  President. - The next item is the report by Barbara Weiler, on behalf of the Committee on the Internal Market and Consumer Protection, on the proposal for a directive of the European Parliament and of the Council on the harmonisation of the laws of the Member States relating to the making available on the market of radio equipment (COM(2012)0584 – C7-0333/2012 – 2012/0283(COD)) (A7-0316/2013).

  Barbara Weiler, Berichterstatterin. - Herr Präsident, liebe Kolleginnen und Kollegen! Ich freue mich, dass wir heute doch noch zu dieser Debatte kommen, weil es meine letzte Rede in dieser Legislaturperiode und außerdem mein letzter Bericht für den Binnenmarktausschuss sein wird.

Ich möchte hinzufügen, es ist auch ein Highlight für mich, denn dieses tolle Ergebnis, das wir erreicht haben, konnten wir nicht von vornherein erwarten. Ich möchte auch allen Schattenberichterstattern herzlich danken. Ohne unseren Zusammenhalt hätten wir nicht diese zukunftsweisende Vereinbarung mit dem etwas zögerlichen Rat vorlegen können. Der COREPER hat bereits am 17.[nbsp ]Januar zugestimmt, der IMCO-Ausschuss ebenfalls und morgen bitte ich um das Votum des gesamten Europäischen Parlaments.

Ein scheinbar kleines Detail ist in den Medien zum großen Hit geworden, nämlich das einheitliche Ladegerät für Handys und andere kleinere Geräte. Und die öffentliche Zustimmung ist auch berechtigt. Es geht um Bürokratieabbau und – vielleicht noch wichtiger – um Müllvermeidung. Mehr als 50[nbsp ]000 Tonnen Elektromüll fallen bisher jährlich an. Das wird demnächst ein Ende haben.

Es gibt auch eine pikante Vorgeschichte. Bereits Kommissar Verheugen und Kommissar Tajani haben sich bemüht, eine Regelung für einheitliche Ladegeräte zu finden. 2009 gab es dann mit 14[nbsp ]führenden Herstellern eine freiwillige Vereinbarung, die aber nur bis Ende 2012 hielt. Darum haben wir, die Abgeordneten, die Initiative ergriffen. Und das ist auch gut so.

Ich erwarte nun eine konstruktive Zusammenarbeit von den Herstellern mit der Kommission, mit dem neuen Parlament, um neue innovative Lösungen zu finden. Und ich appelliere hier an die Kollegen und Kolleginnen, die vielleicht nach der Wahl wiederkommen, den Fortgang ganz genau zu beobachten, denn sicher müssten die Mitgliedstaaten Interesse an dieser Lösung haben, aber ich vertraue eigentlich mehr den Abgeordneten, dass sie das zu einem vernünftigen Ende bringen.

Mobile Kommunikation hat auch in Zukunft ein großes Potenzial. Das haben wir auch in den Debatten eben gehört. Aber umso wichtiger ist die störungsfreie Anwendung. Und ich will einige weitere Ergebnisse aufzählen, die wir erreicht haben, und die ja auch nicht unerheblich sind. Zum einen der Schutz der Verbraucher: Die Verbraucherorganisationen werden in Zukunft bei der regelmäßigen Evaluierung umfassend einbezogen.

Wir haben eine Modernisierung dieses Gesetzes erreicht mit Anpassung an andere bestehende Richtlinien. Es ist ein effizientes Instrument, um Störungen zwischen verschiedenen Geräten zu verhindern. Wir haben eine effizientere Marktüberwachung erreicht, um die Produktgruppen, die negativ auffallen, auch leichter überprüfen und zentral registrieren zu können. Wir haben eine vereinfachte gemeinsame Regel zur Konformitätserklärung. Dazu muss man erwähnen, dass zum Teil bisher nur 30[nbsp ]bis 50[nbsp ]% Konformität festgestellt werden können.

