  Der Präsident. – Als nächster Punkt der Tagesordnung folgt die Aussprache über den Bericht von Cora van Nieuwenhuizen im Namen des Ausschusses für Wirtschaft und Währung über den Vorschlag für eine Verordnung des Europäischen Parlaments und des Rates über Indizes, die bei Finanzinstrumenten und Finanzkontrakten als Benchmark verwendet werden (COM(2013)0641 - C7-0301/2013 - 2013/0314(COD)) (A8-0131/2015).

  Cora van Nieuwenhuizen, Rapporteur. Morgen stemmen wij over cruciale wetgeving: de verordening inzake benchmarks die gebruikt worden in financiële instrumenten en financiële contracten. De afgelopen maanden was het weer raak. Onderzoeken, miljarden aan boetes, krantenkoppen over bedrog en oplichting in de financiële sector. De reden ditmaal: gesjoemel met de 4pm fix-benchmark, een benchmark-prijs waarop wisselkoersen van alle belangrijke valuta zijn gebaseerd. En ook het LIBOR-schandaal bracht een nieuwe recordboete, deze keer voor de Deutsche Bank.

De mythe dat benchmark-fraude het werk is van enkele rotte appels binnen een paar banken is inmiddels dus wel definitief doorbroken. Manipulatie kwam en komt voor in allerlei sectoren, ook bij grote en belangrijke benchmarks. Dit alles toont het belang aan van benchmark-indexen voor de financiële stabiliteit en ook de noodzaak van goede regelgeving om manipulatie van dit soort systeemrelevante benchmarks in de toekomst te voorkomen.

De wetgeving waarover wij morgen stemmen, is erop gericht de stabiliteit van het financieel systeem én de reële economie te beschermen. Dit betekent dat er voldoende waarborgen moeten zijn voor grote benchmarks zoals LIBOR of de benchmarks voor valutawisseling waarvan wij allemaal dagelijks gebruikmaken. Maar de regelgeving moet ook ervoor zorgen dat een groot en divers aanbod van indexen mogelijk blijft, zowel binnen als buiten Europa. Een groot aanbod maakt immers dat investeerders kunnen schakelen en overstappen naar andere benchmarks. Zonder alternatieven zullen meer en meer instrumenten en contracten gekoppeld worden aan een steeds kleiner wordende groep indexen, met als gevolg grotere marktconcentratie, meer macht voor de producenten van de grote indexen en natuurlijk ook grotere risico's voor het financiële systeem en de economie.

Concurrentie in de benchmark-industrie zorgt voor innovatie, beperkt systeemrisico's en zorgt voor sterkere marktdiscipline. Dit betekent dat er voor kleinere benchmarks een uitgebalanceerde behandeling moet zijn in de regelgeving. Het verslag, zoals het er nu ligt, biedt die balans, een balans tussen grote en kleine benchmarks, tussen financiële en benchmarks voor grondstoffen, en tussen die benchmarks geproduceerd in de EU en daarbuiten. Die balans is hard nodig om consumenten te beschermen, om kapitaalmarkten te laten groeien, om het economisch herstel te bevorderen en ook om de visie en doelen voor een Europese kapitaalmarktenunie te verwezenlijken.

Het is denk ik ook om deze reden dat de wettekst met een meerderheid van 48 stemmen voor en slechts 10 tegen de steun heeft gekregen van de Commissie economische zaken. Die steun kwam gelukkig van partijen van zowel links als rechts. Ik wil mijn medeonderhandelaars, de schaduwrapporteurs, heel hartelijk danken voor de collegiale en constructieve manier waarop zij hebben bijgedragen aan het opstellen van het verslag. Ik kijk er erg naar uit om die samenwerking op een goede manier voort te zetten tijdens de trialogen. Ik roep alle fracties op hun steun te geven aan dit verslag, zodat wij snel en met een sterk mandaat die trialogen kunnen ingaan, opdat we na bijna twee jaar van discussiëren aan het eind van dit jaar daadwerkelijk goede wetgeving inzake benchmarks van kracht kunnen laten worden.

  Jonathan Hill, Member of the Commission. Mr President, benchmarks may sound like a minor technical issue, but in fact they go to the heart of the financial services sector and to the economy more widely. They are the basis on which financial contracts are priced. They determine the value of great numbers of financial products, including the interest rates paid on many mortgages. The investment and pension funds in which citizens save for their future use benchmarks to determine their value or their performance.

