  President. − The next item is the report by Zita Gurmai, on behalf of the Committee on Women’s Rights and Gender Equality, on transposition and application of Council Directive 2004/113/EC implementing the principle of equal treatment between men and women in the access to and supply of goods and services (2010/2043(INI)) (A7-0044/2013).

Mr President, if you will allow me, I would like to wait until the Commissioner takes my Hungarian.

Shall I start again from the beginning?

előadó. − Tisztelt Elnök Úr! Biztos Asszony! Kedves Képviselőtársaim! Sokszor halljuk, hogy a gazdasági válság miatt nincs pénz az esélyegyenlőségre. Nem fogadom el az érvelést, ez csak ürügy! Az esélyegyenlőségre mindig figyelni kell, mert az a megoldás része. Fontos, hogy meglegyenek a megfelelő törvények, és azokat be is tartsák. Egy nagyon lényeges témáról beszélünk ma: arról, hogy miként valósultak meg a nemi alapú megkülönböztetéssel kapcsolatos, uniós szinten először megjelenő irányelvben szereplő célok. Ideális esetben ezt úgy tehetjük meg, hogy a rendelkezésünkre áll egy Európai Bizottság által készített jelentés, amelyben sok friss, vonatkozó adat van. Sajnos ez a jelentés nem készült el.

A Bizottság tájékoztatása szerint időben kész lett volna, de közbejött a Test-Achats-ügy és annak következményei. Mint ismeretes, a belga fogyasztóvédelmi szervezet keresete nyomán az Európai Bizottság kimondta, hogy 2012. december 21. után a biztosítási díjakat és szolgáltatásokat illetően már nem lehet a nemek között különbséget tenni. Ennek következményei most még nehezen láthatóak, de az áremelkedés szinte elkerülhetetlennek bizonyult. Ez a fogyasztók szempontjából – különösen gazdasági válság idején – nem elfogadható. Arra kérem hát a Bizottságot, hogy az árváltoztatást közvetlenül kövesse nyomon. Hiszem, hogy hosszú távon az irányelv felülvizsgálata elkerülhetetlen, mert a kibocsátott irányelvek nem adnak kellő jogi biztonságot.

Rövid távon pedig abban bízom, hogy a Bizottság konstruktív párbeszédet kezdeményez a biztosítási szakmával a személyre szabott kockázatértékelés során használt statisztikai módszerekről és az árrendszer újragondolásáról. De ez csak az irányelv egy cikke. Mai vitánk a meglévő adatok alapján értékeli az irányelv tagállami végrehajtásának mértékét és következményeit. Azonosítja a hiányosságokat, és lehetséges megoldásokat javasol azok pótlására. Biztos vagyok benne, hogy a Bizottság nyitott lesz a konstruktív együttműködésre. Ezért munkámmal irányt kívánok mutatni. Mire figyeljenek a fent említett jelentés elkészítése során. Jelentésem főbb pontjai távirati stílusban.

Ha az irányelv felülvizsgálatára sor kerül, igen komolyan el kell gondolkodnunk arról, hogy a média és az oktatás is hatálya alá kerüljön. Általában elmondható, hogy a Bizottság részéről nagyobb átláthatóságra van szükség a folyamatban lévő jogsértési eljárásokkal és a megtett intézkedésekkel kapcsolatban. A nemi alapon történő megkülönböztetéshez kapcsolódó jogszabályok és ítélkezési gyakorlat nyilvános adatbázisának létrehozásával javítani lehetne az áldozatok védelmét. Jól látszik ennél az irányelvnél is – mint olyan sok másiknál –, hogy a megfelelő ütemben történő átültetés nagyon fontos. Kérem a Bizottságot, hogy minden rendelkezésre álló eszközzel segítse és biztassa a tagállamokat.

Lényeges felhívni az állampolgárok figyelmét a jogaikra és jogorvoslati lehetőségeikre. Ezért hangsúlyozom az ezzel foglalkozó kampányok fontosságát. 2013 kiemelkedő alkalmat nyújt az Európáról szóló párbeszédre, hiszen idén van a polgárok európai éve, amelynek során egyik fő feladatunk az európai állampolgárok megfelelő tájékoztatása az EU adta jogaikról és lehetőségeikről. Szeretném végül, de messze nem utolsó sorban, megköszönni a titkárság, kollégáim, és az árnyékelőadók munkáját. Köszönöm továbbá az Európai Bizottság nyitottságát, és itt jelzem, hogy a további munka során is számíthatnak rám, hiszen rengeteg tapasztalatot gyűjtöttünk.   Maria Damanaki, Member of the Commission. − Mr President, the Commission welcomes this report by the European Parliament. It is a very important issue and I would like to thank the rapporteur, Ms Gurmai, the shadow rapporteurs and everybody who helped with this report.

The Commission, as a guardian of the Treaties, has a duty to monitor the implementation of EU legislation by the Member States. So, all legislation regarding equal treatment shall be fully and correctly implemented by all Member States. This is our position. Referring to this special directive, the Commission has started to monitor conformity and what the Member States have been doing since 2011. Then we started monitoring. Following the so-called ‘Test-Achats’ ruling, the Commission adopted guidelines to facilitate the transition to unisex pricing and enhance legal certainty in the insurance sector.

The delay set by the Court of Justice of the European Union to comply with the Test-Achats ruling elapsed on 21 December 2012, so we have legal certainty now. The Commission will watch closely to see whether all Member States have properly implemented the ruling in their respective national legislation.