Die neue Regelung ist auch für die KMU eine große Vereinfachung. Wir haben grundlegende Sicherheitsanforderungen in diesen Entwurf eingebracht, ebenso wie Gesundheitsschutzforderungen, denn viele Bürger haben sich schon wegen der zunehmenden elektronischen Anwendungen und Möglichkeiten auch Sorgen um den Gesundheitsschutz gemacht. Mit diesem Gesetz werden wir aber auch – und das ist auch unser Anliegen im Binnenmarkt-Ausschuss – die Wettbewerbschancen der europäischen Elektronikindustrie erheblich verbessern. Also eine klare Win-win-Situation!

  Neelie Kroes, Vice-President of the Commission. - Mr President, allow me first to thank Parliament for its constructive role, which has enabled an agreement on a proposal for a radio equipment directive. In this context I would like to thank the Committee on the Internal Market and Consumer Protection and in particular its Chair Malcolm Harbour – and, of course, the rapporteur, Ms[nbsp ]Weiler.

The number of mobile devices and wireless applications has grown spectacularly over recent years and continues to show enormous potential for further innovation and expansion. However, the sustained growth also creates a new risk of interference between the various devices on the market. Examples of non-critical interference include disturbance in commercial radio reception or reduced speed of internet access through radio local area networks.

More critical interference may affect manufacturing processes or even the safety of live services such as aeronautical, navigation and public protection services. To enable this sector to further expand we need to ensure increasingly efficient use of the limited resource which is radio spectrum and to strengthen confidence among producers and users in our regulatory framework.

This is why the Commission proposed revising the Directive on Radio Equipment and Telecommunications Terminal Equipment, which establishes a framework for the placing on the market and putting into service of those products. The proposal aims to make sure that all market players comply with the rules for the avoidance of interference.

The Commission also proposed that the directive be clarified and simplified to facilitate its application to some specific cases and eliminate unnecessary burden. The text which you are going to vote on tomorrow includes very positive changes in those areas.

Firstly, clear and harmonised obligations for manufacturers, importers and distributors which make the overall regulatory framework more consistent and easier to apply, with lower costs, especially for small and medium-sized enterprises.

Secondly, improved instruments for market surveillance, in particular the traceability obligations and the possibility of requiring prior registration of radio equipment within the categories affected by low levels of compliance.

I know this point has raised some controversy. Some people consider that systematic registration of all radio equipment, as is practised for example in the US, was a solution to low levels of compliance, while others consider that such an obligation meant an unjustified additional burden. I believe that, with the amendments introduced during the interinstitutional discussions, it is clear that this instrument is to be used as a measure of last resort to target specific categories of products, and that therefore it is proportionate.

Thirdly, deletion of unnecessary administrative obligations such as the prior notification of radio equipment using non-harmonised frequency bands.

Last but not least, I would like to refer to the possibility of requiring certain categories of radio equipment to be interoperable with accessories such as chargers. You know that our action to ensure that mobile phones are compatible with a common charger has been welcomed by EU citizens, and I would like to thank you again for your support. The Commission has launched a study to assess options for follow-up, including a new voluntary industry agreement and legally-binding measures which become possible on the basis of the radio equipment directive.

Another area where interoperability is of concern is access by mobile phones to Galileo, which improves the accuracy and reliability of many services, including emerging services. The directive provides the legal base to require such interoperability.

Mr President, the dialogue with Parliament and the Council has allowed us to reach a good compromise which supports further innovation and growth.

  Wim van de Camp, namens de PPE-Fractie. – Voorzitter, het is hier wel van toepassing is "hoe later op de avond, hoe schoner volk". Het is een heel pittig technisch onderwerp. We hebben dan ook geen camera's, we hebben geen pers en het gaat hier om de kern van de interne markt. Als je nu één ding wil zeggen van de Europese Unie, dan is het wel een werkende interne markt met enorme voordelen voor de consumenten en de producenten.

Dit is een technische richtlijn. Toen ik het schaduwrapporteurschap hiervan kreeg, had ik niet de indruk dat ik de oorkonde in de Orde van Leopold van België kreeg, maar dat ik met mevrouw Weiler en meneer Malcolm Harbour een zeer technisch onderwerp mocht behandelen. En het is voor mij eigenlijk wel een grote eer – ik heb nog nooit 'Barbara' gezegd tegen mevrouw Weiler – dat ik nu hier aanwezig mag zijn bij haar laatste speech.

