  President. − The next item is the report by Carlos José Iturgaiz Angulo, on behalf of the Committee on Petitions, on the deliberations of the Committee on Petitions during the year 2009 (2009/2139(INI)) (A7-0186/2010).

  Carlos José Iturgaiz Angulo, Ponente. − Señor Presidente, hoy me complace venir aquí a presentar a sus Señorías, como hacemos cada año, el informe anual de la actividad de la Comisión de Peticiones del año 2009.

La actividad de la Comisión de Peticiones durante este año estuvo marcada por el paso de la sexta a la séptima legislatura, como ustedes saben, lo que supuso un importante cambio en la composición de la comisión, puesto que dos tercios de sus miembros forman parte de la misma por primera vez.

El informe pretende ofrecer una visión clara de la actividad de la Comisión de Peticiones durante el año y, en última instancia, una explicación más precisa de lo que significa presentar una petición ante el Parlamento Europeo, así como del posible resultado del proceso, de sus logros y limitaciones también. Además, este informe examina los progresos efectuados en la aplicación de anteriores recomendaciones que tenían por objeto mejorar la labor de la comisión y hace hincapié en los principales desafíos futuros a la luz de la entrada en vigor del Tratado de Lisboa.

El Tratado de Lisboa, que entró en vigor el 1 de diciembre de 2009, aparte de confirmar el derecho de petición al Parlamento Europeo como uno de los pilares de la ciudadanía europea, ha establecido también las bases necesarias para aumentar la participación de los ciudadanos en el proceso de toma de decisiones de la Unión Europea, ofreciéndoles a los ciudadanos la oportunidad de sugerir mejoras o adiciones en la legislación de la Unión. En este sentido, la Comisión de Peticiones se congratula por el hecho de poder cooperar, según el artículo 50 del Reglamento del Parlamento, con la Comisión de Asuntos Constitucionales en la redacción del informe sobre la Iniciativa Ciudadana Europea, que debería estar concluido a finales de este año. Además, y siguiendo en el mismo contexto del Tratado de Lisboa, la Comisión de Peticiones del Parlamento Europeo debería establecer relaciones de trabajo más estrechas con las comisiones homólogas de los Parlamentos regionales y nacionales de los Estados miembros, con objeto de promover la comprensión mutua de las peticiones relativas a temas europeos y de garantizar una pronta respuesta a los ciudadanos al nivel más adecuado.

Me gustaría también llamar la atención de sus Señorías sobre el carácter jurídicamente vinculante que la Carta de los Derechos Fundamentales ha adquirido con la entrada en vigor del Tratado de Lisboa, así como subrayar la importancia de la Carta a la hora de reforzar la comprensión y el conocimiento de los derechos fundamentales por parte de todos los ciudadanos. Confío en que se tomarán todas las medidas procedimentales necesarias para garantizar una rápida identificación de los aspectos institucionales de la adhesión de la Unión Europea al Convenio Europeo para la Protección de los Derechos Humanos y de las Libertades Fundamentales. Este extremo es de suma importancia, si tenemos en cuenta el problema al que, día a día, se enfrenta la Comisión de Peticiones en relación con la violación de los derechos de propiedad en determinados Estados miembros, sabiendo que ni la Comisión ni el Parlamento están en posición de emprender ninguna acción legal.

Quiero destacar también las excelentes relaciones que este Parlamento Europeo tiene con el Defensor del Pueblo Europeo. Valoramos especialmente los esfuerzos desplegados por la Oficina del Defensor del Pueblo para aumentar el conocimiento público de su trabajo, así como para identificar y resolver los casos de mala administración de las instituciones europeas. En este sentido, apoyamos la idea del Defensor del Pueblo de establecer un código administrativo de conducta para la administración de la Unión Europea.

Pedimos que se desarrolle un sistema en Internet que indique claramente los diferentes mecanismos de reclamación de que disponen los ciudadanos y qué medios son los más adecuados para sus intereses. Para ello, sería necesario crear una ventanilla única de información en línea.

Pero no todo iban a ser cosas positivas. Me gustaría aprovechar esta intervención para protestar por la práctica constante, desde el año 2007, de la DG de Presidencia y la DG de Comunicación, consistente en registrar como peticiones lo que, de acuerdo con el artículo 201, apartado 1, del Reglamento del Parlamento, no lo es. Estoy hablando de las llamadas «no peticiones». Su tratamiento supone una pérdida innecesaria de tiempo, aparte del coste de personal dedicado a ello. Para que se den cuenta de la importancia de este punto, solo les daré un dato: estas llamadas «no peticiones» alcanzan el 25 % de las peticiones registradas. Esta práctica de mala administración perjudica los derechos de los ciudadanos de la Unión Europea.

Por último, pero no por ello menos importante, quiero expresar la necesidad de aprobar un código de conducta para el tratamiento interno de las peticiones. Por ello, animo desde aquí a la secretaría y a los representantes de los grupos políticos a que trabajen en la elaboración de una guía revisada dirigida a los diputados, relativa a las normas y los procedimientos internos de la Comisión de Peticiones.

Para concluir, mis últimas palabras son —como no puede ser de otra manera, señor Presidente— para agradecer a la secretaría de la comisión las facilidades y el apoyo que nos ha dado para la elaboración de este informe.