So it follows that we need to be able to trust benchmarks, but a sequence of scandals has badly undermined confidence – and let us not forget that this is not a victimless crime. For me, manipulating benchmarks is the same as stealing. So that is why, to rebuild trust, we proposed that benchmark providers should be properly regulated and supervised; that they should put governance controls in place and manage conflicts of interest; that they should make benchmark setting more transparent and ensure that contributors to benchmark setting are appropriately overseen.

For critical benchmarks with cross-border impacts, we also propose setting up colleges of national supervisors, involving the European Securities and Markets Authority (ESMA). This will ensure appropriate oversight and the continuous availability of these benchmarks by requiring contributions from firms if needed.

This has not been an easy file, but it is a critical one, and I would very much like to congratulate Ms van Nieuwenhuizen on the skill with which she has taken it forward. I look forward to discussing some issues further in trilogue. The broad scope of the legislation means that it needs to be appropriate both for big and for small benchmarks, and although our proposal had elements of proportionality, the Committee on Economic and Monetary Control has proposed a more risk-based approach for non-critical benchmarks. I am grateful for your thinking on this and look forward to helping to strike the right balance.

As the EU will be the first jurisdiction to establish such a wide-ranging benchmark regulation, we must also address the question of access for third-country benchmarks, and while we want to keep our borders open, we must avoid importing risks linked to benchmarks that are not robust. Here again I look forward to discussing how we can achieve those objectives. Overall, I think that this is another important step in making sure that we have the building blocks for a strong financial system in place. Now we need to put these measures into effect.

  Marisa Matias, relatora de parecer da Comissão da Indústria, do Comércio Externo, da Investigação e da Energia. Senhor Presidente, a grande maioria dos cidadãos europeus é afetada, direta ou indiretamente, por índices de referência. Atualmente, temos diferentes fornecedores a produzir diferentes índices de referência, utilizando diferentes metodologias.

Muitos dos índices de referência tornaram-se, de facto, bens públicos. Como tal, os seus benefícios sociais devem ser maximizados, enquanto o prejuízo provocado à economia real e à sociedade no seu conjunto, resultante da sua potencial má produção ou manipulação, deve ser colocado sob escrutínio rigoroso e estar sujeito a sanções criminais e pecuniárias.

O meu parecer concentrou-se, principalmente, nas avaliações dos preços dos produtos de base, fornecidas pelas agências de supervisão e pelos mercados físicos de energia. As atuais disposições que proíbem a manipulação dos índices de referência utilizados não abordam todas as vulnerabilidades verificadas no processo de produção.

Os modelos de avaliação dos preços variam consideravelmente. Sabemos também que a manipulação das avaliações dos preços dos produtos de base pode pôr em risco não só o investidor mas também o utilizador final, pois é o que determina o preço que muitas famílias irão pagar pelo gás ou por qualquer outro fornecimento de energia.

Além disso, não podemos ignorar os conflitos de interesses ou arbítrio, que é o que acontece quando não há governação e controlos adequados. Saúdo, por isso, a iniciativa legislativa neste sentido, já que a autorregulação provou ser ineficiente.

No meu parecer, procurei minimizar a vulnerabilidade do processo de avaliação, facilitar a determinação sobre o preço avaliado, se ele reflete com precisão as transações do mercado físico que pretende medir, se os dados são suficientes para representar esse mercado e se são de boa-fé.

Procurei facilitar a capacidade de detetar, dissuadir e, se necessário, tomar medidas coercivas relativamente à manipulação ou outras condutas abusivas.

A minha avaliação final é, contudo negativa em face das propostas que aqui discutimos, não apenas porque as minhas propostas não foram aceites mas porque a questão essencial, a dos índices de referência críticos, ficou muito aquém do que deveria ser.

A redação final é muito limitada no que diz respeito à proporcionalidade e no que diz respeito à definição do que é um benchmark crítico ou um índice de referência crítico.

Propus o alargamento do âmbito do que é considerado índice de referência crítico, houve propostas dos grupos dos Verdes e dos Socialistas, que seriam essenciais para garantir uma regulação eficaz desta matéria, mas tudo isso foi recusado.

