  Roberto Gualtieri, relatore. - Signor Presidente, onorevoli colleghi, signor Commissario, il Parlamento è stato chiamato ad esprimersi in procedura di consultazione sulla proposta di revisione presentata al Consiglio da parte della BCE del regolamento sulla raccolta di informazioni statistiche. Un regolamento che insieme a quello sui poteri della BCE di imporre sanzioni costituisce uno dei pilastri dell'attività statistica della Banca centrale europea. La motivazione della proposta risiede nell'entrata in vigore del meccanismo unico di supervisione bancaria che conferisce nuovi poteri alla BCE e rende quindi necessario un aggiornamento dei meccanismi di raccolta e di trattamento dei dati statistici.

Una volta adottato, l'atto legislativo consentirà alla BCE di utilizzare informazioni statistiche riservate in modo simile a ciò che fanno le banche centrali nazionali, che svolgono funzioni in materia di vigilanza prudenziale. Inoltre la BCE avrà la possibilità di diffondere informazioni statistiche riservate alle autorità nazionali responsabili della vigilanza finanziaria o della stabilità del sistema finanziario, nonché al meccanismo europeo di stabilità nella misura e al livello di dettaglio necessari per lo svolgimento dei rispettivi compiti.

La posizione approvata lo scorso 11 novembre dalla commissione ECON accoglie le proposte della BCE completandole con una serie di suggerimenti volti ad estendere il campo di applicazione della relazione. Gli emendamenti che ho presentato in qualità di relatore mirano a garantire una più adeguata trasmissione dei dati e una maggiore tutela della loro confidenzialità. In particolare un emendamento introduce l'obbligo per le autorità e gli organismi, incluso l'ESM, che ricevono le informazioni statistiche riservate di adottare tutte le misure necessarie per garantirne la protezione.

La commissione ECON ha poi approvato altri emendamenti che rafforzano alcuni punti non trattati dalla raccomandazione della BCE. In particolare viene rafforzata la trasparenza negli atti della BCE in campo statistico, chiedendo che quest'ultima renda pubbliche le decisioni di esentare particolari categorie di soggetti dagli obblighi di segnalazione. Inoltre, viene chiesto di estendere la tipologia dei dati raccolti, in modo da includere anche quelli grezzi. Viene poi aggiunto un riferimento importante al principio di proporzionalità, nella definizione e nell'imposizione degli obblighi di segnalazione statistica. Infine, per quanto riguarda la parte sanzionatoria, viene introdotta una chiara distinzione tra condotta negligente o intenzionale nei casi di infrazione e nella trasmissione dei dati da parte degli agenti statistici, un aspetto particolarmente rilevante proprio nell'ottica del rispetto del principio di proporzionalità. L'adozione di questa revisione riveste quindi una particolare importanza, perché rientra nel quadro più generale di potenziamento dei compiti di supervisione della BCE nell'ambito del disegno di Unione bancaria.

Mi auguro quindi che il Parlamento voglia accogliere favorevolmente le indicazioni della commissione ECON per consentire una veloce adozione da parte del Consiglio e anche naturalmente che il largo consenso che si è manifestato intorno alla relazione, per la quale ringrazio i relatori ombra e i gruppi politici per la loro cooperazione, fornisca un ulteriore incentivo al Consiglio per prendere in considerazione le raccomandazioni della commissione ECON.

  Kay Swinburne, rapporteur. - Mr President, may I extend a welcome to Commissioner Hill. I would like to begin by thanking Mr Johan Van Overtveldt for the excellent work he did in drafting this initial report before leaving Parliament to become Belgian Finance Minister. I have tried to continue working on this report using his methods and vision.

I would also like to thank the shadow rapporteurs from all the political groups for their cooperation on this report and, despite some of the differences on minor parts of the report, I hope this goodwill will extend to the overall report being voted through tomorrow.

In the last Parliament we made an unprecedented change to the role of the European Central Bank. Instead of just acting as a central bank with power over monetary policy, we gave it powers to supervise the largest banks in the eurozone, with the option for those Member States outside the eurozone to also join the single supervisory mechanism.

The Banking Union has fundamentally changed the role and responsibility of the ECB. While the ECB should continue to be independent from political influence in terms of monetary policy, it is imperative that in its new function as banking supervisor it is accountable. During earlier trialogues the Parliament tried to include scrutiny processes and transparency in the ECB’s operations and was often rebuffed, yet we did make some huge steps forward in terms of information-sharing with Parliament, so some democratic accountability is present within the process.

I have tried in this report to continue in this vein, adding accountability and transparency wherever possible. In the initial draft of this regulation, when the ECB imposed a sanction upon a financial institution it could decide whether or not this sanction was made public. There were no conditions or time limits attached. It was entirely within their mandate to decide on whether or not to disclose. While I can see reasons why, in some circumstances, not immediately publishing the fact that they have been sanctioned might be necessary, for example in the case of a wider financial crisis situation or, indeed, worries about bank runs, this should not be the norm. The normal operating procedure should be immediate public disclosure. The prospect of a fine may not faze large financial companies, but being on the front page of every newspaper poses a much larger reputational risk. For this reason we have a compromise between political groups to ensure a three-year time limit so that the ECB cannot wait any longer to disclose the fact that they have sanctioned a financial firm.

