  Der Präsident. − Als nächster Punkt der Tagesordnung folgt die Aussprache über den Bericht von Antolín Sánchez Presedo im Namen des Ausschusses für Wirtschaft und Währung über den Jahresbericht über die EU-Wettbewerbspolitik (COM(2012)0253 – 2012/2306(INI)) (A7-0143/2013).

  Antolín Sánchez Presedo, Ponente. − Señor Presidente, señor Comisario, Señorías, quisiera, en primer lugar, agradecer a la Comisión Europea la presentación del 41º informe anual sobre la política de competencia, al que responde la propuesta de Resolución aprobada por la Comisión de Asuntos Económicos y Monetarios después de haber recibido las opiniones de la Comisión de Empleo y Asuntos Sociales, de la Comisión de Mercado Interior y Protección de los Consumidores y de la Comisión de Transporte y Turismo.

La política de competencia es un pilar del proyecto comunitario: la prohibición de las conductas colusorias y del abuso de posición dominante, las reglas sobre las ayudas estatales y el control de las concentraciones tienen su fundamento en el Tratado de Roma y crean valor cada día para las empresas, los consumidores y los contribuyentes, en definitiva, para el conjunto de los ciudadanos europeos.

En el presente informe pretendo destacar cuatro mensajes. El primero es que si la competencia siempre es importante, en época de crisis es vital. A falta de un marco comunitario para abordarla, ha ofrecido instrumentos para mantener la estabilidad del sistema financiero, proporcionar asistencia a los países en dificultades y promover unos mercados financieros más transparentes, abiertos e innovadores en el seno de la Unión.

La Comisión –y así se indica en nuestra Resolución– debe seguir dando prioridad al sistema financiero, prosiguiendo las investigaciones en marcha, asegurando que el régimen extraordinario de ayudas públicas no vaya más allá de lo necesario y velando por que las entidades beneficiarias se reestructuren con el menor coste social, disciplinen las remuneraciones de sus ejecutivos y no obtengan ventaja alguna respecto de las entidades que no han necesitado ayudas.

El segundo es que la competencia es una palanca para el crecimiento y el empleo sostenible en un entorno de globalización. Hay que recuperar una senda de crecimiento. Para lograr una correcta formación de precios, una óptima asignación de recursos, hay que remover los obstáculos artificiales que impiden el acceso de las empresas al mercado y dificultan que exista un terreno de juego equilibrado.

Un terreno de juego equilibrado es necesario para que las empresas basen su éxito en sus propios méritos, en su talento para satisfacer las demandas sociales. Los objetivos de la Estrategia Europa 2020 no se alcanzarán sin intensificar la efectividad de la política de competencia.

El tercer mensaje es que la política de competencia tiene un papel esencial en los servicios de interés económico general. Para controlar el buen uso de los fondos públicos, perseguir los comportamientos discriminatorios y posibilitar que el progreso técnico se convierta en progreso social es necesario un desarrollo activo de la política de competencia. Su acción en este campo –y tenemos ejemplos en nuestra Resolución en el campo de la salud, de la farmacia y de los seguros– debe redoblarse para que el modelo social europeo tenga futuro.

Y el cuarto mensaje es que la competencia contribuye al bienestar de los consumidores. Poner coto a las distorsiones en el funcionamiento de los mercados, que impiden la creación de valor y la obtención de beneficios desde el primer hasta el último escalón de la cadena económica, es un objetivo permanente de la política de competencia.

La acción en el ámbito alimentario a favor de las pequeñas y medianas empresas y de los consumidores debe continuar y extenderse a otros sectores para que las mejoras económicas puedan beneficiar al conjunto de la sociedad.

La política de competencia no puede ser un obstáculo para devolver sus derechos a quienes se demuestre que han sido víctimas de prácticas irregulares e ilegales en la comercialización de productos financieros, como ha ocurrido escandalosamente en mi país. Espero que el Pleno ratifique con su voto mañana su apoyo al apartado 17 de la propuesta para posibilitar que se haga justicia.

  Joaquín Almunia, Vice-President of the Commission. − Mr President, thank you very much, first of all, to Mr Sánchez Presedo for this excellent report on the 2011 annual competition report. And my thanks also to those Members from the Committee on Employment and Social Affairs (ECON), the Committee on the Internal Market and Consumer Protection (IMCO) and the Committee on Transport and Tourism (TRAN) – Mr Ungureanu, Mr Schwab and Mr Kamall – who also contributed to Parliament’s report on our work in 2011.

This is the fourth competition report during the term in office of the Barroso II Commission, of my term in office as Commissioner for Competition, and I am happy to say before this Parliament that the dialogue between our two institutions on competition policy continues to deepen and I welcome very much your support for the work of the Commission on competition enforcement.

As you know, this report was structured to better respond to Parliament’s wishes, allowing us to focus on key policy areas. We have continued to improve the report in 2012. I had the opportunity recently to present this new report to the ECON Committee and I hope that we have been able to reflect some of your comments on last year’s report in this year’s one.

As I said when I presented the 2011 report to you, almost one year ago, one of our main goals is to maintain stability amid persistent turbulence in financial markets. We continue to use State aid rules to restructure and resolve banks which needed public support to preserve financial stability, minimise the cost to public finances, and ensure that restructured banks are sufficiently viable to be able to lend to companies and households. On this point I fully agree with Mr Sánchez Presedo’s words a few minutes ago.

