  Marielle Gallo, auteur. − Monsieur le Président, dans la crise économique que nous traversons, la nécessité de la rigueur et de l'équilibre budgétaire est absolument certaine. Mais l'assainissement des finances publiques n'est qu'une première étape, indispensable, mais une première étape qui doit nécessairement être complétée par une deuxième étape, celle de la compétitivité de l'Union européenne.

Pour anticiper, pour assurer la croissance économique, pour maintenir les emplois, il faut agir vite. Il faut absolument atteindre les objectifs de la stratégie Europe 2020 et remplir également les objectifs de l'agenda numérique. Nous ne pouvons pas nous exposer à décevoir, comme cela a été le cas pour la stratégie de Lisbonne.

L'économie numérique comporte un énorme potentiel de croissance. Les techniques de l'information et de la communication ont provoqué une véritable révolution. Aux États-Unis, par exemple, la vente des livres numériques dépasse aujourd'hui la vente des livres papier. En revanche, le marché européen est faible, fragmenté, et cette situation s'explique en partie par la fiscalité indirecte.

Pourquoi? Aujourd'hui, le cadre juridique exclut les biens culturels numériques, parce qu'ils sont assimilés à des prestations de service. Si je prends l'exemple du livre, le livre papier a un taux de TVA à 5,5, alors que le livre numérique a un taux de TVA normal qui n'est jamais inférieur à 15 %. J'ajoute que pour les mal-voyants, qui représentent plusieurs millions de citoyens européens, le livre numérique a été une véritable révélation et une révolution.

Donc cette discrimination fiscale est préjudiciable au marché unique du numérique. Je crois que les Américains l'ont compris bien avant nous puisque le président Clinton a pris l'initiative en 1998 de décider d'un moratoire, qu'il a renouvelé d'ailleurs trois fois, en vertu duquel les États fédéraux ne pouvaient pas prévoir une TVA supérieure pour tous les biens du commerce électronique. Le résultat, on le constate aujourd'hui, est que ce marché du numérique est complètement dominé, justement, par les Américains.

Je crois donc que l'Union européenne doit vite mettre en œuvre des moyens qui lui permettent d'atteindre ces objectifs et, en l'occurrence, il s'agit d'introduire un taux de TVA réduit pour l'ensemble des biens culturels numériques. De cette manière, on obtiendra une réduction des coûts de l'offre légale. En réduisant les coûts, elle devient beaucoup plus accessible aux citoyens. C'est aussi pour les consommateurs une plus grande diversité. C'est le moyen de lutter contre le piratage. En élargissant l'offre légale et en la rendant plus accessible, il est évident que la tentation du piratage numérique diminuera; en outre, les recettes fiscales des États ne pourront qu'augmenter puisqu'on élargira la consommation.

Le dernier point que je voudrais soulever, c'est que ce marché unique du numérique doit bénéficier à l'ensemble des États membres. Pour atteindre cet objectif, je demande à la Commission d'avancer la modification du lieu de perception de la TVA qui était prévue au 1er janvier 2015, de manière à ce que la TVA soit perçue dans le pays où le bien est acheté, au lieu du pays du siège du vendeur.

Je pense que si nous réussissons rapidement à mettre en œuvre au moins ces moyens d'ordre fiscal, le marché unique du numérique ne peut que se développer. Nous avons un grand retard encore une fois sur les États-Unis, mais je l'ai expliqué, et je crois que nous n'avons plus le choix, que nous devons absolument agir aujourd'hui et procéder à cet alignement de manière à éviter, et à en finir avec, cette discrimination sur les biens numériques à contenu culturel.

  Androulla Vassiliou, Member of the Commission. − Mr President, the Commission agrees with you that – as an economic principle – online and offline products with the same content should be treated in the same way. Of course you will understand that I personally, as Commissioner responsible for education and culture, am particularly interested in this issue.

However, the application of the standard VAT rate is the general principle set out in EU VAT law, whereas the application of reduced VAT rates remains an option for Member States and is limited to certain categories of goods and services.

As for cultural goods, the current option to apply a reduced rate is limited to the supplies of traditional books printed on paper, as well as to books engraved on physical means of support such as diskettes, CDs, DVDs, etc. On the other hand, supplies of e-books, as well as supplies of online newspapers and online periodicals, qualify as electronically supplied services, to which the reduced rates do not apply.

As far as the place of taxable transactions is concerned, until 2015 the supply of electronic services to final consumers within the EU is taxed in the country of the supplier. From January 2015, those electronic services will be taxed in the country of the customer.

An optional application of reduced rates by the Member States to these products, such as e-books, not only is not permitted under the current rules, but it should also be excluded in the short and medium term as it would lead to distortions in the internal market if only some countries use the option.

With your second question, you suggest advancing the date of 1 January 2015 by which the rules on the place of supply will change.

