  Štefan Füle, Member of the Commission. − Mr President, the College will review, in the light of this vote, the possible options, including a withdrawal of the proposal. We will ask Member States immediately how they apply the working time rules to self-employed drivers and how they monitor compliance with these rules.

  Pervenche Berès (S&D). - Monsieur le Président, je crois comprendre de l'intervention du commissaire que la Commission va retirer sa proposition que nous avons rejetée. Si tel est le cas, elle n'a plus besoin d'être renvoyée en commission de l'emploi.

  Presidente. − Ho colto nelle parole del Commissario una possibilità di considerazione dei questa eventualità. Se così è, è ovvio che Lei ha ragione on. Berès. Se il Commissario conferma la volontà del ritiro, è chiaro che l'Ufficio di presidenza, che io in questo momento rappresento, non manderà il dossier alla commissione competente. È così signor Commissario?

  Štefan Füle, Member of the Commission. − Mr President, I indeed said that the College will review possible options, including a withdrawal of the proposal.

  Pervenche Berès (S&D). - Monsieur le Président, dans ces conditions et compte tenu du degré d'incertitude confirmé dans la réponse du commissaire, je demande, au titre de l'article 56, paragraphe 3, que cette plénière se prononce sur la proposition législative qui, dorénavant, rejette la proposition de la Commission et je demande à mes collègues de confirmer leur vote en votant pour la proposition législative ainsi modifiée.

  Edit Bauer, előadó. − Sajnos azt kell, hogy mondjam, hogy a lehetőségek között ott van az is, hogy 25 tagállam ellen indul holnap infringement eljárás. Azt szeretném kérni, hogy a nevemet vegyék le a jelentésről, mert ehhez én nem kívánok hozzájárulni.

  Presidente. − C'è però una proposta della presidente Berès. Chiedo che un oratore parli a favore e uno parli contro. Chi si esprime contro la proposta dell'on. Berès di porre in votazione il rigetto della proposta legislativa? Nessuno? Chi si esprime a favore?

Ai sensi del regolamento non vi è un problema di inammissibilità della richiesta dell'on. Berès, per cui possiamo porre in votazione la proposta.

  Giles Chichester (ECR). - Mr President, on a previous occasion when this House voted to reject a proposal from the Commission – in that case a directive concerning oil reserves – it was referred back to the relevant committee because the Commission did not emphatically confirm that it was going to withdraw the proposal. The Commissioner has chosen his words very carefully. I disagree with Ms Berès’s interpretation. It should go back to the committee until we know whether the Commission will withdraw its proposal or not.

  Emilie Turunen (Verts/ALE). - Mr President, I would like to speak in favour of proceeding with our votes today. Just to quote Rule 56(3): ‘If the Commission does not withdraw its proposal, Parliament shall refer the matter back to the committee responsible without voting on the draft legislative resolution, unless Parliament, on a proposal of the Chair or rapporteur of the committee responsible or of a political group or at least 40 Members, proceeds to vote on the draft legislative resolution.’

It is very clear. We have asked to proceed. Of course we should proceed.

  Hannes Swoboda (S&D). - Herr Präsident! Diese ganze Abstimmung hätte anders verlaufen können, wenn sich die Frau Berichterstatterin an das Ausschussergebnis gehalten hätte. Ich bitte, das in Zukunft zu tun!
