  Presidente. L'ordine del giorno reca la relazione presentata dall'on. Jean-Paul Gauzès, a nome della commissione per i problemi economici e monetari, sulla proposta di direttiva del Parlamento europeo e del Consiglio relativa ai servizi di pagamento nel mercato interno e recante modifica delle direttive 97/7/CE, 2000/12/CE e 2002/65/CE (COM(2005)0603 - C6-0411/2005 - 2005/0245(COD)) (A6-0298/2006).

  Charlie McCreevy, Member of the Commission. Mr President, firstly I would like to thank the Committee on Economic and Monetary Affairs, and in particular the rapporteur, Jean-Paul Gauzès, for their excellent work in preparing the report on the directive on payment services in the internal market. I also thank you for your patience regarding the deferral of this plenary vote. This has provided the time needed to find common ground between the three institutions.

Currently, 27 different sets of national rules apply to payment transactions. Although we have the euro, national payments markets continue to be fragmented and, sadly, all too often payments are slow and expensive and consumers poorly served. This makes life for our citizens and businesses more difficult than it should be. It holds up their daily activities and hinders their business development. In some cases, desirable payment products, such as direct debits, are simply not available. The directive aims to remedy this situation in two main ways: on the one hand, by providing greater legal certainty and improved consumer protection, and, on the other hand, by opening up the payments market to more competition to encourage greater efficiency and innovation.

The directive provides greater legal certainty by establishing a harmonised set of rights and obligations for users and providers, as well as clear information requirements. Both are essential to an integrated EU payments market, at the heart of which is SEPA, the Single European Payments Area. SEPA is an industry initiative strongly supported by the European institutions. SEPA will allow for the creation of an integrated market, enabling payments to be executed more quickly and easily throughout the European Union. The efficiency of our payments systems should be enhanced and the cost of payments to the economy as a whole reduced. Adoption of the proposed directive is therefore crucial for the successful launch of SEPA.

But the picture would not be complete without the other objective of the directive, namely that of fostering more competition in payments markets through the establishment of an appropriate and balanced prudential framework for new entrants. New payment institutions, such as money remitters, mobile operators and retailers, should act as a spur to innovation.

Throughout these long months of negotiation, both the Council and the Commission have been very aware of the views set out in the report adopted by the Economic and Monetary Affairs Committee last September. The compromise text, which is now on the table as Amendment 286, therefore seeks to meet these objectives and, in particular, calls for a strengthened prudential framework for the new payment institutions. In addition to the qualitative prudential requirements already proposed by the Commission, these new institutions will now be subject to a regime of appropriate and balanced capital charges – both initial and ongoing, and hybrid institutions, such as retailers or telecom companies, must also meet safeguarding requirements such as ring-fencing.

The directive’s scope will be limited to payments that both originate and end in the European Union. It is, however, important not to forget about payment transactions involving non-EU Member States or non-EU currencies. Consumers rightly expect the provisions protecting them with regard to theft, loss or misappropriation of payment instruments to apply irrespective of whether non-authorised use takes place inside or outside the European Union. Performance, quality and price of payments made towards third countries should also improve. EU consumers transfer considerable amounts of funds to third countries, often to support their families. The costs of such payments can be very high. Therefore, after three years of operation, the scope of the directive should be reviewed in order to assess whether ‘one-leg payments’, where only one of the parties involved is in the EU, or payments in non-EU currencies, should be included.

Let me conclude: European citizens and businesses today need a single payments market, in which payments can be made as quickly, efficiently and conveniently as domestic payments. This directive can provide the market with the necessary legal foundation for SEPA and with a new prudential framework fostering new competition.

  Jean-Paul Gauzès (PPE-DE), rapporteur. – Monsieur le Président, Monsieur le Commissaire, mes chers collègues, le premier décembre 2005, la Commission européenne a publié une proposition de directive concernant les services de paiement dans le marché intérieur avec pour objectif de créer un véritable marché unique des paiements dans l'Union européenne.

Désigné comme rapporteur du Parlement en janvier 2006, j'ai estimé que, même si certaines des prévisions de la Commission européenne paraissaient optimistes, la réalisation d'un tel marché grâce à une harmonisation des législations nationales permettrait de lever certains obstacles et aurait des effets positifs sur la croissance. J'ai donc approuvé sur le principe l'initiative de la Commission européenne.

Cette proposition de directive venait de plus à un moment opportun pour permettre le succès de l'initiative du secteur bancaire pour la constitution d'un espace unique de paiement en euros. Les objectifs affichés par la Commission européenne étaient de renforcer la concurrence en créant de nouveaux intervenants – vous venez de le rappeler, Monsieur le Commissaire –, d'améliorer la transparence du marché pour les prestataires comme pour les utilisateurs, et de clarifier les droits et obligations des utilisateurs et prestataires.

Afin de conférer une meilleure efficacité à cette proposition législative et de prendre en compte les contraintes techniques de l'industrie, tout en conservant l'objectif d'une réduction des coûts au bénéfice des utilisateurs, la commission économique a adopté un certain nombre d'amendements cohérents entre eux qui ont finalement reçu l'assentiment des membres de la commission à l'unanimité.

