  Alain Lamassoure, rapporteur. − Monsieur le Président, Monsieur le Commissaire, chers collègues, le traité de Lisbonne s'applique depuis quatre ans. Il a donné au Conseil européen le statut d'institution communautaire sans changer son rôle. Le Conseil européen donne à l'Union les impulsions nécessaires, il en définit les orientations et les priorités politiques générales. Il n'exerce pas de fonctions législatives.

Ça, c'est la théorie. Dans la pratique, sous la pression de la crise, le Conseil européen a considérablement étendu son rôle. Il a multiplié les réunions extraordinaires – cette vingtaine de sommets dits de la dernière chance –, il a évoqué, à son niveau, des sujets traités normalement au niveau des ministres et, ce faisant, il a transgressé son rôle pour empiéter sur les fonctions législatives. Il en est résulté confusion, absence de transparence et affaiblissement du contrôle parlementaire.

Par exemple, sur la gouvernance économique, le Conseil européen a cru bon, une nuit, de renégocier des dispositions identiques à celles qu'un règlement antérieur avait déjà rendues applicables. Au moment de l'adoption du cadre financier pluriannuel, on a assisté à un véritable hold-up législatif, puisque, pour obtenir l'unanimité nécessaire en son sein, le Conseil a prédécidé le contenu de beaucoup de politiques financées par le budget européen. Sur tous ces dossiers, qui sont, par définition, les plus importants, l'absence de dialogue formalisé entre notre Parlement et le Conseil nous a empêchés de jouer pleinement notre rôle de colégislateur établi par les traités.

Le président Van Rompuy – et je tiens à lui rendre hommage – a été sensible à ces inconvénients. Il a cherché à prendre en compte du mieux possible les exigences d'information et de transparence et il nous est apparu que le moment était venu, en cette fin de législature, de prendre acte de ces progrès qui ont été accomplis dans la relation entre nos deux institutions et d'aller plus loin pour préparer l'avenir. À la lumière de ces quatre ans d'expérience, il s'agit de procéder à l'amélioration et à la formalisation des relations de travail entre le Conseil européen, d'un côté, et le Parlement européen, de l'autre. Cela peut prendre la forme d'un échange de lettres, de déclarations communes ou d'accords interinstitutionnels, peu importe.

Nous faisons cinq propositions majeures. D'abord, nous proposons que toute réunion du Conseil européen soit précédée d'un débat dans ce Parlement, dans cet hémicycle, permettant avant la réunion l'adoption d'une résolution, avec présentation par le président du Conseil européen, lui-même, des orientations qu'il propose.

Deuxième proposition, faire en sorte que, dans le calendrier, les réunions du Conseil européen aient lieu après les semaines de session du Parlement et non pas avant ou pendant celles-ci.

Troisièmement, nous proposons que, chaque année, un grand débat sur l'état de l'Union européenne soit organisé en présence du président du Conseil européen, du haut représentant pour les affaires étrangères et la politique de sécurité et du président de la Commission, ceci naturellement sans préjudice du débat qui a lieu chaque année actuellement sur le programme législatif de la Commission.

Quatrièmement, nous demandons que, chaque fois que le Conseil européen engage un plan d'action ou une procédure susceptible de comporter une dimension législative, le Parlement européen soit associé en temps utile et puisse coopérer à la préparation de ces textes selon la forme appropriée à chacun.

Enfin, dernier point qui est très important, le traité de Lisbonne introduit une innovation majeure pour la démocratisation de l'Union. Désormais, le président de la Commission ne sera plus nommé comme un haut fonctionnaire international, il sera issu du suffrage universel, à travers l'élection du Parlement européen. Mais ce progrès essentiel exige que le Conseil européen joue le jeu, qu'il applique l'esprit du traité plutôt que la lettre et qu'il fasse connaître de façon claire, avant le début de la prochaine campagne des élections européennes, comment il entend appliquer le traité en la matière. C'est à cette condition qu'enfin les citoyens prendront le pouvoir en Europe.

  Maroš Šefčovič, Vice-President of the Commission. − Mr President, honourable Members, I also would like to welcome the report of Mr Lamassoure on the relations between the European Parliament and the institutions representing the national governments, and in particular the European Council.

Close cooperation between all the institutions of the European Union in the pursuit of the Treaty objective is vital. The Commission looks positively upon the initiatives to further improve on these working relations within the framework of the Treaties. That includes of course any initiatives to strengthen democratic legitimacy and accountability. In particular, the Commission welcomes the plenary debates in Parliament prior to European Council meetings. The organisation and structure of these and other debates is the prerogative of the Parliament.

Since the report touches upon the annual state of the Union address by the President of the Commission, I would like to emphasise that this address reflects the role and prerogatives of the President of the Commission and his unique relationship with the European Parliament. In the future you will be electing the Commission President. I therefore find it natural that he or she once a year addresses this House with a wide-ranging analysis of the State of the Union – far beyond the annual legislative programme. I think that we have come to appreciate this as one of the high points of the year in terms of our special relationship.

  György Schöpflin, on behalf of the PPE Group. – Mr President, Alain Lamassoure has produced an extremely cogent and illuminating report. We know that the Lisbon Treaty has been in effect long enough for us to have valid insights into its workings, and this is what the report has done, notably focusing on one particular area in which the Lisbon Treaty has left certain points open to interpretation, namely the relationship between the European Council and the European Parliament.