You are well aware of the ongoing discussions around banking supervision and restructuring. On the competition side, we will soon put forward revised State aid guidelines for banks. They will reflect current practice in our case work and include stricter burden-sharing requirements for shareholders and junior creditors, and will provide that, in principle, only reversible measures – like loans or guarantees – can be approved as rescue aid. Thus, we hope that taxpayers will feel less of the pain when a bank needs to be restructured.

One year ago I outlined our plans for the modernisation of State aid. Since then we have been working hard to take this forward, and I welcome the contribution of the ECON Committee and the Transport Committee to this work through the Pietikäinen and the Dorfmann reports. I look forward to these reports being adopted in this Parliament in due course.

Another important project has been the revision of the Regional Aid Guidelines, which was discussed here last night based on the Vlasák report and which the Commission will try to adopt in the coming weeks.

I welcome Parliament’s support for our firm enforcement of the antitrust rules and for the ongoing fight against cartels, in which both our fining policy and settlement procedure play important roles. I note your reiterated call for the Commission to review the Fining Guidelines.

This is a topic which we have discussed on several occasions during recent years. I want to repeat that setting the fines is not an arbitrary exercise. The framework for our fining powers and fining policy is set out in a Council Regulation – Regulation (EC) No 1/2003. This contains objective criteria which limit our discretion: the fines shall reflect the gravity and the duration of the infringements and cannot exceed 10 % of the undertaking’s total worldwide turnover.

We also decided, as have other competition authorities, and as a matter of transparency, to provide further details of our methodology in the Guidelines – the guidelines that are binding for our work. These guidelines take the view that the current legal framework ensures that fines achieve punitive and deterrent effects while allowing the Commission to react quickly to and take into account company-specific and market-related situations. The European Court of Justice has confirmed the legality of this approach on several occasions.

In your report, Parliament draws the Commission’s attention to several specific sectoral issues. We share your concerns about the level of competition in sectors such as energy and transport. In such fields, our policy and our regulatory work go hand in hand. Concerning the full implementation of the third energy package, my colleague Mr Oettinger and his Directorate-General may take the lead; the same in the transport sector with my colleague Mr Kallas and the same in the digital sector, in the telecoms sector, with my colleague Ms Neelie Kroes.

As you said, in difficult times it is ever more important for markets to work efficiently and fairly, to deliver the benefits to businesses of all sizes and to European citizens and consumers, and with your help, we will continue to achieve this.

In another area of key importance to consumers, the Commission shares your concerns in relation to the volatility of food prices. The report published by the European Competition Network last year shows that the food sector has been a priority for competition authorities, which have been very active in enforcing competition law and monitoring market developments.

Between 2001 and 2011, the national competition authorities investigated more than 180 antitrust cases in this area, took close to 1 300 merger decisions, and monitored around 100 activities. The Commission stands ready to investigate any possible anti-competitive agreements between different players in the supply chain which would ultimately lead to price increases for our consumers.

I also agree fully with you that consumers are the final beneficiaries of our competition enforcement action.

So I think that on all these areas we probably share the same objectives, the same priorities, and I hope very much that we will continue to work together. I am very keen now to listen to your views in the debate and to continue our dialogue.

  Traian Ungureanu , rapporteur for the opinion of the Committee on Employment and Social Affairs. − Mr President, the introduction of employment aspects into competition policy is a positive move as the business environment has indeed changed since the beginning of the economic crisis. The Committee on Employment and Social Affairs launched proposals that tackle the effects of competition policy on labour markets.

Firstly, investment in education, training and vocational training. This will ensure that the labour force will withstand competitive pressure and adapt better to new market conditions.

Secondly, the measures for integration and reintegration of workers into the labour market as part of the services of general economic interest (SGEIs) will redefine what SGEIs are in the current market conditions. As stressed by the Employment Committee, competition policy should bring support to SMEs, especially in times of economic crisis.

The Commission needs to assess along these lines the future development of companies undergoing restructuring or privatisation. The employment components should not collide with the principles of competition policy. So I suggest the Commission should address this specific chapter in its next ....

  Syed Kamall, rapporteur for the opinion of the Committee on Transport and Tourism. − Mr President, in the Committee on Transport and Tourism we had a very interesting debate with a wide range of views at the time, but we came to some consensus on a number of points.

One was to ensure that the conditions exist to open up the sector to free and fair competition. The other one was, really, to make sure that we are doing what we set out to do in the first place, such as: implementation of the recast of the first railway package; making sure that there is more liberalisation and more competition but at the same time making sure that consumers gain rather than lose out in any changes; making sure that there is a multimodal system for ticket reservation and sales, so that passengers can order and not just be restricted to one mode of transport. Also when it came to the aviation sector and the EU-US air agreements, making sure that they were compatible regulatory approaches, making sure this happened.

Finally, we talked about the EU road haulage market. This could bring real benefits but at the same time we needed to ensure concerns were taken into account when it came to environmental issues and making sure it really did bring benefits to consumers.

Overall we had a good bit of work in the Transport Committee, but we pushed for greater liberalisation and more competition.

