  Franziska Keller, Verfasserin. − Herr Präsident! Wir unterhalten uns heute über Menschenrechtsverletzungen in Kasachstan. Dabei müssen wir beachten, welches Interesse auch die Europäische Union in diesem Land hat, denn viele europäische Firmen sind momentan – und waren es in der Vergangenheit – in Kasachstan aktiv.

Die EU hat ein signifikantes ökonomisches Interesse in Kasachstan. Die EU ist Kasachstans größter Handelspartner und mit dabei bei den größten Posten von Öl und Gas. An der Ausbeutung von Öl und Gas sind auch europäische Firmen beteiligt. Und wir sehen dabei immer wieder Menschenrechtsverletzungen, nicht zuletzt bei dem großen Angriff auf Arbeiterinnen und Arbeiter im Ölsektor.

Europäische Unternehmen haben demzufolge eine große Verantwortung bei der Einhaltung der Menschenrechte. Wir als Europäisches Parlament haben eine Verantwortung, darauf zu achten, dass die Unternehmen diese einhalten. Deshalb brauchen wir beim neuen Partnerschaftsabkommen mit Kasachstan ein robustes Nachhaltigkeitskapitel mit einem funktionierenden Monitoringmechanismus, damit wir überprüfen können, ob unsere Forderungen eingehalten werden.

Wir brauchen darüber hinaus ein neues Konzept für die Extraktion von Rohstoffen, das Menschenrechte und soziale wie ökologische Standards in den Mittelpunkt stellt, das auch den Technologietransfer vorantreibt, lokale Wertschöpfung und Diversifizierung der Wirtschaft in den Blick nimmt und dabei auch die regionale Integration fördert. Hierbei sind Menschenrechte die zentrale Herausforderung.

Menschenrechtsverletzungen im extraktiven Sektor sind enorm. Wir dürfen in Zentralasien die europäischen Eigeninteressen niemals über Menschenrechte stellen. Entwicklungszusammenarbeit darf auf gar keinen Fall wirtschaftlichen Zwecken alleine dienen.

  Sari Essayah, laatija. − Arvoisa puhemies, hyvä komission jäsen, Euroopan parlamentti on useissa yhteyksissä nostanut esille Kazakstanin ihmisoikeustilanteen.

Marraskuussa 2012 keskustelimme suosituksista EU:n ja Kazakstanin yhteistyösopimukseen liittyen, ja liitimme siihen vahvan ihmisoikeuslausekkeen. Aivan kuten Franziska Keller täällä sanoi, niin talousintressit eivät saa ajaa ohi ihmisoikeuksien. Puhemies Martin Schulz on ollut yhteydessä maan ulkoministeriöön, koska kollegamme Paul Murphyn viisumi maahan on evätty jo kahdesti ilman perusteita.

Nämä huomiot ihmisoikeustilanteeseen ovat todella olleet oikeutettuja, sillä tilanne on pahentunut huolestuttavasti joulukuun 2011 väkivaltaisten yhteydenottojen jälkeen. Tuolloinhan hallinto hyökkäsi ilman perusteluja suhteettomasti valtaa käyttäen protestoivia ja lakkoilevia öljytyöntekijöitä kohtaan ja ainakin 16 ihmistä kuoli ja oppositiojohtaja Vladimir Kozlov sai 7,5 vuoden vankeustuomion. Nyt kokoontumisvapaus on tiukasti kontrolloitua, uskonnon harjoittamista rajoittava tiukka laki on astunut voimaan ja hyökkäyksiä journalistien kimppuun on tehty. Sen tähden meidän täytyy jatkaa tätä painostamista Kazakstanin hallitusta kohtaan.

  Liisa Jaakonsaari, author. − Mr President, last November in the context of our report on enhancing the EU-Kazakhstan PCA, we called on Kazakhstan not to misuse the legitimate fight against extremism as an excuse to ban opposition activity and hinder freedom of expression. However, Kazakhstan ignored our call and banned the opposition party Alga! and quite a number of media outlets on charges of extremism.

