  Luís Paulo Alves (S&D), por escrito. - Aprovo o presente Relatório, começando por saudar a proposta de diretiva da Comissão relativa à luta contra a fraude lesiva dos interesses financeiros da União através do direito penal. Em particular, partilho da opinião de que a fraude e outras atividades ilegais que lesam os interesses financeiros da União constituem um grave problema que prejudica o orçamento da União e, por conseguinte, os contribuintes, que apelam para que os fundos públicos das instituições europeias sejam canalizados para o crescimento estrutural, a consolidação fiscal e o emprego.

  Pino Arlacchi (S&D), in writing. - I voted in favour of this proposal because the fraud and related illegal activities affecting the Union’s financial interests pose a serious problem to the detriment of the Union budget and thereby the taxpayers. For this reason we call to the European institutions to ensure that public money is devoted to structural growth, fiscal consolidation and jobs. There are differences among the Member States legal and sanctioning systems. This fragmented legal framework creates incentives, for the potential perpetrators, to move across the European territory to the most favourable judicial system. I believe we should respond with a unique voice to fraud and any other activities affecting the financial interests of the Union through deterrent measures. I consider this proposal for a directive on the fight against fraud to the Union's financial interest also as an important step in the field of EU Criminal Law. This area has been significantly enhanced since the entry into force of the Lisbon Treaty, and should be used to the fullest extent.

  Sophie Auconie (PPE), par écrit. – La directive sur la protection des intérêts financiers de l'Union vise à établir les mesures nécessaires pour prévenir et combattre la fraude et les autres activités illégales portant atteinte aux intérêts financiers de l'Union en élaborant des définitions communes des infractions et des sanctions pénales.

Les cas de fraude représenteraient près de 600 millions d'euros par an. Cette proposition de directive doit être comprise dans le contexte, plus large, de l'ensemble des propositions de la Commission qui visent à établir des dispositions harmonisées de droit pénal. Je suis persuadée que la lutte contre la fraude doit être menée au niveau européen et que la coopération en matière pénale est indispensable. J'ai voté en faveur de cette directive.

  Mara Bizzotto (EFD), per iscritto. - Non ho inteso sostenere la relazione che analizza la proposta di direttiva relativa alla "lotta contro la frode che lede gli interessi finanziari dell'Unione mediante il diritto penale", poiché ritengo che così come strutturata implichi eccessive e sproporzionate ingerenze nei sistemi penali nazionali.

  Vilija Blinkevičiūtė (S&D), raštu. - Balsavau dėl šio pranešimo, nes sukčiavimas Europos Sąjungos finansiniams interesams yra rimta problema, dėl kurios nukenčia ES biudžetas, taigi ir mokesčių mokėtojai, kurie skubiai ragina Europos Sąjungos institucijas užtikrinti, kad viešosios lėšos būtų skirtos struktūriniam augimui, fiskaliniam konsolidavimui ir darbo vietų kūrimui. Kovos su sukčiavimu srityje egzistuoja gerai struktūrizuotas Bendrijos teisynas, tačiau iki šiol valstybėse narėse jis buvo įgyvendintas tik priimant nepakankamai suderintas ir suvienodintas taisykles bei nuostatas, įskaitant sankcijas. Tokia susiskaidžiusi teisinė sistema skatina potencialius nusikaltėlius keliauti po visą Europos teritoriją ieškant palankiausios teisinės sistemos. Europos Parlamentas mano, kad Europos Sąjunga ir valstybės narės turi ypatingai reaguoti į sukčiavimą ir kitą ES finansiniams interesams kenkiančią neteisėtą veiklą, taikydamos atgrasančias priemones, taip pat turi suteikti veiksmingą ir lygiavertę apsaugą visose valstybėse narėse. Taigi, Europos Parlamentas šiuo pranešimu reaguoją į piliečiams ir mokesčių mokėtojams susirūpinimą keliančius klausimus ir siekia sukurti tvirtesnį pagrindą Europos Sąjungos finansinių interesų apsaugai užtikrinti visoje Europos Sąjungos teritorijoje.