  Gunnar Hökmark, on behalf of the PPE Group. – Mr President, may I first of all thank Mr Sánchez Presedo for his work on the competition report for 2011. Competition policy and its relationship to the overall competitiveness of our Member States, and the Union, is of fundamental importance. That is why I welcome very much that this report that we are discussing today will tomorrow mean that we decide on a number of important messages in regard to increasing competition in sectors of our economies where the level of competition is insufficient today.

First there is a clear message on the importance of making sure that competition policy furthers the interests of consumers and new entrants, rather than companies that are already established enterprises. That is important.

Secondly, the call for more competition among providers of services of general economic and social interest: here we are dealing with some of the most important services in our societies and it is important that consumers, citizens, can make a choice and that they can get the best of the best possible. This is crucial because, if we want to make these services more efficient and consumer-oriented, we must secure the plurality and ever ongoing development of these services.

Thirdly and finally, today too many services are exempted from scrutiny by the competition authorities, not least in relation to services of general economic and social interest. It is important that the Commission always takes an overall perspective on how to further these interests, because what is important in one area is important in another area as well. When consumers can benefit from competition in one sector of our economy, they can also do so in another sector. This is a core issue of the European Union, not only for economic purposes but also for opportunities for new thinking, new ideas in the development of our Europe.

  Arlene McCarthy, on behalf of the S&D Group. – Mr President, I want to take the opportunity this evening to welcome the announcement that the Commissioner is going to bring forward the directive and recommendation for consumers to have a right of compensation if they have been victims due to breaches of anti-trust laws. I think that is fundamental and important and I congratulate you, because only 25% of anti-trust infringement decisions actually see victims get compensation.

I think this is the way forward and, as you know, I take a very big interest in your investigations into the energy sector. That is why I am very pleased that you are continuing to look at the allegations of price-fixing of oil and gas markets. If consumers have been the victims of overcharging they do need to see redress because consumers are paying a high price for oil and gas. Potentially this can have a knock-on effect for households, for business bills. It affects people when they put petrol in the car and it is not right, fundamentally, that people are paying more while companies are booking high profits on the basis of – potentially – manipulated prices.

I believe that the EU, and you personally, play a vital role in investigating anti-trust violations. I think only the EU can bring these actions against companies or institutions. It is interesting that the UK Office of Fair Trading abandoned an investigation over potential oil price-fixing manipulation and that is why, Commissioner, we do have to rely on you and your services. I continue to put my trust and confidence in you restoring the kind of confidence and integrity that we need in markets by clamping down on any manipulation.

  Ramon Tremosa i Balcells, en nombre del Grupo ALDE. – Señor Presidente, señor Comisario, Señorías, en primer lugar quisiera felicitar al ponente, Antolín Sánchez-Presedo, por su buen trabajo y por su buena disposición en la tramitación de este informe.

La política de defensa de la competencia es, sin duda, uno de los ámbitos más importantes dentro de la cartera de la Comisión Europea. La Dirección General de Competencia está legitimada para actuar contra los cárteles y monopolios que perjudican los intereses de los consumidores y de las PYME.

Por todo ello, soy de la opinión de que deberían asignarse más recursos presupuestarios y humanos a la Dirección General de Competencia para asegurar que se pueden defender los intereses europeos en este ámbito con eficacia en tantos sectores a la vez como se requiera.

También soy de la opinión de que este Parlamento debería disponer del poder de codecisión especialmente en lo que se refiere a las ayudas estatales. En ese sentido, estoy de acuerdo con el ponente cuando en su informe nos previene sobre las ayudas estatales, especialmente sobre aquellas que son temporales, pero que, en nombre de unos intereses llamados generales, devienen ayudas estatales permanentes. En ese sentido y en el caso concreto de las ayudas estatales a la banca, creo que la Comisión debería tener un papel más activo en casos como el de Bankia y en la rápida liquidación de la cartera industrial de este banco, puesto que seguir inyectando dinero público tiene un coste de oportunidad, que son los recortes sociales. Por cierto parece ser que en España ahora se quiere rescatar también a las autopistas privadas.

Por último, pienso que es importante también que la Dirección General de Competencia sea más activa en el sector de los transportes y en los problemas a que se enfrenta la competencia en el sector ferroviario –en algunos Estados miembros prácticamente no hay competencia. Y, finalmente, también en el sector aeronáutico parece ser que, a fecha de hoy, existen más de mil tratados bilaterales entre Estados miembros de la UE y terceros países que restringen, entre otras cosas, los aeropuertos de llegada, vulnerando así la libre competencia entre ellos.

  Claudio Morganti, a nome del gruppo EFD. – Signor Presidente, onorevoli colleghi, la concorrenza sicuramente è necessaria per sviluppare appieno le potenzialità del mercato: se infatti si creano accordi o cartelli volti a falsare questo principio ne risente tutta l’economia e non solo il consumatore finale.

Vorrei citare solo due esempi, particolarmente significativi per l’Italia: il primo, riguarda un accordo – che sembra essere evidente tra produttori e distributori petroliferi – per tenere artificialmente elevati i prezzi alla pompa; è in corso anche un'indagine della magistratura su questo e ringrazio il Commissario Almunia per essersi interessato alla vicenda.