  Maroš Šefčovič, Vice-President of the Commission. − Mr President, firstly I would like to thank Mr Iturgaiz for his excellent report and for the very important work that has obviously gone into preparing it. I must say that, in the quality of his report, he went even further than his predecessor on this file, Ms McGuinness, who also succeeded in producing a very important and very informative report.

After studying this report, the Commission found many very important details and many suggestions concerning our better work and cooperation in the future. It is very clear that we have to recognise the growing importance of petitions. We can see that the number and range of issues covered by petitions are really increasing. I would also like to use this opportunity to pay tribute to the new Chair of the Committee on Petitions, Ms Mazzoni, because she has managed in a very short time to bring new energy and impetus into the work of the committee and into the handling of the Commission, and is establishing very collaborative good cooperation with other committees in Parliament and with the Commission as well.

I would like to continue by reiterating that the Commission is, of course, very ready to cooperate with the Committee on Petitions in all aspects relating to petitions. We are ready to provide expert help and to offer what is very important – the background study of the issues and a good exchange of information on the most pertinent issues. Because of the time limitation, allow me to focus only on three points that, from the Commission’s point of view, are very interesting and very important.

We consider the most important point to be the recognition by the rapporteur of the very important part in this whole cooperation played by cooperation with the national authorities and the national parliaments. I listened very carefully just now to his ideas on establishing very close collaboration with the petition committees in the Member States. It is very often true that, where European legislation is concerned, the national authorities are responsible for enforcing it.

Secondly, I understand your call for more readability and more user-friendliness in relation to the information spread and information communication from the Commission. Here we are trying to improve our work and I would underline the quality of the new Europa website where we are trying to direct petitioners to the relevant information.

My third point is that I am very pleased that last week we managed to conclude the framework agreement between the European Parliament and the Commission on the particular issue that was raised in the report, namely the information on stakeholders’ current powers as regards infringement. I am very glad that we have found a solution for that.

I know that my time is up so I will finish here. I am looking forward to our debate. Thank you very much for an excellent report.

  Pascale Gruny, au nom du groupe PPE. – Monsieur le Président, Monsieur le Commissaire, chers collègues, j'adresse tout d'abord toutes mes félicitations à notre collègue Iturgaiz pour le travail accompli.

Je suis d'accord avec le contenu du rapport, sur lequel je ne reviendrai pas. Cependant, je souhaite mettre l'accent sur deux problématiques importantes soulevées par le rapporteur. Tout d'abord, il est important d'informer nos concitoyens de la différence qu'il y a entre l'initiative citoyenne, le processus de dépôt d'une pétition au Parlement européen et le rôle qu'exerce le médiateur européen. Trop de confusion règne encore quant à la mission de chacun. Ensuite, je me rends compte, lorsque je vais à la rencontre des citoyens dans ma circonscription, qu'ils ne connaissent même pas l'existence du droit à déposer pétition auprès du Parlement européen. Comment faire pour que les citoyens y voient plus clair et puissent mobiliser les moyens existant en leur faveur? Pour cela, il est absolument essentiel que le Parlement européen se dote de meilleurs outils de communication.

Vous rendez-vous compte qu'il n'existe actuellement pas de site internet pour expliquer clairement comment déposer une pétition? De la même manière, il n'existe pas d'informations disponibles pour les pétitionnaires afin qu'ils puissent suivre, en direct, l'état d'avancement de la pétition qu'ils ont déposée au Parlement. Ce manque de transparence n'est pas justifiable.

Plus de visibilité est nécessaire pour que les citoyens prennent conscience que nous sommes à leurs côtés. Notre commission existe et travaille pour eux, et nous sommes à leur écoute. Le Parlement européen se doit de tout mettre en œuvre pour remédier à cette lacune de communication et mettre en avant le travail effectué qui est, certes, non législatif mais non moins important. Le citoyen doit être au cœur de nos préoccupations, notre commission tente de répondre à cet objectif jour après jour.

  Χρυσούλα Παλιαδέλη, εξ ονόματος της ομάδας S&D. – Κύριε Πρόεδρε, κύριε Επίτροπε, θα ήθελα και εγώ με τη σειρά μου να εκφράσω τις ευχαριστίες μου και ως αντιπρόεδρος της Επιτροπής Αναφορών προς τον καλό συνάδελφο κ. Iturgaiz για την πολύ σημαντική έκθεση που συνέταξε, κυρίως επειδή, αξιοποιώντας στατιστικά δεδομένα, επισημαίνει τον καίριο ρόλο της Επιτροπής Αναφορών στην επαφή των ευρωπαίων πολιτών με το Ευρωπαϊκό Κοινοβούλιο και, παράλληλα με το θεσμό του Ευρωπαίου Διαμεσολαβητή, στην οικοδόμηση της εμπιστοσύνης του στην Ευρωπαϊκή Ένωση και τους εκπροσώπους της.

Από την άποψη αυτή, η Επιτροπή έχει την υποχρέωση, και χαίρομαι που ο κ. Šefčovič ήδη το έχει δηλώσει (με πρόλαβε!), να συνεργαστεί με τα μέλη της Επιτροπής Αναφορών στη μείωση της γραφειοκρατικής λογικής και στην αποτελεσματικότερη ανταπόκριση της Επιτροπής σε αιτήματα που διευκολύνουν το έργο της Επιτροπής Αναφορών, στην επίσημη και τακτική ενημέρωσή της σχετικά με την πρόοδο στις διαδικασίες επί παραβάσει και στη δημιουργία μιας νέας διαδικτυακής πύλης που θα ενημερώνει τους πολίτες για τους διάφορους μηχανισμούς καταγγελίας που είναι στη διάθεσή τους σε επίπεδο Ευρωπαϊκής Ένωσης και σε εθνικό επίπεδο.

