  Arlene McCarthy, rapporteur. − Mr President, as ever I want to place on record my thanks to everyone: to my shadows; to you, Commissioner Barnier; to the Irish Presidency in particular; and to all our staff and experts who worked extremely hard to help me as rapporteur to deliver these new rules on market abuse, enabling us to vote today on a tougher and more comprehensive set of rules, which I believe will be fit for a fast-moving, high-tech financial world.

This week sees the fifth anniversary – on 15 September – of the collapse of Lehman Brothers, which triggered turmoil in the global financial markets. Some argue that the culture which caused the crisis persists in the financial world, particularly as instances of abuse continue to hit the headlines. These new rules on market abuse are therefore a cornerstone of the programme of financial reform and rehabilitation necessary to restore trust and confidence in the markets. They are essential to ensure that we tackle the problem of what one financial commentator has described as greed and finance getting the whip hand over judgment, prudence and probity.

In July 2012, the LIBOR (London Interbank Offered Rate) scandal was an illustration of greed and market manipulation of the worst kind: manipulation of the most crucial interest rate in global finance, which underpins around USD 350 trillion in derivatives and USD 10 trillion in loans. Regulators in the EU and London were caught unawares because the existing market abuse rules did not cover abuse of non-financial instruments and benchmarks. As a result, the imposition of large fines and the initial prosecution of the LIBOR scandal were carried out by the US regulator, the Commodity Futures Trading Commission (CFTC), with individual traders being called to prosecution in the US by the Department of Justice.

I believe the litmus test of our new market abuse rules will be whether we are able to use them to capture potential or emerging abuses and whether they are tough enough to be a deterrent and to sanction abusive practices. Surely none of us believes that the best way to serve justice in the EU is to extradite those who commit abuses to the US, where they face tougher sanctions and longer jail sentences?

So the rules we are voting on today not only close the LIBOR loophole, but also extend the scope of market abuse rules beyond financial instruments to benchmarks and indices. This is particularly relevant and important amid press rumours and speculation that we are now seeing manipulation in energy markets – in the oil and gas sector – as well as potential manipulation in foreign exchange markets.

These rules provide regulators with a range of tough tools, including more severe sanctions and penalties, a lifetime ban for those committing abuse, and essential protection for whistleblowers. They give regulators the tools they need to monitor, detect and prosecute market abuse, because we know that it is difficult to gather evidence of such abuse.

So, colleagues, I ask you to vote to support these rules. They tackle serious gaps in the regulation of new markets, platforms and over-the-counter trading in financial instruments; close the loopholes for LIBOR, benchmarks, commodities and commodity derivatives; remove obstacles to effective enforcement for regulators; and introduce legal certainty to ensure their effectiveness and ensure that all market abuse can be subject to criminal sanctions.

I am also pleased to report that, with these rules, we have taken the first step towards a system of cross-border surveillance. Given that regulators have informed us that in one case more than seven EU Member States were involved in information-gathering, I think this is a very important step forward.

Finally, today’s vote sends a clear signal to those intent on committing market abuse that the EU is not a soft option or a safe haven. In fact, we have broad public support for the new rules that we will introduce with today’s vote.

  Michel Barnier, membre de la Commission. − Monsieur le Président, Mesdames et Messieurs les députés, là encore, nous tirons toutes les leçons de la crise financière, sans avoir, à aucun moment, la mémoire courte. En particulier à l'égard de gens qui se sont comportés – tout au long de cette crise, dès ses débuts et pendant de longues années – sans aucune morale et sans aucune éthique, mettant en péril la situation de milliers de citoyens et de tous les contribuables dans le monde.

Depuis 2010, avec cette détermination à laquelle je m'étais engagé, nous avons monté ensemble cette architecture de régulation pour remettre de la transparence là où elle n'existait pas, de la responsabilité, des règles, et, finalement, d'une certaine manière, un peu de morale là où elle avait totalement disparu. Tous ces engagements sont conformes à ce que nous avons décidé au niveau le plus élevé de l'économie mondiale – le G20 – et aux recommandations internationales du Conseil de stabilité financière, de l'OICV et du comité de Bâle.

