  Louis Michel, rapporteur. - Madame la Présidente, chers collègues, l'Europe est une idée de liberté, de paix, de solidarité et de prospérité partagée mieux que partout ailleurs dans le monde. Ces valeurs sont ancrées politiquement, mais, surtout, juridiquement dans les traités européens. Il s'agit d'adhérer à ces valeurs et aux traités qui consacrent les droits fondamentaux de tous les citoyens européens.

Quand un État rejoint l'Union européenne, il s'engage juridiquement à respecter concrètement les textes qui consacrent nos valeurs communes. Or, nous observons dans tous les pays de l'Union européenne des transgressions des valeurs, des principes, mais aussi de la législation, laquelle doit garantir l'état de droit, le respect des valeurs d'humanité et d'universalité qui caractérisent nos institutions et nos textes.

Nous devons bien admettre qu'il existe encore trop d'endroits en Europe et trop de cas qui témoignent de manquements graves aux règles auxquelles, pourtant, tous les États ont souscrit pour rejoindre l'Union européenne. Il y a trop d'exemples où les États membres de l'Union européenne banalisent ou ignorent les droits des handicapés, des migrants, des Roms, des syndicats[nbsp ]–[nbsp ]le droit de grève, le droit d'association, de réunion, la protection de la vie privée, l'indépendance des médias, de la magistrature, de l'armée, et j'en passe.

Si l'Europe veut être une force morale qui entend influencer le monde pour le meilleur, elle doit être sévère et rigoureuse avec elle-même. Nous, Européens, avons raison de nous battre pour la démocratie, l'état de droit, l'impartialité de la puissance publique, la protection de la vie privée et des droits individuels et collectifs partout dans le monde. Mais nous le ferons avec d'autant plus d'efficacité si nous sommes crédibles.

Je le répète, les États membres, en adhérant à l'Union européenne, adhèrent aux actes législatifs qui garantissent l'exercice de ces valeurs. Certains oublient, malheureusement, encore trop souvent aujourd'hui ce à quoi ils se sont engagés hier.

Le rapport que nous vous présentons renforce la politique des droits de l'homme à partir des présents traités et ouvre une réflexion en vue d'une prochaine révision des traités. Rien n'empêche aujourd'hui les États membres de clôturer le processus d'adhésion de l'Union européenne à la Convention européenne des droits de l'homme, de clôturer le processus d'adhésion de l'Union européenne à la Charte sociale européenne, d'adhérer aux conventions du Conseil de l'Europe relatives aux droits de l'homme, de mettre en place le mécanisme de Copenhague, sous l'égide morale d'une commission de sages. Cela offrirait aux États membres la garantie d'être traités de façon égale, juste, transparente et objective, d'une part, et au citoyen d'être respecté dans ses droits fondamentaux.

Le deuxième pilier de la partie institutionnelle de ce rapport engage une réflexion sur de nécessaires modifications des traités. Mais nous prétendons que l'essentiel peut déjà être réalisé sur la base des traités actuels. L'adoption de ce rapport sera une avancée majeure pour garantir une meilleure protection de nos concitoyens. Ces droits fondamentaux et les valeurs européennes ne peuvent pas être traités comme des sujets distincts et contournables. Leur application doit être constante et horizontale. Le rapport demande d'intégrer des politiques et des programmes d'action ambitieux afin de garantir les droits fondamentaux, avec notamment l'adoption d'une directive antidiscrimination.

Nous avons été particulièrement attentifs à garantir l'application de l'article[nbsp ]2 du traité, à maintenir l'approche horizontale, à protéger les minorités et tous les citoyens en position de fragilité, à protéger les témoins qui osent dénoncer les situations illégales, à affirmer le droit fondamental à la vie privée et à consacrer la laïcité et l'impartialité de l'État.

Enfin, pour terminer, je souhaite m'adresser une dernière fois aux collègues qui présentent une résolution alternative. Je respecte, chers collègues, pleinement vos opinions, mais votre projet est une version totalement édulcorée de mon rapport. Vous le videz des éléments les plus fondamentaux. Vous préférez une approche sécuritaire qui, par certains aspects, honnêtement, m'inquiète. Vous proposez de supprimer de nombreuses références qui, pourtant, violent les droits fondamentaux, notamment les références à la Charte sociale européenne, à l'histoire européenne et à la genèse du projet européen, au mécanisme de Copenhague, au problème de surpopulation dans les prisons, au taux de suicide au sein de la communauté LGBT, au sécularisme et à la séparation stricte entre la religion et l'État.

  Viviane Reding, Vice-President of the Commission. - Madam President, I welcome this debate in Parliament because it is an important debate. One of my first commitments when I took up my responsibilities was to present an annual report on the application of the EU Charter and to have an annual debate every year on the way in which this Charter is applied. By this I was responding, de facto, to a request made by this Parliament and in particular to the 2007 report of Mr[nbsp ]Johannes Voggenhuber.

I am glad to see that today, on the basis of the report prepared by Mr[nbsp ]Louis Michel and the Commission’s Annual Reports, we are able to hold a fully informed discussion. You know that the Commission is currently preparing its annual report on the application of the Charter covering 2013. It will be published in April.

The Commission supports the call from Parliament to all EU institutions and to the Member States to take decisive measures to protect these rights within the EU. Well, in fact, the Commission has established a fruitful, regular and intensive exchange with this Parliament, but not only with this Parliament but also with national parliaments and with the Member States concerning the improvement of fundamental rights legislation.

Let me here also stress the work of the Fundamental Rights Agency. We have, over the last years, made substantial use of the expertise of this Agency. Just let me recall some of the last reports: access to justice, anti-Semitism and data protection. We observe that fundamental rights awareness has increased considerably, both as regards citizens and as regards the Member States’ authorities. This is evident from the Commission’s annual reports and in particular from the numbers of letters, questions and petitions we receive.

There is also a promising development regarding references to the Charter by national courts and by the Court of Justice. This is a very new development and it is fundamental because national judges are now increasingly aware of the impact of the Charter and they seek guidance from the Court on its application and interpretation through questions referred to the Court.

I see national courts as partners in giving concrete effect to the rights and freedoms enshrined in the Charter, as they directly ensure that individuals obtain full redress in cases of non-respect of fundamental rights within the scope of EU law.

As you have rightly pointed out in your report, there is room for still further improvement and the Commission is in the process of addressing a number of issues. For instance, last year’s revelations on mass surveillance by intelligence services have shown the pressing need for a strong data protection ruling. In this vein I warmly thank Parliament for its commitment to advancing our data protection reform. The aim here is to put individuals back in control of their data by updating their rights, in order to fully respect Article[nbsp ]8 of the Charter.

Explicit consent, the right to be forgotten, the right to data portability and the right to be informed of personal data breaches are important elements and they will help to close the growing rift between citizens and the companies with which they share their data. Furthermore, also on data protection, the Commission is negotiating an umbrella agreement with the US. Here the aim is to ensure that Europeans get a high level of protection and enforceable rights when their personal data is shared between law enforcement authorities in the EU and in the US.

I expect to see progress in the negotiations. I was encouraged with the movement shown last November by the Attorney General at the EU-US Ministerial meeting in Washington. I was encouraged by the constructive signals given in President Obama’s speech last month, but it will take more than words to rebuild trust. I hope that words will turn into action and that the US will deliver on political commitments and make the necessary changes in the practice and in the law.

Where the Charter is applicable the Commission will do everything in its power to check compatibility with and respect of fundamental rights. However, as you know, in areas outside the Charter’s applicability it is up to Member States to address the problems.

The debate about free movement within the EU has put on the agenda the urgent necessity of Roma integration across the EU. The Commission has assessed progress made in the Member States on the five preconditions for a successful implementation of national Roma integration strategies. It has also proposed and negotiated a Council recommendation that will make a difference when the measures it contains are implemented on the ground.

These conclusions have made it possible to formalise the shift of the European and national paradigm towards the local level, where major bottlenecks regarding Roma integration are situated. The Commission strengthened its dialogue with civil society and with the Roma communities themselves.

Furthermore, as recent research from the Fundamental Rights Agency has shown, the protection of people belonging to minorities, protection against hatred and discrimination, needs to be addressed further across the Union. Work needs to be done to fight racism, xenophobia, anti-Semitism, homophobia and gender discrimination.

Last month, on Holocaust Remembrance Day – 27[nbsp ]January – the Commission adopted a report on the implementation of Framework Decision 2008/913/JHA which aims to combat in particular racist and xenophobic crimes. It requires Member States to define as criminal offences public incitement to violence or hatred on grounds of race, colour, religion, descent, or national or ethnic origin. The Commission will engage in bilateral dialogues with Member States during 2014 to ensure correct transposition of the Framework Decision into national law.

The Commission takes into account women’s needs and gender discrimination. One flagship initiative, as you know, concerns the gender balance among non-executive directors of companies listed on the stock exchange. Here again, I appreciate the work Parliament has done. I expect discussions in the Council to advance similarly.

We are also concerned by the gender pay gap. The Commission has focused its work on the correct application of the Equal Pay Directive and has recently adopted a report on its application. The report provides examples of national best practices on matters such as gender-neutral job evaluation, classification, a summary of equal pay case-law of the Court of Justice, examples of national case-law on equal pay, as well as a description of the factors that cause the gender pay gap. These measures should help employers, social partners, national authorities and national courts to more effectively apply national law on equal pay. The Commission is also planning further initiatives – focusing on increased wage transparency – aiming to facilitate the effective application of the principle of equal pay in practice.