Tout au long de la procédure, des contacts informels ont été menés entre les représentants du Parlement européen, des présidences successives et de la Commission européenne. Ces discussions ont permis au Parlement, qui, situation rare, a pris sa position avant que le Conseil ne trouve un accord, d'influencer de manière tangible les négociations au Conseil. Je me réjouis particulièrement de la coopération fructueuse avec la Présidence allemande, qui n'a pas ménagé ses efforts, et avec votre Commission.

Le 27 mars 2007, les ministres des finances, réunis au sein du Conseil des affaires économiques et financières, ont finalement adopté à l'unanimité une approche générale sur un texte de compromis. Ce compromis me paraît aujourd'hui acceptable. Je tiens à remercier la Présidence allemande. Son travail efficace et sa bonne coopération avec le Parlement européen ont permis à ce dossier d'être maintenant sur le point d'aboutir.

Le Conseil s'est rapproché du Parlement sur les points essentiels, à savoir la réduction du champ d'application aux paiements en euros ou dans les autres monnaies effectués à l'intérieur de l'Union européenne - un aménagement pouvant intervenir après une période d'essai -, la restriction de l'activité d'établissement de paiement aux personnes morales, la mise en place de conditions strictes d'autorisation d'exercice, l'introduction d'un capital initial et ongoing, le cantonnement des fonds pour les établissements hybrides, la limitation de l'octroi de crédit à douze mois avec l'interdiction du crédit revolving, ainsi que l'introduction d'une disposition indiquant que l'octroi de crédit ne doit pas être en contradiction avec les règles nationales et européennes relatives, notamment, au crédit à la consommation.

Le rapprochement s'est fait aussi sur l'information plus claire du consommateur, grâce à une distinction entre les informations qui doivent être activement fournies et celles qui doivent seulement être mises à sa disposition, sur la possibilité offerte aux microentreprises de bénéficier de la même protection que les consommateurs en ce qui concerne l'information, enfin sur une possibilité limitée de dérogation, avec un volume de transaction maximum fixé à 3 millions d'euros.

Le texte, tel qu'il est, fixe un délai d'exécution à J+1 et un partage clair des responsabilités entre les différents prestataires de services de paiement en cas de mauvaise exécution d'une transaction. C'est sur ce texte de compromis que le Parlement se prononcera demain.

Compte tenu des avancées significatives obtenues lors de l'Ecofin dans le sens de la position du Parlement et de l'objectif des parties prenantes d'obtenir un accord en première lecture, je n'ai déposé en plénière qu'un seul amendement, qui reprend le compromis de l'Ecofin. J'invite mes collègues à soutenir cet amendement.

Un amendement 287, relatif à la protection des données, qui vise à modifier l'article 71, a été déposé par la gauche unitaire européenne. Je ne pense pas que cet amendement doive recevoir l'accord du Parlement. En revanche, il serait souhaitable, Monsieur le Commissaire - et je m'adresse aussi aux représentants de la présidence et du Conseil -, que des assurances soient données à ce titre à notre Parlement.

Le texte de compromis n'est certainement pas parfait et certains de mes collègues auront peut-être l'occasion de le dire. Il a toutefois le mérite de poser les bases déjà solides d'un marché intérieur des paiements. Il est important de faire valoir ce que représente cette avancée qui conduit à l'harmonisation des systèmes de paiement qui sont aujourd'hui strictement nationaux. Il n'est pas inutile de souligner qu'il ne s'agit pas seulement des paiements transfrontaliers, qui représentent moins de 5 % des paiements, mais bien de l'ensemble des paiements réalisés.

En dépit de son aspect technique manifeste, ce texte a une portée politique certaine. Il améliore les rapports entre les consommateurs et les prestataires de services financiers de paiement et participe à la stratégie de Lisbonne. Mais je voudrais aussi souligner que sur ce sujet spécifique et particulièrement délicat, puisqu'il pourrait mettre en place des conflits d'intérêts, le Parlement a, dans sa diversité, trouvé une solution plus rapidement que les gouvernements. C'est peut-être parce qu'ici on a plus qu'ailleurs …

  Mia De Vits (PSE), Rapporteur voor advies Commissie interne markt en consumentenbescherming. – Voorzitter, collega's, ik denk dat wij morgen stemmen over een zeer belangrijk dossier dat zowel voor de mensen, de bedrijven als de banken, zeer belangrijk is. Ik ben blij dat het Europees Parlement op de besluitvorming in belangrijke mate heeft kunnen wegen. Hiervoor dank aan alle collega's, in het bijzonder aan rapporteur Gauzès die met zijn kennis van de sector dit zeer objectief heeft behandeld en ook dank aan alle schaduwrapporteurs.

Als rapporteur voor advies van de Commissie interne markt, vind ik het zeer belangrijk dat we, geconfronteerd met 27 verschillende betaalsystemen en dus ook met 27 verschillende wetgevingen, erin geslaagd zijn om een zeer hoog niveau van consumentenbescherming te realiseren. Zowel inzake de informatieplicht van de banken, de aansprakelijkheid van de banken in geval van foutieve transacties, als in geval van verlies of fraude van de kaart, lijkt de tekst mij meer dan bevredigend.