You are asking for a new report. I can inform you that the Commission will report on the impact of the ruling in 2014 in the context of a more general report on the implementation of this directive. Then the Commission will also provide information about the outcome of the conformity checks of the national legislations.

We consider that there is no need to propose new legislation to address the principle of unisex pricing in insurance services. The judgment of the Court of Justice of the European Union is clear. That is why we think that legal certainty exists. The Court ensures equal treatment of men and women in insurance, by declaring invalid Article 5 of the Directive on equal access to goods and services. The decision of the Court is very clear – that is why we think that legal certainty is there, and there is really no need for further legal action on this point.

Promoting effective gender equality in the European Union is and will continue to be a priority of the Commission. As the rapporteur underlined – and we would like to agree – national equality bodies play an important role in this, and the Commission can reassure Parliament that it will monitor properly and accurately the situation of the equality bodies across Europe.

I would like to thank the European Parliament for keeping gender equality in Europe high on the political agenda. I would like to reiterate that the Commission strives for good cooperation with the rapporteur, Parliament and everybody here.

  Joanna Katarzyna Skrzydlewska, w imieniu grupy PPE. – Panie Przewodniczący! Sprawozdanie przygotowane przez panią Gurmai ma na celu przeanalizowanie sytuacji prawidłowego wdrożenia i stosowanie dyrektywy 113. Ponieważ Komisja Europejska wciąż nie dostarczyła danych na ten temat z poszczególnych państw członkowskich, co miała uczynić pierwotnie do końca 2010 roku, można sobie wyobrazić, że zawarte w sprawozdaniu informacje nie przedstawiają całościowo sytuacji. Dodatkowo wyrok Europejskiego Trybunału Sprawiedliwości z 2013 roku doprowadził do niepewności prawnej w sektorze ubezpieczeń społecznych, której nawet opublikowane w grudniu 2011 roku wytyczne Komisji Europejskiej nie były w stanie do końca rozwiać. Sektor ubezpieczeń stanął przed potrzebą opracowania systemu oszacowywania osobistego ryzyka na bazie innych czynników niż płeć. To bardzo ważne, aby te nowe zasady w efekcie końcowym nie doprowadziły do dalszej dyskryminacji i aby każdy, bez względu na to czy jest kobietą czy mężczyzną, ponosił ciężar składek adekwatny do swojej indywidualnej sytuacji.

Uważam, że postulaty zawarte w tym sprawozdaniu są słuszne i mam nadzieję, że Komisja Europejska weźmie je pod uwagę. Szczególnie zapisy wzywające do rewizji funkcjonowania i efektywności organów równościowych w poszczególnych państwach członkowskich, które mają stać na straży przestrzegania zasady niedyskryminacji kobiet i mężczyzn w dostępie do towarów i usług zasługują na wyróżnienie.

Wezwanie do wyjaśnienia wątpliwości legislacyjnych poprzez przedstawienie jednolitej i powszechnie obowiązującej wykładni oraz przepisów wykonawczych dla sektora ubezpieczeń na bazie wyroku Trybunału to nie mniej istotny elementy. Według mnie dyrektywa 113 jest bardzo ważnym elementem walki z dyskryminacją, dlatego powinniśmy dołożyć wszelkich starań, aby wszystkie przepisy w niej zawarte były respektowane na poziomie europejskim. Kończąc chciałam bardzo serdecznie podziękować pani poseł Gurmai za bardzo przyjemną i wzorcową współpracę.

  Edite Estrela, em nome do Grupo S&D. – Não obstante os progressos verificados e a legislação aprovada, é um facto: as mulheres continuam a ser discriminadas de várias formas. Por isso, temos de continuar a combater as desigualdades persistentes e a melhorar a legislação. A diretiva que aplica o princípio de igualdade de tratamento entre homens e mulheres no acesso a bens e serviços e seu fornecimento não tem dado os resultados desejados, uma vez que, nalguns casos, se tem revelado prejudicial às mulheres.

Em alguns Estados-Membros, a transposição da diretiva foi incompleta ou adiada, noutros, a legislação nacional resultou vaga e pouco clara, o que tem dificultado a sua adequada interpretação e aplicação e tem gerado insegurança jurídica. São inaceitáveis situações de discriminação ligadas à gravidez e à maternidade, por exemplo, no setor da habitação ou na obtenção de empréstimos, bem como no acesso a bens e serviços médicos, mais concretamente aos cuidados de saúde reprodutiva e aos tratamentos para mudança de género, previstos na legislação.

Nós apoiamos as propostas da relatora, da Senhora Zita Grumai, a quem cujo trabalho agradecemos e saudamos, e claro que são bem-vindas as diligências da Comissão para garantir a segurança jurídica, mas achamos que isso seria melhor se fosse apresentado um novo texto legislativo. É essa a nossa opinião.

  Sophia in 't Veld, on behalf of the ALDE Group. – Mr President, firstly I would like to thank the rapporteur, who has done an excellent job. Before I make my remarks to the European Commission, maybe we could all remind providers of goods and services that they do not actually have to wait for the implementation of the directive to provide their services in an equal manner. It is not only about legislation.

