  Agustín Díaz de Mera García Consuegra, Ponente. − Señor Presidente, hemos recorrido un largo camino desde que iniciamos este expediente. Antes que nada, me gustaría agradecer un montón de comprometidos trabajos: el trabajo realizado por todos mis colegas, los ponentes alternativos; la labor realizada por la Comisión, por su altura de miras, su profesionalidad y su espíritu colaborador; al Consejo, a sus diferentes Presidencias, que fueron la polaca, la danesa, la chipriota, la irlandesa y la lituana; y, por supuesto, a los servicios de la Cámara y, singularmente, a los de la Comisión de Libertades Civiles, Justicia y Asuntos de Interior.

Han sido casi dos años y medio de negociación, en los que hemos celebrado, además de numerosísimas reuniones técnicas, ocho diálogos tripartitos y ocho shadow meetings, lo que viene a reflejar lo complicado pero a la vez importante que es este informe. Finalmente y felizmente el pasado 25 de junio logramos alcanzar un acuerdo mayoritario entre los Grupos PPE –el mío–, ALDE y ECR, junto con la Presidencia irlandesa, que fue posteriormente ratificado por unanimidad en el Consejo del 18 de julio.

Agradezco a todos los acuerdos y también agradezco las discrepancias. Las discrepancias enriquecen el expediente y enriquecen el debate. Y también quiero dar las gracias a la Comisión, con la que hubiese deseado tener mayores niveles de coincidencia en ciertos aspectos. Pero muy especialmente agradezco la sensibilidad mostrada finalmente por el Consejo y por la actual Presidencia, que entendió que este era un buen texto y prueba de ello fue su voto favorable por unanimidad.

El acuerdo alcanzado viene a reforzar la política de visados de la Unión, haciéndola aún más eficaz, solidaria y justa y protegiendo los derechos de nuestros ciudadanos. El reto al que nos enfrentábamos era difícil, pero hemos logrado recoger —creo yo— todas las sensibilidades y dar una respuesta inteligente que garantiza la solidaridad y la igualdad de trato de todos los ciudadanos europeos. Y todo ello en difícil equilibrio, teniendo también y muy especialmente en cuenta la política exterior de la Unión. Hemos alcanzado importantes compromisos en cuestiones tales como los visados de los miembros de las tripulaciones aéreas y marítimas, y también para los miembros de misiones de rescate y emergencia, para tripulaciones de buques en vías fluviales internacionales, para organizaciones no gubernamentales y para refugiados —por su singularidad— en el Reino Unido e Irlanda.

A pesar de que el debate sobre los mecanismos de reciprocidad y suspensión haya hecho pasar estos aspectos a un segundo plano, los puntos a los que me acabo de referir son también muy importantes y dan respuesta a tantas cuestiones diarias que la necesitan. Efectivamente, hemos centrado gran parte de nuestros esfuerzos en encontrar una solución equilibrada para los mecanismos de reciprocidad y de suspensión. Necesitábamos encontrar unos instrumentos eficaces y solidarios que, sin descuidar las relaciones exteriores de la Unión, dieran una respuesta solidaria a las situaciones de trato discriminatorio a nuestros ciudadanos.

Entiendo y respeto los reparos de algunos colegas por las repercusiones que estos mecanismos puedan tener sobre terceros países, pero debemos proteger a los ciudadanos europeos y buscar soluciones a los problemas que ahora mismo padecen millones de ciudadanos. Pienso en polacos, rumanos, búlgaros, checos o chipriotas. Este acuerdo contiene esta solución y además no busca confrontaciones con terceros países, y todo ello, además, protegiendo los poderes que el Tratado de Lisboa otorga al Parlamento.

Todos conocemos la problemática horizontal sobre el uso de los actos delegados y de ejecución, pero hay un acuerdo generalizado según el cual esta cuestión debe ser estudiada caso por caso. Todos los razonamientos jurídicos son interpretables, pero lo que está claro es que el uso de unos u otros mecanismos legislativos depende del objeto jurídico que motive la decisión a adoptar. Prueba de la idoneidad de estas soluciones no es solo que el texto haya sido adoptado por unanimidad en el Consejo, sino que, hasta el mes de julio, encontró el apoyo prácticamente unánime de todos los grupos políticos de esta Cámara.

Si leemos la historia de este expediente, vemos que lo que hoy tenemos es un reflejo de lo que hablábamos en 2011, al inicio del debate. Todos nos marcamos unas líneas rojas que no hemos superado: automatismo, solidaridad, igualdad interinstitucional y respeto a las relaciones exteriores de la Unión. Y por todo ello hoy puedo presentaros este acuerdo y defenderlo consciente de que es la mejor respuesta que podemos dar al reto que nos marcamos hace más de dos años.

  Neven Mimica, Member of the Commission. − Mr President, the Commission is well aware of the importance and sensitivity of this file and, in particular, of the two mechanisms containing the amendment proposal – suspension and reciprocity – which are essential to maintaining the credibility and efficiency of the common visa policy and solidarity between the members. The Commission has worked tirelessly with the presidencies and Parliament in order to obtain a compromise leading to efficient and legally sound mechanisms.

I must thank in particular Mr Díaz de Mera for his tremendous effort in reaching a compromise, in what has been a long and complex negotiation, but one in which a cooperative spirit has always been maintained between the presidencies, the rapporteur and the shadows, and the Commission.

I am glad we have been able to finalise these long negotiations. The two mechanisms which are the essential element of this amendment were needed in order to have a visa waiver system which is not open to abuse but which also ensures that all EU citizens are treated equally by our third country partners. The suspension mechanisms, in particular, will ensure that we can continue our visa liberalisation negotiations with the knowledge that when the visa-free regime is granted to citizens of a certain third country, this is not a country- or region-specific mechanism, but a general one. We will then have a safety brake that can be triggered to avoid a possible abuse of visa-free travel.

This will greatly add to the credibility of our visa system, but I must also tell you that the Commission has mixed feelings about the compromise we are debating today. Despite the satisfaction that an agreement has finally been found, the Commission is disappointed about the form chosen for the reciprocity mechanism. The Commission cannot accept the current text on these mechanisms, as we have strong doubts about its legality and effectiveness. Let me say a few words on that.