I am disappointed that there is one area that we have not been able to find a compromise on so far. I am a firm believer in the concept of innocent until proven guilty. Therefore, if we consider that part of the punishment for breaking the rules is that of reputational damage, using a ‘naming and shaming’ approach, then it seems to me logical that if a decision is subject to an appeal and may still be overturned, we should allow a longer time period before disclosure to the wider market. Failing to provide this safeguard may otherwise cause a bank to lose significant value in its share price based solely on accusations that are later overturned on appeal. I believe adding in this safeguard ensures the fairness of the disclosure process and will increase the effectiveness of the sanctioning regime, which will then increase the effectiveness of the ECB itself when exercising its supervisory powers.

I therefore hope that the majority of the European Parliament political groups can continue to support this centrist position calling for increased transparency. Specifically on the Gualtieri report I have little to add, because quality of regulation depends on quality of the statistics that the supervisors are working on. I honestly believe that the only way we get good quality supervision is good-quality data. Therefore I hope the proposals in these two reports are supported tomorrow.

  Jonathan Hill, Member of the Commission. - Mr President, I am grateful for the opportunity to discuss ECB sanctions and ECB statistical information, and I would like to congratulate Ms Swinburne and Mr Gualtieri on their work. The ECB sanctions recommendation is important because it is part of implementing the banking union, and we need it because it will give the ECB the means to enforce EU banking law and its decisions. So the Commission fully supports the objectives of the ECB recommendation.

Since sanctions can have a major financial and reputational impact on banks and can be subject to legal challenge, the rules should be clear and consistent and provide legal certainty. So the Commission has no serious concerns with the approach taken by the ECB in its recommendation and by Parliament in its opinion.

The Commissionʼs legal services have, however, detected two legal inconsistencies between the ECB recommendation and Parliament’s draft opinion, on the one hand, and the Regulation on the Single Supervisory Mechanism (SSM) on the other. One of those points relates to a legal-base issue and concerns the power to sanction not only the ECBʼs own decisions and regulations, but also directly-applicable Union law, and the other point refers to the publication of sanctions.

The ECB and Parliament’s opinion, as we just heard, proposed to grant the ECB the flexibility to delay publishing sanctions until after any appeal has been concluded. Personally, I understand the logic of that approach and I can see why the ECB might want this discretion. There is, however, a legal inconsistency with the SSM Regulation, which states that the ECB shall publish a sanction whether there has been an appeal or not. I think, therefore, it is worth having a look at this point in order to try to resolve it in a common-sense way.

In terms of next steps, the Commission will adopt its own opinion in the weeks to come, and we will continue to work with the Council, the ECB and Parliament to ensure that the ECB possesses all the tools necessary for the effective enforcement of the applicable EU banking rules.

As far as statistical data is concerned, the Commission issued its opinion on 13 October. We welcome the ECB’s proposal to align the Regulation on the collection of statistical information to the central bank’s new competences in the area of prudential supervision of credit institutions.

The proposed changes will enable the transmission of confidential statistical information between all authorities responsible for supervision and macro-prudential oversight. It will also minimise the reporting burden on undertakings by ensuring that data needs to be collected only once, so we welcome the report of the European Parliament and we agree with Parliament’s view expressed in the Committee on Economic and Monetary Affairs (ECON) report on the confidentiality of statistical information and are happy with what they propose in this respect.

  Burkhard Balz, im Namen der PPE-Fraktion. – Herr Präsident! Als EVP-Fraktion begrüßen wir natürlich die heutige Debatte, bei der es um eine Klarstellung der Kompetenzen der EZB und des SSM bei den Statistikanforderungen und den Sanktionsmöglichkeiten geht. EZB und SSM können hier nicht schalten und walten wie sie möchten. Der ECON-Ausschuss hat seine Position bereits kundgetan, und ich kann sagen, dass wir Parlamentarier unsere Kontrollfunktion in diesen beiden Punkten auch ausüben werden.

Bei den Statistikanforderungen muss die EZB gewährleisten, dass vertrauliche Daten auch vertraulich bleiben. Als EVP möchten wir unsere Bedenken dazu anmelden, wie umfassend der Datenanspruch der EZB werden könnte. Proportionalität ist hier ein wichtiges Thema. Es muss sichergestellt werden, dass die Berichtspflichten nicht Überhand nehmen, gerade mit Blick auf die kleinen und mittelgroßen Institute. Wir brauchen keine zusätzlichen separaten Datensammelstellen, wenn die nationalen Stellen ohnehin die entsprechenden Daten erheben. So muss der Vervielfältigung von Berichtswegen entgegengewirkt werden. Klare Strukturen sind wichtig, und die Grundlage dafür, dass die Datenerhebung und -auswertung gut funktionieren. Das, was wir als Gesetzgeber in den sektoralen Richtlinien beschlossen haben, muss berücksichtigt werden und darf am Ende von der EZB nicht ausgehebelt werden. Das muss auch für den Berichtsumfang und für die Berichtsrhythmen gelten.