The adoption of the Directive, as regards the place of supply of services, was the result of long negotiations in Council which started in 2003. The entry-into-force date of 1 January 2015 was an essential part of this unanimous agreement, and Member States have already indicated that they are not prepared to review this two years after its adoption.

As regards your last question, the Commission is of the opinion that a political discussion on the current VAT rates structure will be necessary in the broader framework of the review of the EU VAT system.

This review was launched with the Green Paper on the future of VAT in December last year. Parliament contributed to the debate with the resolution on the future of VAT adopted last month. The Commission intends to present, before the end of this year, a Communication setting out the priorities for future work on VAT. This will be an open discussion and in 2012 we shall decide, according to the results of this Communication, what measures we should take.

  Andreas Schwab, im Namen der PPE-Fraktion. – Herr Präsident, Frau Kommissarin, liebe Kolleginnen und Kollegen! Der digitale Binnenmarkt, die sogenannte fünfte Grundfreiheit in der Europäischen Union, ist – darauf ist schon hingewiesen worden – für Unternehmen und für Verbraucher gleichermaßen von erheblicher wirtschaftlicher Bedeutung. Auch über das 20-jährige Bestehen des Binnenmarkts hinaus ist dies ein Bereich, der langfristig voranzutreiben ist. Deshalb müssen alle noch bestehenden Hindernisse und Marktverzerrungen, auch wenn sie steuerlicher Natur sind, weiter abgebaut werden, um den grenzüberschreitenden Handel zu fördern und eine faire Verteilung der Einkünfte zwischen den Mitgliedstaaten zu ermöglichen.

Das Beispiel, das wir hier heute diskutieren, zeigt zweierlei: Erstens die Möglichkeit der Mitgliedstaaten, steuerliche Bedingungen für bestimmte Produkte zu variieren, insbesondere nach unten, kann auch einen Anreiz schaffen, mit diesem Mittel eine Reihe von Produkten zum Handel im eigenen Mitgliedstaat zu ziehen. Ich denke, sowohl die Kommission als auch das Parlament wissen, worüber wir hier reden. Zum Zweiten zeigt der Sachverhalt, den wir heute diskutieren, aber auch, dass eine weitere Harmonisierung – ich darf, weil die Kollegin Wallis anwesend ist, auch die Verbraucherrechte-Richtlinie zitieren – nicht nur im Bereich der Mehrwertsteuer notwendig sein wird. Es wird eine Reihe weiterer Maßnahmen notwendig machen, wenn wir langfristig tatsächlich zu einem wirklich einheitlichen Binnenmarkt kommen wollen.

Eines der Beispiele, das hier vorgelegt ist, ist die unterschiedliche steuerliche Behandlung vergleichbarer Produktgruppen oder Dienstleistungen, die beobachtet wurden. Während Mitgliedstaaten z. B. die Möglichkeit haben, einen ermäßigten Steuersatz auf Waren kulturellen Inhalts sowie Bücher anzuwenden, müssen gemäß der Mehrwertsteuerrichtlinie für konkurrierende Online-Dienste wie E-Books die Standardsätze angewendet werden. Diese Ungleichbehandlung ist sachlich jedoch so nicht zu rechtfertigen. Der Markt für E-Books hat ein enormes wirtschaftliches Potenzial für den digitalen Binnenmarkt und ist ein noch außerordentlich junges und sich dennoch rasant entwickelndes Segment, in welchem der Preis eine große Rolle spielt.

Deswegen, Frau Kommissarin, werden wir die weiteren Vorschläge nicht nur von Herrn Šemeta, sondern auch die von Ihnen angesprochene öffentliche Konsultation zur Mehrwertsteuer sehr genau beobachten. Und ich glaube, es ist insbesondere angesichts der momentanen Schwierigkeiten im Interesse des Binnenmarkts, dass wir hier zu einer weiteren Vereinheitlichung kommen. Aber die wird politische Führung von der Kommission verlangen.

  Olle Ludvigsson, för S&D-gruppen. – Herr talman! Europa är i dag i stort behov av stark och hållbar tillväxt. Utan högre tillväxtnivåer blir det svårt både att lösa den akuta skuldkrisen och att klara den globala konkurrensen på lite längre sikt. I det läget har vi inte råd att missa en enda möjlighet att förbättra tillväxtpotentialen i den europeiska ekonomin. Vi måste vända på varenda sten för att få den inre marknaden att fungera mer effektivt.

Ett område med en särskilt stor potential är den digitala sektorn. Om de existerande hindren för digitala tjänster på den inre marknaden togs bort, skulle utbytet av denna typ av tjänst i Europa sannolikt öka marknaden. Detta skulle ha ett direkt ekonomiskt värde, skulle främja utveckling av de digitala tjänsterna och skulle dessutom ge viktiga internationella konkurrensfördelar till de europeiska företag som verkar på området.