The silencing of free expression and critical views violates international and human rights and needs to be addressed immediately. It is good to hear that Kazakhstan is taking the first steps to reform its criminal code. We urge Kazakhstan once again to bring this into line with international law and to amend the problematic article inciting social discord. We continue to insist strongly that Kazakhstan release all persons convicted on the basis of weak criminal charges, particularly Vladimir Kozlov and Vadim Kuramshin, and we repeat our call to the European Union and the European External Action Service to play a more proactive role.

  Leonidas Donskis, author. − Mr President, I have spoken many times about how the situation has deteriorated in Kazakhstan. This time I should like to focus on very concrete facts.

Much to my regret I have to say that the situation is really deteriorating. Vladimir Kozlov, who was arrested immediately after he visited this Parliament, is kept in prison under very degrading conditions. More than that, Aliya Turusbekova, his wife, is being increasingly threatened and intimidated by the authorities for what is described as ‘subversive activities’. This is, in fact, nothing other than a crackdown – and very brutal one –on freedom of expression and opposition. Journalists are being blackmailed and intimidated by the government.

For lack of time, I shall not go deeper into detail, but most importantly Vladimir Kozlov’s health is deteriorating. As a matter of fact, enormous pressure is being put on him, including slander and degrading treatment in prison. That is why time is precious. I am really worried about his health and life and we have to act immediately.

  Marie-Christine Vergiat, auteure. − Monsieur le Président, je regrette ce qui s'est passé dans le précédent débat. J'ai l'habitude de respecter l'ensemble de mes collègues et de ne pas faire d'attaque personnelle. Je m'en tiendrai là. Je voudrais juste dire que certains, que je peux comprendre et qui viennent notamment des pays de l'Est, ont tendance à s'en tenir à un anti-communisme primaire au mépris de l'histoire des communistes en Europe occidentale, qui ont souvent payé de leur vie la lutte contre les dictatures. Ne l'oubliez pas! Je pense que l'histoire doit être complète.

Revenons au Kazakhstan. Depuis notre dernière résolution en mars 2012, la situation au Kazakhstan n'a fait que se détériorer. De plus en plus d'opposants politiques, de syndicalistes, de défenseurs des droits de l'homme et de journalistes sont conduits en prison. Je voudrais particulièrement attirer votre attention sur les cas de Vadim Kuramshin, Rosa Tuletaeva et Vladimir Kozlov, dont la santé est particulièrement préoccupante.

Des lois sécuritaires liberticides sont votées, des médias critiques sont fermés, la pratique de la torture s'étend dans les prisons, le système judiciaire est resté sclérosé. Un exemple: suite à la répression sanglante de décembre 2011, cinq policiers ont été condamnés à des peines légères pour abus de pouvoir, mais personne n'a été condamné pour les seize morts des manifestants. Dans le même temps, dix-sept manifestants ont été condamnés à de très lourdes peines de prison. Et on pourrait aussi parler du renvoi forcé des réfugiés ouzbeks.

Pour autant, les négociations vers un accord renforcé de partenariat et de coopération avec le Kazakhstan vont bon train, comme si de rien n'était, alors que le Service pour l'action extérieure affirme que le Kazakhstan ne s'est pas conformé à plus de 75 % au plan d'action national pour les droits de l'homme établi avec l'Union européenne. Quelle crédibilité l'Union européenne pense-t-elle avoir dans ces conditions?

Le gouvernement du Kazakhstan est un gouvernement autoritaire, avec lequel il ne peut pas y avoir d'accord tant que les droits de l'homme seront foulés aux pieds.

Je vous en conjure, Madame la Commissaire, ne répétez pas dans le cadre du partenariat oriental les mêmes erreurs que celles qui ont été faites dans le cadre du partenariat méridional, notamment en Tunisie, où l'Union européenne a soutenu jusqu'au bout le dictateur Ben Ali. Au-delà des mots, apprenez à tirer les leçons des erreurs du passé. C'est la crédibilité de l'Union européenne en matière de droits de l'homme qui est en jeu. Nous étions hier le 17 avril, date de la Journée internationale des prisonniers politiques. Demandez au Kazakhstan de libérer tous les prisonniers politiques et notamment ceux dont la santé est particulièrement menacée.