  Biljana Borzan (S&D), napisan. - Radi osiguravanja učinkovite, proporcionalne i odvraćajuće zaštite od prijevara te radi osiguravanja optimalne zaštite financijskih interesa Unije, mjere usvojene primjenom upravnog i civilnog prava treba dopuniti zakonodavstvom u okviru kaznenog prava država članica, izbjegavajući neusklađenost u svakom od tih sektora i između njih.

Za zaštitu financijskih interesa Unije potrebna je zajednička definicija prijevare kojom su obuhvaćena nepoštena ponašanja u vezi s rashodima, prihodima, imovinom i obvezama na štetu proračuna Unije, uključujući aktivnosti zaduživanja i kreditiranja. Da bi se osigurala dosljednost prava Unije u pogledu zaštite financijskih interesa, primjereno je uvesti određenu minimalnu razinu kazne. Ovom direktivom se utvrđuju minimalna pravila.

Države članice trebale bi moći zadržati ili uvesti strože sankcije. Kako bi se osigurala učinkovita aktivnost protiv kaznenih djela koja utječu na financijske interese Unije, potrebno je intenzivirati suradnju između država članica, Komisije i Eurojusta.

  Arkadiusz Tomasz Bratkowski (PPE), na piśmie. - Jestem zdania, iż prace nad omawianą dyrektywą powinny być kontynuowane w przyszłej kadencji Parlamentu Europejskiego. O ile w pierwszym czytaniu udało się ustalić podstawę prawną oraz usunąć tzw. minimalne progi ustawowego zagrożenia karą, które wprowadzałyby niepotrzebne komplikacje prawne, o tyle definicja interesów finansowych UE wymaga dalszych prac. W naszym wspólnym interesie leży, by była ona szeroka, aczkolwiek należy wyznaczyć pewne jej granice i zakres stosowania prawa karnego.

Nie jest możliwe, by w definicji prawnej ująć wszystkie elementy mające wpływ na budżet UE, natomiast ważne jest zachowanie właściwych proporcji. Tym samym opowiadam się za wyłączeniem kwestii VAT z zakresu stosowania dyrektywy, gdyż podatek ten stanowi głównie dochód państwa. Jakkolwiek istnieje pośredni związek pomiędzy dochodami z VAT a budżetem unijnym, nie uzasadnia on jednak rozciągnięcia definicji interesów finansowych UE na wszystkie operacje VAT w państwach członkowskich. Tym bardziej, że tzw. środek własny obliczany jest w oparciu o dane statystyczne i skomplikowaną metodologię KE, a nie na bazie realnych wpływów z tytułu podatku VAT. Omawiana dyrektywa ściśle wiązać się będzie z zakresem kompetencji przyszłej Prokuratury Europejskiej. Tym bardziej jestem więc zdania, iż utrzymanie kwestii VAT w kompetencji państw członkowskich jest rozsądne, gdyż nowo utworzona instytucja może być nieprzygotowana do efektywnego ich rozstrzygania.

  Rachida Dati (PPE), par écrit. – Le préjudice que subit le budget de l’Union européenne chaque année, à cause de fraudes massives, est immense et nécessite des mesures visant à garantir une protection efficace des intérêts financiers de l’Union. Malgré le développement de l'acquis de l'Union européenne dans ce domaine, les États membres ont adopté des règles divergentes, entraînant souvent des écarts dans les niveaux de protection prévus par leurs régimes juridiques internes. Le fait de définir des infractions communes à tous les États membres doit permettre de lutter plus efficacement contre la fraude. C’est ce que propose à juste titre ce texte.

  Diane Dodds (NI), in writing. - As an MEP for Northern Ireland, a region of the UK blighted by organised crime led by republican terrorists on the border with the Republic of Ireland, I welcome this focus on tackling fraud across Europe. However, it is completely unacceptable that this, or any other, institution of the EU should pursue a fascination with harmonising criminal law. Member States should retain complete sovereignty and flexibility over powers of criminal investigation and the type of punishments handed out to those convicted of fraud and other forms of organised crime. It should be for national courts to decide these penalties and our judges should not be constrained by the ill-thought minimum provisions set out by Eurocrats here in Strasbourg. I am glad that this report included an amendment accepting so. Ultimately, while cooperation is important, it should be national agencies such as the National Crime Agency in the UK – and support for those investigative bodies – that should take forward the aim of combating organised crime.