I hear what the Commission is saying about the reporting, but I find that a very bureaucratic approach. We do not really need to use the Test-Achats Case in order to keep the report on hold. I think there are many good reasons to report, even before 2014. Let’s face it: even if the directive has been on the table since 2004, it is only a law on paper. If you look at the actual reality that we are living in, we know – even without your report – that there is very unequal provision of services to men and women.

One point which is addressed only summarily in Ms Gurmai’s report is access to sexual and reproductive health services, which are very restricted and limited in some countries – usually for ethical and moral reasons on religious grounds. This disproportionately affects women. They are not so much directed against women, but they affect women. There is, therefore, a case of indirect discrimination. I hope that the Commission will take that into account when reporting.

Finally, when we vote separately on paragraph 19, my group will vote against that paragraph. That is the paragraph on including the media in the directive because, although sometimes I am personally disgusted – how can I put this politely – by the things I see in the media, I do not think that restricting freedom of speech is actually the way to go. We have been approached by lobbyists from the media. We will indeed vote against Article 19, but I think that the media should take responsibility themselves and make sure that they do not discriminate against women.

  Krisztina Morvai (NI), blue-card question. – My question is: do you or do you not consider it sexual discrimination that contraception and family planning is still considered to be the sole responsibility of women? Is it not discrimination? – because you were talking about discrimination in this context in another way. I think that it should be approached this way as well, especially for natural family planning or other means of contraception which can be used by men and should be advertised or marketed more, and that is in my view an equality issue. Do you agree with me?

  Sophia in 't Veld (ALDE), blue-card answer. – Mrs Morvai, I fully agree with you that it is a shared responsibility which is, unfortunately, not always the case in practice, as we know.

But my point was that when sexual and reproductive health services are provided, sometimes there are restrictions which disproportionately or very one-sidedly affect women. This is what I was arguing for: to make sure that women have access to the full range of services so that they have a choice. They should have a choice themselves, regardless of the fact that, of course, men too are responsible for family planning.

  Joanna Katarzyna Skrzydlewska (PPE), pytanie zadane przez podniesienie „niebieskiej kartki”.Pani Poseł, bardzo panią szanuję, mimo że ideologicznie pewnie troszeczkę się różnimy, ale Pani swoją wypowiedzią jak gdyby sprowokowała mnie do zadania pytania. Chodzi mi właśnie o artykuł 19 i jego drugą część, gdzie powiedziała Pani, że Pani grupa będzie głosować przeciwko, gdyż nie chce kneblować ust mediom. Proszę mi powiedzieć, gdzie taki zapis jest w tym artykule, gdyż artykuł brzmi następująco: „wzywamy Komisję, aby rozważyła” – nie nakazujemy, tylko dajemy pod rozwagę – „czy treści przekazywane w mediach i reklamie nie powinny zostać objęte przepisami niniejszej dyrektywy”.

  Sophia in 't Veld (ALDE), blue-card answer. – This is a very difficult point and we have often discussed it in the context of legislation against discrimination. As I said, I often see things in the media which I think are incredibly offensive and discriminatory, either against women or men or which are otherwise discriminatory.

At the same time, I do not think that including the media in this particular legislation would be the solution to that; I think there might be other ways. But I would also use this position to make an appeal to the media to take their responsibility themselves.

  Marije Cornelissen, on behalf of the Verts/ALE Group. – Mr President, Commissioner, if we talk about gender discrimination, we also need to talk about transgender discrimination. The Fundamental Rights Agency very recently did a survey among over 90 000 EU citizens who are LGBT persons. One of the things that they found is that a staggering 35% of transgender persons say that they have faced physical assault in the last five years. That is more than one third, and that is physical assault.

Transgender persons are among the most vulnerable people in the EU. They deserve our protection, but they are falling through the cracks in our policies. They are the ‘T’ in the LGBT movement, but the legislation on sexual orientation does not apply. They are not discriminated against on account of their sexual orientation. They are discriminated against on account of their gender, but the women’s rights movement does not take up their cause either.

Not nearly enough people care about this group. I do, and I hope a majority of this Parliament does too. Please vote in favour of our amendment tomorrow. Thank you.

  Andrea Češková, za skupinu ECR. – Pane předsedající, tato směrnice z hlediska čl. 5 odst. 2 způsobila v oblasti pojistných trhů členských států značnou právní nejistotu.

V prvním odstavci se stanovuje, aby pohlaví nebylo faktorem výpočtu výše pojistného a pojistného plnění pro účely pojištění a souvisejících finančních služeb. Ve druhém odstavci se však hovoří o povolení přiměřených rozdílů u jednotlivých pojištěnců, je-li pohlaví určujícím faktorem při zhodnocení rizika založeného na příslušných a přesných pojistněmatematických a statistických údajích.

To samo o sobě vede k nejistotě, protože nebylo definováno, co znamenají přiměřené rozdíly ve výši pojistného z hlediska pohlaví. Právní nejistota byla umocněna rozhodnutím Evropského soudního dvora.

Je zajisté správné řešit rovné zacházení s muži a ženami v přístupu ke zboží a službám. V tomto případě však jde snaha proti elementární logice pojistněmatematických algoritmů. Výše pojistného, např. u životního pojištění, byla pro ženy vždy uzpůsobena tomu, že se ženy statisticky dožívají vyššího věku, tudíž jsou pro pojišťovny v otázce životního pojištění méně rizikové.

