  Der Präsident. − Als nächster Punkt folgt die Aussprache über sechs Entschließungsanträge zur Meinungsfreiheit in Belarus, insbesondere der Fall Andrzej Poczobut(1).

  Filip Kaczmarek, autor. − Panie Przewodniczący! Pani Komisarz! Cieszę się, że Andrzej Poczobut został w sobotę zwolniony z aresztu, jednocześnie nie mam jednak wątpliwości, że ani jego indywidualny przypadek, ani szerzej rozumiana kwestia wolności słowa, wolności mediów na Białorusi nie jest kwestią zamkniętą. Represje, które spotykają dziennikarzy na Białorusi, mają charakter polityczny. Przepisy prawa karnego są wykorzystywane do nękania niezależnej myśli. Uważam, że przepisy, które umożliwiają takie praktyki, powinny zostać zmienione i o to zresztą wzywamy w naszej rezolucji.

Bronimy wolności słowa i wolności mediów, gdyż wolność słowa jest jednym z podstawowych praw człowieka, jednym z fundamentów demokracji. Na Białorusi te prawa są łamane. Ci, którzy mają odwagę opisywać rzeczywistość taką, jaka jest – jak np. pan Andrzej Poczobut – są za to surowo karani. Został on już wcześniej uznany za więźnia sumienia. Naszym zadaniem jest nakłonienie władz białoruskich do uwolnienia wszystkich więźniów sumienia. I mam nadzieję, że tak się wkrótce stanie.

  Ulrike Lunacek, author. − Mr President, we were also positively surprised by the fact that Mr Andrzej Poczobut was released last Saturday but, as the previous speaker has said, there is no way that we can be satisfied with the situation of human rights and of freedom of expression in Belarus, especially for journalists but also for opposition figures, lawyers and other activists.

There have been several criticisms about how Mr Lukashenko is handling his country, which is very close to a dictatorship. I think it is the last dictatorship we have in Europe. I am happy that this Parliament stands united against any violation of freedom of expression in a European country.

So in our resolution we demand from the Belarusian authorities an immediate end to all forms of pressure and oppression, whether against journalists, media workers or other activists, and the release of all political prisoners. This is Europe and Belarus is a part of Europe. Repression as we see it in Belarus has no place in Europe.

  Marietje Schaake, author. − Mr President, even though Mr Poczobut was released from custody, he still faces charges of libel which seem to target him as a result of his journalistic activities and as a member of the Polish minority population, and sadly he is not the only one. The situation of human rights defenders, civil society representatives, journalists, and citizens in general in Belarus is seriously deteriorating. Freedom of expression, including online on the Internet, is under real pressure. Sadly this is also taking place with the help of EU-based companies who have exported technologies to Belarus to facilitate this repression.

This kind of aiding and abetting of human rights violations through technologies made in Europe should end. It is indeed the last dictatorship in Europe and we should act to turn that around and make it a democracy as soon as we can. The EU should give a clear signal to the Belarusian authorities that they are not welcome at the Eastern Partnership meeting in Brussels at the end of this month. EU engagement with Belarus is already subject to strict conditionality, and the Belarusian authorities should commit to respect for human rights and the rule of law as they stated themselves in the declaration of the Prague Eastern Partnership summit of 2009.

Meanwhile, we should step up our engagement with Belarusian civil society organisations and promote more intense people-to-people contact. Simply put, any and all restrictions on freedom of association, assembly, opinion and expression in Belarus need to be lifted. Respecting these freedoms is among the very basic cornerstones of democracy which, ironically, the Belarusian authorities have committed themselves to respect. We may have to consider additional sanctions and indeed step up our efforts to ensure that the EU sanctions in place are enforced so that they are not just a paper reality.

  Mitro Repo, laatija. − Arvoisa puhemies, Andrzej Poczobut, joka on puolalais-valkovenäläinen toimittaja ja Valko-Venäjän puolalaisvähemmistön merkittävä aktivisti, joutui jälleen vankilaan odottamaan tekaistuja syytteitä ja poliittista oikeudenkäyntiä.

Valko-Venäjällä toimittaja joutuu edelleen vankilaan, kun hän lausuu ja kirjoittaa mielipiteensä maan presidentti Aljaksandr Lukašenkasta tai yhteiskunnan tilasta yleensä. Kynän säilällä voi siis olla yllättävä mahti. Jo pelkällä mielipidekirjoituksella voi saada useiden vuosien vankeustuomion presidenttiin kohdistuvasta kunnianloukkauksesta.