  Diogo Feio (PPE), por escrito. - A fraude e outras atividades ilegais que lesam os interesses financeiros da União constituem um grave problema que prejudica o orçamento da União e, por conseguinte, os contribuintes, impedindo que os fundos das instituições europeias sejam canalizados para o crescimento estrutural, a consolidação fiscal e o emprego. É por isso que devemos ter tolerância zero para com a fraude e definir como objetivo atingir um nível de irregularidades financeiras zero na UE. Concordo, por isso, com a proposta legislativa da Comissão, ao introduzir disposições destinadas a aproximar os sistemas legais nacionais, incluindo medidas de direito penal, a fim de combater a fraude e outras atividades ilegais lesivas para o orçamento da União, de modo a criar um ambiente verdadeiramente dissuasor e punitivo da fraude.

  Monica Luisa Macovei (PPE), in writing. - As EPP Rapporteur on the 2012 Report on the protection of the Union’s Financial Interests, I expressed my concerns regarding the attitude of some Member States which deal with fraudulent irregularities only through the application of financial corrections instead of investigating fully the potential criminal offence. In this respect, I welcomed the Commission’s proposal for a Directive on the Fight against fraud to the Union’s financial interests by means of criminal law. This Directive must represent a strong step forward in the protection of the Union’s financial interests and the taxpayers’ money. In order to achieve this ambitious goal, we need a strong legal basis for the Directive. Criminal procedures will be better unified and therefore more efficient and effective, and at the end of the day this will mean a higher degree of protection against fraudsters. In addition, we need the full participation of the European Parliament throughout the entire legal procedure.

  Jean-Luc Mélenchon (GUE/NGL), par écrit. – La fraude et les autres activités illégales portent atteinte aux intérêts financiers de l'Union et de ce fait constituent un grave problème préjudiciable au budget de l'Union.

La proposition législative de la Commission va dans la bonne direction en prévoyant des dispositions qui tendent à rapprocher les systèmes juridiques nationaux, notamment les mesures de droit pénal, pour lutter contre la fraude et les autres activités illégales. Les rapporteurs proposent en outre de réduire le seuil des infractions de 10 000 à 5 000 EUR, de sorte que les États membres puissent, s'ils le souhaitent, prévoir des sanctions autres que pénales pour les cas de fraude portant sur des sommes inférieures.

Mais tant que la lutte contre la fraude s’arrêtera aux frontières des paradis fiscaux, elle n'aura que peu de poids. C'est la libre circulation sauvage des capitaux que promeut l'Union européenne qui contribue largement au développement de la fraude. Je m’abstiens donc sur ce texte pour ne pas cautionner ces rotomontades sans conséquences.

  Miroslav Mikolášik (PPE), písomne - Podvodné konanie poškodzujúce finančné záujmy Únie spôsobuje straty z rozpočtu Únie, a teda predstavuje aj ujmu pre daňovníkov, ktorí do rozpočtu prispievajú. Považujem za potrebné zabezpečiť v európskom priestore slobody, bezpečnosti a spravodlivosti, aby boli páchatelia spravodlivo potrestaní bez ohľadu na to, v ktorom členskom štáte sa nachádzajú. Doterajšie skúsenosti totiž ukazujú, že sa páchatelia premiestňovali v závislosti na priaznivosti právneho systému členských štátov. Na účinnú finančných záujmov EÚ, a to predovšetkým boj proti podvodom, aktívnou a pasívnou korupciou a spreneverou nepostačujú prostriedky práva občianskeho a správneho, a preto súhlasím zavedením trestnoprávnej ochrany. Podporujem taktiež, aby smernica zaviedla minimálne výšky sankcií.

  Rolandas Paksas (EFD), raštu. - Pritariu pateiktam pasiūlymui dėl direktyvos.