Por isso e por fim, numa área tão sensível como esta, é fundamental fazer, em vez de fingir que se faz. Infelizmente, pouco é feito e isso não é suficiente para podermos ficar descansados ou para devolver a confiança.

  Luděk Niedermayer , on behalf of the EPP Group. Mr President, it was said quite clearly by the rapporteur, Ms Cora van Nieuwenhuizen, and by Commissioner Lord Hill that the situation in the past was bad and could have far-reaching consequences for the credibility of the financial market and stability of the economy.

We should say here that many steps were taken in order to make the financial indices that are of vital importance for financial markets more robust. Now we are debating what is probably the last step in the creation of a safer environment that will bring credible and robust financial industries: legislation that is focused on administration of benchmarks and the creation of the indices.

As was said by the rapporteur, the proposal was put together quite some time ago and unfortunately it was not approved by the previous Parliament. The reasons were also quite technical. The Commission opted for a very wide and very deep proposal which drives concern for the sustainability of this regulation, especially for small indices. There were many questions concerning the consistency of this regulation with the international environment, which went rather towards the recommendation issued by IOSCO, and obviously it created problems with the third-country regime.

I am very happy that I could work on the legislation with the rapporteur because she opted for a balanced approach, focusing on better proportionality between the regulation of important – the most important – indices by allowing transparency to be used for improving the quality of the other indices. At the same time, we improved too the situation vis-à-vis the third-country regime and found the right balance between the responsibility of national supervisors and the responsibility of ESMA.

I feel we have a very good proposal in front of us. I hope that Parliament will give a strong mandate for us to negotiate in trilogue as there is a difference between the opinions of Parliament and the Commission, and that we will end up with a very good regulation that will fulfil all expectations.

  Jonás Fernández, en nombre del Grupo S&D. Señor Presidente, en primer lugar quiero felicitar a la ponente y al conjunto de los ponentes alternativos que hemos estado negociando este Reglamento en los últimos meses, que yo creo que mejora sustancialmente la propuesta inicial de la Comisión.

La posición de mi Grupo —del Grupo socialista— ha estado focalizada en mejorar el control y la regulación de los índices críticos y, en este sentido, en el texto que se somete a votación mañana hemos logrado una definición de índice crítico cualitativa que permite la definición de índices críticos nacionales. Asimismo, en la medida en que esos índices críticos son un «bien público» —como decía nuestra compañera Matias— van a poder estar sujetos a un precio razonable que controle el supervisor y, además, esos índices críticos van a disponer de un colegio de autoridades competentes presidido por la ESMA gracias al texto que aprobará este Parlamento.

Por lo tanto, estamos muy contentos con la regulación que hemos logrado para que los índices críticos (el euríbor, el LIBOR — los grandes índices que ponen en riesgo la estabilidad financiera—) puedan estar sujetos a una regulación más estricta y para que, además, los índices de las materias primas puedan también ser definidos como críticos.

Como contrapartida, es cierto que la negociación ha sido complicada y hemos tenido que ceder en algunos aspectos. Esa proporcionalidad de la que hablaba la ponente y los que me precedieron en el uso de la palabra supone que los índices no críticos van a tener una regulación algo menos restrictiva. Pero es verdad que, gracias a nuestro Grupo, las autoridades competentes nacionales van a disponer de la capacidad de control para supervisar cómo los administradores de esos índices no críticos cumplen su labor con un análisis posterior en los informes de la manera en la que se elaboran esos índices.

Por último, hemos llegado a un acuerdo para que los índices elaborados en terceros países cumplan con las reglas de la OICV. Es algo más de lo que había previamente, no es todo lo que nos hubiera gustado, pero creemos que es un gran acuerdo que va a permitir que los consumidores, los ciudadanos europeos, cuenten con unos índices mucho más robustos y mucho más serios.

  Kay Swinburne , on behalf of the ECR Group. Mr President, I would like to begin by thanking the rapporteur for all her hard work in putting forward a sensible approach to this file and accommodating so many political groups in the compromise position we are voting on tomorrow.

This text provides a good framework for national competent authorities to supervise benchmark administrators within a sound European framework. This new regime will ensure that investors and consumers are protected across the entire EU. The approach rightly focuses a tough regime upon critical benchmarks and is not overly onerous upon other benchmarks that are easily substitutable. The focus upon transparency to users of benchmarks will allow investors and consumers to decide if they are happy with the way in which benchmarks are compiled and use alternatives should they find it necessary.