The central proposal of the report is to regulate this relationship in the expectation that the European Council will not involve itself in negotiations that are properly handled under the codecision procedure. To this effect, meetings of the European Council should be preceded by a debate in Parliament with the President of the European Council making a presentation in person. Then, what the European Council actually states should be – it is clear – negotiating instructions for the Council of Ministers rather than non-negotiable instructions.

Possibly the most urgent point in the report concerns the election of the President of the Commission. Respect for the choice of the citizens of Europe, as articulated in the elections to the European Parliament, is a necessary condition for the legitimacy of the European Union as a whole. It is vital that the European Council respect this provision. Broadly speaking, the underlying thinking behind the report is to strengthen the Community method and to dilute the growing trend towards intergovernmentalism in the governance of the European Union. In this connection, the role of Parliament as a primary body with direct legitimacy is an essential counterweight to intergovernmentalism.

  Zita Gurmai, on behalf of the S&D Group. – Mr President, I would like to thank Alain Lamassoure for his excellent report. It is always a pleasure to work with him.

We have indeed to take stock of the changes that have taken place in practice in recent years, since the adoption of the Lisbon Treaty. In the light of the crisis in the mechanism aimed at strengthening financial stability and economic governance, and of the legislative work carried on since the beginning of this term, we have witnessed important changes. In particular, the role of the European Council and of its President has drastically evolved, sometimes beyond what was foreseen in the Treaties.

Therefore, it is important for this Parliament to assess the evolution of the role of the European Council and the changing nature of its relationship with the European Parliament. Working relations between the Council and the European Parliament should therefore be formalised and enhanced. The evolution of the institutional practices we have witnessed with the crisis calls for much more transparency and democratic accountability. This requires more exchanges with the Council, and especially with its President, given the importance his role has taken on. It also requires more open debate and better coordination on both sides, which means getting information sufficiently in advance, which has not always been the case in recent years. Taking into consideration the negotiations on the MFF, I also believe that the proposal included in the report, to extend the tripartite meetings between the Presidents of the institutions beyond budgetary matters, is worth exploring.

Finally, let me underline how important it is for the European Council to clarify how it intends to respect the outcome of the next European elections in appointing the President of the European Commission. Hopefully, they will be here next time.

  Andrew Duff, on behalf of the ALDE Group. – Mr President, the greatest test of relations between the Parliament and the European Council is of course still to come, in July of 2014 and with the appointment of the next Commission.

The President of the European Council, Mr Van Rompuy, will act as the informateur in finding the successor to Mr Barroso and I think he is going to have to display exceptional sensitivity to parliamentary opinion. I believe, as a matter of routine, he ought to answer parliamentary written questions. At present he declines to do so and, with the greatest respect to the rapporteur, I do not think that Mr Van Rompuy deserves a state of the Union address of his own because I think that would tread further upon the prerogatives of the President of the Commission.

I must say that I would have preferred a slightly wider scope to this report, to include criticism of the rotating presidency of the Council of Ministers, because I believe that a reformed European Council could bring much greater coherence and drive to the work of our respected second legislative chamber than it actually has at present.

  Gerald Häfner, im Namen der Verts/ALE-Fraktion. – Herr Präsident, liebe Kolleginnen und Kollegen! Der Lissabon-Vertrag hat eine Reihe von institutionellen Veränderungen gebracht.

Wir haben nun eine Legislaturperiode unter und mit diesen Veränderungen gearbeitet und stellen fest, einige haben sich bewährt, einige nicht, und wollen aus diesen Veränderungen Konsequenzen ziehen.

Eines der – jedenfalls in dieser Form – formell neu geschaffenen Organe ist der Europäische Rat, mit dem ein merkwürdiges Organ geschaffen wurde, nämlich ein Organ, dessen Mitglieder zwar ihren jeweiligen nationalen Parlamenten gegenüber rechenschaftspflichtig sind, das aber als Organ schlichtweg niemandem gegenüber – oder nur sich selbst gegenüber – rechenschaftspflichtig ist. Das zeigt schon die Problematik, das zeigt ein bisschen auch das dünne Eis, auf dem wir uns gegenwärtig hier in Europa bewegen. Ich meine, dass das im Kontext einer demokratischen Entwicklung nicht gesund ist.

Der Europäische Rat hat seine Rolle auch unter dem Druck der Krise noch deutlich ausgeweitet und sich zunehmend in den Bereich der Gesetzgebung eingemischt, in dem er über keine formelle Kompetenz verfügt.

In dem Bericht, den wir heute abstimmen und für den ich Alain Lamassoure herzlich danken möchte, wird eine Reihe von Vorschlägen zur Abhilfe gemacht: Veränderungen im Kalender, Verbesserung der formalisierten Beziehungen zwischen Parlament und Rat, Einführung einer regelmäßigen Debatte hier im Parlament mit dem Rat, mit dem Europäischen Rat und über den Rat, Berichte vor und nach den Tagungen des Europäischen Rates.

Ich will ausdrücklich sagen: Ich unterstütze diese Maßnahmen – auch namens meiner Fraktion – und meine dennoch, dass dies nicht ausreichen wird. Ich glaube, dass wir der wachsenden Tendenz zur Regouvernementalisierung, zum technokratischen Absolutismus, zur Top-down-Politik in Europa anstelle einer Bottom-up-Politik nicht durch Briefwechsel und interinstitutionelle agreements entgegenwirken können, sondern langfristig nur dadurch, dass wir neue Vertragsgrundlagen formulieren, die sowohl die erste als auch die zweite Kammer auf die Grundlage einer demokratischen Wahl stellen und damit für mehr Demokratie und Gewaltenteilung in der Europäischen Union sorgen.

