  Marianne Thyssen, Member of the Commission. - Madam President, let me underline, in order to set the context, that the European Union and the International Labour Organisation (ILO) have a long record of good cooperation. Even more, the ILO is a key partner for our external policies.

The European Union promotes the ratification and implementation of ILO Conventions and relies on ILO supervision of labour standards, in particular core labour standards, and in the monitoring of trade association enlargement and development agreements. Therefore, having a well-functioning ILO standard supervisory system is important for us since its conclusions are crucial to assessing compliance with international labour standards. And here we have a problem, due to the fact that since 2012 the supervision of labour standards cannot be carried out properly.

Why not? Because employers’ and workers’ representatives at the ILO disagree on whether or not the right to strike is protected under ILO Fundamental Convention No 87, the Convention concerning Freedom of Association and Protection of the Right to Organise Convention. Secondly, employers’ and workers’ representatives also disagree on the capacity of the ILO supervisory bodies to decide on the scope of the right to strike, its limits and the conditions for its legitimate exercise. Beyond this there is, as well, a risk of endangering the tripartite relationships and weakening the ILO supervisory system.

As the Commissioner in charge of relations with the International Labour Organisation, I am deeply concerned about these developments and that is why I followed the discussion at the ILO very closely. I personally met the ILO Director-General, Mr Guy Ryder, last week who informed me of the most recent developments. However, as you know, the European Union is only an observer at the ILO. The Commission will therefore not intervene on the substance of the discussion. These matters fall within the competence of the Member States.

The recognition of the right to strike in ILO Convention No 87 is a delicate matter. At the last session of the ILO Governing Body, also thanks to European Union coordination in approximating their positions, the EU Member States were ready to support the option of asking the International Court of Justice for a clarification of the matter so that we can move forward and resolve this pending disagreement between employers’ and workers’ representatives. A tripartite meeting will take place in the ILO between 23 February and 25 February, the last week of this month, to discuss the issue.

The Commission is ready to support all players and provide information to feed into the discussion, notably by retrieving information on the situation regarding the right to strike in the European Union. Let me remind you that the right to strike is recognised as a fundamental right in the European Union.

The Commission and the EU Delegation in Geneva will support EU Member States and will help them to coordinate their positions and speak with one voice.

  Claude Rolin, au nom du groupe PPE. – Madame la Présidente, Madame la Commissaire, il est clair que le droit de grève est un droit fondamental, constitutif de nos systèmes démocratiques. Bien qu'il ne relève pas de la compétence directe de l'Union européenne, les textes sont nombreux – comme la charte des droits fondamentaux de l'Union européenne ou la charte sociale européenne – qui prouvent l'attachement de l'Union au dialogue social et à ce droit.

Dans son article 28, la charte des droits fondamentaux garantit aux salariés le droit de négocier et de conclure des conventions collectives aux niveaux appropriés et de recourir, en cas de conflits d'intérêts, à des actions collectives pour la défense de leurs intérêts, y compris la grève. En la matière, la référence est clairement l'Organisation internationale du travail (OIT), et plus particulièrement sa Convention n° 87, ainsi que l'interprétation du comité des experts, qui est reconnue au niveau mondial.

Pour traiter des problèmes qui pourraient surgir dans ce domaine, l'OIT a mis en place un comité de la liberté syndicale et également la commission de l'application des normes, avec des experts. Depuis 60 ans, ces instances ont parfaitement fonctionné, de manière idéale. Elles ont toujours été reconnues par les trois composantes de l'Organisation internationale du travail et ont permis de trouver des compromis au bénéfice des différentes parties.

Malheureusement, depuis 2012, nous devons constater que le processus est quelque peu grippé et que les partenaires sociaux ne parviennent plus à trouver un accord.

L'Union européenne a toujours eu une position claire et voulu favoriser le dialogue social. Le blocage actuel est donc problématique, en ce qu'il remet en cause le dialogue social.

Je souhaite donc que la Commission fasse le maximum pour peser de tout son poids de façon à permettre à l'OIT de sortir de cette impasse. Si, toutefois, c'est impossible, le seul moyen sera de demander un avis devant la Cour internationale de justice de La Haye.

Je vous remercie, Madame la Commissaire, pour le travail que vous faites et, au passage, j'en profite pour vous inviter à renouveler les initiatives pour relancer le dialogue social au niveau européen.

  Jutta Steinruck, im Namen der S&D-Fraktion. – Frau Präsidentin! Gleich eins voraus: Wir, die Europäische Sozialdemokratische Fraktion, werden eine Aufweichung des Streikrechts nicht zulassen! Frau Thyssen, wir teilen Ihre Einschätzung, dass es wirklich wichtig ist, dass Sie auf die Mitgliedstaaten in Europa einwirken und dass Sie Ihre Stimme innerhalb der ILO erheben, weil das Streikrecht – und die Kollegen und Sie haben es auch gesagt –ein fundamentales Recht in Europa ist. Die Sozialcharta ist Teil des Lissabon-Vertrags. Wir haben in Europa gelernt, dass erfolgreiche Volkswirtschaften diejenigen mit einer starken Sozialpartnerschaft sind. Aber eine starke Sozialpartnerschaft heißt auch: Sozialpartner auf Augenhöhe. Und Augenhöhe heißt auch, dass wir starke Gewerkschaften haben. Dazu gehört auch das Streikrecht.

In den zurückliegenden Jahren gab es in Europa immer wieder Angriffe auf das Streikrecht. Im Rahmen der Troika wurde in den Krisenländern durch Auflagen auch das Streikrecht eingeschränkt. Immer wieder höre ich und lesen wir auch von Tendenzen in Europa, dass es Institutionen, Parteien, Arbeitgeberverbände gibt, die dieses Streikrecht reformieren und aufweichen wollen. Das schwächt die Verhandlungsbasis der Gewerkschaften. Für uns ist klar: Wehret den Anfängen! Denn der Angriff auf ein erstes fundamentales Recht in Europa kann einen Dominoeffekt zur Folge haben und auch weitere Rechte einschränken.

Wir erwarten von Ihnen: Bitte setzen Sie sich dafür ein, dass der Streit innerhalb der ILO im Interesse der Arbeitnehmerinnen und Arbeitnehmer beigelegt wird, und verteidigen Sie unsere europäischen Grundrechte!

  Helga Stevens, on behalf of the ECR Group. – Madam President, my apologies for being late. I understand fully the concerns of some people with regard to the right to strike. I think it is very important to bring together the interests of both employers and employees while negotiating, and also to have respect for subsidiarity. Companies should have the possibility to input their employees all over Europe so companies are able to compete with other companies in the Single market.

We would like to give them new opportunities for growth and companies should be protected against unfair competition through bad employers who escape their responsibilities. At the same time we should protect vulnerable employees. But it should not become almost impossible for honest companies to set up activities all over Europe.

Viewing the great difference between different Member States, we cannot have a one-size-fits all pattern; that does not work. We hope the Commission is aware of this and will also pay attention to the different approaches necessary in a partial, targeted revision of the Posted Workers Directive. In the framework of the agenda for better regulation,

I trust the Commission will take into account scientifically based risk assessments and will also take into consideration the parliaments’ expressions of concern in the past.