Voorzitter, minder regeldruk, meer duidelijkheid en ook meer juridische zekerheid, zowel voor de producenten als voor de consumenten. Die hele radioapparatuur is een grote markt, met veel onzekerheden, veel bureaucratische verplichtingen. We hebben geprobeerd dat op basis van het voorstel van de Commissie te vereenvoudigen. En er komt geen algemene registratieplicht voor radioapparatuur, alleen de risicogebieden. De radioamateurs zijn vrijgesteld, en ook het wetenschappelijk onderzoek.

Maar inderdaad de kers op de taart is wel de algemeen toepasbare opladers. Dat zal de burgers het meest interesseren. Want ik weet niet of u een Apple[nbsp ]4 heeft of een Apple[nbsp ]5, maar als het een beetje tegenzit, twee verschillende oplaadapparatuur. En dat wordt nu aanmerkelijk verbeterd.

  Catherine Stihler, on behalf of the S&D Group. – Mr President, I would like to start off by congratulating our rapporteur for all her hard work and for persevering with the trilogue negotiations, and also to put on record how much I have enjoyed working with Barbara Weiler. This might be your last report, Barbara, but your legacy will live on, as will Malcolm Harbour’s, and I think tonight’s report on common chargers is particularly significant.

This year, for the first time ever, mobile internet usage has exceeded internet usage on desktop computers. Currently over 500 million mobile phones are being used in the EU, and this number is growing constantly. This creates risks of interference between various products, and therefore an efficient use of radio spectrum is essential. I welcome the introduction of a common charger, which will simplify the use of radio equipment as well as reducing unnecessary waste and cost to consumers.

Each year, incredibly, the EU throws away 6[nbsp ]000 tonnes of mobile phone chargers, and when I think about this I wonder how much we – Parliament and the offices that many of us use – are contributing to that waste, and not from our own choice. Not only is this inconvenient, wasteful and completely unnecessary, it does not suit the needs of consumers of today who seek a faster and better use of technology. By reducing the number of obsolete phone accessories we will be able to cut down on the amount of electronic waste.

Therefore this report is a success not only for the single market and consumers but also for cutting waste and protecting the environment. It may be, as Mr van de Camp said, that there are not very many people in the Chamber this evening, but the fact is that, although this report may be last on the agenda, its significance is so important and your legacy, Barbara, lives on.

  Andreas Schwab (PPE). - Herr Präsident! Ich behalte vier Punkte in Erinnerung. Erstens: Ich sollte den Kollegen Wim van de Camp für den Leopold-Orden von Belgien vorschlagen. Ich weiß nicht, ob ich in der Lage bin, für die EVP diesen Vorschlag zu unterbreiten. Aber ich werde das dringend prüfen, denn ich glaube, er hat als Schattenberichterstatter hervorragende Arbeit geleistet.

Zweitens: Ich möchte ganz ausdrücklich Frau Kollegin Barbara Weiler für ihre – nicht nur bei diesem Bericht – außerordentlich konstruktive und jederzeit unideologische Arbeit danken, die sie in diesem Ausschuss in den letzten Jahren immer geleistet hat, und wo wir immer auch fraktionsübergreifend außerordentlich gut im Gespräch bleiben und zusammenarbeiten konnten. Dafür möchte ich ihr ganz herzlich danken, auch im Namen meiner Fraktion. Ich kann ihr versprechen, dass wir ihrem Wunsch folgen und das Erbe dieses Berichts mit einheitlichen Ladegeräten und anderen technischen Details im Auge behalten werden.

Drittens möchte ich nochmals darauf hinweisen, dass ich als Vertreter des Wahlkreises Schwarzwald und Schwäbische Alb natürlich Sahnehäubchen von Schwarzwälder Kirsch-Torten sehr gut kenne. Wenn das tatsächlich die Spitze dessen ist, was wir mit dieser Richtlinie erreichen, dann muss es wirklich etwas ganz Besonderes sein. Bei uns wird dann normalerweise noch ein Schuss Schnaps mit in den Kuchen gegeben. Das sollten wir heute Abend vielleicht nicht tun.