Het grootste debat ging over de betaalinstellingen en uiteindelijk is ook daar, denk ik, het compromis verdedigbaar, al hadden we het in onze fractie liever nog wat strenger gezien. Het is geen schande om een bank te zijn. Deze richtlijn gaat over betalingen, niet in eerste instantie over kredieten en wil je krediet verlenen, dan moet je aan de voorwaarden en de controle van de banken voldoen.

Toch nog enige bezorgdheid: het SEPA-project mag niet ten koste gaan van de kleine man. Ik stel met genoegen vast, commissaris, dat de Commissie een onderzoek is gestart naar de tarieven van het kaartgebruik. Ik roep de Commissie dan ook op om regulerend op te treden, als we op het terrein zouden vaststellen dat de banken misbruik maken van hun machtspositie. De richtlijn komt op het juiste moment. Het project is een goed project; ik denk dan ook dat het nu tijd is voor een correcte uitvoering ervan.

  Rainer Wieland (PPE-DE), Verfasser der Stellungnahme des mitberatenden Rechtsausschusses. – Herr Präsident! Wir reden in diesen Tagen viel davon, dass wir den Bürgern die Vorteile Europas erklären müssen. Wir haben mit dieser Richtlinie ein Beispiel, das Strahlkraft entwickeln kann, auch wenn heute in der Plenardebatte wieder deutlich wird, dass diese Richtlinie auch eine technische Seite hat. Diese technische Seite ist nicht immer besonders sexy. Wir müssen uns durchaus Mühe geben, die Vorteile auch einmal in aller Offenheit so darzustellen, dass sie die Bürger auch verstehen.

Seit Einführung des Euro haben wir einen Europäischen Zahlungsraum, wir haben ein Zahlungsinland. Ein Zahlungsraum war immer schon auch ein Zahlungsdienstleistungsraum. Und genau diesen Zahlungsdienstleistungsraum bringen wir jetzt einen Schritt voran. Das, was wir vor Jahren mit dem grenzüberschreitenden Massenzahlungsverkehr eingeführt haben, bringen wir jetzt mit dieser Richtlinie voran. Wir sollten auch den Mut haben, dies zu sagen und uns nicht zu sehr in Details verstricken.

Wir können froh sein, dass die Besonderheiten in den einzelnen Mitgliedstaaten berücksichtigt werden konnten, wie z. B. das kosten- und verbrauchergünstige System der Lastschriften. Wir sollten in der Zukunft darauf achten — Frau de Vits hat es angesprochen —, wie sich der Markt entwickelt. Insbesondere sollten wir verstärkt darauf achten, inwieweit die ankommenden — nicht die abgehenden — Zahlungen mit Gebühren belastet werden. Dies sollten wir verstärkt in den Fokus nehmen, denn ich habe den Eindruck, dass hier in der jüngeren Vergangenheit einige Missbräuche getrieben wurden.

Wenn wir jetzt von SEPA – Single European Payments Area — sprechen, dann sollten wir zeigen, dass wir als Parlament vorne sind. Dort, wo wir von Open Skies sprechen, dort können wir von einem Einheitlichen Europäischen Flugraum bzw. Single European Flight Area (SEFA) sprechen. Und wenn jetzt über die Roaming-Gebühren diskutiert wird, kann von einer Single European Telecommunications Area (SETA) die Rede sein. Dann wird Europa auch wieder erkennbar und es werden nicht einzelne Projekte mit immer neuen Denkfiguren befrachtet, so dass die Menschen es nicht wieder erkennen.

  Alexander Radwan, im Namen der PPE-DE-Fraktion. – Herr Präsident, Herr Kommissar, meine sehr verehrten Damen und Herren, liebe Kollegen! Erst einmal möchte ich mich hier ganz besonders bei unserem Kollegen Jean-Paul Gauzès bedanken, der dieses Projekt durch großen Einsatz gemeinsam mit dem Parlament vorangetrieben hat. Wir haben ja schon seit einiger Zeit den Euro, der einheitliche Zahlungsraum in Europa wird vorangetrieben vom Europäischen Parlament, von der Europäischen Union. Das ging mit den grenzüberschreitenden Gebühren los und findet jetzt den nächsten Schritt in SEPA. Und hier gilt es schon, die besondere Rolle des Europäischen Parlaments zu betonen.

Wir haben es geschafft, trotz der verschiedensten Kulturen und der unterschiedlichen Strukturen des Zahlungsverkehrs in Europa eine einheitliche Lösung zustande zu bringen. Die Entscheidung fiel im September letzten Jahres. Nur durch den Druck des Parlaments war es möglich, den Rat hier zu einer Lösung zu bewegen.

Leider sind einige Mitgliedstaaten nach wie vor der Meinung, sie müssten auf europäischer Ebene bei ihren starren Systemen bleiben. Das ist aber nicht Europa! Europa ist das Zusammenführen von allem – und der Kollege Wieland hat das angesprochen. Die Europäische Union kann mit solchen Projekten konkret zeigen, was es für den Bürger bedeutet. Letztendlich gab es Kompromisse wie bei D+1, bei der Frage der Kredite, bei den Zahlungsdienstleistern und bei den Verbraucherschutzbestimmungen. Hier sollte letztendlich nach wie vor das Ziel sein, den mündigen Bürger als benchmark zu haben. Aber ich sehe hierin einen wichtigen weiteren Schritt, und hoffe, die Richtlinie wird entsprechend umgesetzt. Aber bei einigen Punkten sind noch Fragen offen!