  Oldřich Vlasák, za skupinu ECR. – Pane předsedající, pane komisaři, dovolte mi jménem Evropské skupiny konzervativců a reformistů připomenout, že Evropská unie je v první řadě mezinárodní organizací, která vznikla z vůle členských států. A právě suverénní členské státy Evropské unie stanovily práva a povinnosti, zřídily příslušné orgány včetně Evropské rady a vymezily cíle jejich činnosti.

S pozdviženým obočím proto vnímám snahu některých kolegů omezovat, kontrolovat či jinak regulovat to, co členské státy dělají a jakým způsobem založenou mezinárodní organizaci řídí. Údiv spatřuji také nad použitým výrazem „legislativní loupež“, který podle mého názoru nepatří do usnesení Evropského parlamentu.

Dámy a pánové, souhlasím s tím, že je potřeba vést intenzivnější dialog mezi orgány Evropské unie, mezi Evropským parlamentem, Evropskou komisí a Evropskou radou, ale také s představiteli členských států, stejně jako je potřeba vést dialog se zástupci národních parlamentů, regionálními či obecními zastupiteli.

Tento dialog musí být partnerský, nezatížený snahou uplatňovat moc či kontrolu. Souhlasím proto s tezí obsaženou ve zprávě, že by bylo nevhodné interpelovat členy Evropské rady či jiné politiky národních států. Nesouhlasím však s tím, abychom zasahovali do kompetencí členských států. Podle mého názoru musí být kupříkladu zcela věcí členských států, jaké osobnosti navrhnou za členy budoucí Evropské komise. My, poslanci Evropského parlamentu, máme potom právo Komisi buď schválit, nebo neschválit.

  Bruno Gollnisch (NI), question "carton bleu". – Monsieur le Président, j'adhère tout à fait à la position de principe qui a été dégagée par notre collègue Vlasák, mais je souhaiterais lui faire observer que le rapport de M. Lamassoure pose quand même un vrai problème.

Qu'en est-il lorsque les représentants des États membres, que sont les ministres siégeant au Conseil, se trouvent désavoués par les représentants des États membres, que sont les chefs d'État ou de gouvernement, qui sont au Conseil européen?

Nous pourrions quand même penser que les chefs d'État ou de gouvernement, d'une part, les ministres, de l'autre, à l'intérieur d'une même organisation gouvernementale travaillent en harmonie.

Or, là, il faut reconnaître que, pour le Parlement, il est un peu difficile de trouver le bon interlocuteur.

  Oldřich Vlasák (ECR), odpověď na otázku položenou zvednutím modré karty. – Rád bych odpověděl a zopakuji víceméně to, co jsem konstatoval. Myslím si, že je věcí národních států, aby jmenovaly svého zástupce jako takového. Zažili jsme v Evropském parlamentu mnoho výhrad k jednotlivým zástupcům, ale nakonec to může vést pouze k odmítnutí Komise jako celku a nemůžeme se vyhrazovat nějakým způsobem osobně k jednotlivým zástupcům.

  Nikola Vuljanić, u ime kluba GUE/NGL. – Gospodine predsjedniče, očito je iz svega da Vijeće vrlo često djeluje kao neka vrsta samostalne vlade ni na nebu ni na zemlji, vlade koja nikome ne odgovara. Nažalost, građani o institucijama Europske unije znaju vrlo malo i ako neka i jest u žarištu interesa, onda je to ovaj Parlament, a brojne se odluke donose očito na sasvim drugim mjestima. Hoću reći da je informiranje javnosti izuzetno važno i u uspostavi efikasnih odnosa između institucija Europske unije.

Potrebno je uvesti institucionalne promjene koje će učvrstiti komunikacije, ali i međusobno poštovanje odluka, da se odluke u jednom tijelu ne ruše, u drugom tijelu bez ikakvog posebnog razloga, bez obrazloženja pa čak i bez obavijesti. Dijalog pismenim podnescima nije konstruktivan, niti ga netko želi, a ni ne treba nam baš previše. Europski parlament jedina je legalno izabrana institucija. Ostali su postavljeni. Mi bismo sada ovdje trebali odgovoriti na pitanje hoćemo li više Europe, demokratske Europe, ili je ovo dosta. Ako je dosta, pa prekinimo ovakve rasprave.

  John Stuart Agnew, on behalf of the EFD Group. – Mr President, unlike the rapporteur, I am not going to start my remarks by congratulating President Van Rompuy. I am, of course, an MEP from the east of England and in a few months I will learn what the voters make of what I have done since 2009.

They are pretty sensible individuals in my part of the world. They understand that successive governments of every kind have handed over the democratic governance of our country to unelected, unaccountable, power-hungry functionaries of the European Union. Now they are to be confronted with a classic power struggle, as the recipients of that power in the EU project battle it out for supremacy.

The tone of this report tells us that the first shots in the struggle between the European Council and the European Parliament are being fired. By far the most interesting comment in the report though is that which castigates the Council of Ministers for a lack of desirable standards of pace, strategy, consistency, coherence or transparency. Well, we in UKIP have been pointing this out for years and it really is not surprising when you look at the reduction in the standards of living of so many people in Europe. It just is not working.

  Bruno Gollnisch (NI). - Monsieur le Président, ce que révèle sans le dire le rapport de notre très compétent collègue Lamassoure, c'est que le traité de Lisbonne est une véritable usine à gaz. Il en donne dans son rapport, d'ailleurs, des exemples assez pittoresques – je n'ai pas le temps de les citer tous – comme l'accord législatif entre le Parlement européen et le Conseil des ministres sur les brevets européens remis en cause par le Conseil européen. Il y en a bien d'autres.

