  Der Präsident. - Als nächster Punkt der Tagesordnung folgt die Aussprache über die Erklärung der Kommission zum Kampf gegen den sexuellen Missbrauch von Kindern im Internet (2015/2564(RSP)).

  Christos Stylianides, Member of the Commission. - Mr President, the sexual abuse of children is a monstrous crime. The European Union has already taken a series of steps to tackle it, both online and offline. The Child Sexual Abuse Directive includes a substantial number of tools to improve the effectiveness of Member States’ responses to these crimes and to facilitate international cooperation. So the Commission does not intend to propose any amendment in the near future but to focus on its implementation.

A study is ongoing to look into Member States’ transposition of the Directive. The results will be available by April, after which decisions on pursuing or opening new infringement proceedings – 11 are already open – can be taken. In the meantime, the Commission is in bilateral contact with various Member States to facilitate transposition and notification.

There are specific issues regarding the need for law enforcement and judicial authorities to access evidence of child sexual abuse online held by private companies located under different jurisdictions. This is a major obstacle to the effective investigation and prosecution of these crimes, which Member States must ensure in order to respect their obligations to protect the fundamental rights of victims.

These issues are common to other forms of cybercrime and other crimes facilitated by the internet. Given the global reach of the internet, a European Union response to them must take account of the need for cooperation with the EU’s strategic partners worldwide. A comprehensive approach is essential to ensure consistency, including in the fight against crime, in cybersecurity, consumer protection, fundamental rights and data protection, and e-commerce. These challenges will be considered as part of the reflections for the upcoming digital single market package.

I will now turn to the Global Alliance against child sexual abuse online. The Global Alliance is a set of political commitments by Ministers from 54 countries to take action to improve victim identification and assistance, improve investigation and prosecution, raise awareness, and reduce the amount of child sexual abuse material available online. The Global Alliance has succeeded in a number of points. Commitments have become part of national policy.

But the Global Alliance still needs to address a number of issues. First, ensure that all countries continue to pursue the policy targets, by mutual inspiration and pooling resources. Second, it should reach out to more countries. Third, the Alliance should react to the trends and threats that we see in the real world, and adapt the response to them. We must also work more closely with the internet industry that is ready to play a role within the Global Alliance.

Under the Internal Security Fund, the Commission will support the establishment of public-private partnerships between key players from the private sector and law enforcement agencies. Under the Connecting Europe Facility the Commission will continue to co-fund the long-standing European network of Safer Internet Centres which have a key role in raising awareness about internet safety matters for children throughout the European Union.

Safer Internet Centres currently operate in 27 Member States and cover three functions. Firstly, an awareness centre for empowering children, parents and teachers to make the best use of the internet, building on enhanced digital resource centres, from which specific awareness toolkits and services will be adapted and deployed, in cooperation with schools and industry.

Secondly, an online helpline service for children allowing them to seek advice and to report harmful contact, conduct and content. Thirdly, a hotline to receive information from the public relating to child pornography.

The hotlines make a preliminary assessment of the legality of the content reported, trace its origin, and forward the report to law enforcement. They notify the hosting ISP and monitor systematically the take-down of child sexual abuse content by the ISP. Hotlines are networked through the Inhope association, co-funded by the Commission, on a global level.

Finally, the Commission will continue to support law enforcement in more efficient identification of victims and perpetrators by co-funding the development of shared databases, currently hosted in Interpol, giving law enforcement better access to data and evidence available worldwide.

  Monika Hohlmeier, im Namen der PPE-Fraktion. – Herr Präsident, Herr Kommissar, liebe Kolleginnen und Kollegen! Zunächst einmal ein herzliches Dankeschön für diese Aussprache, die ich für sehr wesentlich halte. Wir haben es in der letzten Zeit mit einer Explosion der Taten und mit einer Explosion der Zahl der missbrauchten Kinder zu tun. Das Internet ist Segen für viele Bereiche, in denen wir Wirtschaft und Arbeitsplätze fördern können, das Internet ist aber Fluch für diejenigen, die darüber Opfer von Verbrechen werden.

Ich habe folgende Fragen an die Kommission. Wir haben das EC3 eingerichtet, und nachdem wir wissen, dass das Internet die Hauptplattform ist, ist es wesentlich, dass es überhaupt genügend Personal gibt, um dieser spezifischen Verbrechensform auch mit genügend Personal zu begegnen. Ich muss leider mitteilen, dass wir dafür genau drei Leute für Gesamteuropa haben. Natürlich hat Europol auch mehr Personal, aber sie haben mit Menschenhandel, mit organisierter Kriminalität, mit den unterschiedlichsten Verbrechensformen zu tun. Deshalb meine erste Bitte: Wir brauchen eine adäquate personelle Ausstattung, um diesen Verbrechen entgegenwirken zu können.

Zweite Bitte: Die Umsetzung der Richtlinie muss in den Mitgliedstaaten dringendst beschleunigt werden, und alle Mitgliedstaaten müssen die Umsetzung der Richtlinie, die seit 2011 gilt und wirklich gut ist, tatsächlich durchführen.

Drittens: Ich halte Public-private-Partnerships für hervorragend und sehe es auch als gut an, wie weit wir mittlerweile in diesem Sektor gekommen sind. Die Kooperation ist gut.

Letzter Punkt: Beim Thema Verschlüsselung müssen wir darauf achten, dass sie auf der einen Seite wichtig ist, um Spionage abzuwehren, um Sicherheit, privacy, zu garantieren. Auf der anderen Seite müssen wir Methoden finden, um damit nicht die Schwerstverbrecher zu schützen, die Tausende von Kindern in dieser Welt vergewaltigen und umbringen.

Aș vrea să vă întreb, stimată colegă, dacă credeți că asociația despre care vorbea domnul comisar, finanțată de Comisie, asigură în același timp și siguranța datelor, având în vedere că monitorizează și are la îndemână datele de pe Internet ale celor care sunt monitorizați. Dacă credeți că această asociație finanțată de Comisie prezintă și siguranță și garanția datelor personale?