  Helga Stevens (ECR), blue-card answer. – I fully agree with your view. I think we need to find the balance between the interests of employers and employees. I think we need to focus on the interests of business, and I think that the framework that we have to look at has to consider how companies can perform in an equalised market. This is the responsibility of national governments: to be the watchdogs on how the rules are implemented at a national level.

  Marian Harkin, on behalf of the ALDE Group. – Madam President, I would like to express my concern at the continuing disagreement on the interpretation of Convention No 87, the ILO Convention on the Freedom of Association and Protection of the Right to Organise. It now appears that employer groups within the ILO no longer support the interpretation of the Committee of Experts on this particular convention.

The jurisprudence of the ILO has stood for 60 years on this convention and has interpreted the right to strike as an intrinsic corollary to the right to organise. This right has been recognised internationally as a fundamental right of workers and their organisations. The freedom to associate, to organise, to bargain collectively, make it possible to ensure decent working conditions. Collective bargaining is a mechanism that helps to ensure beneficial outcomes for workers and productive solutions for employers. Collective bargaining can only be achieved by the freedom to organise, and one of those freedoms is the right to strike – as a last resort, to withdraw labour. Without that right it is like having really good legislation in place but no sanctions for non-compliance.

Collective bargaining has no proper foundation without the right to strike. With regard to the current situation, as the Commissioner said, there will be a tripartite meeting at the end of February to try to resolve the current impasse. You, Commissioner, have outlined very clearly the current situation and the willingness of the Commission to support all players by supplying information from the EU, where the right to strike is fundamental.

However, cases like Rüffert, Laval, etc. and the thorny issue of the posting of workers may have sown some of the seeds of this dissent, and we need to finally sort out that matter. But I am heartened to hear of your commitment to finding a resolution. At a global level it is crucial.

  Κώστας Χρυσόγονος, εξ ονόματος της ομάδας GUE/NGL. – Κυρία Πρόεδρε, το δικαίωμα της απεργίας είναι το ισχυρότερο όπλο των εργαζομένων για την προάσπιση των συμφερόντων τους απέναντι στην εργοδοσία και κατοχυρώνεται ρητά στο άρθρο 28 του Χάρτη Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης. Στην πραγματικότητα όμως, οι ευρωπαϊκές ελίτ, επιδιώκοντας τη διαρκώς εντονότερη πτωχοποίηση του κόσμου της εργασίας σε όφελος του κεφαλαίου, επιχειρούν με κάθε τρόπο να υπονομεύσουν και αυτό το δικαίωμα όπως και πολλά άλλα.

Οι εκπρόσωποί τους αξιώνουν διαρκώς με ιταμό τρόπο την τήρηση των συμφωνημένων, όταν πρόκειται για τη δημοσιονομική διαχείριση, αλλά ξεχνούν τα συμφωνημένα όταν πρόκειται για την προστασία των θεμελιωδών δικαιωμάτων, ιδίως των οικονομικών και κοινωνικών.

Ένα τελευταίο χαρακτηριστικό παράδειγμα είναι η επιμονή της Τρόικας, στην τελευταία διαπραγμάτευση με την προηγούμενη ελληνική κυβέρνηση, για κατάργηση στην πράξη του δικαιώματος της απεργίας στην Ελλάδα. Η Τρόικα απαίτησε να θεσπισθεί νόμος με τον οποίο η κήρυξη απεργίας θα επιτρέπεται μόνο αν συγκεντρώνεται η απόλυτη πλειοψηφία των εργαζομένων, πράγμα ανέφικτο, ιδίως σε τριτοβάθμιες εθνικές συνδικαλιστικές οργανώσεις.

Ο ελληνικός λαός με την ψήφο του πριν δύο εβδομάδες έδωσε ένα ηχηρό μήνυμα-απάντηση και σύντομα θα τον ακολουθήσουν και άλλοι ευρωπαϊκοί λαοί. Η Ευρώπη πρέπει να μείνει πιστή στις αξίες των θεμελιωδών δικαιωμάτων πάνω στις οποίες υποτίθεται ότι στηρίζεται, αλλιώς θα κινδυνεύσει να διαλυθεί.

  Jean Lambert, on behalf of the Verts/ALE Group. – Madam President, like others, my Group really regrets this development within the ILO where we are seeing a move to roll back an agreement that stood for many years, and jurisprudence that stands; it almost beggars belief that this is actually going on in the 21st century.

The Conventions, particularly Nos 87 and 98, are, as people have said, about the balance of power within the workplace and they represent hard fought-for rights. That struggle, as we know, is still going on in some of our Member States, but certainly in many countries throughout the world, in sectors such as mining, brick-making and textiles. So any rollback of the definition of these rights that people have has profound implications for those who care about human rights, about decent work and about fair competition. So I think that the employers’ group needs to seriously consider what message it is sending elsewhere in the world through this action.

For the European Union, the ILO core Conventions are part of GSP+, increasingly part of our trade agreements and therefore, for us, they represent a whole set of values and a way of working. We want to end exploitation, we want an end to unfair competition, undercutting through labour standards. So we have to support the right of organised labour and that includes the right to withdraw labour without being sacked, black-listed, beaten up or even worse, in many countries of the world.

So the ILO has a crucial role to play here and that social partnership has a crucial role to demonstrate the sort of standards, the sort of progress that can be made through negotiation and, where necessary, the right to strike. So I really hope the EU employers are recognising they should be leading here, in demonstrating what good standards are.

I also hope that our Member State governments are going to support the continuing recognition of this fundamental right, both within the Union and outside it.

  Laura Agea, a nome del gruppo EFDD. – Signora Presidente, onorevoli colleghi, ho sempre ritenuto che questa fosse un'assise nella quale i diritti dei cittadini fossero la priorità, dove le istanze e la voce dei cittadini fossero il primo obiettivo sul quale lavorare. Invece, purtroppo, soprattutto negli ultimi anni, i diritti dei cittadini sono stati sepolti da interessi ben più grandi, da interessi finanziari, da grandi speculazioni, e tutto questo molto spesso genera la protesta, genera un senso d'insoddisfazione.

Non dimentichiamoci che in Europa ci sono tantissimi cittadini e lavoratori, quelli che ancora sono rimasti, che vivono al di sotto della soglia di povertà, persone che hanno perso il lavoro, persone che hanno perso la casa, persone che vivono per strada, persone che non hanno nulla neanche per sfamare i propri figli, bambini che smettono di andare a scuola. La protesta è la conseguenza.

Ovviamente si cerca di porre un rimedio e un argine alle persone che protestano. Quindi abbiamo visto quello che è successo l'anno scorso in Grecia, quando gli insegnanti protestavano e l'allora Primo ministro negò il diritto allo sciopero adducendo come motivazione quella che potevano verificarsi ovviamente dei disordini sociali e con questa scusa tolse il diritto allo sciopero. Io l'ho visto con i miei occhi pochi mesi fa, a Roma, quando i lavoratori dell'Ast andarono a protestare per la crisi delle acciaierie e vennero caricati dalla polizia, vennero picchiati. Ho visto ragazzi che conoscevo bene essere picchiati. Questo è quello che può succedere.