Uskon kuitenkin, että Valko-Venäjän tapahtumat kertovat enemmänkin presidentti Lukašenkan egon heikkoudesta kuin mistään muusta. Demokratiaa ja todellista kansalaisyhteiskuntaa hän ei maahan edes halua, sillä hän tietää, että se tarkoittaisi hänen hirmuhallintonsa loppua.

Andrzej Poczobut on sittemmin vapautettu. Tämä on erinomainen uutinen. Tästä kuuluvat kiitokset niin suorasukaiselle paheksunnalle ja kritiikille, jonka internet mahdollistaa, kuin myös Euroopan unionille ja parlamentille sekä nopealle reagoinnille. Ihmisoikeusjärjestö Amnesty oli jo aiemmin nimennyt Poczobutin mielipidevangiksi.

Tässä yhteydessä on hyvä muistuttaa, että ainakin 13 muuta mielipidevankia odottaa yhä vapautumistaan Valko-Venäjän vankityrmissä. Henkilön vangitseminen mielipiteensä vuoksi rikkoo törkeästi perustavanlaatuisia, universaaleja ihmisoikeuksia, kuten myös Valko-Venäjän oman perustuslain 34 pykälää.

Euroopan ulkosuhdehallinnon sekä heinäkuussa järjestettävän itäisen kumppanuuden ulkoministerien kokouksen tulisi käsitellä Valko-Venäjän ihmisoikeustilanteen heikentymistä ja myös Poczobutin tapausta.

  Jiří Maštálka, Autor. − Pane předsedající, i já se chci připojit k těm, kdo dnes vystupují na obranu těch, kterým říkáme „vězňové svědomí“. Každý, kdo je nespravedlivě pronásledován za své názory, by měl dostat naši ochranu.

Obávám se ale, že náš výběr projednávaných témat rozhodně neodpovídá ani nedostatku času Parlamentu, ani hloubce společenské nebezpečnosti porušování některých práv. Jistě můžeme přijímat usnesení na obranu člověka jakékoliv národnosti, ale neměli bychom přitom svým výběrem podněcovat etnické a mezistátní spory, které mohou vyústit v mnohem závažnější porušení.

Dnes přijmeme usnesení, která má chránit práva Andreje Pačobuta. Obávám se však, že většina našich voličů se bude mnohem více zajímat o práva jiného disidenta – Juliana Assange, jednoho ze zakladatelů serveru WikiLeaks. Vám se nezdá jako velmi nebezpečný precedens, že ten, kdo před veřejností poodhalí špinavá tajemství politiky, může být kriminalizován?

  Bernd Posselt (PPE), Frage nach dem Verfahren der blauen Karte. – Der weißrussische Botschafter in Prag hat den Herrn Staatspräsidenten Klaus sehr gelobt und ihm für seine konstruktive Haltung gegenüber Weißrussland gedankt. Ich wollte den Kollegen Maštálka fragen, wie er das bewertet.

  Marek Henryk Migalski, autor. − Panie Przewodniczący! Miała rację pani Schaake, kiedy mówiła, że Andrzej Poczobut nie został uniewinniony, został tylko zwolniony na okres toczenia się rozprawy. Znaczy to, że grozi mu w dalszym ciągu 5-7 lat więzienia. Powinniśmy o tym pamiętać. Miał rację pan Repo, kiedy mówił, że tam w dalszym ciągu pozostaje trzynastu opozycjonistów, ludzi, którzy mieli odwagę sprzeciwić się tej ostatniej dyktaturze w Europie – musimy o tym pamiętać. Dlaczego Andrzej Poczobut znalazł się w więzieniu? Dlatego, że jest Polakiem, opozycjonistą i dziennikarzem. Okazuje się, że to jeszcze jest mało – on jest dzielnym Polakiem, dzielnym opozycjonistą i rzetelnie wykonującym swoje obowiązki dziennikarzem. To było już za dużo dla Łukaszenki. Podstawowa wina Andrzeja Poczobuta polega na tym, że wykonuje swoje obowiązki i to co robi, robi dobrze. Pytanie tylko, czy to co my robimy, robimy dobrze?