Posuzovat výši pojistného genderovou optikou je minimálně zvláštní. Bylo-li záměrem zrovnoprávnit ženy a muže a pomoci jim k rovnějšímu přístupu ke službám, pak se tato konkrétní snaha obrátila proti ženám samotným.

Hovořím o životním pojištění, neboť takto to proběhlo v České republice, kterou zde zastupuji. V jiných členských státech to takto proběhlo u jiných druhů pojištění.

  Inês Cristina Zuber, em nome do Grupo GUE/NGL. – Senhor Presidente, estamos, em geral, de acordo com este relatório. É inaceitável que se propague como princípio da União Europeia, em diversas campanhas de marketing, a igualdade entre homens e mulheres como valor inquestionável e que depois, na prática, se ceda aos lobbies das companhias seguradoras e do setor financeiro, prevendo-se a derrogação do princípio, o tal, inquestionável, mas parece que apenas em algumas situações.

É inaceitável que o sexo seja considerado para colocar diferenciações dos prémios e prestações dos segurados. É inadmissível que a vida das mulheres que querem contratualizar um seguro, vejam a sua vida privada devassada por formulários que as inquirem sobre a sua vida reprodutiva, nomeadamente, sobre se realizaram alguma vez uma interrupção voluntária de gravidez.

Por outro lado, é evidente que a atual diretiva não aborda questões fundamentais, nomeadamente dos conteúdos na comunicação social e na publicidade, que, como todos sabemos, são dos meios que mais tratam a mulher de forma estereotipada e discriminatória. Por fim, é importante não esquecer que, hoje, as discriminações que afetam as mulheres no acesso a bens e serviços estão a aumentar rapidamente a outro nível, ao nível mais fundamental da capacidade de aquisição e de escolha resultante das diferenciações no acesso ao emprego de qualidade e no acesso a salários e pensões decentes, ou seja as desigualdades entre homens e mulheres aprofundam-se nos mais elementares planos da vida social, num retrocesso civilizacional sem precedentes, demonstrando a falência destas políticas orientadoras da União Europeia.

  Edit Bauer (PPE). - Megköszönve az előadó munkáját két megjegyzést szeretnék fűzni magához a jelentéshez. Az egyik a Test-Achats döntéssel kapcsolatos. A bírósági döntés nyilvánosságra hozatala a médiában leggyakrabban azzal a kommentárral jelent meg, hogy a nők most megkapták, amit akartak, többet fizethetnek a balesetbiztosításért. Ez többé-kevésbé be is következett, a biztosítók többnyire felemelték a női gépkocsivezetők biztosítási díjait. Persze ugyanakkor a férfiak biztosítási díját nem csökkentették, ahogy arról Češková kolléganő is szólt. Ugyancsak nem, vagy alig alkalmazták a személyre szabott elbírálás lehetőségét. A jelentés teljes joggal állapítja meg, hogy a jogi bizonytalanság továbbra is fennáll, mert a Bizottság iránymutatása nem törvényerejű.

A másik megjegyzésem a jelentés azon megállapítására vonatkozik, hogy a nők hátrányos megkülönböztetése nagyrészt a terhességgel és az anyasággal függ össze. Ezt bizonyítja az Eurobarométer egyik legutóbbi felmérése. Úgy vélem, hogy erre a Bizottságnak nagyobb figyelmet kellene fordítania.

  Corina Creţu (S&D). - O felicit, în primul rând, pe colega noastră, Zita Gurmai, pentru acest raport şi pentru întregul ei efort de promovare a drepturilor femeii.

Din păcate, femeile continuă să fie principalele victime ale violenţelor domestice, ale discriminărilor salariale şi ale inegalităţilor. Ele suferă mai mult decât bărbaţii din cauza disponibilizărilor şi a reducerilor bugetare, pătrund mai greu pe piaţa muncii şi beneficiază de mai puţine posibilităţi de formare profesională. Şi tot femeile sunt mai afectate de decalajele salariale, aceste inegalităţi împingându-le, adesea, în pragul sărăciei. Este grav faptul că, deşi multe din răspunderile în familie revin femeilor, în numeroase societăţi europene acestora le este mai dificil decât bărbaţilor să închirieze o locuinţă, să obţină bunuri şi să beneficieze de servicii medicale, de asigurări. Mamele singure întâmpină mai multe greutăţi la accesarea de credite, iar femeile însărcinate obţin mai dificil azil decât bărbaţii.

Ne confruntăm, aşadar, cu dificultăţi majore în calea afirmării sociale şi a dezvoltării personale ale femeilor, iar acest decalaj de gen reprezintă un obstacol în calea relansării economice. Pentru garantarea drepturilor femeilor consider şi eu, aşa cum s-a spus aici, că este prioritară transpunerea şi aplicarea Directivei 113/2004 privind egalitatea de tratament pentru accesul la bunuri şi servicii în toate statele membre.

Solicit Comisiei să monitorizeze transpunerea directivei pentru a asigura femeilor din Uniunea Europeană protecţia necesară împotriva discriminării.

  Joanna Senyszyn (S&D). - Dziękuję, Panie Przewodniczący! Gratuluję mojej koleżance znakomitego sprawozdania. Apeluję do Komisji o przedstawienie wniosków w sprawie dostosowania dyrektywy równościowej oraz aktualnych danych dotyczących jej wdrażania.