As regards trafficking in human beings, I would like to point to the EU Strategy in this field, which complements Directive 2011/36/EU on preventing and combating trafficking in human beings.

Last, but certainly not least, I would like to refer here to the need to uphold the rule of law. We have witnessed and we had to deal with very many rule-of-law crises in Member States in the past years. The events demonstrated that respect for fundamental values and in particular the value of rule of law cannot always be taken for granted.

We need to be sure that we have the tools to show our citizens that we can respond when these values are endangered. To see that all EU institutions are united around the need to uphold the rule of law, and in developing clear and effective initiatives in this field, sends a strong signal.

The Commission is working on ideas for a rule of law initiative. Yesterday the College held an orientation debate on the matter to look at the different angles of this issue. As a result the Commission intends to bring its ideas together in a communication to be presented shortly. In this context the suggestions and recommendations in Mr[nbsp ]Louis Michel’s report and in today’s debate will surely provide a valuable source of inspiration.

  Ádám Kósa, A Foglalkoztatási és Szociális Bizottság véleményének előadója. - Tisztelt Kollégák! A Foglalkoztatási és Szociális Bizottság véleményének előadójaként szeretném kifejezni sajnálatomat amiatt, hogy véleményünk bizonyos részeit a jelentés nem vette át. Viszont üdvözlöm, hogy Michel úr átvette azt a fontos gondolatot, miszerint az Európai Bíróságnak az Alapjogi Chartát értelmezési útmutatóként kell kezelnie a szociális és foglalkoztatási kérdésekben. Végezetül szeretnék arra az álláspontra is utalni, ami szintén szerepelt a jelentésben: a pénzügyi és gazdasági válság sokkal inkább érintette a leginkább rászorulók és legszegényebbek csoportjait, mint a válságot felelőtlenül előidéző személyeket. Tehát a politikai felelősséget vállalniuk kell a 2008–2009-ben kormányon lévő pártoknak.

  Antigoni Papadopoulou, rapporteur for the opinion of the Committee on Women’s Rights and Gender Equality. - Madam President, this report provides a valuable tool for holding EU institutions and Member States accountable for the situation of fundamental rights. The present crisis is a challenge for European milestone principles such as solidarity, respect for human rights, equality, non-discrimination and social cohesion. Our role as parliamentarians is to scrutinise EU institutions, reveal existing deficits and suggest corrective actions.

As the rapporteur for the opinion of the Committee on Women’s Rights and Gender Equality I would like to stress the persisting gender discrimination and to call for gender legislation monitoring as well as action to combat violence, pay gaps and exploitation of women. We are glad because the report by the Committee on Civil Liberties, Justice and Home Affairs endorsed several amendments by our Women’s Rights Committee.

Speaking of violated fundamental rights in the EU one cannot ignore the severe human rights violations by Turkey in my own country Cyprus. The EU should show zero tolerance when fundamental human rights are violated and this should also apply to Cyprus as well. After all, my compatriots are not second-class European citizens.

Mindenekelőtt szeretném megköszönni az előadó munkáját, de legfőképpen nyitottságát és kompromisszumkészségét. A jelentés széles merítésű, előremutató, de nyilván így is vannak benne olyan részek, amelyekkel nem lehet egyetérteni. A keresztényi értékrend szerint nem lehet elfogadni a kábítószerekhez való hozzáférés liberalizálását, de komoly erkölcsi problémát vet fel az eutanázia kérdése is.

Az emberi jogok helyzete Európában sem problémamentes, ahogy ezt a biztos asszony is többször hangsúlyozta. Itt is van bőven lehetőség az előrelépésre. Nyilván probléma az Alapjogi Chartában foglalt jogok általános hozzáférhetősége. Nem tisztázott például az a kérdés sem, hogyan lehet számon kérni az alapjogokat az diszkrimináció elleni irányelvek alkalmazásakor? Úgy tűnik, nem használtunk ki minden eszközt ennek a létező mechanizmusnak az alkalmazására a jogorvoslás terén, de az is vitatható, hogy valóban szükség van-e új mechanizmusokra.

Sajnálatos, hogy ezek az éves jelentések nem koncentrálnak olyan témákra, ahol valóban szükség lenne arra, hogy Európa odafigyeljen a fejleményekre, legyen az az igazságszolgáltatáshoz való hozzáférés, a magánélethez való jog, vagy a nemzeti kisebbségek helyzete és jogállása. Nyilván probléma a kettős mérce kérdése is: a nemzeti kisebbségek jogait a csatlakozó országok kötelesek tiszteletben tartani, a tagországokat erre semmi sem kötelezi. Így az Unió bővítése során azt látjuk, hogy a csatlakozás után a nemzeti kisebbségek helyzete ahelyett hogy javulna, inkább romlik. Az úgynevezett koppenhágai dilemmát előbb-utóbb fel kell oldani. A nemzeti kisebbségek helyzete nem múlhat csupán a többség hullámzó jóindulatán. A javasolt koppenhágai mechanizmus azonban több kétséget is támaszt, többek közt azt a valós veszélyt rejti, hogy az emberi jogok könnyen a politikai csatározások áldozatává válhatnak.

Sok területen határozottabb előrelépést vártunk el a tagállamoktól, és nagyon örülök, hogy a biztos asszony megemlítette az emberkereskedelemről szóló irányelvet, amelyet sajnálatos módon a tagállamok egy része ez idáig még át sem vett.

  Monika Flašíková Beňová, za skupinu S&D. – Európska únia vytvorila základný súbor právnych predpisov, ktorých primárnym cieľom je zaručiť rešpektovanie, ochranu a presadzovanie základných práv, a to aj prostredníctvom vytvorenia kodanských kritérií, začlenenia článkov 2, 6 a 7 do Zmluvy o Európskej únii, Charty základných práv, povinnosti pristúpiť k Európskemu dohovoru o ľudských právach a zodpovedajúcich vnútroštátnych ustanovení právnych predpisov členských štátov. S[nbsp ]nadobudnutím účinnosti Lisabonskej zmluvy charta pretvorila svoje hodnoty a zásady na konkrétne a vynútiteľné práva a stala sa právne záväznou pre inštitúcie, orgány a agentúry Európskej únie, ako aj pre členské štáty pri vykonávaní právnych predpisov. Európsky parlament viackrát požadoval posilnenie mechanizmov na zabezpečenie dodržiavania, ochrany a podpory hodnôt Únie uvedených v článku 2 Zmluvy o Európskej únii, ako aj riešenie krízových situácií v Únii a v členských štátoch. A v súčasnosti prebieha diskusia o vytvorení nového mechanizmu, v ktorej sa Komisia, Rada a členské štáty pripojili k Parlamentu a mimovládnym organizáciám. Komisia tiež oznámila, že by chcela posilniť zásady právneho štátu v Európskej únii a mohla by navrhnúť použitie formálnej výzvy podľa článku 7 ods. 1 Zmluvy o Európskej únii. Zároveň ste uviedli potrebu zmeniť zmluvy a oznámili, že navrhnete zmeny tak, aby bolo možné zorganizovať diskusiu počas volieb, a to aj o použití článku 7, a hľadať konsenzus o týchto návrhoch, ktorého cieľom by malo byť zabezpečiť, aby politika Európskej únie v oblasti základných práv v Európskej únii vychádzala z jasných pravidiel a mechanizmov, objektívnych ukazovateľov a údajov, aby bola transparentná, spravodlivá a najmä aby pevne chránila individuálne práva, demokraciu a právny štát. Ako už spomenul spravodajca, v rámci Európskej únie a v členských štátoch stále dochádza k mnohým porušovaniam základných práv a vyplýva to aj zo správ, či už ročných, alebo osobitných Európskej komisie, agentúry pre základné práva, Rady Európy a mnohých ďalších organizácií. Dotknuté subjekty zaznamenali zistenia, najmä pokiaľ ide o situáciu porušovania práv menšín, ale tiež médií a novinárov, či konanie bezpečnostných síl, polície a tajných služieb. Na tomto mieste by som sa chcela poďakovať spravodajcovi, pánovi Michelovi, za veľmi dobrú spoluprácu a za veľmi dobrú diskusiu. A na záver môjho vystúpenia by som chcela, kolegyne a kolegovia, upozorniť na to, že o tri mesiace nás čakajú voľby do ďalšieho legislatívneho obdobia Európskeho parlamentu. Verím, že prijatie tejto správy, tak ako bola schválená vo výbore, aj v zajtrajšom hlasovaní bude dobrým signálom pre našich občanov v členských štátoch, že je to práve Európsky parlament, ktorý sa bude vždy snažiť dohliadať na dodržiavanie ich základných práv.

  Renate Weber, on behalf of the ALDE Group. – Madam President, I strongly believe that we as the European Union must set an example of how much human rights mean to us and how determined we are to protect them in our own home, Europe. Of course it is the duty of each national legal system to observe the rights and liberties provided for by the EU Treaties and the Charter. But we should be able to both monitor and sanction each and every Member State if they fail to carry out their duty. This is why I firmly believe that we need an objective and effective mechanism aimed at monitoring compliance with the Copenhagen Criteria by every Member State.

So far, only the accession countries have been subjected to such scrutiny and, in addition, a cooperation and verification mechanism was set up only for Romania and Bulgaria. When a majority of Member States has the power of verification on just two countries, such a mechanism becomes a political weapon. This was crystal clear on at least two occasions: firstly, when the EU decided not to use the tools provided for by the Treaty for a wide scrutiny on Hungary; secondly, when some Member States invoked such scrutiny to deny Romania’s and Bulgaria’s rightful claim to enter the Schengen area. It is high time we ended the double standards when it comes to judging how well one Member State upholds the rights enshrined in the Treaty, or how well their justice system works. We are a Union, and we should share the same rights and have the same penalties applied if we break the rule of law.