Insgesamt ist es ein sehr gelungener Bericht. Deswegen der Berichterstatterin und den Schattenberichterstattern ein herzliches Dankeschön!

  Sergio Gaetano Cofferati (S&D). - Signor Presidente, onorevoli colleghi, voglio anch'io unirmi ai ringraziamenti alla collega relatrice, perché quello che Barbara Weiler ha fatto è molto importante. Nel lavoro di ciascuno di noi, conta sempre quel che si fa, in merito alle cose che proponiamo, ma conta molto anche come lo si fa. E Barbara Weiler ci ha dato un esempio importante di stile nel lavoro. Sarà questa la sua ultima relazione, ma che lei sia qui ad argomentare con la passione di sempre come ha fatto, credo che sia un bellissimo segnale per tutti noi.

Poi, credo che il lavoro che lei e i relatori ombra hanno svolto sia doppiamente significativo. Da un lato c'è questa cosa già commentata da molti, ma che vale tantissimo, apparentemente scontata ma che in verità non lo era mai stato, quello cioè di arrivare a definire che per tutta questa strumentazione, dai telefonini agli smartphone, ai tablet, alle videocamere, si avrà da qui in avanti un caricatore comune. È una semplificazione enorme, molto importante per tutti i consumatori, sia dal punto di vista della praticità dell'uso di questi strumenti, sia da quello dei costi. Ovviamente c'è una riduzione assai importante dei costi di ciò che verrà reso disponibile dalla tecnologia e dalle aziende da qui nel futuro.

Ma vorrei sottolineare anche – perché lo considero altrettanto significativo – il risultato che avremo contro lo spreco dei materiali elettrici. Noi parliamo spesso di economie che devono crescere rispettando l'ambiente e dunque che devono essere compatibili con il mondo nel quale poi noi e le generazioni che verranno siamo chiamati a vivere. Però, poi a volte ci dimentichiamo degli atti concreti, dei fatti apparentemente piccoli ma molto significativi, anche per l'efficacia che hanno. I materiali elettrici sono materiali spesso inquinanti, sono materiali che hanno un valore, non disperderli e recuperarli è un passo in avanti nella direzione dello sviluppo sostenibile che tante volte abbiamo auspicato.

  Zuzana Roithová (PPE). - Pane předsedající, paní komisařko, jde o směrnici, která souvisí s harmonizačním balíčkem deseti směrnic, kterým zavádíme konečně do praxe moderní horizontální pravidla pro uvádění výrobků na trh.

Já si nesmírně vážím práce zpravodajky Weilerové a oceňuji její pečlivost a důslednost, protože zapracovala do toho nového textu předpisů pro dodávání rádiových zařízení na trh také další návrhy na odstranění zbytečné administrativní zátěže a naopak navrhla posílení interoperability rádiových zařízení a jejich příslušenství.

Chci se silně postavit za zavedení jednotné nabíječky a podporuji v tom kolegyni Weilerovou. Samozřejmě víme, že by to zjednodušilo využívání rádiových zařízení, např. mobilních telefonů, tabletů atd., že by to snížilo množství nebezpečného elektrického odpadu a že by to také mělo vést ke snížení nákladů. Takže občané Evropské unie by to bezpochyby nesmírně ocenili.

Je otázkou, jestli dokážeme ty pozitivní výsledky naší práce svým způsobem prodat. Je to zejména na vás poslancích, kteří budete znovu kandidovat. Já jsem chtěla ještě říct, že také velmi blahopřeji paní Weilerové k úspěšnému zdolání trialogu, zejména proto, že si také zakusila ten problém s řešením komitologie, který provázel můj balíček deseti směrnic. Takže děkuji za to, že jsme tady balíček po těch deseti letech dokončili, protože už v roce 2006 jsme přijali Goods package a teprve nyní, pokud jde o tuto směrnici teprve za další dva roky, budou ty myšlenky a vize, na kterých jsme se tady shodli, realizovány.