W Polsce debaty nad przygotowaniem ustawy o wdrożeniu niektórych przepisów unijnych w zakresie równego traktowania trwały latami. Konserwatyzm prawicy i sprzeciw kościoła katolickiego opóźniały wdrażanie antydyskryminacyjnych standardów do polskiego prawa. Dopiero realna groźba kar finansowych skłoniła rząd i sejm do przyspieszenia prac i przyjęcia ustawy w 2010 r. Polska wywiązała się z unijnych zobowiązań minimalnie i wybiórczo. Najkrytyczniej oceniają ustawę jej adresaci, zwłaszcza dyskryminowanie z powodu płci, orientacji seksualnej, rasy, religii, niepełnosprawności i wieku. Za mało skuteczne są organy ds. równości. Polskie biuro pełnomocniczki jest przykładem organu, który zamiast działać prewencyjnie i antycypować zagrożenia, jedynie reaguje na pojawiające się oznaki dyskryminacji. Polska nie realizuje w dostatecznym stopniu reprodukcyjnych praw kobiet, ograniczony jest dostęp do antykoncepcji, aborcji, badań prenatalnych, rzetelnej edukacji seksualnej w szkołach. Polskie media, podobnie jak inne instytucje, utrwalają dyskryminujący kobiety obraz życia społecznego. Przykładowo ponad 85% osób zapraszanych do programów publicystycznych to mężczyźni. Sytuacja jest zła. W 2012 r. Polska zajmowała 53. miejsce w rankingu „Gender Gap Index”. To duży spadek – w 2011 r. mieliśmy 42. lokatę.

  Silvia Costa (S&D). - Signor Presidente, concordo decisamente con l'impostazione della relazione della collega Gurmai, che ha colto l'occasione sia per chiedere alla Commissione di presentare, seppure con grande ritardo, la sua relazione sull'applicazione della direttiva del 2004, che in particolare si sofferma su alcuni punti molto importanti.

In particolare, oltre agli aspetti già sollevati dai colleghi che mi hanno preceduto, vorrei ricordare la problematicità che deriva dalla sentenza Test Achats della Corte di giustizia del marzo 2011, che dato vita alle linee guida interpretative della Commissione, le quali modificano di fatto l'interpretazione della direttiva e, a mio giudizio, dovrebbero essere in realtà modificate con una norma analoga alla direttiva, perché ci sono molti dubbi interpretativi.

Il tema centrale della questione è il seguente: fino allo scorso dicembre, negli Stati membri era possibile applicare una deroga al principio della differenziazione dei premi sulla base del sesso per una ragione statistica e attuariale, ovvero le donne statisticamente vivono più a lungo degli uomini, hanno un comportamento migliore alla guida delle autovetture e una diversa problematica in merito alla loro salute. Su questi dati si incideva anche con verifiche e parametri di tipo individuale.

Le linee guida e la sentenza di cui sopra hanno fatto sì che oggi vi sia la possibilità di trattare soltanto su base individuale; senza alcun monitoraggio e una maggiore chiarezza nelle indicazioni. Oggi abbiamo il seguente dato nel mio paese, così come in altri: le giovani donne che stipulano, ad esempio, assicurazioni auto pagano fino al 18 percento in più di prima.

Chiedo pertanto che sia prestata una maggiore attenzione alle discriminazioni che di fatto colpiscono le donne e una più specifica attenzione alla gradualità di attuazione di queste nuove norme che in realtà le penalizzano.

  Minodora Cliveti (S&D). - Egalitatea între femei şi bărbaţi este unul dintre principiile fundamentale ale dreptului comunitar. În acest context, o salut şi o felicit pe raportoarea noastră. Salut elaborarea acestui raport din proprie iniţiativă, care vine să înlăture lacunele încă existente în Directiva 113/2004, aferentă aplicării principiului egalităţii între femei şi bărbaţi privind accesul la bunuri şi servicii şi furnizarea acestora. Susţin propunerea raportoarei, care invită Comisia Europeană şi statele membre să ia măsuri concrete pentru explicarea acestei directive şi a impactului său, cu exemple concrete, pentru a se asigura că atât femeile, cât şi bărbaţii pot utiliza pe deplin şi în mod adecvat directiva, ca un instrument eficient de protecţie a drepturilor lor.

Salut, de asemenea, ideea creării unei baze de date, cuprinzând legislaţia şi jurisprudenţa în domeniu, precum şi mai buna protecţie a victimelor discriminării pe criterii de gen. De asemenea, insist asupra necesităţii publicării raportului Comisiei Europene privind aplicarea directivei, care trebuia publicat în 2010, dar a fost amânat pentru 2014.

  Sergio Gaetano Cofferati (S&D). - Signor Presidente, desidero anzitutto esprimere le mie congratulazioni alla collega Gurmai per il lavoro svolto.

Vorrei poi rapidamente sottolineare – e mi rivolgo alla signora Commissario – quella che mi appare come una nuova discriminazione, troppe volte sottovalutata, perché si colloca a cavallo tra il lavoro e lo stato sociale, ed è quella relativa alla previdenza: con il passaggio, nel corso del tempo, da sistemi a ripartizione a sistemi a capitalizzazione, le donne stanno subendo un danno grave perché i lavori di cura familiare e la maternità sono a loro carico e siccome alla fine la pensione viene pagata sulla base dei contributi versati, anche a parità di età anagrafica, le donne hanno contributi inferiori a quelli degli uomini, per cui la parità di età come accesso alla pensione, se non è accompagnata da forme di compensazione per colmare il vuoto determinato dalla maternità, continuerà a discriminare le donne.