  Rui Tavares, em nome do Grupo Verts/ALE. – O relatório que nos encontramos a discutir aqui hoje sobre direitos fundamentais na União Europeia no ano transato é uma das melhores peças de relatório de iniciativa de opinião política de marcação de agenda que eu li sobre estes temas aqui, no Parlamento Europeu, durante este mandato. É um relatório abrangente, é um relatório que é coerente internamente e é um relatório que não se dedica só a fazer o diagnóstico, mas pretende fazer também um prognóstico e lançar prescrições para o futuro naquilo em que, de facto, deveria ser a nossa principal missão, isto é, manter o Estado de direito, os valores democráticos e os direitos fundamentais sempre bem vivos e promovidos dentro da União Europeia. Portanto, parabéns ao nosso colega Louis Michel pelo excelente trabalho desenvolvido.

Meus Caros Colegas, Senhora Comissária, de facto, este desiderato dos direitos fundamentais, do Estado de direito e dos valores democráticos na União é o maior desafio da União. Sempre foi desde o início, não tenhamos dúvidas acerca disso. Quando se fez uma Comunidade do Carvão e do Aço ou uma Comunidade Económica Europeia, sempre os pais fundadores da União disseram que esses instrumentos só serviam um propósito, que era o de garantir a paz dentro da União e garantir a paz através do respeito pelo Estado de direito em cada Estado-Membro da União. Senão, voltamos à mesma situação que tivemos durante a Sociedade das Nações, em que um Estado-Membro testa os limites dos princípios da nossa Comunidade, outro, a seguir, viola esses princípios e depois, quando finalmente os políticos acordam, já é tarde demais.

Essa é a nossa principal missão agora: evitar que venha a ser tarde demais. Os limites já estão a ser testados neste momento, a nossa resposta foi atrás dos acontecimentos, não foi uma resposta ativa, foi uma resposta apenas reativa. Todas as instituições - Comissão, Parlamento, Conselho - têm diferentes defeitos na forma de lidar com estes assuntos. A Comissão porque não se encontra ainda democraticamente legitimada, o Parlamento porque é uma instituição demasiado política, o Conselho porque cada Estado-Membro acha sempre que é o próximo na linha que vai ser acusado de violação de direitos fundamentais. É preciso, fundamentalmente, criar instituições não políticas, instituições prestigiadas e neutrais e é por isso que aqui neste relatório se pede a criação de uma Comissão de Copenhaga, que possa desempenhar esse papel e premir o botão de alarme quando o alarme de facto já está instalado num dos nossos Estados-Membros.

  Cristiana Muscardini, a nome del gruppo ECR. – Signora Presidente, onorevoli colleghi, signor Commissario, è paradossale che nel 2014 si debba ancora parlare della mancata implementazione da parte degli Stati membri dell'Unione di quei valori di democrazia e Stato di diritto che avrebbero dovuto costituire il fondamento dell'integrazione europea.

Sono ancora molte le lacune esistenti in vari paesi. In Italia continuano ad esistere carceri dove sono rinchiusi migliaia di detenuti in condizioni inaccettabili. In Germania, nella grande Germania, continuano ad esistere istituti come lo Jungendamt a danno della libertà e dei diritti dei figli di coppie binazionali e dei diritti dei entrambi i genitori.

L'Europa ha aperto le frontiere alle merci, ma alcuni paesi le hanno chiuse per i bambini. Pochi paesi hanno sottoscritto la Convenzione di Istanbul contro la violenza sulle donne, sui minori e sugli anziani e non tutti gli Stati hanno accettato di chiedere ai propri agenti di polizia di usare i numeri identificativi. Sono molte le questioni aperte in tema di diritti civili, tutela dei rifugiati e libertà di espressione. Oltre ai nostri confini uomini e donne combattono per avere quei diritti che sono stati loro negati. Anche in Europa diventa sempre più necessario garantire che non si debba più negoziare per i diritti fondamentali. Occorre anche una Carta comune dei doveri, dei doveri delle istituzioni verso i cittadini e dei cittadini verso le istituzioni.

  Marie-Christine Vergiat, au nom du groupe GUE/NGL. – Madame la Présidente, je voudrais tout d'abord remercier M.[nbsp ]Michel pour sa volonté et sa capacité à tenter de fédérer l'ensemble de nos points de vue. Je dirais même concilier l'inconciliable,[nbsp ]comme je le lui ai déjà dit. Nos échanges ont été quelquefois vifs, mais les résultats sont là. Un grand merci aussi aux rapporteurs fictifs, qui ont joué le jeu, et à nos collaborateurs, pour le travail accompli.

Ce rapport et son annexe nous donnent à voir combien les droits fondamentaux sont bafoués à l'intérieur de l'Union européenne, et la situation s'aggrave, du fait notamment de la crise financière et de l'incapacité de l'Union européenne et de ses États membres à y faire face.

Une résolution alternative cherche à vider le rapport de son contenu en nous expliquant que ces violations relèvent de la compétence des États. Nous le savons, c'est l'application des traités. Mais les traités, c'est aussi l'article[nbsp ]2; ce sont aussi ces valeurs dites "européennes", mais en réalité universelles. Et respecter ces valeurs, c'est faire en sorte que les droits fondamentaux, que les droits des femmes et des hommes qui vivent sur le territoire de l'Union européenne, soient aussi bien protégés que les marchandises et les capitaux. Et nous en sommes loin! Et il n'est guère étonnant, dès lors, que tant de nos concitoyens ne voient plus dans le rêve européen qu'un horizon éloigné.

Ce rapport trace des pistes pour que ces valeurs prennent enfin corps, et je m'en félicite. Mais si les droits fondamentaux sont universels, ils sont aussi indivisibles. Cela veut dire que les droits économiques et sociaux doivent être aussi bien respectés que les droits civils et politiques. Le rapport est un peu faible dans l'équilibre en ce domaine, c'est pourquoi j'ai présenté quelques amendements en ce sens, et j'espère que certains seront adoptés.

Je vais donner un seul chiffre pour appuyer mon point de vue: entre 2008 et 2012, le pourcentage des personnes vivant en-deçà du seuil de pauvreté est passé de 18 à 25[nbsp ]%, sans parler de l'aggravation du chômage, et particulièrement de celui des jeunes, notamment dans les pays du Sud de l'Europe. En période de crise, ce sont les plus vulnérables qui trinquent, qu'il s'agisse des personnes âgées, des handicapés, des migrants, des Roms, des femmes ou des LGBT, tout ce que veut faire disparaître la résolution alternative.

À force d'écouter certaines sirènes, certains oublient les valeurs dont ils se gargarisent pourtant à l'étranger. C'est une question de cohérence.

  Νικόλαος Σαλαβράκος, εξ ονόματος της ομάδας EFD. – Κύριε Πρόεδρε, η έκθεση του κυρίου εισηγητή πάνω σε ένα τόσο σημαντικό θέμα, όπως είναι αυτό των ανθρωπίνων δικαιωμάτων, έχει ενθουσιασμό, περιέχει αρκετά θετικά αλλά και ορισμένα - δεν θα πω αρνητικά - μη ρεαλιστικά στοιχεία. Πιο συγκεκριμένα, πέραν της αντίθεσής μας στην ελεύθερη πρόσβαση στα ναρκωτικά και τα ερωτηματικά μας για την ευθανασία, στην παράγραφο 42 της έκθεσης γίνεται λόγος για την ευρύτερη αρχή της μετανάστευσης και για την αρχή της μη επαναπροώθησης.

Η αρχή της επαναπροώθησης των παράνομων μεταναστών και η σύναψη συμφωνιών επανεισδοχής αποτελούν το πρακτικότερο διαθέσιμο εργαλείο για την πρόληψη και την αντιμετώπιση της παράνομης μετανάστευσης, και θα πρέπει να αποτελούν επίσης σταθερή παράμετρο των εξωτερικών σχέσεων της Ευρωπαϊκής Ένωσης με τις τρίτες χώρες. Εδώ λοιπόν διαφωνούμε! Άλλωστε τα ανωτέρω κατοχυρώνονται από νομοθετήματα και συνθήκες αυξημένης τυπικής ισχύος έναντι της έκθεσης αυτής.

Επιπρόσθετα, κάποια σημεία της έκθεσης, όπως αυτά για μηχανισμούς παγώματος των νομοθετικών διαδικασιών των κρατών μελών και η σύνταξη πινάκων επίδοσης, θεωρώ ότι ξεφεύγουν από το πλαίσιο της δικαιοδοσίας του Ευρωπαϊκού Κοινοβουλίου και πρέπει να γίνει σεβαστή η αρχή της αναλογικότητας. Θεωρώ σημαντικό, σε περίοδο οικονομικής κρίσης, να εστιάσουμε την προσοχή μας στην διαφύλαξη των δικαιωμάτων στην εργασία, την κοινωνική πρόνοια και την υγεία.

Δεν χρειάζεται να πάμε μακριά σε τρίτα κράτη· αυτήν την περίοδο και εντός της Ευρωπαϊκής Ένωσης, με τις δημοσιονομικές περικοπές και σε άλλες ‘μνημονιακές’ χώρες, η διαφύλαξη των θεμελιωδών ανθρώπινων δικαιωμάτων είναι πολύ κακή για τις ιδιαίτερα ευάλωτες ομάδες του πληθυσμού.