Un altro esempio eclatante riguarda il comparto assicurativo tra auto e moto: nonostante il numero dei sinistri sia in costante diminuzione, il costo delle polizze continua a salire e ha raggiunto livelli ormai insostenibili. Siamo arrivati al paradosso che l'assicurazione di un ciclomotore possa costare addirittura più del ciclomotore stesso e questo è assurdo! Uno scooter che ha lo stesso prezzo in vendita in Italia o in Germania, ma può avere da noi un prezzo assicurativo annuo superiore addirittura di 10 volte rispetto al mercato assicurativo tedesco. Di questa follia ne risente l’intero comparto produttivo delle due ruote, che ha nell’Italia il principale produttore europeo. Aziende storiche come la Piaggio di Pontedera sono in crisi anche per questo motivo e l’Europa non può rimanere insensibile e inerme di fronte a tutto questo.

  Jacky Hénin, au nom du groupe GUE/NGL. – Monsieur le Président, en novembre 2011, la compagnie maritime SeaFrance disparaît, sabordée par son propriétaire – la SNCF. Cette disparition laissera sur le quai 1 500 salariés et leurs familles. Le malheur des uns faisant le bonheur des autres, il s'est trouvé immédiatement d'autres compagnies pour venir occuper la place encore chaude des compagnies qui espéraient, grâce à l'aide de leurs amis politiques, mettre rapidement la main sur les bijoux de famille de l'ancienne compagnie SeaFrance: quatre navires. Des navires dont la valeur comptable pouvait se situer entre 200 et 300 millions d'euros mais qui ne valaient, tout à coup, plus rien.

En juin 2012, la justice française attribuait au Groupe Eurotunnel, pour un peu plus de 60 millions d'euros, la propriété des navires. Quelle claque pour ceux qui pensaient avoir trouvé une mine d'or à ciel ouvert. En août 2012, après 50 millions de rénovations, le Groupe Eurotunnel, s'appuyant sur une société coopérative ouvrière fondée par une partie des ex-salariés de SeaFrance, aide MyFerryLink à prendre la mer. Aujourd'hui, ce sont 600 salariés qui ont retrouvé un emploi. Un emploi qu'ils pourraient perdre dans six mois parce que la commission de la concurrence britannique, saisie par ceux qui pensaient avoir gagné à l'euromillion, a décidé de leur refuser l'accès au port de Douvres. Aucune solution n'est proposée car les navires en leur nom seraient interdits de port.

Depuis quand les champions de la concurrence "libre et non faussée" ont-ils peur de quelques marins français? Depuis quand un État européen aurait-il le droit de refuser ce qui est inscrit dans les traités, à savoir la libre circulation des biens et des personnes? Pendant combien de temps encore les Britanniques vont-ils pouvoir défendre des intérêts particuliers contre les intérêts de l'Europe? Vous voulez parler concurrence, alors parlons concurrence, si ce mot a vraiment encore une signification.

  Ildikó Gáll-Pelcz (PPE). - Először is szeretném megköszönni a jelentéstevő képviselőtársam nagyszerű munkáját, és különösen azt szeretném megköszönni, hogy e jelentés fókuszába a fogyasztói nézőpontot állította.

Továbbá egyetértek a jelentéstevővel abban is, hogy a válság ötödik évében igazán időszerű, hogy belássuk azt, hogy egy jól működő és valóban átlátható versenypolitikára van szükségünk, sokkal inkább talán, mint az előző években.

Azonban azt is látni kell, hogy a válságra adott válaszok sorában, bár egyértelműen nélkülözhetetlen a szigorú költségvetési fegyelem, vagy a szabályozott gazdaságpolitika, növekedés és szabályozott piac nélkül, ellenőrzött piac nélkül nem beszélhetünk gazdasági növekedésről, nem beszélhetünk arról, hogy Európa gazdasága újra tud indulni.

Három elemet szeretnék kiemelni a jelentésből, amit különösen fontosnak tartok: az első az állami támogatások kérdése. Fontos, hogy a jelentéstevő ezt megemlítette. Annál is inkább, mert számomra ez azt igazolja, hogy nincsenek egyenmegoldások a válságkezelésben. Második elem a banki hitelek kérdése, ez az elem azt mutatja, hogy valóban ez még nem működik, vannak még teendőink. És a harmadik az energiapiac kérdése, és a szabályozott verseny kérdése, a fogyasztói megközelítés kérdése ezen a monopolisztikus piacon. Úgy gondolom, hogy a jelentés jól fókuszált ezekre a kérdésekre, ezért mindenféleképpen támogatni fogom.

  Sergio Gaetano Cofferati (S&D). - Signor Presidente, onorevoli colleghi, l'ottimo lavoro del collega Sànchez Presedo ci permette di sottolineare di nuovo – cosa che non è mai inutile – il valore della concorrenza nella definizione dell'economia sociale del mercato europeo. Così come è significativo l'essere arrivati a definire come linea guida per l'attività futura, che l'azione della Commissione deve essere volta non a rafforzare l'esistente, ma a favorire l'aumento di soggetti, di attori, e a fare emergere nuove idee e tecniche in modo tale che la concorrenza sia reale.

Ma io volevo richiamare l'attenzione del Commissario su due questioni specifiche, che lui ha nominato nella sua introduzione: la prima, riguarda la necessità, secondo me inderogabile, di definire una normativa europea relativa ai ricorsi collettivi. Non possiamo più avere una struttura legislativa come quella attuale che toglie ai consumatori la possibilità di unirsi per chiedere che venga rispettato un loro diritto, che vengano risarciti. Perché il tema del risarcimento e dell'altro aspetto, ha una sua urgenza: noi siamo oggi di fronte ad una contraddizione che può apparire assurda.