  Monika Hohlmeier (PPE), Antwort auf eine Frage nach dem Verfahren der „blauen Karte“. – Wenn im Internet von Unternehmen Daten untersucht werden, findet das nicht durch persönliche Einschau statt, weil die Daten ja viel zu viele sind, sondern es findet per technischen Algorithmen statt. Nur dann, wenn spezifische Merkmale, wie zum Beispiel die Vergewaltigung eines Kindes, per Algorithmus entdeckt werden, findet eine persönliche Einsichtnahme statt. Vor diesem Hintergrund halte ich diese Form der Einsichtnahme für wichtig.

  Birgit Sippel, im Namen der S&D-Fraktion. – Herr Präsident! Sexueller Missbrauch von Kindern – da sind wir uns alle einig – das sind Verbrechen, schwere Verbrechen, die bei den Opfern oft zu langanhaltenden körperlichen, psychischen und auch sozialen Schäden führen. Das Internet schafft die Möglichkeit, Bilder und Filme des Missbrauchs schnell und sehr breit zu verbreiten. Internettäter nutzen es, um Kontakte zu Kindern aufzubauen.

Als Parlament haben wir gemeinsam mit dem Rat 2011 eine Richtlinie verabschiedet, damit die Staaten gegen diese Art von Verbrechen wirksam mit einheitlichen Standards vorgehen, mit gemeinsamen Regeln für die Definition von Straftaten und des dazugehörigen Strafmaßes sowie mit einheitlichen Bestimmungen über die Verfolgung von Straftätern, auch bei Straftaten im Ausland. Prävention und Schutz der Opfer spielen eine wichtige Rolle, ebenso die Verbesserung der Medienkompetenz. Unverändert gilt: Die Sperrung solcher Inhalte kann immer nur eine Übergangslösung sein. Ziel muss gerade im Interesse der Opfer die verbindliche Löschung der Inhalte sein. Darüber dürfen private Provider nicht allein entscheiden.

Wird denn diese wichtige Richtlinie nun konsequent und umfassend umgesetzt? Dazu fehlt es den Mitgliedstaaten offensichtlich am politischen Willen. Im Januar 2014 erließ die Kommission gegen elf – elf! – Mitgliedstaaten ein Mahnschreiben als erste Stufe des Vertragsverletzungsverfahrens. Und nur im Falle Zyperns wurde das Verfahren unterdessen eingestellt. Übrigens: Mein eigenes Mitgliedsland hat ein entsprechendes Gesetz erst im November letzten Jahres verabschiedet, übrigens ohne Mahnschreiben.

Die Mitgliedstaaten müssen endlich ihre Hausaufgaben machen, und die Kommission muss ihrer Aufgabe als Hüterin der Verträge gerecht werden, ohne falsche Zurückhaltung gegenüber den Mitgliedstaaten. Bis Dezember muss die Kommission einen Bericht zur Richtlinie vorlegen. Ich bin gespannt, wie weit wir dann sind.

Wir sollten bei der ganzen Debatte eines nicht vergessen: Missbrauch ist nicht virtuell, er findet tagtäglich real statt. Es ist erschreckend, wie unterschiedlich das Problem in verschiedenen Staaten und Regionen gehandhabt oder gar ignoriert wird, auch in Europa.

  Monika Hohlmeier (PPE), Frage nach dem Verfahren der „blauen Karte“. – Ich hätte ja auch darauf verzichtet. Ich wollte die Kollegin Sippel fragen, ob sie wirklich ernsthaft der Meinung ist, dass Google zum Beispiel keine Inhalte – wenn sie zufällig entdeckt werden –, wo ein Kind vergewaltigt wird, selbständig löschen soll, sondern zunächst warten sollen, bis sie jemanden von den offiziellen Behörden oder gar einen richterlichen Beschluss haben. Ich glaube, bei Schwerststraftaten ist es notwendig, dass private Unternehmen unter gemeinsamer Absprache eben entsprechend selbständig agieren. Da handelt es sich nicht mehr um privacy.

  Birgit Sippel (S&D), Antwort auf eine Frage nach dem Verfahren der „blauen Karte“. – Liebe Kollegin Hohlmeier, jeder Bürger ist verpflichtet, wenn er eine Straftat zufällig entdeckt, in angemessener Weise einzugreifen. Aber bei der Diskussion zu dieser Richtlinie haben wir sehr wohl gemerkt, dass es neben dem eindeutigen Missbrauch von Kindern auch viele Zweifelsfälle gibt, die nicht eindeutig sind. Deshalb ist es wichtig, dass es in solchen Fragen eine Rücksprache mit öffentlichen Behörden gibt.

  Timothy Kirkhope, on behalf of the ECR Group. – Mr President, the measure of any society is how we protect those who cannot protect themselves. There are very few situations where there is an absolute right and an absolute wrong, but where the exploitation and abuse of children is concerned there is no confusion. It is the worst kind of crime. We must do all we can at every level, national, European and global, to eradicate it and punish those that seek to do children harm.

Arguments on freedom of expression and the right to privacy cease to be relevant in this context, and when we ask ourselves what needs to be done to stop the abuse it is quite simple: everything humanly possible. We need to work with internet companies and providers, social media, schools, parents, communities and police authorities. We need to block search results that lead to child abuse. We need to identify illegal images and take them down. We need to capture and prosecute perpetrators and provide justice for victims, and to give ourselves the tools to do so. Then we need to offer victims the necessary help and assistance to feel safe again. There are too many dark corners in the internet, and the most heinous of crimes are committed there. Children need a united voice committed to protecting them and their childhood.

