigste Voraussetzung dafür sind, dass mit Staaten Beitrittsverhandlungen begonnen werden können, und dass die Frage der Achtung der Menschenrechte ein ganz wesentliches Kriterium schon vor der Aufnahme von Beitrittsverhandlungen ist und es selbstverständlich auch im Zuge von Verhandlungen sein muss.

Mrs Lynne talked about trafficking in human beings. I fully agree that this issue is very important. I should just like to mention that the European Union cooperates closely in this respect with the OSCE, which is very active in this field. We should continue this cooperation and, again, there should be no duplication but rather a synergy effect.

Mrs Lynne and others talked about the question of human rights in the European Union. Of course there are human rights violations in all European Union countries, including my own. However, what makes the European Union different from other regions in the world is that we have effective instruments to deal with human rights violations. All European Union Member States are also members of the Council of Europe and signatories to the Convention on Human Rights. There is the unique instrument of the Human Rights Court in Strasbourg, and within the European Union we also have the necessary mechanisms and instruments to take care of any violations. We should not confuse the situation within the European Union with that in other states where such instruments do not exist.

I fully agree with Mrs Esteves and others that there should be no double standards and that the credibility of the European Union is the most important thing. That is why I reject all allegations that we distinguish between small and large countries. I do not think we treat one country differently from another, which is important.

So, assuming I have understood the report correctly, I thank you all very much for the support the Council’s policy has received. Let us continue to defend human rights everywhere in the world and let us do so together.

  Alessandro Battilocchio (NI). – L'UE rappresenta il vessillo a livello mondiale per quanto riguarda la tutela dei diritti umani. Questo Parlamento in innumerevoli occasioni si è espresso in favore del miglioramento delle condizioni di vita e dignità umana rispetto a molteplici situazioni purtroppo ancora quotidianamente sotto gli occhi dell'opinione pubblica internazionale.

Tuttavia molto resta ancora da fare per trasformare le nostre intenzioni in azioni concrete che puntino alla realizzazione di strategie efficaci per migliorare la situazione dei diritti umani nel mondo. L'UE stessa in primis deve vegliare affinché le politiche europee di relazioni esterne, commercio internazionale e sviluppo assumino tale impegno tra le proprie priorità, integrando l'attenzione ai diritti umani in ogni attività che da esse deriva. Una dovuta coerenza è inoltre necessaria tra le azioni comunitarie e quelle intraprese da ogni singolo stato membro.

Un'attenzione particolare va riservata ai paesi con cui l'UE ha legami più stretti: i paesi candidati (specialmente per quanto riguarda la Turchia) ed i paesi partner della Politica di vicinato, e penso in particolare alle repubbliche caucasiche, in cui, nonostante i notevoli progressi, restano ancora aperte molte questioni relative alla tolleranza etnica e religiosa e alla libertà di espressione.

  Glyn Ford (PSE). – I would like to congratulate Mr Howitt on his report. Our twin reports in Parliament on human rights in the world and human rights in the Union demonstrate the importance we place on this issue. Our consistent campaign against the death penalty, whether in the United States or China, Iran or Japan, is to be welcomed. My own Government in Britain was influential in pushing this forward during its Presidency last year.

My only criticism on this Foreign Affairs Committee report would be its unevenness in places and its over-reliance on third-hand reports. For example, Saudi Arabia barely gets a mention. The situation is that the majority of the population – its women – face vicious discrimination. Followers of all faiths, save its own peculiar form of Islam, face persecution and where torture and mutilation are rife. Equally, it reports persecution of journalists in North Korea. Yet as someone who follows the country closely, it is a complaint I have never heard. There is much rightly to raise with the Government of North Korea regarding human rights in the prisons and camps, plus the humanitarian situation in the countryside, rather than these blanket and unsupported catch-all allegations that do no credit to our work.

  Katalin Lévai (PSE). – Ha az Európai Közösségről és a közös európai értékekről beszélünk, első helyen kell említenünk az emberi jogok védelmét.

Az Európai Alkotmány újabb nagy előrelépést jelent majd az Alapvető Jogok Chartájának alkotmányos szintre emelésével, az önálló uniós emberi jogi védelmi rendszer megteremtésével.

Európa intenzívebb külügyi szerepvállalásának is egyik kulcsmotívuma, hogy komoly hatással lehet az emberi jogokra, amikor egységesen szólal fel, és különösen befolyásos szereplő lehet a nemzetközi fórumokon.

A jelentésből is kiviláglik, hogy a jelenlegi helyzet vegyes és ellentmondásos. Bár az Európai Unió továbbra is az emberi jogok egyik fő védelmezője a világban, sokkal inkább jeleskedik nyilatkozatok kiadásában, mintsem azok nyomon követésében, és egyéb politikáiba és programjaiba sok esetben nem integrálja vagy nem érvényesíti az emberi jogi megfontolásokat.

Az viszont üdvözlendő, hogy az elmúlt évben az EU kiemelten támogatta a halálbüntetés eltörlését az egész világon, intenzíven foglalkozott például a kínai, a csecsenföldi és a zimbabwei helyzettel, továbbá a szakszervezeti jogok megerősítésével Iránban és Kambodzsában.

Fontosnak tartom, hogy mind a csatlakozási, mind a stabilitási és társulási megállapodásokról szóló tárgyalások során – Koppenhága szellemében – elsődleges hangsúlyt kapjanak az emberi jogok. Magam is szorgalmazom, hogy a jelölt országokkal és a stabilitási és társulási folyamatban részt vevő országokkal folytatott szerződéses kapcsolatokban az ENSZ és – például a kisebbségi jogok tekintetében – az Európa Tanács egyezményeinek való megfelelés is prioritást kapjon.

Meggyőződésem, hogy a Parlamentnek mint az Európai Unió egyetlen közvetlenül választott testületének vezető szerepet kell játszania az emberi jogok fejlődésében és biztosítania kell, hogy a többi európai uniós intézmény is mindig szem előtt tartsa az emberi jogokat.

  David Martin (PSE). – I welcome this report by my colleague Richard Howitt on Human Rights in the World 2005. He is right to draw to our attention to the fact that while the EU is vigorous in promoting human rights, its efforts are largely confined to specialist and one-off representations. There is, sadly, a general failure by the EU to address human rights concerns systematically and continuously with respect to third countries and to mainstream human rights policy with respect to the Union’s trade, development, and other external policies with such countries. We need a common, consistent and transparent policy for dealing with abuses of human rights in third countries.