Bei den Sanktionsmöglichkeiten möchten wir betonen, dass die Zusammenarbeit mit den nationalen Behörden wichtig ist. Die EZB und der SSM sind an Vertraulichkeit gebunden. Veröffentlichungen sind dann möglich, sobald der Rechtsweg ausgeschöpft ist. Darüber hinaus möchte ich noch die internationale Komponente hervorheben. So spielt die Frage der gleichen Wettbewerbsbedingungen hinsichtlich der Verhältnismäßigkeit von Strafzahlungen ebenfalls eine Rolle. Der ECON-Ausschuss hat sich dafür ausgesprochen, dass hier ein internationaler Austausch dazu stattfindet.

  Costas Mavrides, on behalf of the S&D Group. – Mr President, this review of the existing regulation regarding the ECB’s powers to impose sanctions on undertakings for failure to comply with regulations and decisions was made in order for the ECB’s tasks to be in line with the Single Supervisory Mechanism Regulation. The scope of the ECB’s powers to impose sanctions was extended in order to establish a coherent regime for the imposition by the ECB of all administrative penalties relating to the performance of its supervisory tasks.

In this aspect, in the Committee on Economic and Monetary Affairs our proposal to the Council aims to improve the text concerning several points, including the following three: firstly, it emphasises that the ECB shall act based on equal treatment of credit institutions and without any discrimination against any Member State; secondly, it specifies that the period to impose penalties starts to run from the date on which the decision was taken to initiate infringement procedures, rather than the date on which the infringement occurred; and thirdly, it ensures transparency by publishing the decision without undue delay, with a possibility to delay publication until three years after the date on which the decision was taken in the event that immediate publication would jeopardise the stability of financial markets.

At this point I would like to raise our great concern regarding the PPE’s amendment introducing a broader derogation which allows delaying, in an open-ended manner, the publication of the decisions imposing penalties with the phrase ‘until all legal means of appeal have been exhausted’. This wording is in contradiction with the transparency principle. We strongly believe that there could have been a way to have a balanced phrase servicing transparency and fairness.

  Stanisław Ożóg, w imieniu grupy ECR. – Panie Przewodniczący! Panie i Panowie! Ostatni kryzys finansowy doprowadził do zachwiania zaufania do sektora bankowego. Bardzo ważne jest zagwarantowanie takiego nadzoru i przejrzystości przepisów, aby w przyszłości zapobiegać sytuacjom, jakie miały miejsce przed kryzysem i w jego trakcie. O ile odpowiednie wykorzystanie i wymiana informacji statystycznych pomiędzy poszczególnymi organami to elementy kluczowe, to jednak należy zapewnić ochronę odpowiednich informacji poufnych czy też wrażliwych. Zgadzam się co do zasady z treścią obu sprawozdań i uważam, że zaproponowane przez Parlament poprawki są dobrze wyważone, ale obawiam się politycznego zagrożenia wynikającego z przesunięcia tak ważnych kompetencji krajowych na poziom Unii Europejskiej. Ponieważ jednak zapisy są elementem dużo większej układanki dążącej do głębokiej integracji systemów – i to nie tylko finansowych – państw członkowskich, pragnę podkreślić swój sceptycyzm.   Cora van Nieuwenhuizen, namens de ALDE-Fractie. – Allereerst wil ik graag de beide rapporteurs alsook de andere collega's die een bijdrage hebben geleverd aan deze verslagen, heel hartelijk danken voor het werk dat zij hebben verricht.

De afgelopen jaren hebben aangetoond dat inadequaat toezicht op de banken desastreuze gevolgen kan hebben voor de stabiliteit van financiële markten en voor de economie als geheel. Nu op 4 november de Bankenunie van start is gegaan en daarmee de belangrijkste Europese banken onder direct toezicht van de ECB zijn gesteld, is het dan ook van het grootste belang dat de ECB snel, juist en effectief kan optreden, wanneer banken regels overtreden die ons terug kunnen leiden tot de praktijken en de problemen van vóór en tijdens de financiële crisis.

Daarom zijn de onderwerpen van deze twee verslagen ook zo belangrijk. Bij het werken aan en het beoordelen van deze verslagen zijn voor ons de volgende drie zaken leidend geweest: allereerst het versterken van de financiële sector. Adequaat toezicht en het aanpakken van misstanden in de bankensector zijn noodzakelijk om het vertrouwen, zowel binnen Europa als internationaal, in de Europese bankensector te herstellen. Tegelijkertijd moeten ook de financiële geloofwaardigheid en weerbaarheid van de sector worden versterkt. Boetes, opgelegd aan banken die zich niet aan de regels houden, moeten daarom gaan naar het versterken van het bankenresolutiefonds, onder het motto "de vervuiler betaalt".

Het tweede punt is het voorkomen van financiële instabiliteit. Dit betekent dat onderzoeken naar overtredingen door banken binnen een redelijke termijn moeten worden opgestart en afgerond. Waarborgen van financiële stabiliteit houdt ook in dat eventuele beslissingen omtrent sancties of boetes gepubliceerd worden op het moment dat de uitkomsten van die onderzoeken definitief zijn.

