  Przewodniczący. – Kolejnym punktem porządku dnia jest debata nad sześcioma projektami rezolucji w sprawie Tanzanii, w szczególności kwestii zawłaszczania ziemi (2015/2604(RSP)).

  Heidi Hautala, author. Mr President, this joint resolution is about our concern for an indigenous people in Tanzania – the Masai people. It appears that thousands of indigenous people have been evicted from land to which they have customary rights.

The European Parliament is, of course, an important actor here, because Tanzania is one of the development partner countries of the European Union. It is necessary to ensure that the European Union and its Member States, with the help of its development aid, encourage and demand full transparency and good governance on land tenure issues. The issue is that a very powerful presidential administration is doing big land deals with foreign companies in secret. We should insist on open accessible land registers so that the public and developing partners also have the right to know what kind of deals are being made at the cost of human rights.

  Catherine Bearder, author. Mr President, attacking pastoralists’ right to roam on their own land is an issue that has come up time and time again. The Masai Mara Serengeti ecosystem supports the highest concentration of wildlife on earth. It is estimated that Masai territories provide habitats for 80% of East Africa’s wildlife.

The Masai and other pastoralists see themselves as custodians of the land they inhabit and they play an essential role in conservation and environmental protection. They are ideally placed to be the eyes and ears to protect vulnerable species from poaching and other wildlife crimes.

Rather than being considered a threat to conservation, the Masai and other pastoralists must be included in plans to protect this fragile land on which they have co-existed peacefully and sustainably for millennia.

Tanzania must respect the numerous promises they have made to these people over the years. Pastoralists all over the world need protection from land encroachment and so the Commission and Member States must put pressure on the Tanzanian Government to make sure it brings forward legally binding laws to protect the rights of the Masai, not sell off their land to the highest bidder to create a playground for the rich and powerful.

  Branislav Škripek, autor Chcem tu verejne odsúdiť zaberanie pôdy v Tanzánii. Tento nezdravý jav umožňuje silnejším, aby v mene luxusu pripravili slabších o možnosť obživy. Verím, že budúcnosťou každého národa, no najmä afrického kontinentu, sú drobní farmári. Tí tanzánski majú už teraz ťažkú situáciu kvôli korupcii a prostrediu, ktoré v ich krajine vládne, a kvôli tomu, ako je u mnohých z nich zneužívaná ich negramotnosť. Ak chce Európa prispieť k rozvoju Afriky, mala by sa zaujímať o bežných ľudí, ktorých jedno luxusné safari určite nevytrhne z biedy a viac im pomôže možnosť obrábať pôdu svojich predkov bez strachu, že ju zo dňa na deň stratia, a mali by sme prispieť k tomu, naopak, aby sme nejakým spôsobom dosiahli, že tí samotní vlastníci budú chápať, že sú vlastníci na základe toho, že o tom môžu mať doklad a môžu sa dožiadať svojich práv, svojej dedovizne, zeme svojich predkov. Ja myslím, že lepšia cesta nie je.

Signor Presidente, onorevoli colleghi, bene, si è passati dalla corsa all'oro nero alla corsa alla terra: la terra degli indigeni, la terra dei masai, come nel caso della Tanzania di cui stiamo trattando. Soltanto che i masai, a differenza nostra, delle nostre idee speculative nei confronti della terra altrui, hanno l'idea che la terra non sia di nessuno, che essa sia dei morti, dei vivi, sia di chi deve ancora nascere.

Noi, nei confronti della Tanzania e di queste popolazioni, agiamo con il classico atteggiamento ipocrita di chi condanna, come in questa risoluzione – che chiaramente voteremo e che spero voterà tutto il Parlamento – per poi avallare investimenti crescenti nei biocarburanti in paesi come la Tanzania, che faranno sì che altre popolazioni indigene verranno spazzate via dai loro luoghi di origine.

Quindi dobbiamo stare attenti a cosa affermiamo, a cosa votiamo e poi a cosa facciamo di concreto, perché molte delle imprese che vanno a investire là – e il rapporto Gallagher che è stato commissionato dal governo della Gran Bretagna dimostra che sono investimenti crescenti, nel 2020 si parla di 31,5 milioni di ettari destinati alla produzione di biocarburanti – fanno sì che il nostro atteggiamento risulti molto ambiguo.

