  President. - The next item is the debate on the Commission statement on prolongation of detention by Member States of illegally staying third-country nationals beyond the 18-month time limit in violation of the Return Directive (2014/2701(RSP)).

  Janez Potočnik, Member of the Commission. - Mr President, I would like to answer on behalf of my colleague, Cecilia Malmström, who is unfortunately not able to attend today’s session.

The Return Directive provides very clearly that, after 18 months, administrative detention must be stopped and only lesser measures, such as residence restrictions or regular reporting can be applied. In our recent communication on EU return policy, we noted that before the Return Directive was adopted the maximum length of detention varied significantly across Member States and in at least nine there was no upper ceiling on how long returnees could be detained.

The Return Directive has contributed to a convergence and overall to the reduction of maximum detention periods across the European Union. While the legal time limits for detention have increased in eight Member States, they have decreased in 12 Member States. All Member States, including Greece, now have legislation in force which respects the maximum periods provided by the directive. The only exception is the United Kingdom, which decided not to opt into the Return Directive and which still allows unlimited detention.

However, in an opinion last month, the Greek State Legal Council concluded that, after a maximum of 18 months’ detention, it is possible to impose a further obligation on non-cooperating returnees to remain in a centre. The Commission is concerned about the practical effects of this opinion on Greek administrative practice. According to a preliminary Commission analysis, the wording of the opinion is ambiguous and it remains to be seen if it will be used by the Greek administration as a basis for practices compatible with the directive or incompatible ones.

The Return Directive does not prevent the use of measures such as residence restrictions or regular reporting obligations for returnees released from detention. The important point is the nature of these measures. Once the restrictions reach the level of deprivation of liberty, they would have to be considered as de facto detention. The Commission will ask Greece about the practical application and consider further steps once it has been clarified how the opinion is actually being applied.

As regards detention conditions in Greece more generally, the Commission is constantly monitoring the implementation of the Greek Action Plan on Asylum and Migration. In this context, the Greek authorities have already closed some of the centres mentioned in the MSF report, such as Pagani in Lesvos, Palaio Elliniko, Aspropyrgos, Tychero, Piraeus, and Venna. With the support of the European Return Fund, some modern detention centres have been opened and some other facilities have been renovated.

However, there is still room for improvement. The report by Médecins Sans Frontières (MSF) primarily described an alarming situation in the detention centre located in Komotini. The Commission has already sent an inquiry to the Greek authorities to know how the substantial support received by Greece under the Return Fund to improve detention conditions in the pre-removal centre has been used in practice. The Commission has regularly visited the detention centres in the region of Athens – most recently in March – and is ready to go back to Greece very soon to check the situation in the other detention centres, including Komotini.

Finally, regarding any possible infringement procedures. To ensure mutual trust between the Commission services and the Member States, a degree of confidentiality is of course essential. The Commission therefore does not comment on ongoing or planned infringement procedures but the Commission will of course not hesitate to take appropriate steps if necessary.

In conclusion, let me insist that the Commission will follow up on all shortcomings identified in our recent implementation report on the Return Directive. In the context of the overall monitoring of the implementation of the directive, and in particular in the context of the Greek Action Plan on Asylum and Migration, we will pay particular attention to those provisions of the directive which relate to the detention of returnees, safeguards and legal remedies, as well as the treatment of minors and other vulnerable persons in the return procedures.

The new Schengen evaluation mechanism will provide further opportunities to examine and assess the practices of Member States in these areas and to check whether Member States are fully complying with the directive and international human rights standards.

  Hubert Pirker, im Namen der PPE-Fraktion. – Herr Präsident! Herr Kommissar, Sie haben vollkommen zu Recht angemerkt, dass die Probleme mit längerer Inhaftierung in der Regel dadurch entstehen, dass Identitäten nicht festgestellt werden, dass die Herkunftsländer nicht ohne weiteres feststellbar sind, oder auch, dass die Rückübernahme durch die Drittstaaten nicht ordnungsgemäß funktioniert.