Het laatste punt dat ik zou willen noemen is het verbeteren van de informatievoorziening door banken aan toezichthouders. Dat moet wat ons betreft ook zo effectief mogelijk gebeuren en wij steunen dan ook de amendementen die dit mogelijk maken.

  Sven Giegold, im Namen der Verts/ALE-Fraktion. – Herr Präsident, liebe Kolleginnen und Kollegen, liebe Kay Swinburne! Wir sind uns bei diesen Berichten ja weitgehend einig. Es gab nicht viele Konflikte. Vielen Dank für die gute Kooperation. Ich habe vor allem zwei Dinge anzusprechen. Der erste Punkt betrifft die Statistik für die gemeinsame Aufsicht durch die Europäische Zentralbank. Hier scheint mir das Problem weniger in der Gesetzgebung als in der Praxis zu liegen. Da frage ich mich schon, ob es adäquat ist, dass die EZB jetzt bis zu 50 000 Euro herunter eine Art Kreditregister schafft und danach bis in die kleinste Bank über Daten über jede einzelne Kreditbewegung verfügt. Ich frage mich schon, wer dort eigentlich auf das Proportionalitätsprinzip achtet. Wir haben dort – Herr Balz verwies auch schon darauf – eher Probleme mit der Mehrfachberichterstattung und einer Tendenz zum Übereifer. Vielleicht kann sich die Kommission das auch einmal anschauen, ob das mit den Prinzipien der Proportionalität übereinstimmt.

Zu den Sanktionen, und das ist ja der Hauptstreitpunkt, den wir hier noch haben: In der Frage, ob Sanktionen nun direkt veröffentlicht werden sollen, selbst dann, wenn ein Widerspruch eingelegt wird, ist unser Rechtsgrundprinzip eigentlich sehr klar. Aus rechtsstaatlicher Perspektive ist es eigentlich eine Art Vorverurteilung, wenn man sich rechtsstaatlich gar nicht mehr gegen eine Sanktion wehren kann, da diese Sanktion durch die Veröffentlichung faktisch bereits eingetreten ist. Daher unterstützen wir grundsätzlich das Anliegen der EPP zu sagen, dass das nicht passieren sollte. Allerdings würde ich gerne von der Kommission wissen, ob sie einen Weg sehen, wie man die Probleme mit Artikel 18 Absatz 6 der SSM-Verordnung lösen kann?

  Patrick O’Flynn, on behalf of the EFDD Group. – Mr President, at the last meeting of the meeting of the Committee on Economic and Monetary Affairs I told Mr Draghi that I felt sorry for him – and I still do. The problem here is that you can make as many ad hoc adjustments to the powers and remits of the ECB and its quangos as you like, but you will still have a seriously suboptimal currency zone. Only by abolishing national governments, national elections and, indeed, any feeling of national identity among national populations could you create the conditions for a smooth-running single currency zone. You would need popular consent for massive and permanent transfer payments from the stronger parts of the zone to the weaker. You would need to deploy ruthless political power to impose structural and, indeed, cultural changes on the non-powerhouse nations.

You do not have any of this, and I, for one, pray you never get it, because the right outcome is to dismantle the euro and let national currencies presided over by national governments accountable to national populations come into being once again. That way, interest rate decisions could be taken to suit national economies and the exchange rate could serve as an adjustment mechanism to protect economic activity in the weaker parts. Your wish to indulge in incremental deepening of the ECB is perhaps understandable in the circumstances, but this is a bodged repair job on a fundamentally unsound vehicle. It is time you allowed the peoples of Europe to cut their losses. It is time to send the euro to the scrapyard.

  Michał Marusik (NI). - Panie Przewodniczący! Szanowni Państwo! Skoro siedzimy tutaj prawie do północy, to znaczy, że nie są nam te sprawy obojętne. Koncentrujemy się na szczegółach funkcjonowania Europejskiego Banku Centralnego, tymczasem kryzys, jakiego się obawiamy, ma swoje podłoże zupełnie gdzie indziej – ma swoje podłoże w samej ustrojowej istocie tej instytucji jaką jest Europejski Bank Centralny. Przecież bank ten funkcjonuje jako instytucja kontrolująca wypływ pieniądza euro. Ma to takie skutki, że inflacja, czyli deprecjacja waluty euro, daje zyski temu bankowi centralnemu w ilości emitowanego pieniądza, natomiast daje równocześnie takie same straty wszystkim użytkownikom tej waluty, deprecjonując ten pieniądz, i to jest podłoże kryzysu. Wszystkie gospodarki narodowe zatrzymywały dotychczas swoje pieniądze w swoich budżetach i w swoich bankach narodowych, dopóki posługiwały się walutami narodowymi. A w tej chwili tuczymy gigantycznego pasożyta Europy, który jest przyczyną kryzysu tejże Europy i nie możemy, analizując drobiazgi, gubić tak ważnego czynnika, który zatrzymał nam rozwój. Powinniśmy się dalej rozwijać i wrócić do tradycyjnych walut narodowych. Dziękuję bardzo.