  Krisztina Morvai (NI). - Nagyon szép meglepetést hozott az alapvető jogok helyzetéről szóló jelentés, hiszen újdonságként hangsúlyozta az őshonos nemzeti közösségek jogait, mint emberi jogokat. Kérdezem az itt jelen lévő Viviane Reding biztos asszonyt, hogy áttehető-e majd ez az elmélet a gyakorlatba a most forrongásban lévő Ukrajnához jelenleg tartozó, valaha Magyarországhoz tartozott, de békediktátumokkal elszakított Kárpátalja vonatkozásában, ahol hagyományosan békességben élnek együtt magyarok, ruszinok és más nemzetek, más népek. Ön szerint támogatja-e, illetve Ön hogy nyilatkozik – támogatja-e az Európai Unió az ő nemzeti önrendelkezéshez való jogukat, ami azt jelenti, hogy a Luxemburgnál egyébként ötször nagyobb terület választhatja az autonómia útját, választhatja a teljes önállóság útját vagy kérheti a Magyarországhoz történő visszacsatolását.

  Véronique Mathieu Houillon (PPE). - Monsieur le Président, Madame la Commissaire, chers collègues, chaque année, nous nous prêtons à cet exercice crucial d'évaluation de la situation des droits fondamentaux dans l'Union européenne. Mais là, une fois encore, et je le regrette, on nous propose un rapport idéologique et hors sujet. Pêle-mêle, on y trouve toutes sortes de recommandations et d'accusations que je pourrai difficilement soutenir demain à l'occasion du vote. Le rapport demande, par exemple, la mise en place d'une commission de Copenhague, une espèce de nébuleuse qui s'ajoute à des structures déjà très efficaces. Je voudrais savoir quels seront les experts qui pourront juger du respect des droits fondamentaux. Pourquoi vouloir à tout prix politiser cette question, alors que nous avons déjà un suivi impartial de la Commission, de la Cour de justice de l'Union européenne et de la Cour européenne des droits de l'homme?

Le rapport attaque les forces de police, toutes amalgamées pour mauvais traitement, par exemple. On souhaite la dépénalisation des stupéfiants, ce qui est quand même édifiant. Et il faudra qu'on m'explique le lien qui existe entre tout cela et les droits fondamentaux.

Chers collègues, je voudrais vous dire aussi que la gauche et les libéraux n'ont pas le monopole de la défense des droits fondamentaux. La droite s'est toujours engagée pour la défense des droits de l'homme, et elle est fière de cette situation. Par exemple, dans mon pays, Nicolas Sarkozy n'a pas attendu la gauche pour instaurer un défenseur des droits de l'homme en France. Il y en a un dans chaque département depuis 2008, et c'est pour cette raison notamment que nous avons déposé notre propre résolution alternative, dont le PPE est très fier.

En fait, il nous reste beaucoup à faire pour les droits fondamentaux en Europe, pour les personnes handicapées, pour l'égalité entre hommes et femmes, contre le racisme et contre toute forme de discrimination. La liste n'est certes pas exhaustive, mais comment pourrait-elle l'être? Soyez raisonnables, ne pas nommer une catégorie, ce n'est pas forcément la discriminer.

Et plutôt que de protéger les citoyens, plutôt que d'essayer d'avancer ensemble pour les groupes les plus vulnérables, le rapport Michel détourne le débat d'une façon contreproductive, alors que nous devrions nous battre ensemble pour ceux qui en ont besoin. C'est la raison pour laquelle nous voterons notre propre résolution.

  Claude Moraes (S&D). - Mr President, the shadow for our group, Ms Flašíková[nbsp ]Beňová, has already spoken for our group and supported the rapporteur, Louis Michel. As an S&D speaker, I would also like to support this report.

This is now my third term in this Parliament, and I think I understand that the Fundamental Rights report does a number of things. Firstly, it does the impossible, which is to call the European Union a community of values. This in itself is a very broad thing to have to do. When it does it, it does two things: it tries to keep up to date with what that means and, secondly, it then makes the rapporteur fall into controversies.

I think we have to settle on a report which commands enough support across this Parliament. We take the view that Louis Michel has produced a challenging report, but a good report. I would like to give some snapshots of where we think he has done that. He has challenged us; but do we want to produce a report which is merely cosmetic, which does not make us think and which does not really tell our citizens what fundamental rights are? Let me give you three quick examples. We would never have talked about the balance between security, fighting terrorism and mass surveillance in the past, yet this is now something that many of us across the political spectrum can debate and sometimes agree on. We do not want our citizens to suffer mass surveillance of their data; we want them to be protected against terrorism. We need to find the balance. Louis Michel has touched on this issue in his report.

He has touched on a completely different issue: the fight against anti-Semitism. How many of us would disagree with this in the European Union of today?

It is of course a question of balance and of how we do it, but I would go further and say that anti-discrimination is something that we should extend to other areas. There will, of course, be disagreements on exactly how we do it, but I think again he is challenging us and that we are getting the balance right. Is it right to leave migration, the most sensitive of topics, out of such a report? I do not think so.

So these are just three snapshots that I have seen in this report which I believe should be there. Overall he has done a good job, challenged us and come to the conclusion that we are a community of values. That is what we should be. I think we should support this report for that reason.

  Cecilia Wikström (ALDE). - Herr talman! Vi debatterar nu en av de allra viktigaste frågorna för Europeiska unionen. Kom ihåg att den grundades på principen om alla människors lika värde och grundläggande rättigheter.

För att bli medlem i EU krävs att man uppfyller Köpenhamnskriterierna, som bl.a. kräver en stabil demokrati och respekt för grundläggande mänskliga fri- och rättigheter. Dessutom ska man skydda minoriteter och deras rättigheter.

Men när man väl är medlem finns det ingen mekanism som ställer landet i fråga till svars om man inte fullföljer dessa grundlägganden åtaganden. De senaste åren när vi har lidit under den ekonomiska krisen har vi samtidigt sett att land eller efter land bryter mot respekten för grundläggande rättigheter, men kritiken är inte lika hård och åtgärderna är inte lika kännbara som om man bryter mot den ekonomiska stabilitetspakten.

Varför tar vi inte detta på lika stort allvar? Kom ihåg att EU finns till för att säkra medborgarnas rättigheter och inte medlemsländernas möjligheter att kränka sina medborgares grundläggande rättigheter.

De senaste åren har vi sett exempel på medlemsländer som har brutit mot stadgan om de grundläggande rättigheterna. Det tydligaste exemplet är så klart Ungern där man har inrättat ett statskontrollerat mediaråd – inget annat än en stor censurmyndighet, där man diskriminerat minoriteter, inskränkt rättsväsendets oberoende och andra saker. Med en högerextremism som är på frammarsch har vi sett grundläggande rättigheter urholkas i ännu flera länder.

Därför är det nu mycket hög tid att skapa en oberoende kommission eller mekanism som granskar alla medlemsländer och som föreslår sanktionsmyndigheter när det skulle behövas.

Brott mot grundläggande värden måste få konsekvenser, både ekonomiska och politiska. Jag välkomnar den här rapporten som tar så tydligt stöd för grundläggande rättigheter och säkrar deras efterlevnad, och jag uppmanar er alla att helhjärtat stödja Louis Michels betänkande, som är fantastiskt viktig.

  Krisztina Morvai (NI), blue-card question. – Would you be so kind to explain to me why this body is so obsessed with Hungary when it comes to human rights violations? Can you name another Member State which has been referred to so often in the context of human rights violations? If you look at countries such as Romania, Slovakia and so on – plus Serbia, which of course is not yet a Member State – which violate the human rights of native Hungarians there on a mass basis, the European Union does not do anything whatsoever.

First of all, the media council that they put in place is nothing but a big censoring authority. Secondly, to have forced retirements on judges and prosecutors constitutes an undermining of the principle of the rule of law in a democracy in a European Member State.

Hungary is a tremendous example of where fundamental rights have not at all been respected as they should have been, and for that Hungary needs to take responsibility.

  Ruža Tomašić (ECR). - Gospodine predsjedniče, mogla bih dugo pričati zašto se ne slažem s ovom i ovakvim rezolucijama, ali ću se umjesto toga usredotočiti samo na jednu pojedinost. Primjećujem kako se iz sjednice u sjednicu u ovom visokom domu popis takozvanih ranjivih skupina povećava. Sada tu već spadaju i osobe osumnjičene za terorizam. O ovoj Rezoluciji dovoljno govori činjenica da su upravo osumnjičeni za terorizam dobili jednako prostora u poglavlju o pravu na dostojanstvo kao siromašni koji su danas najbrže rastuća društvena skupina u Europi.

Izvjestitelj u svom zalaganju za prava raznih manjina zaboravlja kako su u siromaštvu svi jednaki, bez obzira na dob, spol, nacionalnost te rasnu i vjersku pripadnost. Zbog rigoroznog ovršnog zakona, u Hrvatskoj bez krova nad glavom ostaju ljudi koji prema liberalnim kriterijima često izrađenima u ovome domu ne spadaju u takozvane ranjive skupine. Pripadnici su većinskog naroda, većinske vjere, većinske spolne orijentacije, ali su svejedno ostali bez svojih domova. Smatrate li da neki drugi slučajevi imaju prednost pred ovakvima, samo zato što se radi o pripadnicima manjima? Ima li kod siromaštva doista mjesta za pozitivnu diskriminaciju?

  Magdi Cristiano Allam (EFD). - Signora Presidente, onorevoli colleghi, voterò contro questa risoluzione perché questa Europa sta implodendo, non perché non vengano rispettati i diritti, ma perché si sono del tutto dimenticati i doveri. Elargiamo a piene mani diritti e libertà, senza chiedere in cambio l'ottemperanza dei doveri e il rispetto delle regole.