  Tomasz Piotr Poręba, autor. − Panie Przewodniczący! Stosunki z Kazachstanem są bez wątpienia dla Unii Europejskiej szczególnie ważne, gdyż chodzi o kraj odgrywający ważną rolę polityczną w Azji Centralnej, w regionie o strategicznym znaczeniu dla światowego bezpieczeństwa. Dobrze, że Parlament Europejski dzisiaj po raz kolejny słusznie wyraża zaniepokojenie sytuacją w tym kraju. Z niepokojem przyjmujemy płynące z Kazachstanu informacje o problemach z zakresu praw człowieka oraz o naruszeniach demokratycznych standardów w systemie funkcjonowania państwa. Oczekujemy od władz Kazachstanu jak najszybszego przywrócenia właściwych standardów w zakresie demokracji i praw człowieka we wszystkich przypadkach, gdzie te standardy mogły zostać naruszone, np. w sprawie dotyczącej pana Kozłowa. Mamy jednak wątpliwości co do treści wspólnego projektu rezolucji, który zawiera sformułowania niekiedy zbyt daleko idące, a często niesprawdzone i nie poprzedzone też wysłuchaniem drugiej strony. W tym kontekście trudno jest nam poprzeć wspólny projekt rezolucji uznając, że znacznie bardziej obiektywną i lepszą rezolucją jest ta, która została przygotowana przez grupę ECR, do której poparcia w tym momencie serdecznie namawiam.

Eu aşa am înţeles. Domnia sa este de acord cu ce a susţinut una dintre colegele noastre?

  Eija-Riitta Korhola, PPE-ryhmän puolesta. – Arvoisa puhemies, arvoisa komission jäsen, Kazakstanilla on merkittävä rooli Keski-Aasian rauhan ja vakauden ylläpitäjänä, kuten myös koko alueen talouskehityksessä. EU:n ja Kazakstanin yhteistyö onkin tiivistynyt useilla sektoreilla, dialogi on ollut toimivaa, ja taloudellisen poliittisen yhteistyön vahvistaminen molemmille tärkeää.

Ihmisoikeustilanne on kuitenkin luisunut alamäkeä, ja siihen pitää puuttua. Joulukuussa oppositiopuolue Alga kiellettiin määrittelemällä se ääriliikkeeksi, ja sitä tukeneet mediat joutuivat lopettamaan toimintansa. Myös kazakstanilaiset ihmisoikeusaktivistit ovat kertoneet tulleensa ahdistelluiksi.

Vuonna 2001, heti oman ETYJ-puheenjohtajuuskautensa jälkeen Kazakstan myös hyväksyi lain, joka määrittelee uudet vaatimukset uskonnon rekisteröinnille ja rajoittaa lähetystyötä sekä hengellisen kirjallisuuden maahantuontia ja levittämistä. Sana- ja uskonnonvapaus on oleellinen kriteeri demokraattiselle valtiolle ja myös ihmisoikeuksien toteutumiselle. Parhaillaan Kazakstanin hallitus suunnittelee uutta kansallista ihmisoikeustoimintasuunnitelmaa vuosille 2013–2020. On tärkeää, että siinä näkyy nyt konkreettisena askeleena se, mihin Kazakstan itse sitoutui ETYJin puheenjohtajana 2010.

  Véronique De Keyser, au nom du groupe S&D. – Monsieur le Président, mes collègues ont exprimé la difficulté de ce cas. Tout le monde a dit que le Kazakhstan est un pays important. C'est un pays important pour la paix. C'est un pays important pour l'Europe. Il possède des ressources énergétiques extrêmement impressionnantes. Par ailleurs, c'est un pays qui nous a habitués à l'Eurovision, au football, probablement à l'exposition internationale de 2017, qu'il a ravie à ma ville de Liège qui était en compétition avec Astana. Vous comprenez bien que ce n'est pas Liège qui a gagné...

C'est donc un pays très fort. Concernant le ton même de cette résolution, je m'étonne quand on dit que nous sommes allés un peu trop loin car, pour moi, nous ne sommes pas allés assez loin. Le ton est résolument positif.