  Markus Ferber (PPE). - Herr Präsident, Herr Kommissar, liebe Kolleginnen, liebe Kollegen! Es geht hier nicht um die Frage, Euro ja oder nein, sondern es geht darum, wie bei der Bankenunion die Europäische Zentralbank in die Lage versetzt wird, ihre Aufgabe zu erfüllen. Dafür braucht sie statistisches Material, und dazu muss sie auch in der Lage sein, für die Banken, bei denen sie Aufsichtsaufgaben übernommen hat, entsprechend Sanktionen zu verhängen, wenn die Vorgaben der Aufsicht nicht erfüllt werden. Also alles das, was nationale Aufsichtsbehörden bisher gemacht haben, muss für die Banken, die unter der Kontrolle der EZB stehen, auf die EZB übertragen werden. Deswegen begrüßen wir als EVP-Fraktion die beiden Vorschläge.

Ich will mich besonders auf das Thema Sanktionen konzentrieren, weil ich das für meine Fraktion bearbeiten durfte. Hier geht es schon darum, dass wir keine Doppelbestrafung vornehmen – das heißt Veröffentlichungspflichten erst dann, wenn auch der Rechtsweg abgeschlossen ist. Ich halte das für ein normales Vorgehen, wie es auch bei den nationalen Aufsichtsstrukturen üblich ist.

Zum Zweiten haben wir noch die spannende Frage zu beantworten, wohin das Geld fließt. Ich bin doch überrascht, dass der Abwicklungsmechanismus jetzt plötzlich über Sanktionen finanziert werden soll. Ich würde mich freuen, wenn die Kolleginnen und Kollegen, die das beantragt haben, darüber nachdenken, ob das Sinn und Zweck dieser Übung ist. Ich kann nur darauf hinweisen, dass es nicht helfen wird, den Abwicklungsfonds sehr schnell mit sehr viel Geld zu füllen. Die administrativen Sanktionen, um die es hier geht, sind in seltenen Fällen mit hohen Beiträgen bemessen.

Wir haben als EVP-Fraktion auch beantragt, dass ein internationaler Austausch stattfindet. Ich hoffe, dass der Rat insbesondere dieses Thema aufgreift.

  Jonás Fernández (S&D). - Señor Presidente, la unión bancaria está en marcha. El mecanismo único de supervisión, encabezado por el Banco Central Europeo, ha iniciado ya su trabajo y próximamente tendremos un fondo de resolución bancaria a la espera, señor Hill, de una nueva iniciativa para aprobar un seguro de depósitos. En todo caso, la financiación prevista en el actual fondo de resolución es muy escasa: apenas serán 55 000 millones de euros para 2024.

Por ello, el Grupo socialista ha presentado una enmienda que pretende que los ingresos correspondientes a las sanciones impuestas por el BCE dentro de su labor supervisora puedan alimentar también ese fondo de resolución. Apoyaríamos, señor Ferber, una vía adicional de ingresos a ese fondo, que ahora mismo son muy escasos, y además, una vía plenamente europea.

Por este motivo, pido el voto a favor de nuestra enmienda en este Parlamento, porque fortalece el proyecto de unión bancaria, coadyuvando así una salida más rápida de la actual crisis.

An diesem Bericht ist nichts auszusetzen, wenn man die Bankenunion bejaht, wenn man es bejaht, dass die Europäische Zentralbank jetzt die Aufsicht über die wichtigsten Banken der Eurozone wahrnimmt. Aber das ist genau der springende Punkt. Die Frage ist: Soll eine Institution, die für die Geldversorgung zuständig ist, gleichzeitig auch die Aufsicht über das Kreditwesen innehaben? Bauen sich dort nicht Interessenkonflikte auf? Dass es solche Interessenskonflikte gibt, sehen wir schon daran, wie die Europäische Zentralbank jetzt Geldpolitik betreibt, indem sie am langen Ende der Zinsstrukturkurve mit dem Ankauf von ABS-Papieren Liquidität zur Verfügung stellt.

Dann haben wir eine Institution, die für unser Geld, für unser gesamtes Finanz- und Kreditwesen und für die Versorgung von Mittelständlern mit angemessenen Krediten zuständig ist oder sich zuständig fühlt. Das ist eine Superbehörde, die keiner demokratischen Kontrolle ausgesetzt ist. So etwas sollte man in Europa nicht dulden.

  Gerolf Annemans (NI). - Van de hier regerende meerderheid vandaag zetten wij alweer een nieuwe stap in het euro-verhaal dat op zichzelf allang totaal uit de hand is gelopen. Wij geven opnieuw bijzondere macht aan de Europese Centrale Bank, die zichzelf trouwens voordien stelselmatig bevoegdheden heeft toegeëigend die zij in feite niet had.

Het ritme waarmee hier in dit huis bevoegdheden aan technische en niet gekozen EU-instellingen worden overgedragen, heeft een nooit gekende snelheid bereikt en dat gebeurt steeds meer met het mes op de keel, namelijk het dwingende argument dat de munt en dus het maatschappelijke stabiele economische veld overeind moet worden gehouden. In uw omgekeerde wereld wordt ons, de critici en de sceptici van de Europese Unie, verweten dat wij de ideologie van het nationalisme willen opdringen, maar het is omgekeerd!