  Ivan Jakovčić (ALDE), pitanje koje je podizanjem plave kartice postavio. Gospodine Corrao, pažljivo sam vas slušao. Dijelim vaše mišljenje i moje pitanje je vrlo jednostavno: slažete li se sa mnom da je ovo smišljeni zločin nad narodom Masaija i da bi Europska unija u takvoj situaciji trebala prekinuti sve ozbiljne poslovne odnose s Tanzanijom?

  Ignazio Corrao (EFDD), Risposta a una domanda "cartellino blu". Sono assolutamente d'accordo con il collega Jakovčić: il modo in cui noi avalliamo queste speculazioni nel territorio delle Tanzania è assolutamente criminale. Io vorrei che noi pensassimo a cosa faremmo se fossero gli altri a venire nel territorio europeo e ci cacciassero perché devono coltivare qualcosa che serve loro per motivi energetici…

Sono assolutamente d'accordo: dovremmo interrompere qualsiasi rapporto con il governo della Tanzania se non si mette la parola fine su atteggiamenti speculativi come questo.

  Maurice Ponga, auteur. Monsieur le Président, chers collègues, nous discutons aujourd'hui d'un problème important: la question de l'accaparement des terres, qui affecte tout particulièrement la Tanzanie.

Suite à un projet de grande envergure des Émirats arabes unis, dans la province de Serengeti, plus de 40 000 Massaï vont être expulsés de leurs terres dans les semaines à venir. Cette situation n'est malheureusement pas isolée en Tanzanie. En effet, de nombreux projets menacent les modes de vie traditionnels des communautés pastorales, et notamment des Massaï de Tanzanie.

Dans notre résolution, nous condamnons fermement les déplacements illégaux des communautés rurales et la destruction de leur mode de vie traditionnel. Nous appelons les autorités tanzaniennes à respecter les droits des peuples autochtones et à protéger les droits des Massaï, et notamment leurs terres ancestrales. Nous demandons également à l'Union européenne de promouvoir la bonne gouvernance de la terre et de soutenir la transparence des investissements à grande échelle qui ont une incidence foncière en Tanzanie.

  Lidia Senra Rodríguez, Autora. Senhor Presidente, a apropriação da terra por empresas ou investidores chama-se acaparamento. O acaparamento de terras é uma realidade no Sul, mas também na Europa: Galiza, Roménia, Ucrânia e mais países.

Têm sido muitas as minhas intervenções neste Parlamento pelo fim do acaparamento das terras. Também tenho promovido atividades para sensibilizar sobre o impacto nos agricultores e agricultoras, tanto no meu país, na Galiza, como no Sul, na Colômbia. Mas hoje, infelizmente, não posso apoiar esta resolução, porque ela não recusa o acaparamento em si. Porque fazer transações de terra de maneira transparente continua sendo acaparamento. Porque há transparência na prestação de contas das empresas da União Europeia, das instituições financeiras e investimentos agroindustriais em grande escala, essas aquisições de terra na Tanzânia continuam sendo acaparamento.

  Josef Weidenholzer, Verfasser. Herr Präsident! Das Recht, über sein angestammtes Land zu verfügen und dort die traditionellen Lebensweisen verfolgen zu können, ist ein natürliches Recht der Menschen. Schon Rousseau hat darauf hingewiesen. Es wurde oftmals verletzt, seinerzeit im Verlauf der Kolonialisierung, jetzt als Folge von Marktöffnung und Kommodifizierung ursprünglich öffentlicher Güter.

Die Vereinten Nationen haben 1962 in der Entschließung über die immerwährende Souveränität über natürliche Ressourcen den Zusammenhang zur Degeneration der Menschenrechte hergestellt. Um diesen Zusammenhang geht es jetzt im Serengeti-Nationalpark. Private Investoren haben Rechtstitel erworben, die dazu führen werden, dass bis zu 80 000 Menschen der angestammten Massai-Bevölkerung ihre natürlichen Lebensgrundlagen verlieren. Wenn wir weltweit die Einhaltung der Menschenrechte einfordern, dann sollten wir nicht lockerlassen, landgrabbing als das zu kritisieren, was es ist: ein Bruch der Menschenrechte.