Dlatego zawsze na tej sali znajdzie się ktoś, niekiedy cała grupa, która nie jest w stanie utrzymać spójnej linii politycznej przez dłuższy czas. Stosujemy czasami metodę marchewki, czasami metodę kija. Zdecydujmy się przynajmniej na jakiś czas na zastosowanie jednego bądź drugiego, albo jednego i drugiego w dłuższej perspektywie czasowej. Zawsze jest tak, że Unia Europejska o tyle ponosi odpowiedzialność za to, co się dzieje na Białorusi – w małym stopniu, ale ponosi –że nie jest w stanie wobec reżimu w Mińsku utrzymać stałej linii. I o ę stałą linię apeluję i do tej izby, i do Komisji.

  Sergio Paolo Francesco Silvestris, a nome del gruppo PPE. – Signor Presidente, onorevoli colleghi, per l'ennesima volta siamo qui a denunciare la mancanza di libertà di espressione in Bielorussia, paese con cui l'Unione europea ha rapporti di vicinato. Il corrispondente in Bielorussia del maggior quotidiano polacco Andrej Poczobut infatti è stato arrestato per aver diffamato il presidente Lukashenko, rischia una pena fino a cinque anni di carcere. Non è la prima volta che questi finisce in prigione con l'accusa di aver diffamato il premier: lo scorso anno ha passato tre mesi in carcere ed è stato condannato a tre anni per aver criticato il presidente dalle colonne del suo giornale.

In Bielorussia i diritti alla libertà di espressione e di riunione sono stati gravemente limitati e manifestanti pacifici sono stati arrestati e condannati sommariamente. Inoltre ci sono state indagini rapide e imparziali sulla accuse di tortura e altri maltrattamenti e ai prigionieri di coscienza è stato negato l'accesso all'assistenza medica e legale. Con questa risoluzione il Parlamento deve chiedere con forza il rispetto dei diritti umani in Bielorussia, pregiudiziale essenziale per ogni eventuale, ulteriore e solo successivo ragionamento su iniziative di allargamento dell'Unione europea.

  Lidia Joanna Geringer de Oedenberg, w imieniu grupy S&D. – Panie Przewodniczący! Cenzura mediów i ograniczenia wolności słowa są powszechną praktyką na Białorusi. Wprowadzone w 2008 r. prawo medialne umożliwia nadzór nad mediami i rząd skrzętnie z niego korzysta. Według nieoficjalnych doniesień w 2011 r. zatrzymano co najmniej 95 dziennikarzy, 13 z nich zostało skazanych i uwięzionych z powodu rzekomego niedopełnienia obowiązków administracyjnych.

Dnia 21 czerwca władze aresztowały Andrzeja Poczobuta, polskiego korespondenta „Gazety Wyborczej” i wybitnego działacza mniejszości polsko-białoruskiej. Oskarżono go o zniesławianie prezydenta oraz podważanie zdolności sądowej i wykonawczej państwa. Mimo że Poczobut został zwolniony z aresztu 30 czerwca, zarzuty przeciwko niemu nie zostały wycofane, grozi mu wieloletni wyrok.

Apeluję stanowczo do przedstawicieli Białorusi, aby działali zgodnie z międzynarodowymi zobowiązaniami w zakresie poszanowania podstawowych praw człowieka, począwszy od artykułu 34 białoruskiej konstytucji, która gwarantuje swoim obywatelom wolność słowa i wypowiedzi..

  Charles Tannock, on behalf of the ECR Group. – Mr President, the case of the journalist and political activist Andrzej Poczobut, who is from the Polish minority in Belarus, illustrates the brutality and paranoia of the Minsk regime. Poczobut was detained by the KGB and imprisoned for allegedly slandering President Lukashenko in an article written for an Internet newspaper.

In the EU, criticism of one’s government is rightly considered legitimate debate and encouraged as an integral constituent part of the democratic processes. However, in Belarus such free expression earned Poczobut the personal ire of the President, a suspended three-year prison sentence and enduring house arrest while awaiting trial.

It has long been clear that, under the Lukashenko dictatorship, there is no rule-of-law provision, independence of the judiciary or even basic standards of human rights in Belarus. EU sanctions against the regime should be increased until Lukashenko steps down and gives Belarusians a democratic vote to determine their own future governance freely. We have had enough, in this Parliament, of another Cuba in Europe.