Wij pleiten tegen de euro, omdat die eenheidsmunt een politiek waanidee is. U bent de ideologisch verblinde EU-elite, vervreemd van het volk en van de slachtoffers van uw eenheidsmachine. Wij staan niet aan de ideologische, maar aan de pragmatische zijde, als wij zeggen dat een munt de weerslag moet zijn van een economische werkelijkheid.

  Romana Tomc (PPE). - Banke so zelo pogosto na naših urnikih, na našem dnevnem redu. Veliko se o njih pogovarjamo in zahvaljujem se obema poročevalcema za izredno dobro opravljeno delo.

Vsi se najbrž strinjamo, da je svetovna kriza, ki se je nekatere države Evropske unije počasi otepajo, je bila v veliki meri posledica napačnega upravljanja v bankah.

Govorim o bančnem sistemu, ki ni bil dobro upravljan, še manj pa dobro nadzorovan. In ker seveda ne želimo, da se zgodovina ponavlja, je bistvenega pomena, da je ECB varuh in zaščitnik interesov vseh nas, potrošnikov, naj bodo to varčevalci, podjetja, državne banke, kdorkoli.

Če želimo učinkovit sistem pa potrebujemo ustrezne vzvode. Uredbi ponujata te vzvode za večjo učinkovitost nadzora poslovanja, in to je dobro. Vendar večja pooblastila na drugi strani zahtevajo tudi večjo transparentnost, ki jo vsi pričakujemo.

  Theodor Dumitru Stolojan (PPE). - Domnule președinte, voi susține propunerile Consiliului de a pune în concordanță puterile conferite Băncii Centrale Europene cu noua funcție de supraveghere a celor mai importante bănci din Uniunea Europeană. Putem discuta că prin această putere, fără puterea de a aplica sancțiuni în cazul încălcării regulilor, a deciziilor Băncii Centrale Europene, precum și fără puterea de a obține informațiile necesare pentru exercitarea funcției de supraveghere, ar fi afectată credibilitatea întregului proces de supraveghere, precum și credibilitatea Băncii Centrale Europene.

De asemenea, aș dori ca Banca Centrală Europeană și Consiliul să țină seama de recomandările Parlamentului, deoarece acestea aduc mai multă claritate, atât în ceea ce privește transparența necesară proceselor respective, cât și în ceea ce privește relația dintre Banca Centrală Europeană și băncile centrale din statele membre.

  Luděk Niedermayer (PPE). - Mr President, first of all let me take this opportunity to congratulate the previous Parliament and the Council for guiding the process of the creation of Banking Union to the end. I think this is a fantastic success for Europe, and it is good for all of us. I also want to wish the ECB all the best. The process for us is almost, but not quite, at an end, because there are still some leftovers which we should work on, and we should also focus to make sure that the legislation works as intended. We are talking about what should be done: for example, I believe we should focus on the issue of emergency liquidity assistance in the environment of the Banking Union.

As regards the report, I think this was a good proposal and the Committee on Economic and Monetary Affairs (ECON) has done very good work, so let me first comment on the sanctions. To find a trade-off between transparency, efficiency and firmness is very difficult in the financial sector, because too early disclosure of the fines can be a very costly error. That is why I support the compromise reached by ECON. As regards statistics, as a former central banker, I have to say that statistical requirements imposed by the central banks are excessive. I would kindly ask the ECB and the Council to consider using the Banking Union to reduce the burden of statistics on the financial sector.

  Ivana Maletić (PPE). - Gospodine predsjedniče, poštovani povjereniče, poštovani izvjestitelji, preduvjeti učinkovitog nadzora su kvalitetni ulazni podaci s jedne strane, i snažno postupanje po uočenim nedostacima s druge strane. Ova dva izvješća osnažuju upravo to i pridonose tako jačanju bankovne unije, što nam je svima zapravo i cilj.

Upravo se zato u većem dijelu slažem oko predloženih izvješća i ova rasprava to i pokazuje. Slažem se da bi mogla obavljati svoju nadzornu ulogu, Europska središnja banka mora imati i pristup povjerljivim statističkim podacima. Ali, sustav pritom mora biti jasan i jednostavan te uzimati u obzir nacionalne procedure. Kada govorimo oo izricanju sankcija, nadzor moraju naravno pratiti i mjere kojima se banke ozbiljno potiče na rješavanje uočenih nedostataka.

Ali, pritom je važno dobro podijeliti uloge i prava na izricanje sankcija, supervizije na nacionalnoj i europskoj razini. Mislim da su zasad ova pitanja u izvješćima dobro riješena.

  Othmar Karas (PPE). - Herr Präsident, Herr Kommissar, meine Damen und Herren! Wir sagen uneingeschränkt Ja zur Bankenunion. Wir sind daher froh, dass in beiden Berichten zwei zusätzliche Instrumente für die EZB vorgesehen sind, nämlich Statistiken auf der einen Seite und der Sanktionsmechanismus auf der anderen Seite, um effizient in der Bankenunion tätig sein zu können. Bei den Statistiken mangelt es noch an der Proportionalität. Die ist noch nicht ausreichend umgesetzt.