The more proportionate approach taken within Parliament’s text for non-critical benchmarks is to be welcomed. However, it is only possible if Member States are also able to choose to elevate a benchmark that may not naturally fall into the critical category, should they feel it is systemically important to their domestic market; indeed they should be able to upgrade to critical status if they think that index is particularly susceptible to manipulation.

As we begin negotiations with the Council and the Commission, I would urge all parties to pay particular attention to the way our third-country provisions interact, with a proportionate approach being proposed for non-critical benchmarks.

The use of internationally—agreed IOSCO principles to measure equivalence is of fundamental importance to improving the standards that benchmark administrators globally are held to, without creating the many problems we have seen with other pieces of legislation that have had an extra—territorial effect.

I look forward to working with the rapporteur and the rest of the negotiating team in trilogue to achieve a workable and beneficial outcome for all.

  Sylvie Goulard, au nom du groupe ALDE. Monsieur le Président, Monsieur le Commissaire, je vous remercie d'être parmi nous. Je voudrais remercier également Cora van Nieuwenhuizen, même si elle fait partie du groupe ALDE, parce que, en tout cas au nom de l'antériorité, ceux qui étaient présents lors du mandat précédent savent à quel point la question était difficile.

Monsieur le Commissaire, j'ai beaucoup apprécié vos paroles fortes. J'espère qu'elles vous guideront dans le trilogue et que, lorsque vous aurez affaire, peut-être – qui sait? –, à des États quelque peu réticents, vous utiliserez le même genre de paroles devant eux.

Je crois que Cora van Nieuwenhuizen est arrivée à un résultat équilibré avec un grand travail aussi des autres groupes politiques. Cela mérite d'être souligné.

En revanche, personnellement, j'aurais préféré un rôle encore plus déterminé pour ESMA. On a créé cette autorité de supervision pour que, justement, dans le marché intérieur, il ne soit pas possible de se dérober. Donc, dans la définition des nombreuses normes techniques, ESMA aura un rôle, c'est vrai. Cette institution aura aussi un rôle d'arbitre ultime pour la définition des indices d'importance critique – je crois que cela est un point très crucial –, à savoir tous les indices qui ne sont pas liés à un taux de change ou interbancaires mais qui ont notamment une incidence sur la stabilité financière. La gestion et le suivi du registre public des indices de référence lui sont également confiés, et ESMA aura un rôle en cas de non-respect des règles par une autorité compétente. Je crois que tout ceci va vraiment dans le bon sens.

Monsieur le Commissaire, j'attire l'attention sur la question du budget d'Esma qui est toujours, comme celui de toutes ces autorités de supervision, un petit peu menacé en permanence. Si le Conseil était là, je le dirais aussi au Conseil. Il y aura un difficile équilibre à trouver entre l'encadrement et la supervision étroite au vu de l'influence de certains indices et de la proportionnalité compte tenu du nombre d'indices. Ce sera donc petit à petit dans la mise en œuvre que, selon moi, on pourra, de manière pragmatique, éventuellement rectifier le tir.

En tout cas, merci à vous tous et bon courage pour les trilogues.

  Josu Juaristi Abaunz, en nombre del Grupo GUE/NGL. Señor Presidente, señor Hill, ha mencionado que manipular equivale a robar.

Yo quiero hablarles del IRPH y de este Reglamento, que se supone que debería nacer precisamente con el objetivo específico de reducir el riesgo de manipulación de los índices de referencia. Sin embargo, los requisitos mínimos que establece la nueva normativa son muy básicos, y, aun así, el IRPH los incumpliría.

Se exige, por ejemplo, hacer públicos los datos empleados para elaborar el índice, algo que en el caso del IRPH no se cumple, alegando que se trata de datos secretos. Además, el IRPH no es representativo del mercado ni está sujeto a la ley de la oferta y la demanda, con lo que incumpliría otros dos requisitos mínimos.

Este Parlamento debe impedir que las familias con menos recursos se vean obligadas a pagar hasta trescientos euros más en comparación con las hipotecas que usan el euríbor como índice de referencia. El IRPH es claramente abusivo. Está llevando a las familias afectadas primero, a la miseria y luego, al desahucio. Este Reglamento no puede dejar ningún resquicio que permita que ese índice abusivo siga siendo aplicado por los bancos.