Tout cela, les vingt dirigeants des grandes puissances économiques du monde l'ont rappelé, il y a quelques jours, à Saint-Pétersbourg. D'ailleurs, je trouve nécessaire et normal que le premier point à l'ordre du jour de chaque sommet du G20, comme à Saint-Pétersbourg, soit de dresser le bilan de la mise en œuvre de ce qui a été décidé depuis cinq ans. En tout cas, l'Europe est en train de concrétiser les engagements qu'elle a pris et elle est presque au bout de ce chemin.

Voilà pourquoi, Mme McCarthy, Mesdames et Messieurs, le texte dont vous débattez aujourd'hui, ce règlement que je vous ai proposé, est un élément important sur les abus de marché. Il apporte de la transparence et de la responsabilité. Nous devions adapter ce texte européen, qui était trop faible, parce que le monde a changé – comme l'a dit Arlene McCarthy –: les plateformes de négociation se sont multipliées, les marchés financiers et les marchés de matières premières sont de plus en plus intégrés, et puis toutes les nouvelles technologies vont évidemment plus vite que la capacité des pouvoirs publics à les surveiller.

Enfin, plus récemment, on a découvert ce que personne, ou peu de monde, n'avait imaginé: ces scandales de manipulation d'indices de référence, comme le LIBOR, qui minent la confiance et des citoyens et des investisseurs. Voilà pourquoi je vous ai proposé de renforcer les sanctions, avec pour objectifs la dissuasion, la répression et, quand il le faudra, dans certains cas, la prison pour ceux qui se comportent de la manière la plus scandaleuse.

Nous avons donc proposé cette révision de la directive sur les abus de marché sous la forme d'une proposition de règlement pour aller plus vite. Je suis très heureux que le Conseil ait adopté, le 26 juin, un accord politique avec le Parlement sur ce projet de règlement et je voudrais exprimer mes remerciements très sincères à Arlene McCarthy, mais aussi à Sharon Bowles, aux différents rapporteurs fictifs, Mme Pietikäinen, M. Klinz, M. Giegold et Mme Swinburne.

Grâce à votre travail, nous avons également pu améliorer, comme c'est souvent le cas, la législation actuelle, y compris ma propre proposition. Le règlement tient compte des évolutions des marchés financiers que je viens de rappeler, notamment les nouvelles plateformes de négociation, les MTF et les OTF, les transactions de gré à gré, les quotas d'émission de CO2. Il adapte notre cadre, autant que possible, aux nouvelles technologies des transactions à haute fréquence et il veille à ce que les nouvelles formes d'abus de marché, rendues possibles par ces nouvelles technologies, soient clairement interdites. Enfin, un point important pour moi, le règlement traite de la volatilité et de la financiarisation des marchés de matières premières, qui sont aussi l'objet d'un trop grand nombre de manipulations.

Je suis donc très heureux que l'on ait élargi ce cadre réglementaire aux abus de marché qui se produisent tant sur les marchés de matières premières que sur les marchés des instruments dérivés. Il s'agit d'un changement très significatif, comme d'ailleurs la toute dernière réponse que je vous ai proposée – et que vous avez soutenue – pour réagir au scandale du LIBOR et aux manipulations des indices de référence, qui feront d'ailleurs l'objet d'un nouveau cadre de régulation extrêmement strict que je proposerai, avec la Commission européenne, la semaine prochaine.

La dissuasion est un élément essentiel pour lutter contre les abus. Elle passe par la détection des abus, par des sanctions sévères et, quand il le faut, par des peines de prison. Le règlement accorde aux autorités compétentes les pouvoirs nécessaires pour détecter les abus et mener des enquêtes tout en respectant naturellement la très grande diversité des systèmes juridiques nationaux et les droits fondamentaux des citoyens.