As a matter of principle, implementing and delegated acts cannot be used for taking the same decision. It is possible to have both implementing and delegated acts provided for in the same legislative text but for different types of mechanisms, which is not the case here. In the compromise, during a period of two years any decision would be taken through an implementing act, but after two years the procedure would switch to delegated acts. On this the Commission cannot agree. Moreover, the nature of the measure does not allow for the use of delegated acts. The reciprocity mechanism concerns a specific country whose citizens do not need a visa to visit the EU and which imposes a visa obligation on the citizens of one or more EU Member States.

The measure left to the Commission consists of temporarily derogating from the regulation with regard to that individual third country. This is a concrete and specific individual situation, not a measure for general application as the Treaty requires for a delegated act. And beyond matters of form, the political objective – to have a more efficient reciprocity mechanism – has not been reached. The current compromise will not be efficient, as during the first two years the Commission can only adopt an implementing decision suspending the visa waiver for certain categories of citizens of the third country in question, such as diplomatic and service passport holders. For this reason, in anticipation of the vote on Thursday and the subsequent acts by the Council, I need to make the following formal statement on behalf of the Commission:

‘The Commission welcomes the adoption by the European Parliament and the Council of its proposal amending Regulation No 539/2001 aiming at enhancing the credibility of the common visa policy and ensuring more solidarity amongst Member States. However, the Commission regrets that the powers conferred on the Commission with regard to the revised reciprocity mechanism are, in the opinion of the Commission, not in compliance with Articles 290 and 291 of the Treaty on the Functioning of the European Union. The Commission therefore reserves the right to make use of the remedies available under the Treaty with a view to having this point clarified by the Court of Justice.’

  Véronique Mathieu Houillon, au nom du groupe PPE. – Monsieur le Président, Monsieur le Commissaire, chers collègues, je tiens aujourd'hui à féliciter chaleureusement notre collègue Agustin Díaz de Mera García Consuegra. Il l'a rappelé: ce résultat est le fruit de deux ans et demi de négociation, de tous ses efforts et de sa ténacité pour dégager un accord sur cette réforme cruciale, et ce malgré toutes les pressions et les changements de position intervenus au cours des négociations. Le résultat est plus que probant.

Ce rapport nous permet de mieux gérer notre politique européenne des visas. Jusqu'à présent, nous n'étions pas armés pour réagir à toute nouvelle évolution consécutive à l'octroi de l'exemption de visa à un pays tiers. Désormais, nous disposons d'une réelle politique européenne, puisque nous pouvons réagir collectivement pour dénoncer un État tiers qui imposerait toujours une obligation de visa aux ressortissants de certains États membres, alors même que nous le dispensons de visas. Nous pourrons alors rétablir en retour l'obligation de visa pour cet État.

Ce principe de réciprocité que nous mettons en œuvre est fondamental. Il donne sens à notre gestion européenne des frontières et concrétise notre engagement commun. Désormais, nous disposons d'un mécanisme adéquat nous permettant de suspendre temporairement une exemption de visa d'un pays tiers en cas d'augmentation rapide et substantielle d'entrées illégales, sur le territoire européen, de ses ressortissants ou de rejet de demande de réadmission de ses ressortissants, ou de pression sur le système d'asile.

En effet, nous ne pouvons pas être naïfs. Si l'exemption de visa pour des séjours courts est détournée au profit de l'immigration irrégulière, si elle conduit à une pression trop importante sur nos systèmes d'asile, il est normal que nous protégions nos citoyens européens et rétablissions une obligation de visa. Car l'exemption de visa est certes un droit que nous accordons à certains pays tiers, mais c'est également un devoir, devoir de ne pas dévier et abuser de ce droit.

Cette réforme nous permet donc une gestion juste et réaliste de notre politique de visas afin de prévenir tout abus.

  Tanja Fajon, v imenu skupine S&D. – Zelo sem razočarana, da se danes pogovarjamo o predlogu poročila, ki bo začrtal prihodnjo vizumsko politiko Unije, a se hkrati z njim odrekamo pristojnostim, ki jih ima Evropski parlament v postopku soodločanja, ko gre za najbolj občutljiva vprašanja, to je svobodo gibanja Evropejcev.

V pogajanjih smo bili deležni pritiskov, neprožnosti in celo izsiljevanj Sveta, zato ne razumem, zakaj se je poročevalec de Mera, s katerim sva odlično sodelovala, v zadnjem trenutku odločil, da se odreče delegiranim aktom, pristojnostim Evropskega parlamenta, ko gre za uvedbo mehanizma o začasni zamrznitvi brezvizumskega režima.

Zelo resno tvegamo, da bodo evropske vlade tak mehanizem izkoristile kot politično sredstvo za nabiranje domačih političnih točk proti prišlekom iz sosednjih držav. V mislih imam posebej državljane Zahodnega Balkana, za katere je bila odprava vizumov zgodovinski korak na poti v Unijo. Resno bomo ogrozili ne le prihodnost vizumske politike, ampak tudi našo politiko do sosedstva.

Kdo nam jamči, da bo mehanizem le skrajni ukrep? Že dolgo časa obstajajo poskusi, da bi eni ali več državam Zahodnega Balkana vizume vnovič uvedli. Bomo dovolili ta udarec državam, ki jim obljubljamo jasno evropsko perspektivo? Ne da bi obdržali varovalke demokratičnega nadzora na naši instituciji, v našem Evropskem parlamentu?

Podobno velja za mehanizem vzajemnosti. Naše pravne službe pod vprašaj postavljajo oba dogovora. Prvega zaradi že omenjenega odrekanja pristojnosti, drugega zaradi kombinacije delegiranih in izvedbenih aktov, kar je omenil gospod komisar. Grozi nam tožba Evropske komisije pred Evropskim sodiščem. Slišali smo, da ima Komisija mešane odzive, občutke.

