  Presidente. − L'ordine del giorno reca la relazione di Philip Bushill-Matthews, a nome della commissione per l'occupazione e gli affari sociali, sulla proposta di direttiva del Parlamento europeo e del Consiglio riguardante l'istituzione di un comitato aziendale europeo o di una procedura per l'informazione e la consultazione dei lavoratori nelle imprese e nei gruppi di imprese di dimensioni comunitarie (rifusione) (COM(2008)0419 - C6-0258/2008 - 2008/0141(COD)) (A6-0454/2008).

  Philip Bushill-Matthews, rapporteur. − Mr President, I suspect that this dossier will be slightly less controversial than the earlier one, and certainly there is a shorter list of speakers. But we shall see. Life is full of surprises.

May I start by thanking the Commission and indeed the Council for getting us to where we are today. Unlike the previous dossier, this is a first reading, but we provisionally have informal agreement in trialogue, which will mean that there is first-reading agreement, assuming colleagues support it in the vote tomorrow. Colleagues may differ as to whether the trialogue text is an improvement on the original report, but at least there is a trialogue agreement and history will be the best judge of that. I look forward to hearing any comments colleagues may have and I will sum up at the end.

  Vladimír Špidla, člen Komise. − Vážený pane předsedo, vážené poslankyně, vážení poslanci, evropské rady zaměstnanců jsou průkopníky sociální Evropy. Oživují sociální dialog mezi vedením a pracovníky ve více než 820 podnicích. Umožňují, aby téměř 15 milionů pracovníků dostávalo informace a aby se s nimi konzultovalo, a to nejen na místní, ale rovněž na evropské, a dokonce i na světové úrovni. Umožňují lépe propojit hospodářské a sociální aspekty v podnicích s celoevropskou působností. Můžeme být pyšní na to, čeho bylo od přijetí směrnice před patnácti lety dosaženo. Tato stará směrnice však již není dostačující a my máme nyní oprávněně vyšší nároky.

Komise proto v červenci navrhla důkladně obnovit právní rámec pro evropské rady zaměstnanců. Cílem je zvýšit jejich počet a účinnost, posílit právní jistotu a lépe sladit konzultaci na vnitrostátní a evropské úrovni, zejména pokud jde o restrukturalizace. Komise proto navrhla upřesnit pojmy „informování pracovníků“ a „konzultace s pracovníky“ a vyjasnit sladění těchto činností na různých úrovních. Navrhla rovněž, aby byla uznána role sociálních partnerů při zřizování nových evropských rad zaměstnanců a aby byla umožněna kontinuita a přizpůsobení již existujících podnikvých rad. Navrhla, aby byly upřesněny možnosti koordinace a konzultací rad, které byly zřízeny automaticky. V neposlední řadě navrhla, aby byla upřesněna úloha členů evropských rad zaměstnanců, zejména pokud jde o předávání informací pracovníkům a jejich možností využívat školení.

Na výzvu francouzského předsednictví vypracovali evropští sociální partneři, zaměstnavatelé a odborové organizace letos v létě společné stanovisko, v němž přijímají návrh Komise jako základ pro diskusi. Přišli s několika změnami tohoto návrhu, jejichž cílem je zejména upřesnění definic „informování“ a „konzultací“ a stanovení dvouletého období, během něhož bude možné zřizovat nové evropské rady zaměstnanců nebo je obnovovat, aniž by se musela použít nová pravidla.

Komise vždy podporovala jednání mezi sociálními partnery, a proto tuto iniciativu uvítala. Komise vítá konstruktivní přístup Parlamentu a Rady, díky němuž dospěly ke spolehlivému a vyrovnanému řešení na základě souboru vytvořeného návrhem Komise a společným stanoviskem sociálních partnerů. Při hledání řešení Komise s oběma zmíněnými orgány aktivně spolupracovala. Kompromis, k němuž došel Parlament a Rada, upřesňuje nadnárodní kompetenci evropských rad a sankce a nezavádí minimální počet zastoupených pracovníků. Tento kompromis zachovává to podstatné z návrhu Komise. Proto Komise může tento kompromis podpořit.