In breve, quello che viene presentato come un grande elemento di parità, in verità è la costruzione di una nuova e pesantissima discriminazione.

  Anna Záborská (PPE) - Chcela by som sa poďakovať pani Gurmai za túto správu, aj keď musím priznať, že nerozumiem jej obavám z nerovnakého zaobchádzania medzi ženami a mužmi v súvislosti s predajom antikoncepcie a vykonávaním interrupcií. No o to viac vítam otvorenie diskusie o diskriminácii tehotných žien a matiek v oblasti bývania a získavania úverov. Táto diskriminácia nie je založená na stereotypoch, ale na fakte, že žena, ktorá sa stane matkou, prichádza o svoj príjem a je odkázaná na štátnu podporu. Jej postavenie je často horšie ako situácia nezamestnaného muža. Príčinou je zlyhanie spoločnosti pri ohodnotení zodpovedného materstva. Naším cieľom pritom musí byť realistické ocenenie a najmä zaplatenie práce matiek starajúcich sa o deti a členov rodiny. Len takto je možné efektívne skoncovať s ich diskrimináciou v oblasti úverov a bývania.

  Silvia-Adriana Ţicău (S&D). - Derogarea prevăzută la articolul 5 alineatul (2) din cadrul Directivei 113/2004 a oferit posibilitatea de a permite diferenţe proporţionale în materie de prime şi prestaţii pentru cei asiguraţi în cazul în care criteriul de gen reprezintă un factor determinant în evaluarea riscurilor.

Conform Hotărârii Curţii Europene de Justiţie în cazul Test-Achats, din martie 2011, articolul 5 alineatul (2) din directivă este contrar realizării obiectivului privind egalitatea de tratament între femei şi bărbaţi şi este incompatibil cu Carta drepturilor fundamentale ale Uniunii.

Solicităm Comisiei să revizuiască această directivă şi să includă prevederi cu caracter obligatoriu pentru clarificarea situaţiei cu privire la societăţile de asigurări şi serviciile financiare conexe. Solicităm Comisiei şi statelor membre să ia măsuri concrete pentru a garanta că toţi cetăţenii Uniunii Europene pot utiliza pe deplin şi în mod adecvat directiva, ca instrument eficient de protecţie a drepturilor lor referitoare la egalitatea de tratament în ceea ce priveşte accesul la toate bunurile şi serviciile.

  Krisztina Morvai (NI). - Nem elég, hogy a nőknek joguk legyen a diszkriminációmentes elbánáshoz. Tehát pl. ahhoz, hogy egy kisvállalkozás indításakor bankkölcsönt vehessenek föl ugyanúgy és ugyanolyan feltételekkel, mint a hasonló helyzetben lévő férfi. Vagy hogy munkahelyre való jelentkezéskor ne érje őket hátrányos elbánás azért, mert a női nemhez tartoznak. Vagy munkavégzés során azért, mert várandósak vagy édesanyák lesznek. Nem elég, hogy ez tény, és ezt mondja a jogszabály vagy az európai uniós norma. Az is fontos lenne, hogy a nők tisztában legyenek ezekkel a jogaikkal és azzal, hogy az Európai Unió az egyenlő elbánás kötelezettségét támasztja, és hogy jogaikat érvényesíteni is tudják.

Kérdezem egyfelől a Bizottság képviselőjét, másfelől pedig az előadót, magyar honfitársnőmet, Gurmai Zitát – akinek gratulálok –, hogyan lehetne elérni azt, hogy pl. közös hazánkban, Magyarországon a nők tisztában legyenek a jogaikkal, és pl. a durva munkahelyi diszkriminációk sorozatánál, illetve a munkahelyre való fel nem vételek miatt európai uniós normákra hivatkozva jogérvényesítési lehetőséget kapjanak?

  Sari Essayah (PPE). - Arvoisa puhemies, miesten ja naisten yhdenvertaisen kohtelun periaate on tärkeä, ja voin vain yhtyä mietinnön vaatimukseen komission seurantakertomuksen tärkeydestä, jotta voimme arvioida direktiivin voimaanpanoa jäsenvaltioissa.

Sukupuolen ja vakuutustuotteiden välinen suhde on sen sijaan monimuotoisten vakuutustuotteiden takia hankalampi kysymys. Jos tilastot osoittavat, että naiset ottavat liikenteessä pienempiä riskejä ja heille tapahtuu vähemmän liikenneonnettomuuksia ja he elävät kauemmin, niin miksi näitä objektiivisia tietoja ei saisi huomioida vakuutusmaksuissa?

Itse pelkään, että nyt tuomioistuinpäätöksen jälkeen ainoa muutos tulee olemaan se, että naisten vakuutusmaksut näillä aloilla nousevat. Olen huolissani tämän poikkeusmahdollisuuden poistumisesta. Kun tarkastellaan taas eläkevakuutuksia, niin monesti naisten äitiys- ja hoitovapaat pienentävät eläkekertymää. On hyvä, että mietinnössä on huomioitu se tosiasia, että monet epätasa-arvoa luovat käytännöt syntyvät stereotypioista, joita esiintyy mainonnassa ja myös mediassa.

  Mojca Kleva Kekuš (S&D). - Rada bi podprla poročevalko Zito Gurmai, ki se v bistvu prvič na ravni EU ukvarja z obravnavo enakosti spolov in diskriminacijo zaradi spola izven področja zaposlovanja.