Die Rückführungsrichtlinie ist die Grundlage für all die Maßnahmen, die hier gesetzt werden. Wir wissen, dass sie sehr präzise regelt, aus welchen Gründen eine Inhaftierung wie lange erfolgen kann. Die Kommission hat in ihrer Bewertung im Bericht im März 2014 auch festgestellt, dass die Auswirkungen der Richtlinie positiv sind. Es haben sich nämlich in zwölf Mitgliedstaaten die Inhaftierungszeiten verkürzt, in acht Mitgliedstaaten verlängert. Aber in Summe werden die Maximalzeiten eingehalten. Auch von den Vereinten Nationen wurden die Maßnahmen der Europäischen Union als positiv gelobt. Die Illegalität ist nach ihren Einschätzungen im Zeitraum von 2008 bis 2012 um 30[nbsp ]% zurückgegangen. Sie haben aber auch festgestellt, dass es eine Diskrepanz gibt, nämlich zwischen der Entscheidung über eine Abschiebung und der tatsächlichen Durchführung. Das hängt wieder mit den Gründen der Rückübernahme zusammen. Das wissen wir alles. In Summe aber ein positives Instrumentarium, die Richtlinie ist in Ordnung, und sie sollte auch beibehalten werden.

Wie sieht aber die Situation in Griechenland aus, die Sie angesprochen haben? Ich hatte die Möglichkeit, mit anderen Kollegen an einer LIBE-Delegation teilzunehmen. Wir konnten die Situation vor Ort an der Grenze, am Fluss Evros sehen. Griechenland war bis 2012 extrem betroffen von illegaler Einwanderung. Ich würde es keinem Land wünschen, derartige massive illegale Einwanderungsströme bewältigen zu müssen. Es hat Auffanglager gegeben, die wir beobachtet und untersucht haben. Einige waren neu, waren in einem hervorragenden Zustand, und auch die Verfahrensabwicklungen waren exzellent organisiert. Es hat einige gegeben aufgrund dieses Massenandrangs, die auch zu Recht als problematisch dargestellt werden mussten, und wo uns versichert worden ist, dass sie geschlossen werden. Ich gehe davon aus, dass das auch in der Form geschehen ist.

Die Unterstützungsmaßnahmen der Europäischen Union haben gegriffen. Ich gehe davon aus, dass das, was damals auch kritisch angemerkt worden ist, jetzt zum gegenwärtigen Zeitpunkt erledigt ist. Es ist die Kommission, die zu überprüfen hat, ob es in Ordnung ist oder nicht. Es sollten dann Maßnahmen gesetzt werden, wenn es nicht in Ordnung ist. Es gibt aber keinen Grund, die Richtlinie zu ändern.

Das ist nach 15 Jahren meine letzte Rede, und ich darf abschließend nur bemerken, dass es ein Privileg war, Herr Präsident, hier im Parlament arbeiten zu dürfen. Ich danke allen, die diese Arbeit ermöglicht und unterstützt haben, und wünsche allen, die in Zukunft hier arbeiten werden, noch alles Gute und viel Erfolg!

  Cecilia Wikström, för ALDE-gruppen. – Herr talman! Jag finner det smått skandalöst att den grekiska ordförandestolen där borta står tom här i kammaren i[nbsp ]dag, när vi nu diskuterar brister och föreslår förbättringar för hur Grekland ska komma tillrätta med denna situation. Då orkar det grekiska ordförandeskapet inte ens pallra sig till kammaren! Det är förfärligt oacceptabelt!

Nyligen har Greklands rättsliga råd beslutat att förlänga tiden för förvar av migranter på obestämd tid, tills det blir möjligt att deportera dem. Artikel[nbsp ]15 i återvändandedirektivet slår fast att en person kan hållas i förvar i sex månader och att denna period kan förlängas till tolv månader. Det ger en maxtid på 18[nbsp ]månader i förvar, vilket bara ska kunna ske i mycket speciella fall som en sista utväg. Medlemsländerna är skyldiga att följa regelverket om att ingen ska hållas i förvar längre än så, vilket också EU-domstolen har fastslagit.

Det beslut som Grekland har fattat kommer samtidigt som maxtiden närmar sig för många migranter som sattes i förvar vid en stor operation 2012. Det är för mig alldeles uppenbart och står klart som i eldskrift att beslutet strider mot EU:s lagstiftning, att Grekland måste släppa ut de personer som de har hållit så länge i förvar eller se till att de kan lämna landet om de inte uppfyller kriterierna för internationellt skydd.