  Nathalie Griesbeck, au nom du groupe ALDE. – Monsieur le Président, Monsieur le Commissaire, chers collègues, il y a quelques semaines, en commission des libertés, lors d'un débat important sur la lutte contre la cybercriminalité et les cyberprédateurs, nous avons pris connaissance de données et de statistiques atroces, inspirant le dégoût et abjectes à l'égard des enfants: 4 millions de matériels pédopornographiques circulent actuellement sur l'internet.

Les victimes sont de plus en plus jeunes – 10 % des enfants ont moins de deux ans –, les images sont de plus en plus violentes, le réseau possède un système de cryptage de plus en plus sophistiqué, etc. Il y a quelques semaines, j'ai, pour ma part, commencé à essayer de comprendre comment les choses fonctionnaient sur le dark web et mieux pris conscience – s'il en était besoin – de ses facettes sordides et dangereuses.

Certains réseaux, dont Tor et Freenet, sont totalement détournés par les cyberpédophiles et, chers collègues, nous ne pouvons pas rester les bras ballants face à cette indignité.

À la lecture du rapport de l'AFA, on s'aperçoit qu'on a enregistré, ne serait-ce qu'en 2014, une hausse de 100 % des signalements des contenus pédopornographiques. C'est-à-dire qu'on a constaté, une fois de plus, que cette pédopornorgraphie sur l'internet augmente plus que jamais.

Face à cette horreur, à cette abjection dans nos démocraties, quelles réponses?

Premièrement, pouvons-nous obtenir un véritable rapport d'évaluation de la mise en œuvre de la directive européenne, dont le délai de transposition – je le rappelle à la Commission – était fixé au 13 décembre 2013? Pouvons-nous obtenir des informations à ce sujet? La Commission peut-elle exercer son rôle de gardienne des traités à cet égard?

Deuxièmement, qu'en est-il du rôle et de l'accroissement éventuel des compétences et des pouvoirs de la Joint Cybercrime Action Taskforce d'Europol et du centre de cybercriminalité?

Troisièmement – vous n'en avez pas vraiment parlé, Monsieur le Commissaire, et je le regrette –, nous devons agir pour supprimer les sites et les bloquer afin de supprimer ces horreurs et ce contenu pédopornographique.

  Martina Anderson, on behalf of the GUE/NGL Group. – Mr President, I am pleased to see that this issue has been given some attention. The best way to advance this discussion is on the basis of a detailed proposal coming from the Committee on Civil Liberties, which we await.

Obviously this is a big issue but it is an area that needs to be looked at from a grassroots perspective: that is the only way to ensure children are protected. Children are carrying around smartphones in their pockets, and very few are aware of the risks associated with them. We need to explore the use and danger of new media so that children take precautions, and we need to ensure that parents and educators have the skills to inform. We should look at solutions which, while protecting children, also protect a free internet, and we should open up the discussion and raise awareness.

Recently in my own constituency in the North of Ireland, relatively innocent photographs of schoolgirls were obtained and used online: 732 photographs of schoolchildren from 19 post-primary schools were on a pornographic website used by paedophiles. This is shocking stuff, but it should be used as an example to show others in this age group just how careful they need to be.

Many believe that the people uploading these photographs should have been arrested, and this leads to the question of necessary measures to address this issue of ownership of photographs on social network sites, and how they are legally or illegally prepared.

  Jean Lambert, on behalf of the Verts/ALE Group. – Mr President, I think all of us will welcome the review of the directive when it comes later this year. It is very disturbing for us to hear just how many Member States have still, apparently, not fully transposed its provisions. Obviously, as people have said, the removal of existing content on websites is an important issue, and the directive makes it very clear that action to take down sites is compulsory and that, even if Member States choose to block, we need to be clear in the law about where responsibility lies. I think this partly answers the question that was raised earlier about service providers or whoever else it is: the law needs to be clear about what their action should be, and I think the directive is clear on people’s responsibility.

I would also welcome it if the Commission could say a little more about the difficulties it is having in getting agreement with third countries where sites are hosted and how that can be followed up, because we are all aware that child abuse images should not be acceptable in any country in the world. Indeed, child abuse itself should not be acceptable. I think we also we need to link together some of the actions that we are taking on vulnerable children, for example the measures in place to report missing children rapidly. We need to close the gap in our asylum system, where at present there is no duty for anyone to follow up on children who go missing.

Others have spoken – and my colleague just now – about the issues of the prevention and empowerment of children and young people so that they do recognise the risks. Certainly the Safer Internet Centres play an important role in also being a point of contact for children who cannot, or will not, report things to parents or teachers. I also think that there are issues here about good sex and personal relationship education, so that children understand what is really happening.

  Tibor Szanyi (S&D), Kékkártyás kérdés. – Képviselő asszony említette, hogy a megfelelő irányelveknek az átültetésében számos tagországi kormány habozik, lassú, vagy esetleg éppen tétlen. És azt is említette, hogy harmadik országokkal való együttműködés is bizonyos nehézségekbe ütközik. Itt, ebben a teremben egyhangúan beszélünk, de Ön szerint mi akkor annak az oka, hogy a kormányok vonakodnak? Tagországi kormányokra gondoltam elsősorban.

  Jean Lambert (Verts/ALE), blue-card answer. – Well, I am sure that the report that we get from the Commission will help clarify why some Member States are taking so long to actually implement the Directive.

I think that for some it is a question of whether it matches with their own particular laws, in particular where they are having to increase penalties, but like you, I find it amazing that Member States have really not got their act together on this. This is absolutely a crucial thing about protection of young people and, whatever the reasons, we should be asking our colleagues in national parliaments to be raising the questions there, as well, about why this is not transposed.

  Diane Dodds (NI). - Mr President, while the internet has been one of Europe’s most transformative assets in terms of expanding opportunities for businesses and consumers, we must accept that it has also aided the faceless criminals who prey on children online. It is therefore an area where we are right to work together to seek solutions and fight against such abuse.