  Bogdan Brunon Wenta, w imieniu grupy PPE. Panie Przewodniczący! Wysiedlenia ludności, migracje środowiskowe przybierają masowy charakter w Tanzanii. Większość obserwowanych wysiedleń dotyka członków najuboższych i marginalizowanych grup ludności. Społeczności szczególnie obciążone konsekwencjami nielegalnego wysiedlenia to osoby nieposiadające sformalizowanych praw do ziemi. Brak tych praw często stanowi powód odmowy rekompensaty związanej z przesiedleniem, co łamie standardy praw człowieka. Słabością Tanzanii jest to, że brakuje wielu aktów prawnych.

Potępiam bezprawne wysiedlenia ludności, dyskryminację w zakresie praw własności oraz naruszenie podstawowych praw człowieka związanych z nielegalnym przywłaszczaniem ziemi lokalnej społeczności. Niepokoi brak dostępności przejrzystych informacji dotyczących liczby inwestycji w Tanzanii. Wzywam władze Tanzanii do wspierania polityki rolnej dającej korzyści populacji lokalnej i wdrożenia przepisów dotyczących prawa własności ziem w celu ochrony tej społeczności. Podkreślam znaczenie udzielenia adekwatnej rekompensaty zgodnie z rzeczywistą wartością wcześniej zamieszkiwanej czy użytkowanej ziemi.

  Kashetu Kyenge, a nome del gruppo S&D. Signor Presidente, onorevoli colleghi, le restrizioni alla proprietà della terra imposte per motivi etnici o di nazionalità o di genere devono essere abolite. Tutti, uomini e donne, hanno diritto alla terra. La terra deve essere condivisa tra quanti ci vivono e ci lavorano. Migliaia di masai sono stati cacciati violentemente dalle proprie case e dalle loro terre ancestrali in Tanzania, senza che avessero un giusto risarcimento.

Tutto questo per lasciare spazio a pochi ricchi turisti. Non è un fenomeno locale, non è una vicenda africana: è un fatto che ci riguarda da vicino. Dobbiamo chiedere più trasparenza alle società europee che operano nel settore agricolo in Africa o al settore privato maggior consapevolezza nei propri codici di condotta. A causa di questo fenomeno, intere comunità vengono espulse dalla terra, lasciate senza risarcimento o fonte di reddito. Non dimentichiamoci che la povertà è una delle principali cause dei conflitti.

  Csaba Sógor (PPE). The recent eviction at gunpoint of thousands of Masai in Tanzania is a manifest violation of the universal human right to own property and an act that should be immediately stopped.

In the case of these pastoralist cultures, land, animals and people are a cohesive whole. This is a case where there could be a strong synergy between the interests of the Masai and those of conservation and tourism. Unfortunately we see, sometimes in the EU too, that indigenous people, time and again, are denied the principle of free, prior and informed consent when it comes to their future.

Not only should we strongly condemn such acts, we should also make maximal use of all the tools the EU has at its disposal to prevent such measures before they take place, and especially the EU development financing, which should be fully linked to respect for human rights and cultural and environmental preservation principles.

  Lidia Joanna Geringer de Oedenberg (S&D). Panie Przewodniczący! Zawłaszczanie gruntu jest poważnym problemem w wielu krajach afrykańskich, w tym w Tanzanii. Dotyczy przede wszystkim utraty prawa lokalnej społeczności do ziemi, wody i innych zasobów naturalnych. W ostatnich latach odnotowano nową falę przejęć terenów na dużą skalę, spowodowaną rosnącym globalnym popytem na surowce, produkty rolne, biopaliwa czy turystykę. Przejęcie terenu nie gwarantuje jednak rozwoju, przykładowo większość inwestycji w biopaliwa w latach 2003-2008, na które przeznaczono 640 hektarów, upadła.

