  Panayiotis Demetriou, on behalf of the PPE-DE Group. – Madam President, the oral amendment I want to propose is the following: ‘The spouses may agree to designate the law applicable to divorce and legal separation provided that such law is in conformity with the fundamental rights defined in the Treaties and in the Charter of Fundamental Rights of the European Union and the principle of public policy.’

This oral amendment limits the right of the spouses to have the choice of law as provided for in Article 20. I believe that it satisfies the policy of the PPE-DE Group, which wanted to limit the choice of law so as to be in conformity, as we say here, with fundamental rights and also with public policy. So a judge, faced with this application by spouses to apply foreign law, will judge and say that they do not accept that because it is against public policy or fundamental rights.

  Evelyne Gebhardt, Berichterstatterin. − Frau Präsidentin! Ich kann diesen Änderungsantrag annehmen, weil er eine Selbstverständlichkeit wiedergibt. Natürlich muss das anwendbare Recht den Grundsätzen unserer Verträge und der Grundrechtecharta genügen. Mit diesem Antrag habe ich kein Problem.

  La Présidente. - Y a-t-il des oppositions à cet amendement oral?

Je n'en vois pas.

  Carlo Casini (PPE-DE). - Signora Presidente, ovviamente non sono contrario a che i diritti dell'uomo e i diritti fondamentali dell'Unione siano rispettati nella scelta della legge. Ma il problema è un altro. Il problema è se la legge che può essere scelta dai coniugi – faccio presente che la scelta della legge è un fatto eccezionale in tutti gli ordinamenti giuridici – se questa legge deve essere una legge di uno dei 27 Stati dell'Unione o di qualsiasi paese del mondo.

Quindi non sono contrario a questo emendamento ma credo che questo emendamento non possa precludere il voto sugli emendamenti successivi del Partito popolare, i quali stabiliscono che si può scegliere solo una legge di uno dei 27 paesi dell'Unione.

  Bruno Gollnisch (NI). - Madame la Présidente, ce débat prouve à l'évidence que le dossier n'est pas mûr. Ces questions auraient dû être débattues, évidemment, en commission. C'est la raison pour laquelle, en application de notre règlement, j'ai l'honneur de vous demander le renvoi en commission de ce rapport.

Die Vereinbarung zwischen den Fraktionen EVP, PSE, Grüne und Liberale war Folgende: Wenn wir diesen mündlichen Änderungsantrag der EVP akzeptieren, werden alle EVP-Änderungsanträge zurückgezogen werden. Ich erwarte von der EVP, dass sie diese jetzt auch zurückzieht.

  Παναγιώτης Δημητρίου, εξ ονόματος της ομάδας PPE-DE. – Κυρία Πρόεδρε, είναι γεγονός ότι αυτός ο συμβιβασμός περιείχε και αυτόν τον όρο. Ο κύριος Casini έχει μίαν άλλην άποψη. Πιστεύω ότι οι τροπολογίες του Ευρωπαϊκού Λαϊκού Κόμματος καλύπτονται από αυτή την προφορική τροπολογία που έχω αναφέρει και έχει εγκριθεί, και δεν χρειάζεται να γίνει ψηφοφορία πάνω σ' αυτές τις τροπολογίες που κατατέθηκαν ακριβώς για να στηρίξουν το αίτημα του περιορισμού του δικαιώματος.

Donc on continue, il y a eu une expression au nom des groupes.

  Cristiana Muscardini (UEN). - Madame la Présidente, on doit quelquefois prendre des lunettes pour voir s'il y a un parlementaire qui demande, en termes de règlement, de parler avec la présidence.

Alors, comme vous savez, un autre groupe peut prendre les amendements qu'un groupe a rejetés. Pour les mots qu'a dits M. Casini, nous ne sommes pas tranquilles, on va voter sur cet amendement que le groupe UEN reprend à son compte.

  La Présidente. - Madame Muscardini, on venait de dire que les amendements étaient caducs. À partir du moment où ils sont caducs, je ne peux pas les mettre aux voix.