Det finns nu risk för att fler länder, som överskridit sina befogenheter, följer efter om de har brutit mot reglerna för förvar. Nu är det viktigt att kommissionen faktiskt granskar detta och att vi sätter stopp för dessa förfärliga fall. Det är människor vi pratar om! Det är levande människor, och det är inga kriminella. Det är förtvivlade personer som söker skydd i EU. Alla medlemsländer jobbar nu med att implementera asylpaketet. Grekland är icke undantaget från detta ansvarsområde.

  Franziska Keller, on behalf of the Verts/ALE Group. – Mr President, in 2008 when the Return Directive was adopted in this House it was harshly criticised by us Greens, by many nongovernmental organisations and even by heads of government. Latin American leaders called it a directive of shame. The directive allows for excessive detention of irregular migrants. They can be put into jail for up to 1.5 years, not for a crime but for the simple offence of staying in the European Union without permission. Now we are informed that even these excessive rules are not being implemented properly by the Member States. Obviously Greece is using an illegal trick for detaining migrants even longer than the maximum of 1.5 years and this could affect several thousand people.

I would like to know from the Commission what it is going to do against this breach of European law, and whether it will take effective measures to end this. From the recently published evaluation of the Return Directive by the Commission, which, by the way, is not very informative, we also learned that other Member States are not even sticking to the low standards of the Return Directive. Several do not have criteria for the risk of absconding, which is the major reason why people are being detained. One Member States prolongs detention unlawfully. A fourth of all Member States have no mechanism for monitoring return procedures, and only one half of all Member States have special detention centres.

If I understand the evaluation report correctly, then the Commission has not started even one case of an infringement procedure. Can the Commission please explain that: what steps are you going to take against Member States that are obviously in breach of European law? The evaluation also omits very important questions. I would like to know, in particular, how long migrants are being de facto detained, and why did the Commission not provide any information on this? Lastly and finally, Parliament has always said that no[nbsp ]one is illegal and we should also respect that in the titles of our debate.

  Νικόλαος Χουντής, εξ ονόματος της ομάδας GUE/NGL. – Κύριε Πρόεδρε, γνωρίζετε πολύ καλά ότι η Ελλάδα και άλλες χώρες του Νότου δέχονται το κύριο μεταναστευτικό ρεύμα και, ενώ το πρόβλημα είναι ευρωπαϊκό, η έμπρακτη αλληλεγγύη από τις άλλες ευρωπαϊκές χώρες μένει μόνο στα λόγια. Η ελληνική κυβέρνηση, και άλλες κυβερνήσεις, αντί να απαιτήσουν να τροποποιηθεί η μεταναστευτική πολιτική, να αλλάξει ο κανονισμός του Δουβλίνου, πολλές φορές, για να αντιμετωπίσουν το πρόβλημα, προχωρούν σε απάνθρωπες και αναποτελεσματικές μεθόδους.

Μία τέτοια μέθοδος πηγάζει από την πρόσφατη απόφαση του Νομικού Συμβουλίου του ελληνικού κράτους την οποία υιοθέτησαν οι αρμόδιες αρχές και βάσει της οποίας μπορεί να παρατείνεται η κράτηση αλλοδαπών πέραν των 18 μηνών, ουσιαστικά επ’ αόριστον, μέχρι να γίνει εφικτή η απέλασή τους. Αυτό γίνεται για να καλύψει η ελληνική κυβέρνηση μία άλλη αδιέξοδη επιλογή της, η οποία αφορά τη σύλληψη και κράτηση 7[nbsp ]500 αλλοδαπών, τις περισσότερες φορές κάτω από απαράδεκτες συνθήκες, μία ενέργεια η οποία, εξ αιτίας αυτής της απόφασης, έχει ως αποτέλεσμα να μην αντιμετωπίζεται το πρόβλημα αυτό που συνιστά κατάφωρη παραβίαση και της εθνικής και της ενωσιακής νομοθεσίας. Επομένως, κύριε Επίτροπε, οι απαντήσεις που δώσατε για το συγκεκριμένο θέμα ήταν τελείως αόριστες, δεν ήταν συγκεκριμένες. Άλλωστε, όπως είπατε, ανάλογες πρακτικές εφαρμόζουν και άλλες χώρες.