Il diritto allo sciopero è un diritto sacrosanto che nessuno può togliere a nessuno, che i lavoratori devono vedere tutelato. Io mi aspetterei che nel 2015 quelli che sono diritti che sono stati conquistati da altri, che ce li hanno lasciati in eredità, non fossero neanche occasione di argomentazioni o di confronti. I diritti, quelli inalienabili, quelli che ci siamo conquistati, quelli che altri prima di noi e per noi hanno conquistato, non vanno minimamente tolti alle persone. Se c'è una protesta non si agisce sulla protesta, si vanno a risolvere le cause della protesta. Io mi aspetto questo dall'Europa.

  Σωτήριος Ζαριανόπουλος (NI). - Στην Ευρωπαϊκή Ένωση, παρά τα λόγια για αξίες, στην πράξη η συμμετοχή στα συνδικάτα και η απεργία θεωρούνται από την εργοδοσία και το κράτος έγκλημα. Τιμωρούνται με απόλυση και άλλες ποινές. Στην Ελλάδα, οι περισσότερες απεργίες κηρύσσονται παράνομες και είναι χιλιάδες οι εργάτες που επιστρατεύτηκαν ή απολύθηκαν για απεργία.

Η Ευρωπαϊκή Ένωση ζήτησε από την Ελλάδα τον περιορισμό του απεργιακού δικαιώματος και τη νομιμοποίηση του λοκ άουτ, που η Ευρωπαϊκή Ένωση αναγνωρίζει σαν δικαίωμα της εργοδοσίας. Αναθερμαίνεται σε όλα τα ευρωενωσιακά όργανα η συζήτηση για περιορισμό του απεργιακού δικαιώματος, όπως απαίτησε η εργοδοσία από το Διεθνές Γραφείο Εργασίας. Η πρωτοβουλία Μόντι να απαγορεύονται οι απεργίες όταν διεκδικούν αιτήματα ενάντια στη στρατηγική της Ευρωπαϊκής Ένωσης αναβλήθηκε μεν αλλά είναι ζωντανή.

Δυο αλήθειες αποκαλύπτονται:

Πρώτη αλήθεια: Σε όλα τα κράτη της Ένωσης, είτε με λιτότητα είτε με χαλάρωση, η αντεργατική επίθεση κλιμακώνεται με κέντρο τις διαρθρωτικές μεταρρυθμίσεις για την ανταγωνιστικότητα του κεφαλαίου. Αναμένονται λαϊκές αντιδράσεις, παίρνονται μέτρα καταστολής τους.

Δεύτερη αλήθεια: Ένας είναι ο φόβος τους: η εργατική τάξη, ο οργανωμένος λαός. Κανένας σωτήρας δεν τον σώζει. Μόνο η οργάνωση και η πάλη του για τα δικά του δίκια, για ανάπτυξη σε όφελος του ίδιου, όχι του κεφαλαίου.

Αλλοίμονο αν στην Ιστορία η πάλη των εργατών έπαιρνε την άδεια των εκμεταλλευτών τους! Το δικαίωμα της απεργίας κατακτήθηκε με αγώνες από τους ίδιους τους εργάτες. Από τους ίδιους θα προστατευθεί και θα αξιοποιηθεί για τη δικιά τους υπόθεση.

  Λάμπρος Φουντούλης (NI), ερώτηση “γαλάζια κάρτα”. – Κύριε συνάδελφε, όσο σεβαστό και ιερό είναι το δικαίωμα της απεργίας, το ίδιο σεβαστό είναι και το δικαίωμα στην εργασία. Πώς κρίνετε το φαινόμενο μειοψηφικές ομάδες συγκεκριμένου πολιτικού χώρου να απαγορεύουν την είσοδο σε εταιρίες εργαζομένων, πολλές φορές με τη βία, και το αποτέλεσμα να είναι στο τέλος να κλείνουν αυτές οι εταιρίες και να μένουν όλοι χωρίς δουλειά;

  Σωτήριος Ζαριανόπουλος (NI), απάντηση “γαλάζια κάρτα”. – Δεν περιμέναμε τίποτε άλλο από τους ναζιστές της Χρυσής Αυγής. Είναι όργανα του κεφαλαίου. Έχουν σχέσεις με συγκεκριμένους εργοδότες. Χρηματοδοτούνται για να τρομοκρατούν τους εργάτες, για να δουλεύουν σαν εργολαβικά γραφεία, σαν δουλέμποροι, για να βάζουν πάμφθηνους εργάτες στην υπηρεσία των αφεντικών τους.

Αυτοί είναι οι ναζιστές. Αυτός είναι ο ρόλος τους. Πάντα τέτοιος ήτανε, και γι’ αυτό πρέπει να καταδικαστούν και να απομονωθούν από τους ίδιους τους εργάτες.

  Jiří Pospíšil (PPE). - Paní předsedající, já jsem velmi uvítal prohlášení Komise prezentované paní komisařkou. To její prohlášení velmi vítám, protože právo na stávku považuji stejně jako moji předřečníci za klíčové právo, které patří k demokratickému právnímu státu, tak je dobře, že se zde v plénu tímto problémem zabýváme, že Evropská komise bude vyjednávat s Mezinárodní organizací práce aktuální stav u této organizace a že se budeme snažit odblokovat situaci sociálního dialogu, který dneska je u této organizace zablokován. Myslím si, že je to správná forma, že budeme podporovat Mezinárodní organizaci práce, která má být hlavním gestorem a ochranitelem tohoto kolektivního pracovního práva na evropském kontinentě.

Na druhou stranu tady chci zdůraznit, to co také zaznělo, že právo na stávku má být jaksi upraveno na národní úrovni v jednotlivých národních právních režimech, že bychom zde měli ctít princip subsidiarity, a proto jsem rád, že jsem nezaznamenal z vystoupení paní komisařky, že by zde v budoucnu měla být snaha na evropské úrovni v rámci komunitárního práva některé aspekty práva na stávku upravovat. Chci jenom vzpomenout neúspěšnou iniciativu nařízení Monti II z roku 2012, které, jak víte, většina zemí zablokovala zvednutím žluté karty, tehdy to bylo 12 členských zemi, já jsem tehdy byl členem národní vlády v České republice a pamatuji si na vzedmutou debatu, která s tím byla spojena a v zásadě napříč politickým spektrem v České republice jak Senát, tak vláda jasně stály za stanoviskem, že má být zde uplatňován princip subsidiarity.

Takže pozice, aktivní pozice EU ve vztahu k Mezinárodní organizaci práce, ano, to je velmi důležité, prosazujme takto aktivní mezinárodní ochranu práva na stávku, ale prosím respektujme zde pozice jednotlivých členských států a jejich právních řádů.

  Agnes Jongerius (S&D). - Madam President, in June 2012 the International Organisation of Employers walked into the ILO conference with their corporate lawyers in a grossly unprecedented move. After decades of jurisprudence, they challenged the fact that the right to strike was part of the ILO Convention on the Freedom of Association, and social dialogue on the international level has been gridlocked ever since.