Nous aurions pu penser, tout de même, comme je le disais à l'instant, que les ministres représentant les États membres soient solidaires de leur chef d'État ou de gouvernement respectif, que le président du Conseil européen, M. Van Rompuy, assure lui-même ce travail de coordination, que le coreper, qui réunit les représentants diplomatiques de chaque État membre, y contribue.

Il est vrai que, lors de la dernière réunion du Conseil des ministres où l'on a octroyé des visas aux ressortissants de l'Azerbaïdjan, la France était représentée par son ministre de la culture. Ce n'est pas forcément une garantie de compétence.

M. Lamassoure propose des remèdes légitimes, comme le fait que les Conseils européens soient précédés d'une déclaration du président du Conseil, suivie d'une résolution. Mais qu'est-ce qui empêchait jusqu'à présent qu'il en soit ainsi?

En réalité, le fond du problème, c'est la présidence permanente du Conseil qui n'a pas fait disparaître la présidence tournante du conseil des ministres. Autant d'occasions, de chevauchements de compétences et de conflits. Il n'y a toujours pas d'abonné au numéro de la maison Europe.

  Angelika Werthmann (ALDE), Frage nach dem Verfahren der „blauen Karte“. –Herr Gollnisch! Den Lissabon-Vertrag gibt es seit vier Jahren, und ich finde den Bericht ausgezeichnet. Er zeigt ganz klar, wo wir alle miteinander noch dazulernen müssen – wir als europäische Institution betrachtet. Wie sehen Sie das? Warum wollen Sie einen Vertrag, und warum wollen Sie der Europäischen Union nicht ganz konkret hier zeigen, dass wir sehr wohl noch viel verbessern können und alle miteinander auf Zusammenarbeit hinarbeiten müssen?

  Bruno Gollnisch (NI), réponse "carton bleu". – Je réponds brièvement. Madame, le problème, que soulève d'ailleurs, entre les lignes, le rapport de M. Lamassoure, c'est qu'il y a trois interlocuteurs, qui ont trois légitimités différentes: le président permanent du Conseil européen, M. Van Rompuy, la présidence tournante tous les six mois assurée par un ministre d'un État membre du Conseil des ministres et le président de la Commission, dont la légitimité démocratique va augmenter. Dans ces conditions, comme le disait encore une fois Henry Kissinger autrefois, je ne sais pas à qui téléphoner quand je veux m'adresser à l'Europe.

C'est une contradiction entre les termes. Du point de vue européiste, qui n'est pas le mien, mais qui est celui de M. Lamassoure, nous avons une Europe tricéphale. C'est un monstre normatif, en quelque sorte.

  Constance Le Grip (PPE). - Monsieur le Président, je souhaite, à mon tour, féliciter notre collègue Alain Lamassoure pour son excellent rapport d'initiative consacré aux relations entre le Parlement européen et les institutions représentant les gouvernements nationaux. Il y a mis vraiment tout le fruit de sa longue expérience acquise ici, au sein de notre Assemblée, à laquelle il appartient depuis de nombreuses années.

En sa qualité de président de la commission des budgets, il a été au cœur des négociations budgétaires. Il a été également membre de l'Assemblée nationale française, membre de deux gouvernements de la République française et il a donc vraiment pu mettre toute son expérience, acquise à bien des postes de responsabilité, dans l'analyse de ce qui se passe actuellement depuis l'entrée en vigueur du traité de Lisbonne, depuis la multiplication des réunions du Conseil européen et, aussi, dans la présentation de propositions de pistes pour l'avenir.

Évidemment, la multiplication des sommets européens, l'implication de plus en plus forte des membres du Conseil européen dans des fonctions législatives, en quelque sorte, qui ne leur étaient pas conférées au départ par le traité de Lisbonne, amènent à nous poser des questions. Le moment est donc venu de réfléchir à comment formaliser les relations entre le Parlement européen et les institutions représentant les gouvernements nationaux et les membres du Conseil.

Je soutiens les pistes qui sont proposées dans le rapport Lamassoure, qui propose que ces nouvelles pratiques, un certain nombre de pistes soient formalisées, soit dans un échange de lettres formel, soit dans une déclaration commune, soit – hypothèse peut-être un peu moins facile à réaliser – dans un accord institutionnel. Il faut bien sûr travailler à renforcer le contrôle parlementaire. Les propositions sont, bien sûr, toutes bonnes à étudier, bonnes à reprendre. Ce sera peut-être à nos successeurs de travailler à cela, de formaliser cela. Bien évidemment, l'idée principale est que les réunions du Conseil européen doivent être précédées d'un débat au Parlement en présence du président du Conseil européen; cela me semble tout à fait essentiel.

Je voudrais terminer par un point très important, sur lequel, vraiment, nous insistons beaucoup, qui est que les membres du Conseil européen s'engagent dans l'esprit et dans la lettre du traité de Lisbonne, et notamment de l'article 17, à dire comment ils vont respecter le choix de nos concitoyens, le choix fait par nos électrices et nos électeurs au moment des prochaines consultations électorales dans la présentation qu'ils feront du prochain président ou de la prochaine présidente de la Commission européenne, et comment ils s'engageront à respecter ce choix également dans le nom qu'ils proposeront pour le commissaire pressenti de leur propre pays. C'est un point très important. Nous insistons vraiment sur cet aspect-là de la disposition du traité de Lisbonne.

  Roberto Gualtieri (S&D). - Signor Presidente, onorevoli colleghi, la relazione dell'onorevole Lamassoure tocca un tema davvero importante e delicato.