  Valérie Létard, présidente en exercice du Conseil. − Monsieur le Président, Monsieur le Commissaire, Monsieur le rapporteur, Mesdames, Messieurs les députés, nous sommes maintenant réunis pour débattre d'une proposition de directive qui concerne directement 880 entreprises européennes et quinze millions de salariés européens. L'enjeu est donc majeur et nous devons tous aborder ce débat en mesurant bien quelles sont nos responsabilités. Comme vous le savez, la proposition de directive dont nous discutons ce soir procède à la refonte de la directive de 1994 sur le comité d'entreprise européen.

Le texte qui est présenté au Parlement européen est le fruit d'un travail collectif, qui a impliqué tous les acteurs compétents sur le plan européen. Je pense bien sûr à la Commission, qui a présenté dès le 2 juillet 2008 une proposition de refonte; je pense aussi aux partenaires sociaux européens qui, dès l'été 2008, ont présenté huit propositions communes dans le cadre d'un avis paritaire conjoint; je pense bien sûr au Parlement européen et au rapporteur qu'il a désigné sur ce texte, M. Philip Bushill-Matthews, que je remercie pour la qualité de son travail. Tous ont travaillé avec la Présidence du Conseil pour arriver rapidement à un texte acceptable par tous. Le résultat de ces efforts collectifs, c'est que nous sommes, ce soir, en situation de procéder à l'adoption, en première lecture, de la proposition procédant à la refonte de cette directive de 1994.

À ma connaissance, il y a longtemps que, dans le domaine social, une telle situation ne s'était pas produite. C'est un encouragement pour l'avenir, pour continuer à travailler ensemble dans un esprit collectif. Le texte qui vous est présenté ce soir est un compromis équilibré, qui permettra de renforcer le dialogue social au sein des entreprises européennes et de donner de nouvelles garanties aux travailleurs des vingt-sept États membres.

Avec ce texte, nous renforçons les prérogatives des comités d'entreprise européens, en adoptant notamment une nouvelle définition de la consultation et de l'information qui était attendue depuis longtemps.

Avec ce texte, nous encourageons la mise en place de nouveaux comités d'entreprise européens puisque nous ouvrons, comme cela avait été fait en 1994, une fenêtre d'opportunité de deux ans durant laquelle les accords conclus pourront déroger aux nouvelles dispositions de la directive.

Avec ce texte, enfin, nous améliorons la sécurité juridique des travailleurs et des entreprises, en levant des incertitudes qui pouvaient avoir des conséquences graves.

C'est aussi dans cet objectif de sécurité juridique que le texte qui vous est présenté procède à la sécurisation des accords conclus durant la précédente période d'opportunité ouverte entre 1994 et 1996, après l'entrée en vigueur de la directive actuelle.

Aujourd'hui, le compromis auquel ont œuvré tous les acteurs concernés est soumis au vote du Parlement européen et il est important que ce vote soit positif. C'est important car le contexte actuel de crise expose les entreprises à un risque accru de restructuration et, dans cette situation, les salariés européens attendent que nous leur apportions des garanties supplémentaires, des garanties qui les rassureront sur leur avenir.

Il est également important que ce vote soit positif car les citoyens européens ont besoin de signaux forts qui montrent que l'Europe sociale redémarre en cette année 2008 et qu'elle n'est pas un objet de discours, qu'elle est capable de réalisations concrètes qui leur apportent des plus dans leur vie quotidienne.

Il est important que ce vote soit positif, enfin, car le dialogue social doit être encouragé en Europe et cela passe par la mise en place de nouveaux comités d'entreprise et la valorisation des démarches conjointes engagées par tous les partenaires sociaux européens, comme cela a été le cas dans ce dossier.

  Jan Cremers, on behalf of the PSE Group. – Mr President, there is a saying that compromises will never win beauty contests. At first sight, this could be said with regard to the outcome of all the negotiations on the recasting of the European Works Council Directive. Based on the Menrad report, adopted in this House six years ago, on the jurisprudence and on the experiences of management and labour in the last 12 years, the PSE Group has always asked for an ambitious revision of the Directive.