Vsem, ki verjamete, da bo mehanizem pomagal pri vzajemni odpravi vizumov – denimo med Kanado in Češko – želim sporočiti, da se to ne bo zgodilo. Evropske vlade so v izjavi, ki je pricurljala v javnost, zajamčile, da bodo pred kakršno koli odločitvijo dale prednost odnosom s strateškimi partnerji. Si res predstavljate, da bi celotna Evropska unija vnovič uvedla vizume za državljane Združenih držav Amerike ali Kanade, če bodo te še naprej zahtevale vizume za preostalih 6 držav Evropske unije? To je, dragi kolegi, politično orodje, ki žal ne bo nikoli aktivirano!

Kolegice in kolegi! Pozivam vas, da ta teden glasujete proti poročilu in s tem omogočite, da v drugem krogu, v drugem branju zaščitimo pristojnosti Evropskega parlamenta, ki nam pripadajo po Lizbonski pogodbi na področju vizumske politike. Gre za najbolj občutljiva vprašanja, ki zadevajo naše državljane, za najbolj otipljivo svobodo gibanja, ki jo naši Evropejci danes občutijo, za temelj evropskega povezovanja. In posebej zadevajo mlade, ki danes največ potujejo in ki imajo že tako najmanj svetlo vizijo.

Dogovor, ki ga imamo zdaj pred sabo, je slab, je škodljiv za naše državljane, je slab za naše odnose s Svetom Evropske unije, je slab za celotno Evropsko unijo in naše sosedstvo.

Imamo izjemno odgovornost, ko bomo glasovali ta četrtek. Vizumske politike na tak način v Evropski uniji ne bomo okrepili, nasprotno, ogrozili jo bomo in ogrozili bomo svobodo gibanja naših državljanov.

  Franz Obermayr (NI), Frage nach dem Verfahren der „blauen Karte“. – Herr Präsident! Ich möchte mir erlauben, an die Frau Vorrednerin, doch zwei Fragen als Betroffener bzw. Angehöriger eines Landes zu stellen, das von dieser Westbalkan-Öffnung doch einigermaßen betroffen ist.

Sie haben mit großer Begeisterung von der Öffnung des Westbalkans durch die Visa-Liberalisierung gesprochen. Mich würde es schon interessieren, ob Sie die Situation speziell in angrenzenden Ländern – ich spreche hier von meinem Heimatland Österreich – auch verfolgt haben. Wir konnten feststellen, dass hunderte Busse mit Menschen, die eben als Touristen, als Besucher aus Staaten des Westbalkans nach Österreich kamen, leer wieder zurückgefahren sind. Die Reisenden sind untergetaucht und nicht mehr in ihre Heimatländer zurückgefahren. Wissen Sie das und können Sie sich vorstellen, was das für die betroffene Bevölkerung wirklich bedeutet?

  Tanja Fajon (S&D), Odgovor na vprašanje, postavljeno z dvigom modrega kartončka. – Hvala lepa kolega Obermayr, da ste mi dali to priložnost, da vam zelo konkretno odgovorim.

Zelo poznani so mi podatki iz zadnjega poročila Frontexa, kaj se dogaja na mejah v Evropski uniji. Vi imate to srečo, da prihajate iz države, ki ima najmanj problemov. V Avstriji ni prišlekov iz držav Zahodnega Balkana. Avstrija je uvedla čudovit sistem. Postavila je vse države Zahodnega Balkana, ki so v procesu pristopanja Evropski uniji, na seznam držav varnega izvora.

So težave prišleki iz Zahodnega Balkana, prihajajo v Evropsko unijo, vendar se je število teh izjemno zmanjšalo in države, vlade na Zahodnem Balkanu so naredile vse nujne korake, da bi preprečile prihod lažnih azilantov.

Mislim, da moramo tu predvsem razmišljati na solidarnost in iskati druge poti. Iskati poti, da bomo države, posebej ko govorim za našo soseščino, pustili, da stopajo naprej proti Evropski uniji, sami pa jim pomagali na tej poti. Gre za zelo težke življenjske zgodbe, gospod kolega.

  Cecilia Wikström, för ALDE-gruppen. – Herr talman! Detta är ett viktigt betänkande, för det innehåller en skyddsklausul för tillfälligt upphävande av visaliberaliseringar för tredje länder när ett av våra medlemsländer utsätts för en ökad mängd ogrundade asylansökningar. Men målet – som jag vill framhålla – är att vi trots allt ska uppnå en visaliberalisering.

Genom ömsesidighetsmekanismen ökar vi solidariteten mellan våra länder och sänder samtidigt en mycket stark signal till omvärlden, nämligen att alla medlemsländer ska behandlas lika när det gäller viseringar.

Beträffande kommittéförfarandet rekommenderar ALDE-gruppen att vi ska rösta denna vecka och inte använda debatten om delegerade akter som ett skäl för att förkasta den överenskommelse som efter mycket möda och stort besvär trots allt har uppnåtts.

Det jag vill understryka idag är att vi behöver ökad solidaritet. Vi behöver visa den solidariteten och visa att vi hör ihop gentemot omvärlden.

  Tatjana Ždanoka, on behalf of the Verts/ALE Group. – Madam President, first of all I would like to thank our rapporteur, Mr Díaz de Mera, for our fruitful cooperation along this ‘very long road’, as it was referred to, along which we have travelled for two and a half years, and for the personal efforts of Mr Díaz de Mera in maintaining the position of Parliament, as adopted in the vote in the Committee on Civil Liberties, Justice and Home Affairs. Unfortunately, the results of the negotiations are not very positive from the point of view of my group, the Greens/EFA Group.

On the one hand, there is progress on visa reciprocity. You all remember that the original amendment, which was proposed by our respected colleague Alexander Alvaro – whom I a wish good recovery – and supported by our group and a number of other shadows and colleagues here in this room, was on almost automatic reintroduction of visas for the nationals of the third country that introduced, reintroduced or maintained visa requirement for nationals of a Member State. It was not fully supported. However, the Council, as you know, is ready to agree a two-stage mechanism where, in the end, the Commission would be obliged to ensure reciprocity.