These employers want to take away the only tool workers have in order to stand up for themselves. After the catastrophe in Dhaka, Bangladesh, in 2013 thousands of workers swamped the streets to demand safer working conditions. Because of the right to strike they were able to stand up for safe working conditions and against fraudulent employers. Also in Europe, we have seen workers’ rights being weakened by the crisis: social dialogue is under pressure and unions are increasingly being set aside. This attack on the right to strike is a direct attack on fundamental social rights in the EU and abroad. Without the right to strike, collective bargaining is nothing more than collective begging.

Dear Commissioner, I heard your support for the routes for bringing this case to the International Court of Justice, and I applaud your intentions. My question is what can you do in order to get more votes for these routes?

  Tania González Peñas (GUE/NGL). - Señora Presidenta, el derecho a la huelga está seriamente amenazado en todo el mundo. Obstaculizar el derecho a la huelga y a la acción sindical amenaza las más básicas libertades democráticas.

España es uno de los países europeos donde más hemos retrocedido en este sentido, con la criminalización de más de 300 sindicalistas, con penas de hasta 64 años de cárcel y con una reforma del Código Penal y una ley mordaza que suponen recortes drásticos en estos derechos fundamentales. No es casual que el Gobierno que más se está distinguiendo por desmontar el Estado social sea también el que más recorta el legítimo derecho de la ciudadanía a defenderse.

Además, las políticas europeas de precarización del empleo dificultan cada vez más a los trabajadores organizarse y reclamar sus derechos. Es prioritario defender el derecho a la huelga y apoyar la convocatoria de la Jornada de acción mundial del próximo 18 de febrero, en defensa de las libertades y del derecho a la huelga, contra la posición antidemocrática del Grupo de Empleadores de la Organización Internacional del Trabajo.

  Jane Collins (EFDD). - Madam President, the right to strike is, of course, an important part of industrial relations and the last resort in defence of an individual. However, it must not be abused. It is hard enough getting trade unions to play fair in the UK. They are giving financial support to groups who blockade political offices, and stopping elected representatives from speaking to voters and appearing in public to discuss local and national issues. Of course, the last time the EU was involved in strikes, it was over the British jobs for British workers, the Posted Workers Directive being brought into light for allowing companies to hire workers that undercut the wages of the country they were posted to. So I would be very wary of sticking your noses in again to what is already a very sensitive subject in the UK.

To be discussing here and calling for the unelected EU Commission to potentially meddle with the rights and the freedoms that it has taken centuries in the UK to develop is not something the British people voted for. Laws should be decided by our elected and accountable national governments, not imposed from bureaucrats from Brussels and Strasbourg.

  Edouard Martin (S&D). - Madame la Présidente, chers collègues, permettez-moi d'exprimer mon inquiétude quant aux attaques lancées par la justice espagnole à l'encontre de plus de trois cents syndicalistes pour fait de grève. Certains sont même poursuivis et condamnés au pénal. Ce qui pose problème dans ce cas de figure est l'interprétation extrêmement restrictive du droit des travailleurs, et c'est encore plus vrai en temps de crise économique.

Nous voyons bien que sous la pression d'une partie du patronat, le droit de grève est mis à mal, et pas seulement en Espagne. Il existe un courant en Europe, de plus en plus fort, pour restreindre, voire interdire le droit de protestation et d'expression des travailleurs.

La démocratie sociale est mise à mal une fois de plus. Serait-ce un deal, à peine caché, des États pour attirer des investisseurs? Le droit des travailleurs constituerait-il un péril pour le grand marché? Pourtant, la charte européenne des droits fondamentaux, dans ses articles 12 et 28, fait référence au droit de grève et aux actions collectives. Le Parlement européen et l'Union européenne doivent donc réaffirmer avec force ces droits fondamentaux pour qu'ils soient respectés par tous les États membres. J'invite l'ensemble des parlementaires à soutenir l'initiative de la Confédération syndicale internationale pour faire du 18 février 2015 une journée de mobilisation internationale pour la défense du droit de grève des travailleurs. Le Parlement européen pourrait, par exemple, rédiger une déclaration dans ce sens.

  Νεοκλής Συλικιώτης (GUE/NGL). - Κύριε Πρόεδρε, η Επιτροπή για την Ελευθερία της Συνάθροισης της ΔΟΕ διακήρυξε το δικαίωμα στην απεργία ως ανθρώπινο δικαίωμα. Αυτό το ανθρώπινο δικαίωμα μεταφράζεται πάντα, σύμφωνα με την εν λόγω Επιτροπή, ως το δικαίωμα στη συμμετοχή σε συνδικάτα στον χώρο εργασίας, στην προάσπιση των επαγγελματικών συμφερόντων των εργαζομένων μέσα από τη συλλογική διαπραγμάτευση. Δυστυχώς, οι νεοφιλελεύθερες μνημονιακές πολιτικές σκληρής λιτότητας που επιβάλλονται στα κράτη μέλη μέσω της Τρόικας στην Ευρωπαϊκή Ένωση αποδεδειγμένα διαλύουν τις εργασιακές σχέσεις και καταπατούν τα δικαιώματα των εργαζομένων.

Σύμφωνα με τη Eurofound, όλο και περισσότερες ευρωπαϊκές κυβερνήσεις διαλύουν μονομερώς τις συλλογικές συμβάσεις. Η Ευρωπαϊκή Ένωση οφείλει να αλλάξει πλεύση από αυτές τις νεοφιλελεύθερες πολιτικές της σκληρής λιτότητας και των μνημονίων. Η Ευρωπαϊκή Επιτροπή οφείλει να πιέσει τα κράτη μέλη να προωθήσουν πολιτικές που διασφαλίζουν τη συλλογική διαπραγμάτευση, τα εργασιακά δικαιώματα και το δικαίωμα στην απεργία.

Εμείς, ως Ενωτική Αριστερά, δηλώνουμε την αλληλεγγύη μας στον αγώνα των εργαζομένων για προάσπιση του αναφαίρετου δικαιώματος της απεργίας.

  Ole Christensen (S&D). - Fru formand! Tak til kommissæren for kommentarerne. Det er jo egentlig en lidt mærkelig sag, vi har at gøre med. Én part, nemlig arbejdsgiverne, fortolker ikke længere retten til at strejke som retten til, at arbejdstagerne kan forsvare deres arbejdsforhold og deres lønninger. Det er jo en fundamental ret, og der skal være en balance i den sociale dialog! Ellers er det jo alene de stærkes ret, der kommer til at gælde. Her er det vigtigt, at arbejdstagerne kan kæmpe for deres arbejdspladser, deres arbejdsforhold og deres lønninger.

Hvis jeg ser på Danmark, så er det sådan, at arbejdsgiverne bakker op om, at arbejdsgiverne i ILO har trukket sig fra fortolkningen af konvention 87, nemlig at det skal være op til medlemslandene at vurdere, om denne ret fortsat skal være til stede. Det synes jeg ikke kan være rimeligt! Vi har en generel ret i verden, at folk kan kæmpe for deres arbejdspladser; så må det være op til medlemslandene at vurdere, hvordan det skal foregå, men det skal være en verdens ret at kunne strejke og kæmpe for sine arbejdsforhold. Vi skal selvfølgelig støtte andre lande i, at man også kan gøre det som arbejdstager, at strejkeretten må og skal bevares som en central del af konvention 87.