Visų pirma, siekiant kovoti su sukčiavimu ir kitomis Sąjungos biudžetui kenkiančiomis neteisėtomis veikomis, reikia suvienodinti nacionalines teisines sistemas, įskaitant baudžiamosios teisės priemones, ir ES taikyti bendrą politiką. Tai yra reikšmingas postūmis kuriant Europos baudžiamojo teisingumo erdvę. Mes privalome užtikrinti veiksmingą, proporcingą ir atgrasomąją Sąjungos finansinių interesų apsaugą. Remiantis šia direktyva turėtų būti sukurta tokia sistema, pagal kurią veiktų būsima Europos prokuratūra.

Visų pirma, sukčiavimą reikėtų atskirti nuo korupcijos ir pinigų plovimo. Sveikintina, kad į direktyvos taikymo sritį yra įtraukiamas sukčiavimas PVM.

Siekiant apsaugoti Sąjungos finansinius interesus, bendradarbiavimas neturėtų būti apribotas valstybių narių ir Komisijos bendradarbiavimu, bet turėtų apimti ir valstybių narių tarpusavio bendradarbiavimą. Be to, tikslinga leisti valstybėms narėms pačioms nustatyti kitokias nei baudžiamąsias sankcijas už mažesnio masto sukčiavimą.

  Antigoni Papadopoulou (S&D), in writing. - This report aims to fight against fraud to the Union’s financial interests. By means of criminal law, it defines the criminal offences for which a prospective European Public Prosecutor’s Office would have jurisdiction. It translates into Union law the existing Convention for the protection of the financial interests of the European Communities, which include among others: corruption, collection of VAT and the concept of a public official, fraud and fraud related offences which affect the Union’s financial interests. Minimum criminal sanctions are to be enforced for fraud and corruption offences. I believe that there should be a greater cooperation between Member States and Eurojust with regard to criminal offences and core principles of criminal law should be restated.

  Maria do Céu Patrão Neves (PPE), por escrito. - Votei favoravelmente a presente proposta de diretiva da Comissão relativa à luta contra a fraude lesiva dos interesses financeiros da União através do direito penal. O Parlamento é da opinião de que a fraude e outras atividades ilegais que lesam os interesses financeiros da União constituem um grave problema que prejudica o orçamento da União e, por conseguinte, os contribuintes, pelo que faz um apelo para que os fundos públicos das instituições europeias sejam canalizados para o crescimento estrutural, a consolidação fiscal e o emprego. De facto, o objetivo geral da proposta consiste em proteger os interesses financeiros da União através da adoção de medidas efetivas, proporcionais e dissuasivas. Para tal, estabelece-se requisitos mínimos, incluindo definições de infrações e sanções mínimas e máximas, em matéria de luta contra a fraude e outras atividades ilegais lesivas dos interesses financeiros da União.

  Sandra Petrović Jakovina (S&D), napisan. - Podržala sam ovo izvješće prvenstveno zbog toga što prijevara i sve protupravne aktivnosti koje negativno utječu na financijske interese Unije u konačnici rezultiraju ozbiljnim ugrožavanjem ne samo budžeta EU-a, već također i interesa građana i poreznih obveznika. Konkretno, dovode do nedozvoljenog preusmjeravanja sredstava koja bi inače bila namijenjena otvaranju radnih mjesta, gospodarskom razvoju i poreznoj konsolidaciji.

Bitna je realizacija efikasne i proporcionalne zaštite financijskih interesa Unije kao i odvraćajući učinak sankcija na potencijalne počinitelje kaznenih djela u cijeloj Europi, uz istovremenu primjenu visoke razine procesnih standarda diljem EU-a, koje se odnose između ostaloga i na primjenu načela ne bis in idem.

Za uspješnu realizaciju prethodno navedenog jednako je tako neophodna uska suradnja između država članica, relevantnih institucija EU-a i agencija koje se bave istragama prethodno navedenih prijevarnih radnji. Ovo izvješće pruža čvrstu osnovu za osiguranje efikasne zaštite financijskih interesa Unije diljem čitavog njezinog područja na način da se protupravno oduzeta sredstva povrate i prenesu u budžet Unije.