November 2014 saw the publication in my own constituency of Northern Ireland of an independent report into child sexual exploitation, compiled by Kathleen Marshall. This found that, in one instance, a school reported it had identified six cases of online grooming in the last four years. In another example, it found that, in a facility for vulnerable young people, the number of cases of online abuse had increased from five in 2008 to 22 in 2013. The most recent Young Life and Times Survey in Northern Ireland reported that a staggering one in nine 16-year-olds had experienced grooming. We really must ensure that our children are equipped to deal with the internet. But, more than that, we must ensure that the global giants who run the internet ...

  Tadeusz Zwiefka (PPE). - Panie Przewodniczący! Wśród wielu różnych rodzajów cyberprzestępczości ta, która dzieje się z wykorzystywaniem seksualnym dzieci jest przeraźliwie oburzająca. Dlatego ważne jest, że dzisiaj Parlament Europejski podjął debatę na ten temat, choć czas na nią przeznaczony jest żenująco krótki – nie czarujmy się. Jest to nasza odpowiedź na raport, który opublikował Europol. Raport, który opisuje wzrost tego rodzaju cyberprzestępczości. On pokazuje także, jak niska wciąż jest skuteczność zwalczania tego rodzaju przestępstw. Z czego to się bierze? Kto z Państwa przeczytał ten raport to doskonale rozumie, w jakich kierunkach dzisiaj tego rodzaju przestępczość się rozwija. Przecież można sobie zamawiać sesje online, live, z różnych krajów świata, siedząc gdzieś w zaciszu swojego pokoju. I taki obleśny przestępca płacąc przez Kajmany czy przez jakąś inną wyspę, na której nie ma żadnej kontroli przepływów finansowych, zamawia sobie tego rodzaju obrzydliwe usługi seksualne.

To pokazuje, że konieczna jest większa harmonizacja przepisów, które pozwolą na zwalczanie tego rodzaju cyberprzestępczości, zwiększenie skuteczności współpracy organów ścigania i tych organów w państwach członkowskich oraz współpracujących z nimi krajach trzecich, które mają przeciwdziałać tego rodzaju przestępczości. To nie tylko oczywiście zwalczanie bezpośrednie, poprzez zabranianie, ale to także edukacja. Ważne jest i cieszę się, że będziemy mieli rezolucję, bo nie wyobrażam sobie...

Ifisser li naqbdu u nimblukkaw jew nillimitaw l-internet? Ċertament dik m'hijiex is-soluzzjoni. Hemm bżonn li l-Unjoni Ewropea tiffoka fuq żviluppi teknoloġiċi bħad-Darknet, is-suq illegali online li jiġi aċċessat minn infrastrutturi anonimi bħal Tor Network. F'Novembru li għadda l-Istati Uniti u anki l-Unjoni Ewropea ingħaqdu flimkien fl-operazzjoni 'Onymous' kontra dawn l-infrastrutturi. Hemm bżonn li nespandu ħidmiet globali bħal din biex nittargitjaw il-pornografija tat-tfal online, u hawnhekk nappella wkoll lill-Kummissjoni Ewropea biex taddatta d-Direttiva 2011 għal dawn ir-realtajiet ġodda.

Ħafna drabi ngħidu li t-tfal huma l-akbar riżorsa li għandna, u fl-istess ħin id-drittijiet tagħhom jiġu injorati. Il-marka li jħalli fuq it-tfal dan l-abbuż hija għal dejjem, għaliex dak ir-ritratt u dak il-filmat jibqa' jiġri magħhom.

  Branislav Škripek (ECR) - S nástupom týchto nových technológií nám tu vyrastá generácia mladých ľudí a detí, ktoré ovládajú technologické novinky omnoho lepšie ako ich rodičia a pedagógovia. Preto je oveľa ťažšie pre rodičov, ktorí majú prvotnú zodpovednosť za výchovu svojich detí, ustrážiť ich pred nevhodným a škodlivým obsahom na internete.

Deti sú prirodzene dôverčivejšie, častokrát si neuvedomujú nebezpečenstvá, ktoré im hrozia, keď navštevujú takéto nevhodné stránky, či komunikujú s nevhodnými ľuďmi. Ja si myslím, že tu tkvie naša zodpovednosť stanoviť a uplatniť legálne kroky voči producentom takýchto prevrátených vecí.

Ja som ešte ako poslanec Slovenskej národnej rady otvorene poukazoval na problém zobrazovania nevhodného, často až pornografického obsahu v dennej tlači a moja kampaň Nahota na predaj mala za cieľ legislatívne ukotviť ochranu detí pred nevhodným obsahom. Do dnešného dňa sa na podporu tejto myšlienky vyzbieralo takmer 70000 podpisov a ja som presvedčený, že toto ohrozovanie morálnej výchovy mladých začína už takýmto sledovaním aj v dennej tlači a prístupom k otvorenej pornografii.

De sexuella övergreppen och exploateringarna av barn på internet blir grövre och grövre och offren allt yngre, och blixtsnabbt sprids bilderna över världen. 2011 antog vi direktivet om bekämpandet av sexuella övergrepp av barn på internet. Nu måste kommissionen verkligen komma med den här rapporten och anvisa riktade verktyg som är verkningsfulla – inte bara ännu en rapport, utan verkningsfulla medel så att vi kan komma tillrätta med detta.

Manau, akivaizdu, kad valstybinės priežiūros institucijos ne visada turi pakankamai resursų atsekti padarytus nusikaltimus, juo labiau juos užkardyti. Todėl siekiant pokyčių reikia ne tik didinti atsakomybę dėl prievartos prieš vaikus, bet ir užtikrinti didesnį atsakingų institucijų finansavimą, bendrus Europos Sąjungos ir kitų šalių darbuotojų mokymus ir informavimą. Taip pat būtina gerinti skirtingų valstybių narių priežiūros institucijų bendradarbiavimą. Būtina, kad informacija greitai pasiektų skirtingas institucijas, būtų numatyti ir nuolat atnaujinami bendri greito reagavimo planai.