  Helmut Scholz (GUE/NGL). - Frau Präsidentin, Frau Kommissarin! Ich melde mich in dieser Debatte ausdrücklich als Mitglied des Handelsausschusses zu Wort. Frau Kommissarin, ich stimme Ihren Erwägungen zu den Handelsvereinbarungen zu. Denn rasant entwickeln sich neue globale Produktions- und Wertschöpfungsketten. Dadurch werden die Lebens- und Arbeitsbedingungen von Beschäftigten in verschiedenen Teilen der Welt in einen Bezug gesetzt, unmittelbar, bei unterschiedlichsten wirtschaftlichen und sozialen Rahmenbedingungen.

Wir müssen daher zügig den entsprechenden regulatorischen Rahmen errichten. Ausgangspunkt bleiben dafür die UN-Menschenrechtscharta, die ILO-Konventionen und -Jurisprudenz und der UN-Sozialpakt. Artikel 8 Absatz d garantiert völkerrechtlich verbindlich das Streikrecht, ratifiziert von 162 Staaten.

Handel und Wirtschaftskooperation brauchen Rechtsschutz. Denken Sie bei diesem Satz einmal nicht an Investoren, sondern an Arbeitnehmer und ihre Gewerkschaften! Ausbeutung bedeutet im Wettbewerb soziales Dumping. Das Streikrecht ist ein legitimes Kampfmittel dagegen und muss von der Europäischen Union international verteidigt werden. Andernfalls entwerten wir die Verpflichtung zur Achtung der ILO-Konvention 87 als Kernnorm in den Nachhaltigkeitskapiteln der EU-Handelsabkommen.

  Marita Ulvskog (S&D). - Fru talman! Utan rätten att strejka blir det meningslöst att föra fackliga förhandlingar och kollektivavtalsförhandlingar, för det är ingen förhandling om den ena parten inte har något alls att sätta emot. Det blir som en fotbollsmatch där det ena laget får springa och spela på knäna medan arbetsgivarna i det andra laget får använda sina ben fullt ut, med full kraft. Nog vet vi hur sådana matcher slutar.

Det är mer än 100 år sedan arbetarrörelsen inledde sin kamp för anständiga villkor och skäliga löner. Fortfarande idag måste denna kamp föras. Nu handlar det om att arbetsgivarna i Europa vägrar att erkänna den grundläggande rätten att strejka i enlighet med gällande ILO-konvention.

Jag vill tacka kommissionär Thyssen för att hon agerar i frågan – det måste ni och medlemsstaternas regeringar fortsätta att göra. Antingen blir EU en plats för hårda konflikter och långsam utveckling eller så sätter vi punkt för arbetsgivarnas nya krig mot den mänskliga rättighet som fackliga rättigheter i grunden handlar om.

  Miguel Viegas (GUE/NGL). - Senhora Presidente, dizia eu que o direito à greve representa um direito fundamental. Com a greve os trabalhadores tomam consciência da sua força, compreendem de forma clara onde nasce a riqueza e quem se apropria dela. Por isso a greve é sistematicamente atacada pelas associações patronais, que a temem – e têm razões para isso.

De forma recorrente introduzem-se expressões como o direito fundamental de todo o cidadão a não ser incomodado, a preservar a sua saúde e o seu bem-estar. Falam dos custos totais da greve para a sociedade. Para eles, os trabalhadores não são cidadãos, não fazem parte da sociedade. Com isto pretende-se limitar o exercício da greve através de um cardápio de medidas destinadas na prática a impedir os trabalhadores de fazer greve, a limitar o seu impacto até estas se tornarem inoperantes.

Naturalmente que, se dependesse de alguns, ainda estaríamos no tempo da escravatura. Contudo, para nós, o futuro passa pela emancipação social e política dos trabalhadores. Qualquer retrocesso nessa matéria merecerá sempre a nossa mais firme oposição.

  Jude Kirton-Darling (S&D). - Madam President, I welcome the efforts of colleagues who have secured the debate today. When the ILO is in crisis, it shows multilateralism is in crisis and widespread concerns over TTIP show that EU citizens do not want a global economy without fair social rules. Global free trade without effective labour rights, including the right to strike, effectively means more downward pressure on wages and unsustainable development for the many.

But the Commission also has a special responsibility to ensure that the ILO functions properly. The Commission has outsourced to the ILO the assessment of whether a country qualifies for trade preferences with respect to labour rights. The Commission chose to rely on the ILO’s Committee on the Application of Standards. We therefore have a duty to guarantee that this Committee can function properly and delivers effectively. The conflict within the ILO must be resolved urgently and it must be resolved, if necessary, by the ICJ.

  Josu Juaristi Abaunz (GUE/NGL). - Señora Presidenta, creo que la Comisaria está recogiendo suficientes ejemplos para poder evaluar mejor el nivel de incumplimiento de las normas laborales en la Unión Europea. Entiendo que la Comisión esté preocupada y siga de cerca el debate en la OIT, pero haría mucho mejor en presionar a los Estados miembros y exigirles que cumplan la Carta de los Derechos Fundamentales de la Unión Europea. El debate en la OIT no puede ser una excusa para la inacción. Actuemos en el marco internacional y hagamos otro tanto en la Unión Europea.

Alabo el empeño de la Comisaria en intentar que la Unión Europea hable con una sola voz ante la OIT, pero espero que no sea sobre la base del mínimo común denominador, como tantas veces ocurre: el mínimo común denominador menos progresista.

Debemos parar la involución democrática en muchos Estados miembros de la Unión Europea, por ejemplo en el Estado español, donde las fuerzas policiales han sido convertidas también en fiscales y jueces en el marco de una ofensiva contra derechos políticos y sindicales.

  Sergio Gaetano Cofferati (S&D). - Signora Presidente, onorevoli colleghi, il diritto allo sciopero è uno dei diritti fondamentali delle persone che lavorano. Ci sono tre condizioni che sono tra di loro strettamente connesse e che non devono essere mai separate: la possibilità per il lavoratore/lavoratrice di organizzarsi e di rappresentarsi collettivamente, la possibilità di negoziare le loro condizioni di vita e la possibilità di utilizzare lo sciopero.

Senza organizzazione non ci sarebbe contrattazione collettiva e la contrattazione collettiva sarebbe una pura mistificazione se non ci fosse da parte di chi lavora la possibilità di dar vita ad azioni di contrasto del proprio interlocutore, in questo caso delle imprese. È una catena che non deve essere mai interrotta. Ed è così naturale che ciò accade in tutte le parti del mondo. Tutti gli Stati evoluti, ma anche i paesi in via di crescita e di sviluppo, hanno questa certezza per le persone che lavorano ed è così naturale che la Carta dei diritti dell'Europa, all'articolo 28, non a caso ha messo insieme il diritto di contrattazione con quello di sciopero.

  Sergio Gaetano Cofferati (S&D), risposta a una domanda "cartellino blu". – Io credo che qualunque consesso nazionale o sovranazionale, che ha a cuore il valore del lavoro, il valore sociale del lavoro e la dignità delle persone che lavorano, dovrebbe garantire sempre i tre diritti fondamentali che ho ricordato: quello di organizzarsi, quello di contrattare e quello di poter utilizzare lo sciopero come strumento.