We understand your dissatisfaction, Commissioner Barnier, but I have to say that the progress is there. On the other hand, we are completely disappointed with the deal concerning the temporary suspension of visa waiver. In the Greens/EFA Group, we do not agree that the increase in the number of asylum applications could be a criterion for suspension. The nationals of a third country on a positive list should not be punished for the attempts of the nationals of the same country to use the individual right to asylum without a good reason. Moreover, by not supporting the given criteria for suspension, we are certain that it must not go through an implementing act, as colleagues felt. If permanent restoration of visas goes thorough codecision, Parliament should also be able to block a temporary one. Thus, only a delegated act would ensure that its elementary prerogatives are duly protected. Taking all this into account, my group cannot support the first reading agreement.

  Cornelia Ernst, im Namen der GUE/NGL-Fraktion. – Frau Präsidentin, meine Damen und Herren! Mit dieser Verordnung, das sollten wir doch auch ehrlich sagen, verändert sich der Charakter der Visumpolitik der EU.

Was meine ich damit? Ich meine, dass die Visumpolitik zu einem Erpressungsinstrument wird. Einem Erpressungsinstrument – in diesem Fall – vor allem gegenüber dem Westbalkan. Und wenn wir irgendetwas damit stärken, dann ist es die Solidarität unter den reichen Ländern, zum Beispiel Deutschland und Österreich.

Der Aussetzungsmechanismus, die Aussetzung der Visumfreiheit, ist eine „Lex Roma“, sprechen wir es doch deutlich aus. Darum geht es doch in vielen Fragen und führt bereits jetzt dazu, dass an den Grenzen Serbiens Roma, oder Menschen, die so aussehen wie sie, ohne Begründung aufgehalten und zurückgeschickt werden, dass Busunternehmer ohne Gründe Roma nicht in Fernbusse einsteigen lassen, dass in Mazedonien ein Gesetz beschlossen wurde, welches dazu führt, dass Asylsuche unter Strafe gestellt wird. Reiseverbote, Passentzug und Ausreiseverbote, das sind jetzt schon die Folgen, bevor wir diese Regelung haben, und danach wird es noch sehr viel schlimmer sein.

Grundrechtsverletzungen, denen mit dieser Verordnung Vorschub geleistet wird, darum geht es doch! Und ich frage Sie, waren sie schon ein Mal in einem dieser Länder? Ich habe mir das in Serbien angeguckt. Da haben Leute auf einer Müllhalde gelebt, aber nicht weil die Roma gerne auf Müllhalden leben, sondern deshalb, weil deren Häuser in den Städten mit Bulldozern beseitigt wurden. So sieht doch die Sachlage aus. Wir haben es hier mit Rassen-Profiling zu tun, wir haben es hier mit Menschenverachtung zu tun. Und mich ärgert, dass die EU mit einer solchen Verordnung dabei mitmacht.

Ich glaube, dass die EU sich um ihre menschenrechtliche Aufgabe drückt. Das halte ich für schlimm und das fördert natürlich die rechte Seite dieses Hauses, die in solchen Fragen dann jubelt: „Danke EU!“ Soweit sind wir gekommen! Ich kann nur sagen, wir dürfen auf keinen Fall dieser Verordnung zustimmen, sie muss abgelehnt werden!

  Carlos Coelho (PPE). - Senhor Presidente, Senhor Comissário, caras e caros Colegas, duas observações. A primeira sobre o mecanismo de reciprocidade. Concordo que a completa reciprocidade em matéria de vistos deve constituir o nosso objetivo. Quando um Estado-Membro notifica que um país terceiro decidiu instaurar a obrigação de visto para os seus nacionais, todos os Estados-Membros devem ter uma reação coletiva, dando uma resposta comum a uma situação que afeta toda a União. Nós não podemos permitir que os cidadãos da União tenham um tratamento diferente.

Esta é a abordagem do colega Díaz de Mera e estou completamente de acordo com ele.

Em segundo lugar, a questão da reintrodução dos vistos, ou seja, a suspensão temporária da isenção da obrigação de visto. Queria sublinhar que a ativação desse mecanismo deve ocorrer apenas em casos muito concretos de urgência onde se tenha detetado um aumento substancial e repentino do número de imigrantes irregulares ou de pedidos infundados de proteção internacional.

Concordo com a abordagem que Andrey Kovatchev fez na Comissão dos Assuntos Externos, sublinhando que este mecanismo não pode ser automático. E concordo quando ele sublinha que a isenção de vistos é apenas um aspeto das relações mais amplas entre a União e um país terceiro ou região e que, por essa razão, a reintrodução da obrigação de visto não pode ser dissociada desse processo mais vasto e não deve pôr em causa a coerência das políticas externas da União Europeia.

Partilho com muitos colegas a ideia de que o Parlamento Europeu devia ter mais do que os direitos de informação que tem, mas sou muito sensível ao argumento do colega Díaz de Mera, que respeito desde há muito. Se não é possível um compromisso mais vasto, é melhor darmos este primeiro passo do que ficarmos sem nada. É melhor que o Parlamento participe com o direito de informação do que continuemos com o regime que está em vigor neste momento.

  Josef Weidenholzer (S&D). - Frau Präsidentin! Eine der wichtigsten Errungenschaften des Vertrags von Lissabon ist die Schaffung eines Raums der Freiheit, der Sicherheit und des Rechts, der gleichwertig mit den Zielen der Vollendung der Wirtschafts- und Währungsunion und des Binnenmarkts ist. Es war daher nur folgerichtig, diesen Bereich dem Mitentscheidungsverfahren zu unterwerfen. Diese grundsätzliche Überlegung gilt es im Auge zu behalten, wenn wir heute über die Abänderung der Ratsverordnung Nr. 539/2001 diskutieren. Die Erleichterung des Zugangs zu Visa ist daher vor diesem Hintergrund auch nicht mehr ausschließlich von nationalem Interesse. Ein gemeinsamer Raum der Freiheit, der Sicherheit und des Rechts erfordert eine gemeinschaftliche Strategie und damit das Zusammenwirken von Rat, Parlament und Kommission.