Prima di preoccuparci della discriminazione dei Rom e degli immigrati – e addirittura si citano i sospetti terroristi tra le categorie che dovrebbero essere tutelate – dobbiamo occuparci della discriminazione dei cittadini. Nel mio paese, l'Italia, sono gli italiani ad essere discriminati nell'assegnazione delle case popolari, dei posti agli asilo nido pubblici, dei sussidi e delle pensioni sociali.

Da ex immigrato orgogliosamente cittadino italiano, da sociologo e da giornalista che per trentacinque anni si è occupato di immigrazione, sento il dovere di mettere in guardia questa Europa dall'esplosione di un'ondata di razzismo non perché, come vorrebbe far credere questa proposta di risoluzione, verrebbero discriminati gli immigrati o i sospetti terroristi, ma perché si discriminano i cittadini dei paesi europei per la nostra sottomissione a un'ideologia globalista, immigrazionista, buonista e relativista. Io mi ribello a un'Europa così come prospettata da questa risoluzione. Dico no all'Europa che si presenta come una landa deserta, dove chiunque arriva pianta la propria tenda e detta le proprie condizioni, finendo per trasformarci in una terra di conquista.

  Auke Zijlstra (NI). - Wij spreken vandaag over de eerbiediging van de grondrechten. En iedere lidstaat van de Europese Unie biedt waarborgen voor de democratie, voor de rechtsstaat, voor de mensenrechten. Anders waren zij immers geen lid.

Maar in dit Parlement roept Voorzitter Schulz op tot het inperken van de vrijheid van drukpers door te stellen dat een islamkritische film niet verder verspreid mag worden.

Dit Parlement wil vrije discussies van vrije burgers beïnvloeden door anonieme propaganda op internet voor een Europees project tijdens de Europese verkiezingen.

En dit Parlement wil nog steeds dat Turkije toetreedt, een land dat geen enkel grondrecht erkent en dat journalisten opsluit. Voorzitter, dit Parlement beschermt helemaal geen grondrechten, zelfs niet het recht van volkeren op zelfbeschikking, terwijl de Europese Unie zich tot een superstaat ontwikkelt, waarin burgers alleen nog een speelbal zijn van ongekozen bureaucraten.

Voorzitter, Nederland moet uit de Unie. Mijn partij heet niet voor niets de Partij van de Vrijheid. De Nederlandse vlag moet weer in vrijheid wapperen, dan pas zullen de Nederlanders hun grondrechten gegarandeerd zien.

  Marco Scurria (PPE). - Signor Presidente, onorevoli colleghi, ho ascoltato il relatore Michel che chiedeva di ripensare la possibilità di presentare la nostra relazione arrivando a definirla addirittura inquietante. Cominciamo bene a discutere sulla situazione dei diritti fondamentali, il primo dei quali dovrebbe essere quello di rispettare le idee degli altri.

Che cosa ci sarebbe di inquietante quando scriviamo che vogliamo il divieto assoluto della tortura e dei trattamenti crudeli, quando sottolineiamo che vogliamo lottare con forza contro il terrorismo e la criminalità organizzata? Cosa c'è di inquietante quando condanniamo qualunque forma di discriminazione legata all'orientamento sessuale, quando riconosciamo la libertà di pensiero, di coscienza, di religione, di credere e di non credere, nonché di praticare la religione di propria scelta? Cosa c'è di inquietante quando vogliamo che siano rispettati e tutelati i diritti dei rifugiati, dei migranti e dell'assistenza umanitaria ai migranti che si trovano in pericolo in mare? Cosa c'è di inquietante quando ci preoccupiamo per il fatto che le persone con disabilità continuano ad essere vittime di discriminazione ed esclusione e quando condanniamo qualunque persecuzione, violenza, discriminazione dei Rom nell'Unione europea, e tante altre cose ancora?

Personalmente, ciò che invece non mi convince – non voglio dire che sia inquietante, per carità – della relazione del collega Michel è l'alto tasso ideologico di cui è infarcita e che rischia davvero di compromettere la realizzazione dei diritti fondamentali perché, attraverso la parvenza di diritti fondamentali, entra in situazioni che in tutti i nostri Stati sono ancora controverse, sono discussioni politiche di parte e che nulla hanno a che vedere con i diritti fondamentali.

  Sylvie Guillaume (S&D). - Monsieur le Président, Madame la Commissaire, chers collègues, c'est toujours un moment important que celui du débat sur les droits fondamentaux dans l'Union européenne, qui s'appuie sur l'excellent rapport de notre collègue Louis[nbsp ]Michel. Cette année encore, le texte dresse une analyse franche et courageuse de la situation actuelle dans les États membres.

De la même façon que nous portons un regard souvent critique sur la situation de ces droits dans le reste du monde, il est de notre devoir de parlementaire européen de reconnaître que, dans quelques domaines, la longue marche pour l'égalité des droits reste encore à mener aussi dans l'Union, et ce plus encore alors que la crise économique perdure et qu'elle laisse sur le bord de la route de plus en plus de personnes marginalisées.

Notre responsabilité est donc certainement de condamner les violences racistes, antisémites, homophobes, transphobes et xénophobes, ainsi que les discriminations qui frappent les migrants et les groupes ethniques, tout cela à des niveaux alarmants, en particulier sur l'internet. Et cela m'amène aussi à rappeler que le Conseil doit se prononcer –[nbsp ]enfin![nbsp ]– sur la directive antidiscrimination adoptée par le Parlement il y a maintenant cinq ans.

Mais je retiens également de ce rapport l'appel formulé à l'adresse des États membres pour qu'ils révisent les législations prévoyant des sanctions à l'encontre des personnes qui portent secours aux migrants en détresse en mer. Face à des tragédies comme celle de Lampedusa en octobre dernier, il faut en finir avec des pratiques qui mettent gravement en péril la vie d'êtres humains, et ce quel que soit leur statut.

Dans cette même perspective, nous appelons le groupe de travail pour la Méditerranée à lancer au plus vite un plan complet en matière d'immigration et d'asile, sur la base de la solidarité et du partage des responsabilités. Dans cette démarche, toutes les institutions européennes et les États membres doivent se mobiliser pour améliorer sensiblement les droits des Européens.

Ce débat intervient également alors que, dans certaines de nos démocraties européennes, on traverse des heures sombres, et il y a dans l'atmosphère un fort parfum des années[nbsp ]30. J'en veux pour preuve les discours en faveur de l'édification de frontières de plus en plus étanches, du repli sur soi, la recherche de boucs émissaires aux échecs économiques et sociaux ou encore le dénigrement systématique des institutions.

Il s'agit d'une incroyable remise en cause des valeurs européennes que sont la non-discrimination, la tolérance, la justice, la solidarité et l'égalité entre les femmes et les hommes.

C'est dans ce contexte que nous devons exprimer nos préoccupations. Nous devons nous mobiliser pour que les droits fondamentaux ne se réduisent pas à de simples vœux pieux. Et dans un contexte déjà inquiétant, j'estime qu'il est particulièrement surprenant de voir fleurir une résolution alternative, qui masque de réelles problématiques et qui gomme notamment toute référence aux questions de droit et à la santé sexuelle ou encore au programme de surveillance de la NSA.

  Andrew Henry William Brons (NI). - Mr President, in the eyes of the EU all rights are equal but some are more equal than others. In any democracy the political rights – freedom of expression, freedom of assembly and electoral rights – should be pre-eminent. Why? Because they are the key to all the others: their recognition, their extent and their limitations. Indeed many of the personal rights were established only with the exercise of these political rights.

However, the EU regards the personal rights – chosen or determined behaviour, freedom from constraint, prohibition of discrimination, freedom of movement – to be paramount. If there should be a conflict between, say, freedom of expression and one of these personal rights, freedom of expression would be the loser.

What they are really saying is that the political rights were simply vehicles for campaigning for their range of personal rights. Once these have been elevated to the status of having self-evident virtue, the political rights have served their use and have become redundant.

  Anna Záborská (PPE). - Demagógia zástancov takzvaného práva na potrat nemá mieru. Charta základných práv v časti o ľudskej dôstojnosti hovorí, že každý má právo na život, a reprodukciu spomína len pri zákaze klonovania ľudských bytostí. V[nbsp ]predloženej správe v oblasti ľudských práv v Európskej únii sa dočítame, že základným prvkom ľudskej dôstojnosti sú reprodukčné práva, teda aj potraty. Pritom Európsky súdny dvor potvrdil, že aj nenarodenému ľudskému plodu prináleží dôstojnosť a integrita. Charta základných práv má túto dôstojnosť chrániť. Obhajovať potrat odkazom na chartu je nielen svojvoľnou dezinterpretáciou. Ja osobne odmietam túto demagógiu. Správa tiež navrhuje zväčšiť kompetencie Európskej komisie a Agentúry pre základné práva, aby mohli vstupovať do vnútorných záležitostí členských štátov. Porušil by sa tým princíp subsidiarity, ktorý je jedným z hlavných pilierov európskeho projektu. Práve subsidiarite vďačíme za krehkú rovnováhu právomocí a zodpovednosti. Jej porušenie by viedlo k strate legitimity a posilnilo by nárast radikálneho nacionalizmu v členských štátoch. Preto by sme mali takéto návrhy jednoznačne odmietnuť.