Se poi esistono condizioni o ragioni per tutelare, soprattutto nel campo dei servizi, gli utenti che possono essere coinvolti anche negativamente da un libero esercizio di un diritto, allora a quel punto siano le organizzazioni a stabilire quali sono le forme e le modalità per difendersi.

  Guillaume Balas (S&D). - Madame la Présidente, nous sommes au cœur du sujet. On le voit en effet aujourd'hui, sous la pression, notamment, d'une partie du patronat.

Encouragé par la crise économique – qui engendre un déséquilibre en sa faveur dans le rapport de forces, puisque le travail est très abondant alors que le capital, évidemment, est plus rare – et exploitant cette disproportion, il fait pression sur des organes politiques et des États, qui vont restreindre le droit de grève, comme on le voit, par exemple, en Espagne ou ailleurs.

Cela veut donc dire que, symétriquement, une intervention du politique est nécessaire dans l'autre sens, pour soutenir, évidemment, la demande des organisations d'employés au sein de l'OIT – c'est certain, notamment par rapport à la Cour de justice –, ainsi qu'à l'égard des États européens, qui agissent aujourd'hui à l'encontre de ces conventions.

De ce point de vue, la Commission européenne a un rôle absolument majeur à jouer, et nous l'encourageons à le faire.

  Sergio Gutiérrez Prieto (S&D). - Señora Presidenta, señora Comisaria, la OIT ha desempeñado un papel fundamental a lo largo de la historia, también a lo largo del reconocimiento de los derechos fundamentales en la Unión Europea. Gracias a la OIT, el derecho a la huelga se ha incorporado a la Carta Social Europea. Gracias a la OIT, el derecho a la huelga está considerado uno de los derechos fundamentales de nuestro modelo social. Y cuando esto se pone en riesgo por el Grupo de Empleadores en la OIT, la Unión Europea no puede ser neutral, por mucho que sus propias reglas le atribuyan el papel de observador. Porque estamos defendiendo un derecho social, un derecho fundamental, en un contexto en el que se está produciendo una gran revisión, precisamente, de ese modelo y de los derechos de los trabajadores.

No solo estamos hablando de la OIT. Estamos hablando también de la propia Unión Europea, donde muchas reformas laborales, donde muchas leyes están intentando desproteger a los trabajadores, quitándoles el derecho a la huelga y la protección de los convenios colectivos, aumentando la flexibilidad a costa de su seguridad. Por lo tanto, usted no puede ser neutral en este debate, señora Comisaria. Usted tiene que defender no solo el derecho a la huelga, sino un modelo social que proteja a los trabajadores en nuestra Unión Europea, en nuestra región monetaria, para, fundamentalmente, trasladarlo a otros lugares del planeta, como reza nuestro principio constitucional.

  Vilija Blinkevičiūtė (S&D). - Iš tikrųjų didžiulį nerimą kelia žinia apie tai, kad imamasi žygių atšaukti tarptautinėje darbo teisėje numatytą darbuotojų teisę streikuoti ir tokiu būdu būtų paneigta TDO nusistovėjusi jurisprudencija dėl visuotinai pripažįstamos teisės darbuotojams streikuoti, būtų destabilizuota seniai įtvirtinta TDO ginčų sprendimo sistema ir tikrai susilpnėtų socialinis dialogas ir dėl to nukentėtų abi pusės, tačiau labiausiai nukentėtų darbuotojai.

Iš tiesų blogai, kad nesiekiama išsiaiškinti TDO konvencijos „Dėl asociacijų laisvės“ turinio, o siekiama tik destabilizuoti iki šiol veikusį priežiūros mechanizmą. Tokia padėtis negali būti toleruojama, kai kalbame apie darbuotojų teisę streikuoti. Tai yra labai svarbus garantas, kad dirbantys žmonės darbo vietoje nebūtų išnaudojami ir kad jų teisės nebūtų pažeidžiamos. Pone Komisijos nary, raginu Jus asmeniškai ir Komisiją padėti išspręsti šią susidariusią situaciją, kad būtų apgintos mūsų piliečių, mūsų darbuotojų teisės, ir labai svarbu padėti Europos Sąjungos valstybėms narėms, kad Europos Sąjunga šioje situacijoje kalbėtų vienu vardu.

  Danuta Jazłowiecka (PPE). - Pani Przewodnicząca! Trzy lata temu Komisja Europejska zaproponowała rozporządzenie w sprawie korzystania z prawa do strajków w kontekście swobody świadczenia usług. Celem Komisji było skodyfikowanie orzecznictwa Trybunału Sprawiedliwości oraz wprowadzenie jasności prawa poprzez potwierdzenie, że prawo do strajku i swoboda podejmowania strajku mają taką samą wagę co swoboda świadczenia usług. Rozporządzenie wskazywało na fakt, że prawo do strajku nie jest prawem absolutnym i powinno być uregulowane. W rozporządzeniu tym określono także nowy mechanizm powiadamiania o brzemiennych w skutkach konfliktach dotyczących stosunków pracy w sytuacjach transgranicznych.

Propozycja rozporządzenia spotkała się jednak z krytyką przedstawicieli nie tylko biznesu, ale również związków zawodowych. Ostatecznie Komisja wycofała propozycję rozporządzenia Monti II ze względu na procedurę żółtej kartki – przypomnę tylko: niektóre parlamenty państw członkowskich nie zaakceptowały tego rozporządzenia, uważając, że jest to wchodzenie w zakres kompetencji państw członkowskich.

Powracając dzisiaj do propozycji Monti II, musimy pamiętać, że jak każda działalność tak i organizacja strajków powinna być oparta na najwyższej odpowiedzialności.

  Marc Tarabella (S&D). - Madame la Présidente, la grève ne se fait jamais par plaisir. Elle est un droit fondamental et l'arme ultime des travailleurs lorsque leurs droits sont gravement menacés et que toutes les autres voies ont échoué.

On voudrait restreindre le droit de grève au Bangladesh, où les gens travaillent dans des conditions inhumaines pour moins d'un dollar par jour, on voudrait le restreindre dans l'Union où les droits des travailleurs se sont acquis au prix de hautes luttes.

À l'heure où le cynisme de certains patrons, Lakshmi Mittal en tête – c'est celui qui me vient à l'esprit –, n'a d'égal que le mépris qu'ils manifestent envers leurs travailleurs en fermant les entreprises rentables par pur calcul financier, où les fonds de pension ne recherchent qu'une rentabilité à deux chiffres, nécessairement en menaçant les droits des travailleurs quand ils sont propriétaires de l'entreprise, où la fraude fiscale généralisée et orchestrée par de grandes banques semble être une règle, on voudrait restreindre le droit des travailleurs, le droit de grève? C'est ignoble!

Je salue cette initiative de la Confédération syndicale internationale et vous remercie, Madame la Commissaire, pour votre vigilance et votre engagement pour la défense des droits des travailleurs, notamment, parmi ceux-ci, le droit de grève.