In letzter Zeit mehren sich in meinem Büro die Anfragen, was eigentlich bei Überweisungen passiert, die fälschlicherweise ausgefüllt wurden und dann ausgeführt werden. Nur ein Beispiel: Jemand hat von Deutschland nach Italien 150 Euro überwiesen und aufgrund einer falschen Eingabe wurden 113 Euro Gebühren einbehalten. Wenn die Banken so weitermachen, werden sie den nächsten Schritt heraufbeschwören.

Darum appelliere ich zu einer sinnvollen Selbstregulierung und dazu, sich ein Stück weit am Bürger zu orientieren. Ich hoffe, dass dieser Appell jetzt nicht dazu führt, dass das Licht wieder ausgeht. So schlimm war er ja auch nicht. Ich danke nochmals ganz herzlich dem Kollegen Gauzès und der Kommission, dass wir es gemeinsam geschafft haben, den Rat doch noch auf eine Linie zu bringen.

  Gianni Pittella, a nome del gruppo PSE. – Signor Presidente, onorevoli colleghi, anch'io voglio rivolgere un particolare ringraziamento al relatore Gauzès per il lavoro eccellente che ha svolto, ma anche per il dialogo, lo stile e la capacità di concertare con i gruppi politici, come pure con la Commissione e con il Consiglio. Rivolgo un saluto anche al Commissario McCreevy.

Il Parlamento nel suo insieme ha avuto un ruolo determinante per quanto riguarda la direttiva sui servizi di pagamento e, anche in questo caso, ha confermato di essere l'istituzione che, in questa fase storica, ha la maggiore vitalità. E' grazie al Parlamento, grazie al nostro lavoro, che si è raggiunto un accordo e che il Consiglio ha adottato quale base del suo lavoro la relazione approvata quasi all'unanimità dalla commissione per i problemi economici e monetari. E' grazie al nostro ruolo che sono stati affrontati gli scogli impervi ed è grazie al nostro lavoro – e voglio anche ricordare il ruolo specifico svolto dalla delegazione socialista attraverso la collega van den Burg, la collega De Vits, la collega Berès e io stesso – che sono stati affrontati in maniera positiva anche alcuni problemi, come quello della concessione del credito, che giustamente adesso viene ancorato alla direttiva sul credito al consumo.

Io penso che l'accordo raggiunto in marzo in sede di Consiglio "Ecofin", grazie alla tenacia della Presidenza tedesca e al lavoro fatto in precedenza dalla Presidenza finlandese, rappresenti un ottimo risultato e ritengo che noi dobbiamo sostenere questa posizione. E' per questo motivo che annuncio il voto favorevole del gruppo socialista, in modo da evitare qualsiasi ritardo. Non possiamo consentire ulteriori ritardi che sarebbero a danno dei consumatori – come ha ricordato Mia De Vits –, delle imprese e dell'industria bancaria. Per quanto riguarda le banche, l'indagine che sta svolgendo la Commissione è importante al fine di rilevare eventuali incongruenze; tuttavia, nonostante la necessità di essere severi nel nostro giudizio, mi sembra anche giusto sottolineare quando le banche fanno sforzi positivi. Infatti, per adeguarsi a questa direttiva, le banche stanno compiendo sforzi quasi pari a quelli fatti per l'introduzione dell'euro. Un ritardo sarebbe quindi negativo sul piano degli interessi di questi soggetti e noi, col voto di domani, dovremo evitare assolutamente che questo ritardo si verifichi.

  Sharon Bowles, on behalf of the ALDE Group. – Mr President, am I happy with this package? The answer is ‘not really’. Am I supporting it? Yes, because I believe it makes sense to have a European payments system to improve the single market and therefore it makes sense to take this step, far from perfect though it is.

I have been astonished at how difficult it has been trying to move out of the dark ages on payment times, capital regimes and electronic money. The question I have most often been asked about this directive is ‘Will it make payments cheaper?’, not ‘Will it make payments safer?’. But this is not a price-regulation directive, so the only way to make payments cheaper is through greater competition and through transparency, so that consumers know what they are getting.

We have achieved greater transparency, which I welcome, as I do the other useful safeguards for consumers. Hopefully, the payment service providers’ ability to passport will enhance competition, but I harbour fears that the ongoing capital regimes and especially the scaling factors of 0.5 and 0.8 for money remitters and mobile remittances respectively mean repeating the mistakes made in the E-money Directive.

A review of the capital regime after three years in the light of experience, and perhaps after the functioning of extremes of implementation of 20% flexibility, may, therefore, turn out to be interesting. It is certainly an essential backstop that allows me to give my support, as is the possibility of reviewing the scope after three years. It is quite a disappointment to me that the present scope does not extend to one-leg payments.

Finally, as regards Amendment 287, I persuaded my group not to table a similar amendment because, in addition to technical details, the data-protection issue is wider than this directive. That does not mean that the issue does not need addressing or, should it come to it, that a vote against the amendment is against the principle that it embodies, but I hope that another solution can be found that encompasses the idea without destroying the opportunity of this single-reading agreement.