  Kinga Göncz (S&D). - Nem működik a hatalmi ágak szétválasztása, a kormányzat egy sor független intézmény felett vette át az ellenőrzést, korlátozta a véleménynyilvánítás szabadságát és egyéb demokratikus alapjogokat, és megkurtította az Alkotmánybíróság jogköreit. A politikai hatalom mellett a gazdaság és a kultúra felett is átvette az irányítást. A fenti értékelés nem egy tagjelölt országról született, hanem egy lassan már 10 éves tagsági viszonnyal rendelkező európai uniós országról készítette nemrégiben a német Bertelsmann Alapítvány. Vajon zöld jelzést kapna-e a csatlakozásra az az ország, amelyben ilyen problémákat tapasztal a nemzetközi szervezetek sora. A válaszunk határozott nem.

Vajon rendben van-e, hogy a csatlakozás után nincs az európai intézmények kezében hatékony eszköz a koppenhágai kritériumok betartatására, az uniós alapértékek védelmére. Az Európai Parlament többször és határozottan nemmel felelt erre a kérdésre. Luis Michel jelentése már az ötödik parlamenti dokumentum, amely felszólítja az Európai Bizottságot és a Tanácsot egy olyan közösségi ellenőrző és szankcionáló rendszer felállítására, amely elejét veszi a súlyos és rendszerszerű jogsértéseknek, illetve hatékony, gyors, egyenlő mércével mérő beavatkozást tesz lehetővé.

A válság világossá tette pénzügyi, gazdasági értelemben a tagállamok egymásrautaltságát, és kikényszerítette a szorosabb integrációt. Nincsen azonban hatékony gazdasági unió szorosabb politikai integráció nélkül. Az EU tehetetlensége az alapjogok védelmében kedvezőtlenül hat a gazdasági teljesítményre, és megkérdőjelezi az Unió hitelességét a nemzetközi kapcsolatokban is. Meggyőződésünk, hogy a Szerződés most is lehetővé teszi a jogállamiság és demokrácia rendszeres értékelését a tagállamokban, és rendszerszerű problémák esetén a hatékonyabb uniós beavatkozást is.

A nemzetközi szervezetek rendszeresen publikálnak olyan adatokat, mutatókat, amelyek az alapjogi ügynökség éves értékelésének alapjául szolgálhatnak. Az új koppenhágai mechanizmus kidolgozása azonban szükségessé teheti a szerződés módosítását is. Őszintén reméljük, hogy a hamarosan megszülető bizottsági közlemény minderre javaslatot tesz, és a Tanácsban is meglesz a politikai akarat ahhoz, hogy valóban érvényt szerezzünk az EU alapértékeinek.

Megismételné, hogy melyik országról beszélt képviselőtársam? Remélem, hogy ezúttal nem a saját hazáját gyalázta kivételesen, de egyúttal akkor már hadd kérdezzem meg, hogy sikerült-e kihevernie Önnek és társainak, hogy a Tavares-jelentésnek Magyarországgal kapcsolatban gyakorlatilag semmi következménye nem volt azon kívül, hogy nagyon megerősödött az Unió-ellenesség közös hazánkban?

  Kinga Göncz (S&D), Kékkártyás válasz. – Őszintén sajnálom, hogy Morvai képviselőasszony nem figyelt. Nem említettem országot, csak egy jelentésből idéztem. A Tavares-jelentésnek egyébként többek között a mostani Luis Michel-jelentés a folytatása, és őszintén remélem, hogy hamarosan az a jelentés is folytatása lesz, amelyet én fogok elkészíteni, és amelyik ugyanezzel a témával foglalkozik. Szükség van európai szintű kontrollra a demokrácia és a jogállamiság területén is, folyamatos ellenőrzésre és krízismechanizmusra is. Ennek a módjait keresi ez a jelentés is.

  Alajos Mészáros (PPE). - A Parlament ez évi állásfoglalása ismét számos problémára hívja fel a figyelmet az alapvető jogok védelme terén. Fontos, hogy beszéljünk az Unión belüli hiányosságokról, és a feltárt hibákat minél előbb orvosolni tudjuk. Nem mindegy viszont hogyan, milyen módszerekkel próbálunk majd a helyzeten javítani.

Az alapvető jogok tiszteletben tartásának értékelése során azokat az elveket és értékeket kell az Uniónak követnie, amelyeket a szerződések is magukba foglalnak, kiemelve, hogy közösségünk értékközösség, és ez áll az integráció középpontjában. Az értékközösség minden tagjától elvárt, hogy teljesítse az alapvető jogok és szabadságok garantálásával kapcsolatos kötelezettségeit. Mindez vonatkozik az uniós intézményekre és a tagállamokra egyaránt. A tagállamok értékelése során elsősorban azoknak a mechanizmusoknak a megfelelő kihasználására kell odafigyelni, amelyek már léteznek. A tagállamok jogállamisági szempontból történő vizsgálata és értékelése csakis tárgyilagos és minden tagállamra érvényes, és egységes szempontok alapján történhet meg ma és a jövőben is. A jogállamiság garantálása és az alapvető jogok tiszteletben tartása kell hogy legyen a célja minden unós szintű mechanizmusnak.

Az Európai Unióról szóló szerződés 2. cikkének felsorolásában szerepel a kisebbségekhez tartozó személyek jogainak tiszteletben tartása is. Ezen a téren az európai nemzeti, etnikai, nyelvi és kulturális sokféleség addig nem fog tudni teljesen érvényesülni, amíg nem születik megfelelő, átfogó uniós szabályozás, amely a történelmi és nyelvi kisebbségek alapvető jogainak védelmét mozdítja elő. Az uniós szinten megfogalmazott garanciák által egyszerűbbé válhat a tagállamokon belüli nemzeti kisebbségekkel szemben tapasztalt diszkrimináció kiküszöbölése.

Bár a jelentés a 2012-es évvel kapcsolatosan készült, azóta eltelt már egy év, amelyet az EU az uniós polgárok évének nyilvánított, jelezve ezzel is az uniós polgárság adta lehetőségeket. Az uniós polgárok alapvető jogaikkal akkor tudnak valóban élni, és akkor élvezhetik a szabad mozgás adta előnyöket, ha az egyenlő bánásmód elvét minden tagállam maradéktalanul érvényesíti majd velük szemben.

  Salvatore Caronna (S&D). - Signor Presidente, onorevoli colleghi, questa relazione sulla situazione dei diritti fondamentali nell'Unione europea costituisce indubbiamente un punto di riferimento molto importante e un punto di riferimento avanzato.

Io voglio sinceramente complimentarmi con il relatore Michel per il brillantissimo lavoro che ha saputo offrire a questo Parlamento. Infatti, in questa risoluzione sono contenuti in modo chiaro e forte, in tutti i campi, quali debbano essere i diritti fondamentali da garantire da parte di un'Unione europea che vuole essere all'avanguardia nel mondo sul terreno della democrazia e delle libertà, come è stato detto di un'Europa che ha l'ambizione di essere un esempio e una forza morale.

Tuttavia, la distanza tra ciò che dovrebbe essere e quello che effettivamente si verifica nei paesi dell'Unione in termini di rispetto di questi diritti è spesso molto grande. Basti pensare ai diritti delle donne, al rispetto delle differenze sessuali ma anche alla libertà di pensiero, di associazione, di politica e culturale. Per non dire poi di quello che riguarda i mezzi d'informazione, condizionati in modo sempre più forte da poteri economici e finanziari che stanno soffocando la libertà d'informazione in molti paesi.

Dunque è fondamentale che questa risoluzione vada avanti, venga approvata e dia i poteri a partire dal Parlamento europeo a tutte le istituzioni per poter fare un salto in avanti molto importante verso tutta l'opinione pubblica.

  Carlos Coelho (PPE). - Senhor Presidente, Senhora Vice-Presidente Reding, caras e caros Colegas, para a grande maioria de nós, a União Europeia é sobretudo uma União de valores comuns a todos os Estados-Membros, que estão no cerne da identidade da União e permitem que todos os cidadãos com ela se identifiquem: o respeito pela dignidade humana, pela democracia, pela igualdade, pelo Estado de direito e pelos direitos humanos.

O respeito por estes valores constitui uma condição imprescindível para que qualquer Estado possa pertencer à União. A ação da União e dos seus Estados-Membros deve ser irrepreensível em matéria de direitos fundamentais. Por isso, é necessário promover e reforçar uma verdadeira cultura dos direitos fundamentais, não apenas nas instituições da União, mas também nos Estados-Membros.

Demos passos importantes ao incluir os artigos 2.º, 6.º e 7.º do Tratado da União, ao tornar a Carta dos Direitos Fundamentais juridicamente vinculativa, ao tornar a promoção dos direitos fundamentais da União uma das prioridades para o futuro do espaço de liberdade, segurança e justiça, e ao confirmar, ao colocar os direitos humanos no centro da ação externa da União.

Muitas vezes usamos esta Casa, justa e oportunamente, para defender um maior respeito pelos direitos humanos no resto do mundo. O facto de, ao contrário de outros, procedermos à análise do grau do respeito desses mesmos direitos no espaço da União e de não prescindirmos de os querer ver reforçados sublinha a nossa credibilidade nesta luta.

Cumprimento o relator Louis Michel pelo trabalho que produziu. Não subscrevo todos os pontos do seu relatório, mas reconheço que, globalmente, ele cumpre o objetivo de nos responsabilizar no sentido de um melhor respeito pelos direitos fundamentais. Os direitos humanos constituem direitos de cada pessoa. O respeito por esses direitos é uma exigência da nossa civilização, que devemos valorizar e legar às gerações vindouras, sem qualquer espécie de distinção com base na raça, cor, sexo, língua, religião, opinião política ou outras convicções. A sua proteção deve ser absoluta e em caso algum poderão ser encontradas desculpas ou invocadas razões de segredo de Estado para limitar a obrigação dos Estados de protegerem esses direitos e investigarem e porem cobro a eventuais violações.