Too many workers’ representatives are still deprived of the basic information and consultation rights as their employer refuses to grant them these rights. In our view, however, these rights are an integral part of the modelling of all industrial relations. The position of the worker as the stable stakeholder who stays in the company – compared to the job-hopping of management and the uncommitted attitude of the new type of financial investor – has to be reflected in the corporate governance of our companies. With the advice of the social partners incorporated in the directive and the additional modifications reached during our negotiations, the PSE hopes to deliver some building blocks for a new dynamic.

The formal political procedure is almost finalised. It is now up to management and labour to act. Compliance with the directive, currently some 40%, is still much too low. The PSE is of the opinion that this is not the end of the story; it is a new beginning. The European social partners have the enormous challenge of convincing those companies that still refuse to comply with the directive.

We urge the European Commission to contribute to this task. A new campaign is needed. Recent research has demonstrated that companies with adequate information, consultation and participation of workers function better, especially in hard times. The economic crisis and the restructurings that we have to face in the near future make workers’ involvement in the decision-making process of our companies more topical than ever.

I would like to thank my opponent, Mr Bushill-Matthews, for the professional chairing of the negotiations, my colleagues from the other groups for their political assistance and the French presidency for their sophisticated approach. Let us go to work.

  Bernard Lehideux, au nom du groupe ALDE. – Madame la Présidente du Conseil en exercice, Monsieur le Commissaire, Monsieur le Président, l'accord trouvé avec le Conseil sur les comités d'entreprise prouve que l'Europe sociale, tellement nécessaire, se construit brique par brique. Il prouve également que dans cette Europe sociale en construction, le dialogue social a trouvé ses marques.

En effet, chacun sait que ce texte résulte, avant tout, d'un travail fructueux entre les syndicats de salariés et les organisations d'employeurs. L'actuelle directive avait manifestement atteint ses limites puisque, 14 ans après son adoption, des comités avaient été créés dans seulement un tiers des entreprises concernées et des incertitudes juridiques conduisaient la Cour de justice à intervenir à plusieurs reprises. Ce n'est pourtant pas aux juges de fixer les règles, mais bien aux politiques de prendre leurs responsabilités. En outre, l'actualité nous rappelle cruellement que la consultation des comités d'entreprise est de plus en plus vitale, le plus en amont possible en cas de restructuration.

C'est pourquoi, nous devons avancer et soutenir l'accord, en première lecture, après avoir remercié le rapporteur pour la qualité de son travail et de son écoute.

  Elisabeth Schroedter, im Namen der Verts/ALE-Fraktion. – Herr Präsident, sehr geehrter Herr Kommissar, sehr geehrte Frau Ratspräsidentin! Als die Unternehmensleitung von Nokia in Finnland beschlossen hatte, das Nokia-Werk in Bochum zu schließen und nach Rumänien zu verlegen, haben die betroffenen Arbeitnehmerinnen und Arbeitnehmer – 2 000 sind entlassen worden – das aus der Zeitung erfahren.

Um solch eine Situation nicht wieder entstehen zu lassen, ist es dringend notwendig – und ich betone hier: dringend –, die geänderte Richtlinie für die europäischen Betriebsräte in Kraft zu setzen, und zwar mit der neuen Definition für transnationale Unternehmen. Es ist sehr traurig, dass die Kommission damit so viele Jahre gewartet hat und diesen Kompromiss bis zuletzt boykottiert hat.

Es zeigt sich wieder einmal, dass das soziale Europa bei der Kommission ganz hinten ansteht. Wenn es die Änderungen eher gegeben hätte, hätte es nämlich so einen Fall wie Nokia nicht gegeben.

Diese Änderungen sind dringend notwendige Änderungen, die Versäumtes nachholen und eigentlich überfällig sind, wenn man die neuen Unternehmensstrukturen über die nationalen Grenzen hinweg und das Agieren der Unternehmen betrachtet. Meine Freude über den Kompromiss ist verhalten. Trotzdem stehe ich als Teil der Verhandlungskommission des Parlaments für diesen Kompromiss, denn wir brauchen diese Richtlinie jetzt.