  Barbara Kappel (NI). - Herr Präsident! Der sexuelle Missbrauch von Kindern im Internet ist ein abscheuliches Verbrechen. Täglich werden Bilder und Videos von missbrauchten Kindern hochgeladen. Wir haben derzeit einen Bestand von vier Millionen Bildern und Videos. Dieser Bestand erhöht sich jährlich um 80 000 Bilder und Videos. 70 % der Kinder darauf sind unter zehn Jahre alt, und das Schlimme ist, die Bilder und Videos werden nicht gelöscht. Das heißt, dramatische Situationen bleiben für Kinder ein Leben lang erhalten.

Großbritannien ist ein Best-Practice-Beispiel für die Bekämpfung des Missbrauchs von Kindern im Internet. Es gibt einen Straftatbestand, der sexuelle Chats zwischen Erwachsenen und Kindern im Internet darstellt. Es wurde eine Spezialeinheit eingerichtet aus der National Crime Agency und dem Geheimdienst, um aktiver im Darknet vorzugehen. Es wurde eine Datenbank eingerichtet, Budgetpositionen eingerichtet, um ausreichend Personal für diese Task Force bereitzustellen. Ebenso wurden weitere 50 Millionen Pfund für den Global Child Protection Fund gewidmet. Länder der EU wollten das umsetzen. Leider ist die Richtlinie bis heute nicht in allen Ländern umgesetzt. Das ist schlecht.

Pädophile im Netz sind wie digitale Terroristen, und sie müssen – so wie die Terroristen – verfolgt werden, nämlich mit koordiniertem Einsatz von Polizei und Geheimdiensten, national, europäisch und international. Ebenso sind Task Forces einzurichten und auszustatten.

  Agustín Díaz de Mera García Consuegra (PPE). - Señor Presidente, más de un millón de imágenes pornográficas de niños circulan por internet, 200 nuevas aparecen cada día. Entre 50 000 y 100 000 pedófilos se coordinan en redes organizadas. Estos y otros datos reflejan la gravedad de este asunto.

La Directiva —actualizándola— o la creación de la alianza global son medidas importantes para hacer frente a esta amenaza creciente. Por eso es necesario adoptar un enfoque común, que abarque la acción policial y judicial contra delincuentes, la protección de las víctimas y la prevención del fenómeno. Por eso también deben darse especiales garantías en la prevención y persecución de estos delitos, y aún más en el tratamiento de los datos obtenidos en los procesos penales, para evitarles una mayor estigmatización a los niños.

Debemos utilizar la tecnología para eliminar sus errores, ya que en un problema tecnológico, parte de la solución es tecnológica. Son necesarias la eliminación de las URL cargadas de contenido delictivo, la lucha contra la financiación de páginas con pornografía infantil, la lucha contra la distribución y tenencia de material, especialmente a través de las redes de descarga peer to peer, o la creación de códigos de conducta de seguridad en internet, entre otros. Y todo ello con coordinación internacional de las autoridades implicadas, las fuerzas y cuerpos de seguridad del Estado, el sector privado y la sociedad civil, impulsando especialmente el rol de Europol y su EC3, de Eurojust y de la coalición financiera europea contra la explotación sexual comercial online de los niños.

Naturalmente, lo que hace falta es dejar aparcados los escrúpulos y los prejuicios, que tienen más que ver con la protección del delito que con la protección de la víctima.

  Marielle de Sarnez (ALDE). - Monsieur le Président, nous avons perdu beaucoup de temps, depuis dix ans, date de notre premier rapport. Si nous ne mobilisons pas toutes nos forces, nous allons perdre cette bataille, car aujourd'hui tout va de plus en plus vite, vous le savez, avec le dark web ou le deep web.

Nous avons un besoin vital d'un état des lieux pays par pays – nous vous l'avons déjà dit – et les réponses à apporter, au fond, nous les connaissons. Il faut sensibiliser les parents et les enfants, former les éducateurs et, d'ailleurs, pourquoi pas, mettre en place un numéro vert européen sur cette question. Nous devons aussi pouvoir bloquer et filtrer les sites. De toute évidence, les moyens d'Europol sont dérisoires, alors il faut vraiment les renforcer afin de pouvoir mieux rechercher et trouver les prédateurs, identifier les victimes et faciliter le partage des données. Au fond, pour protéger nos enfants, nous avons besoin de cette mobilisation sans faille, pas seulement de nos responsables politiques, mais aussi de la société tout entière.

  Richard Howitt (S&D). - Mr President, I am pleased, in this week of Safer Internet Day and as an official champion of the Internet Watch Foundation in the UK, to welcome this debate and to call for intensified efforts by the hotlines that already exist to take the imagery of child sex abuse down more quickly and to foster cooperation to ensure that the perpetrators are identified and prosecuted wherever they are in the world.

Last year the IWF removed 13 300 such images from the internet: a 100% increase on the previous year. At present in Britain there are a series of high profile prosecutions taking place on historic cases of child sex abuse from the 1970s. This debate is a reminder that the digital age has provided new opportunities for paedophiles and abusers for abuse and grooming.

What Safer Internet Day has taught us this year is that 3 in 4 young people themselves believe they have the power to create a kinder online community. We have to give them the tools to do so.

Myslím si, že v této věci Evropská komise, Evropský parlament a také členské státy musí spojit své síly, protože internet nemá hranice. Vy jste zde, pane komisaři, vyjmenoval řadu zásahů, včetně implementace směrnice z roku 2011, ale co mi chybí, je skutečně podrobné hodnocení toho, jak je směrnice implementovaná. My zde totiž nenavrhujeme žádnou novou regulaci ani směrnici, ale chceme se ptát, jak dosavadní směrnice funguje, jak jsou její opatření účinná. A vzhledem k nárůstu obětí se ukazuje, že všechna tato legislativní i technická opatření nejsou zřejmě účinná. Všechna tato opatření mají prostě zpoždění za těmi, kteří chtějí děti zneužívat. A já bych se Vás chtěla zeptat na to, jaký je Váš názor na skutečně účinnou podporu a větší osvětu v této věci vzhledem k rodičům, k dětem a školám.