Nel caso che si verifichi una violazione c'è la multa per questa violazione che viene pagata dagli Stati membri, mentre non è prevista la possibilità di avere, anche per i consumatori, una compensazione. Quei consumatori sono penalizzati due volte: da un lato perché non ricevono la compensazione e dall'altro perché come contribuenti pagano attraverso lo Stato il danno che è stato prodotto da altri.

Io credo che per questa ragione, i due temi debbano …….

  Olle Schmidt (ALDE). - Herr talman! Jag välkomnar kommissionens beslut att lägga fram ett förslag om kollektiv prövning, collective redress, så att enskilda medborgare och företag kan genomdriva sina rättigheter enligt EU-rätten när dessa har åsidosatts.

Jag är en varm förespråkare av en europeisk typ av grupptalan och välkomnar detta första viktiga steg. Detta behövs för en fungerande inre marknad för att stärka konsumenternas intressen. Helst hade jag sett en gemensam EU-lag. Vi vet att konsumenter och småföretag skräms av att inleda processer på grund av oro för långdragna processer och framför allt höga kostnader.

Att kommissionen nu ägnar särskild uppmärksamhet åt energisektorn är mycket viktigt. Skiffergasrevolutionen i USA hotar den europeiska konkurrenskraften. EU behöver en gemensam energimarknad, som är effektiv, flexibel och konkurrenskraftig. Vi behöver det för att klara den konkurrensutsatta svåra energimarknaden framöver.

  Theodor Dumitru Stolojan (PPE). - Apreciez în mod deosebit flexibilitatea Comisiei Europene în adaptarea politicii cu privire la competiţie şi la ajutorul de stat faţă de noile probleme declanşate de criza financiară şi economică. De asemenea, doresc să mulţumesc dlui Comisar Almunia pentru deschiderea şi transparenţa în dialogul structurat cu membrii comisiei ECON.

Doresc însă să subliniez persistenţa diferenţelor mari de preţuri, care încă există la unele produse şi servicii între diferitele state membre în cadrul pieţei unice. Aceasta demonstrează că există încă obstacole în calea competiţiei în această piaţă unică şi este de datoria Comisiei Europene să identifice aceste obstacole, să acţioneze pentru eliminarea lor în beneficiul competiţiei şi al cetăţenilor europeni.

One of the things I have been pleased to hear here in Parliament in particular over the last couple of years is a new focus on competitiveness generally in Europe. There is no doubt about it, we have lost competitiveness. Even in my own country it was unbelievable in many respects how over a short period of time we became totally uncompetitive. But thankfully, as a result of the measures being taken in the bailout programme etc. we are regaining that.

Competition is vital. It is the lifeblood of trade as they say, and it is good for businesses themselves because it helps them to focus on their core activity and to reach the highest possible standards. It is also very good for citizens because there is more choice and keener pricing.

I welcome in particular the efforts made to make the banks more sustainable and more vibrant, and indeed more accountable, which is absolutely vital because without working banks you cannot have a working economy. That is very important.

I would also agree completely regarding the energy market in Europe; we have failed to address that properly. We need to focus on it, because we will never become properly competitive if we do not have a good, competitive energy market.

  Zofija Mazej Kukovič (PPE). - Hvala poročevalcu in poročevalcem v senci za to prepotrebno poročilo, kajti konkurenčnost je temelj socialno-tržnega gospodarstva in Evropski parlament je tukaj odigral veliko dodano vrednost.

Politiki smo odgovorni za to, da vzpostavljamo okolje, v katerem bosta lahko inovativnost in ustvarjalnost posameznika in podjetij cveteli, v katerem bodo lahko srednja in mala podjetja vstopala ne samo na evropski trg, ampak tudi na globalne trge, konkurenčno okolje, v katerem se bodo lahko institucije znanja in centri odličnosti povezovali med sabo in z večjo močjo znanja nastopali na zunanjem trgu, torej ne tekmovali samo med sabo, ampak tekmovali navzven.

V končni fazi pa je potrošnik tisti, ki bo imel največjo korist, posebej na področju živilstva, kajti 14 % je tistih stroškov, ki jih vsak potrošnik ravno porabi za to področje.

In še kako lahko izboljšana komunikacija s potrošniki pripomore tudi k izboljšanju konkurenčnosti na nivoju Evrope, ki bo močnejša v svetu.

  Danuta Jazłowiecka (PPE). - Panie Przewodniczący! Polityka konkurencji jest niemal od samego początku wpisana w europejski proces integracyjny. Można z całą odpowiedzialnością powiedzieć, że bez niej nie byłoby Unii. Dlatego też musimy rygorystycznie pilnować przestrzegania zasady wolnej konkurencji, szczególnie teraz, w czasie drugiej fali kryzysu. W pełni zgadzam się z sprawozdawcą, że polityka konkurencji nie może służyć jedynie wzmacnianiu istniejących przedsiębiorstw, ale ma ułatwiać wchodzenie na rynek nowym podmiotom.