  Anna Hedh (S&D). - Herr talman! Till skillnad från EPP:s urvattnade version, tycker jag att det här betänkandet är en bra genomgång av hur situationen såg ut för grundläggande rättigheter i EU 2012. Det innehåller ett flertal bra delar av sexuella och reproduktiva rättigheter, mediemångfald, romers situation, asylsökandes rättigheter och rättigheter för hbt-personer. Det har också ett ovanligt starkt fokus på fackliga och sociala rättigheter, vilket gläder mig mycket som socialdemokrat.

Som föredragande för EU:s människohandelslagstiftning uppskattar jag också uppmaningen till medlemsstaterna som ännu inte implementerat direktivet full ut att göra det.

Tyvärr innehåller betänkandet mycket problematiska skrivningar om narkotikapolitiken i punkt 105. Den här punkten känns väldigt märkligt placerad i ett betänkande om grundläggande rättigheter. Den framför väldigt svepande och oklar kritik, och saknar helt grund i fakta om hur drogsituationen ser ut i medlemsstaterna.

Med tanke på det oerhörda lidande och skador som narkotika skapar, kan målet för mig aldrig vara något annat än ett samhälle helt fritt från narkotika. Därför kommer jag att rösta nej till den punkten.

  Csaba Sógor (PPE). - Őszintén üdvözlöm Luis Michel képviselőtársam jelentését, amely végre kimondja azt, amit eddigi európai parlamenti munkám alatt végig szorgalmaztam. A hagyományos nemzeti kisebbségek, a regionális nyelvi csoportok és az autonóm régiók vonatkozásában átfogó uniós szintű védelmi rendszerre van szükség, amelyhez működőképes nyomon követési mechanizmus kapcsolódik. A jelentés rávilágít arra a tényre is, hogy a nemzeti kisebbségek védelmét nem lehet egyszerűen az idegengyűlölet és a megkülönböztetés elleni küzdelem révén megvalósítani, hanem ehhez konkrét jogi, nyelvi, kulturális, szociális rendszereket és eljárásokat kell alkalmazni.

Külön kiemelném, hogy a szövegben arra is utalást találunk, amit az általam képviselt közösség tagjai pontosan tudnak. A mindennapi életben e kisebbségi közösségek tagjai akadályokba ütköznek az igazságszolgáltatás, az egészségügyi és szociális ellátás, oktatás és kultúra területén, aminek következtében sérülnek jogaik és európai uniós polgári méltóságuk, ami olyan helyzetek kialakulásához vezet, amelyekben saját tagállamuk nemzeti hatóságai másodrendű állampolgárokként kezelik őket.

Meggyőződésem, hogy ennek a jelentésnek az elfogadása mérföldkőnek számít, hiszen felkéri a Parlament a Bizottságot, hogy hozzon létre szakpolitikai normát a nemzeti kisebbségek, köztük az őshonos, hagyományos nemzeti és nyelvi kisebbségi közösségek védelmére, tekintettel arra, hogy ezek létszáma meghaladja az Unió összlakosságának 10%-át. Ezzel elkerülve a tagjelölt országok és tagállamok közötti különbséget tevő kettős mérce alkalmazását.

A tagállamok felé is fontos kéréssel fordul a jelentés. A tényleges egyenlőség előmozdítására vonatkozó intézkedések meghozatalát, valamint a nemzeti kisebbségek alapvető jogainak megsértésével kapcsolatos esetekről szóló átfogó adatok rendelkezésre bocsátását kéri a 28 tagállamtól. Ennek a jelentésnek az elfogadásával az Európai Parlament nem tesz mást, mint ami a szerződésekben meghatározott feladata: megjeleníti az európai polgárok érdekeit.

  Josef Weidenholzer (S&D). - Herr Präsident! Die öffentliche Debatte um den Bestand der Grundrechte ist ein wichtiger Bestandteil unserer Arbeit. Und weil die Grundrechtecharta ein wesentlicher Eckpfeiler des europäischen Projekts ist, brauchen wir meiner Ansicht nach diese Debatte. Wir brauchen aber auch einen Mechanismus, damit es nicht nur bei einer Debatte bleibt.

Ich finde es sehr positiv, dass der Aspekt des Datenschutzes in mehreren Bereichen aufgegriffen wird, weil die Grundrechtecharta dem Schutz personenbezogener Daten eine besondere Bedeutung zumisst. Seit dem letzten Grundrechtebericht haben sich in Bezug auf den Datenschutz wichtige Dinge ereignet, im negativen und im positiven Sinn. Die Enthüllungen Edward Snowdens haben deutlich gemacht, dass diese Rechte – Grundrechte wohlgemerkt – tagtäglich systematisch und massenhaft und ohne Rechtsbasis verletzt werden. Das ist ein Skandal epochalen Ausmaßes. Good news ist freilich, dass das Europäische Parlament bereit und in der Lage war, Konsequenzen zu ziehen. Es hat im Oktober mit großer Einheitlichkeit ein richtungsweisendes Datenschutzpaket verabschiedet, und es hat auch im LIBE-Ausschuss eine wirklich beispielhafte Aufarbeitung dieser Vorkommnisse gegeben.

Leider hat der Rat nicht dieselbe Konsequenz an den Tag gelegt. Die Bürgerinnen und Bürger hätten es verdient, ernstgenommen zu werden. Eine Verabschiedung des Datenschutzpakets vor den Wahlen im Mai hätte Handlungsfähigkeit gezeigt. Wir brauchen also nicht nur gute Berichte, sondern wir brauchen auch eine kohärente Politik!

  Frank Engel (PPE). - Monsieur le Président, j'aimerais commencer par remercier également le rapporteur Louis Michel pour son projet de rapport. Tous ceux qui, comme moi, ont eu le plaisir de le voir à l'œuvre, quand, en tant que, Président de l'Assemblée paritaire ACP-UE, il essayait de convaincre un parterre de dirigeants africains dignes, mais pas très réceptifs à un certain nombre d'idées, de la nécessité de reconnaître, en fin de compte, les droits des personnes homosexuelles. Par exemple, je sais avec combien de cœur Louis Michel s'occupe de ces choses et, également, je suppose, quelles valeurs le guident.

J'ai beaucoup entendu par parler de valeurs, tout récemment, dans ce débat. Je vais vous dire ceci: l'une de mes valeurs essentielles et principales, en politique du moins, est que l'on ne prenne pas l'État en otage pour faire en sorte que les constitutions deviennent des copies conformes de programmes électoraux. Je constate, hélas, que dans un nombre croissant de pays membres, gouvernés d'ailleurs par toutes sortes de configurations de coalitions – ce n'est pas l'apanage de la gauche, ni d'ailleurs celui de la droite. On voit se développer une tendance à faire en sorte que la constitution reflète les convictions personnelles et intimes des gouvernants du moment. Il s'agit là d'une atteinte flagrante au principe de l'impartialité de l'État – cette impartialité qui, seule, en fin de compte, peut garantir le respect constant et immuable des droits des citoyens. Et tant que cette tendance persistera dans l'Union européenne, où que cela se passe, il faudra, avec la plus haute urgence, que nous menions des débats comme celui-ci, et que nous adoptions des rapports comme celui de mon collègue, et néanmoins ami, Louis Michel.

  Elena Băsescu (PPE). - Ar fi fost de dorit să fi avut un mecanism care să supravegheze respectarea criteriilor de la Copenhaga în vara lui 2012, când alianța socialistă a dat lovitura de stat în România.

Este necesar acest mecanism, în special, în ţările în care puterea politică încalcă statul de drept din cauza unor interese meschine, de cele mai multe ori oculte şi imorale. Ceea ce s-a întâmplat în România ne demonstrează faptul că democraţia nu este un concept ireversibil. Desigur, riscul unor derapaje este asociat în special statelor membre noi, însă trebuie să fim onești că nici statele membre vechi nu sunt la adăpost, iar acest lucru este demonstrat de raportul general anticorupţie. Sper că mesajul pe care îl trimite Parlamentul European în această seară să fie receptat de majoritatea socialistă de la București. Ei trebuie să înţeleagă că parcursul european depinde de respectarea statului de drept. Încălcarea criteriilor de la Copenhaga, în mod repetat, ar putea să ducă la sancţiuni la adresa României, în special în ceea ce priveşte fondurile europene. Premierul Victor Ponta şi ai săi, părăsiți aseară și de liberalii care le mai spălau imaginea în lume, trebuie să bage bine la cap că Uniunea nu va ezita să ne sancţioneze, dacă ei vor continua să încalce Constituția, să-i apere pe corupţi şi să paraziteze instituţiile statului.

  Andrej Plenković (PPE). - Gospodine potpredsjedniče Karas, poštovana gospođo Reding povjerenice, poštovani kolega Michel, vi ste izradili jedno vrlo sveobuhvatno izvješće koje se odnosi na stanje temeljnih prava u Europskoj uniji, gdje smo nakon stupanja na snagu Lisabonskog ugovora i s pravno obvezujućom Poveljom o temeljnim pravima ušli u jednu novu, kvalitativno višu fazu zaštite temeljnih prava u Europskoj uniji.