Vorrei in particolare sottolineare due punti che mi sembrano assolutamente decisivi e centrali. Il primo è quella vera e propria intrusione del Consiglio europeo nella procedura legislativa ordinaria, di cui abbiamo avuto un'esperienza molto chiara nel quadro dell'approvazione dei regolamenti collegati all'MFF e che ora rischia di riproporsi nel percorso che potrebbe portare a un regolamento sui cosiddetti accordi contrattuali.

È davvero contrario alla lettera e allo spirito dei trattati che il Consiglio europeo con una procedura all'unanimità vincoli il Consiglio e quindi svuoti di fatto la procedura legislativa ordinaria che si basa sul voto, invece, a maggioranza qualificata e sul ruolo paritario di due codecisori. Per questo giudico molto positivamente la proposta di includere una formulazione standard nelle conclusioni del Consiglio europeo.

C'è poi l'altro aspetto di grande rilievo per l'imminente appuntamento elettorale che riguarda l'elezione del Presidente della Commissione. Elezione che è bene innanzitutto ricordare che è un'elezione e non un voto di consenso – così dice in modo inequivocabile il trattato, e che quindi necessariamente, non solo per quel che poi dice lo stesso trattato circa le modalità con cui la proposta del Consiglio europeo deve tenere conto del risultato delle elezioni – non può che scaturire questa elezione da una procedura che il Consiglio europeo si deve impegnare a rispettare e a stabilire, che peraltro la dichiarazione undicesima annessa ai trattati chiede di definire e di precisare – e quindi anche in questo senso la proposta dell'onorevole Lamassoure di chiedere al Consiglio europeo un formale impegno che non è solo sul come intende rispettare, ma anche un impegno a definire di comune accordo una procedura appunto per attuare la dichiarazione undicesima e rendere quindi sostanziale l'articolo 17, paragrafo 7, è una proposta di grande importanza che io condivido.

  Angelika Werthmann (ALDE). - Herr Präsident! Die grassierende Krise hat uns gezeigt, was für Auswirkungen auf unsere Arbeitsweisen entstehen können und entstanden sind, insbesondere auf den Europäischen Rat. Der ist leider ein paar Alleingänge gegangen, Stichwort Bankenaufsicht. Das war für uns alle weniger erfreulich. Es hat aber zudem gezeigt, dass das Europäische Parlament wesentlich stärker berücksichtigt und vor allem eingebunden werden muss. Das möchte ich uns allen hier noch einmal in Erinnerung rufen.

Zur Präsenz der europäischen Regierungschefs möchte ich sagen: Es geht mir in der Tat sehr ab, dass wir diese Diskussionen nicht wirklich führen können, dass sie sich hier nicht zeigen, dass sie sich hier im EP nicht der Diskussion mit uns allen stellen.

Last, but by no means least möchte ich noch ein kurzes Wort zur anstehenden Wahl verlieren. Es ist wirklich ein Zeichen von Demokratie und wirklich aktiver Bürgerbeteiligung, wenn der Kommissionspräsident von unseren Bürgerinnen und Bürgern gewählt wird. In diesem Sinne hoffen wir alle auf eine starke Wahlbeteiligung.

  James Nicholson (ECR). - Mr President, I would also like to congratulate the rapporteur. I agree that there is a need to improve the working relations between Council and Parliament. It is evident that we have not yet found the magic formula to effectively implement codecision between the two peoples in Europe. Lisbon was ground-breaking for Parliament: our legislative authority is now enshrined in the Treaty. However, Parliament is not yet adapted to effectively fulfil its role as a co-legislator.

This report highlights the Council’s legislative deficiencies, but what about our legislative deficiencies here in Parliament? Only in the light of newly instigated trialogues and the resulting trialogue agreements have we begun to see the glaring gaps in our lawmaking capacity in Parliament. The Commission fields more experts than the Council and Parliament put together. We are constantly battling to ensure that we keep on top of the attachment-loads of emails and the reams of updated documents of the most technical nature that come forward. The CAP reform was a typical example of this and we have to ensure that delegated acts certainly fulfil and respect the political agreements that were made.

  Jaroslav Paška (EFD) - Zložitý a dynamický hospodársky vývoj v Európe, ale aj vo svete si vyžiadal intenzívnejšie zapojenie Európskej rady do formovania politických opatrení Európskej únie.

Aj keď článok 15 odsek 1 Zmluvy o Európskej únii definuje Európsku radu len ako inštitúciu, ktorá dáva Únii potrebné podnety na rozvoj a určuje všeobecné smerovanie a priority, jej skutočná angažovanosť pri určovaní zásadných politických aj hospodárskych opatrení sa stala ďaleko výraznejšou.

Preto je potrebné vhodnou formou upraviť aj spôsob komunikácie medzi Európskou radou a Európskym parlamentom tak, aby sa aktivity týchto inštitúcií navzájom dopĺňali a obohacovali a aby sa predchádzalo zbytočným nedorozumeniam či zdržaniam. Optimálnym riešením sa dnes javí uzavretie medziinštitucionálnej dohody, ktorá by precíznejšie definovala a upravila vzťahy a spôsoby spolupráce oboch inštitúcií.

Intenzívny spoločenský a politický vývoj nielen v Únii, ale aj v najbližšom okolí si vyžaduje, aby sme dokázali na tieto rôznorodé impulzy pohotovo, správne a koordinovane reagovať. Dobre sformulované pravidlá spolupráce nám k tomu môžu len napomôcť.