W Tanzanii 75% populacji stanowią rolnicy, ale tylko 10% z nich posiada formalne świadectwa własności ziemi, które uprawia. Powszechna korupcja i nadużywanie władzy przez polityków i urzędników państwowych prowadzi do zawłaszczania terenów uprawianych przez ludność lokalną i przekazywania ich w ręce zagranicznych inwestorów, a pozbawieni dostępu do zasobów naturalnych mieszkańcy zmuszani są do migracji w poszukiwaniu pożywienia i wody. Rząd Tanzanii powinien wspierać inwestycje, które przynoszą korzyści miejscowej społeczności, my zaś jako Unia Europejska powinniśmy prowadzić świadomą lokalnych bolączek politykę dialogu, wymiany handlowej oraz monitorowania operacji spółek z Europy w tym rejonie świata.

  Stanislav Polčák (PPE). Já bych rovněž chtěl podpořit toto usnesení. Samozřejmě považuji rozvoj zemědělství v Tanzanii za klíčové.

Každopádně vyhánění Masajů je nutno odsoudit a rovněž bych chtěl upozornit na to, že pouze tedy 10 % populace v Tanzanii vlastní konkrétní dokument prokazující jejich vlastnictví dané půdy. To je samozřejmě problém, protože potom investoři, kteří se chtějí k půdě dostat, mají poměrně usnadněnou situaci.

Rovněž bych chtěl upozornit na jiný klíčový moment, a to je otázka vzdělávání. Myslím si, že bychom měli tanzanskou vládu podpořit a vyzvat ji k tomu, aby posílila vzdělávání svých lidí právě v oblasti zemědělství, protože podle posledních údajů, které byly uveřejněny v časopisu Foreign affairs z února 2015, pouze 2 % afrických vysokoškoláků má vzdělání v oboru zemědělství. To si myslím, že je také jeden z těch důvodů.

Volevo chiedere al collega Polčák se è d'accordo sul fatto che dovremmo sanzionare e impedire che le imprese europee vadano in Tanzania a sfruttare il territorio e quindi cacciare popolazioni, come i masai, per fare degli investimenti speculativi su quel territorio. Cosa ne pensa lui.

  Stanislav Polčák (PPE), odpověď na otázku položenou zvednutím modré karty. Já děkuji za ten dotaz.

Těžko budu asi ze své pozice přikazovat nebo určovat tanzanské vládě, aby zaváděla nějaké sankce. Jestli na úrovni EU by měly být zavedeny podobné sankce podnikům, které se tímto způsobem chovají v Tanzanii, to si nedovedu bez znalosti konkrétního problému představit. Já jsem o tomto problému takto ještě neuvažoval.

  Marc Tarabella (S&D). Monsieur le Président, on estime que c'est au XVe siècle que les Massaï émigrant depuis le Soudan du Sud se sont installés dans les plaines sauvages du Kenya et de Tanzanie. Beaucoup de ces plaines, depuis, sont devenues des parcs à safari pour touristes, menaçant les richesses naturelles des terres et la tranquillité de ce peuple de chasseurs-éleveurs.

Aujourd'hui, plus que jamais, c'est l'avidité et l'appât du gain du gouvernement et des compagnies de chasse qui menacent les terres ancestrales massaï. Depuis 2009, maisons brûlées, accaparement des terres et violences font partie du quotidien de cette tribu. En février 2014, les autorités ordonnaient aux gardes nationaux du Serengeti d'expulser la population de force. Résultat: en trois jours, 114 habitations massaï réduites en cendres et 2 000 à 3 000 sans-abris.

Mais la violence envers ces peuples ancestraux n'est pas le seul problème de la Tanzanie. Entre pauvreté, chômage, corruption, inégalités et discriminations, le choix est grand.

Il est donc temps de taper du poing sur la table pour dénoncer cette violence et défendre le droit inaliénable des peuples à disposer d'eux-mêmes.

Monsieur Tarabella, je voudrais vous demander au sujet de la situation de la population massaï: ne serait-il pas plus important que l'Union européenne aide le gouvernement de Tanzanie à créer un service de cadastre plus efficace et à établir les papiers nécessaires pour cette population?

  Marc Tarabella (S&D), réponse "carton bleu". Il est clair que nous pouvons toujours exporter nos bonnes pratiques.