Je souhaite remercier le Parlement d'avoir soutenu ce renforcement des sanctions administratives. Pour ne citer qu'un exemple, Mesdames et Messieurs les députés, la possibilité d'imposer des amendes maximales de 15 % – 15 % ! – du chiffre d'affaires est un signal très clair pour montrer que ces abus de marché et ces manipulations sont inacceptables et ne seront désormais plus acceptées.

Je sais que le Parlement aurait souhaité aller plus loin. Je peux le comprendre. C'est pourquoi nous avons prévu une clause de révision qui nous permettra, sans doute, de revenir sur ce point.

Enfin, un mot sur la directive sur les sanctions pénales pour les abus de marché, qui fait partie de ce paquet de propositions. Je sais que le Parlement veut faire progresser les trilogues sur ce texte également. C'est aussi mon souci, et j'espère que nous pourrons, avec la présidence lituanienne, réaliser des progrès significatifs pour parachever ce texte, qui fait partie du paquet, avec MIF 2 et la directive sur les sanctions pénales que je viens d'évoquer. Ce sont deux textes importants et nous avons donc, sur ce sujet-là aussi, beaucoup de travail à faire ensemble les jours et les semaines qui viennent.

  Richard Seeber, Verfasser der Stellungnahme des mitberatenden Ausschusses für Umweltfragen, öffentliche Gesundheit und Lebensmittelsicherheit. − Herr Präsident! Die Europäische Union hat sich in ihrem Kampf gegen den Klimawandel ein marktbasiertes Instrument geschaffen – das europäische Emissionshandelssystem. Und dieses System ist durch die MiFID-Richtlinie zu 80 % abgedeckt. Durch diese hier besprochene Verordnung werden die restlichen 20 % ebenfalls integriert. Sie betrifft also die unregulierten Spotmärkte und den Primärmarkt.

Das Emissionshandelssystem hat natürlich verschiedene Besonderheiten. Die Offenlegungspflichten, die in den anderen Märkten hauptsächlich die Emittenten betreffen, treffen hier die Marktteilnehmer. Emittenten sind ja die Staaten bzw. jetzt in der dritten Periode die Kommission. Diese Offenlegungspflichten sollen natürlich nur die Marktteilnehmer treffen, die einen Einfluss auf die Preisbildung haben. Der ETS-Markt ist so gestaltet, dass ca. 7 % der Teilnehmer 80 % der Emissionen verursachen und ca. die Hälfte der Zertifikate sozusagen von 20 Unternehmen verwendet werden. Daher ist es sinnvoll, hier besondere Regeln einzuziehen, aber wichtig ist natürlich, dass wir auch hier market abuse entsprechend sanktionieren, damit dieser Markt gut funktionieren kann.

  Alexandra Thein, Verfasserin der Stellungnahme des mitberatenden Rechtsausschusses. − Herr Präsident, Herr Kommissar, sehr geehrte Kolleginnen und Kollegen! Ich bin froh, dass wir im Rahmen der Finanzmarktregulierung dem Bürger zeigen können, dass wir Insidergeschäfte und Marktmissbrauch stärker bekämpfen.

Ich möchte der Berichterstatterin danken, dass sie die Anregungen aus dem Rechtsausschuss – in dem sie auch sitzt – aufgegriffen hat: dass wir unterschiedliche Schwellenwerte für die Offenlegung von Insidergeschäften haben, indem wir die unterschiedliche Größe der Börsen aber auch die unterschiedliche Größe der Einkommen berücksichtigen, dass wir weiter die unterschiedlichen Rechtstraditionen berücksichtigen, indem wir kein naming and shaming bekommen und dadurch die Privatsphäre Nichtbeteiligter schützen.

Und ich hoffe, dass wir mit der Begriffsbestimmung für Insiderinformationen richtig liegen und dass die Praxis damit sowie auch mit der Strafbarkeit des Versuchs in Zukunft umgehen kann und wir das richtig reguliert haben.