  Dariusz Maciej Grabowski, w imieniu grupy UEN. – Panie Przewodniczący! Inicjatywa dyrektywy jest na pewno słuszna i uzasadniona. Tym niemniej budzi ona szereg zastrzeżeń. Utworzenie instytucji płatniczych nasuwa pytanie czy działać będą one zgodnie z zasadą maksymalizacji zysku czy też dobra publicznego. A są to podejścia wykluczające się. W związku z tym pojawia się pytanie, czy nastąpi realne powiększenie konkurencji między instytucjami czy też po krótkim czasie nastąpi koncentracja i właściwie oligopolizacja rynku płatności. Jeżeli tak, to kwestią zasadniczą jest wprowadzenie tego rozwiązania dla krajów objętych strefą EURO. Kraje nowo przyjęte będą miały wtedy czas, aby dostrzec czy są korzyści z wprowadzonego systemu czy też nie. Ponadto będą one mogły zobaczyć, jakie są koszty wprowadzenia tego systemu, gdyż z uwagi na oprogramowanie i kontrolę mogą się one okazać stosunkowo wysokie, czego na razie nie można oszacować.

  John Whittaker, on behalf of the IND/DEM Group. – Mr President, on a technical matter, the rapporteur is concerned to have rigorous separation of payment services from other commercial activities, which must mean banking business. The purpose of this separation is, presumably, to minimise risk. But all payments, apart from a tiny proportion of cash payments, are transfers between bank accounts. Hence banks are the natural institutions for operating payment systems, and I doubt that such a separation is either feasible or even desirable from an efficiency point of view. This directive states that it has the worthy objectives of increased competition, transparency, consumer protection and so on. I wonder whether it will turn out like other financial directives such as MiFID, the Markets in Financial Instruments Directive, for instance. Many people in the City of London have now realised that the costs of compliance with MiFID are far larger than any potential benefits.

  Piia-Noora Kauppi (PPE-DE). – Mr President, I wish to begin by saying that I totally disagree with Mr Whittaker about MiFID and its consequences. I think MiFID will be a revolution for trading in European markets and it will deliver very good results in Europe. I think the Commissioner agrees with me on this.

Overall, the Payment Services Directive represents a very positive step in internal market harmonisation. Like the Commissioner, I believe that with the present agreement we have reached a balance between banks and other service providers on the one hand and consumers on the other. This was an instance in which the market was not delivering the best possible results and regulation was really needed.

I would like to raise three brief points of substance. Firstly, I very much agree with Mrs Bowles concerning capital regime. I would have favoured the EC’s original proposal on capital requirements. I think that it might not be enough of a level playing field, and new access-related barriers might appear especially for non-banks. I should have liked to see a more liberal competition regime in these aspects.

Secondly, on the question of credit granted, especially by credit card companies which are non-banks, there are possible disadvantages for these credit card companies, but we can look at these issues again in our review in three years’ time.

Thirdly, on the liability of payment service providers, I understand that there is an in-built flexibility in payment contracts on what, for example, the payer’s responsibility is in cases like Mr Radwan referred to, when the payment does not appear when it should. However, I think the strict definition on liability in the directive could be too rigid and inflexible and it should have been reformed. On the other hand, we can also go back to this in the review.

Finally, concerning the single reading process, I think Parliament, the Commission and the Council interacted very well on this. However, we were put in a ‘take it or leave it’ situation and it would have been better if Parliament had been able to put substantial amendments in place before the vote in plenary. However, all in all the single reading is a good step towards modernising our legislative processes, but it is not an end in itself. We have a good compromise on this directive, but if this is not the case, the single reading should not be used.

  Pervenche Berès (PSE). – Monsieur le Président, huit ans après le passage à l'euro, je crois qu'il est raisonnable que l'Union se dote d'un marché unique des systèmes de paiement. Je crois tout aussi raisonnable que ce Parlement ait insisté pour qu'au même moment où nous mettons en place ce marché unique des paiements, nous légiférions sur les établissements de paiement, nouvel acteur entrant sur ce marché.

Lorsque je regarde l'ensemble des parties prenantes à l'installation de cette nouvelle dimension du marché intérieur, qu'il s'agisse des banques, des distributeurs, des administrations ou des consommateurs, il me semble que nous apprécierons finalement mieux la validité de la législation que nous allons adopter si, demain, les services de paiement ne sont pas plus onéreux pour les consommateurs et si leur diversité est valorisée de façon à faciliter l'accès aux moyens modernes de paiement.

Je crois aussi que nous avons eu raison d'insister pour que les établissements de paiement ne soient peut-être pas soumis à toutes les normes définies par Bâle II, mais pour qu'a minima, leur stabilité et leur viabilité soient assurées dans l'intérêt du consommateur.

Par ailleurs, je regrette qu'une certaine confusion soit introduite entre la notion de prêt et celle de paiement. J'espère que l'accord obtenu avec ce texte ne compromettra pas un accord sur une directive crédit-consommation dont l'Union a tant besoin.

Enfin, permettez-moi d'insister sur le sens de l'amendement 287 et, surtout, sur la lettre que le Président de notre institution a reçue du président du groupe dit "de l'article 29", chargé de la protection des données au sein de l'Union européenne. Nous ne pouvons pas accepter aujourd'hui de voter le rapport de notre collègue, M. Gauzès, sans garanties aussi bien de la Commission que du Conseil. Aussi, je m'adresse à nos deux interlocuteurs institutionnels pour qu'au moment de la mise en œuvre du système SEPA, nous ne soyons pas dans une situation qui, avec ce que nous savons du système SWIFT, nous conduise à aggraver la dérive que nous connaissons.