Ελπίζω πως η Επιτροπή θα αντιμετωπίσει με τη δέουσα προσοχή την έκθεση του κ. Iturgaiz και θα αξιοποιήσει τα συμπεράσματά της, με στόχο να επιδιώξει την οικοδόμηση της ευρωπαϊκής ταυτότητας και συνοχής

  Marian Harkin, on behalf of the ALDE Group. – Mr President, first of all I want to thank the rapporteur for his very comprehensive report.

I have been a substitute member of the Committee on Petitions for six years and during that time I have worked very closely with some petitioners and listened very carefully to others.

The first thing that always concerns me is that, in general, citizens have a very different perspective on the EU institutions than we do as MEPs or you do as Commissioner. I think we need to put ourselves in the shoes of petitioners. I think if we want a really effective, citizen-friendly process, we need to set up some kind of panel composed of petitioners and then listen to what they have to say and use that as a catalyst for positive change.

For many citizens, petitioning the European Parliament is the last lap of a very long journey and they are often already very frustrated. We have a responsibility to smooth that path as much as possible, and indeed the proposal to convert the EU rights web page into a user-friendly, one-stop shop is, I think, an excellent one. But we also need to be supportive of citizens throughout the process, with clear, timely explanations as to what is happening throughout the entire procedure.

The issue of inadmissible petitions comes up year after year and I think we need to be real about this. We are never going to fully explain to citizens what the competences of the Union are or are not, so I think what is more important is that, if a petition is inadmissible, then that is clearly and simply explained to the petitioner and, crucially, suggestions as to where they might turn next are also included in the response.

Two final points. I support paragraph 17, which calls on the Commission to deal with misleading directory companies. Year in, year out, small businesses in many if not all Member States are subject to harassment and legal threats from these misleading directory companies.

Finally, recital E speaks about the direct impact of EU legislation on citizens’ lives and how citizens are best placed to assess its effectiveness and shortcomings. We as legislators, and the Commissioners as initiators of legislation, need to listen to this and use it as part of a reinforcing loop that improves our effectiveness rather than a cul-de-sac.

  Margrete Auken, for Verts/ALE-Gruppen. – Hr. formand! Også jeg vil gerne sige tak til hr. Iturgaiz for en vigtig betænkning, som har mange glimrende punkter. Da min taletid er knap, vil jeg koncentrere mig om vores ændringsforslag.

Vi bør nævne konkrete sager, hvis borgerne skal forstå, hvad vores arbejde går ud på. Det er ikke for at hænge nogen ud, tværtimod har arbejdet jo båret frugt. De lokale eller nationale myndigheder har lyttet til os. Det er misforstået høflighed kun at tale helt abstrakt om sagerne og modarbejder de gode intentioner om at gøre vores arbejde mere borgervenligt, som mange af mine kolleger har.

Med ændringsforslag 1 vil vi klargøre, at EU-retten selvsagt er overordnet også nationale domstole. I betænkningen kan man få det indtryk, at nationale domstole har det sidste ord at skulle have sagt; men naturligvis kan borgerne henvende sig til os med sager, også uden om de hjemlige domstole. Ellers bliver det, ikke mindst af økonomiske grunde, nærmest umuligt for de fleste at komme igennem med deres klager.

Ændringsforslag 4 er nok det, der for mig er det vigtigste. Vi skulle nødig give Kommissionen mulighed for at unddrage sig sit ansvar for, at medlemsstaterne overholder fællesskabslovgivningen. Det er fint at finde på nye metoder, men jeg kunne heller ikke helt af kommissærens kommentar her høre, om der ikke også var et forsøg på at unddrage sig sine forpligtelser, og det skal Kommissionen ikke have lov til.

Til slut et par ord om vores ændringsforslag 5 om indre regler og arbejdsformer i Udvalget for Andragender, som næppe overhovedet kommer plenarforsamlingen ved. Men altså helt kort: De nuværende regler og metoder fungerer udmærket, og husk: If it ain't broke, don't fix it! Vi har allerede spildt for megen kostbar tid på den debat.

  Zbigniew Ziobro, w imieniu grupy ECR. – Panie Przewodniczący! Na wstępie chciałbym przyłączyć się do podziękowań dla sprawozdawcy za wykonaną pracę.

Chciałbym zwrócić uwagę, że zasadniczy wpływ na działalność komisji będzie miało wejście w życie traktatu lizbońskiego, chociaż dostosowanie prac komisji do nowych warunków traktatowych jest celem, który będzie wymagał dalszej realizacji. W tej nowej sytuacji, w jakiej się znaleźliśmy, niebagatelną rolę powinien odegrać Parlament, zwłaszcza w pracach nad nową inicjatywą obywatelską, tak, aby instrument ten mógł spełniać swój cel w ramach procesu decyzyjnego w Unii Europejskiej. Komisja Petycji odgrywa dużą rolę w realizacji kontrolnych uprawnień Parlamentu. Warto jest wspomnieć przykład skarg na działalność niemieckich urzędów do spraw młodzieży, które utrudniały realizację praw rodzicielskich przez rodzica pochodzącego z innego niż Niemcy państwa członkowskiego. Problem ten stał się przedmiotem analizy komisji, która zwróciła uwagę na nieprawidłowości w tym względzie.