Ich denke, dass das wirklich ein großer Erfolg im Rahmen der Finanzmarktregulierung ist.

  Ildikó Gáll-Pelcz, a PPE képviselőcsoport nevében. – A befektetői bizalomnak az erősítése a piaci integráció szempontjából is rendkívül fontos. Gratulálok a jelentéstevőnek, mert nagyon alaposan, körültekintően nemcsak jogtechnikai, hanem piaci szempontból is meghatározta a bennfentes kereskedelem tevékenységét, és a manipuláció fogalmát. Rátért és értelmezte a közös pénzügyi felügyeletet és a gazdaságpolitikai szankciókat is.

Mindemellett olyan célkitűzéseket fogalmazott meg, amelyek egyértelműen ezen a piacon hozzájárulhatnak a feketegazdaságnak a visszaszorításához Európában.

Nagyon fontos, hogy ez a rendeletre irányuló javaslat a MiFID irányelv hatálya alá tartozó valamennyi pénzügyi eszközre kiterjed, és kiterjeszti a piaci visszaélésre vonatkozó keretrendszernek a hatályát is.

Nagyon fontosnak tartom a közös keretrendszer megalkotását, és ennek a célul történő kitűzését, mert ez alkalmas arra, hogy a piaci visszaélések területén egységes szerkezetben kezelje majd a piacokat és növelje a befektetői bizalmat.

Nagyon fontos, és nagyon kiemelendő, hogy közös felügyelet alá vonja a pénzügyi eszközöket. Azokat a pénzügyi eszközöket, amelyek alkalmasak lehetnek a visszaélésekre, így az algoritmikus kereskedést, a HFT kereskedést, de kiterjeszti a javaslat a hatályát a teljes elsődleges és szabályozatlan azonnali piacokra is.

Fontos a bennfentes információnak a meghatározása is, annál is inkább, mert ez az információ bármilyen módon alkalmas lehet a manipulációra. Én nagyon értékelendőnek érzem a javaslatban azt, hogy a piaci szereplőket, a piaci résztvevőket terheli a közzétételi kötelezettség, merthogy ez egy lényegesen szélesebb kör, és ezek a résztvevők valójában lényeges hatást gyakorolhatnak a kibocsátási egységek árképzésére. Támogatom, hogy a kibocsátási helyszínek átláthatóságát növelni kell, a szervezési és piacfelügyelet tekintetében azonos feltételek legyenek.

Még egy utolsó kiemelendő dolog: hogy nem fontos és nem szükséges, hogy egyértelműen az egyén manipulációs szándéka bizonyítást nyerjen, elég, hogyha fennáll az, hogy indirekt módon akár visszaélésre alkalmat adó magatartást tanúsíthat.

Még egyszer gratulálok Képviselő asszonynak, és természetesen a jelentést támogatni fogom.

  Evelyn Regner, im Namen der S&D-Fraktion. – Herr Präsident, sehr geehrter Herr Kommissar! Zunächst einmal Gratulation an Arlene McCarthy für dieses wichtige Stück Gesetzgebung zur Bändigung der Finanzmärkte. Erstmals gibt es eine EU-weite Definition von Insider-Handel, stärkere Durchgriffsrechte der Aufsichtsbehörden und eine gewisse europäische Aufsicht.

Am wichtigsten an diesem Stück Gesetzgebung ist aber, dass es mehr Vertrauen in die Finanzmärkte und einen höheren Anlegerschutz bringt. Vertrauen spielt eine doppelte Rolle. Auch die Akteure des Finanzmarkts müssen sich auf die Richtigkeit der Referenzwerte verlassen können. Wenn Banken den Libor-Zinssatz oder den ISDAfix manipuliert haben und womöglich gleichzeitig die betreffenden Swap-Geschäfte, ist das ein Skandal, und vom Vertrauen in die Finanzmärkte bleibt nicht mehr viel übrig. Das Vertrauen der Anleger und der europäischen Bürgerinnen und Bürger kann aber erst gewonnen werden, wenn alle Mitgliedstaaten verpflichtend teilnehmen und hier harte, abschreckende Sanktionen festlegen. Nur so kann die Integrität der Finanzmärkte Europas auch gewährleistet werden.