  Silvia-Adriana Ţicău (S&D). - Domnule președinte, Directiva 1999/5/CE stabilește un cadru de reglementare pentru introducerea pe piață, libera circulație și punerea în funcțiune în Uniune a echipamentelor hertziene și a echipamentelor terminale de comunicații. Consider că este important ca, prin noua directivă, să se asigure clarificarea și simplificarea directivei existente, inclusiv unele adaptări limitate ale domeniului de aplicare, astfel încât să faciliteze aplicarea acesteia și pentru a elimina poverile inutile pentru agenții economici și autoritățile publice.

Subliniez faptul că utilizarea eficientă a spectrului de frecvență radio pe baza celor mai avansate tehnologii ar trebui să fie asigurată, astfel încât să se evite producerea de interferențe. Interoperabilitatea între echipamentele radio și accesorii, precum încărcătoarele, simplifică utilizarea echipamentelor radio și reduce deșeurile și costurile inutile.

Susțin necesitatea dezvoltării unui încărcător universal pentru anumite categorii de echipamente radio, în special pentru telefoanele mobile și tabletele care sunt introduse sau puse la dispoziție pe piață și care ar trebui să fie compatibile cu un încărcător universal care permite interoperabilitatea.

Catch-the-eye procedure

  Malcolm Harbour (ECR). - Mr President, as the shadow rapporteur for Ms Weiler and the committee chairman who chaired the trilogues, I just want to add my very warm congratulations to her. Like me, she was a founder member of the Committee on the Internal Market and Consumer Protection (IMCO), and we have worked together on many dossiers. I am really pleased that we have been able to have this debate, even though – as Mr van de Camp pointed out – it is late at night.

When we started work on this dossier, I do not think that any of us realised the amount of change that we actually needed to make it into a really good proposal. I think this is a really clear example of the important work that the IMCO Committee does – as a number of colleagues have said – perhaps below the radar. You have heard from many Members who have spoken this evening and that, in itself, is an indication of the engagement of our Members with this type of work. We have made some significant advances in such things as mobile chargers, but also in the construction of the whole directive.

I particularly want to thank the Commission, and your colleagues in DG Enterprise, for working with us to make a number of these changes, and indeed perhaps reversing some of their previous ideas about it. The Council also helped us. For my part, I was particularly pleased that the Commission has agreed to work to include all the details on the display screen of these mobile devices. This seems to me to be an important technical advance, which we had to fight for, and I am very pleased that Mrs[nbsp ]Weiler supported me in that.

So I will just say – because this will be her last appearance here, although we will be back in action in April – that you can see this evening why it is such a pleasure to be able to chair such an engaged, interesting and knowledgeable group of people.

  Biljana Borzan (S&D). - Gospodine predsjedavajući, današnje društvo sve više funkcionira online i život bez spravica koje nam omogućuju komunikaciju, navigaciju i zabavu je nezamisliv. No, mobiteli se često mijenjaju, kvare i gube i zato je prosječno kućanstvo zatrpano kablovima i punjačima. Osim toga, bacanje nepotrebnih punjača je i ekološki problem. Stoga, pozdravljam donošenje direktive o stavljanju na tržište radijske opreme jer će od ovih pravila najviše profitirati potrošači.

Najvažnija novost je zahtjev prema proizvođačima elektronike da počnu proizvoditi univerzalne punjače za mobitele, tablete mp3 playere, kamere i slične uređaje. Ovo je prvi put da Europska unija donosi odluku kojom uvođenje univerzalnoga punjača postaje obveza. U svijetu u kojem baterija pametnoga telefona traje prosječno jedan dan, mala stvar poput univerzalnoga punjača našim će građanima značajno pojednostavniti život. Na kraju bih se željela zahvaliti i čestitati izvjestiteljici Weiler na odrađenom poslu.

  Neelie Kroes, Vice-President of the Commission. - Mr President, excellent cooperation can lead to a successful outcome and here, now, is the result of this legislative revision. We strongly believe that the Radio Equipment Directive will improve the conditions for further innovation and growth in the area of radio equipment for the benefit of citizens, companies and public users. In a spirit of compromise, and with a view to reaching a first reading agreement, the Commission will not stand in the way of an agreement between institutions. It therefore welcomes this compromise package and looks forward to its rapid adoption.