W tym kontekście moje ogromne zaniepokojenie budzi rynek bankowy. Dostępne dane pokazują, że trwająca konsolidacja w tym sektorze przyczyniła się do zwiększenia udziału w rynku kilku dużych instytucji finansowych. Jest to szczególnie niepokojące, bo to właśnie sytuacja w bankach stała się przyczyną wybuchu kryzysu w 2008 roku. Podjęte działania naprawcze miały doprowadzić do sytuacji, by nie było banków „zbyt dużych, żeby upaść”, tak aby społeczeństwo nie musiało więcej płacić za błędy prywatnych podmiotów. Przecież kryzys budżetowy w wielu krajach członkowskich ma swoje źródło właśnie w ratowaniu przez państwo zagrożonych dużych banków. Okazuje się dzisiaj, że podjęte działania nic nie dały, a nawet doprowadziły do powstania jeszcze większych instytucji finansowych. Kto zatem za ich błędy zapłaci? Znowu społeczeństwo?

  Σπύρος Δανέλλης (S&D). - Κύριε Πρόεδρε, θα ήθελα να υπογραμμίσω ένα κεντρικό μήνυμα της πολύ καλής έκθεσης του Sánchez Presedo, δηλαδή ότι η πολιτική ανταγωνισμού πρέπει να έχει ως απώτερο σκοπό της, την είσοδο νέων παραγόντων και την ανάδειξη νέων ιδεών και πρωτοβουλιών στις οικονομίες των κρατών μελών. Αυτό το μήνυμα δεν έχει ηχήσει εξίσου δυνατά σε όλες τις χώρες που διανύουν περίοδο κρίσης, παρότι είναι προϋπόθεση της οργάνωσης ενός νέου, βιώσιμου παραγωγικού μοντέλου στην οικονομία. Παράλληλα, είμαστε ακόμη μακριά από το να πείσουμε πως οι κανόνες είναι κοινοί για όλους.

Βέβαια οι παράγοντες που παρεμποδίζουν την ολοκλήρωση της ενιαίας αγοράς έχουν και μακροοικονομική διάσταση, όπως είναι οι διαφορές στην προσβασιμότητα ή στο κόστος του χρήματος, το εργασιακό δίκαιο και άλλα ανά κράτος μέλος, που αντιμετωπίζονται ριζικά, βεβαίως, μόνο με ενιαία οικονομική διακυβέρνηση. Όμως, θ' αλλάξει δραστικά το τοπίο εάν προχωρήσουμε άμεσα στην εναρμόνιση και απλούστευση των ρυθμιστικών πλαισίων στο σύνολο των οικονομικών δραστηριοτήτων.

  Jaroslav Paška (EFD). - V predloženej správe sa vysoko hodnotí uplatňovanie európskej politiky hospodárskej súťaže založenej na troch základných nástrojoch, t. j. antitrustových pravidlách, regulovanej štátnej pomoci a kontrole koncentrácií. So skúsenosťami z reálneho fungovania hospodárskeho života v mojej krajine by som chcel upozorniť na čitateľný jav nahrádzajúci hospodárske súťaženie v niektorých sektoroch.

Vzájomná koordinácia cenových politík malého počtu rozhodujúcich hráčov v niektorých sektoroch mi pripomína prax kartelových dohôd. Napríklad bankové poplatky sú v mojej krajine niekoľkonásobne vyššie ako vo väčšine štátov Únie napriek tomu, že všetky u nás pôsobiace banky sú dcérskymi spoločnosťami najväčších bankových domov Únie a na požadovanie vyšších poplatkov nemajú žiaden rozumný dôvod. Kartelovú dohodu sa im však nepodarilo preukázať. Podobnú situáciu môžeme vidieť aj u mobilných operátorov, ktorých ceny sa nám podarilo pred časom výrazne stlačiť len legislatívnymi opatreniami a bez ingerencie štátu a Únie by hospodárskym súťažením k ich zníženiu zjavne nedošlo.

  Joaquín Almunia, Vice-President of the Commission. − Mr President, thank you very much to all those who intervened in this debate.

I think everybody agrees with the first point that Mr Sánchez Presedo made in his presentation of the report: in times of crisis competition policy is of the utmost importance in creating opportunities for new entrants, in supporting SMEs, in creating new areas of economic activity and in encouraging investments and innovation. This will give us a more competitive economy, improve our competitiveness and provide an excellent basis for more growth and more jobs.

When talking about competition policy in times of crisis I also fully agree with Mr Sánchez Presedo and some of the other participants in the debate that it is important to have the right approach to the financial sector in this time of crisis. The financial sector is key for the recovery of our economy to finance the real economy.

We know about the huge amounts of taxpayers’ money which is being channelled to the banks that need public support. This is authorised according to state aid control decisions based on restructuring plans and commitments to put in place viable business models for our banks with adequate burden-sharing to avoid having taxpayers shoulder an excessive burden and to create the best conditions to preserve and protect competition in the banking sector.

Some of you raised other issues. The last speech, by Mr Paška, referred to the level of banking fees. This is relevant in creating the conditions for restructuring banks to protect competition in a national market or in a global market at European level. In particular we have ongoing anti-trust cases with a view to placing, for instance, the fees that credit and debit card players charge the users of these payment instruments under the control of government competition policy.