Gerade im Sicherheitsbereich werden oft aus innenpolitischen Gründen Ängste geschürt – Herr Kollege Obermayr, auch ich habe mir diese Zahlen genau angesehen, und ich kann eigentlich keine Evidenz für Ihre Feststellungen finden. Daher ist eine Stärkung der europäischen Perspektive und der europäischen Diskussion notwendig für eine rationale Handhabung der Probleme. Es müsste also daher im Interesse aller sein, diesen europäischen Aspekt zu stärken, vor allem müsste es im Interesse des Europäischen Parlaments sein.

Der Berichterstatter, den ich für seine sachliche Arbeit sehr schätze und der auch im Rahmen dieses Berichts sehr viel Positives geleistet hat, hat hier leider am Ende eine gegenteilige Position eingenommen und hat diese europäische Perspektive nicht so stark wahrgenommen, wie er das hätte tun sollen. Deswegen ist sein Bericht auch abzulehnen, weil wir alle darauf hoffen, dass wir in einer zweiten Lesung die Rechte des Europäischen Parlaments wieder in diese Debatte mit einbringen können!

  Jan Mulder (ALDE). - De fractie, en ikzelf ook, stelt zich op het standpunt dat vrijheid van beweging een groot goed is in de wereld en de Europese Unie zal zich dan ook moeten openstellen voor allerlei andere landen die dat ook willen.

Er kan echter ook wat fout gaan. En er gaat zo nu en dan wat fout. Daarom is het goed dat in de wetgeving die nu wordt voorgesteld er een zogenaamde suspension clause is opgenomen, die inhoudt dat als het fout gaat, wij maatregelen kunnen treffen om misbruiken te voorkomen. Dat is voor de liberale fractie een zeer belangrijk goed. Wij vinden het ook belangrijk dat als een bepaald land bepaalde regelingen opzegt ten opzichte van burgers van de Europese Unie, wij daarop kunnen reageren door ook hetzelfde te doen tegenover dat andere land.

Wat betreft de gedelegeerde handelingen, ook een belangrijk punt: de fractie legt de wetgeving in die zin uit dat de mogelijkheid tot gedelegeerde handelingen blijft bestaan en dat vinden wij ook zeer belangrijk. Kortom, wij kunnen het huidige voorstel van de rapporteur ondersteunen. Wij danken hem voor zijn werk en wij hopen dat het voorstel op een meerderheid in deze plenaire vergadering kan rekenen.

  Hubert Pirker (PPE). - Frau Präsidentin! Als das Europäische Parlament 2010 diese Visumbefreiung für südosteuropäische Staaten unterstützt hat, da hat das Europäische Parlament das sehr überlegt und sehr sinnvoll beschlossen.

Wenn wir aber jetzt feststellen, dass die Asylanträge aus dieser Region plötzlich in dem Maße zunehmen, wie sie es tun, dass etwa 16 % der Asylanträge bereits aus Südosteuropa stammen – insbesondere sind Deutschland, Schweden und die Schweiz davon betroffen –, dann müssen wir hier reagieren.

Daher unterstütze ich es sehr, dass eben jetzt Maßnahmen gegen eine Lähmung des Asylsystems durch eine Fülle von Anträgen, die offensichtlich unbegründet sind, ergriffen werden. Die wichtigste Maßnahme – und ich erachte sie als klug und notwendig – zur Bekämpfung des Asylmissbrauchs ist die Beschlussfassung für eine Schutzklausel, wenn es einen erheblichen und einen plötzlichen Anstieg von illegal Aufhältigen oder von Asylbewerbern, die offensichtlich unbegründet einen Asylantrag stellen, oder von Fällen gibt, in denen Rückführungsabkommen nicht durchgeführt werden.

Das ist ein sehr guter Vorschlag, und er wird helfen, dass es eben nicht zu einer Lähmung des Asylsystems kommt, sondern zur beschleunigten Abwicklungen von Asylverfahren. Das ist das Ziel, das dahinter steckt. Und zweitens ich begrüße es, dass der Reziprozitätsmechanismus eingeführt wird. Das führt sicher auch zu mehr Solidarität unter den Mitgliedstaaten.

  Ioan Enciu (S&D). - Madam President, I understand the concerns which have been expressed by our colleagues on the question of the use of implementing acts, versus delegated acts, in the supensionary mechanism which has been agreed. I respect my colleagues’ opinions on this matter.

However, I must recall that the agreement which has been reached with the Council has the potential to put an end to an unacceptable situation of inequality, which concerns millions of our fellow EU citizens, in the EU visa policy with the USA and Canada. The reciprocity mechanism would provide an EU answer as an act of solidarity towards the citizens of Romania, Bulgaria, Poland, the Czech Republic, Cyprus and Croatia, who are discriminated against in visa policy. Although the text which was agreed on remains imperfect, in the name of the principle of solidarity, I ask you to support it.

  Mariya Gabriel (PPE). - Madame la Présidente, je voudrais tout d'abord moi aussi remercier et surtout féliciter notre collègue Agustin Díaz de Mera García Consuegra pour son excellent travail, mais aussi pour son engagement depuis le tout début de ce long processus.

En effet, ce règlement alimente les débats depuis un long moment déjà mais c'est grâce à son rapport que nous avons – je crois – réussi à nous concentrer sur l'essence même de nos principes en tant qu'Union européenne, espace de liberté et de justice. Le Parlement européen doit aussi avoir son mot à dire à cet égard.

Nous avons maintenant une définition qui contribue à nous donner une base solide dorénavant, car – n'hésitons pas à le dire – au-delà des modalités techniques, nous envoyons un message d'importance politique quant à nos relations avec les pays tiers. Et c'est à cela que les critères neutres et objectifs viennent s'ajouter. C'est grâce à ces clarifications que tout mauvais usage pourrait être prévenu.

Sur le plan technique, tout déclenchement du mécanisme de suspension doit se faire dans le respect des critères que nous avons définis, mais surtout par une analyse au cas par cas. C'est le seul moyen de répondre adéquatement à un accroissement migratoire, mais surtout au danger d'une instrumentalisation excessive.