En ce qui concerne le cadastre, nous le devons à Napoléon, dont nous allons célébrer le deux-centième anniversaire de la défaite. Je sais que cela fait du bruit, car en Belgique, nous avons édité une pièce commémorative – c'est l'Histoire. Nos amis français n'aiment pas cela, mais un des mérites de Napoléon est d'avoir, notamment, introduit le cadastre ainsi que le Code civil.

Il est vrai que nous pourrions exporter ces pratiques afin d'instaurer un équilibre judicieux entre, d'une part, les droits des peuples à disposer de territoires et à ne pas en être chassés, ainsi que de pouvoir vivre de leur économie et de leurs activités sur ces terres, et, d'autre part, d'autres activités qui sont sûrement très intéressantes, comme l'exportation de ressources naturelles.

  Νότης Μαριάς ( ECR). Κύριε Πρόεδρε, η υφαρπαγή γαιών στην Αφρική είναι στην ημερήσια διάταξη. Διάφορες μεγάλες επιχειρήσεις και δήθεν επενδυτές αποκτούν με τη βία τεράστιες εκτάσεις, διότι θέλουν να τις χρησιμοποιήσουν είτε για γεωργική καλλιέργεια είτε για βιοκαύσιμα. Αυτό που συμβαίνει, στη συγκεκριμένη περίπτωση, είναι ότι επιχειρήσεις από τα Ηνωμένα Αραβικά Εμιράτα έχουν πετύχει να αποκτήσουν συγκεκριμένες περιοχές και να αρχίσει πλέον η παράνομη εκδίωξη των Μασάι από την περιοχή τους.

Υποτίθεται, τους λένε, ότι δεν έχουν έγγραφα που να αποδεικνύουν την ιδιοκτησία. Μα η ιδιοκτησία τους επί της γης προκύπτει από την χρησικτησία, προκύπτει από την καλλιέργεια επί πέντε τουλάχιστον αιώνες. Επομένως, απέκτησαν δικαιώματα. Δικαιώματα ιδιοκτησίας και αυτά προστατεύονται από τις Συνθήκες για τα Ανθρώπινα Δικαιώματα. Πρέπει, επίσης, να προστατευθούν και ως μειονότητα. Χρειάζονται μέτρα για την προστασία τους!

  Ivan Jakovčić (ALDE). Gospodine predsjedniče, ova me tragedija naroda Masaja podsjeća na one tragedije koje su na drugi način doživljavali moji Istrijani. Naime, oduzimanja zemlje u prošlom stoljeću svugdje je bilo mnogo zbog totalitarnih režima koji su bili, a baš je moja regija iznimno puno trpila zbog toga. I ljudi su ostajali bez zemlje. Ovdje, danas, u ovom stoljeću, to je zaista nevjerojatno da se takve stvari dešavaju, a da mi ne poduzimamo nikakve sankcije i nikakve akcije. Suosjećam s ovim što se dešava jer ovo kako se želi oteti zemlja zaista je skandalozno i pokušavam ovim jasno dati do znanja da Europa, Europska unija, treba reagirati, naročito ako ima saznanja da su u to uključene i europske tvrtke.

  Fabio Massimo Castaldo (EFDD). Signor Presidente, onorevoli colleghi, gentile Commissario, chi sono e che cosa stanno facendo le società europee in Tanzania? Questa è la domanda che dovremmo porci. Secondo voi può essere ancora tollerabile che nel terzo millennio comunità locali, in questo caso i masai, vedano espropriate le loro terre con atti di violenza incredibile e senza alcun rispetto dei loro diritti ancestrali? Terre da sempre destinate a riti funerari, alla comunità, per dar spazio a business company che speculano per costruire resort turistici e consentire la caccia grossa, questo ignobile e vigliacco trastullo per ricconi occidentali europei e arabi?

Con questa risoluzione noi intendiamo dare voce a oltre due milioni di cittadini del mondo che hanno firmato questo appello. Con questo discorso vi chiedo di contribuire a sviluppare un modello di agricoltura sostenibile, di ridare speranza a chi ha visto offesi diritti dei vivi e la pietà dei morti. È ora di sanzionare chi contribuisce a questo perverso meccanismo.

La Tanzania non può e non deve essere né il latifondo né il parco giochi dell'Occidente, noi siamo con i masai.