  Andrej Plenković (PPE). - Gospodine predsjedniče, prije svega čestitam predsjedniku Odbora za proračune i članu Odbora za ustavna pitanja s izuzetno velikim iskustvom u ovoj instituciji, općenito europskim poslovima, g. Lamassouru na izvješću koje je vrlo precizno identificiralo bitne, čak, rekao bih, i pravne praznine u odnosu između Europskog vijeća i Europskog parlamenta, a u kontekstu provedbe Ugovora iz Lisabona tijekom mandata ovog saziva Europskog parlamenta.

Mislim da je kriza koja je pogodila Europsku uniju u financijskom i u gospodarskom smislu utjecala na jačanje tendencije međuvladine suradnje na razini Europske unije. To je ono što je, po mom sudu, bilo prirodno u smislu brzine reakcije, ali sigurno nije dobar trend u smislu jačanja demokratskog legitimiteta europskih institucija, a pritom posebno mislim na punu uključenost Europskog parlamenta u sve ključne procese donošenja odluka.

Europsko vijeće jest, to je točno, ušlo u zakonodavnu sferu aktivnosti samoga Vijeća, međutim, mislim da su aktivnosti i Komisije i Parlamenta u institucionalnom trokutu pažljivo izbalansirane kompromisom u Lisabonskom ugovoru, a na nama je da pojačamo strukturiranu suradnju između Parlamenta i Vijeća. Posebno mi se čini da su zanimljive ideje o izvještavanju Europskog parlamenta od strane predsjednika Europskog vijeća. Mislim da g. Van Rompuy radi dobar i vrlo politički i diplomatski nijansiran posao, ujedno uz prisustvo Visoke predstavnice za vanjsku politiku. To bi, čini mi se, iz ovog kratkog iskustva od šest mjeseci, osvježilo odnose Parlamenta i Vijeća, i, u konačnici, smatram da je ključno pitanje da se Europsko vijeće pravodobno očituje o poštovanju volje europskih birača na predstojećim izborima 25. svibnja pri vrlo sofisticiranoj proceduri imenovanja predsjednika Komisije.

  Enrique Guerrero Salom (S&D). - Señor Presidente, este informe y el anteriormente debatido de los señores Gualtieri y Trzaskowski tienen varias cosas en común. Lo que más tienen en común es la denuncia del comportamiento institucional y político por parte del Consejo, que, a lo largo de todo este periodo de crisis, ha cometido errores desde el punto de vista institucional al caminar por el marco intergubernamental olvidando el método comunitario.

Es verdad que, como ha señalado el Vicepresidente de la Comisión, en algunos momentos ha habido que reaccionar rápidamente ante la inmediatez de los problemas y, seguramente, la única respuesta posible era la intergubernamental. Pero han pasado ya varios años y, ayer por la noche, el Consejo amenaza de nuevo con responder con un acuerdo intergubernamental a los problemas planteados a la unión bancaria. No se puede convertir en permanente lo que ha sido una respuesta de urgencia.

A su vez, la práctica en la negociación del marco financiero ha sido de auténtico acoso del Consejo Europeo al Parlamento Europeo. Un auténtico «bullying», tratando de condicionar la regulación del Parlamento para obtener unanimidad en el Consejo. Por tanto, en ese marco, las propuestas que hace el informe del señor Lamassoure me parecen, en general, correctas y coherentes, especialmente la que obliga al Presidente del Consejo Europeo a comparecer antes de la celebración del mismo. Es una práctica que existe en muchos países y es una práctica que debe implantarse en este Parlamento.

  Dubravka Šuica (PPE). - Gospodine predsjedniče, želim se zahvaliti gospodinu Lamassoureu koji je dobro proanalizirao stanje i koji je dobro proanalizirao odnose između Parlamenta i Vijeća nakon Lisabonskog ugovora koji je gotovo četiri godine već na snazi.

Činjenica je da Europsko vijeće ima status institucije, ali isto je tako jasno da nema zakonodavnu ulogu, ali zbog situacije, zbog krize, češće se sastajalo i malo po malo je, po mom mišljenju, izašlo izvan okvira svoje uloge. Mi kao parlamentarci definitivno hoćemo konzumirati ono što nam je Lisabonski ugovor dao i zato se slažem s ovih pet točaka koje je iznio gospodin Lamasourre vezano za sastanke Vijeća koji trebaju prethoditi raspravama u Europskom parlamentu.

Također se slažem s kalendarom sastanaka da se Vijeće održava između plenarnih sjednica a ne istovremeno. Isto tako ne bi bilo loše da se svake godine rasprava o stanju Unije napravi i u nazočnosti Vijeća i Komisije. Također, zašto ne bismo imali akcijski program rada? Razumijem da nekad nije moguće zbog trenutnih izvanrednih situacija, ali bi trebalo imati neki okvirni kalendar. I naposljetku, najnovija inovacija, a to je demokratizacija Europske unije na način da se bira predsjednik Komisije nakon izbora i sljedeće godine u svibnju prvi put ćemo moći testirati na djelu pitanje kako će se Komisija postaviti.

Dakle, ono što bi trebalo zaključiti je da trebamo formalizirati odnose između Vijeća i Parlamenta i da bismo trebali duh i slovo Lisabonskog sporazuma konačno primijeniti, unaprijediti odnose između Vijeća i Parlamenta, odnosno dati Parlamentu ulogu koju smo stvarno Lisabonskim sporazumom i dobili. Hvala još jedanput gospodinu Lamasourreu na njegovom izvješću.