  Paul Murphy, on behalf of the GUE/NGL Group. – Mr President, in order to maintain its grip on power the Lukashenko dictatorship relies on brutal repression against anyone involved in opposition activity, critical journalism, the defence of minority rights, the defence of human rights or the genuine independent trade union activity which exists.

The arrest and detention of Ales Bialiatski, Chairman of the Viasna Human Rights Centre, is an illustration of this repression. He should be released immediately together with all prisoners detained for opposition to the regime.

This Parliament should also be calling for an immediate moratorium on executions and the abolition of the death penalty. I call on the international trade union movement to give its solidarity and its active support to the struggle of working people in Belarus.

The genuine grass-roots trade unions need to be built to defend the interests of the majority of the population in the struggle against mass privatisations and liberalisations of basic foodstuffs and to fundamentally democratise society and the economy to ensure that the wealth can be used in the interests of the majority of the population rather than a tiny political and economic elite.

  Jaroslav Paška, za skupinu EFD Často sa vo svete stáva, že vládcovia, ktorí cítia, že ich občania nechcú vidieť v čele krajiny, hľadajú rozličné možnosti, ako sa udržať pri moci. A čím viac narastá túžba ľudu zbaviť sa nechceného vodcu, tým tvrdšie a drastickejšie metódy musí tento vládca použiť na potlačenie pre neho nepriaznivej verejnej mienky. Novinárska obec a predstavitelia nespokojného ľudu sa potom stávajú prvými obeťami represií, pretože sú často hovorcami tých, ktorí sa domáhajú politickej zmeny.

Aj blížiace sa parlamentné voľby v Bielorusku tak prirodzene vyvolávajú zvýšenú nervozitu vo vládnych kruhoch, lebo politické nálady obyvateľstva sa čoraz viac odkláňajú od podpory súčasného režimu. Lukašenkovi prisluhovači dostávajú za svoju prácu dobré platy a politická zmena by ich mohla pripraviť o stabilné a mocensky výhodné pozície v spoločnosti. Preto neváhajú aj v mene svojho vodcu zneužívať poriadkový systém na šikanovanie nezávislých novinárov a politických odporcov.

Stretnutie ministrov zahraničných vecí Východného partnerstva v Bruseli tak môže byť dobrou príležitosťou na to, aby sme bieloruskú administratívu upozornili, že takéto maniere nie sú v civilizovanej spoločnosti prijateľné.

  Liisa Jaakonsaari (S&D). - Arvoisa puhemies, olen tavannut monta kertaa Valko-Venäjän poliittisia vankeja. Heitä on lehtimiehiä, niin kuin tässä tapauksessa herra Poczobut, ja ammattiyhdistysaktivisteja. Myös oman sisarpuolueeni monia jäseniä on tällä hetkellä vankiloissa.

Sellaista käsitettä kuin poliittinen vanki ei pitäisi olla Euroopassa. Nyt Euroopan sydämessä on ihmisoikeustilanne huononemassa, ja tämän takia Euroopan unionin toiminnan pitää olla aktiivisempaa ja jatkuvaa kaikilla tasoilla.

Erityisen tärkeää on nyt, kun valmistaudumme tähän ulkoministerien kokoukseen, nostaa siellä esityslistalle tämä ihmisoikeustilanteen huononeminen. Se on välttämätöntä. Vielä enemmän pitäisi tukea myös niitä nuoria ja opiskelijoita, jotka haluavat tulla muualle Eurooppaan opiskelemaan ja tällä tavalla kasvattaa uusia aktivisteja.

  Jacek Protasiewicz (PPE). - Panie Przewodniczący! Tydzień temu, kiedy proponowaliśmy tę rezolucję, Andrzej Poczobut był w areszcie. Dzisiaj – całe szczęście – jest już wolnym człowiekiem, aczkolwiek wypuszczonym warunkowo. Chciałbym powiedzieć o nim parę zdań, ponieważ znam go osobiście. Miałem szczęście i zaszczyt być odwiedzanym przez niego w moim domu w Polsce, kiedy reprezentował delegację Polaków z Białorusi. To jest człowiek o niezłomnym charakterze, kochający wolność i kochający ludzi, którzy go wybrali do funkcji w Związku Polaków na Białorusi. To jest człowiek, który nie da się złamać żadnemu dyktatorowi. Przypomina mi Adama Michnika, legendarną postać polskiego podziemia, polskiej opozycji demokratycznej, walki o wolność, dziennikarza i polityka. Tak jak komunizm w Polsce wyłamał sobie zęby na Adamie Michniku i jego przyjaciołach, tak samo białoruski reżim połamie sobie zęby na Andrzeju Poczobucie. Dlatego apeluję o rozsądek do Mińska, do Aleksandra Łukaszenki i wszystkich jego współpracowników – chcecie współpracy z Europą, przestańcie prześladować opozycję, w tym Polaków na Białorusi.