Komisja Petycji odgrywa również ważną rolę przy kontrolowaniu prac Komisji Europejskiej. Jako przykład można podać sprawozdanie na temat przygotowań związanych z inwestycją Nord Stream i rodzące się podejrzenie niedopełnienia wszystkich wymogów związanych z ochroną środowiska.

Trzecim istotnym czynnikiem, o którym warto pamiętać w kontekście dyskusji o działalności Komisji Petycji, jest nadanie Karcie Praw Podstawowych prawnie wiążącego charakteru. Temat ten będzie też przedmiotem dalszych intensywnych prac komisji.

  Willy Meyer, en nombre del Grupo GUE/NGL. – Señor Presidente, yo también quería sumarme a las felicitaciones y al agradecimiento al señor Iturgaiz en nombre de mi Grupo. Yo creo que estamos ante un informe detallado sobre el intenso trabajo que tuvo la Comisión en 2009.

Un intenso trabajo que se corresponde con las peticiones, que se convierten en un instrumento cada vez más efectivo para la ciudadanía. De tal manera que, efectivamente, han aumentado todas las peticiones en relación con 2008. Yo creo que esto indica que, efectivamente, este Parlamento es, a ojos de muchos ciudadanos, una herramienta muy útil a la hora de hacerle llegar peticiones de todo tipo: problemas medioambientales, derechos fundamentales, justicia, mercado interior…

Cada vez más peticiones: a la cabeza Alemania, España, Italia, Rumanía —espero que no se corresponda con el resultado del partido de pasado mañana y que no esté Alemania por delante de España—. Pero es verdad que estamos ante un instrumento verdaderamente útil para muchos ciudadanos.

Yo creo que el informe tiene la virtud no solamente de describir, sino también de señalar, ante la Comisión Europea, aspectos que hay que corregir por el bien de la efectividad del procedimiento de petición.

En primer lugar, la simplificación de la petición que nos corresponde a todos —también a este Parlamento—. Pero, después, en todo lo referente a las competencias que son propias de la Unión Europea, como la gestión del ecosistema, las medioambientales, etc., en el marco de este procedimiento tendríamos que acelerar mucho más las respuestas de la Comisión Europea, incluso con las cartas de apercibimiento a los Estados miembros, porque sabe la Comisión que, muchas veces, cuando llega la carta o incluso cuando interviene el Tribunal de Justicia de la Unión Europea, ya es tarde. El daño es irreversible. El daño medioambiental es irreversible.

Por eso a mí me parece muy importante que, efectivamente, en este punto concreto, seamos capaces de encontrar un mecanismo mucho más rápido: mucho más rápido desde que llega la petición, desde que se pronuncia la Comisión dando la razón al peticionario de que se ha hecho un daño o se está produciendo una vulneración de directivas europeas relativas a la protección medioambiental, para que ese procedimiento, cuando llegue a los tribunales, llegue mucho más rápido para procurar que el daño no sea irreversible.

Esta es la experiencia que hemos tenido en 2009. Ha sido un año para mi país, para España, que ha tenido una repercusión muy importante. España ha sido uno de los países que más problemas ha tenido con el urbanismo no controlado y, por eso, el informe de la señora Auken fue muy importante en su momento. Recordemos, por ejemplo, el puerto de Granadilla.

Recientemente nuestra visita a Huelva en relación con todo lo que significaba la contaminación de la ría, demuestra que, efectivamente, es un instrumento muy útil. Y si somos capaces de acelerar, de simplificar y de concretar mucho más la acción de la Comisión cuando hay incumplimientos medioambientales, yo creo que los ciudadanos lo agradecerán.

  Angelika Werthmann (NI). - Herr Präsident, sehr geehrte Kolleginnen und Kollegen! Das Petitionsrecht wurde durch den Vertrag von Lissabon als wichtiger Teil der Unionsbürgerschaft verankert. Staatsangehörige aus Deutschland und Spanien bringen mit großem Abstand die meisten Petitionen ein. Mein Heimatland Österreich liegt im Vergleich zu den Spitzenreitern weit abgeschlagen. Es ist meine Überzeugung, dass eine breite öffentliche Aufmerksamkeit positive Effekte auf eine vertiefte Integration der Europäischen Union haben kann.

Die Beschlüsse der Europäischen Union haben direkten Einfluss auf das tägliche Leben der Bürger und Bürgerinnen. Denn mittels einer Petition können Bürger und Bürgerinnen direkt Kontakt mit europäischen Institutionen haben – Institutionen, die oft als sehr abstrakt und bürokratisch wahrgenommen werden.

Doch auch die Institutionen gewinnen durch eine Petition. Denn oftmals wird über eine Petition die Umsetzungsweise von Unionsrecht ersichtlich. Ein Beispiel dazu ist etwa die gegenseitige Anerkennung von Ausbildung, beruflichen Qualifikationen und Berufserfahrung. Die EU unterstützt verschiedene Mobilitätsprogramme. Damit diese auch erfolgreich funktionieren, sollte eine gegenseitige Anerkennung sichergestellt sein.