Je partage le souci et l'inquiétude exprimés par mes collègues par rapport aux cas de détenus qui ont subi des condamnations injustes, probablement, mais je dis: une question: comment faut-il faire? Moi, je lis des tas de choses positives: la commission de Venise, la demande d'un monitoring des droits de l'homme, et c'est très bien! Donc, nous avons abordé le Kazakhstan aujourd'hui de façon positive.

Eh bien nous verrons ce qui va se passer et je vous assure que ce n'est sans doute pas la dernière fois que nous adopterons une résolution sur ce grand pays qui est un pays riche.

  Graham Watson, on behalf of the ALDE Group. – Mr President, last September, human rights defender Vadim Kuramshin was arrested on his return from the OSCE Conference and sentenced to 12 years in prison. The following month, it was opposition leader Vladimir Kozlov, with whom my colleague Mr Donskis has spoken.

In December, the courts banned almost all independent media, and in February the Court of Appeal banned independent journalists from exercising their profession. What is worse is that they are now considering further changes to the legal system, with fines and prison terms foreseen for the creation of political parties, and incarceration for participation in illegal rallies.

The sky over Kazakhstan is darkening fast as it flouts its OSCE commitments. I hope that Baroness Ashton, on her frequent visits there, is raising these issues. If she is, would she report to this House on Kazakhstan’s reaction? And if she is not, would she at least send her new special representative for human rights to deal with it?

  Tarja Cronberg, on behalf of the Verts/ALE Group. – Mr President, Kazakhstan is an increasingly important international partner in the region, and also for the EU. I especially note their support during the recent talks with Iran, and also their proposal to establish an international fuel bank in Kazakhstan. Kazakhstan also has an ambition to act as mediator and facilitator in international security issues. However, the Kazakh authorities need to respect the international commitments they have signed up to, including the rule of law and the independence of the judiciary.

Kazakhstan’s political role in the region cannot grow when there is such discord with the international principles of transparency, human rights and the rule of law. We are very concerned by the detentions of opposition leaders, journalists and lawyers on the basis of trials which fall short of international standards. The charges against these people are very vague and could be considered to be politically motivated.


We would like to call on the Kazakh authorities to follow through with the enforcement of the existing human rights action plan, which draws on the recommendations of the Venice Commission, and to make use of EU technical assistance under the Rule of Law Initiative.

  Cristiana Muscardini, a nome del gruppo ECR. – Signor Presidente, signor Commissario, onorevoli colleghi, dopo 24 anni in questo Parlamento, ho sempre più la sensazione che i diritti umani siano difesi in maniera differente, a seconda degli interessi politici e partitici dei gruppi.

Sono dispiaciuta del testo della risoluzione, eccessivamente punitiva nei confronti di una situazione sociale e politica in evoluzione. Non neghiamo che vi sono difficoltà e ingiustizie da parte dell'amministrazione, ma si governa un territorio ampio a cavallo tra il mondo europeo e asiatico, che ancora cerca di sanare le ferite lasciate dall'Unione sovietica.

Chi ha seguito le vicende del Kazakistan in questi anni ha visto i progressi compiuti per migliorare il dialogo. Ne è un esempio l'Eurasian Media Forum che da anni, ogni anno, vede rappresentanti della stampa e della televisione dell'area asiatica e delle altre aree del mondo confrontarsi e discutere in piena libertà.

Come conservatori socialriformatori italiani, siamo contrari a questa risoluzione, che poco sarà di aiuto a un paese che, con difficoltà, cerca di implementare le convenzioni internazionali e siamo preoccupati dell'eccessiva durezza del Parlamento, che rischia di essere un freno a un miglior dialogo costruttivo.

  Jaroslav Paška, za skupinu EFD Šikanovanie opozičných predstaviteľov v Kazachstane, keď po falošnom obvinení z extrémizmu či rozličných prečinov sú trestne stíhaní a väznení, naznačuje, že je potrebné zvýšiť úsilie o dosiahnutie reformy trestného práva v tejto krajine.