Die vorliegende Verordnung sagt, Marktmissbrauch umfasst jegliches unrechtmäßige Handeln an den Finanzmärkten. Dieser Satz aber muss jetzt mit Leben gefüllt werden. Die europäischen Institutionen und die Mitgliedstaaten sind gefordert, bestehende Vorhaben, wie etwa die Regulierung der Schattenbanken, in die Wege zu leiten, zu beschließen und ohne weitere Verzögerung umzusetzen.

  Wolf Klinz, im Namen der ALDE-Fraktion. – Herr Kommissar, liebe Kolleginnen und Kollegen! Ich kann mich an eine Zeit erinnern, da waren Insider-Handel und Marktmissbrauch eher ein Kavaliersdelikt, denn ein echtes Vergehen. Und gleichzeitig wurden beiden Straftatbestände in den USA schon mit harten Strafen belegt. Erst 2003 hat die Europäische Union eine Richtlinie gegen Insider-Handel und Marktmissbrauch vorgelegt. Seitdem haben sich die Umstände aber gravierend verändert. Wir haben heute eine Vielzahl von Handelsplattformen und wir haben heute Finanzinstrumente, die vor zehn Jahren noch gar nicht bekannt waren.

Insofern ist es richtig und wichtig, dass sich das Europäische Parlament auf der Grundlage eines Vorschlags der Kommission mit diesem Thema beschäftigt hat. Und ich glaube, das was zwischen Parlament und Rat ausgehandelt worden ist, kann sich sehen lassen. Es ist ein guter Vorschlag, der uns wirklich nach vorne bringt.

Wir haben jetzt eine einheitliche Definition von Insider-Geschäften. Die Regulierungsbehörden bekommen mehr Befugnisse: Sie können nicht nur gegen Unternehmen vorgehen, sondern auch gegen natürliche Personen, bis hin zu einem lebenslangen Berufsverbot. Drittens werden – und das ist ganz wichtig – nicht nur Finanzinstrumente, sondern auch die Marktmanipulation von Indizes bestraft, einschließlich der Preisfestlegung bei Rohstoffen wie Öl und Gas.

Und das Letzte, das positiv anzumerken ist: Die whistleblower werden geschützt und können tatsächlich ihre Aufgabe erfüllen, ohne Sorge zu haben, dass ihnen daraus berufliche oder persönliche Nachteile entstehen. Trotz alledem bleibt noch etwas zu tun.

Ich glaube, dass wir bei der Frage der grenzüberschreitenden und marktübergreifenden Überwachung und Erfassung noch nicht am Ende angekommen sind, da müssen wir noch weiterarbeiten. Ich glaube auch, dass wir nicht das endgültige Ziel erreicht haben, wenn wir die legalen Insider-Geschäfte auf 5 000 oder 20 000 Euro begrenzen, sondern hier müssen wir darauf achten, wie sich das in Zukunft entwickelt. Und eigentlich ist die Marktkapitalisierung die bessere Basis, denn es ist ein absoluter Wert.

Und der letzte Schritt ist, dass wir einfach zur Kenntnis nehmen müssen, dass es in Europa 28 unterschiedliche Strafrechte gibt. Insofern wird die strafrechtliche Verfolgung von Marktmanipulation noch lange unterschiedlich sein. Trotz alledem ist es ein guter Schritt in die Zukunft, auf dem wir aufbauen können.

  Kay Swinburne, on behalf of the ECR Group. – Mr President, I am very wary of those who think a vote on this regulation is the end of the story. The original Market Abuse Directive has been in place for the entire financial crisis and the many scandals of LIBOR (the London Interbank Offered Rate) and product mis-selling that we have seen across the EU in recent years have occurred despite the existence of legislation in individual Member States and in countries around the world.