Bürger und Bürgerinnen der Union werden im Europäischen Parlament vertreten. Schon aus diesem Grunde ist es wichtig, dass sie sich mittels Petitionen direkt an uns wenden können. Als Mitglied des Petitionsausschusses setze ich mich jedenfalls aktiv für einen größeren Bekanntheits- und Wirkungsgrad des Ausschusses ein. Wenn es mehr Wissen über die Zuständigkeit der EU gäbe, dann könnte man auch das Problem des großen Umfangs von unzulässigen Petitionen in den Griff bekommen.

Und – last but not least – möchte auch ich mich für den Bericht bedanken!

  Erminia Mazzoni (PPE). - Signor Presidente, onorevoli colleghi, saluto il Commissario Šefčovič, sottolineo l'assenza per questo dibattito del rappresentante del Consiglio.

L'Unione europea – lei sa Presidente – negli anni è andata rafforzando il concetto di cittadinanza europea, quale fondamento della propria legittimazione politica e soprattutto per coltivare la propria ambizione di rappresentanza democratica. L'Unione europea, come tutti gli organismi internazionali, infatti, non può mettere in campo azioni che vadano al di là del diritto pattizio né può interpretare estensivamente i propri poteri.

Eppure ha un carattere di specialità, che le deriva proprio da quel sogno europeo dei suoi padri fondatori, che le attribuivano un carattere popolare. In particolare l'ultimo trattato, il trattato di Lisbona – di recente entrato in vigore – iscrive in una cornice politica delle Istituzioni europee, in nome dell'obiettivo di una maggiore partecipazione dei cittadini, mattoni dell'istituenda Europa dei popoli.

La commissione per le petizioni del Parlamento europeo è l'unico strumento diretto di partecipazione attiva dei cittadini alla vita delle Istituzioni europee, basti pensare che essa definisce la propria agenda dei lavori in relazione alle istanze dei cittadini e non alle indicazioni della Commissione esecutiva. Del suo lavoro e dei suoi risultati il Parlamento e la Commissione dovrebbero tenere più conto.

Dai dati della relazione del 2009, per la quale rivolgo il mio plauso al collega Iturgaiz Angulo, emerge un tasso di coinvolgimento crescente molto apprezzabile nonostante la ritrosia che in passato la Commissione europea ha sicuramente manifestato a collaborare con la commissione petizioni.

Nell'ultimo anno abbiamo migliorato le procedure interne, abbiamo avviato una revisione del metodo di esame delle petizioni ricevibili e abbiamo proposto, come hanno detto tutti quanti i colleghi, un sistema di ammodernamento del portale web per rendere più fruibile il sistema ai cittadini. È stato un anno proficuo...

Vorrei concludere con un auspicio per il prossimo anno: spero in una collaborazione più proficua con la Commissione esecutiva e per questo confido nelle parole del Commissario Šefčovič e nei suoi tre punti, che spero possano trovare attuazione, e oltretutto spero che questa Commissione possa avere un ruolo specifico nella procedura che è in discussione per l'iniziativa popolare legislativa.

  Kinga Göncz (S&D). - Én is szeretnék gratulálni a jelentéshez. Azt gondolom, hogy pontos képet ad a 2009-es évről, ami nem volt könnyű év. A bizottság tagjainak körülbelül kétharmada kicserélődött, közben emelkedett - ha enyhén is - a petíciók száma. Egyébként is izgalmas volt abból a szempontból, hogy az Európai Unió a demokratikus deficitet csökkenteni próbálta a Lisszaboni Szerződés elfogadásával, életbe lépésével.

A Petíciós Bizottság valóban nem vesz részt a jogalkotási folyamatban és emiatt sokan kevésbé fontosnak tekintik, mint más bizottságokat, de pontosan a demokratikus deficit csökkentése szempontjából kiemelt szerepe van, abból a szempontból tehát, hogy az állampolgárok és az uniós intézmények között kapcsolatot teremt. Fontos visszajelzés nekünk az, hogy enyhén emelkedett a benyújtott petíciók száma, de nem igazán csökkent a nem befogadható petíciók száma. Sokat kellene javítani még az információn, hogy pontosan tudják az állampolgárok, hogy mikor fordulhatnak petíciókkal a bizottsághoz.

Azt hiszem, az is fontos visszajelzés mindannyiunk számára, hogy milyen területeket érintenek a petíciók. Ezek vagy azok, ahol nem elégséges az európai uniós jogszabályok átültetése, nem elegendően jó a végrehajtásuk, vagy ahol az állampolgárok szeretnének nagyobb európai uniós kompetenciát látni: környezetvédelem, emberi jogok kérdése. Egyre több a petíció, ami a szabad mozgással kapcsolatos, igazságszolgáltatás, belső piaci kérdések, azt hiszem mind nagyon fontosak.