Skutočnosť, že Kazachstan je v súčasnosti členom v Rade OSN pre ľudské práva a ako člen OBSE sa v roku 2010 zaviazal dodržiavať a uplatňovať zásady tejto organizácie, nás oprávňuje k tomu, aby sme od jeho administratívy vyžadovali dodržiavanie týchto medzinárodných záväzkov. Je škodou, že vysoká komisárka pani Ashtonová pri svojej návšteve v Kazachstane v novembri minulého roka nevyužila túto príležitosť na to, aby upozornila našich kazašských partnerov na neprijateľné postupy štátnych inštitúcií voči opozičným silám. Preto, myslím si, má Európsky parlament povinnosť sformulovať naše výhrady voči zneužívaniu štátnej moci na potláčanie opozičných politických síl v Kazachstane a povzbudiť kazašské orgány na intenzívnejší dialóg s Benátskou komisiou o pripravovanej zmene trestného poriadku.

Kazachstan zastáva stále významnejšiu úlohu vo svojom regióne, a preto sa musíme usilovať o to, aby nové právne prostredie po vykonaní príslušných reforiem umožnilo nielen sudcom a právnikom, ale aj novinárom a opozičným politikom slobodne vykonávať ich prácu.

  Elisabeth Jeggle (PPE). - Herr Präsident! Die fraktionsübergreifende Entschließung spricht schon die in der Vergangenheit gestellten Forderungen an, und wir haben uns immer wieder zu den Themen ausgetauscht. Wir können und müssen von Kasachstan Rechtsstaatlichkeit erwarten, ebenso wie das Einhalten von unterschriebenen Verträgen und Konventionen. Insofern sehe ich diese Entschließung als Aufforderung, in gemeinsamen Strategien voranzukommen.

Ich setze mich für einen konstruktiven Dialog mit Kasachstan ein. Selbstverständlich müssen wir, um die Entwicklung in der Region weiter voranzutreiben, auch kritisch sein. Aber eine unausgewogene, einseitige Anklage unserer kasachischen Partner, die oft auf unsicheren Quellen basiert, ist weder für Kasachstan noch für uns selbst hilfreich. Ich möchte keine Abkühlung der europäisch-kasachischen Beziehungen, sondern ein lebendiges und zukunftsorientiertes Miteinander. Deshalb setze ich mich sehr für eine Intensivierung unserer Beziehungen ein, in politischen, sicherheitspolitischen sowie wirtschaftlichen Bereichen, in Kultur und Bildung. Gerade auf die junge Generation müssen wir setzen und an sie bei der vollen Akzeptanz der Demokratie, der Rechtsstaatlichkeit und der Menschenrechte denken!

  Lidia Joanna Geringer de Oedenberg (S&D). - Dziękuję Panu Przewodniczącemu! Unia Europejska postrzega w Kazachstanie silnego partnera w Centralnej Azji, czego wyrazem jest planowana w dalszej perspektywie umowa o partnerstwie i współpracy. Porozumienie to jednakże uwarunkowane jest postępami tego kraju w kontynuacji reform gwarantujących demokrację oraz poszanowanie podstawowych praw i swobód obywatelskich.

Tymczasem sytuacja w kwestiach praw człowieka w Kazachstanie uległa w ubiegłym roku gwałtownemu pogorszeniu. Po starciach policji z demonstrującymi pracownikami naftowymi, które miały miejsce w grudniu 2011 r., do więzienia oprócz strajkujących trafiło także wielu działaczy społecznych oraz dziennikarzy. Wśród osadzonych znalazł się Vladimir Kozlov – lider partii opozycyjnej skazany na 7,5 roku pozbawienia wolności. Po szeregu niejawnych procesów, związanych ściśle ze sprawą Kozlova, kazachstański sąd wstrzymał działalność jego partii oraz kluczowych niezależnych mediów.

Jeśli Kazachstan chce kontynuować rozmowy o współpracy z Unią Europejską, to musi zaprzestać jawnego łamania praw człowieka, ograniczania działalności opozycji i politycznych aresztowań dokonywanych pod pretekstem walki z terroryzmem.