Enfin, le mécanisme de réciprocité devrait être renforcé pour correspondre à notre objectif, à savoir le principe d'efficacité. Parce que l'unité dans l'action et les solidarités entre les États membres doivent rester les deux fils rouges que nous ne devons pas perdre de vue. Le débat aujourd'hui le prouve: nous avons besoin d'une politique commune de visas dont les instruments soient clairement définis. C'est ainsi que nous pourrons atteindre nos objectifs.

Je remercie encore une fois le rapporteur de nous avoir permis de faire d'importants pas en avant sur ce sujet.

  Jacek Protasiewicz (PPE). - Pani Przewodnicząca! Debata, którą właśnie kończymy dowodzi, jak trudny jest kompromis wypracowany przez naszego sprawozdawcę, pana Díaza de Mera. Jednak chciałbym panu posłowi sprawozdawcy tego kompromisu pogratulować, chociaż jak każdy kompromis, także i ten nie jest w pełni satysfakcjonujący dla wszystkich stron. Uważam jednak, że jest on wart poparcia. Dlaczego? Dlatego, że nie ulega wątpliwości – była o tym mowa już w naszej debacie – że dla wielu, dla bardzo wielu obywateli Unii Europejskiej jednym z największych osiągnięć integracji jest swoboda przepływu osób. To unikatowe porozumienie, jakie stworzyło strefę Schengen, jest wartością, którą powinniśmy wzmacniać, ale jednocześnie chronić. Chronić skutecznie przed nadużyciami, tak żeby nasi obywatele nie stracili wiary w sens jego istnienia.

Jak chronić skutecznie? Przede wszystkim, jeśli mamy do czynienia z nadużywaniem, zwłaszcza przez obywateli krajów trzecich, możliwości wjazdu na teren Unii bez wizy i następnie nieuzasadnionego korzystania z możliwości starania się o azyl, to jest oczywiste, że możliwość reakcji powinna być zapewniona. Nie w interesie biurokratów i urzędników unijnych, ale w interesie obywateli Unii Europejskiej.

Mam świadomość, że tym rozporządzeniem, tymi zmianami, kładziemy wielką odpowiedzialność na Komisję Europejską, ale też wierzę, że Komisja Europejska jest w stanie temu zadaniu, tej odpowiedzialności, sprostać. Dowiodła już tego nie raz, że w takich sprawach zachowuje się bardzo odpowiedzialnie. Jednocześnie wierzę, że skoro wprowadzimy mechanizm czasowego zawieszania wiz dla obywateli państw, którzy nadużywają możliwości swobodnego wjazdu, bezwizowego ruchu z Unią Europejską, tym bardziej powinniśmy być otwarci na zawieranie takich porozumień bezwizowych z krajami Partnerstwa Wschodniego. To są narody, które czekają na taki gest polityczny, i dzięki mechanizmowi, który być może przyjmiemy, powinniśmy być bardziej szczodrzy w oferowaniu im możliwości bezwizowego wjazdu na teren Unii Europejskiej, bo to jest nasza odpowiedzialność i nasze zadanie, zwłaszcza wobec presji, jaką wywiera na te narody ich wschodni sąsiad.

  Tonino Picula (S&D). - gospodine povjereniče Mimica, cijenjene kolegice i kolege, dok se reciprocitet odnosno ponovno uvođenje viznog režima za one zemlje koje ga uvedu građanima EU može razumjeti i prihvatiti, upozoravam na posljedice moguće tvrde primjene takozvane zaštitne klauzule u slučajevima izvanredne situacije. Suspenzija bezviznog režima trećim zemljama koja bi se dogodila kao posljedica dnevno političkih procjena neke zemlje članice mogla bi dodatno ugroziti politički i gospodarski ambijent potreban za provedbu strukturnih reformi, pogotovo u zemljama kandidatkinjama za članstvo u EU. Nasuprot tome, podupirem stajališta koja dokazuju kako bi bilo dobro rješenje skraćivati postupak u kojemu se razmatraju zahtjevi za azil. Trebalo bi slijediti primjere država poput Belgije, koje su nedavno uvele promjene u proceduri za rješavanje azilantskog statusa i tako izbjegle uvođenje neselektivnih sankcija građanima bilo koje zemlje a osobito, ponavljam, građanima zemalja kanditatkinja za članstvo u EU. U evropskoj godini građana bilo bi dobro poslati poruku ohrabrenja svim građanima Evrope, poruku da granice EU neće postati nesavladive barijere iscrtane neprincipijelnim interesima. Hvala.

  Ulrike Lunacek (Verts/ALE). - Frau Präsidentin, sehr geehrte Kolleginnen und Kollegen! Meine Kollegin von den Grünen bzw. der EFA, Tatjana Ždanoka, hat ja schon gesagt, dass wir Grüne diesem Antrag nicht zustimmen werden, denn wir unterstützen dieses Aussetzungsrecht nicht, und wir finden, es braucht hier tatsächlich die parlamentarische Einbeziehung in der vollen Form, die der Vertrag von Lissabon gewährleistet.

Als Berichterstatterin für den Kosovo möchte ich auch darauf hinweisen, dass die Kosovaren und Kosovarinnen die Einzigen auf dem Balkan sind, die überhaupt noch nicht frei reisen dürfen. Gerade die Reisefreiheit ist eine der Errungenschaften des Erweiterungsprozesses.

Aber eine Anmerkung muss ich auch zum Kollegen Obermayr, dem österreichischen Kollegen der Freiheitlichen, der hier gesprochen hat, machen: Sie haben gemeint, da kommen Hunderte Busse und fahren dann leer zurück. Naja, logisch! Wenn Busse kommen, dann bringen sie Leute. Und Reisefreiheit heißt ja, dass die Leute auch in Österreich und anderswo bleiben dürfen und sich das dort anschauen können, Verwandte besuchen etc. Na klar fahren die nicht gleich wieder mit den Leuten zurück! Ihre Argumentation ist hier alles andere als stichhaltig.