Το δεύτερο σημείο στο οποίο θέλω να επιστήσω την προσοχή σας, ένα σημείο το οποίο έχει γενικότερη αξία, είναι ότι έφτασε ο καιρός να ακούσουν επιτέλους η Επιτροπή και τα άλλα ευρωπαϊκά όργανα τις φωνές για αλλαγή του κανονισμού του Δουβλίνου ο οποίος εγκλωβίζει ανθρώπους και δημιουργεί αυτές τις ‘αποθήκες’ στις χώρες εισόδου.

  Mario Borghezio (NI). - Signor Presidente, mentre stiamo qui a cercare il pelo nell'uovo sulle norme giuridiche di questo diritto europeo, che in realtà è il risultato delle formulazioni filosofiche delle Corti di giustizia, c'è una sfida che minaccia il confine meridionale dell'Europa.

Secondo fonti dello stesso ministro degli Interni italiano, ci sono 600[nbsp ]000 disgraziati nella zona subequatoriale dell'Africa pronti a invadere l'Europa, magari attraverso le coste italiane. Certo, i parlamentari che rappresentano i partiti, i movimenti e le nazioni del nord Europa sono meno sensibili a questa sfida, ma noi abbiamo le coste invase dalle carrette dei clandestini per opera delle organizzazioni criminali mafiose, di cui non si parla mai perché i clandestini sono utili, sono uno strumento di queste mafie.

Parliamo allora con chiarezza: diciamo che l'Europa, come ha profetizzato Jean Raspail in un grandissimo romanzo negli anni '70, sta per essere invasa e di fronte a questa minaccia, noi discutiamo del pelo nell'uovo delle norme dei respingimenti. Ma cosa volete respingere, quando saranno 600[nbsp ]000, forse un milione, coloro che cercheranno di arrivare in Europa? Bisogna fare come dice la Lega e come dicono i movimenti più responsabili.

Nel prossimo Parlamento saremo in tanti a ribadire queste cose, a dire che la politica dell'immigrazione dell'Europa non vale un fico secco. Non avete difeso l'Europa, questa è la vostra vergogna! Traditori dell'Europa!

  Cecilia Wikström (ALDE), fråga "blått kort". – Mario Borghezio, att ni inte skäms, att tala om människor som söker skydd i Europa för att de har flytt undan krig och förföljelse. Tar vi Syrien som exempel, är det sex miljoner människor – inga kriminella, utan det är läkare, sjuksköterskor, civilingenjörer som söker skydd i Europa. Att ni har mage att säga att nordeuropeiska länder inte tar sitt ansvar! Det är ju bara okunskap eller kanske till och med illvilligt tal från er sida. Det är Sverige och Tyskland som tar emot dessa människor just nu i[nbsp ]dag och erbjuder dem skydd och nya livsmöjligheter. Vad gör ni?

Ma vede, quando da certi pulpiti, non solo laici ma anche religiosi, ci si dice che dobbiamo accoglierli, io chiedo loro, per esempio a Lei onorevole: quanti immigrati ha accolto a casa Sua? Si vergogni! Ipocrita! Invadono l'Europa e voi, vigliacchi, Europa vile – come diceva Oriana Fallaci – vi state facendo invadere senza dire nulla! (Il Presidente toglie la parola all'oratore)

  Γεώργιος Παπανικολάου (PPE). - Κύριε Πρόεδρε, και για μένα είναι η τελευταία μου παρέμβαση στο Ευρωπαϊκό Κοινοβούλιο και θέλω να ευχαριστήσω όλες και όλους τους συναδέλφους για την υπέροχη συνεργασία που είχαμε στη διάρκεια των πέντε ετών που πέρασαν. Υπήρξε για μένα πραγματικά προνόμιο η συνεργασία και η ανταλλαγή απόψεων που είχαμε, με τις καλές αλλά και με τις πιο δύσκολες στιγμές, όλα αυτά τα χρόνια, στην Επιτροπή Πολιτικών Ελευθεριών, Δικαιοσύνης και Εσωτερικών Υποθέσεων, και ιδιαίτερα για τα θέματα της μετανάστευσης. Σας ευχαριστώ μέσα από την καρδιά μου, σας διαβεβαιώνω ότι αυτές οι εμπειρίες θα με συνοδεύουν για πάντα και βεβαίως εύχομαι να κρατήσουμε επαφή τα χρόνια που έρχονται.