Having rules is not good enough. This has to be about effective supervision and enforcement. The competent national authorities on the ground need to make it clear that abusive practices will not be tolerated, and fines need to be set at such a high level as to be a genuine deterrent. Personally I am disappointed at the low level set in this legislation as a maximum fine that can be levied for market abuse: 15% of turnover is simply the price of doing business in some markets, and I fear it will not be an effective deterrent for some players. Recently, European banks found guilty of market manipulation by US authorities have been fined amounts ranging from USD 100 to USD 1 billion, on the basis not of their turnover but of the impact their actions have had on others.

It is time that the EU as a whole enforced our market legislation on abuse firmly and successfully and prosecuted individuals and institutions across all our markets. In the interests of market confidence, I hope that my own Member State and as many others as possible will use the discretion given to them in this legislation to go further and make certain that financial crime does not pay. Deterrents, including punitive fines and, where necessary, criminal sanctions, need to be applied.

  Marisa Matias, em nome do Grupo GUE/NGL. – Senhor Presidente, eu também quero agradecer o trabalho realizado pela Colega Arlene McCarthy. Faz exatamente agora neste mês de setembro cinco anos que tivemos o escândalo da Lehman Brothers, e continuamos a conviver todos os dias com problemas de abuso de mercado, de abuso de informação privilegiada, de manipulação de mercado, opacidade, falta de transparência, imoralidade. Eu acho que podemos e devemos usar mesmo essa palavra neste caso: imoralidade.

Há manipulações que vão desde a alteração dos números, a interferência nas taxas de juro, ao escândalo dos índices de referência e muitas mais que poderíamos identificar. E é bem verdade que em todos os países da União Europeia nós continuamos a assistir todos os dias a notícias que aparecem nas principais páginas dos jornais, de revelação de indivíduos ou instituições que tiveram acesso a essas informações. E por muito que seja difícil provar, a verdade é que não se tenta sequer fazer provar este crime e há total impunidade ainda a acontecer. São raros os casos em que estes crimes foram penalizados. Ora, não é porque sejam cometidos por indivíduos de gravata ou de casaco, ou por instituições que acham que estão além daquilo que são as sanções normais da sociedade, que não devem ser punidos. Devem ser punidos e devem ir até pena de prisão se for esse o caso, porque para criminosos o resultado deve ser a pena de prisão, independentemente daquilo de que estamos a falar. E só com sanções concretas e com regulação concreta poderemos finalmente falar do mercado financeiro ao serviço da sociedade, e não da vergonha a que estamos a assistir desde há cinco anos a esta parte.

  Hans-Peter Martin (NI). - Herr Präsident! Auch als jahrzehntelanger Kassandra-Rufer im Bereich der Finanzmärkte musste man sich in jüngster Zeit schon die Augen reiben: die Manipulation des Interbanken-Indexes Libor, die Manipulation im Öl- und Gasbereich mit den nachfolgenden Untersuchungen bei BP, Statoil und Platts, weitere Manipulationen im Bereich der Derivate und der Rohstoffmärkte. Das war alles auch eine Folge des falsch verstandenen Neo-Liberalismus in der Tradition, muss man sagen, von Tony Blair und Gerhard Schröder.

Arlene McCarthy gehört jetzt zu denjenigen, die bei der Regulierung der Finanzmärkte in die Geschichtsbücher eingehen können, als eine, die aus einer Gruppe kommt und sich von Saulina zur Paulina wandelt. Es ist gut, was sie vorlegt, es ist sehr erfreulich! Der Geltungsbereich, die Definitionsvereinheitlichung, die Strafbestimmungen – da sind wir auf dem richtigen Weg. Peinlich genug, dass die USA bisher schon viel strengere Regelungen haben als wir. Aber es gibt noch sehr viel zu tun, Arlene! Es ist sehr schade, dass der Kommissar, der hier sitzt – und vielleicht kannst du ihn nochmals darauf ansprechen –, nicht wie angekündigt schon im Juni die Regulierung zu dem Bereich vorgestellt hat, in dem du hauptsächlich tätig bist, im Bereich des too-big-to-fail und des Liikanen-Berichts.