Én is szeretném kiemelni azt, hogy nagyon nagy szüksége van a bizottságnak arra, hogy az Európai Bizottsággal együtt tudjon működni, kiemelten Sefcovic biztos úrral, akinek a segítsége nélkül sokkal kevésbé tudunk hatékonyak lenni. Fontos, hogy bizonyos kérdésekben igen gyorsan szülessenek döntések, ahol jóvátehetetlen károk történhetnek akkor, ha nem vagyunk elég gyorsak. Egyébként is az időtényező nagyon fontos, és emiatt a Bizottság együttműködése. Még egy dolgot említenék meg: nem minden nyelven egyenlő gyorsan tudjuk intézni a petíciókat. A kis nyelvek nincsenek igazán képviselve a bizottság adminisztrációjában. Fontos lenne ezt is javítani és felgyorsítani.

  Peter Jahr (PPE). - Herr Präsident! Das Petitionsrecht ist eines der wichtigsten Rechte der Bürger der Europäischen Union. Dadurch können sie auf mögliche Verletzungen ihrer Rechte oder Missstände in der Europäischen Union aufmerksam machen. Damit sind die eingereichten Petitionen ein guter Gradmesser für das Funktionieren des europäischen Rechtssystems. Deshalb freue ich mich, dass mit rund 1 900 Petitionen noch einmal mehr Petitionen eingereicht wurden als im Jahr 2008.

Aber die Bürger haben auch ein Recht auf eine angemessene, ausreichende und kurzfristige Antwort. Das heißt, wir müssen gemeinsam unsere Arbeit und unsere internen Verfahrensabläufe optimieren. Das heißt erstens: Die so genannten Nichtpetitionen müssen schneller aussortiert werden. Sie gehören nicht in den offiziellen und umfangreichen Geschäftsgang. Zweitens: Petitionen, für die wir nicht zuständig sind, müssen schneller abgewiesen oder überwiesen werden. Und drittens: Die Abgeordneten des Petitionsausschusses sollten schneller in einen Dialog mit den Petenten kommen.

Der Petitionsausschuss hat hier eine große Chance, die Europäische Union für die Bürger ein wenig lebendiger zu machen. Ich denke, wir werden gemeinsam – wir, das heißt, der Petitionsausschuss, die Kommission und die zugeteilte Verwaltung – diese Chance in der nächsten Zeit umfangreich und angemessen nützen.

  Lena Kolarska-Bobińska (PPE). - Panie Przewodniczący! Sprawozdanie pokazuje bardzo dobrze, jakim ważnym elementem europejskiej demokracji jest Komisja Petycji i cały system petycji. Reagujemy tam na codzienne problemy ludzi, ale co też jest bardzo ważne, obywatele informują nas o nieprzestrzeganiu prawa europejskiego przez instytucje w krajach członkowskich, czy przez same kraje członkowskie. I my w Komisji Petycji dyskutujemy o tych sprawach i zamykamy je, ale zupełnie potem nie wiemy, czy kraje członkowskie wzięły pod uwagę nasze ustalenia.

Brakuje więc nam prawdziwych mechanizmów monitorowania, czy nasze działania przyniosły efekt, a nasze wnioski zostały wysłuchane i wzięte pod uwagę. Trudno pełnić też funkcje kontrolne, jeśli nie ma follow-upu, jeśli nie wiemy, co się dalej dzieje. I potem dzieje się też tak, że pewne petycje zaczynają do nas wracać. Skargi zaczynają być powtarzane.

Jednym z takich przykładów jest petycja z 2006 r., która w tej chwili do nas wpływa w 2010 r., i będziemy znowu się nad nią zastanawiali. Autor sprzeciwiał się wtedy budowie gazociągu Rosja–Niemcy na dnie Bałtyku, pokazując zagrożenia dla środowiska naturalnego. I w 2008 r. Parlament Europejski przyjął sprawozdanie, w którym wzywał do powstrzymania budowy gazociągu północnego na dnie Bałtyku. Nasza komisja domagała się sprawdzenia przez Komisję Europejską, czy ocena całej sytuacji została zrobiona w sposób rzetelny i czy Komisja Europejska dopilnowała sprawy. Okazuje się, że nie było monitorowania – sprawa do nas jeszcze raz wraca, więc trzeba zastanowić się i stworzyć system monitorowania, co dalej się dzieje z naszymi petycjami, które zostały zamknięte.

  Mairead McGuinness (PPE). - Mr President, I would like to thank the rapporteur. I want to use my time to bring to the attention of the House an update on the work of the Committee on Petitions dating back to 2006 and 2007, when we set up a committee of inquiry into Equitable Life. I chaired that committee. This House voted on a report in 2007 which called on the UK Government to recognise its responsibility and to compensate Equitable Life policyholders in the UK, Ireland, Germany and elsewhere. Today many of you may have received representations from your constituents who are concerned about the extent of this compensation. There is a suggestion that compensation will only amount to about 20%. This is not what the committee I chaired had in mind. I would like this House and the Commission in particular to look very carefully at this. I believe the new UK Government should honour what it said in its opening statement and commit to compensating all policyholders in an appropriate and fair manner.

  Sonia Alfano (ALDE). - Signor Presidente, onorevoli colleghi, ritengo il diritto alla petizione uno dei principali strumenti in possesso dei cittadini europei per partecipare attivamente all'attività politica dell'Unione europea.

Affrontando il mio mandato di eurodeputato con spirito di servizio e rispetto al cittadino e alla centralità che questo deve avere nelle decisioni del Parlamento europeo, mi sono più volte interessata a conoscere le petizioni che erano state presentate...