  Krzysztof Lisek (PPE). - Panie Przewodniczący! Są tacy, którzy mówią do nas posłów:„O rany, kolejna rezolucja w sprawie Białorusi! Przecież to nic nie daje, przecież pan Łukaszenka się nie przejmuje.” Być może te sygnały, które dochodzą na Białoruś – a na pewno dochodzą, bo dzisiaj można to wszystko przeczytać w internecie – może nie działają na samego pana Łukaszenkę, ale ja wierzę, że jest grupa ludzi wokół pana prezydenta Łukaszenki, którzy wyrzucają pracowników z pracy za to, że należą do opozycji demokratycznej i działają na rzecz wolności słowa, którzy wyrzucają studentów z uczelni, i że ci ludzie zrozumieją, że my będziemy pamiętać o ich działaniach. I będziemy konsekwentni w tym, żeby nie mogli przyjeżdżać na narty do Austrii, na wakacje na plaże w Hiszpanii. Mam nadzieję, że to wreszcie zadziała i że doprowadzimy do tego, że kiedyś na Białorusi odbędą się wreszcie demokratyczne wybory i że Białorusini sami zadecydują o swojej przyszłości.

  Sari Essayah (PPE). - Arvoisa puhemies, Valko-Venäjä on säännöllisesti täällä meidän kiireellisten ihmisoikeuskeskustelujemme kohteena. Paitsi että Lukašenkan hallinto sortaa omia kansalaisiaan, tällä kertaa loukkaus kohdistuu myös puolalaiseen lehteen, jonka toimittajana puolalaiseen vähemmistöön kuuluva Poczobut toimii. Vaikka hänet on vapautettu, kuten olemme täällä useaan kertaan todenneet, rangaistusta ei kuitenkaan ole peruttu. Häntähän rangaistiin jo vuonna 2011 ensimmäisen kerran Lukašenkan niin sanotusta kunnianloukkauksesta.

On hyvä muistaa, että Valko-Venäjän vankiloissa viruu muitakin mielipidevankeja. Itse olen esimerkiksi adoptoinut nuoren mielipidevangin Mikalai Dziadokin, jota on nyt pahoinpidelty vankilassa hänen vanhemmiltaan saamieni tietojen mukaan. Vetoankin komissaariin, että me tekisimme kaikkemme, jotta nämä mielipidevangit saataisiin vapaiksi.

  Franz Obermayr (NI). - Herr Präsident! In Zusammenhang mit dem Journalisten Andrzej Poczobut stellt sich unter anderem natürlich auch die Frage der Pressefreiheit. Die Pressefreiheit, die wir in Europa so schön als die vierte Gewalt bezeichnen, ist ein überaus wichtiger Baustein jeder Demokratie. Wie weit man dabei gehen darf und ob Beschimpfungen via Medien statthaft sind, ist wieder eine andere Frage. Ich glaube, der Umstieg nach einem halben Jahrhundert kommunistischer Diktatur zu einer Demokratie ist sicherlich ein sehr schwieriger Prozess, was das durchaus als überzogen zu bezeichnende Strafausmaß unterstreicht.

Nur bedingt verstehe ich allerdings die Reaktionen mancher europäischer Politiker, denn Poczobut ist weißrussischer Bürger, lebt und arbeitet dort. Und gerade in Europa sollten wir sehr sensibel mit der Einmischung in die Politik eines anderen Nachbarstaats sein, und ein Ausschließen eines Landes aus europäischen oder Zusammenarbeitsgremien, wie es heute auch empfohlen wurde, ist für mich der falsche Weg. Wenn wir über Pressefreiheit reden, sollten wir nicht mit unterschiedlichem Maß messen, denn wenn es um bedeutende Wirtschaftspartner von Fernost bis zur arabischen Halbinsel geht, da drücken wir manchmal beim Thema Meinungsfreiheit eine Auge zu.

