3. Rozhodnutí o použití naléhavého postupu

El siguiente punto en el orden del día es la decisión sobre tres urgencias:

propuesta de Directiva del Parlamento Europeo y del Consejo por la que se modifican determinadas directivas en los ámbitos del medio ambiente, la agricultura, la política social y la salud pública debido al cambio de estatuto de Mayotte respecto de la Unión (COM(2013)0418 - C7-0176/2013 - 2013/0192(COD))

  Carl Schlyter, on behalf of the Committee on the Environment, Public Health and Food Safety. − Mr President, the procedure started when Mayotte had a referendum and then decided to change status. Then the Commission made the proposal to adapt certain rules to the new status. It chose the correct legal basis based on the different directives’ original legal bases. We have three in environment, one in agriculture and also the coming fishery ones. Adaptations were required in all those cases, mostly to give Mayotte more time. However, the Council approved the correct legal basis and chose a special route in the Treaty in 355. That means that it is a Council decision, taking away the prerogative of Parliament to have the ordinary legislative procedure, thereby undermining what is given to us in the Treaty and the power that is conferred to us in the Treaty.

Therefore, we would like to protest against changing the legal basis. We sought advice from the Committee on Legal Affairs and they came to exactly the same conclusion as our Legal Service, namely that the correct legal basis is what the Commission proposed – that it should be a normal legislative procedure. We need to take a quick decision. If we want to follow the normal procedure, I would urge the Council to withdraw its legal basis and to accept the Commission’s legal basis. Then we, as a Parliament, could take our responsibility and quickly vote through these measures, because they will need to take effect on 1 January 2014.

However, we cannot accept them changing the legal basis and taking the power so that we are only consulted. In that case, we would have to take them to the Court. So our recommendation would be to take the Council to the Court if they do not change the legal basis. We should, therefore, vote ‘minus’ on all three if you agree with what the Committee on the Environment, Public Health and Food Safety wants to do. To the Council, which is not even present here today, I would like to say ‘nice try, but no thanks’.

Propuesta de Reglamento del Parlamento Europeo y del Consejo por el que se modifican determinados reglamentos en el ámbito de la pesca y la salud animal debido al cambio de estatuto de Mayotte respecto de la Unión (COM(2013)0417 - C7-0175/2013 - 2013/0191(COD))

  Ferreira, João (GUE/NGL), en nome da Comissão das Pescas. – Senhor Presidente gostaria, em nome da Comissão das Pescas, de recomendar ao Parlamento a rejeição do pedido de aplicação do processo de urgência submetido pelo Conselho relativamente a este dossiê.

O prazo fixado pelo Conselho não permite à nossa comissão dar a devida atenção a esta proposta. Apesar disso, queria aqui dizer que tomamos boa nota das preocupações apresentadas pelo Conselho e queria sublinhar que a Comissão das Pescas tem por objetivo ultimar a sua posição o mais brevemente possível, de forma a permitir uma decisão do Parlamento também o mais breve possível, tendo em conta que a mudança de estatuto de Maiote produzirá efeitos a partir do dia 1 de janeiro de 2014.

Dito isto, não posso deixar de aqui clarificar também que não acompanhamos a proposta do Conselho relativamente à base jurídica desta proposta. A Comissão das Pescas irá ainda decidir qual a base jurídica mais apropriada e essa decisão será transmitida ao Conselho em devido tempo. Mas, não sendo de descartar a devida consideração do artigo do Tratado relativo às regiões ultraperiféricas, atendendo às propostas em apreço, que cobrem aspetos centrais da legislação da UE no domínio das pescas, parece-nos que a codecisão é a base mais adequada podendo, no entanto, ser considerada a eventualidade de uma dupla base jurídica. Portanto, recomendávamos também a rejeição deste pedido do Conselho.

Propuesta de Directiva del Consejo por la que se modifica la Directiva 2010/18/UE del Consejo debido al cambio de estatuto de Mayotte (14220/2013 - C7-0355/2013 - 2013/0189(NLE))

  Elisabeth Schroedter, in namen des Ausschusses für Beschäftigung und soziale Angelegenheiten. − Herr Präsident, liebe Kolleginnen und Kollegen! Im Namen des Beschäftigungsausschusses möchte ich dem Parlament empfehlen, diese Dringlichkeit zurückzuweisen. Auch der Beschäftigungsausschuss ist der Meinung, er müsste in einem normalen Zeitrahmen und in Ruhe darüber befinden, ob es diese Ausnahme gibt. Bis zum November haben wir diese Zeit nicht, weil es nur ganz wenige Wochen sind und auch unsere Fristen nicht eingehalten werden.

Der Beschäftigungsausschuss will dazu nicht sagen, wie er am Ende zu einer Schlussfolgerung kommt, aber er macht deutlich, wie es auch die anderen Ausschüsse gemacht haben, dass wir doch sehr große Fragen in Bezug auf die Rechtsgrundlage haben und dass wir zuerst die Stellungnahme des Juristischen Ausschusses kennen müssen, ehe wir darüber abstimmen. Deswegen empfehle auch ich Ihnen im Namen des Beschäftigungsausschusses, diese Dringlichkeit abzulehnen.