Κυρίες και κύριοι, η Ελλάδα τα χρόνια αυτά έκανε και εξακολουθεί να κάνει ό,τι μπορεί σε σχέση με τη μετανάστευση. Η Ελλάδα βρέθηκε στο επίκεντρο τόσο της οικονομικής κρίσης όσο και της κρίσης της μεταναστευτικής μας πολιτικής. Διότι, πράγματι, ο ευρωπαϊκός Νότος πιέστηκε τα προηγούμενα χρόνια και συνεχίζει ακόμη να πιέζεται· η ευρύτερη γειτονιά μας βρίσκεται σε αναταραχή και για αυτό εκατοντάδες υπήκοοι τρίτων χωρών καθημερινά φθάνουν στον ευρωπαϊκό Νότο.

Τι έκανε η Ελλάδα; Πραγματικά έκανε και κάνει ό,τι μπορεί. Αξιοποίησε κάθε ευρωπαϊκή δυνατότητα και κάθε ευρωπαϊκό πόρο. Έφτιαξε νέα κέντρα φιλοξενίας και υποδοχής υπηκόων τρίτων χωρών και κατήργησε εκείνα που δεν λειτουργούσαν σωστά. Οι ροές στον Έβρο σταμάτησαν χάρις στην προσπάθεια των ελληνικών αρχών με την συνδρομή της Frontex. Οι αξιολογήσεις του Σένγκεν δείχνουν πλέον την προσπάθεια που κάνει η Ελλάδα. Δημιούργησε νέα Υπηρεσία Ασύλου, και πλέον τα αιτήματα ασύλου απαντώνται θετικά στην Ελλάδα σε ποσοστά πολύ μεγαλύτερα από τον ευρωπαϊκό μέσο όρο. Όλο αυτό το διάστημα, η Ελλάδα εξακολουθεί να ζητεί την αλληλεγγύη της Ευρώπης και εξακολουθεί να ζητεί από την Ευρώπη μια ολοκληρωμένη μεταναστευτική πολιτική.

Τι κάνει η Ευρωπαϊκή Ένωση; Δεν κάνει ό,τι μπορεί. Η Ευρωπαϊκή Ένωση δεν κατάφερε να αλλάξει το άδικο "Δουβλίνο ΙΙ" και δεν κατάφερε να δημιουργήσει τον μηχανισμό εσωτερικής επανεγκατάστασης, τον μηχανισμό που εμείς ζητούμε από την αρχή και η Επιτροπή είχε υποσχεθεί να τον προχωρήσει. Δεν μπόρεσε να προχωρήσει σε δίκαιη κατανομή των βαρών. Δεν μπόρεσε να πείσει όλα τα κράτη μέλη ότι χρειαζόμαστε μια ολοκληρωμένη μεταναστευτική πολιτική με αλληλεγγύη, με δίκαιη κατανομή των βαρών, με κατανομή της ευθύνης σε όλους.

Εύχομαι, κύριε Πρόεδρε, οι συνάδελφοι στην επόμενη κοινοβουλευτική περίοδο να αναδείξουν τα ζητήματα αυτά για να μπορέσουμε να συνεχίσουμε όλοι μαζί να παλεύουμε για μια ολοκληρωμένη μεταναστευτική πολιτική που θα έχει στο επίκεντρό της τον άνθρωπο, τα δικαιώματα όλων των υπηκόων τρίτων χωρών και, πάνω από όλα, την Ευρώπη.

  Jean Lambert (Verts/ALE). - Mr President, I trust our excitable friend is now lying down in a darkened room. I was one of those who negotiated the Return Directive. Certainly the section on detention was an extremely difficult one and I think that the results are not results which we should necessarily be proud of, but the directive is extremely clear that any detention shall only be maintained as long as removal arrangements are in progress and executed with due diligence.

So that means that things have to be moving, people have to be informed of what is happening and if that is not the case they should not be in detention. The courts are clear on this, UNHCR has raised questions about the changes going on in Greece, but I think we also have some issues here in terms of the follow-up to the Stockholm Programme, in what we are doing that actually helps make returns sustainable in terms of preparation, prospects and indeed follow-up, to find out what actually does happen to people on return.

We have reports – verified reports – of people tortured on return, for example to Sri Lanka and indeed other countries. I think we also need to be paying more attention to those who cannot be returned, either because of the lack of cooperation of the country of return or the situation in that country and of those who are actually stateless. We have to avoid deliberately making people destitute and potential victims of criminals who prey on the vulnerable.