  Tonino Picula (S&D), napisan. - Podržavam izvješće o suzbijanju prijevara počinjenih protiv financijskih interesa Unije kaznenopravnim sredstvima. Potrebno je osigurati optimalnu zaštitu financijskih interesa Unije, kao i osigurati učinkovitu i proporcionalnu zaštitu od najozbiljnijih slučajeva radnji povezanih s prijevarama. Korupcija predstavlja ozbiljnu prijetnju te može biti povezana s prijevarom.

Slažem se s izvjestiteljima koji vjeruju kako bi definicija financijskih interesa Europske unije trebala biti proširena s ciljem uključivanja imovine i obveza Unije i europskih institucija. Također, u svrhu zaštite financijskih interesa Unije potrebna je zajednička definicija prijevare kojom su obuhvaćena nepoštena ponašanja u vezi s rashodima, prihodima, imovinom i obvezama na štetu proračuna Unije, uključujući aktivnosti zaduživanja i kreditiranja.

Hrvatska je već u pretpristupnom razdoblju bila dužna osigurati zakonodavni okvir za zaštitu financijskih interesa Europske unije te osigurati uspostavu učinkovitog i djelotvornog sustava upravljanja nepravilnostima i prijevarama, vezano uz upravljanje i korištenje sredstava pomoći Europske unije. Ministarstvo financija kao glavno koordinacijsko tijelo AFCOS sustava i kontakt točka Europskom uredu za borbu protiv prijevara, zajedno s institucijama partnerima, kontinuirano se zalaže za zaštitu financijskih interesa EU-a.

  Sergio Paolo Francesco Silvestris (PPE), per iscritto. - Accolgo con favore la proposta della Commissione relativa alla lotta contro la frode che lede gli interessi finanziari dell'Unione mediante il diritto penale, che costituisce un grave problema e si ripercuote sul bilancio dell'Unione e di rimando sui contribuenti europei.

Appoggio alcune proposte dei relatori, in particolare in merito a una definizione più precisa di frode che lede il bilancio dell'Unione o le disposizioni che facilitano il ravvicinamento delle contromisure per le attività fraudolente relative all'accesso agli appalti pubblici dell'UE, comprese le attività che annullano o distorcono la concorrenza naturale tra i partecipanti alle gare di appalto.

  Kay Swinburne (ECR), in writing. - The focus of this proposal for a directive is on how fraud and related illegal activity within EU institutions affects the financial interests of the EU and, in turn, the taxpayer. This legislative proposal introduces criminal law measures in order to counteract such fraud and other illegal activities deemed detrimental to the EU’s budget. As the UK does not participate in these measures, I abstained on the final vote.

  Marc Tarabella (S&D), par écrit. – J'ai voté en faveur de la proposition de directive relative à la lutte contre la fraude portant atteinte aux intérêts financiers de l'Union au moyen du droit pénal. En particulier, ils sont d'avis que la fraude et les autres activités illégales portant atteinte aux intérêts financiers de l'Union constituent un grave problème préjudiciable au budget de l'Union et, de ce fait, aux contribuables, qui appellent instamment les institutions européennes à faire en sorte que l'argent public soit consacré à la croissance structurelle, à l'assainissement budgétaire et à l'emploi.

  Silvia-Adriana Ţicău (S&D), în scris. - Am votat pentru raportul referitor la propunerea de directivă a Parlamentului European și a Consiliului privind combaterea fraudelor îndreptate împotriva intereselor financiare ale Uniunii prin intermediul dreptului penal. Pentru a se asigura coerența dreptului Uniunii în ceea ce privește protecția intereselor financiare ale Uniunii, este oportun să se introducă anumite niveluri minime ale sancțiunilor în ceea ce privește infracțiunile definite în prezenta directivă. Prezenta directivă stabilește norme minime. Statele membre ar trebui să rămână libere să mențină sau să introducă sancțiuni mai stricte pentru aceste infracțiuni. Am votat împotriva amendamentului 42 prin care veniturile provenite din TVA nu sunt incluse în domeniul de aplicare al prezentei directive. Am votat pentru amendamentele 43 și 44 depuse de grupul S&D prin care pragul prejudiciului produs scade de la 100 000 EUR la 50 000 EUR. Curtea de Conturi, instituțiile naționale de control, precum și auditorii care au ca misiune auditarea bugetelor instituțiilor, organismelor, birourilor și agențiilor înființate în temeiul tratatelor sau auditarea bugetelor gestionate și auditate de către instituții, comunică OLAF toate infracțiunile penale de care iau cunoștință în desfășurarea misiunii lor. De asemenea, funcționarii Uniunii comunică OLAF toate infracțiunile penale de care află în timpul misiunii lor.