U pogledu niza elemenata koje ste spomenuli, smatram da je jako dobro da 5 godina djelovanja Agencije Europske unije za temeljna prava pokazuje jedan dobar signal i izvor objektivnih i pouzdanih podataka o stanju temeljnih prava na razini Europske unije i dobro je da je Hrvatska bila uključena i prije nego što je postala članica. Ono što mi se čini posebno zanimljivim u vašem izvješću je ovaj segment koji poziva na osnivanje svojevrsnog mehanizma koji bi emancipirao Kopenhagenske kriterije za države članice, 21 godinu nakon što su oni bili postavljeni kao temeljne vrijednosti na kojima je Unija osnovana kao kriteriji za članstvo.

Hrvatska je praktički živjela 20 godina da ispuni te kriterije. Zanimljiva je bila odluka Europske unije da na temelju naučenih lekcija iz mehanizma praćenja obaveza za Bugarsku i Rumunjsku ne bude post-monitoringa za Hrvatsku. Sada je na stolu jedan prijedlog koji ide prema svima, dakle erga omnes, i mislim da tu moramo paziti da ne bude duplikacije s Europskim sudom za ljudska prava i s Vijećem Europe i da prijedlog Komisije koji dolazi u ožujku bude vrlo elaboriran u pogledu obveznosti ovog mehanizma.

  Iosif Matula (PPE). - Deși cetățenia europeană conferă o serie de drepturi fundamentale locuitorilor Uniunii, constatăm că există încălcări ale democrației, statului de drept și ale drepturilor cetățenești. Susțin importanța sancționării tuturor acestor derapaje, indiferent că vorbim de membri mai noi sau mai vechi ai UE. În unele state, spre exemplu, cetățenilor le este încălcat dreptul la libertatea de mișcare și ședere, concomitent cu încălcarea dreptului fundamental la muncă. Este un fapt îngrijorător, care afectează și cetățeni din țara mea, România, și contravine drepturilor fundamentale și legislației Uniunii, iar aceasta fără ca UE să sancționeze imediat practicile discriminatorii. Închei prin a-mi exprima îngrijorarea cu privire la o altă comunitate, stigmatizată de multe ori pe baza stereotipurilor etnice în țări cu o îndelungată tradiție democratică: comunitățile de romi din Europa sunt evacuate forțat și relocate, fără a li se oferi o alternativă viabilă, în condițiile în care toți declarăm public sprijinul pentru integrarea acestei populații.

  László Tőkés (PPE). - Elnök úr! Az előző években az alapvető jogok és a jogállamiság megsértése miatt az Európai Parlament ismételten súlyos elmarasztalásban részesítette Magyarországot. Nagy megdöbbenésünkre tavalyi jelentésében az Európai Alapjogi Ügynökség Görögország mellett szintén a magyarországi emberi jogi helyzetet pellengérezte ki. Ugyanezt a pártos egyoldalúságot tapasztaljuk Luis Michel alapjogi jelentésében, amikor is nevesített módon Litvániát és Magyarországot részesíti megrovásban. A balliberális politikusoknak végre fel kellene hagyniuk a szelektív elbírálás, valamint a kettős mérce alkalmazásával, és példának okáért a posztkommunista Szlovákia vagy Románia esetében is hasonló következetességgel kellene védelmükbe venni a hagyományos etnikai kisebbségeket, köztük a súlyos diszkriminációt szenvedő magyarok alapvető jogait.

  Viviane Reding, Vice-President of the Commission. - Mr President, the debate shows that we have triggered a process of awareness-raising about fundamental rights across the EU. This awareness has led to a tangible improvement in the fundamental rights situation in many of our Member States. But as the rapporteur and the speakers have rightly pointed out, work remains to be done.

The Commission is doing its part of the work on a number of projects to guarantee respect for fundamental rights. Very soon we will receive the 2013 report on the application of the EU Charter of Fundamental Rights and, as I told you in my introduction, after the debate the College had yesterday on a rule of law mechanism, we will also present a proposal concerning this problem.

  Louis Michel, rapporteur. - Monsieur le Président, Madame la Commissaire, tout d'abord, merci beaucoup, Madame la Commissaire, pour votre ouverture de vues et surtout pour votre disponibilité, qui fut totale pendant toutes les discussions sur ce rapport.

Je ne vais pas répondre à certaines outrances obscurantistes que j'ai entendues ici. On me fait un véritable procès en sorcellerie, notamment Mme[nbsp ]Záborská et M.[nbsp ]Allam. Je ne répondrai pas à cela.

Quelques considérations rapides: je reste persuadé, comme mon collègue Engel, de l'importance, évidemment, de l'impartialité de la puissance publique dans tous nos États. Il s'agit de l'un des fondements mêmes des valeurs européennes, qui est d'ailleurs traduit juridiquement dans des obligations. Je crois qu'il est important de le rappeler.

Enfin, je ne comprends pas pour quelle raison on refuse d'avoir une évaluation annuelle État par État. Il s'agit essentiellement d'indiquer, dans chaque État, les progrès qui restent à faire. On n'est pas dans la dénonciation; c'est simplement une évaluation qui permet d'encourager, d'aménager, de corriger, aussi, un certain nombre de tirs. Je crois, en effet, que le problème des droits fondamentaux en Europe ne sera jamais véritablement réglé. C'est, évidemment, un processus évolutif.

Je voudrais quand même dire le plaisir que j'ai eu à entendre M.[nbsp ]Coelho, ainsi que Mme[nbsp ]Bauer –[nbsp ]même si nos divergences existent, je ne les nie pas. Je tiens à dire que Mme[nbsp ]Bauer, en tant que rapporteure fictive, a fait preuve de beaucoup de créativité, de beaucoup de bonne volonté pour essayer de faire avancer le dossier. Ce n'est évidemment pas le cas de positions aussi caricaturales –[nbsp ]et je lui renvoie le qualificatif[nbsp ]– et idéologiques que celles que j'ai entendues dans la bouche de Mme[nbsp ]Mathieu. Il est caricatural de dire que j'ai eu une position idéologique. Non, j'essaie simplement de capter tout ce qui ne va pas un peu partout en Europe afin, à partir de là, de nous forcer, nous tous, à nous poser les bonnes questions.

J'espère simplement que, demain, on aura une majorité significative pour réussir à faire avancer d'un pas important la défense et la protection des droits de l'homme.

Je remercie tous les rapporteurs fictifs, qui ont participé et contribué très positivement à ces discussions.

  Cristian Dan Preda (PPE), în scris. Sunt rareori în dezacord cu grupul meu politic, dar azi am fost. Am susținut Raportul Louis Michel și mai ales propunerile vizând instituirea unui mecanism împotriva statelor membre ce nu respectă drepturile fundamentale și valorile UE prevăzute în articolul 2 din Tratat după aderare (noul mecanism Copenhaga). Raportul oferă indicații clare asupra parametrilor care ar trebui să definească acest mecanism, inclusiv faptul că trebuie să fie bazat pe criterii uniforme și obiective de evaluare a situației drepturilor omului și a statului de drept din țările membre. Textul propune și instituirea unor sancțiuni eficace și proporționale, printre care suspendarea temporară a finanțărilor, în cazul încălcării valorilor și drepturilor fundamentale ale Uniunii. După cum au dovedit-o evenimentele din România din vara anului 2012, sau mai recent, tentativele de modificare a Codului penal, un astfel de mecanism este necesar pentru că nu sunt deloc excluse derapaje în privința drepturilor fundamentale și a respectării statului de drept. Este în același timp un semnal foarte clar către majoritatea socialistă de la București că Europa nu va sta cu brațele încrucișate dacă aceste derapaje se vor reproduce. Suntem membri ai Uniunii și cred că a venit în sfârșit momentul să ne comportăm ca atare.

  Valdemar Tomaševski (ECR), raštu. Pone Pirmininke, Europos Sąjungoje ir kai kuriose valstybėse narėse vis dar yra daug pagrindinių teisių pažeidimų atvejų, tai įrodo Europos Komisijos ataskaitos. Visi Europos Sąjungos piliečiai privalo turėti garantuotas pagrindines laisves. Tautinių mažumų ir tautinių bei regioninių kalbų apsauga išplėstoje Sąjungoje šiandien kelia pagrindinę problemą, nes, neskaitant pasirašytų konvencijų, kai kuriose šalyse yra kovojama su daugiakalbyste. Ataskaitoje keliama daug svarbių aspektų, vertų pritarimo. Pavyzdžiui, kvietimas uždrausti asmenų, priklausančių tautinėms mažumoms, diskriminaciją ir pradėti kovą su kalbų diskriminacija. Pranešėjas išreiškė susirūpinimą, kad mažumų bendruomenės nariai susiduria su kliūtimis teisingumo, edukacijos ir kultūros srityse, ir dėl to yra pažeidžiamos jų teisės. Be to, savo gimtosios valstybės valstybinėse institucijose jie yra traktuojami kaip antrarūšiai piliečiai. Pranešimo autorius teisingai ragina valstybes nares rūpintis, kad asmenys, priklausantys tautinėms mažumoms, nebūtų diskriminuojami šalies teisės sistemoje. Taip pat ragina priimti tinkamas priemones, turinčias skatinti atitinkamus tarptautinius standartus, pagrįstus Europos Tarybos Tautinių mažumų apsaugos pagrindų konvencija. Ir, kas svarbiausia, paragino Komisiją sukurti politinius standartus, skirtus tautinių mažumų apsaugai, įtraukiant autochtonines ir kalbines bendruomenes, atsižvelgiant į tai, kad jos sudaro virš 10[nbsp ]% ES gyventojų. Pabrėžė, kad būtina kompleksinė sąjunginė tradicinių tautinių mažumų, regioninių kalbų grupių apsaugos sistema, kartu su jos funkcijas stebinčiu mechanizmu.