Beim Sanktionsmechanismus sagen wir klar Ja, denn eine Regelung ohne Sanktionen ist wie ein Fisch ohne Fleisch und wie ein Gebiss ohne Zähne. Aber wir wollen nicht doppelt bestrafen. Daher wollen wir eine Trennung zwischen dem Aussprechen der Sanktionen und der Veröffentlichung. Die Veröffentlichung sollte erst stattfinden, wenn der Rechtsweg ausgeschöpft ist, denn ansonsten käme es nicht nur zu einer doppelten Bestrafung, sondern auch zu einer starken Einflussnahme der Marktmechanismen, die unter Umständen auch Auswirkungen auf jene Banken und auf den Finanzmarkt generell haben, die vom Sanktionsmechanismus nicht direkt betroffen sind. Die Entwürfe sind ausgewogen und ein wichtiger weiterer Baustein, um unser Wirtschafts- und Finanzsystem sicherer und nachhaltiger zu machen.

  Γεώργιος Κύρτσος (PPE). - Κύριε Πρόεδρε, επιθυμώ να υποστηρίξω με την παρέμβασή μου την τροπολογία 4, δηλαδή τη διεθνή παγκόσμια διάσταση των κυρώσεων. Έχω την εντύπωση ότι οι ευρωπαϊκές τράπεζες που λειτουργούν στις Ηνωμένες Πολιτείες λειτουργούν κάτω από ένα πιο αυστηρό νομοθετικό διοικητικό πλαίσιο από εκείνο των αμερικανικών τραπεζών που λειτουργούν στην Ευρωπαϊκή Ένωση. Αυτό μπορεί να δημιουργήσει συνθήκες άνισου ανταγωνισμού σε μια παγκοσμιοποιημένη τραπεζική αγορά και μπορεί να λειτουργήσει ως ερέθισμα για να επιβάλει η αμερικανική πλευρά υπέρογκα πρόστιμα. Διαβάζοντας τον διεθνή Τύπο μπορεί να βρει κανείς τέτοιες περιπτώσεις. Νομίζω πάντως ότι με αυτή την τροπολογία κινούμαστε προς τη σωστή κατεύθυνση. Κατά τα άλλα, εκτιμώ ότι η εικόνα είναι καλή διότι βλέπουμε ότι υπάρχει πολιτική απόφαση για την τραπεζική ένωση και διότι παρατηρούμε ότι ο διοικητής της Ευρωπαϊκής Κεντρικής Τράπεζας είναι πολύ ικανός και παίρνει πρωτοβουλίες, με δυναμισμό και αποτελεσματικότητα. Νομίζω ότι οφείλουμε να πούμε καλά λόγια και για τον Λόρδο Hill διότι κινείται με χαρακτηριστική άνεση και αποτελεσματικότητα. Θεωρώ επίσης ότι και τα στελέχη της οικονομικής επιτροπής που είναι αρμόδια για όλους αυτούς τους χειρισμούς έχουν αποδείξει την καλή τους ποιότητα. Βλέπω επομένως ένα θετικό μήνυμα σε μια Ευρωπαϊκή Ένωση που δοκιμάζεται και αμφισβητείται.

  Νότης Μαριάς (ECR). - Κύριε Πρόεδρε, επανέρχομαι στο ζήτημα της σύγκρουσης συμφερόντων διότι η Ευρωπαϊκή Κεντρική Τράπεζα, όπως γνωρίζουμε, παίζει καθοριστικό ρόλο στην άσκηση της νομισματικής πολιτικής και μάλιστα με πάρα πολύ αυξημένες αρμοδιότητες. Ταυτόχρονα, έχει πλέον αποκτήσει τεράστιες εξουσίες εποπτικού ελέγχου και μάλιστα ελέγχει τις 130 συστημικές τράπεζες οι οποίες έχουν το 81% του συνολικού ενεργητικού του τραπεζικού τομέα. Είναι όμως και πιστωτής των κρατών, διότι έχει αγοράσει ήδη στη δευτερογενή αγορά και μάλιστα με έκπτωση κρατικά ομόλογα αξίας τουλάχιστον 217 δισ. ευρώ. Ταυτόχρονα, είναι και μέλος της τρόικας, ενεργώντας ως δήθεν τεχνικός σύμβουλος. Έχουμε μια σύγκρουση συμφερόντων και μια υπερενισχυμένη Ευρωπαϊκή Κεντρική Τράπεζα χωρίς να υπάρχει το αντίστοιχο πολιτικό δέος απέναντί της.

  Miguel Viegas (GUE/NGL). - Senhor Presidente, intervenho para denunciar o que entendemos ser um completo extravasamento do papel do BCE, no quadro do mandato que lhe é conferido pelos seus estatutos.

Paulatinamente, à medida que se foi aprofundando a crise da Zona Euro, o BCE foi estendendo o domínio das suas competências, imiscuindo-se cada vez mais na área económica. Começou por comprar quantidades industriais de dívida soberana no mercado secundário. Passou de emprestador de liquidez a financiador de longo prazo. Avança agora com a compra de ABS, títulos potencialmente tóxicos que ameaçam transformar o BCE numa autêntica lixeira.