Mi sono più volte interessata a conoscere le petizioni che erano state presentate e allo stato di avanzamento delle stesse presso la commissione competente. Purtroppo, nonostante il regolamento del Parlamento all'articolo 5, comma 3, preveda che i deputati hanno il diritto di prendere visione di tutti i documenti in possesso del Parlamento o di una commissione, ho dovuto riscontrare che il database interno e-Petition è accessibile esclusivamente ai membri della commissione competente. Ho contattato l'unità di riferimento, ma purtroppo non ho ricevuto alcuna risposta.

Penso che si debba porre immediatamente rimedio a questa discriminazione che sminuisce l'importanza delle petizioni dei cittadini e non valorizza il lavoro stesso della commissione parlamentare. Abbiamo poco tempo, Presidente, per cui in un minuto uno cerca di dire tutto.

  Elena Băsescu (PPE). - Mai întâi doresc să-l felicit pe colegul meu, domnul Iturgaiz, pentru munca depusă la acest raport.

Tratatul de la Lisabona a reconfirmat dreptul fundamental al cetăţenilor Uniunii Europene de a adresa petiţii Parlamentului European. Însă pentru a putea fi soluţionate, aceste petiţii trebuie să se încadreze exclusiv într-unul dintre domeniile de activitate ale Uniunii.

De aceea, am solicitat printr-un amendament ca viitorul portal interactiv pentru petiţii să descrie cât mai detaliat responsabilităţile Uniunii în diferite domenii. Doar în acest fel se va putea elimina confuzia dintre competenţele comunitare şi cele naţionale şi se va reduce numărul petiţiilor declarate inadmisibile.

Consider că pe viitor Comisia trebuie să coopereze în mod constant cu Ombudsmanul European pentru a se evita redactarea de rapoarte speciale precum cel în cazul plângerii 676 din 2008.

  Anneli Jäätteenmäki (ALDE). - Arvoisa puhemies, onnittelut esittelijä Iturgaiz Angulolle erinomaisen informatiivisesta mietinnöstä. En ole valiokunnan jäsen, mutta tästä mietinnöstä saa hyvän kuvan valiokunnan työstä ja myös vetoomusmenettelyn hyödyllisyydestä.

Vetoomusmenettely on hyödyllinen, vaikkakin se on aika huonosti tunnettu kansalaisten kesken. Siinä riittää vielä työsarkaa. Riittää senkin jälkeen, kun Lissabonin sopimuksen voimaantulon myötä tulee käyttöön tämä uusi kansalaisaloite. Kun kansalaisaloitteen pelisäännöistä keskustellaan, on syytä ottaa oppia vetoomusvaliokunnan työstä, eikä keksiä pyörää kahta kertaa. Toisaalta kansalaisia tulee myös informoida mahdollisimman laajasti siitä, että vetoomus on eri asia kuin kansalaisaloite.

  Andrzej Grzyb (PPE). - Panie Przewodniczący! Ciekawe sprawozdanie, ciekawa działalność tej komisji. Ostatnio ona została, w szczególności w poprzedniej kadencji, bardzo spopularyzowana przez niektóre sprawozdania, ale jednocześnie ciekawe są konkluzje sprawozdawcy, wśród których chciałbym wyróżnić właśnie tę konieczność lepszej współpracy z parlamentami narodowymi, czy też dostępność informacji dla obywateli. I tutaj w pełni zgadzam się również z panią poseł Gruny, że należy wprowadzić większe upowszechnienie roli petycji, pracy rzecznika, czy rolę, jaką może odegrać inicjatywa obywatelska.

Jednocześnie wydaje mi się bardzo istotne, aby informować o stanie zaawansowania prac nad petycją, ale również nad wykonaniem rezolucji, która jest w wyniku działalności Komisji Petycji podjęta. Przykładem jest to, co mówiła również pani poseł Kolarska-Bobińska: rezolucja w sprawie Nordstreamu została przyjęta, ale jednocześnie obywatele, na przykład w moim kraju, pytają się, co dalej. Jaki jest efekt tej rezolucji? I to jest rzeczywista odpowiedź na to, co robi Parlament Europejski.

  Czesław Adam Siekierski (PPE). - Panie Przewodniczący! Chciałbym na wstępie wskazać i podkreślić, jak rośnie znaczenie Komisji Petycji jako instytucji, która słusznie przychodzi z pomocą przeciętnemu obywatelowi UE. Prawo składania petycji do Parlamentu Europejskiego jest jedną z ważnych form demokracji na szczeblu unijnym. Dla wielu osób dotkniętych różnymi problemami jest ważną formą obrony ich interesów.

Chcę wskazać na potrzebę współpracy i kontaktów Komisji Petycji Parlamentu z ich odpowiednikami w parlamentach narodowych, tak, aby tworzyć wspólny i uzupełniający się system obrony praw obywatelskich. Wyjątkowo ważne są funkcje kontrolne Komisji Petycji w stosunku do działań Komisji Europejskiej.

Na koniec chcę powiedzieć o konieczności przybliżenia naszym obywatelom kompetencji poszczególnych instytucji unijnych i krajowych.

  Maroš Šefčovič, Vice-President of the Commission. − Mr President, if I try to focus on the most important elements in the debate, I think I can group them into three important parts: the first is better communication and a better information spread; the second is cooperation between the European Parliament and the Commission in the field of petitions; and the third concerns all issues related to the infringement procedures.