  Olle Ludvigsson (S&D). - Herr talman! Det gläder mig att en första trialogöverenskommelse gällande förordningen om marknadsmissbruk nu finns på bordet. Som jag ser det är den lagstiftning som vi är på väg att anta ett stort steg framåt i flera avseenden.

En viktig aspekt är att tillämpningsområdet utökas rejält. Manipulation av exempelvis styrräntor som Libor och Euribor omfattas av de nya reglerna. Detsamma gäller insiderhandel och otillbörlig marknadspåverkan inom avista-råvaruhandeln, handeln med utsläppsrätter och den OTC-handel som äger rum utanför de reguljära marknadsplatserna. I och med detta skapas ett regelverk som täcker en mycket stor del av marknaden. De vita fläckarna på kartan görs betydligt färre. Det tycker jag är utmärkt.

En annat viktig aspekt är att whistleblowers – alltså interna uppgiftslämnare – ges ett bättre skydd än tidigare. De anställda på olika finansföretag ska anonymt kunna rapportera om missförhållanden utan att behöva frukta repressalier från arbetsgivaren. Detta är en avgörande förbättring som definitivt kommer att ge en ärligare och mer stabil marknad.

Förhandlingarna i frågan om marknadsmissbruk måste nu drivas på, så att även de relaterade direktiven kommer på plats.

  Miroslav Mikolášik (PPE) - Vnútorný trh s akýmikoľvek službami vrátane tých finančných musí byť založený na jasných pravidlách, v dostatočnej transparentnosti a zároveň ochrane zdravej a efektívnej hospodárskej súťaže.

Integrita finančných trhov, respektíve aktérov na nich pôsobiacich, bola v posledných rokoch značne naštrbená. Nedá sa očakávať, že budú všetci účastníci trhu konať len podľa morálnych pravidiel profesionálnej etiky.

Takéto jednanie musí byť vyžadované právnymi predpismi a práve v prípade porušenia aj efektívne sankcionované. Niektorým sa totiž môže zdať výhodné konanie neetické a nezákonné a môžu z toho profitovať.

Súhlasím preto so zavedením účinných a transparentných opatrení a postupov na efektívne odhaľovanie zneužívania a manipulácie na finančných trhoch.

  Michel Barnier, membre de la Commission. − Monsieur le Président, je voudrais remercier brièvement la rapporteure, Arlene McCarthy, les rapporteurs fictifs et tous ceux qui sont intervenus pour souligner l'importance de ce texte, comme Mme Gáll-Pelcz, Mme Regner ou M. Klinz.

Ce texte constitue une étape fondamentale, puisqu'il a un champ d'application très large et qu'il prévoit une supervision européenne et des règles communes. Cette réforme fait partie de nos efforts globaux pour remettre de l'ordre, de la transparence, de la responsabilité dans les marchés financiers, et aussi – c'est malheureusement nécessaire, comme nous l'avons vu – prendre des sanctions pour dissuader ou pour réprimer. La proposition concernant la régulation du système bancaire "parallèle" et des fonds monétaires est maintenant sur votre table. Nous poursuivons nos efforts parce que, comme Mme Regner l'a évoqué, nous avons encore du travail pour les mois qui viennent.

M. Klinz a dit une chose importante sur l'évolution des marchés financiers, qui est extrêmement rapide. Nous devons en effet être capables de nous adapter, d'évoluer, de revenir sur ce sujet pour essayer de suivre la vitesse à laquelle les marchés financiers évoluent. Parfois, certains, sur ces marchés financiers, essaieront de détourner ou de contourner les règles pour éviter certaines sanctions. Là encore, nous n'aurons pas la mémoire courte et nous devrons être intransigeants. Voilà pourquoi la clause de révision contenue dans ce texte est importante: elle nous permettra d'adapter les règles, d'évaluer le contenu de ce texte que nous adoptons aujourd'hui.