  Ivan Jakovčić (ALDE). - Gospođo predsjednice, očekujemo od Komisije da u ovoj zategnutoj situaciji pokuša izbalansirati ono što se može učiniti između poslodavaca i radnika, ali ono što mora biti naš minimum je zaista ono što je dosegnuto. Mi imamo pravo na štrajk u Europi, imamo kolektivno pregovaranje i ići ispod onoga što smo danas dosegnuli - neovisno o globalizaciji, neovisno o problemima u našoj industriji tekstila, industriji čelika, u drugim industrijama koje su zbog globalnih uvjeta danas u ozbiljnoj krizi - mi ipak ne možemo dozvoliti da idemo ispod onoga što smo dosegnuli.

Zato i kao liberal želim čvrsto stati iza onoga što su prava radnika i sve ono što Europa danas ima kao uzor drugima u svijetu.

  Paloma López Bermejo (GUE/NGL). - Señora Presidenta, el grupo de empresarios ha lanzado un ataque continuo y deliberado contra el derecho a la huelga, y este ha sido avalado por la Comisión Europea cuando ha instado a los Estados miembros a aplicar reformas estructurales que han dañado el diálogo social y la negociación colectiva, desregulando el derecho al trabajo y rompiendo con ello las relaciones de equilibrio en las relaciones laborales, precisamente en contra de los trabajadores.

Ahora se criminaliza la huelga. España es un claro ejemplo de ello.

Existe en todo esto una clara finalidad antisindical que, desde mi Grupo, no vamos a consentir. Hoy, aquí, señora Thyssen, no vale con decir que se coordinarán posiciones: hay que comprometerse y manifestar con claridad el apoyo a la jornada convocada por la Confederación Sindical Internacional el día 18 de febrero, y abrir expediente también a países como España por su ataque a las libertades y por las prácticas antisindicales.

  Sofia Ribeiro (PPE). - Senhora Presidente, foi aqui neste debate por vezes confundido o direito de manifestação com o direito à greve, e eu queria apelar à Sra. Comissária para ter em atenção essa grande diferença.

O direito à manifestação é um direito espontâneo que surge hoje muitas vezes com um mecanismo que é o das redes sociais e que permite os contactos rápidos, mas o direito à greve tem por trás uma questão essencial que é a da negociação. E, portanto, nós, quando estamos a falar de um direito fundamental, estamos a falar de compromissos que são assumidos entre os trabalhadores e as suas entidades empregadoras, que pretendem, através da negociação, numa primeira fase, chegar a um consenso. E só quando tal não é possível é que os trabalhadores enveredam pela greve com um prejuízo próprio. E é essa primeira questão, prejuízo próprio, que muitas vezes também é aqui esquecida. Quando se fala nos prejuízos societais e económicos que advêm de uma greve, não nos podemos nunca esquecer que os trabalhadores utilizam o direito à greve para mostrarem que são peças chave na nossa sociedade.

Sra. Comissária, o nosso lema é: Unidos na Diversidade. Esse também é o lema das associações sindicais.

  Jonás Fernández (S&D). - Señora Presidenta, en primer lugar, quería agradecer la celebración de este debate en unos momentos en los que el derecho a la huelga se está cuestionando, y no solo en países emergentes.

Como ya se ha dicho, en mi país hay más de ochenta causas judiciales abiertas en los juzgados que afectan a más de 300 trabajadores por ejercer el derecho a la libertad sindical y el derecho a la huelga. En ese sentido, hace apenas unos días, un juez ha sentenciado con más de dos años de prisión a cinco compañeros del sindicato del Metal en Asturias, MCA-UGT, por realizar esas labores de información sindical ante una huelga general.

Ante la desproporción de esta sentencia, más de treinta diputados de esta Cámara han firmado una carta de solidaridad con estos compañeros y el propio Gobierno ha reconocido el grave problema que tiene con la implementación de la actual legislación. Sin embargo, no ha hecho nada; ha hecho una reforma laboral que complica aún más el ejercicio del derecho a la huelga. Y yo creo que esto no puede seguir así.

Por eso, creo que la Comisión debería interesarse por este asunto, que afecta a los derechos fundamentales de los trabajadores y de los ciudadanos en Europa.

  António Marinho e Pinto (ALDE). - Senhora Presidente, Senhora Comissária, as empresas têm hoje na União Europeia e nas sociedades livres uma responsabilidade social ineludível. A responsabilidade social das empresas deve ser uma exigência dos Estados modernos e das sociedades modernas. A liberdade de exercer a greve é uma liberdade fundamental para os trabalhadores. O direito à greve torna as empresas mais fortes, mais poderosas, mais competitivas no mercado global.

Por isso, em vez de restringir o direito à greve na União Europeia, nos Estados-Membros, deve-se é procurar dinamizar o direito à greve nas potências emergentes, como na China e outros países onde esse direito não é respeitado. Por isso, a Comissão Europeia, a União Europeia, deve defender o direito à greve e punir, sancionar os Estados-Membros que restrinjam esse direito, que limitem esse direito.

  Εμμανουήλ Γλέζος (GUE/NGL). - Κύριε Πρόεδρε, με την απεργία αποκαλύπτονται δύο γεγονότα:

Αποκαλύπτεται ότι η θεωρία του χρήματος δεν έχει καμία απολύτως αξία. Εάν ο εργαζόμενος με την εργασία του δεν παρήγε αγαθά, δεν θα τον ενδιέφερε τον εργοδότη η απεργία· θα έλεγε: «Θα βάλω το χρήμα να παράξει αγαθά». Όμως δεν το κάνει. Έτσι αποκαλύπτεται ότι ο εργαζόμενος και μόνον αυτός παράγει αγαθά και αξίες, και το χρήμα μονάχα ανταλλάσσει αξίες.

Γι’ αυτό το λόγο, η Ευρωπαϊκή Ένωση πρέπει όχι μονάχα να διακηρύξει το δικαίωμα στην απεργία στην Ελλάδα, όπου με αίμα από το 1916 οι μεταλλωρύχοι της Σερίφου πέτυχαν να καθιερωθεί το δικαίωμα της απεργίας, αλλά και να το θέσει ως όρο για τη συμμετοχή οποιουδήποτε κράτους στην Ευρωπαϊκή Ένωση.

Και αν δεν το δεχθεί μια Ευρωπαϊκή Ένωση ....

  Tibor Szanyi (S&D). - Valójában ez a mai vita is jól mutatja, hogy a sztrájkkal kapcsolatban szóba jöhető szereplőknek, értsük ez alatt a munkavállalókat, a munkaadókat, illetve a szabályozásról gondoskodó állam esetében, szankciók egyedül a munkavállalókat sújthatják. Én úgy gondolom, hogy a jövő szabályozásában figyelni kell arra is – és főleg itt az Európai Közösségen belül talán van is erre lehetőségünk – hogy ha a szabályozásban az állam vét, arra is legyen valamiféle visszajelzés vagy szankció. Ha a munkaadók állítanak elő olyan helyzetet, ami miatt sztrájk van, arra is legyen azért szankció. A másik, és itt a Bizottsághoz fordulnék. Véleményem szerint a TTIP szerződés csak akkor kerülhet tető alá, csak akkor érdemes aláírni, hogyha nem csupán az ipari szabványokat, de a munkaügyi szabványokat is egységesítjük benne.