  Marek Henryk Migalski (ECR), pytanie zadane przez podniesienie niebieskiej kartki”. – Ja mam krótkie pytanie, bo ja z Pana wypowiedzi nie zrozumiałem, czy Pan popiera aresztowanie Andrzej Poczobuta, czy Pan jest temu przeciwny. Czy Pan uważa, że to jest wewnętrzna sprawa Białorusi i Unia Europejska nie powinna się w to włączać? Czy też uważa Pan jednak, że to jest naszą powinnością i naszą robotą? Między innymi za to prawdopodobnie Panu płacą europejscy podatnicy, żeby Pan walczył o takich ludzi jak Andrzej Poczobut.

  Franz Obermayr (NI), Antwort auf eine Frage nach dem Verfahren der blauen Karte. – Danke, Herr Migalski, für die Frage. Das gibt mir die Möglichkeit, meinen Standpunkt zu präzisieren, was in einer Minute relativ schwierig gewesen wäre. Ja, natürlich ist das durchaus eine Angelegenheit der Europäischen Parlamentarier, sich Gedanken zu machen. Es geht mir darum, ist eine Ausgewogenheit zu finden bei der Bemessung von Verstößen gegen die Menschenrechte, gegen die Pressefreiheit, bei der wir – wie ich bereits gesagt habe – bei manchen anderen Ländern, die etwas größer und wichtiger sind als Belarus, etwas toleranter sind. Das ist das eine.

Ich glaube auch, dass wir hier natürlich im Dialog einerseits Belarus auf diesem schwierigen Weg in die Demokratie unterstützen müssen, andererseits auch sehr sensibel sein sollten. Wir dürfen natürlich nicht vergessen, dass wir uns um die Leute, die hier bedroht sind, klar kümmern müssen – aber eben sehr sensibel!

  Lena Kolarska-Bobińska (PPE). - Panie Przewodniczący! Przedstawiciel Białorusi na spotkaniach Partnerstwa Wschodniego ciągle powtarza, że Białoruś jest spychana na margines, że nie odgrywa odpowiedniej roli, że my ją źle traktujemy (my – to znaczy Unia). Jednocześnie Białoruś kontynuuje swoje niedemokratyczne procedury, wsadza ludzi do więzień i zupełnie nie przejmuje się tymi sygnałami, które są wysyłane z Unii Europejskiej, a sygnały te są coraz bardziej wyraźne.

Wzywam więc uczestników posiedzenia ministrów spraw zagranicznych krajów Partnerstwa Wschodniego, które odbędzie się w lipcu, do oceny i rewizji stosunków Białorusi z Unią Europejską, biorąc pod uwagę to, że Białoruś nie reaguje nasze sygnały i nadal dopuszcza się łamania praw człowieka. Te nasze sygnały muszą być przez ten kraj brane pod uwagę w dużo większym stopniu niż dotychczas.

Wczoraj odrzuciliśmy ACTA, bo dostrzegaliśmy w tym złożonym i skomplikowanym dokumencie jakieś niejasności, bo wiele osób czuło, że ich wolność w internecie może być ograniczona i zagrożona. To była trudna decyzja, ale podjęliśmy ją, bo wolność, tworzenie informacji i korzystanie z nich ma dla nas absolutnie podstawowe znaczenie. I dzisiaj tego samego żądamy od naszego wschodniego sąsiada, od Białorusi. Haniebne jest zachowanie władz w tym pięknym europejskim kraju, a godna największego podziwu jest postawa dzielnego, uczciwego Andrzeja Poczobuta i innych działaczy opozycji demokratycznej, dla których głośno żądamy wolności, swobody działania, solidarności i wsparcia od wszystkich instytucji europejskich dążących do tego celu.

  Connie Hedegaard, Member of the Commission. − Mr President, on 23 September Belarus will go to the polls in parliamentary elections. This debate, therefore, is very timely as we all know that freedom of expression is an essential element for any free election campaign. I think it is extremely timely that we have this very strong message from a very broad part of the European Parliament.

Vice-President/High Representative Ashton remains seriously concerned about the continued lack of respect for human rights, the rule of law and democratic principles in Belarus.