  Jo Leinen (S&D). - Herr Präsident! Der Kollege Lamassoure erinnert sich noch gut daran, dass beim letzten Konvent Präsident Giscard d’Estaing gegen den großen Widerstand der großen Mehrheit der Konventsmitglieder durchgesetzt hat, dass der Europäische Rat ein eigenständiges Organ wird. Viele von uns haben befürchtet, dass die Staats- und Regierungschefs eine Eigendynamik, ein Eigenleben entwickeln werden, und genauso ist es gekommen. Wir stellen fest, dass dieses Gremium nicht kontrolliert werden kann, weder vom Europäischen Parlament noch von den nationalen Parlamenten.

Kollege Lamassoure hat einige Vorschläge gemacht, wie wir diese Demokratielücke vermindern können. Wir können sie nicht ganz verhindern, aber wir können sie vermindern. Wir brauchen eine Vereinbarung des Parlaments mit dem Europäischen Rat, dass vor und nach den Gipfeln Rechenschaft abgelegt wird, dass der Präsident auch hierher kommt und uns erklärt und auch hört, was wir zu sagen haben.

Es ist nicht mehr angemessen, dass unser Präsident nur zur Eröffnung eines Gipfels reden darf. Wenn es Themen gibt, die die Rechte des Parlaments berühren, dann muss er auch bei diesen Themen dabei sein.

Ich frage den Kollegen Lamassoure: Wir haben einige Präzedenzfälle, dass der Europäische Rat Gesetzgebung macht, was er nicht darf. Sollten wir nicht zum Europäischen Gerichtshof gehen und bei künftigen Fällen dagegen klagen? Der Test kommt jetzt bei der Europawahl. In der Tat, Van Rompuy und die einzelnen Mitglieder sollten vor der Wahl erklären, dass sie das Bürgervotum akzeptieren und nicht nach der Wahl damit spielen.

Langfristig stimme ich Andrew Duff zu: Der Europäische Rat sollte eine Formation des Rates werden: Er sollte der Allgemeine Rat werden, da hätte er viel zu tun und könnte sich sehr nützlich machen im Institutionengefüge der EU.

  Paulo Rangel (PPE). - Em primeiro lugar, eu gostava, naturalmente, de cumprimentar o colega Alain Lamassoure por este relatório, que considero, a vários títulos, exemplar e, portanto, tem sido de facto um dos deputados com quem tenho tido gosto de trabalhar e com quem mais aprendi aqui na casa e não quero neste momento deixar de o dizer.

Dito isto, o que é que me parece? Parece-me que talvez nós ganhássemos um pouco mais, embora este relatório seja de facto já um grande avanço, uma grande melhoria, em perspetivar constitucionalmente, e em termos de separação de poderes, o lugar do Conselho Europeu. O Conselho Europeu, neste momento, é um órgão de natureza híbrida, que tem uma dupla natureza, uma natureza mista. Por um lado, é um órgão quase de iniciativa legislativa, ou de impulso legislativo para o Conselho de Ministros e, portanto, é uma espécie de super câmara legislativa e, por outro lado, é um órgão de orientação política que se parece com um chefe de estado colegial, portanto, tem, no fundo, esta dupla natureza.

Enquanto órgão de direção política ou de indirizzo político, para usar a expressão italiana, eu acho que, obviamente, ele tem de dar algumas contas, tem de prestar contas ao Parlamento. Enquanto órgão que está no processo legislativo do Conselho, bem, ele é uma espécie de câmara alta ou de super câmara alta, e talvez aí não tenha que ter uma relação de prestação de contas ou de responsabilidade, portanto, acho que isto deveria ser separado.

Tenho também uma outra dúvida que é saber se há algum interesse em que o Presidente do Parlamento Europeu participe nas reuniões do Conselho. Isso faz-me lembrar uma espécie de solução inglesa antiga do King-in-Parliament, mas, neste caso, ao contrário, é o Parliament in King. Parece-me que isso não favorece a transparência constitucional no sistema da União Europeia. Talvez seja melhor trazer aqui o Presidente do Conselho para os debates, mas afastar claramente o Conselho e o Parlamento e instaurar uma separação de poderes. Um dos problemas que eu acho que a União Europeia tem institucionalmente é que presta pouca atenção à separação dos poderes e o Parlamento procura meter-se em poderes que não são seus, são executivos, são de direção política, são de relações internacionais e o contrário também acontece. E, portanto, quanto mais nós tornamos clara a separação de poderes, penso que mais ganharemos institucional e constitucionalmente.

Gospodine predsjedniče, uzimajući u obzir detaljno razmatranje određenih situacija i problema i prijedloge za rješavanje istih u odnosima Europskog parlamenta s institucijama koje predstavljaju nacionalne vlade, dozvolite mi da izrazim podršku ovom prijedlogu Rezolucije, posebno u odnosu na sljedeće: bilo je potrebno uzeti u obzir iskušenja čelnika država ili vlada da pribjegnu međuvladinim sredstvima što ugrožava „metodu zajednice”, kršeći ugovore.

Također je bilo potrebno uzeti u obzir činjenicu da je nedostatak strukturiranog dijaloga između Parlamenta i Europskog vijeća spriječio Parlament da u potpunosti ispuni svoju ulogu suzakonodavca uspostavljenu ugovorima.

Pozdravljam poboljšanje i učvršćivanje radnih odnosa između Europskog vijeća i Parlamenta; te način da se isto postigne međuinstitucionalnim dogovorom.