  Ruža Tomašić (ECR). - Hvala lijepa. S obzirom na društvene izazove s kojima se Europa suočava zbog nekontroliraong priljeva doseljenika iz trećih zemalja, te sve slabije integracije novih imigracijskih valova u europsko društvo, pozdravljam uvođenje neke vrste sigurnosnog mehanizma u migracijsku politiku Unije. No, iako se mogu složiti s duhom ovakvih mjera, smatram da je najsretnije rješenje da svaka država članica sama provodi svoj vizni režim jer njega određuje ne samo priznavanje prava određenim potlačenim skupinama iz trećih zemalja na život u slobodi i demokraciji već i ekonosmak razvijenost zemalja članica koja nije na jednakoj razini. Ovim putem molim Komisiju da razmotri posebne povjesne, ekonomske i nacionalne veze koje Republika Hrvatska ima s Bosnom i Hercegovinom te odobri potpisivanje bilateralnog sporazuma o lakšem prelasku granice državljanima BH koji nemaju hrvatsku putovnicu.   Janusz Wojciechowski (ECR). - Pani Przewodnicząca! Swoboda poruszania się po Unii Europejskiej jest rzeczywiście wielką wartością. Korzystają z tej możliwości nie tylko obywatele Unii Europejskiej, ale także obywatele państw trzecich. Nie zawsze jednak jest w tej kwestii wzajemność i obywatele niektórych państw członkowskich, do których obywatele państw trzecich mogą przyjechać, sami wjechać do tych państw bez wizy nie mogą. To jest dyskryminująca sytuacja i dobrze, że w sprawozdaniu widać próbę podjęcia pewnych działań, żeby tę sytuację zmienić, próbę wywarcia prawnych i politycznych nacisków na państwa trzecie, żeby zniosły ten obowiązek wizowy. Widzę, że działania Unii Europejskiej zmierzają w dobrym kierunku, dlatego popieram sprawozdanie i wyrażam uznanie dla posła sprawozdawcy.

  Franz Obermayr (NI). - Frau Präsidentin! Auch wenn es der geschätzte Kollege Weidenholzer und auch Frau Lunacek nicht wahrhaben wollen, zigtausende Drittstaatsangehörige missbrauchten in den letzten Jahren sowohl das Asylsystem der EU als auch das Visumsystem der EU.

Nun soll es eine Schutzklausel ermöglichen, die Visumfreiheit auszusetzen, wenn sich die illegale Zuwanderung verschärft. Und diese Klausel ist notwendig! Das Ermessen muss dabei aber bei den Mitgliedstaaten liegen. Wenn es eine akute Problemlage gibt, kann man nicht warten, bis die Kommission langwierig über diesen Antrag entscheidet. Vielmehr muss sich die Visumpflicht rasch und flexibel an den geänderten Einwanderungsgegebenheiten orientieren und entsprechend angepasst werden. Sind – das wissen wir aus der Vergangenheit aus guten Beispielen oder schlechten Beispielen – Illegale erst einmal im Land, ist eine nachträgliche Ausweisung schwierig bis gar nicht möglich.

  Ulrike Lunacek (Verts/ALE), Frage nach dem Verfahren der „blauen Karte“. – Herr Obermayr! Sie haben jetzt gerade behauptet, Tausende hätten hier in Österreich das Asylrecht missbraucht. Das stimmt nicht! Sie wissen ganz genau, dass die Asylbewerberzahlen in Österreich massiv zurückgegangen sind.

Und wenn Sie von einem europäischen Asylsystem und einem europäischen Migrationssystem sprechen – ich weiß ja nicht, wovon Sie sprechen: Wir haben leider kein gemeinsames Asylsystem in Europa. Jedes Land macht sein eigenes. Wir haben leider keine gemeinsame Migrationspolitik. Und die brauchen wir, und nicht einzelne hier, die argumentieren, hier werde lauter Asylmissbrauch betrieben. Es geht darum, Menschen die Reisefreiheit zu erhalten, und nicht darum, von Ihnen hier Argumente zu bekommen, die in die falsche Richtung gehen!

  Franz Obermayr (NI), Antwort auf eine Frage nach dem Verfahren der „blauen Karte“. – Frau Präsidentin! Es war eigentlich keine Frage, sondern eine Feststellung: Dass die Frau Kollegin Lunacek den Asylmissbrauch in Europa, der auch Österreich betrifft, nicht wahrhaben will, ist ihr Problem. Tatsache ist, dass aufgrund des vorliegenden Berichts klar ist, dass sich verantwortungsvolle Politik auch Sorgen um die Bürger macht, Sorgen um einen Missbrauch, und dass wir Lösungen finden müssen. Dass die Lösung nicht jedem gefällt, ist mir aus der Sicht der Frau Kollegin Lunacek, die ja eine bekannte Position vertritt, durchaus verständlich. Das ist ihr Standpunkt, ich habe einen anderen Standpunkt. So ist es einfach in der Demokratie!

  Neven Mimica, Member of the Commission. − Madam President, honourable Members, despite the problems with the reciprocity mechanisms which I explained in my opening remarks, I prefer now to focus on the positive elements of this compromise and, above all, on the fact that we will now have a suspension mechanism which ensures the credibility of our visa policy and provides it with a tool to fight abuses.

Rest assured that this mechanism is a last resort and that the Commission will ensure that it is only used if and when all the conditions are met. The Parliament will be regularly informed of the different steps related to the implementation of the two mechanisms. I am aware of the importance of ensuring visa-free travel between the Schengen area and our closest partners and neighbours. Arriving at the visa-free regime was often a long and complex process and we will not reverse it carelessly without considering all the consequences.

Let me say a few words on the Western Balkans visa policy. First of all, the suspension mechanism is not an instrument especially designed to cover the Western Balkan countries. It is of a general application for all countries enjoying a visa-free regime with the Schengen area and could be applied to any of them, including any countries that will benefit from a visa waiver in the future. However, the situation in the Western Balkans requires our special attention. This is due to its impact on the EU’s enlargement policy and the EU’s visa liberalisation and asylum policies and practice on the one hand, and on the other hand it is due to still high but decreasing numbers of asylum applications by nationals of the Western Balkan countries in certain EU Member States.