  Gianluca Buonanno (NI). Signor Presidente, onorevoli colleghi, volevo dire che non so se sono nel Parlamento o in un bar, perché sembra di essere al bar qua, invece di parlare di cose importanti. Guardi, guardi lo spettacolo! Cioè di cosa dobbiamo parlare, parliamo del cappuccino, del caffè? Parliamo delle brioches?

Io volevo parlare della questione dei masai: visto che è importante la questione dei masai, io vedo tanta ipocrisia. Però prima di pensare ai masai, vogliamo pensare prima agli europei, alla nostra gente, alla nostra sicurezza contro il terrorismo, contro quello che sta succedendo, ad esempio, in Libia, di cui si è parlato troppo poco?

Vogliamo parlare delle cose concrete del nostro popolo, della nostra gente o pensiamo sempre solo agli altri e ci dimentichiamo invece dei nostri giovani, dei nostri anziani, della gente che non ce la fa ad andare avanti?

Queste sono le cose che dovrebbe discutere questo Parlamento: guardi qua lo spettacolo, guardate che bello! Perché non facciamo anche una bella festa, tiriamo qualche petardo, tiriamo i coriandoli: questo è il Parlamento europeo?

  Johannes Hahn, Member of the Commission. Mr President, the debate today on the challenges associated with land rights in Tanzania is yet another testimony of the attention that Parliament has devoted to this matter for years and for which I thank you. This complex topic rightfully deserves our attention as it touches on issues that the European Union takes a keen interest in: human rights, rule of law and governance, and healthy and transparent business environment.

The phenomenon termed ‘land grabbing’ has different manifestations. Reports involving foreign investors or those threatening the livelihood of pastoralist communities have caused concerns. I refer to the most recent shocking case in Loliondo, Serengeti area, where park rangers and security forces burned the homes of Masai villagers, which affected 3 000 people. This was the latest episode in a longstanding conflict where the government’s authority to manage land use collides with the exercise of the pastoralist communities acquired customary rights.

The EU delegation and Member Statesʼ missions in Tanzania have consulted with the representatives of the pastoralist communities and they await the outcome of the investigation launched by district authorities. Land disputes are usually the result of complex and contrasting interests, weak legislation and administration, and poor dispute settlement mechanisms lead to conflicts that occasionally erupt with serious violations of human rights.

Tanzania has made commitments to improve land governance by signing up to the land transparency initiative launched by the G8 or by participating in the multilateral Open Government Partnership. We support these efforts and advocate for efficient and corruption—free land administration and law enforcement.

As we celebrated Women’s Day last Sunday, let me conclude by mentioning a special form of land grabbing that is often overlooked. Women in Africa are often denied ownership of land and lose it if their husband dies. In Tanzania, the EU supports a project promoting women’s ownership of land in densely populated areas. This contributes to a more equitable use of land and a more balanced growth, and ultimately to women’s empowerment.

  Lola Sánchez Caldentey (GUE/NGL), por escrito. Aplaudimos que la Resolución hace un llamamiento a los derechos de las indígenas de Tanzania y denuncia los casos de acaparamiento de tierra. También se apela a la coherencia de políticas de cooperación al desarrollo, así como a la responsabilidad y el rol de la UE y las empresas europeas en actuaciones de acaparamiento de tierras. Asimismo, recalca la importancia de la transparencia y de la rendición de cuentas y enfatiza el problema de inseguridad alimentaria por el aumento de biocombustibles. Sin embargo, encontramos algo vaga la Resolución al no contemplar puntos fundamentales como son la soberanía alimentaria, la problemática de la corrupción, el derecho a decidir, la problemática de la privatización de los bienes comunes como el agua y otros recursos los recursos.

Nous voudrions savoir si les députés européens vont être informés de la saisine, par M. Schulz, de l'Office européen de lutte antifraude (OLAF) concernant son seul assistant accrédité, Herbert Hansen, qui est pourtant établi dans la région d'Aix-la-Chapelle et qui est le responsable de l'agence de voyage du SPD. Évidemment, c'est une situation qui risque de créer – ou qui, en tout cas, permet de suspecter – un conflit d'intérêts.