  Ruža Tomašić (ECR). - Gospodine predsjedniče, (ne čuje se) Ministarstva unutarnjih poslova Republike Hrvatske iz 2013. jedno od petero djece koja koriste internet primilo je prijedlog seksualne prirode, dok je između 25 i 35 posto bilo izloženo seksualnim sadržajima. Počinitelji seksualnog nasilja danas više ne vrebaju iz grmlja, već iza pomno smišljenih korisničkih imena i lažnih profila na društvenim mrežama.

Smatram stoga da se moramo fokusirati na podizanje svijesti među djecom i roditeljima o opasnostima koje vrebaju na internetu. Dakle, ne čekati da se nešto dogodi pa onda reagirati, nego prevenirati. Dijete koje je pravodobno i kvalitetno informirano o opasnostima internet komunikacije s nepoznatim osobama znači jednu žrtvu manje. Također smatram da moramo razviti i širiti online sustave prijave seksualnog zlostavljanja djece, poput Red Buttona koji je implementiran u Hrvatskoj, te logistiku koja stoji iza njih.

  Ignazio Corrao (EFDD). - Signor Presidente, onorevoli colleghi, signor Commissario Stylianides, i dati li avete già dati voi, i dati delle ONG, i dati di Europol su quello che è veramente un problema di difficile soluzione, anche perché è come se fosse il rovescio della medaglia dei lati positivi di Internet. Se da un lato abbiamo uno strumento che ci consente, appunto, di unirci, di poter fare delle cose inimmaginabili fino a qualche anno fa, dall'altro lato c'è il Deep Web, il Dark Web, qualcosa che sfugge al nostro controllo e che comporta poi reati gravissimi che possono avere come vittime bambini di due anni o minori di ogni tipo. Quindi dobbiamo cercare di trovare il modo per riuscire a correre veloce quanto lo sviluppo di Internet. Non è semplice, gli strumenti che abbiamo a disposizione oggi non sono sufficienti e dobbiamo cercare di trovare insieme delle soluzioni.

  Anna Záborská (PPE) - Chcem poďakovať Monike Hohlmeier za to, že upozornila na potrebu sledovať uplatňovanie a prípadne aktualizovať smernicu o boji proti sexuálnemu zneužívaniu a vykorisťovaniu detí a proti detskej pornografii. Pripájam sa aj k požiadavke, aby Komisia pripravila osvetovú kampaň, ktorá by deťom umožnila pochopiť riziká internetu a podporila úsilie rodičov chrániť deti na internete.

Na Slovensku podobná kampaň, ktorú som iniciovala pod názvom „Viete, čo robí teraz vaše dieťa?“, poskytla rodičom základné informácie o rizikách alkoholu a drog, sexuálneho zneužívania a obchodovania s ľuďmi. Práve na ňu by mohla teraz Komisia nadviazať. Boj proti zneužívaniu detí na internete musí patriť medzi priority Európskej únie, aby sa našli prostriedky na financovanie takýchto dôležitých projektov.

  Christos Stylianides, Member of the Commission. - Mr President, I would like to thank you for giving me the chance to discuss with you today this challenging and extremely important issue. As you can appreciate, the European Union has already taken a series of steps to tackle sexual abuse of children on the internet, but unfortunately the fight to eradicate this hideous crime is far from complete. Unfortunately.

We need, therefore, to reflect on a policy that balances the right to privacy and protection of personal data with citizens’ security. Ensuring effective investigations and prosecution of child sexual abuse online is a positive duty of Member States to ensure protection of children’s fundamental rights.

Just one point. Indeed, as many others of you have already mentioned, we need more people to work in the focal point, in EC3. This is why the Commission supports the strengthening of Europol. It is very critical. All of us recognise these needs, these demands, already. But I would like to repeat that this is far from complete, this very painful issue, and I am sure that we will continue our cooperation to maintain awareness at an optimum level.

  Biljana Borzan (S&D), napisan. Izvješća o seksualnom zlostavljanju djece na internetu pokazuju alarmantne trendove. Sve je veća potražnja za internetskim sadržajima na kojima se prikazuje seksualno zlostavljanje djece, sve je više nasilja u takvim sadržajima, a dob žrtava je sve niža. Prema podacima Europola 10 posto žrtava ima manje od dvije godine.

Policiji je jako teško ući u trag počiniteljima, a sporni sadržaji ostaju online predstavljajući trajnu traumu za žrtve. Procjenjuje se da se svake godine uploada oko 50 tisuća spornih fotografija. O brzom skidanju neprimijenjenih sadržaja s interneta sam pisala Komisiji ranije, posebno se osvrćući na zabrinjavajući trend kada se maloljetnici viktimiziraju međusobno.

Na razini EU-a djeca u prosijeku počinju koristiti internet od 7. godine, a djeca od 9 do 16 godina provedu na njemu oko sat i pol dnevno. Razvojem i dostupnosti tehnologije stvara se veliki prostor za manipulacije. Smatram da je zajednička akcija na nadnacionalnoj razini nužan preduvjet za uspješno suzbijanje ovih trendova.

The cost of a free and open internet can, however, have hideous consequences, namely facilitating the occurrences of exploitation of and crimes against children. It is vital for us to vigorously peruse from every possible angle all means to protect innocent children from such cruel and deplorable crimes. We cannot afford to waste any time. With every year that passes, the amount of child pornography material and number of websites continue to grow exponentially and contaminate the web. In my country, the Czech Republic, the amount of child pornography content discovered by police soared from 136 in 2007 to 1047 reported cases in 2011. The nature of the internet, however, means that we cannot tackle this problem on a national level. Criminals on the other side of the world can be uploading images that may easily be accessed across borders and jurisdictions. These images do not disappear and continue to re-victimise the children long after the original crime has happened. Locally, nationally, and globally, we must protect our children.