  Philippe Lamberts, au nom du groupe Verts/ALE. Monsieur le Président, ce qui est frappant dans l'histoire des indices de référence, c'est que les infractions à la loi se sont poursuivies massivement, bien au-delà de la crise financière. On aurait cru que la crise financière aurait ramené l'industrie à un petit peu plus de raison; or des méga-institutions financières  – on a cité Deutsche Bank mais il y en a bien d'autres – se sont "amusées" à manipuler ces indicateurs pour leur profit, pendant des années, jusqu'à aujourd'hui peut-être.

Certains diront: "C'est bien, aujourd'hui, ils ont été condamnés à des amendes qui sont payées par les banques, pas par les individus". Je rappelle que, dans certains pays, ces amendes sont même déductibles fiscalement, ce qui fait qu'elles sont payées par le contribuable. Alors, il était temps, évidemment, qu'un nouveau règlement voie le jour, et je remercie donc Cora van Nieuwenhuizen pour le travail qu'elle a fait.

Nous avions un compromis pratiquement jusqu'à la fin. Or, à la fin, certains amendements de dernière minute ont, en fait, soustrait à ce règlement une série d'indicateurs qui autrement auraient été considérés comme critiques. Vous l'avez vu, on a un régime dur pour les indicateurs critiques et un régime assoupli pour les indicateurs qui sont jugés non critiques. Une série d'indicateurs échappent donc à cette législation.

La seule chose que je puisse dire, c'est que je me réjouis que l'État membre qui contrôle le plus ces indicateurs, le Royaume-Uni, n'ait pas attendu le Parlement européen pour adopter une réglementation beaucoup plus stricte que celle que nous approuvons aujourd'hui. Cependant je m'interroge, un peu comme Sylvie Goulard, sur le fait que, en matière de régulation financière – alors que nous savons que nous avons un marché unique –, nous nous en remettons finalement à la sagesse des États membres, sans beaucoup de contrôle pour ESMA, d'ailleurs, pour faire appliquer ce règlement.

Nous ne pouvons donc pas accepter que la définition d'un indicateur critique soit laissée aux États membres. Si nous pouvons encore, en dernière minute, modifier le texte demain par les amendements que nous déposerons, nous ferons partie de la majorité.

  Bernard Monot (NI). Monsieur le Président, Monsieur le Commissaire, chers collègues, au vu des débats qui ont été consacrés à cet avis sur les indices de référence, on est tenté de trouver décevant le résultat de ce rapport, qui prévoit la seule supervision.

Le constat de départ est pourtant consensuel: il faut encadrer plus strictement les indices financiers afin d'éviter les scandales passés. Je regrette que le seuil pour les indices critiques ait été fixé trop haut et que la partie véritablement contraignante de la réglementation ne s'applique qu'au Libor et à l'Euribor.

Mais, au-delà, je voudrais dénoncer, une fois de plus, certaines banques d'affaires au cœur des scandales financiers, qui nous obligent à agir.

Le scandale du Libor n'est qu'une manipulation des marchés parmi d'autres, comme celles du cours de l'or ou du Forex. Il s'ajoute aux scandales à répétition d'HSBC, au blanchiment d'argent, à l'aide à l'évasion fiscale, aux bonus indécents, aux prêts immobiliers à risque, etc.

Plus on légifère, moins les banques privées sont contraintes par les États et plus elles prospèrent sur leur dos. Les quelques milliards d'euros d'amendes sont minimes au regard de l'enjeu qui s'élève à plusieurs dizaines de milliards d'euros par an de profit pour les fraudeurs.

La véritable question que l'on doit se poser est celle de savoir comment casser la dynamique infernale de la finance sans frontières. Pour les économistes patriotes et sérieux, c'est une évidence: pour être efficace, il faut rétablir un contrôle des mouvements de capitaux aux frontières nationales afin notamment de limiter la spéculation et les ventes à découvert.

  Ева Паунова (PPE). Доверието в нашите пазари пострада от скандали и твърдения за манипулация на показателите. На това трябва да бъде сложен край, а доверието да се възстанови, както и да бъде дадена повече прозрачност на финансовата система.

Ето защо аз приветствам това предложение и поздравявам колегите, работили по доклада, за създаването на по-балансиран текст, който преодоля проблематичните елементи и може да осигури широка подкрепа.