Regarding better communication, I agree with honourable Members that it is very clear that we should try to spread information better and try to find a way to explain to the citizens what the European Citizens’ Initiative is, how it differs from petitions, what the relevant rights are and which rights relate to the Ombudsman. There is not enough information on the EU, and I think here we have to work together as regards how to improve the information spread among our citizens.

We have tried to improve the communication tools the Commission has at its disposal through the improved website. As I mentioned in my introductory remarks, the new Europa website is aimed precisely at overcoming that problem. We have already informed the Committee on the Internal Market and Consumer Protection about the work done on the website, and that committee will be very happy to pass that information on to the Committee on Petitions. We would welcome comments from the PETI Committee – or from any other committees in the European Parliament – on how they think we can improve the website and how we can better direct information to our citizens.

With the approval of the European Citizens’ Initiative, our citizens will get a new tool with a view to setting the agenda for all of us who work on European legislation. I would like warmly thank the PETI Committee in particular, because its experience and advice was very important when we were drafting the draft regulation on the ECI. I am sure that we will be cooperating very closely in the coming days and months – when this issue is being discussed and debated in the European Parliament, and once the ECI is in place – as regards how we can work even better with this instrument and with the citizens who will be using it.

The Commission is open to working in very close cooperation with Parliament, because we realise how important petitions are for our citizens and we understand that the best answer is one which is correct, quick and not subject to delays. If this is the case, citizens will get frustrated. But sometimes it is not easy to provide quick answers because very thorough analysis and very thorough legal study has to be done. There has to be a lot of background research so things sometimes take a while, but I am sure that we will be working with Parliament in looking for ways in which we can improve and speed up the process in this area.

The last point concerns infringements. I would like to assure honourable Members that we take this issue extremely seriously, as you can see from the list of infringement procedures that have been opened. It is a regular process within the Commission. The Commission’s primary goal is to encourage all Member States to uphold European law and all directives. We are trying to use all the means at our disposal to do this, including exchanges of views and encouraging Member States to correct improper transposition of European law. If this does not work, we take the matter to the European Court of Justice with a plea to correct the inappropriate transposition of European law. In the past there have been requests from the European Parliament for more information on infringement procedures. I am very glad that we have now found an understanding as to how this will be done in the future, once the framework agreement between Parliament and the Commission enters into force. I am sure that, with the additional information you will have at your disposal, you can also exercise your rights and use your influence in the Member States to ensure that European law is respected.

I took note of the other detailed questions and comments raised and I will pass them on them to the relevant departments.

  Carlos José Iturgaiz Angulo, Ponente. − Señor Presidente, quiero dar las gracias a todos los colegas por sus palabras y sus intervenciones.

Yo creo que hay un eje común en todas las intervenciones que han hecho mis colegas. Y ese eje común es la importancia que tiene la Comisión de Peticiones, porque miles de ciudadanos depositan su confianza y sus ilusiones, en muchas ocasiones, en esta comisión para resolver sus problemas principales, sus problemas reales.

Por eso la Comisión de Peticiones —así lo han señalado varios compañeros— es, de todas las comisiones, la que tiene una relación más directa con el ciudadano, pues los ciudadanos intervienen también en ella. Y hay que salvaguardar esta comisión por su significado y mejorar los flecos pendientes, para que así, tanto el Parlamento como la Comisión, y también los peticionarios, nos sintamos aún más útiles en esta comisión.

Con su venia, señor Presidente, termino pidiéndole al Comisario que tome muy buena nota. Yo sé que el Comisario lo va a hacer, porque muchas de las quejas de mis colegas que hoy hemos escuchado aquí están llenas de razón. Tienen mucha razón en esos comentarios que han hecho: en la falta de información, en el hecho de que determinadas peticiones se hayan paralizado y no hayan seguido su curso.

Creo, por lo tanto, que no se puede mirar hacia otro lado, sino que se tiene que ir al fondo de la cuestión. Hay que solucionar esas peticiones que se han iniciado, que siguen abiertas y cuyos problemas aún no se han solucionado. Y yo creo que desde su puesto de Comisario tiene que hacer ese esfuerzo para intentar dar solución a esas quejas que hoy ha escuchado aquí, en esta Cámara.

  Jim Higgins (PPE), in writing. I am delighted to see that the number of submitted petitions has continuously increased; this has been greatly aided by the opportunity to submit petitions online. The year 2009 saw 65% of petitions submitted online, and I am proud to say that Ireland has the highest per capita submission of petitions in the EU. The Petitions Committee is an invaluable tool for bringing Europe into citizens’ lives through its direct interaction with petitioners. In 2009, 54% of petitions received were deemed inadmissible. This is a worrying trend, which if continued will inhibit the effectiveness of the committee. Most of the petitions deemed inadmissible are the result of ongoing confusion concerning the powers and responsibilities of the Petitions Committee. We need to urgently introduce information campaigns for citizens on the powers and responsibilities of the Petitions committee – this could be done through a one stop website, which would explain in a clear manner what falls under the committee’s powers and responsibilities and provide information on other possible methods of redress for non petition issues. The Petitions Committee is crucial in that it brings the powers of Europe to the people, who are best placed to judge the shortcomings in the application of EU policy by Member States.