  Therese Comodini Cachia (PPE), in writing. Child sexual abuse online is a crime that is ubiquitous and knows no borders. The fight to eradicate the online exploitation of children is far from complete. Child pornography offenders are increasingly operating in international online groups that use high standard technology and security protocols to frustrate the efforts of law enforcement to investigate their crimes. In addition to the further actions that should be taken to investigate cases of child sexual abuse online and to identify and prosecute offenders, we need to focus on prevention and need effective campaigns to support parents and educators on how to identify the online risks. We need an effective mechanism for reporting suspected sexual behaviour which on the surface can appear innocent. This initiative requires a global approach. While many efforts to improve child online protection are already under way, their reach has been more national than global. We need further EU action with the commitment of online platforms, internet providers and other stakeholders outside of the EU as well to fight against online child exploitation and to build powerful reporting tools and educational resources.

Le stime dell'Internet Center for missing and Exploited Children quantificano in 25 milioni di file il volume di materiale pedopornografico circolante in rete: in poco più di 10 anni, dall'ultima analisi del 2002, si registra una drammatica impennata di circa il 500%. Adolescenti, preadolescenti, ma anche bimbi e lattanti,vittime della navigazione più oscura, quella che spesso si annida e nasconde nel dark web ma anche tra le maglie dei social network.

Dobbiamo fare di più e ricorrere ad ogni misura e strategia per arginare questo infame fenomeno e sfruttare le capacità delle rete senza mettere a rischio la nostra sicurezza, ancor di più quella dei nostri bambini. La direttiva 2011/93/UE sulla lotta all'abuso e lo sfruttamento sessuale dei minori deve essere punto di partenza per un'azione coordinata e dura, preventiva e punitiva per reati di questo genere: task force internazionale, promozione degli "hashes" per identificare le immagini più pericolose circolanti online, avviare una seria riflessione a sostegno dell'etica e responsabilità dei colossi dei network, campagne di informazione per i più giovani sui pericoli della rete e per le famiglie per un'azione di controllo maggiore.

Ponad 70% z udziałem dzieci w wieku poniżej dziesięciu lat, a 10% z dziećmi poniżej dwóch lat! Jest to jedynie wycinek tej patologicznej rzeczywistości. W dalszym ciągu bardzo trudne jest określenie dokładnej liczby dzieci wykorzystywanych przez dorosłych w sieci. Anonimowość, która jest jedną z większych zalet internetu, w tym kontekście jest jego przekleństwem. Argumenty na temat wolności słowa i prawa do prywatności przestają mieć tutaj zastosowanie.

Dzisiejsza debata jest przypomnieniem, że era cyfrowa stwarza też nowe możliwości dla pedofilów. Biorąc pod uwagę globalny zasięg internetu, odpowiedzią UE na ich przestępstwa musi być nawiązanie szerszej współpracy z jej strategicznymi partnerami na całym świecie. Słuszne zatem jest powstanie światowego sojuszu, który ma zwalczać wykorzystywanie seksualne dzieci w internecie. Z całą pewnością wspólne działania poprawią skuteczność identyfikacji i udzielania pomocy ofiarom.

Kluczowe będzie także usprawnienie dochodzeń i ścigania cyberprzestępców oraz podniesienie świadomości zagrożeń wśród rodziców i dzieci, a także usuwanie treści niezgodnych z prawem. Musimy zrobić wszystko, by chronić najmłodszych uczestników wirtualnej rzeczywistości. Dzieci potrzebują naszego zjednoczonego głosu, który zobowiąże się do ochrony ich dzieciństwa.

  Beata Gosiewska (ECR), na piśmie. Internet niewątpliwie zrewolucjonizował nasze życie codzienne. Dla większości z nas stał się podstawowym źródłem informacji, edukacji, zatrudnienia czy rozrywki. Ale jak każde narzędzie może być używany w nieodpowiedni sposób. Nie ulega wątpliwości, że wykorzystywanie seksualne dziecka jest najbardziej odrażającą formą przemocy. Współczesny nieograniczony dostęp do mediów elektronicznych powoduje, że coraz więcej osób małoletnich korzystających z tych technologii jest narażonych na szkodliwe dla nich treści. Nie możemy zapominać o tym, że technologie nie stoją w miejscu i zmieniają się niezwykle szybko. Znalezienie równowagi pomiędzy wolnym internetem a zwalczaniem nielegalnych treści w sieci nie jest łatwe. Jednakże, w trosce o dobro najmłodszych obywateli UE, naszym obowiązkiem jest stworzenie skutecznego prawa, które odpowiada na wyzwania epoki cyfrowej.

Parlament Europejski wzywał wielokrotnie Komisję do znowelizowania dyrektywy o audiowizualnych usługach medialnych. Niestety do tej pory to nie nastąpiło. Komisja powinna zająć się przygotowaniem takiej nowelizacji, jak również dopilnować, aby państwa członkowskie jak najszybciej implementowały dyrektywę o wykorzystywaniu seksualnym dzieci z 2011 r. Należy znaleźć także dodatkowe środki na edukację zarówno dzieci, jak i dorosłych w tym zakresie.

  Ivan Jakovčić (ALDE), in writing. At almost every plenary sitting we discuss problems connected to the use of internet and to the violence that persists on the web. It was, once the case regarding war propaganda, but this time it is about the worst case scenario: the sexual abuse of children using the Internet. Personally, I think that all abusers should be strongly punished and that we have to use the logic of zero tolerance in such cases of cybercrimes. I want to highlight the need for the Commission to propose, with the so-called Global Alliance, an overall approach for the prevention of violence on the internet, and to oppose to everything that threatens our freedom and values. The new digital era should comply with new regulations. I feel that our legal system is still not fully ready to tackle new technologies and internet possibilities that go more quickly than our political and legal responses to the new digital era.