Ich appelliere noch einmal an alle, die jetzt versuchen, diesen Kompromiss wieder aufzuknüpfen. Das ist ein Spiel mit dem Feuer. Das würde bedeuten, dass wir ewig verhandeln und dass sich so ein Fall wie Nokia dann doch wiederholen würde. Deswegen ist es notwendig, diesen minimalen Anspruch an Demokratie, den wir jetzt in der Richtlinie haben, wirklich in Kraft zu setzen.

Politisch bleibt auf der Tagesordnung, dass die Revision noch kommen muss. Ich sage der Kommission noch einmal, das hier ist eine Anpassung. Die Revision steht noch auf der Tagesordnung, und wir stehen dafür, dass wir eine ordentliche Revision brauchen, die dann als solche den Betriebsräten wirklich das gibt, was sie für ihre langfristige Arbeit brauchen. Jetzt ist es nur eine Anpassung.

  Δημήτριος Παπαδημούλης, εξ ονόματος της ομάδας GUE/NGL. – Κύριε Πρόεδρε, εμείς δεν συμμεριζόμαστε ως Ομάδα της Αριστεράς το κλίμα των πανηγυρισμών, γιατί ξέρουμε πολύ καλά ότι η κοινωνική Ευρώπη είναι έξω από τις προτεραιότητες και της Επιτροπής και του Συμβουλίου. Κύριοι συνάδελφοι του Ευρωπαϊκού Κοινοβουλίου, ο κοινός συμβιβασμός της BUSINESSEUROPE με τα συνδικάτα είναι πίσω από αυτά που ζητούσε το Ευρωπαϊκό Κοινοβούλιο το 2001. Eπίσης, η διαδικασία της αναδιατύπωσης περιορίζει το ρόλο του Κοινοβουλίου. Εμείς θα καταθέσουμε τροπολογίες οι οποίες στηρίζουν και προβάλλουν τα αιτήματα που στη διαπραγμάτευση προέβαλαν τα εργατικά συνδικάτα, και πιο συγκεκριμένα καλύτερη, έγκαιρη και ουσιαστική πληροφόρηση, δημοσιότητα και διαφάνεια στις συμφωνίες καθώς και ενισχυμένη συμμετοχή των εμπειρογνωμόνων των συνδικαλιστικών οργανώσεων. Δυστυχώς χάνουμε μια ευκαιρία για μια ουσιαστική βελτίωση της οδηγίας και με τη θεωρεία της Realpolitik αποδεχόμαστε πολύ λιγότερα από αυτά που χρειάζονται οι εργαζόμενοι.

  Jean Louis Cottigny (PSE). - Madame la Présidente en exercice, Monsieur le Président, Monsieur le Commissaire, je tenais, en premier lieu, à féliciter M. Bushill-Matthews qui nous a donné une grande leçon de démocratie en étant porteur du message de la commission "Emploi" lors du trilogue. Aujourd'hui, le trilogue a eu lieu. Les partenaires ont tenté de se mettre d'accord.

Et je voudrais aussi vous féliciter, Monsieur le Commissaire, parce que, à un moment donné, vous avez réussi à faire en sorte que le rôle du colégislateur que le Parlement est, soit un peu dénié, puisque par un accord qui a eu lieu entre les partenaires sociaux, vous nous avez mis dans l'obligation d'estimer que seuls les points évoqués par eux pouvaient être discutés entre nous.

Aujourd'hui, ce qui est important, c'est de réussir ce trilogue. Ce trilogue a eu lieu et nous sommes aujourd'hui dans une situation où nous pouvons faire en sorte que ce texte soit adopté en première lecture. Mais cela ne doit pas pour autant retirer la révision, et cela ne doit pas pour autant nous empêcher d'imaginer par la suite comment nous pouvons arriver à une révision complète, soutenue par les partenaires sociaux ou presque tous ces partenaires sociaux.