Повечето държави – членки на Европейския съюз, в момента нямат нормативна уредба за производството на референти показатели на национално равнище, което предоставя възможност за създаването на хармонизирана европейска рамка за критерии. Въвеждането на такава рамка ще подобри защитата на потребителите на финансови услуги, ще повиши доверието и с това ще допринесе и за подобряване на финансовата стабилност на национално и европейско ниво.

Важно е обаче да се вгледаме и в последствията от новите правила върху цялостния финансов пазар, например, ако някоя инициатива задължи доставчиците на входящи данни да променят значително своите бизнес модели и има опасност те да намалят броя на предлаганите услуги.

Ето защо е важно да се погрижим новите правила за доставчици на входящи данни за референтните показатели да не възпрепятстват иновацията и да не създадат ненужни тежести за бизнеса.

Като цяло подкрепям доклада, който ще повиши доверието на европейските граждани във финансовата система на Европейския съюз и ще осигури повече прозрачност.

  Pervenche Berès (S&D). Monsieur le Président, Monsieur le Commissaire, d'abord toutes mes félicitations à la rapporteure parce qu'il s'agit d'un sujet technique mais critique.

Au fond, si nous sommes ici réunis autour de ce texte, c'est parce qu'il y a eu le scandale de l'Euribor et la question du Libor, parce que ces indices critiques peuvent mettre en cause la stabilité des marchés financiers, fragiliser leur fonctionnement et, au bout du compte, avoir un impact réel sur les conditions de financement de l'économie. C'est la raison pour laquelle il était urgent que l'Union européenne se mobilise. Mais, bien sûr, nous sommes face à un compromis, et je regrette, moi aussi, que les pouvoirs de l'autorité de supervision – autorité qui démontre jour après jour la solidité de ses analyses et de ses recommandations – n'aient pas été davantage renforcés pour ce qui est tant de la définition des indices critiques que de leur supervision.

De la même manière, je regrette que les États membres bénéficient d'une marge de manœuvre trop grande dans la définition des indices dits non critiques.

Enfin, un dernier point, Monsieur le Président, si vous me le permettez. L'Union européenne se dote d'une législation exigeante et elle entend vérifier son équivalence avec les législations des autres parties du monde sur la base de ce qui existe sans tenir compte de l'avancée que nous allons faire ici, en se référant uniquement aux travaux de l'OICV. Je trouve qu'il y a là une marge de manœuvre, et nous aurions dû aller plus loin; mais je souhaite, moi aussi, bon courage à l'équipe de négociation.

  Stanisław Ożóg (ECR). Szanowny Panie Przewodniczący! Sprawozdanie zawiera słuszne rozwiązania dotyczące indeksów w instrumentach i umowach finansowych. Wiele uwagi poświęcono starannemu opracowaniu definicji i późniejszemu traktowaniu tzw. wskaźników kluczowych i niekluczowych, traktowaniu wskaźników towarowych, wyłącznych zasad IOSCO do rozporządzenia oraz w dostępie do wskaźników stosowanych przez państwa trzecie. Proponowane regulacje powinny przyczynić się do poprawy rzetelności wskaźników, zmniejszenia ich podatności na manipulacje, a pośrednio zwiększenia zaufania do rynków finansowych i poprawy warunków ich funkcjonowania.

Jednakże widziałbym tutaj kilka obszarów, które można byłoby jeszcze poprawić, szczególnie jeśli chodzi o doprecyzowanie przepisów wyznaczających zakres obowiązywania projektów czy wprowadzenie bardziej adekwatnych przepisów lub dodatkowych zwolnień dla wybranych kategorii administratorów, a także doprecyzowanie przepisów przejściowych.   Barbara Kappel (NI). Herr Präsident, Herr Kommissar Hill! Robuste und transparente Benchmarks sind wichtig für die Stabilität des Finanzmarkts. Allein das Volumen von 500 Milliarden Euro an Finanzkonstrukten, Finanzkontrakten und Finanzierungsinstrumenten, das auf Benchmarks beruht, zeigt uns, wie wesentlich der heutige Bericht ist und wie wichtig es ist, Transparenz in den Bereich der Benchmarks zu bringen. Der Libor-Skandal wurde heute schon angesprochen. Auch hier zeigt sich: Nur Transparenz kann den Interessenkonflikt von Manipulation und Missbrauch lösen, Transparenz sowohl bei den Input-Daten als auch bei der Methodologie, denn das wurde im Libor-Skandal deutlich: Man kann sich zwar über eine gemeinsame Methodologie einig sein, aber wenn die Input-Daten manipuliert werden, wird man nicht weiterkommen. Es ist zu diesem Skandal gekommen, der zu einer Rekordbuße für die Deutsche Bank geführt hat – wir hörten es.