  Marek Henryk Migalski (ECR). - Dziękuję Panie Przewodniczący, oczywiście Pana przeprosiny zostają przyjęte. Rozumiem, że to było nieporozumienie. Teraz do rzeczy. Rzeczywiście tutaj i pan Watson, i pan Donskis, i pani Geringer de Oedenberg wspominali, zresztą inni też, o osobie Władimira Kozłowa. Jego sytuacja dzisiaj wydaje się najgorsza, dlatego że skazany na 7 i pół roku cierpi za to tylko, że chciał wolności i demokracji dla swojego kraju. Mam dla Państwa informację – konsultowałem to z Piotrem Borysem – dzisiaj na Sali, tutaj na galerii siedzi żona Władimira Kozłowa Alija. Jeśli mogę prosić, to przywitajmy ją brawami i dodajmy otuchy jej mężowi i wszystkim tym, którzy walczą w Kazachstanie o prawa człowieka.

Rzeczywiście jest tak, że kontakty między Unią Europejską, a Kazachstanem są ważne i będą coraz ważniejsze i powinny być coraz ważniejsze, ale nie powinno to się odbywać kosztem praw człowieka i takich osób jak Władimir Kozłow.

Yhteiskunnallinen kehitys Kazakstanissa on heikentynyt viime vuoden aikana. Sanavapauden osalta Kazakstanin hallitus jatkaa hajota ja hallitse -politiikkaa yhä alistaen sillä kansalaisyhteiskuntaa.

EU:n ja Kazakstanin välinen vuoropuhelu on tähän asti ollut tärkeä väylä ihmisoikeuskysymysten esille tuomiseksi, mutta vuoropuhelun toimivuutta ja sen jatkamisen mielekkyyttä on syytä harkita vakavasti silloin, kun toinen osapuoli ei näytä ottavan kansainvälisiä velvoitteitaan vakavasti.

Yhteiskunnan kehittäminen ja kansalaisyhteiskunnan eri osa-alueiden vapaa ja aktiivinen toiminta ovat demokraattisen ja kansalaisten hyvinvointia tavoittelevan valtion ensisijainen tehtävä. Valitettavasti niin Yhdysvallat kuin Euroopan unionikaan ei ole onnistunut sisällyttämään selkeitä ihmisoikeustavoitteita strategisiin kauppakumppanuuksiinsa Kazakstanin kanssa. Euroopan unionin ei tule käydä kauppaa hinnalla millä hyvänsä, varsinkin jos hintana ovat ihmisoikeudet.

  Struan Stevenson (ECR). - Mr President, I have been to Kazakhstan many times. I first visited Almaty and Semipalatinsk – which is now called Semey – 14 years ago. The country was still trying to get on its feet economically. In Semipalatinsk, few of the streets were paved, and there were hardly any street lights. When the sun went down the people came out onto the streets to cook their evening meals on charcoal stoves.

In the past decade, the country has been transformed. It is the most outstanding economic success in Central Asia, and is a bastion of peace and stability. The standard of living for all Kazakhs has risen inexorably, which is why President Nazarbayev is popular with his own people. It has also – as we have heard in this debate – become a global player. It has joined the UN, chaired the OSCE in 2010, hosted the recent talks on the Iranian nuclear crisis, and now it will host the international EXPO – or world trade fair – in 2017 in Astana.

Against that background, I think that this resolution is very negative and does not talk about the positives. It seems to emphasise all the negatives. I am going to vote against it.

  Piotr Borys (PPE). - Miałem okazję wielokrotnie przyjmować Vladimira Kozlova w Parlamencie Europejskim, kiedy mówił o prawach człowieka oraz o potrzebie dialogu. Miałem okazję także być i rozmawiać z prokuratorami niezwłocznie po jego aresztowaniu. Byłem także w Kazachstanie po raz drugi, kiedy byłem świadkiem w jego procesie. Uważam, że dzisiaj potrzeby jest intensywny dialog pomiędzy Unią Europejską i Wysoką Przedstawiciel ds. Polityki Zagranicznej a władzami Kazachstanu. Uważam, że jeżeli Kazachstan ma ambicję być głównym graczem w Azji Centralnej, organizatorem EXPO, musi otworzyć się na prawa człowieka i ich przestrzegać. Dlatego uważam, że powinniśmy bezwzględnie monitorować sprawę V. Kozlova, pomóc mu uzyskać ułaskawienie ze strony prezydenta Azerbajeva. Uważam, że powinniśmy wykorzystać takie metody, jak chociażby ostatnia delegacja pana Coxa i pana Kwaśniewskiego. Spróbujmy użyć wszelkiej polityki do tego, aby uwolnić te osoby, które dzisiaj siedzą w więzieniu. Naprawdę, pomóżmy im, ponieważ jest to nasz obowiązek.