We are working with the Western Balkan countries and affected Member States to monitor the situation closely and find solutions. Once the suspension mechanism is available we cannot exclude that, if the current situation continues, one or more Member States will trigger the mechanism. It must, however, be clear that triggering this mechanism will not automatically lead to suspending the visa waiver. The Commission will have to assess whether the conditions of the mechanisms are met and we have to assess the gravity of the situation. The Parliament will be informed of the situation throughout the procedure.

  Agustín Díaz de Mera García Consuegra, Ponente. − Señora Presidenta, gracias a todos los colegas que han enriquecido con sus intervenciones este debate. La prueba de su importancia la indica el número de participaciones: 18 diputados han hecho uso de la palabra para hacer un pronunciamiento sincero y democrático. A todos ellos les agradezco su participación, tanto a los que han apoyado el informe como a los que han presentado reservas.

Pero hay una palabra para la Comisión y una cuestión de fondo. La palabra para la Comisión es la siguiente: señor Comisario Mimica, la legalidad, ¿quién la interpreta? ¿La interpreta la Comisión, o la interpreta el Consejo, o la interpreta el Parlamento? La Comisión nos ha anunciado una declaración ―ya lo sabíamos, sabíamos que iba a hacer esa declaración―.

No compartimos su juicio jurídico con referencia a la legalidad o ilegalidad de la propuesta legislativa, por la mezcla, si se puede hablar así, en el terreno de la reciprocidad de actos delegados y actos de ejecución. No, no lo compartimos.

Y, por otra parte, querría decirle algo que tiene mucho interés, sobre todo después de escuchar su segunda intervención. ¿No está de acuerdo con el informe en general o está de acuerdo con el informe en la «b» y no en la «a»? Es decir, ¿está de acuerdo con lo que tiene que ver con el mecanismo de suspensión, que usted se ha ocupado de desarrollar mucho mejor que yo, y no está de acuerdo con el mecanismo de reciprocidad solo en la formulación jurídica del mismo? Realmente, señor Comisario, no ha aportado usted elementos esperanzadores en el ámbito de la clarificación jurídica.

De modo que quiero que traslade mi aprecio, mi respeto, a la Comisaria Malmström, porque creo que ella ha seguido con mucho interés este expediente y creo que hay espacios para la concertación y para el acuerdo.

El ponente, señor Comisario, lo que ha hecho es reforzar el papel de la Comisión y reforzar, sobre todo, el papel diplomático de la Comisión. Y, efectivamente, los Balcanes Occidentales no tienen nada que temer. Lo que ha hecho el ponente, en puridad, es conseguir un instrumento, un reglamento de solidaridad y de respuesta ante la falta de solidaridad.

Por eso, quiero acabar esta intervención mencionando seis nombres, seis nombres muy potentes. Cuando he hecho este informe he pensado en ellos; he pensado en los croatas, en los chipriotas, en los checos, en los búlgaros, en los rumanos y en los polacos. Y para ellos pido reciprocidad, y para ellos pido solidaridad.

  Neven Mimica, Member of the Commission. − Madam President, I would just like to explain, in a straightforward way, that the Commission is very much in favour of the reciprocity mechanism as stipulated in the regulation, but what we are not in agreement with is the legal solution – the legal mechanisms on how to enable this reciprocity in real life. The same goes for the suspension mechanism, which has the full support and full endorsement of the Commission in terms of both elements – the political and institutional context, together with the legal context.

I agree that there is room for further discussion and further agreement on this issue. I would like to thank the rapporteur once again for his contribution and efforts throughout these long-standing negotiations and for the compromise that was reached.

  Agustín Díaz de Mera García Consuegra, Ponente. − Señor Comisario, señor Mimica, le agradezco estas aclaraciones, que me parecen oportunas, y, sobre todo, le agradezco el esfuerzo que usted ha hecho para situarse en defensa de la posición de la Comisión, porque usted está en franca desventaja. Yo conozco muy bien el informe, y los colegas conocen muy bien el informe, y usted ha tenido que hacer un esfuerzo para sustituir a la señora Malmström. Lo valoro, sinceramente, lo valoro.

Pero creo que usted, con independencia de su independencia, que está reconocida como Comisario, va a tener dificultades para explicar en su país de origen este punto de vista. Va a tener, sinceramente, dificultades políticas, y no se las deseo.

Así es que deseo que aproximemos lo que nos separa y lo que nos separa es, sencillamente, la interpretación jurídica que aplica el ponente en el mecanismo de reciprocidad y en el mecanismo de suspensión.

  Kinga Gál (PPE), írásban. – A mai vitával egy igen régen húzódó fontos dosszié lezárásához közeledünk. Gratulálni szeretnék a jelentéstevő kitartó munkájához, amely a rendelet ismételt módosítására irányult.

Örülök annak, hogy a vízumfelfüggesztési klauzulára vonatkozó szabályok olyan formában kerültek megfogalmazásra, amely nagyobb biztonságot ad a tagállamoknak vészhelyzetek esetére, ugyanakkor biztosítja azt is, hogy annak harmadik országokkal szembeni alkalmazása szigorú szabályokhoz és feltételekhez kötött. Ezen eszközt valóban vészhelyzetek esetére kell megőrizni, annak csak rövid távra történő bevezetése is indokolt.

A reciprocitási mechanizmus módosítása, illetve annak hatékonyabbá tétele ugyancsak a tagországok érdekeit szolgálja. Magyar képviselőként mindig is szorgalmaztam, hogy az Unió külső határai átjárhatók legyenek a jóhiszemű beutazók számára, és ne gördítsünk indokolatlanul nagy akadályokat a beutazók számára, akadályozva ezzel a határok két oldalán élő emberek közötti kapcsolattartást. Ugyanakkor fontos tagországaink biztonságának megőrzése is.

  Graham Watson (ALDE). - Mr President, we have just debated the issue of third-country nationals crossing EU borders. I have 30 000 constituents whose right to free movement in the Union is being systematically and unjustifiably denied. And, since today is Gibraltar’s national day, I hope that you and the House will join with me in sending a message of solidarity to the people of Gibraltar – a message of dismay at the border controls being imposed and of outrage at the intemperate comments of Mr García-Margallo.