Der vorliegende Bericht ist hier ein erster wichtiger Schritt, nämlich um Transparenz und Sicherheit zu schaffen, und ebenso für die Benchmark-Administratoren, die sich bei ESMA hinkünftig anmelden müssen. Wir müssen aber als Europäisches Parlament einen Schritt weiter gehen. Führende Banken und Versicherungsvertreter fordern heute eine bessere makroprudenzielle Regulierung, um die Finanzmarktstabilität zu gewährleisten. Hier muss das Europäische Parlament einen nächsten Schritt setzen, hier sind wir gefordert.

Signor Presidente, onorevoli colleghi, la considerazione di partenza, a mio modo di vedere, riguarda l'ottimo lavoro che è stato fatto nella compilazione di questa relazione, perché rispetta l'obiettivo che dobbiamo proporci di fronte alla pur critica situazione sottostante. L'obiettivo è quello di ristabilire un clima di fiducia.

Se di fronte ai pur condannabili scandali dovessimo decidere di attivare un fenomeno di terrorismo psicologico, avremmo rinunciato al perseguimento del nostro compito anche politico. Quindi complimenti alla relatrice e a chi ha sostenuto questo lavoro, che ha come punto d'equilibrio, ad esempio, a mio modo di vedere, l'ottima scelta di individuare quali sono le distinzioni tra indici critici e indici invece non considerabili come tali.

È chiaro: anche il mio paese, l'Italia, ha visto in questa fase un'importante difficoltà legata, ad esempio, a una procura che rispetto ai rischi legati a 2 milioni e mezzo di famiglie possibili danneggiate ha attivato una rogatoria internazionale che coinvolge grandi istituti europei. È vero, in Italia si discute del fatto che Deutsche Bank sarebbe esposta per una quantità di derivati che è cinque volte il PIL dell'eurozona, benissimo, ma l'approccio è questo: la soluzione del problema, non l'attivazione di un ulteriore terrore, di ulteriore sfiducia.

La preoccupazione sugli effetti che una procedura di questo tipo può avere sulle SMEs, sulle piccole e medie imprese, è una preoccupazione che condivido, e a volte a questa domanda rispondo con fatica perché, purtroppo, ai buoni propositi abbiamo sempre visto succedere conseguenze non all'altezza delle nostre domande.

Credo che la strada sia quella buona. Credo che la prima preoccupazione che dobbiamo avere è costringere gli istituti di credito dell'Unione europea a rimettere al centro della loro attenzione le piccole e medie imprese.

Come? Come può essere ottenuto questo? Passa anche attraverso una revisione radicale della struttura di governance delle istituzioni di credito a livello europeo, non solo attraverso la ridefinizione dei benchmark finanziari.

  Zbigniew Kuźmiuk (ECR). Panie Przewodniczący! Panie Komisarzu! Manipulacja wskaźnikami LIBOR i wskaźnikami walutowymi przez podmioty sektora finansowego, banki i inne fundusze inwestycyjne doprowadziła w ostatnich latach zarówno przedsiębiorstwa, jak i inwestorów indywidualnych do ogromnych strat finansowych. Wprawdzie regulatorzy rynków finansowych w Europie doprowadzili do ukarania tych, którzy manipulowali tymi wskaźnikami, karami opiewającymi na miliony euro, ale w związku ze stratami, jakie ponieśli inwestorzy, konieczne jest przyjęcie na poziomie unijnym uregulowań, które zapobiegną w przyszłości takim skandalom finansowym.

Omawiane dzisiaj rozporządzenie idzie w tym kierunku i skupia się na realizacji trzech celów. Po pierwsze, na wzmocnieniu systemów zarządzania i norm, zwłaszcza w przypadku szeroko stosowanych wskaźników o znaczeniu systemowym – tzw. kluczowych – i zmniejszeniu ich podatności na manipulacje i nadużycia. Po drugie, zwiększeniu przejrzystości poprzez udostępnienie większej ilości informacji dostępnych dla użytkowników wszystkich wskaźników w celu umożliwienia im podejmowania świadomych decyzji. Wreszcie po trzecie, utrzymaniu podaży różnych wskaźników i dostępu do nich poprzez proporcjonalne stosowanie wymogów w zakresie korzystania nimi.