Gre za odlično poročilo, ki ga danes obravnavamo. In res bi želela vse svoje spoštovanje do poročevalke, ki se je lotila tega res pomembnega problema.

Načelo enakosti kot temelj zakonodaje EU je hkrati kazalec stopnje demokratičnosti in sploh demokracije v Evropski uniji. Dostop do blaga in storitev je nekaj, kar pomembno vpliva na vse nas. Zato se moramo boriti za to, da na tem področju ne prihaja do diskriminacije.

Neoviran dostop do blaga in storitev pozitivno vpliva na spodbujanje gospodarske aktivnosti, tako da več ljudi, ki ima neoviran dostop do blaga in storitev, lahko koristi našim podjetjem v teh težkih časih.

Posebno podporo pa bi rada dala ideji, da se v nadzor direktive vključi tudi medije, celotno splošno javnost in organizira informacijske kampanje.

  Maria Damanaki, Member of the Commission. − Mr President, I would like to thank all our colleagues for their interventions.

I can share the concerns expressed by all of you that in real life discrimination is still there, despite our common efforts and our legislation. Discrimination exists, and it exists in some areas which have to do with this directive; but it also exists in general. Of course we cannot handle all the problems now –for example, pensions are not included in this case; but we have to take care of other areas, for example your concerns in connection with the insurance market.

Let me answer your questions. As regards legal certainty, the Commission thinks that we have legal certainty, following the decision of the Court and our Commission guidelines. The issue here is not legal uncertainty – there is legal clarity – but of course I can understand that some of you would like to amend the directive in what you think would be a better way. This is not an easy exercise though. We have to bear in mind that amending the directive means that we have to be sure that we can obtain a unanimous vote in the Council, which will not be easy, as you can imagine.

In any case, what the Commission is saying is that we are going to report on this directive, as requested, in 2014, bearing in mind all your concerns. Then we can decide together what we are going to do.

This is about legislation. But I agree with you that the two main challenges that we face are application and implementation. Here we have to do our best. What we can say regarding the insurance market, for example, is that the Commission remains vigilant in following the evolution of insurance markets in order to detect any unjustifiable rise in prices attributed to the Test-Achats ruling, including tools available under competition law in the event of alleged anti-competitive conduct. So here we have to continue with our competition services and competition rules to find out if there is a problem, as we have already said.

Referring to the problem as a whole which we have already mentioned, I would like to underline that the Commission is preparing the report – but this does not mean that we are not taking action. I would like to inform you that three infringement cases are currently open against Member States for non-conformity with the directive. This is a problem of application. Germany, Denmark and Lithuania are under investigation for the application of this directive, and I think that we can do more following an assessment of the replies of the Member States in this legislation.

  Zita Gurmai, rapporteur. − Madam President, I would like to thank the Commissioner and my colleagues for their highly valuable input and comments. I think it is very clear that Parliament recognises the importance of this dossier and overall of ensuring gender equality in all fields, including access to and the supply of goods and services.

As I said in my introductory remarks, this is the first ever piece of legislation to tackle gender equality in access to and the supply of goods at European level. Thanks to Anadio Montopolo. I believe that we all agree that, just as with all directives, proper implementation is the key here and, of course, the role of the Commission is paramount.

In order to assess this, we are in need of up-to-date and accessible data. There are positive experiences when it comes to implementation of this directive, but it is clear that further steps are necessary in certain areas. I hear the points that some of you raised regarding my reference to the inclusion of the media and advertisements in the scope of the directive: should there be revision? Let me assure you that I am just as committed to the freedom of the press as you are, but I am also committed to eradicating gender-based stereotypes, and these fields do play a major role in the birth, survival and, sometimes, strengthening of these stereotypes. I am also confident that, with proper drafting, these two things can be reconciled, so I am counting greatly on you.

Finally, I would like to reiterate once more what I said about the changes in pricing of certain insurance products. I do not doubt that the industry uses reliable data – and differentiation is not discrimination. However, we do have an ECJ judgment, and we need to adapt to this in a way that is not detrimental to the customer.

I insist on this point, and in this I count on the Commission and the insurance industry to enter into a constructive and fruitful discussion, either regarding new factors in pricing or a revision of the directive, or both. During the current crisis, citizens keep losing trust and faith in the European Union. Let us try to reverse this negative trend.