Je crois que c'est dans cet esprit qu'il faut agir. Bien sûr, demain, en première lecture, nous devons avoir gain de cause, mais il est évident aussi que nous devons regarder comment tout cela est mis en application et comment nous pourrons à faire en sorte qu'une révision puisse avoir lieu.

  Siiri Oviir (ALDE). - Lugupeetud nõukogu esindaja, volinik, head kolleegid. Kõigepealt tahan tänada raportööri konstruktiivse lähenemise eest direktiivi läbivaatamisel.

Arutatava direktiivi uuesti sõnastamine kergitas ka teatud juriidilisi küsitavusi meie tegutsemisvõimalustes. Tundub, et raportööri abil on need küsimused tänaseks leidnud lahenduse.

Samas on Euroopa töönõukogu direktiivi läbivaatamine olnud nii ettevõtjate kui ametiühingu jaoks oluliseks küsimuseks juba pikka aega. On tunnustamist väärt, et käesoleval suvel saavutasid tööturu osapooled kokkuleppe. Kindlasti aitab see kokkulepe ka meil, parlamendil, teema käsitlemine positiivselt lõpule viia.

Seadmata kahtluse alla ümbersõnastamise vajadust antud ajal ja antud olukorras, pean siiski vajalikuks direktiivi uuendatud ja kaasajastatud variandi menetlemist tulevikus, see tähendab veel Euroopa Parlamendi järgmise koosseisu volituste ajal.

Kuid täna, väikeriigi esindajana, ei saa ma nõustuda komisjoni ettepanekuga, milline seab erikomisjoni loomisel selle liikmelisuse sõltuvusse kontserni töötajate arvust. Selline nõue võib kaasa tuua olukorra, kus mõni liikmesriik jääb läbirääkimistel oma huvide esindajateta.

  Proinsias De Rossa (PSE). - Mr President, I welcome the first-reading agreement on the recasting of the European Works Council, which was due in no small way to the skill of our shadow rapporteur, Mr Cremers. We are in a deepening economic crisis, which is a crisis of the system and not just in the system.

‘Business as usual’ is not possible, and both employers and governments must accept that, in this time of crisis, workers must have a greater say in what is happening at their workplace. Any other approach will not be acceptable.

Blind faith in untrammelled markets and competition has failed abysmally, and now is the time for Europe to be more courageous in creating a new social contract between workers and businesses, and indeed for Member States and Europe to build a new social market economy, as provided for in the Lisbon Treaty.

  Harald Ettl (PSE). - Herr Präsident! Seit 1999 steht eine Revision der Europäischen Betriebsratsrichtlinie an. Daraus geworden ist ein Recast-Verfahren – zu wenig für eine sich rasch verändernde Industrielandschaft! Dazu gehört natürlich eine verbesserte Information und Konsultation als Instrument einer konfliktreduzierenden Unternehmenskultur. Das ist wesentlich. Transnationale Entscheidungen gehören in das Beratungsgremium des Europäischen Betriebsrats. Die an sich zahnlose Richtlinie muss in ihrer Umsetzung rechtlich gestärkt werden. Das muss auch mit Sanktionen verbunden werden, um die Umsetzungsmöglichkeit der Richtlinie zu gewährleisten. Das muss geschehen, damit EuGH-Urteile nicht mehr nur ignoriert werden.

Trotz kleiner Fortschritte wird spätestens nach drei Jahren eine Revision fällig sein. Auch das hätten wir noch festschreiben können und sollen, um diesen industriepolitischen Realitäten, diesem raschen Wandel einigermaßen zu entsprechen. Aber – und das ist das Wichtigste an der Sache – immerhin geschieht etwas!

  Silvia-Adriana Ţicău (PSE). - Comitetul european de întreprindere şi procedura de informare şi consultare a lucrătorilor din întreprinderi sau grupuri de întreprinderi sunt instrumente indispensabile pentru protecţia angajaţilor.