Madame Swinburne, vous jugez insuffisants les 15 % de pénalisation par rapport au chiffre d'affaires. Je comprends votre point de vue et je peux d'ailleurs vous rejoindre là-dessus, mais il s'agit d'un compromis entre les différents États membres et le Parlement. Je rappelle que c'est un minimum qui devient obligatoire pour la première fois. Rien n'interdit aux États membres – y compris au vôtre – d'aller beaucoup plus haut s'ils trouvent ces 15 % de pénalisation insuffisants.

En tout cas, nous évaluerons ce point, comme tous les autres, dans le cadre de la clause de révision. Je veux souligner que le signal que nous envoyons – et que vous envoyez – aujourd'hui par votre vote est extrêmement important à l'égard d'un certain nombre de gens qui se sont cru tout permis sur les marchés financiers, et à qui nous avions tout permis. Désormais, ce ne sera plus le cas, grâce au vote du Parlement et au travail du Conseil.

  Arlene McCarthy, rapporteur. − Mr President, again I want to thank, in particular, my shadows for their commitment to what was a very detailed piece of work and a very complex dossier. Perhaps that is why Ms Swinburne misunderstood: what we have here are indeed minimum sanctions, they are not maximum. There is discretion to go further and indeed, as she has requested, we have also asked Member States to put in more resources so that we have more effective supervision and enforcement.

This is the beginning of a long-term process. While we have the potential to review the regulation, however, I want to ask colleagues to support this text with no amendments. I am baffled by the EFD Group amendment for a split vote which ultimately attempts to stop competent authorities from cooperating to tackle market abuse. It would mean they would not be able to gather evidence; it would mean they would not be able to conduct cross-border investigations on scandals such as that of LIBOR (the London Interbank Offered Rate). It would let perpetrators of market abuse off scot free: they would have a free ride. So I would ask colleagues not to vote for the EFD amendment. We need global cooperation and EU-wide cooperation to be able to conduct these investigations.

The Lithuanian Presidency representatives are not here but I wish to give them a very strong message – as, indeed, the Commissioner has done – that we would like to begin the trialogue, and to prioritise wrapping this up, with the question of criminal sanctions. We know some Member States have opted out here but that is not a reason not to proceed, and I hope the Lithuanian Presidency will accord the matter priority. I have been somewhat concerned to hear that this is not seen as one of the Presidency priorities. Let us hope we can change that with today’s vote, so we can put the final piece in this jigsaw.

Thanks again to my colleagues, to the Commission and to the Irish Presidency, and I hope today that we get a strong vote for strong rules on market abuse.

  George Sabin Cutaş (S&D), în scris. – Buna funcționare a piețelor financiare și încrederea cetățenilor și a actorilor economici reprezintă precondiții pentru o economie stabilă. Manipularea informațiilor financiare poate cauza pierderi semnificative pentru investitori și dăuna economiei reale, așa cum s-a întâmplat în cazul scandalului Libor/Euribor, în care diverse bănci au manipulat dobânzi interbancare, modificând sumele pe care oamenii le-au plătit pentru împrumuturi și le-au primit în schimbul banilor economisiți.

De aceea, prezentul regulament, care urmărește să elimine situațiile de abuz de piață, va contribui la îmbunătățirea transparenței, integrității și eficienței în domeniu, căutând nu doar să-i protejeze pe cei implicați în tranzacționare, ci și să evite destabilizarea pieței financiare a Uniunii Europene. Prin propunerea unui cadru legal unic, aplicabil pe întreg teritoriul Uniunii și a unor sancțiuni comune, construim un mediu previzibil, propice investițiilor și în măsură să contribuie la creșterea economică.
