20.6. Искане за снемане на парламентарния имунитет на Виктор Успаских (A8-0061/2015 - Evelyn Regner) (гласуване)

– Vor der Abstimmung:

  Guy Verhofstadt (ALDE). – Mr President, after the emphatic discussion that I had with President Schulz – who told me that I should intervene now and not two hours ago – I call for this report to be referred back to committee on the basis of Rule 188(2). The reason is that, if you read the report, there are still doubts about a number of important issues – WikiLeaks documents and so on. There are also doubts about something that is especially important. When we dealt with the case of Mr Severin, we agreed to lift his immunity but on the condition that his capacity to exercise his mandate was not affected, that his personal freedom was not restricted. I would ask the Committee on Legal Affairs to take the same decision in the current case, and to reconsider this, so that Mr Uspaskich’s personal freedom is not restricted. I do not see why Mr Uspaskich should be treated in a less favourable way than Mr Severin, who was pursued for corruption, which is a much more serious matter. For that reason, I ask you to have a vote to refer this back to the committee.

  Bruno Gollnisch (NI). – Monsieur le Président, bien que M. Verhofstadt soit un adversaire politique, je soutiens fermement sa proposition.

J'ai siégé pendant plus de dix ans à la commission spéciale qui s'appelait alors "commission du règlement, de la vérification des pouvoirs et des immunités". Il y avait, il y a plus de vingt ans, dans ce Parlement, une jurisprudence objective, due à un de nos collègues – M. Donnez –, qui disait très clairement que lorsqu'il y avait un fumus persecutionis, une odeur de persécution politique, selon laquelle le député était poursuivi par des adversaires politiques et pour des raisons politiques, il fallait maintenir son immunité.

Cette jurisprudence, je l'ai, je pense, personnellement toujours observée, y compris lorsqu'il s'est agi d'un adversaire politique. J'ai observé avec regret une évolution de la commission qui tendait à maintenir l'immunité, disons, des parlementaires mainstream et à la lever systématiquement, même pour des affaires d'expression politique, pour les parlementaires "politiquement incorrects".

Je conclus, Monsieur le Président. J'aurais souhaité que M. Verhofstadt appliquât la même ...

  Evelyn Regner (S&D). – Herr Präsident! Herr Uspaskich hatte umfassend Gelegenheit, sich in seinem Fall zu Wort zu melden.

Der Rechtsausschuss ist in dieser Angelegenheit sehr umsichtig, sehr sorgsam vorgegangen – wie auch in anderen Immunitätsfällen. Wir haben uns eingehend damit beschäftigt – schon in der letzten Legislaturperiode. Das Ganze ist ein Verfahren, das jetzt vor dem Berufungsgericht ist, und wir haben diesen selben Fall abermals sehr sorgfältig im Rechtsausschuss behandelt.

Daher ist die Entscheidung absolut reif – und zwar jetzt. Wir haben uns diesen Fall wirklich lange und ganz genau angeschaut und jetzt ist der Zeitpunkt, um auch darüber abzustimmen.