  Νότης Μαριάς (ECR), γραπτώς. Ο αγώνας ενάντια στη σεξουαλική κακοποίηση των παιδιών στο διαδίκτυο πρέπει να είναι άμεσος, αποφασιστικός και συνεχής. Δεν μπορούμε να αφήσουμε τα παιδιά μας στο έλεος των διαφόρων κυκλωμάτων και των εγκληματιών. Για το λόγο αυτό απαιτείται νομοθεσία αυστηρή και αποτελεσματική. Απαιτείται συντονισμός της δράσης των κρατών μελών της Ευρωπαϊκής Ένωσης και εδώ καλείται να παίξει σημαντικό ρόλο και η Ευρωπαϊκή Επιτροπή. Για να υπάρξει όμως αποτελεσματικότητα απαιτείται εφαρμογή της σχετικής οδηγίας της Ε.Ε. για τη σεξουαλική κακοποίηση και τη σεξουαλική εκμετάλλευση των παιδιών και την παιδική πορνογραφία. Ταυτόχρονα, οι διωκτικές αρχές και οι δικαστικές αρχές των κρατών μελών της Ε.Ε. πρέπει να γίνουν ακόμη πιο αποτελεσματικές για το χτύπημα των κυβερνοεγκλημάτων που δεν γνωρίζουν σύνορα. Μηδενική ανοχή λοιπόν στη σεξουαλική κακοποίηση των παιδιών στο διαδίκτυο. Αυτό είναι το μήνυμα που πρέπει να στείλει σήμερα το Ευρωπαϊκό Κοινοβούλιο.

  Jutta Steinruck (S&D), schriftlich. Der Missbrauch von Kindern und die Darstellung kinderpornografischen Materials im Internet ist ein weltweiter Skandal. Durch das weltweite Netz können die Täter Kinder ansprechen und mit Bildern und Filmen handeln. Kinder müssen davor bestmöglich geschützt werden. Dazu gehört die Bildung in den Familien, Kindertagesstätten und Schulen zum richtigen Umgang mit den neuen Medien. Aber dazu gehört vor allem ein entschlossener Kampf der Mitgliedstaaten.

Die Mitgliedstaaten müssen endlich die beschlossene Richtlinie aus dem Jahr 2011 in nationales Recht umsetzen. Außerdem dürfen die Mitgliedstaaten bei der Bekämpfung der abscheulichen Verbrechen die Verantwortung nicht an private Provider abgeben. Provider müssen jederzeit mit staatlichen Behörden zur Verbrechensbekämpfung kooperieren. Es darf keine privaten Systeme der Überwachung der Internet-Aktivität geben, die sich außerhalb der Verantwortung staatlicher Stellen bewegen. Das widerspricht dem Verständnis des Rechtsstaates.

Ich fordere die Kommission und die Mitgliedstaaten auf, endlich für eine rasche Umsetzung der Richtlinie in den Mitgliedstaaten zu sorgen und die staatliche Verantwortung zur Bekämpfung von Verbrechen nicht in private Hände zu legen.

Zastrašujuća je činjenica da je jedno od petero djece koja koriste internet primilo neželjeni prijedlog ili zahtjev seksualne prirode te da ih je u Europi od 10 do 20 posto seksualno zlostavljano. Nažalost, taj broj konstantno raste i slijedi alarmantne trendove kada je riječ o zlostavljanju djece na internetu. Poznato je da u zemljama u razvoju internet nije zastupljen kao u nekim zapadnim zemljama, stoga moramo na vrijeme oštro osuditi seksualno zlostavljanje i iskorištavanje djece uključujući dječju pornografiju, prostituciju i sve ostale okrutne zločine jer predstavljaju ozbiljno kršenje temeljnih ljudskih prava. Moramo ustrajati u tome da ustanovimo točan popis kaznenih djela, odredimo minimalne kazne, educiramo nadležne osobe te osiguramo protok informacija i kriminalnih dosjea počinitelja kako bi podignuli razinu svijesti o ozbiljnosti problema. Zadatak nam je stvoriti sigurno okruženje za djecu na internetu kako bismo ih istovremeno zaštitili i osposobili. Nadalje, žrtvama je nužno osigurati zaštitu te izraditi pouzdan zakonodavni okvir za pronalazak, identificiranje i kažnjavanje počinitelja s obzirom da su djeca ranjiva i često vrlo teško iznose svoje probleme. Ovo je situacija u kojoj moramo djelovati preventivno jer su u pitanju temeljna dječja i ljudska prava, prava naše djece - naše budućnosti.

Evident că propagarea rapidă și liberă a informației prin intemediul Internetului accelerează dezvoltarea economică și socială, stimulează cercetarea și inovarea și facilitează accesul la educație în zonele mai puțin dezvoltate. Dar, totodată, s-au deschis mai multe porți pentru infracțiuni, printre care și problema foarte gravă a abuzului sexual al minorilor şi a pornografiei infantile pe Internet. În ultimii ani s-au făcut pași importanți pentru combaterea acestor abuzuri, inclusiv din partea Comisiei Europene. Salut, pe acestă cale, Alianța Globală împotriva abuzului sexual al copiilor în mediul online. În acest context avem nevoie de măsuri de prevenție și sancționare care să țină pasul. De aceea, fac apel la o alocare mai substanțială de fonduri din partea Uniunii Europene pentru combaterea acestei infracțiuni. Se impune o alocare în concordanță cu gravitatea acestui tip de infracțiune, pe două dimensiuni: (1) implementarea și susținerea noilor măsuri; (2) informarea publică cu privire la acestea. Organizațiile care facilitează raportarea în mod anonim a acestor infracțiuni trebuie să fie mai puternic sprijinite, prin participarea activă a tuturor statelor și a instituțiilor UE, iar noi mecanisme de prevenție și sancționare pot fi introduse. Utilizatorii de Internet trebuie să fie clar informați că, prin implicarea lor, pot stopa fenomenul și că ignorarea abuzurilor vine în sprijinul infractorilor.