Nous avons besoin de savoir qu'au moment où le système SEPA entrera pleinement en vigueur, nous aurons un système qui permette la protection des données échangées à travers SWIFT. Nous avons aussi besoin, et j'attends sur ce point une déclaration des deux autres institutions, que des négociations s'engagent avec nos partenaires américains pour vérifier dans quelles conditions les données transmises par SWIFT le sont à l'administration américaine.

  Margarita Starkevičiūtė (ALDE). – Aš labai norėčiau pabrėžti, kad svarbu, jog ši direktyva bus taikoma ne tik euro zonos šalyse, bet taip pat šalyse, naudojančiose kol kas ir ne eurą. Todėl, kad tokiu būdu tų šalių finansų rinkos bus modernizuojamos. Norėčiau padėkoti pranešėjui už puikų jo darbą.

Čia buvo išsakyta daug problemų, kurios susijusios su šios direktyvos įgyvendinimu. Taip pat norėčiau pasakyti, kad, kaip pasakė pranešėjas, ši dokumentas yra labai techninio pobūdžio. Mums vis dar reikia išsiaiškinti kelis dalykus ir, svarbiausia – tai ši mokėjimų direktyvos įgyvendinimo priežiūrą, kai veikia didelės bankinės ir finansinės grupės. Kas bus atsakingas? Nors atrodytų direktyva tai apibrėžia, tačiau išlieka daug neaiškumų.

Kitas svarbus klausimas, į kurį reikia atkreipti dėmesį, tai nebankinių finansinių institucijų priežiūra , kuri būtinai reikalinga, sveikintina. Tačiau atskyrimas kartais gali būti tos priežiūros išryškinimas ir kainuoti brangiau negu pačios operacijos mažose šalyse.

  John Purvis (PPE-DE). – Thank you, Mr President, and well done, Mr Gauzès. We have waited a long time, but we have finally got there. Well done! Importantly, the payment services directive opens up the payments market to non-banks. Barriers to entry and the stifling of innovation have been addressed, at least to some extent, through a mix of waivers for smaller players and flexibility for Member States on electronic money and other new means of payments, such as the money purse.

However, I feel that there are some aspects where we have had an opportunity to make bigger inroads towards competition but have not gone nearly far enough. Non-banks do not need such comprehensive capital requirements as have been agreed with the Council. Payment services companies such as remitters, bill payers and companies offering card-based payment services do not take deposits and therefore do not need the same financial underpinning as deposit-taking commercial banks. One suspects that this is more a matter of protecting traditional banks from new competitors than of protecting consumers.

Secondly, in this age of instantaneous communication surely even one day is more than should be necessary to move money from one end of the earth to the other, let alone from Strasbourg to Freiburg. And why are the banks afraid to be transparent about the cost of their services instead of charging by stealth in the form of unjustifiably long float times? Surely, in the spirit of Lisbon, we should be leading the world in applying today’s technology to money transfers. They should be instantaneous, with no delay at all. The service provider should then openly display its full charge for the service.

So this directive, as finally and tortuously agreed, is a step in the right direction towards providing Europeans, both individuals and SMEs, with a modern, efficient and reasonably-priced money transmission service. But it is not all we should expect. Hopefully there will be further steps, Commissioner.

  Ieke van den Burg (PSE). – Voorzitter, ik zou eerst willen aansluiten bij wat mevrouw Kauppi op het eind zei over de eerste lezing-procedure. Ik denk dat we daar inderdaad goed mee om moeten gaan in dit Parlement. Het is prima dat dat nu gelukt is. Ik wil ook zeggen dat de rapporteur en de schaduwrapporteurs op een heel goede manier de rest van de economische commissie hebben geïnformeerd en dat op een heel transparante manier hebben gedaan wat soms niet het geval is in eerste lezing-procedures, maar het is goed dat we nu snelheid hebben en met dit dossier verder kunnen.

Twee opmerkingen over de inhoud. Allereerst sluit ik mij deels aan bij wat mijnheer Purvis heeft gezegd over de concurrentie op de betalingsmarkt. In Nederland hebben wij niet zo veel moeite met die waiver die nu aangegeven is, omdat we ook hopen dat er zich nieuwe diensten ontwikkelen en zich ook nieuwe dienstverleners op de markt begeven, met name als je kijkt naar bijvoorbeeld migranten die hun geld naar hun thuislanden willen sturen. Dat is typisch een dienst waar zich nieuwe dienstverleners ontwikkelen en een dienst die ik graag in het witte circuit zie, en niet in de illegaliteit ondergronds. Ik denk dat we dat soort ontwikkelingen en dat soort mogelijkheden, juist waar het om kleinere bedragen en om heel simpele diensten gaat, een kans moeten geven, want waarom zouden die mensen van dure bankdiensten gebruik moeten maken.

Laatste opmerking - en dat is ook al door verschillende sprekers aan de orde gesteld -: Laten we - en dat is ook een signaal naar de Commissie en DG mededinging - heel goed in de gaten houden dat er niet weer nieuwe monopolies, oligopolies of kartels ontstaan die zich op deze markt manifesteren, zodat het uiteindelijk toch niet leidt tot goedkopere en betere dienstverlening voor de cliënten.