Many of you also referred to services of general economic interest. I would remind this Parliament that we have put in place a new framework for state control in these key aspects of our social market economy. Services of general economic interest should be efficient to provide the best services at the lowest possible cost to our citizens, but this sector also needs public financing. The question is how to establish an adequate level of public finance for these services and how they can create more opportunities and more competition without distorting competition. I think we are implementing the new framework successfully.

Some of you mentioned some sectors of strategic importance from the competition policy enforcement viewpoint. I fully agree with those who mention the transport sector and energy sector. These are network industries which were former state monopolies and still have a strong market presence at the national, and sometimes cross-border, level. They require special attention and that is why some specific comments were made in the annual report concerning them.

I am always ready to establish dialogue with any of you – not just with the ECON committee, which is my main interlocutor, but also with other committees dealing with some of those sectors – and to explain in more detail what we are doing in these areas.

I would also like to specifically refer to the decision the College of Commissioners adopted today here in Strasbourg regarding public enforcement. We have adopted a proposal for a directive on the possibility to compensate the victims of competition infringements.

As we know, all Member States have the option of taking individual actions. We have therefore established in this proposal, which will be discussed by you and by the Council, a common approach with a view to establishing a level playing field offering greater possibilities and opportunities for compensation to the victims of breaches of competition rules. We have also set out in this proposal principles and requirements that will need to be taken into account in the Member States that have legislation on collective redress.

As you will remember, in the plenary session vote on the Lehne report, this Parliament asked the Commission not to legislate in particular, and to focus competition policy enforcement on collective actions. We have adopted today a recommendation setting out principles for collective redress not only in the cases of the private enforcement of competition rules but also for other kinds of collective action.

For competition policy to be credible and with a view to achieving its objectives, both and private enforcement and public enforcement by the Commission and the other competition authorities is required. Private enforcement is extremely important, and collective action is a key issue. I hope that the recommendations we adopted today and national legislation sharing the same principles will contribute to the achievement of the desired results.

Finally, thank you very much for the remarks regarding DG Competition’s human resources and economic means. You are the budget authority together with the Council. You know what you are voting for when adopting the budget every year, when discussing the next multiannual financial framework. I can tell you that, if DG Competition were allocated greater human and economic resources, we could do more. We are also asking the Member States to do more with less money given the difficulties and constraints of fiscal consolidation.

We are stepping up action to modernise state aid, we are increasing our action against cartels, we are increasing our action in terms of anti-trust and we are increasing our action in the control of mergers, but we can do more, and not only with our own efforts.

I want to thank you for your efforts but also the staff working under my responsibility for their efforts. I also can tell you that if we had more resources we could even do more.

  Antolín Sánchez Presedo, Ponente. − Señor Presidente, señor Vicepresidente, quisiera, en primer lugar, agradecer el tono positivo de las intervenciones de los distintos diputados que han participado en este debate. Quiero agradecer muy especialmente las valiosas aportaciones y el espíritu constructivo de los ponentes alternativos, de los ponentes de opinión y de los diputados que han presentado enmiendas, y también la extraordinaria cooperación de los administradores de la Comisión y de nuestros asistentes en este dossier.

La política de competencia es una política horizontal, que debe impregnar el conjunto de las políticas sectoriales en el ámbito de la Unión Europea. Es preciso asegurar la coherencia de la legislación europea con los principios de la política de competencia y conseguir, además, una cooperación cada vez más estrecha entre todas las autoridades de competencia en el ámbito de la Unión Europea.

Quiero expresar mi satisfacción porque hoy el Comisario ha presentado su propuesta de Directiva sobre acciones por daños derivados de infracciones a la competencia, que será tramitada por codecisión. Es decir, el Parlamento, como ha venido solicitando reiteradamente, podrá ejercer su papel de colegislador.

En mi opinión, es un paso muy importante que establece un pilar privado —junto al pilar público que ya existe— en el ámbito de la política de competencia, promoverá la cultura de la competencia y fortalecerá la legitimidad democrática en el ámbito de la competencia.

El informe presentado por la Comisión ha revelado la contribución de la política de competencia frente a los requerimientos de la presente coyuntura y las necesidades estructurales y de largo plazo de la economía de la Unión Europea, y mi intención es que mañana el Parlamento, más allá de los 85 apartados concretos de la Resolución, envíe un claro mensaje de que la Comisión va a seguir contando con nuestro fuerte apoyo para seguir trabajando con el fin de hacer efectivos los principios de la política de competencia en la Unión Europea.

  Sergio Berlato (PPE), per iscritto. – Gli strumenti di politica della concorrenza definiti dal Trattato di Roma, l'antitrust, gli aiuti di Stato e il controllo delle concentrazioni, concorrono a mantenere condizioni eque ed un mercato aperto e dinamico. L'economia sociale di mercato europea sarebbe impensabile senza la concorrenza. Essa consente, infatti, un'adeguata formazione del prezzo, un'allocazione ed un uso efficienti delle risorse. Nel corso del 2011, l'inasprirsi delle tensioni sui mercati del debito sovrano, le preoccupazioni relative al settore bancario, l'incertezza gravante sull'economia in un contesto caratterizzato da prezzi petroliferi elevati e dal rallentamento della crescita della produzione mondiale, hanno contribuito a una forte perdita di fiducia e alla conseguente contrazione della produzione. A mio avviso, la concorrenza si è rivelata uno strumento necessario per rispondere alla crisi: ha attenuato le tendenze al protezionismo e alla frammentazione del mercato, ha fornito un quadro di orientamenti che ha contribuito alla stabilità e alla ristrutturazione finanziarie ed ha favorito una concorrenza più equa in mercati finanziari più trasparenti. Affinché la politica di concorrenza abbia successo, a mio avviso, occorre coinvolgere maggiormente il Parlamento nella sua elaborazione, garantire che la Commissione disponga di risorse adeguate e incrementare la partecipazione delle parti interessate e della società civile.