  Γεώργιος Παπανικολάου (PPE), ερώτηση “γαλάζια κάρτα”. – Πολύ σύντομα, θέλω να ευχαριστήσω την κυρία Lambert για τη συνεργασία που είχαμε όλα αυτά τα χρόνια και, ολοκληρώνοντας αυτό που έλεγα πριν, θέλω να τονίσω ότι ο λόγος για τον οποίο δημιουργούνται αυτά τα προβλήματα είναι η ανυπαρξία μιας ολοκληρωμένης πολιτικής για τις επανεισδοχές και η έλλειψη συνεργασίας με τις τρίτες χώρες. Υπογράψαμε τώρα τη συμφωνία με την Τουρκία αλλά βλέπουμε όμως ότι σε πολλές συμφωνίες υπάρχουν προβλήματα. Συμφωνείτε ότι η συνεργασία πρέπει να ενταθεί και ότι πρέπει να εφαρμόζονται οι συμφωνίες επανεισδοχής με τις τρίτες χώρες;

Ευχαριστώ πολύ, και πάλι, για όλα όσα ζήσαμε αυτά τα χρόνια.

  Jean Lambert (Verts/ALE), blue-card answer. – I think we have at least been able to talk to each other sensibly about these extremely difficult issues over the past. As a political group, we have problems with the readmission agreements, particularly when they are linked to questions of trade, because the readmission agreement is about individuals – human beings – and how we actually treat them. In terms of an integrated approach, I think you are right. The European Union is very good at having a sort of piecemeal approach, but it has not looked at how these approaches actually work together, either for the benefit of the individuals concerned, or indeed for that of the societies in which they are moving.

  Marie-Christine Vergiat (GUE/NGL). - Monsieur le Président, curieux avis que celui que vient de prendre le conseil d'État grec. S'agit-il vraiment d'un avis juridique?

Selon la directive Retour, qui n'est pourtant pas la panacée, la rétention doit rester exceptionnelle et ne peut excéder 18[nbsp ]mois. Or, elle devient la règle et on cherche à la prolonger par tous les moyens. Cette durée maximum est déjà appliquée par les autorités grecques. Le conseil d'État grec a estimé que la détention pouvait être d'une durée indéfinie jusqu'à ce que les migrants coopèrent.

Non, il n'y a pas d'invasion des migrants. C'est en parlant comme cela que l'on trahit l'Europe et ses soi-disant valeurs. L'ONU et le conseil d'État condamnent les États membres dans ce domaine. Et si l'on n'avance pas, c'est parce que les États les plus concernés ne le veulent pas. La seule solidarité dont ils veulent entendre parler, c'est d'une solidarité financière.

La Commission doit clairement condamner de telles pratiques. Le bilan de la directive Retour peut nous en donner l'opportunité.

Je voudrais savoir, Monsieur le Commissaire, ce que vous entendez quand vous nous dites que la Grande-Bretagne s'est dispensée d'appliquer la directive Retour?

Il faut agir vite car nous pouvons craindre un effet de contagion. La Commission est trop hésitante en la matière. Elle devrait faire preuve de la même ténacité qu'elle a en matière économique.

  Philip Claeys (NI). - Als er in sommige lidstaten illegale vreemdelingen zijn die langer dan 18 maanden vastgehouden worden, dan heeft dat een reden. In de overgrote meerderheid van de gevallen heeft dat te maken met het feit dat de landen van herkomst deze illegalen weigeren terug te nemen, of met het feit dat veel illegalen zelf weigeren te zeggen welke nationaliteit zij hebben of waar zij vandaan komen, in de hoop dat zij zo niet teruggestuurd kunnen worden.

Alles zou moeten worden gedaan om dit soort toestanden te vermijden, maar de Commissie en dit Parlement doen net het tegenovergestelde. De regelgeving zit zo in elkaar dat de rechten van illegale vreemdelingen zwaarder doorwegen dan de rechten van de lidstaten en de burgers van die lidstaten. Wanneer men vaststelt dat sommige elementen van de terugkeerrichtlijn door de lidstaten moeilijk kunnen worden nageleefd, dan moet die terugkeerrichtlijn aangepast worden. Die maximumperiode van 18 maanden detentie, bijvoorbeeld, moet kunnen worden verlengd. Dat moet er gebeuren, in plaats van sancties te willen opleggen aan de lidstaten die effectief illegale immigratie willen bestrijden.