Podržavam također stav da svakoj sjednici Europskog vijeća treba prethoditi rasprava pred Europskim parlamentom, koja bi dozvolila usvajanje rezolucije te konačno da predsjednik Parlamenta treba sudjelovati na sastancima Europskog vijeća kada se rješavaju međuinstitucionalna pitanja.

  Marino Baldini (S&D). - Poštovani gospodine predsjedavajući, dragi kolege, poštovani predstavnici Komisije, gospodine potpredsjedniče, pozdravljam izvješće kolege Alaina Lamassourea kojim se ističe važnost i uloga Europskog parlamenta kao tijela nužno uključenog u procese pregovaranja i odlučivanja. Parlament kao tijelo čiji su članovi izravno izabrani od strane građanki i građana država članica po naravi svoje funkcije mora transparentno, konzistentno i u cijelosti biti uključen u svoje procese koji imaju legislativnu dimenziju, neovisno o tome od strane kojeg tijela dolazi zakonodavna inicijativa.

To svakako podrazumijeva nazočnost predsjednika Europskog parlamenta na svim sjednicama Vijeća koje imaju za temu međuinstitucionalne odnose Unije. Samo na taj način mogu se u cijelosti ostvariti načela i standardi procesa odlučivanja koji imaju svoje temelje u Lisabonskom ugovoru.

  Andrew Henry William Brons (NI). - Mr President, it is tempting to applaud the proposals for increasing the power of Parliament and increasing the accountability of the President of the European Council to it. Equally, it is easy to deprecate the behaviour of the European Council in trying to extend its role. If I were an enthusiast for the EU project, I would succumb to both temptations. However, I am not so I shall not. Do I look at the European Council through rose-tinted spectacles? No. My view of some of their members might involve unparliamentary language.

However, whatever I think of particular members of the European Council, its members represent Member States and are ultimately responsible to their electorates and removable by them. The Parliament, whatever its merits, is not responsible to a single electorate with a consciousness of its identity so it cannot take a conscious collective decision as to the choice of Commission President. Indeed its decision will look like the decision of a Ouija board.

  Maroš Šefčovič, Vice-President of the Commission. − Mr President, as is underlined in the report, the fact that under the Treaty the European Council has no legislative functions is very important and must be taken into account. In reality, very often different Council formations cannot complete their work and send the open files to the European Council so political agreement can be sought. I think that, as was stated in the report, we have seen quite a few such occasions over the last few years. Therefore I think that todayʼs debate very much reflects this new tendency and I understand very clearly the wish of Parliament to organise better the bilateral working relations between Parliament and the European Council.

Let me remind you that the Commission has a positive assessment of its framework agreement with Parliament. It has allowed our two institutions to establish clearer rules on various issues where potential conflict could not be excluded at the outset, and to settle them in a manner which ensured good and on most occasions, very smooth, cooperation.

I believe it will be important for the Council to be fully involved in any future revision of the framework agreement, so we can also cover these parts of EU cooperation. I have to say that in my discussions with the Ministers in the General Affairs Council there is already, I would say, a positive inclination to have discussions of this kind and to approach the future framework agreement discussion positively, with the clear intention that the Council should participate in them, which I find a very encouraging sign.

The Commission also agrees with Parliament that the European Council should take into account the outcome of the European elections and the appointment of the President of the next Commission, and fully respect all relevant Treaty provisions. As you know, Mr Barroso proposed that the political parties should nominate their candidates for this post because this would add additional democratic credentials to this process and would bring increased political visibility to the process of elections for the European Parliament and to the process of nominations for the Commissionʼs President.

So I would like to express my appreciation and thank the honourable Members for this debate and the rapporteur, Mr Lamassoure, for the high quality of the work on the report.

  Alain Lamassoure, rapporteur. − Monsieur le Président, je voudrais faire trois remarques de conclusion en remerciant tous les intervenants.

D'abord, je voudrais rassurer le commissaire Šefčovič. Si nous proposons qu'il y ait un débat annuel sur l'état de l'Union en présence du président du Conseil européen et du président de la Commission, ce n'est pas pour remplacer le débat annuel actuel mais pour compléter le débat qui, actuellement, porte sur le programme législatif par un débat plus large sur la situation interne et externe de l'Union.

Deuxième remarque, j'ai été très frappé par le très large consensus, sur tous les bancs du Parlement, sur le diagnostic, consensus auquel appartiennent, à la fois, les défenseurs traditionnels de l'Europe communautaire et aussi ceux qui préfèrent une Europe intergouvernementale. C'est l'intérêt des uns et des autres que nos deux institutions, le Conseil européen et le Parlement européen, travaillent mieux ensemble.

On dit qu'il faut être deux pour danser le tango. D'après le traité, aujourd'hui, le partenaire naturel du Parlement pour danser le tango, c'est le Conseil, mais le conseil des ministres est paralysé et, de son côté, le Conseil européen danse le tango tout seul, le Parlement n'ayant pas le droit d'être son partenaire. Il faut y remédier.

Enfin, dernière remarque, beaucoup d'intervenants, au nom de leur groupe, ont confirmé que le Conseil européen, l'année prochaine, ne peut pas, lorsqu'il aura à désigner le candidat au poste de président de la commission européenne, prendre le risque de nier le résultat du vote populaire.

De deux choses l'une, ou bien ce vote est clair et massif et il y a un vainqueur, à ce moment-là, le rôle du Conseil européen sera le rôle d'un chef d'État collectif, le rôle de la reine d'Angleterre, ou bien le résultat n'est pas tout à fait net, et, à ce moment-là, ce sera plutôt le rôle du roi des Belges.

Mais de toute manière, la décision finale appartiendra aux citoyens.