Comitetele de întreprindere trebuie să fie foarte active, mai ales în situaţiile de restructurare a întreprinderilor. În cazul companiilor multinaţionale sau al grupurilor de întreprinderi este esenţial ca şi angajaţii întreprinderii din statul membru în care au loc concedieri să fie consultaţi şi să stea la masa de negocieri. În situaţia în care un grup de întreprinderi ia decizii importante privind viitorul întreprinderii şi al angajaţilor acesteia, salariaţii întreprinderii din statul membru în care au loc restructurări trebuie să fie informaţi şi să poată participa şi influenţa decizia luată.

Până acum, Comunitatea Europeană asista financiar doar întreprinderile în situaţii de restructurare. Consider că această asistenţă trebuie acordată şi angajaţilor concediaţi.

  Stephen Hughes (PSE). - Mr President, first of all, many thanks to the rapporteur. Though the amendments voted through committee were not what he wanted – in fact he wanted no amendments – he nevertheless defended the committee position in the negotiations which led to this first-reading agreement.

Many thanks also to Mr Cremers, our shadow rapporteur, who was the real architect of the content of the agreement. The three additions to the points agreed by the social partners in their advice note – on sanctions, on transnationality and the removal of the threshold for the special negotiating body – are important in themselves, but many of us, as has been said, still feel cheated by this recasting.

We were promised a full revision of the directive almost 10 years ago. Other serious deficiencies need to be addressed, and we insist that the Commission should bring forward that full revision during the next mandate.

Another serious concern about the handling of this recasting was the crossover between the social dialogue and legislative tracks. The social partners were consulted in accordance with Article 139 and eventually signalled their inability or unwillingness to negotiate a framework agreement. But just as we began our legislative work, they did signal that they would like to open negotiations. They then agreed an advice note, which has no standing at all in the Treaties, but that gave our rapporteur, Mr Bushill-Matthews, the opportunity to pretend to be conciliatory by accepting the content of the note, but nothing more.

Rather than acting as a spur to our work, that advice note almost became a straitjacket. The Article 139 and 138 procedures need to be kept clearly separated. It is wrong if either undermines or constrains the other, and it is the job of the Commission to ensure that separation. Even as we speak, a similar crossover is being allowed to derail a legislative amendment we have been calling for to address the problem of needle-stick injuries.

I repeat, this is dangerous and can only lead to resentment and distrust between the social partners and Parliament. Nevertheless, this is a step forward in terms of information and consultation rights for workers, and I welcome it.

  Ewa Tomaszewska (UEN). - Panie Przewodniczący! Dyrektywa wprowadzająca europejskie rady zakładowe w momencie swego uchwalenia była istotnym krokiem naprzód w kreowaniu dialogu społecznego w gospodarce. Ułatwiała też wzrost produktywności przy zachowaniu pokoju społecznego.

Dziś, po kilkunastu latach doświadczeń, partnerzy społeczni widzą potrzebę jej zmian i uściśleń. Rola członków rad zakładowych w procesie informowania załóg i konsultacji z nimi wymaga doprecyzowania. Szczególnie w okresie kryzysu porozumiewanie się partnerów społecznych, negocjacje w dobrej wierze oparte o rzetelne informacje mają wielką wartość. Waga dialogu społecznego, znajdowanie rozwiązań poprzez debatę i negocjacje, dostrzeganie dobra i interesów drugiej strony wskazują na potrzebę uszanowania rezultatów tego dialogu i zaakceptowania porozumienia między organizacjami pracodawców i związkami zawodowymi na poziomie europejskim.

Gratuluję sprawozdawcy i oczekuję dokonania w przyszłych latach przeglądu efektów działania tej dyrektywy.

  Ilda Figueiredo (GUE/NGL). - Lamento que se desperdice este momento para avançar numa melhoria mais profunda e significativa desta directiva sobre o Conselho de Empresa Europeu, como, aliás, já se previa em 2001 quando se aprovou o relatório Menrad em que eu própria participei. Por isso insistimos na apresentação e votação de algumas propostas de alteração que visam o reforço do direito de informação e consulta dos representantes dos trabalhadores em todos os casos, incluindo também o direito de veto, sobretudo quando há reestruturações e tentativas de deslocalização de empresas, designadamente transnacionais, quando os direitos dos trabalhadores não são respeitados.