Ett betydande hinder för den digitala inre marknaden är de regler i momsdirektivet som säger att tjänster med kulturellt innehåll inte ska ha samma låga momssats när de levereras digitalt som när de levereras i fysisk form. Dessa regler är föråldrade och behöver omgående ändras. Böcker, tidningar och musik som förmedlas i digital form bör naturligtvis ges samma skatteförutsättningar som den fysiska motsvarigheten.

  Diana Wallis, on behalf of the ALDE Group. – Mr President, I am really grateful to Ms Gallo for raising this issue and for setting out so carefully and properly the challenge that we face in her introduction. I would also like to thank the Commissioner for her careful but – from our point of view – rather unsatisfactory answer.

I want to keep this dead simple. I have here a pile of books. They are not very pretty or wonderful books, but they are books. I love books and I will have a whole lot of real books on my Christmas list this Christmas.

But why should it be that these books pay less VAT than e-content? I can carry a whole library around on my e-reader. Both of them are cultural content, but there is a huge difference in the VAT to which they are subject.

We talk about an internal market, we talk about a digital revolution. It seems to me that our Member States have something to learn from what has happened in America in these terms. A pile of books or e-content. Let us be modern, let us be equal.

  Rolandas Paksas, EFD frakcijos vardu. – Aš visiškai sutinku su autorės ponios M. Gallo mintimis, ir man atrodo, kad šiuo atveju gerbiamos Komisijos narės pozicija yra šiek tiek per atsargi. Gerbiamieji, skaitmeninėms ir fizinėms prekėms taikomas skirtingas pridėtinės vertės mokestis iš tikrųjų yra opi šių dienų problema, kuri užkerta kelią tinkamai pasinaudoti skaitmeninės rinkos teikiamos augimo ir didelės prekių ir paslaugų pasiūlos potencialu. Be to, yra sukuriamos diskriminacinės sąlygos, kai bendrosios rinkos privalumai teikiami tik fizinėms prekėms. Atsižvelgdamas į tai, aš manau, kad Komisija turėtų imtis neatidėliotinų veiksmų, kad kultūros prekėms ir paslaugoms, teikiamoms fizinių laikmenų formatu arba internetu, būtų taikomas lengvatinis pridėtinės vertės mokesčio tarifas, ir būtų supaprastintos ir suvienodintos pridėtinės vertės mokesčio taisyklės. Ypatingas dėmesys turėtų būti skiriamas elektroninėms knygoms, kurioms šiuo metu yra taikomas įprastas pridėtinės vertės mokesčio tarifas, o fizinėms knygoms yra taikomas mažesnis, atitinkamai 15 proc. ir 5 proc. Manau, kad įgyvendinus šias priemones, bus sudarytos geresnės sąlygos skaitmeninių išteklių kultūros sferoje plėtrai ir efektyviam bendrosios skaitmeninės rinkos veikimui. Ši rinka yra labai svarbi ir būtina plėtojant modernesnį verslą bei teikiant geresnes paslaugas Bendrijos šalių piliečiams, stipriai prisideda prie tolimesnio elektroninės prekybos, elektroninių paslaugų vystymo, todėl būtina kuo skubiau panaikinti bendrosios skaitmeninės rinkos egzistuojančias kliūtis.

  Saïd El Khadraoui (S&D). - Voorzitter, mevrouw de commissaris, collega's, de resolutie die voorligt is belangrijk en zou met de nodige aandacht behandeld moeten worden. Btw is inderdaad een belangrijk beleidsinstrument en kan een grote rol spelen in de keuzes die de consumenten maken in de aankoop van goederen of niet.

Met name in de boekensector is dat frappant. De cijfers spreken voor zich. De auteur heeft al verwezen naar het enorme potentieel van e-books, door de link te maken met wat er in de Verenigde Staten is gebeurd, waar dat een enorme markt is. Als we de digitale sector echt een kans willen geven, moeten we in Europa diezelfde weg volgen. Een paar voorbeelden: In Italië zouden maar een zevenduizendtal boeken beschikbaar zijn via digitale weg. Het btw-tarief voor papieren boeken ligt op vier procent, op twintig procent voor e-books. In Duitsland zou het aantal titels groter zijn, dat zou tussen 30.000 en 40.000 liggen. Ook daar zie je een enorm verschil: zeven procent voor papieren boeken, 19 procent voor de e-books.

Dus we pleiten ervoor dat het verlaagde tarief ook wordt toegepast op deze categorie van werken. Want ik denk dat naast het argument van de interne markt, waar al herhaalde malen naar verwezen werd, er toch ook een cultureel argument is: meer en meer jonge mensen komen eigenlijk in aanraking met de wereld van boeken, van literatuur, via de digitale weg. Zij zijn daar mee vergroeid. Ik denk dat het belangrijk is dat we er rekening mee houden dat jonge mensen, die minder geld hebben, ook toegang blijven hebben tot literatuur en tot boeken in het algemeen.