  Ruža Tomašić (ECR), napisan. - Fokus ovog prijedloga Direktive je učinak koji prijevare i srodne ilegalne aktivnosti unutar europskih institucija imaju na financijske interese EU-a, to jest na porezne obveznike. Podupirem inicijativu da se financijski zločini trebaju tretirati ozbiljnije i da se konkretnije trebamo pozabaviti njihovim utjecajem na gospodarsku krizu. Jedan od predloženih načina suzbijanja ilegalnih aktivnosti je uvođenje kaznenih mjera zakona kako bi se suzbile buduće prijevare i ilegalne aktivnosti koje su štetne za proračun EU-a. Međutim, glasovala sam suzdržano jer ne podržavam uključivanje prijevare PDV-a u okvir ove Direktive, jer vjerujem da bi odredbe EU-a o porezu trebale biti definirane u Ugovoru o porezu , koji funkcionira na principu jednoglasnosti.

  Axel Voss (PPE), schriftlich. - Wenn die finanziellen Interessen der EU auf dem Spiel stehen, muss ein Betrug auch strafrechtlich bekämpft werden. Aus diesem Grund ist die strafrechtliche Bekämpfung von gegen die finanziellen Interessen der EU gerichtetem Betrug ein entscheidender Schritt in die richtige Richtung. Dieser Bericht enthält Vorgaben zu verschiedenen Straftaten wie Untreue, Betrug, Bestechung, Ausschreibungsbetrug etc., die den finanziellen Interessen der EU zuwiderlaufen. Die Kommission sieht in ihrem Verordnungsvorschlag aber auch Mindeststrafen (Freiheitsstrafe von sechs Monaten) vor. Tendenziell bin ich gegen die Einführung von Mindest- und Höchsstrafen im strafrechtlichen Bereich. Mindeststrafen lassen die Vielfalt der Rechtsräume und die notwendige rechtliche Ermessensfreiheit außer Acht. Der Wunsch nach einheitlichen Strafmaßen könnte Störungen in den nationalen Strafzumessungssystemen provozieren. Ich bin prinzipiell nicht gegen eine Vereinheitlichung der Strafzumessungsregeln und ein Voranschreiten der EU auf strafrechtlicher Ebene, ich denke allerdings, dass es dafür derzeit einfach noch zu früh ist. Deswegen begrüße ich, dass das Europäische Parlament sich in seiner Position gegen die Einführung von Mindeststrafen ausgesprochen hat!

  Josef Weidenholzer (S&D), schriftlich. - Betrugsdelikte, die gegen die finanziellen Interessen der EU gerichtet sind, und damit zusammenhängende Straftaten sind ein großes Problem. Dem EU-Haushalt und in weiterer Folge den Steuerzahlerinnen und Steuerzahlern entgehen damit Mittel, die für Investitionen in nachhaltiges Wachstum und Beschäftigung eingesetzt werden könnten. Der Vorschlag zielt darauf ab, die finanziellen Interessen der Union und der europäischen Bürgerinnen und Bürger wirksam zu schützen. Dafür sollen auf diesem Gebiet Mindestregeln sowie Mindest- und Höchstmaße für Sanktionen festgelegt werden.

  Angelika Werthmann (NI), schriftlich. - Der vorgelegte Bericht beschäftigt sich mit dem Schutz der finanziellen Interessen der Europäischen Union und dem damit verbundenen Kampf gegen Betrug und andere kriminelle Tätigkeiten. In diesem Sinne ist dem Bericht zuzustimmen, da besonders in Zeiten der drohenden Zahlungsunfähigkeit spezielles Augenmerk auf die Sicherung finanziellen Eigentums gelegt werden sollte.