Impõe hoje reformas estruturais aos Estados-Membros em domínios tão vastos como a saúde, a educação ou a segurança social. Com a supervisão bancária, assume poderes que mais nenhuma instituição europeia tem. Como é possível reunir na mesma instituição a política monetária e a supervisão bancária? É o próprio Friedman que deve estar neste momento a dar voltas no caixão.

Não é possível dar todos esses poderes ao BCE sem uma contrapartida ao nível da legitimação democrática. Todas as reformas, para além destas que estamos a discutir, implicam uma completa subversão das instituições, desvalorizam a voz dos cidadãos e afastam estes da vida democrática.

We are having a debate about two specific pieces of law, and yet some Members explain to us why the euro is not good; another complains about the Troika; and you give us general statements about the ECB. Can we not stick to good parliamentary discussion? We have had all the debates about the banking union, the euro and so on. Can you not stick to the topic of this debate? I must say that I am really annoyed about this. You must decide whether you want to be part of this debate here or not.

É que, de facto, não é possível mais o BCE resumir-se a uma função técnica. O BCE hoje tem uma missão política, e refugiar o domínio deste debate na questão estritamente técnica é um erro, e nós, enquanto nos derem voz, nós não permitiremos que isso aconteça.

  Jonathan Hill, Member of the Commission. - Mr President, the hour may be late but the debate has been an interesting one, and Mr Giegold brought us back to the technical nature of what we are here to discuss. It shows the significance of the implementation phase that we have entered into – into this area of financial services – and it underlines the old saying about the devil always being in the detail.

As I said at the beginning, the Commission has already adopted its opinion on the statistics recommendation, and it will adopt its opinion on the sanctions recommendation in the coming weeks. I have heard the comments made this evening by Members – some of whom are still here – about the importance of data remaining confidential, about proportionality in reporting, about equal treatment for all and the need for good supervision, and I will obviously reflect on those.

I am grateful to the ECB for having prepared the two recommendations, which I think provide a sound base for the European Parliament, the European Commission and the Council. I think it is essential that we have strong and legally sound sanctioning regimes in place. As I indicated earlier, there are some technical legal issues about the legal base of one of the recommendations, so I will continue to work closely with the Parliament, the ECB and the Council to see that we can get a balanced outcome, which I believe is what Members want. I would just like to end by thanking Ms Swinburne and Mr Gualtieri for their reports; they have given us all a lot to think about and they have pointed to some extremely helpful ways forward.

  Roberto Gualtieri, relatore. - Signor Presidente, onorevoli colleghi, penso che non avrò bisogno neanche di utilizzare tutti e due i minuti, perché mi sembra di rilevare che per quanto riguarda la relazione sulla raccolta di statistiche vi sia un largo consenso e anche una positiva sintonia con la Commissione europea. Quindi penso che domani andremo incontro ad un'approvazione largamente consensuale e ribadisco naturalmente l'auspicio che il Consiglio terrà conto delle nostre raccomandazioni e di quelle della Commissione.

Registro invece alcuni problemi politici e giuridici sull'altra relazione e naturalmente considero molto rilevanti le affermazioni del Commissario riguardo ai dubbi sulla base giuridica e sulla congruenza con il regolamento SSM e quindi auspico che naturalmente si tenga conto, anche nell'ambito del voto di domani sulla relazione Swinburne, di queste criticità e di questi elementi sicuramente molto rilevanti.

  Kay Swinburne, rapporteur. - Mr President, I call on my colleagues tomorrow to send a strong message to the Council on the need for increased transparency and public disclosure with respect to the sanctions. I appreciate that, as has become fairly obvious tonight, there is a matter outstanding that has proven to be very controversial: that of whether or not an appeal should be allowed before public disclosure.

I am sure the Commission will advise the Council on how they might balance the need for information to be made public versus the right of a company to appeal, also bearing in mind that they need to balance the requirements of the SSM legislation with this report, and indeed the procedures for disclosure by listed companies throughout the EU and the possible market abuse regulation and directive requirements too.

I am sure the Commission will find a solution to this, and I call upon my Members tomorrow to send a strong message on the need for public disclosure.

  Janusz Zemke (S&D), na piśmie. Proponowane dokumenty dotyczą uprawnień EBC wobec banków w strefie euro. Chciałbym jednak zwrócić uwagę, że sytuacja tych banków wpływa także na wiarygodność systemu bankowego państw, które nie przyjęły euro, gdyż europejski system bankowy to system naczyń połączonych. Zdecydowanie popieram zwiększenie uprawnień nadzorczych EBC nad bankami strefy euro. Szczególnie ważne wydaje mi się objęcie szczególnym nadzorem wszystkich banków, których aktywa przekraczają, co najmniej 30 miliardów euro lub stanowią co najmniej 20% PKB w ich państwach. W praktyce będzie to oznaczało nadzór nad 130 bankami strefy euro. Europejczycy muszą mieć pewność, że banki te działają zgodnie z prawem, są zarządzane profesjonalnie, mają płynność finansową. Poważne problemy jednego z tych banków nie dotykałyby tylko jego centrali, ale mogłyby także wpływać na sytuację ich filii w innych państwach. Dlatego dodatkowe uprawnienia nadzorcze EBC nad bankami strefy euro są ekonomicznie i społecznie uzasadnione.