  Zsolt László Becsey (PPE-DE). – Gratulálok a jelentéstevőnek, és remélem, hogy egy történelmi pillanathoz érkeztünk. A belsőpiaci szolgáltatások terén ugyan még csak félig-meddig sikerült eredményt elérni, de remélem, komolyabb áttörést valósítunk most meg a fizetési szolgáltatásoknál.

Én magam egy még mindig újnak számító tagállamból érkeztem, és bízom benne, hogy a belső piac megnyílásának kedvező hatásait is élvezhetjük a sok kedvezőtlen mellett. Ezért volt csalódás számomra a tavalyi év, amikor igazi bátorsággal megnyithattuk volna azokat a szolgáltatásokat, amelyek az új tagállamok komparatív előnyét jelentették volna, és ez erősítette volna a belső piaci versenyt. Most újra itt állunk és újra reméljük, hogy nemcsak egy szolgáltatás eddig komplexen nem szabályozott kérdéseit foglaljuk jogszabályba, hanem új szereplők hadba lépésének biztosításával valóban lejjebb tudjuk szorítani a jó minőségű fizetési szolgáltatások árát is.

Kiemelkedően fontos a letelepedés és a szolgáltatás szabadságának tényleges biztosítása. A Bizottság eredeti javaslata bátor volt e tekintetben, hiszen különösebb speciális tőkekövetelmények nélkül tette volna lehetővé az új szolgáltatások belépését, megtörve ezzel a bankok e téren szerzett monopol helyzetét. Ezt Neelie Kroes asszony felmérése is nagyon jól bizonyította. Sajnálattal kellett látnom, hogy az eredeti javaslathoz képest szigorúbb tőkekövetelmények jelennek meg, de remélem, hogy ez nem akadályozza az új szereplők piacra lépését.

A másik fontos szempont az, hogy az átutalások minél gyorsabban eljussanak a címzetthez, akik ezt a lehető leggyorsabban használni tudják. E téren a jelenlegi kompromisszum előrelépés lehet, mert lerövidíti azt a jelentős időt, amíg a bank a mi pénzünket ingyen használhatja.

Örülök annak is, hogy a mikro-vállalkozásokat egyéni fogyasztóként külön figyelemmel kezelik a kompromisszumban. A megállapodást, amely zárt és elitista körülmények között jött létre, megszavazom. A legfontosabb pillanat azonban a nemzeti jogba való átültetéstől számított 3 év múlva, a felülvizsgálat lesz – mint a puding próbája, az evés. Ha a fenti három, általam fontosnak tartott területen pozitív változás történik, és a kiszolgáltatott közép-európai fogyasztók és kisvállalkozók számára olcsóbb lesz a fizetési szolgáltatás, akkor jót tettünk. Ha nem, mert nem léptek piacra új szereplők, akkor majd módosítani kell, és ehhez bátorságra lesz szükség, de az akkor majd legyen is meg bennünk.

  Silvia-Adriana Ţicău (PSE). – Doresc să-l felicit pe domnul Gauzès pentru raport. Directiva privind serviciile financiare în cadrul pieţei comune completează iniţiativa sectorului bancar privind înfiinţarea zonei unice pentru plăţi în euro prin armonizarea legislaţiei din statele membre. Deşi în Uniunea Europeană 96% din plăţi au un caracter naţional şi doar 4% din plăţi se realizează între furnizorii de servicii financiare din state membre diferite, directiva propusă va încuraja competiţia, va reduce costurile, va asigura o mai mare transparenţă privind condiţiile si tarifele aplicabile precum şi o mai bună protecţie a utilizatorilor şi furnizorilor prin definirea drepturilor şi obligaţiilor acestora. Sistemele electronice de plăţi asigură un timp de procesare redus şi facilitează tranzacţiile între furnizorii de servicii financiare din state membre diferite, dar implementarea acestora necesită investiţii importante. Mobilitatea cetăţenilor necesită mijloace electronice de plată. În ultimii ani s-au dezvoltat sisteme electronice de plată şi, în acest context, securitatea plăţilor electronice este crucială pentru încrederea utilizatorilor acestor servicii. Consider că, pentru protecţia consumatorilor şi încrederea acestora în serviciile financiare, este important ca pentru instituţiile plătitoare să existe condiţii de autorizare şi funcţionare foarte clar definite. Felicit încă o dată raportorul.

  Karsten Friedrich Hoppenstedt (PPE-DE). – Herr Präsident! Die nun gelungene Einigung in erster Lesung stellt einen wichtigen Schritt hin zum einheitlichen Euro-Zahlungsraum dar, da nur so die ersten Maßnahmen rechtzeitig Anfang 2008 starten können. Hier gilt mein Dank natürlich dem Berichterstatter Jean-Paul Gauzès sowie der deutschen Ratspräsidentschaft, und auch die Kommission schließe ich hier mit ein. Die europäische Kreditwirtschaft hat auf dieses wichtige politische Signal als Startschuss gewartet. Man sollte ihr an dieser Stelle durchaus einmal für die konstruktive und sehr wirkungsvolle Mitarbeit Dank sagen.