Since April, when prominent political prisoners Sannikau and Bandarenka were released, there has been no further release of political prisoners and those who have been released remain subject to heavy restrictions on their civil and political rights. Instead, we have over the last weeks again seen an intensification of the repressive policies against independent voices, notably by means of administrative fines and sentences.

The spokesperson of Vice-President/High Representative Ashton therefore last week expressed her ‘deep concern about numerous reports over the last weeks of acts of harassment of representatives of civil society, the opposition and independent media’.

The freedom of the media remains seriously curtailed in Belarus and independent journalists are frequently directly targeted by the authorities. In the statement of the spokesperson of Vice-President/High Representative Ashton, particular reference was made to journalist Andrzej Poczobut who, for his journalistic activities, as we have already heard here today, has again been charged with libel against the president.

Earlier this week, Mr Poczobut was released, but the charges against him have so far not been dropped. Other recent cases against journalists include the sentencing of Pavel Sviardlou to 15 days of administrative arrest for allegedly swearing in public.

As Belarus prepares for the September parliamentary elections, an overall climate of fear prevails in which independent political expression or manifestation is not tolerated and independent journalists are systematically impeded from exercising their activities.

The Vice-President/High Representative therefore again calls on the authorities to stop all acts of harassment of representatives of the independent media, civil society and the political opposition and to reverse the current repressive policies.

To Ms Essayah and others who want an increased effort, I have some encouraging news for you. As of today, there is a new development because the UN Human Rights Council earlier today adopted an EU-sponsored resolution on the human rights situation in Belarus, with 22 votes in favour, 20 abstentions and three votes against.

This resolution clearly urges the Government of Belarus to immediately and unconditionally release and rehabilitate all political prisoners and, moreover, the resolution establishes the mandate of a special rapporteur on Belarus who will report annually to the Human Rights Council and to the UN General Assembly.

I think that this is a major success for the European Union which this time gained a higher number of positive votes and a lower number of negative votes on the establishment of the special rapporteur than for much milder reporting mechanisms only last year. The situation is serious, but this was some good news.

  Zuzana Brzobohatá (S&D), písemně. Porušování lidských práv v Bělorusku je bohužel smutnou každodenní realitou. Zadržení Andreje Pačobuta je jedním z mnoha případů ukazujících, jak běloruská vláda zachází s novináři svobodných médií. Zadržení Andreje Pačobuta důrazně odsuzuji, protože odebírání svobody pouze na základě vyjádření názoru jde proti veškerým demokratickým principům a hrubě porušuje mezinárodní právní povinnosti Běloruska. Vzhledem k tomu, že Bělorusko je jedinou evropskou zemí, kde je povolen trest smrti, mám velké obavy ohledně dalšího vývoje v této zemi, co se aktivistek a aktivistů pro lidská práva týká. Považuji politickou situaci za velmi nebezpečnou, zejména pro aktivní občanskou běloruskou společnost, a tímto kladu důraz na důležitost ochrany a podpory aktivistů ze strany evropských institucí. Vyzývám běloruskou vládu, aby propustila z vězení politické aktivisty a aby ukončila represi nezávislých a opozičních novinářů.

  Monica Luisa Macovei (PPE), in writing. I am deeply concerned about the politically motivated arrest of Mr. Andrzej Poczobut, the Polish-Belarusian minority activist and journalist. This is not the first time that he has been imprisoned, for so-called libel against the president. The deteriorating human rights situation is reflected in the repression of the national polish minority, whose journalists are silenced, threatened, and intimidated—as well as the broader, long-standing pattern of judicial harassment against journalists, members of civil society, and human rights defenders in Belarus. Belarusian authorities have breached both national law and the UN Declaration on Human Rights Defenders and other instruments that Belarus has ratified. I urge Belarus to end arbitrary detentions and travel bans, to allow freedom of the media and freedom of expression, to allow media, opposition members, and human rights defenders to do their work. I remind the Belarusian authorities that political systems based on oppression and fear are not lasting. Fear leads to hate and hate cannot be the basis of a solid political construction, but it is the seed of destruction. Belarusian authorities, it is in your interest to stop oppression and fear.