  Cristian Silviu Buşoi (ALDE), în scris. – Concurența este piatra de temelie a pieței interne și un vector important pentru dezvoltarea economică și bunăstarea consumatorilor europeni, lucru care a fost confirmat de-a lungul timpului. Criza economică pe care o traversăm a făcut să reapară unele tendințe protecționiste și a alimentat un discurs anti-concurență. Cred că instituțiile europene ar trebui să combată aceste tendințe, punând mai mult în valoare avantajele concurenței pentru consumatori în special, pentru a spori legitimitatea politicii în domeniul concurenței. Doresc să felicit Comisia pentru modul în care a aplicat politica în domeniul concurenței în 2011. Consider totuși că există anumite aspecte care merită ceva mai multă atenție în viitor în special din perspectiva consumatorilor. Printre acestea se numără aplicarea deplină a pachetului energetic, care este de o importanță majoră pentru consumatorii europeni, în contextul creșterii prețurilor la energie, supravegherea atentă a concurenței în sectorul agroalimentar sau evoluția către o piață mai deschisă a plăților electronice. Închei prin a sublinia încă o dată importanța pentru consumatori a mijloacelor de soluționare alternativă a litigiilor și a acțiunilor colective în despăgubire ca urmare a daunelor generate de nerespectarea regulilor în materie de concurență.

  Vladimír Maňka (S&D), písomne. – Ak chceme odstrániť prekážky v záujme lepšieho prístupu MSP na vnútorný trh, potrebujeme aktívnu politiku hospodárskej súťaže. Bez nej je európske sociálne trhové hospodárstvo nemysliteľné. Hospodárska súťaž umožňuje tvorbu cien, efektívne prideľovanie a využívanie zdrojov a sociálny pokrok. V kontexte globalizácie nedokážu európske podniky a hospodárstvo bez spravodlivej súťaže prežiť. Komisia v spolupráci s vnútroštátnymi orgánmi musí preto vyhodnotiť deformácie vo fungovaní hospodárskej súťaže a ich hospodársky vplyv.

V bankovom sektore sa zvýšil trhový podiel niektorých veľkých finančných inštitúcií. Našim cieľom musí byť posilnenie hospodárskej súťaže na európskych bankových trhoch. Tu je potrebné sprísniť antitrustové pravidlá. Orgány EÚ na ochranu hospodárskej súťaže musia monitorovať trhy s farmaceutickými, zdravotnými a poistnými službami. Pritom je potrebné odhaliť zneužívanie práv pacientov a diskriminačné správanie. Aj keď organizácia odvetvia zdravotnej starostlivosti a sociálnej ochrany patrí primárne do právomoci členských štátov, tieto služby by mali podliehať kontrole, aby sa ochránili verejné financie a zachovali právne predpisy pre hospodársku súťaž a práva občanov EÚ. Komisia musí brať do úvahy ciele zamestnanosti stanovené v stratégii Európa 2020. Politika hospodárskej súťaže by mala umožniť lepšiu podporu tých MSP, ktoré sa najväčšou mierou podieľajú na tvorbe pracovných miest.

  Róża Gräfin von Thun und Hohenstein (PPE), na piśmie. – Aby odbudować wzrost gospodarczy po kryzysie, musimy zadbać o wysoką konkurencyjność, tak aby przedsiębiorcy w każdym państwie członkowskim mieli równy dostęp do rynku. Trzeba kłaść większy nacisk na rozwój rynku elektronicznego. Szczególnie powinniśmy podjąć działania w kierunku ujednolicenia i uproszczenia płatności elektronicznych.

Dlatego jak najszybciej należy wprowadzić w życie elementy zawarte w dyrektywie w sprawie praw konsumentów. Chodzi tutaj m.in. o likwidację ukrytych kosztów przy płatnościach w internecie i o przestrzeganie zakazu stosowania dodatkowych opłat wobec konsumentów z tytułu płatności kartami bankowymi i innymi środkami płatniczymi. Swobodne oraz tanie płatności przez internet mogą znacząco zwiększyć e-handel wewnątrz Unii.

Według Ecommerce Europe do najszybciej rozwijających się państw w dziedzinie handlu internetowego należą kraje spoza UE, jak Ukraina czy Turcja. Co więcej detaliczna sprzedaż online dóbr i usług w Europie wzrosła w 2012 r. aż o 19%. Aby rozwijać unijny rynek, musimy znosić obecne na rynku bariery, harmonizując prawo, co będzie wsparciem dla małych i średnich przedsiębiorców działających w internecie. Duża część z nich to młodzi ludzie i znoszenie barier może znacząco przyczynić się do zmniejszenia bezrobocia wśród tej grupy wiekowej. Komisja powinna bacznie obserwować ten rynek, gdyż w tej kwestii należy działać niezwykle dynamicznie – tak dynamicznie, jak rozwija się rynek elektroniczny.