  Róża Gräfin von Thun und Hohenstein (PPE). - Mr President, I can only agree with my colleagues from all political parties that have spoken before me, and I also agree with my friend Diana Wallis that many of our friends and many European consumers are going to get a nasty shock when they go shopping for Christmas. Electronic books, which are growing in popularity thanks to readers such as – maybe I should not enumerate them – Kindle, iPads, etc. are subject to a much higher VAT rate than their paper cousins (which we love, I agree with you, Diana).

The so-called VAT gap – the difference between the reduced VAT rate applied to books in 25 of 27 Member States and the standard VAT rate to which e-books are subject – is stifling the development of the digital single market. It is going in the opposite direction to what we are striving for.

The problem is very simple. Our EU law is out of date. There is no reason why a difference in VAT rate should be applied to the same product simply due to the means of its delivery. It has been said many times that in Europe e-commerce and other digital services lag behind those in many other parts of the world. This blocks the great potential for their growth. Cultural goods should be made as widely available as possible, and we must support the digitalisation of books. I fully agree with my colleagues.

E-books are a new way of reading, maybe especially for the young generation, and we must care about them and give them a chance. This VAT rate reduces the incentive to publishers to further develop the area and for consumers to buy e-books. This will cause us to read less – and we care about our European culture.

So I am sure that, if the European Commission puts forward a reasonable proposal to have the same VAT rate for paper products and digitalised products, we will all support you with great joy.

  Jaroslav Paška (EFD). - Aj keď nepovažujem za zmysluplné a systémové riešenie poskytovanie znížených sadzieb dane z pridanej hodnoty pre niektoré tovary a služby, rešpektujem skutočnosť, že viaceré vlády používajú daňové úľavy na stimuláciu vybraných aktivít či produktov. Ak teda krajina využíva znížené sadzby dane z pridanej hodnoty pri knihách, dá sa akceptovať takáto znížená sadzba aj pre ich elektronické verzie.

Na rozdiel od svojej kolegyne pani poslankyne Gallovej však hlavný zmysel zvýhodnenia nevidím v ich kultúrnom obsahu, ale viac vo vzdelávacom obsahu. Keď sa pozrieme na množstvo učebníc, pracovných zošitov a povinnej či odporúčanej literatúry, ktoré prejdú našim deťom a mládeži cez ruky počas prípravy na život, som presvedčený, že elektronické verzie učebníc a pracovných materiálov štandardným spôsobom vkladaných do dnes už cenovo dostupných a kvalitných čítacích zariadení môžu našim žiakom a študentom výrazne odľahčiť ich školské tašky. Možno aj preto by mohla byť takáto znížená sadzba zmysluplná.

  Androulla Vassiliou, Member of the Commission. − Mr President, let me say that I started by saying that I do agree with all of you about this irregularity, but we cannot get away from the facts. These discussions with Member States started in 2003 and were completed in 2008 with the adoption of certain decisions. At that time – even in 2008 – there was probably not a correct evaluation of the value of online books, periodicals etc. Technology advances so rapidly and we can now see that this evaluation was lacking.

What we need is a political discussion on the current VAT rates and structure. This is necessary in the broader framework of the review of the EU VAT system, and the Commission intends to initiate this discussion with the Communication that we shall adopt in December. As I said, this Communication will cover all aspects of VAT, including the issues that we have been discussing, and I hope that this will lead to some decisions to be taken for action next year.

  Elena Băsescu (PPE), în scris. – O piaţă digitală unică viabilă ar putea îmbunătăţi competitivitatea şi stimula creşterea economică în UE. Aceasta este esențială pentru dezvoltarea întreprinderilor mici şi mijlocii europene. Încrederea în tranzacţiile electronice trebuie consolidată.

La ora actuală, doar 54 % dintre utilizatorii de Internet din Europa cumpără sau vând bunuri pe piața virtuală. În acelaşi timp, comerţul electronic are un rol de susţinere a comerţului transfrontalier. Eliminarea tuturor barierelor din calea utilizării comerţului electronic este importantă. În special obstacolele fiscale trebuie înlăturate.

Este necesar ca discriminările între furnizarea serviciilor electronice şi furnizarea de bunuri să fie evitate. De exemplu, aceeaşi rată de TVA trebuie să fie aplicată atât cărților imprimate, cât şi cărților în format electronic.

Ţara mea ocupă locul 10 în lume după raportul calitatea conexiunii-accesul la Internet. O serie de proiecte vizând acoperirea zonelor albe broadband urmează sa fie lansate, pentru care se vor aloca 84 milioane de euro cu finanțare europeană.