  Kristiina Ojuland (ALDE), in writing. The case of Andrzej Poczobut is an example of systematic harassment of journalists and pro-democracy activists in Belarus. Many similar cases have been referred to in our resolution. The EU has taken decisive action against Lukashenka's regime by applying targeted sanctions and he cannot expect any concessions in relations with the European Union, unless the regime loosens the grip around free media, minorities and human rights defenders. We call the Council to consider expanding the blacklist of Belarusians, as there appear to be more people responsible for human rights violations linked to Lukashenka's regime. To help along the democratisation of Belarus we should now also reinforce our commitment to assist the civil society in their struggle that there would be more brave people like Andrzej Poczobut. Lukashenka cannot possibly arrest the whole country.

  Justas Vincas Paleckis (S&D), in writing. Freedom of media and freedom of expression are among the main pillars of democracy. I deeply regret that these freedoms are limited in Belarus by the legislation and in practice. The case of Andrzej Poczobut illustrates how authoritarian government of Belarus transforms fundamental human rights into an instrument of domestic political pressure and a tool of international influence. I reiterate that international and Belarusian activists and journalists, as well as ordinary Belarusian citizens, become victims of Belarusian controlled judiciary system and do not have right to fair trial. The European Parliament calls Belarusian authorities to respect their international commitments, to respect human rights and democratic principles. The repressions against civil society and political opposition have to be stopped. Free and fair parliamentary elections this autumn could be the good opportunity for the Belarusian government to show its good will to move towards the EU standards.

W związku z ostatnimi wydarzeniami na Białorusi, dotyczącymi aresztowania Pana Andrzeja Poczobuta dziennikarza Gazety Wyborczej oraz działacza nieuznawanego przez władze w Mińsku Związku Polaków na Białorusi uważam, że zwolnienie go z aresztu było minimalnym krokiem jaki mógł zrobić rząd białoruski, aby przybliżyć się do odwrócenia obecnej polityki represji istniejącej w tym kraju. Sam czyn aresztowania dziennikarza jest kolejnym dowodem na stale bardzo złą sytuację praw człowieka na Białorusi. Jednocześnie wyrażam głębokie zaniepokojenie tym, co dzieje się na Białorusi. Rząd białoruski zdecydowanie nadużywa swoje prawo oraz nie stosuje się do międzynarodowych zasad jak na przykład Deklaracja Narodów Zjednoczonych czy Powszechna Deklaracja Praw Człowieka. Apeluję do władz Białorusi o respektowanie zasad demokracji, w tym prawa do wolności słowa oraz do reformy prawa dotyczącego wolnych mediów i swobody zrzeszania się. Wyrok Pana Poczobuta - 3 lata w zawieszeniu to działanie, ma na celu zawieszenie jego pracy i próbę zastraszenia go więzieniem. Jeśli w prasie pojawią się kolejne artykuły, które nie spodobają się rządom białoruskim, z powrotem wróci on do więzienia? Nawołuję więc władze do stosowania się do międzynarodowych standardów prawa. Uciszanie dziennikarzy nie jest sposobem na utrzymanie dobrej reputacji państwa, a zwykłym aktem nękania i ograniczania jednostki.

  Кристиан Вигенин (S&D), в писмена форма. Подкрепям тази резолюция, защото тя осъжда затягането на режима на Лукашенко срещу гражданите на Беларус. През последните месеци, белоруските власти предприемат все по-рестриктивни мерки срещу защитниците на човешките и гражданските права в Беларус, срещу журналисти, опозиционни лидери и представители на гражданското общество, включително съдебни дела и арести. Свободата на словото е една от основните граждански свободи, гарантирана и от Конституцията на Беларус, и ограничаването й под какъвто и да било претекст е недопустимо в една правова държава. Демократичният път на Беларус е към сътрудничество с ЕС в рамките на Източното партньорство. За съжаление това сътрудничество е възпрепятствано от политиката на Лукашенко на репресии и цензура. Надявам се президентът да избере пътя на реформите и на диалога с ЕС, за да работим заедно за демократичен преход на Беларус. Решаваща роля в това отношение ще имат предстоящите парламентарни избори и оценката на международните наблюдатели за тях. Важно е не само гражданите да могат свободно да упражнят правото си на глас в деня на вота, но и предизборната кампания да даде равни възможности на всички кандидати. Само свободни и честни избори за парламент ще позволят да поканим демократично избраните представители на белоруските граждани да вземат пълноправно участие в Парламентарната асамблея Евронест.