  Zita Gurmai (S&D). - (A felszólalás első része technikai probléma miatt nem került rögzítésre.) …és folyamatosan fejlődő gazdasági kapcsolatok ellenére az EU és Kazahsztán viszonya korántsem nevezhető zökkenőmentesnek. Jól jelzi ezt, hogy időről-időre foglalkoznunk kell e ház falai között is az emberi jogok kazahsztáni helyzetével. Kazahsztán egyre ambiciózusabb a nemzetközi politikában, amit jól jelez az országnak az ENSZ Emberi Jogi Tanácsában betöltött tagsága is. De ezeknek a törekvéseknek nagyobb felelősséggel is kell járniuk, és a nemzetközi kapcsolatokban megjelenő elkötelezettségnek nemzeti szinten, az országhatárokon belül szintén meg kell jelennie. Az EU külpolitikája nem épülhet csak a gazdasági együttműködésre.

Valamennyi partnerországunkon számon kell kérnünk az egyetemes emberi jogok betartását. Emellett, szociáldemokrata politikusként elfogadhatatlannak tartom a szakszervezetek működésének korlátozását és az alapvető munkavállalói jogok megsértését is. Meggyőződésem, hogy az alapvető polgári és politikai jogok biztonsága nemcsak az EU és Kazahsztán közötti gazdasági kapcsolatokat erősítené, de fontos szerepet játszhat a térség biztonságának… (Az elnök megvonta a szót a képviselőtől.)

  Laima Liucija Andrikienė (PPE). - Mr President, of course we understand the importance of the relations between the EU and Kazakhstan. We know that the Kazakh Government is considering adopting a new national human rights action plan and that preparatory work in order to reform the criminal code is also going on.

At the same time, I have to say that the Court decision to ban opposition parties, including the unregistered opposition party Alga!, based on charges of extremism, and to ban key independent media players violates the principles of freedom of expression and assembly and deserves our sincere criticism.

I would like to take this opportunity to call on the authorities to respect the principles and commitments of the OSCE standards on the freedom of expression and the freedom of assembly and association and I would like to encourage Kazakhstan to view criticism not as a threat but as a constructive tool to improve policies and inclusiveness.

  Herbert Dorfmann (PPE). - Herr Präsident! Als Mitglied der Zentralasien-Delegation war ich mehrmals in Kasachstan, zuletzt im letzten November. Wir müssen die Menschenrechtssituation in Kasachstan sicher ansprechen. Kasachstan ist ein Transformationsland, das sich anschickt, ein Wohlstandsland zu werden, und das auch seinen Auflagen in Sachen Menschenrechte nachkommen muss. Aber allgemeine Verurteilungen sind sicher fehl am Platz.

Ich möchte einen Punkt ansprechen, der in der Entschließung, über die wir jetzt diskutieren, auch steht, und zwar die Frage der Religionsfreiheit. Im Staat Kasachstan leben über 100 Religionsgemeinschaften friedlich nebeneinander. Durch die Tatsache, dass sie jetzt registriert werden müssen, und die Art und Weise, wie sie registriert werden müssen, wird dieses Zusammenleben in keinster Weise beeinflusst. Hier müssten wir schon schauen, was wir wirklich kritisieren und die wirklich schwierigen Punkte auch ansprechen.

  Bogusław Sonik (PPE). - Panie Przewodniczący! Kazachska władza dopuszcza się naruszenia wolności słowa i wolności zgromadzeń. Niedopuszczalna jest sytuacja, w której dziennikarze krytykujący prezydenta Nazarbajewa pozbawiani są z tego tytułu prawa do wykonywania zawodu. Należy pamiętać o obrońcach praw człowieka, którzy przebywają w kazachskich więzieniach. Taki sposób rozprawiania się z politycznymi przeciwnikami jest godny potępienia. Należy uświadomić władze kazachskie, że wzmocnienie dwustronnej współpracy Unii Europejskiej z tym krajem będzie możliwe tylko wtedy, gdy Kazachstan będzie przestrzegał międzynarodowych porozumień dotyczących ochrony praw człowieka.