However, the Commission does have some concern over the competence of the committee set up by this directive and has sent a statement to this effect to Parliament’s services for the records of the plenary sitting.

From now on – with Ms Weiler’s permission – my charger will be called Barbara.

Commission’s position on amendments by Parliament

Having weighed the public interest in the swift adoption of the present directive against the institutional concerns raised by the compromise text the co-legislators are about to agree, the Commission has decided not to stand in the way of a final agreement. In this regard and recognising the exceptional circumstances, the Commission has in particular taken into account the direct benefits for the citizen resulting from the measure, and the need to ensure adoption before the end of the current parliamentary term.

However, the Commission regrets the adoption of article 44 paragraph 5 and the corresponding recital 67 concerning the Committee, which have the potential to create confusion and legal uncertainty. The role of the committees which ensure control by Member States of the Commission’s exercise of implementing powers is defined only by Regulation (EU) No 182/2011, adopted on the basis of Article 291, third paragraph TFEU. Therefore, no other secondary legislative act should alter or specify further this role. In particular, the rules of procedure of committees are adopted by the committees on the basis of Regulation (EU) No 182/2011. As such they are to be applied when the committees exercise their role defined by Regulation (EU) No 182/2011. Any reference to rules of procedure outside this context is superfluous and inappropriate. It also risks complicating the functioning of the committees.

With regard to recital 68 and the possibility of the European Parliament being invited to meetings of expert groups, the Commission will proceed in accordance with its practice in the implementation of point 15 of the Framework Agreement on relations between the European Parliament and the European Commission. Meetings of comitology committees are explicitly excluded under this arrangement. Concerning the reference to infringements in the same recital, the Commission considers this misleading, as infringements proceeding are discussed with Member States in the context of the procedures set out under article 258 TFEU.

The Commission underlines that its acceptance of the compromise in the present case is without prejudice to its position on other files.

  Barbara Weiler, Berichterstatterin. - Herr Präsident! Zum Inhalt möchte ich eigentlich nichts mehr sagen. Es ist bereits alles gesagt worden. Dies ist ein schönes Beispiel für die nächste Legislaturperiode, für die Kollegen, das zeigt, was wir als Abgeordnete erreichen können, wenn wir zusammenhalten. Das muss ja nicht heißen, dass wir immer einer Meinung sind, aber es ist schon hilfreich. Ich habe ein paar Kleinigkeiten etwas anders in Erinnerung, als die Kommissarin das am Anfang erzählt hat. Aber das macht nichts. Diese kleinen Widersprüche können auch sein. Entscheidend ist das Ergebnis, das wir mit dem Rat vereinbart haben, und wie es weitergeht.

Ich möchte diese Gelegenheit, diese letzte Minute, nutzen, um nochmal meinen ganz herzlichen Dank nicht nur den Schattenberichterstattern, sondern allen Kolleginnen und Kollegen vom IMCO-Ausschuss auszusprechen, denn ich habe mich dort in den letzten zehn Jahren in der Debatte immer wohl aufgehoben gefühlt. Es waren sehr spannende Jahre. Der IMCO-Ausschuss ist ein ganz besonderer Ausschuss. Das werden die Kollegen auch noch merken.

Ich möchte auch einen besonderen Dank an Malcolm Harbour aussprechen, den ich in einigen Trilogen als sehr konstruktiv und hilfreich kennengelernt habe. Ich weiß nicht, Malcolm, ob das ein großes Lob für Dich ist, wenn ich Dir sage: Ein Anti-Europäer bist Du garantiert nicht! So solltest Du auch bleiben und so konstruktiv für Europa mitarbeiten.

Einen Dank an alle Kolleginnen und Kollegen in diesem Hause, die nicht nur national, sondern europäisch denken, und die Europa nicht kleinreden, sondern konstruktiv an der Gestaltung mitarbeiten. Gemeinsam als einziges supranationales Parlament Politik mit den Bürgern und für die Bürger machen – das wünsche ich Ihnen für die nächsten fünf Jahre! Zwei Monate haben wir ja noch.