É bom que estas propostas possam aqui ser aprovadas para assim haver, de facto, um reforço da directiva do Comité Europeu de Empresa.

  Karin Jöns (PSE). - Herr Präsident! Auch ich und meine Fraktion hätten sich mehr gewünscht als das, was jetzt herausgekommen ist. Aber ich denke trotzdem, wir haben viel erreicht und die Mitbestimmung auf europäischer Ebene doch ein Stück vorangebracht. Eines ist nämlich klar: In Zukunft müssen die europäischen Betriebsräte vor einer Entscheidung – und das ist das Wichtige – vor einer Entscheidung über Umstrukturierungen unterrichtet und konsultiert werden, und sie werden in Zukunft dies nicht mehr aus der Zeitung erfahren.

Aber eines möchte ich ganz klar in Richtung Kommission sagen: Es darf nicht passieren, dass noch einmal ein solches Chaos entsteht, wie wir es gehabt haben, als es darum ging, wer hier eigentlich verhandelt. Es muss eine saubere Trennung zwischen dem sozialen Dialog und dem Europäischen Parlament geben. Wir haben manchmal das Gefühl gehabt, dass hier die Rechte dieses Hauses ausgehebelt werden sollten. Das darf in Zukunft nicht wieder passieren!

  Valérie Létard, présidente en exercice du Conseil. − Monsieur le Président, Mesdames et Messieurs les députés, la refonte de la directive sur le comité d'entreprise européen est une bonne nouvelle.

Elle montre que l'Europe sociale avance, que des progrès sont possibles pour améliorer les droits à l'information et à la consultation des travailleurs européens. Elle montre aussi la valeur de l'implication des partenaires sociaux. Sans elle, nous ne serions sans doute pas parvenus à un tel résultat. Elle montre, enfin, la qualité du travail et de la coopération entre les trois institutions: Commission, Parlement, Conseil, puisque, si le Parlement le décide demain, nous serons parvenus à un accord en première lecture et nous ne pourrons que nous en féliciter.

  Vladimír Špidla, člen Komise. − Pokrok je obtížný, ale je možný. Myslím si, že historie tohoto návrhu směrnice o podnikové radě je toho důkazem. Nebyla to lehká cesta a chtěl bych zvláště zdůraznit úlohu sociálních partnerů a úlohu pana zpravodaje Bushilla Matthewse stejně tak jako jeho sociálně demokratického kolegy pana Cremerse. Myslím si, že debata jasně ukázala, že předloha je zralá ke hlasování, a myslím si také, že to je opravdu dobrá zpráva pro sociální Evropu.

  Philip Bushill-Matthews, rapporteur. − Mr President, as colleagues know, I am a great believer in social dialogue and works councils, and I am pleased that there has been an agreement at first reading, so that legal certainty can prevail for all the social partners.

My view is that we would have achieved a first-reading agreement even if we had not gone through this particular process. Since Stephen Hughes has chosen to give a rather distorted version of how this was achieved, I would just like to set the record straight so that posterity will show how we got to where we have. The social partners most certainly asked all of us not to table any amendments, and the trade unions certainly confirmed to me that, as far as they were concerned, the other groups would absolutely respect that. What I did not expect, and what I did not know, was that, whilst they were urging our group not to table any amendments, they were actually urging the Socialists to table amendments. We therefore had a very distorted balance in committee. Had we come to Parliament first, and had all colleagues had the chance to debate the matter, I still think we would have had agreement, but it would have been slightly different.

Having said that, let me put colleagues’ minds at rest: I do not propose to unpick the agreement that we have. It is important that there is an agreement and I am confident that it will be adopted tomorrow. However, it is a supreme irony that, on an issue concerning mutual trust between employee and employer, and harmony and cooperation between both sides of industry, one of the social partners should approach the matter in a very different way.

I hope that this will be an isolated episode, because social dialogue needs to proceed with trust on both sides. However, on this occasion there has been a backward step in that regard, and one which I hope will never ever happen again.