Opnieuw wordt duidelijk hoe de EU elke voeling met de realiteit is kwijtgespeeld, maar het oordeel van de kiezers op 25 mei, binnen enkele weken, zal des te harder zijn.

  Hélène Flautre (Verts/ALE). - Monsieur le Président, les gens dont on parle ici ne sont pas des gens qui sont à l'extérieur de l'Union européenne. Ce sont en général des personnes qui ont vécu plusieurs années –[nbsp ]voire quelquefois jusqu'à une dizaine d'années[nbsp ]– en Europe, qui y ont travaillé –[nbsp ]souvent de manière clandestine[nbsp ]–, qui y ont parfois fondé des familles et qui, un beau jour, parce que leur titre de séjour n'est pas en règle, vont se trouver confrontées à des procédures extrêmement violentes d'arrestation, d'enfermement, de séparation et d'expulsion. Voilà ce dont nous parlons.

Ces procédures sont extrêmement violentes, elles entraînent donc énormément de violations des droits. C'est pourquoi il faut être absolument intraitable. Quand nous dénoncions, à l'époque, la directive Retour –[nbsp ]nous l'appelions à l'époque la directive de la honte[nbsp ]–, que voulions-nous dire? Nous voulions contester le fait que cette directive consacrait au fond l'enfermement et l'expulsion comme un mode de gestion des politiques migratoires de l'Union européenne. Là est le problème fondamental!

Il existe –[nbsp ]on ne l'a jamais contesté[nbsp ]– un certain nombre de garanties sur la durée et les conditions de rétention, sur l'accessibilité des centres de rétention et sur l'enfermement comme dernier recours. Elles ne sont toutefois pas respectées dans la plupart des États membres! Votre communication le dit d'ailleurs tout à fait explicitement.

Je crois qu'il ne faut pas tergiverser une seule seconde. Il faut lancer des procédures d'infraction à l'encontre des États membres, il faut être extrêmement catégorique! Parce que les violations sont insupportables et sont une honte pour l'Europe!

  Andrew Henry William Brons (NI). - Mr President, there is a principle in English civil law called ‘to one who is willing, no harm is done’. In other words, you cannot sue if you put yourself in danger of loss or injury. These illegal immigrants were not kidnapped in their own countries by wicked Europeans who then brought them to Europe and incarcerated them for eighteen months or more. They chose to enter an EU country illegally and then avoided being repatriated. Presumably they are free to return to their countries of origin, but refuse to do so.

We have heard that illegal immigrants – those who do not leave – are usually given a piece of paper ordering them to leave, in order to avoid them disappearing. If their stay is a long one it is usually because of extensive court actions to avoid repatriation. While talking about a breach of the Returns Directive, we learned in the Committee on Civil Liberties, Justice and Home Affairs on 31 March that in 2012 only 37% of those given a return decision eventually left. The other 63% remained.

  Janez Potočnik, Member of the Commission. - Mr President, first, I would like to clearly say that I wish to express the Commission’s commitment to do everything in its power to bring all Member States into line with the requirements of the directive. I was also clear that our eyes are focused in the Greek case on the problem, where we also share your view that the problem potentially really exists there.

What we are doing? We are constantly monitoring in all cases what is happening in all Member States, that support is clearly done through the European Return Fund. We are regularly visiting the places and trying to make improvements. Concerning the things you mentioned about infringements, it is true that there are no infringements yet, but we are monitoring Member States and dialogue with them has already resulted in quite a few cases in positive changes. We have launched a few pilot cases, which means that this is a kind of pre-infringement monitoring which the Commission is doing, and of course, if necessary, we will not shy away from opening the infringements.

I have also heard from your side quite clearly that you are not entirely satisfied with the situation on the ground and also with how the Commission is dealing with handling the problems, and that some of the replies in my original initial statement were weak. I of course took that point. I can promise you that I will forward your worries and criticism to my colleague, and try to make sure that we address it properly.

Finally, I would like to say that concerning the case of the United Kingdom, it has the possibility to opt out on the Treaty basis in this area and has decided to do so. That is simply a fact of life. Since this is also my last speech in this European Parliament, I would like to thank you all for your work and for your cooperation and of course I wish good luck to all those who wish to return to this Parliament.