  Maria Grapini (S&D). - Doamnă Președinte, doamnă comisar, stimați colegi, subiectul de astăzi este, cred, extrem de important, poate mai mult decât de închipuim. Trebuie să judecăm rațional și nu pasional.

Dreptul la grevă trebuie să existe. Eu nu cred că trebuie să îl mai punem în discuție. Este, însă, la fel de important, așa cum spunea colegul Cofferati, cum se reglementează înainte de a ajunge la grevă. Greva nu trebuie să mulțumească pe nimeni, nu trebuie să bucure pe nimeni, pentru că greva înseamnă pierdere de o parte și de alta.

Angajatorii nu pot exista fără angajați, așa cum nici angajații nu pot să aibă loc de muncă fără angajator. De aceea ambele părți trebuie să înțeleagă că negocierea trebuie să fie echitabilă. Responsabilitatea socială trebuie să crească, dar nu trebuie să încurajăm indisciplina.

Angajatorii trebuie să înțeleagă că nu lucrează cu roboți, în același timp, nu pot să-și asigure competitivitate și productivitate fără oameni mulțumiți și bine pregătiți profesional. Am auzit aici des cuvântul „luptă”, eu cred că nu trebuie să existe cuvântul „luptă”, ci trebuie să existe reglementare, dialog, și aceasta este responsabilitatea guvernelor din fiecare țară.

  Marianne Thyssen, Lid van de Commissie. - Mevrouw de Voorzitter, beste collega's, het stakingsrecht is een fundamenteel recht. Dat staat zo in artikel 28 van ons Handvest van de grondrechten. Dat staat zo in artikel 11 van het Europees Verdrag voor de Rechten van de Mens. En dat staat ook – althans zo hebben wij Conventie 87 altijd al geïnterpreteerd – in die conventie van de Internationale Arbeidsorganisatie.

Geachte parlementsleden, ik heb vastgesteld dat velen onder u de zorg van de Commissie delen. Een dubbele zorg: 1) dat de interpretatie van Conventie 87 ter discussie gesteld wordt, maar 2) ook meer structureel, dat als dit geblokkeerd blijft, dit het toezichtssysteem van de Internationale Arbeidsorganisatie zelf in gevaar kan brengen. U hebt zelf onderstreept in uw tussenkomsten waarom dat niet gewenst of niet wenselijk is.

Wij weten allemaal dat de lidstaten in de eerste plaats de leden zijn van de Internationale Arbeidsorganisatie. De Commissie is daar alleen als waarnemer aanwezig. Maar, zoals gezegd in mijn inleiding, zal de Commissie heel actief de lidstaten ondersteunen, hen helpen in de discussies en waar nodig een inspanning leveren om tot één positie te komen of om de eenheidspositie die men verworven heeft, te bewaren.

Het belang van de vergadering van eind februari mag niet onderschat worden. Het is een informele tripartite bijeenkomst. Daar komt men hopelijk tot een concensus. Als dat niet het geval is, zullen we kijken hoe dat verder moet, maar de niet-formele conclusie die daar genomen wordt, zal doorgeschoven worden – u kent de structuur van de Internationale Arbeidsorganisatie – naar de Raad van bestuur (de governing board) van de Internationale Arbeidsorganisatie. Daar zal dan uiteindelijk in maart een definitieve beslissing moeten worden genomen.

U mag erop rekenen dat de Commissie, samen met onze delegatie in Genève en met de lidstaten, alles in het werk zal stellen en alles zal doen om tot een positief resultaat te komen. U weet dat de Commissie een groot belang hecht aan de sociale dialoog. Sommigen van u hebben daar ook op gewezen. We zullen die bevorderen op alle vlakken, zowel internationaal, als binnen onze eigen Europese Unie.

Sajnos az egész világon, nemcsak Európában, a munkavállalói és munkaadói oldal egyensúlya megbillent: a munkaadók folyamatosan növekvő, a munkavállalók pedig egyre csökkenő befolyással bírnak a munkafeltételekre. Ebben a környezetben a munkavállalók egyik leghatékonyabb eszköze a sztrájk. A sztrájk joga a huszadik század óta megilleti Európában a munkavállalókat és szakszervezeteiket, az ILO 87. számú egyezménye az egyesülési szabadságról és a szervezkedési jogról pedig, melynek tagja minden uniós tagország, ha nem is expressis verbis mondta ki, de gyakorlatilag elismerte ezt a jogot. 2012 óta a munkaadói oldal az ILO-n belül vitatni kezdte a munkavállalókat megillető sztrájkjogot, és ezt a törekvést csendben támogatják ázsiai, afrikai kormányok, sőt néhány európai kormány is. Ez tökéletesen elfogadhatatlan. Európa kormányai és az Európai Bizottság számára nem az üzleti érdekek vak kiszolgálása, hanem a társadalmi párbeszéd feltételeinek biztosítása és a felek kiegyensúlyozott párbeszédének elősegítése a feladata.

A kormányok valódi szerepfelfogásával leginkább ellentétes magatartásra „a legjobb példa” saját hazám. Magyarországon a 2010-es sztrájktörvény módosítása óta a sztrájkolás előfeltételeként a feleknek meg kell állapodni az elégséges feltételekről. Ez a gyakorlatban lehetetlenné tette a magyar munkavállalók számára a sztrájkjog gyakorlását. Pedig egyértelmű, hogy a méltó munkaviszonyok megteremtése nem lehetséges kiegyensúlyozott erőviszonyok és párbeszéd fenntartása nélkül, melynek alapja a sztrájkjog.

  Evelyn Regner (S&D), schriftlich. Das Streikrecht ist ein fundamentales Grundrecht. Es ist in der Europäischen Union durch die Grundrechte-Charta garantiert und muss auch international ohne Einschränkungen verankert sein. Ich fordere die Arbeitgeberseite innerhalb der Internationalen Arbeitsorganisation (ILO) auf, ihre Blockadehaltung aufzugeben. Denn einerseits bezweifeln sie, dass das Streikrecht durch das ILO-Übereinkommen Nummer 87 über Versammlungsfreiheit gesichert ist. Andererseits verhindern sie aber, dass die ILO den Internationalen Gerichtshof in Den Haag anruft, um diese Frage zu klären. Das fordere ich umso mehr, als wir in den letzten Jahren vermehrt Fälle sehen, in denen ArbeitnehmerInnen das Streikrecht versagt wird. Das war in Griechenland in den letzten Jahren der Fall. Ganz aktuell wurde in der Türkei ein Streik der MetallarbeiterInnen untersagt. Das zeigt deutlich, dass wir in dieser Frage dringend eine Klärung durch den IGH brauchen. Wir SozialdemokratInnen werden es nicht hinnehmen, dass fundamentale Freiheiten von ArbeitnehmerInnen eingeschränkt werden – weder in der EU noch in unseren Nachbarstaaten oder sonstwo auf der Welt. Daher ist es mir besonders wichtig, dass die Europäische Union ihren Einfluss in allen Bereichen geltend macht, um die Einhaltung dieses Rechts und der ILO-Kernarbeitsnormen durchzusetzen. Das gilt insbesondere bei Freihandelsabkommen wie etwa TTIP.