Na końcu, wracając do poprzedniej debaty na temat Wietnamu, uważam, że jednak te słowa powinny wybrzmieć. Tutaj nie można nikogo oskarżyć. Pani Vergiat mówiła o tym, że potępia nieprzestrzeganie praw człowieka w Wietnamie. Te słowa powinny wybrzmieć.

  Cecilia Malmström, Member of the Commission. − Mr President, we have indeed witnessed a growing awareness on the part of the Kazakh authorities of the importance of moving forward in the democratisation of society. First steps such as the election of rural governors, and strengthening the powers of the parliament are stated in the strategy Kazakhstan 2050. However, we do share many of the concerns expressed in your recommendation and nor is this, indeed, the first time that this Parliament has spoken on the situation in Kazakhstan. There have been regular reports almost yearly as well as the report from last November.

We do continue to work through all possible channels to implement the different recommendations that you highlight and the concerns that you have raised as well. We address these systematically through specific démarches. One was issued on the closure of the premises of the opposition Respublika newspaper last December and on the case of Vadim Kuramshin. Our delegation there has also followed very closely and issued a démarche on the case of Vladimir Kozlov, visiting him in prison and keeping in close contact with his collaborators and his family. We are engaged in continuous interaction with the Kazakh authorities, working to strengthen the joint actions with NGOs, human rights defenders and other civil society actors concerned. Vice-President Ashton, when she was there in November, did raise these issues with the authorities and she has also met with different representatives of civil society.

Our cooperation and assistance projects in support of the rule of law are key tools for accessing concrete results and sharing EU experience and expertise, while increasing the capacity of Kazakh society and the government to search for successful solutions.

We remain convinced that engagement is the key to achieving progress, particularly in the new context provided by Kazakhstan’s membership of the Human Rights Council since the beginning of this year and the imminent start of work on a new national human rights action plan.

In our view, the cross-cutting nature of human rights can only benefit from comprehensive cooperation between the EU and Kazakhstan, as reflected by the Partnership and Cooperation Agreement. We have always emphasised that the successful conclusion of negotiations on a new agreement will depend on the advancement of political reforms and fulfilment of Kazakhstan’s international commitments. This is our point of department for the negotiations and it is a clear commitment.

Human rights issues should not be seen in isolation but in connection with our political and economic agendas. Kazakhstan is, as many of you have said, an important economic and trade partner in the region. It is a key partner for the stability of the region, notably through its increasingly active role in the developing EU–Central Asia cooperation, as well as for the stability of the broader region through its contribution to the Heart of Asia process and to nuclear non-proliferation.

The EU will continue to work with Kazakhstan. Promoting progressive development in the human rights area will remain a key part of our engagement with Kazakhstan and supporting the political, social and economic development of that country. Thank you very much for this debate.

  Monica Luisa Macovei (PPE), în scris. – Condamn măsurile represive luate în continuare de guvernul kazah ca urmare a protestelor din decembrie 2011 de la Janaozen. Fără să iniţieze un dialog cu protestatarii şi fără să aplice măsuri pentru îmbunătăţirea situaţiei muncitorilor din domeniul petrolier, preşedintele Nazarbayev preferă să dea vina pe dizidenţi şi presă. Astăzi, Kazahstanul nu mai are niciun respect pentru drepturile civile şi politice şi nici pentru pluralismul politic. Figuri celebre ale opoziţiei, ca Vladimir Kozlov şi apărători ai drepturilor omului ca Vladimir Kuramshin au fost condamnaţi la închisoare pentru că s-au opus abuzurilor puterii. Decizia de a închide peste 40 de instituţii de media şi de a interzice jurnaliştilor respectivi să îşi exercite profesia este extrem de gravă. Aceste măsuri abuzive elimină din spaţiul public vocile care se împotrivesc guvernării tot mai autoritare a lui Nazarbayev. Solicit Serviciului European de Acţiune Externă să impună aceste grave abuzuri pe agenda autorităţilor de la Astana şi să ofere asistenţa necesară victimelor represiunii lui Nazarbayev.