  Vilija Blinkevičiūtė (S&D), raštu. – Sveikinu pranešėją už gerą pranešimą, nes šiame pranešime ir Tarybos direktyvoje ES lygiu sprendžiamos egzistuojančios problemos dėl lyties įvairiose srityse. Be to, šiuo pranešimu Europos Parlamentas siekia įvertinti šios Tarybos direktyvos įgyvendinimo valstybėse narėse pažangą bei nustatyti esamas problemas. Nors ši Tarybos direktyva, įgyvendinanti vienodą požiūrį į moteris ir vyrus, buvo priimta beveik prieš dešimtmetį, vis dar yra nemažai problemų, susijusių su diskriminacija dėl lyties, naudojantis prekėmis ir paslaugomis bei jas tiekiant. Taigi, valstybės narės turėtų atkreipti didesnį dėmesį į diskriminaciją dėl lyties ir kuo greičiau perkelti šios direktyvos nuostatas į savo nacionalinę teisę, nes vis dar esama teisinių spragų. Be to, reikėtų geriau koordinuoti ir stebėti lyčių lygybės įgyvendinimą kontroliuojančias institucijas, kad jos garantuotų kuo geresnį šios direktyvos įgyvendinimą šalyse ir užtikrintų, jog nebūtų pažeistas vienodo požiūrio į moteris ir vyrus principas. Dar reikėtų atkreipti dėmesį į tai, jog kai kuriose lyčių lygybės institucijose nepakanka darbuotojų, neretai trūksta finansinių išteklių, ne visada keičiamasi gerąja patirtimi, o tai neužtikrina veiksmingo darbo, kovojant su diskriminacija lyties pagrindu. Taip pat raginu Europos Komisiją atidžiai stebėti bet kokius diskriminacijos atvejus, ypač susijusius su nėščiomis ir maitinančiomis, vienišomis motinomis, joms siekiant gauti medicinines prekes ir paslaugas arba siekiant gauti paskolą butui ar verslo kreditą.

  Vasilica Viorica Dăncilă (S&D), în scris. Într-o Europă ameninţată de îmbătrânire, multe femei decid târziu să devină mame, ceea nu este benefic pentru Uniunea Europeană. În mai multe state membre se constată că acestea se confruntă cu o serie de dificultăţi în perioada de sarcină şi cea de îngrijire a copilului, pornind de la găsirea unei locuinţe de închiriat sau dificultăți în obținerea unor împrumuturi, precum şi la capitolul plăţilor pentru asigurările pentru boală sau accidente, prețul acestora fiind în aceste ţări diferenţiat faţă de preţul plătit de bărbaţi. Pe de altă parte, directiva în sine nu reglementează discriminarea împotriva părinților, strâns legată de perioada de maternitate, cu accent pe accesul la spațiile publice, transportul în comun sau lipsa facilităților pentru părinții cu copii mici sau copii cu handicap. Având în vedere educația și rolul important pe care îl joacă aceasta în crearea şi menținerea de stereotipuri bazate pe gen, consider că trebuie lansate campanii de informare pentru a evita apariţia şi menţinerea de diferențe semnificative între statele membre în ceea ce privește discriminarea privind accesul la bunuri și servicii și furnizarea de bunuri și servicii pentru perioada de sarcină şi maternitate, dar şi pentru o bună informare a cetățenilor UE cu privire la drepturile lor.

  Jutta Steinruck (S&D) , schriftlich. – Die Umsetzung der Rechtsgrundlagen des Allgemeinen Gleichbehandlungsgesetzes ist Voraussetzung dafür, dass Gleichberechtigung zur Realität unserer Gesellschaft wird. Einheitliche Versicherungsverträge für Männer und Frauen sind ein wichtiger Bestandteil des Gleichstellungsgesetzes und müssen zum allgemeinen Standard werden. Deswegen unterstütze ich die Berichterstatterin in ihrer Forderung an die Kommission, die Umsetzung durch die nationalen Gleichstellungsbehörden besser zu überwachen und vorhandene Lücken zu schließen. Die private Versicherungswirtschaft hatte genügend Zeit und Möglichkeiten, ihre Tarife entsprechend dem Urteil des EuGH anzupassen. Die „Befürchtung“, dass diese Regelung bald auch zu gleichen Leistungen in der betrieblichen Altersvorsorge – und damit zu Milliardenrisiken für Betriebe – führen wird, halte ich für ungerechtfertigt und übertrieben. In meiner Arbeit im Beschäftigungsausschuss setze ich mich mit aller Kraft dafür ein, dass die Betriebsrente keinen Schaden durch eventuelle Gesetzesänderungen erleidet. Die Problemstellen sehe ich dabei nicht darin, dass Frauen und Männern die gleichen Rechte zustehen sollen. Gleichbehandlung ist in der betrieblichen Vorsorge oftmals bereits Standard, weil sie auf einer kollektiven statt individuellen Betrachtungsweise basiert. Andere Vorschläge der Kommission beeinflussen die Sicherheit der Betriebsrenten viel stärker. Daher darf die Tatsache, dass Frauen in Zukunft keine höheren Beiträge für schlechtere Leistungen zahlen, keinesfalls als Argument gegen die Gleichberechtigung in Frage kommen.

Deşi în unele state membre s-au făcut paşi importanţi pentru a asigura accesul nediscriminatoriu la servicii, au fost raportate cazuri de discriminare pe bază de gen, de exemplu discriminări legate de sarcină și maternitate cu privire la sectorul locuințelor (închiriere) sau dificultăți în obținerea unor împrumuturi. Accesul la produse și servicii medicale s-a dovedit de asemenea problematic, în special accesul la serviciile de sănătate reproductivă. Un aspect sensibil este şi discriminarea legată de alăptare. Chiar dacă directiva privind serviciile nu reglementează discriminarea împotriva părinților, această formă de discriminare, strâns legată de maternitate, a fost subliniată ca fiind problematică, în special în ceea ce privește accesul la spațiile publice, transportul în comun sau lipsa facilităților pentru părinții cu copii mici sau copii cu handicap. În orice caz, este nevoie în primul rând ca legislaţia europeană să fie implementată cât mai rapid în statele membre şi ca aceasta să fie suplimentată de legislaţii naţionale care să asigure un tratament egal pentru toţi cetăţenii când vine vorba despre accesul la servicii.