Für die Verbraucher stellen die Regelungen einen Schritt zu einem wirklich einheitlichen Binnenmarkt für Finanzdienstleistungen dar. Meine Vorredner haben das entsprechend gewürdigt.

Bei allem berechtigten Grund zum Jubilieren sollten wir nicht vergessen, dass ein Kompromiss immer Abstriche gegenüber der optimalen Lösung bedeutet. Vor allem kommen auf die Kreditinstitute zum Beispiel aufgrund der Ausführungsfrist von nur einem Bankenarbeitstag, aber auch durch andere strukturelle Maßnahmen erhebliche Kosten zu. Man spricht ja von etwa 23 Milliarden Euro, die bereits für die strukturelle Ausrichtung für den gesamten Bereich SEPA investiert worden sind. Eine Ausführungsfrist von zwei Bankenarbeitstagen ohne Ausnahmeregelung wäre für die europäische Finanzwelt einfacher, transparenter sowie wettbewerbsfreundlicher und auf jeden Fall kostengünstiger gewesen. Doch wir leben nun mit dieser Entscheidung, die wir morgen fällen werden.

Die größere grenzüberschreitende Auswahl an Kreditinstituten ist aus Verbrauchersicht zu begrüßen. Unter dem Aspekt des Verbraucherschutzes muss man jedoch kritisch anmerken, dass nicht alle Anbieter den gleichen aufsichtsrechtlichen Regelungen unterliegen. Dem Grundsatz „gleiche Bedingungen für alle Marktteilnehmer“ wird nicht in jedem Falle entsprochen. Die Leitlinie für unser politisches Handeln sollten immer die Verbraucher sowie ein funktionierender und wettbewerbsfähiger Finanzmarkt sein. Gut funktionierende, kostengünstige sowie akzeptierte nationale Verfahren und Finanzprodukte dürfen deshalb nicht in jedem Fall auf dem Altar der – verhältnismäßig immer geringer werdenden – europäischen Zahlungsverkehrstransaktionen geopfert werden.

  Corien Wortmann-Kool (PPE-DE). – Voorzitter, met de richtlijn waar wij morgen over gaan stemmen, stemmen wij over een alleszins verdedigbaar compromis, met grote dank aan onze collega Gauzès. Terecht begon commissaris McCreevy de doelen nog eens goed uiteen te zetten die we willen bereiken: meer efficiency, meer competitie. In overweging 4 staat met zoveel woorden dat het een flinke stap voorwaarts moet zijn, als het gaat om de kosten en de efficiency voor de consument en het midden- en kleinbedrijf. Maar wat zien we in de praktijk? In Nederland en in andere landen geven banken nu al signalen af dat het door Europese regels duurder wordt voor de consument en het MKB, dat de kosten voor kaartbetalingen omhoog zullen gaan. We zien dat ook al in een aantal landen. Commissaris McCreevy, het project is niet klaar, maar het project is net begonnen. Hoe blijft u betrokken? Hoe gaat u ervoor zorgen dat die doelen ook echt bereikt worden en de consument er ook echt beter van wordt? Wat gaat u samen met collega Kroes de komende jaren ondernemen om dat echt voor elkaar te krijgen?

  Charlie McCreevy, Member of the Commission. Mr President, I have listened carefully to the discussion on the proposal for a directive on payment services in the Internal Market and I would like to thank you all for your comments.

We cannot establish a single market for payments without a harmonised legal framework at EU level instead of the patchwork of 27 sets of different national rules. At the same time we need more competition and innovation in payments markets. This will provide substantial benefits to our citizens, our businesses, our public administrations and our economy as a whole. Quite simply, payments are the lifeblood of our economy and without an efficient payments system we cannot have an efficient single market.

The issue regarding data protection was raised by the following Members: Mr Gauzès, Mrs Bowles and Mrs Berès. I would like to say two things on this issue. Firstly, the Commission has already responded to Parliament’s resolution of 14 February 2007 on the SWIFT case. Article 19 of the proposed directive allows the exchange of information between competent authorities responsible for protecting personal data and the authority responsible for supervising payment institutions. This corresponds to the conclusions of the Article 29 working party opinion of 22 November 2006 on the processing of data by SWIFT.

Secondly, the limitation of data processing to EU countries, as proposed by Amendment 287, would in fact be a contradiction of the data protection directive. That directive has a specific regime for authorising the export of data to third countries if those countries provide the necessary guarantees. This regime aims at ensuring that European data protection standards are not undermined by the export of data to countries with more lenient standards.

The SWIFT case has demonstrated that we must remain vigilant on the protection of personal data. Combating terrorism and terrorist financing are important. So is the protection of privacy, however, which is a fundamental principle for all EU Member States. The Commission will use all means at its disposal to ensure that all Member States respect data protection, including the export of data to third countries. I will bring the points made here to the attention of my colleague, Commissioner Frattini, who is directly responsible for this area.

Tomorrow Parliament has the opportunity to endorse the proposal which reflects the views already expressed in its lead committee’s report, which provides a legal foundation for an efficient and modern payments market. The Commission fully supports a set of compromise amendments aimed at achieving this. I would once again like to thank the rapporteur, Mr Gauzès, and Parliament for your patience in deferring this vote. I stress his conviction that your vote is a historic occasion for payments in Europe.