Chciałbym wyrazić nadzieję, że zastosowanie tego rozporządzenia w praktyce przyczyni się do potężnego ograniczenia nadużyć przez sektor finansowy polegających na manipulowaniu wskaźnikami.

Domnule Președinte, Uniunea Europeană a fost și este preocupată de stabilitatea economică, în general, dar, mai ales, de stabilitatea și buna funcționare a piețelor financiare și de mărfuri. În acest sens, instrumentele financiare folosite pentru încheierea diferitelor contracte financiare trebuie să beneficieze de o legislație clară, dar, mai ales, predictibilă. Atragem atenția însă că indicii de referință pot constitui mijloace de manipulare a piețelor, ceea ce determină nevoia de a identifica mecanisme și măsuri menite să prevină acest lucru, astfel încât să nu avem de a face cu o deformare a acestor realități. Evoluția rapidă a piețelor trebuie să determine factorii responsabili de a găsi un echilibru între nevoia de transparență și capacitatea utilizatorului de a impune o disciplină, având ca obiectiv major descurajarea manipulării indicilor de referință. Sub acest aspect este deosebit de important să ținem seama de faptul că, întotdeauna, piețele și realitățile economice diferite generează și diferite tipuri de indici de referință. Uniunea Europeană trebuie să găsească mecanisme prin care să reglementeze indicii de referință atunci când aceștia au efect în mai multe state membre, lăsând însă aceste mecanisme la latitudinea statelor naționale, când se manifestă doar la nivel național. În acest sens, trebuie să avem în vedere creșterea standardelor și sistemelor de guvernanță, precum și creșterea transparenței, oferind posibilitatea tuturor de a lua decizii în cunoștință de cauză. Doar în acest fel putem vorbi de o concurență echitabilă pentru toți administratorii, atât pentru cei de la nivelul Uniunii Europene, cât și pentru cei de la nivelul statelor terțe.

  Marijana Petir (PPE). Gospodine predsjedniče, smatram da je potrebno donošenje uredbe kojom će se na razini Unije uspostaviti zakonodavni okvir za indekse koji se rabe kao referentne vrijednosti u financijskim instrumentima i financijskim ugovorima, a glavni razlog tome je osiguravanje visoke razine zaštite potrošača i investitora.

Važno je obuhvatiti sve referentne vrijednosti s pomoću kojih se određuje cijena financijskih instrumenata ili potrošačkih ugovora te mjeri uspješnost investicijskih fondova. Osiguravanje točnosti i ispravnosti indeksa je ključan zahtjev koji se želi osigurati ovom uredbom i podržavam četiri osnovna cilja za poboljšanje okvira u kojem se referentne vrijednosti utvrđuju.

Utjecaj na proračun Unije ne smije biti kamen spoticanja kod usvajanja uredbe i mislim da će koristi od strožeg upravljanja ključnim referentnim vrijednostima i nadzora pri njihovom utvrđivanju daleko nadmašiti pri tom nastale troškove. Slučajevi manipuliranja referentnim kamatnim stopama su isto tako, uz navodne manipulacije referentnim vrijednostima u sektorima energetike i deviznog poslovanja, pozvali na donošenje ovakve uredbe i zato je podržavam.

Signor Presidente, onorevoli colleghi, i mercati finanziari riscontrano a più riprese la manipolazione dei valori di riferimento per la determinazione dei tassi d'interesse quali LIBOR ed EURIBOR. Tali manipolazioni, con la dimostrazione che i valori di riferimento possono essere soggetti a conflitti d'interesse e vulnerabilità, sono importanti fattori di disturbo degli equilibri economici e causano considerevoli perdite ai consumatori e agli investitori, oltre a distruggere la fiducia dei cittadini nel settore finanziario.

È senza dubbio opportuno, quindi, ristabilire la fiducia nei valori di riferimento, senza limitarsi tuttavia al semplice riconoscimento dell'illegalità di tali comportamenti. Sono quindi d'accordo con la relazione, che ritiene necessario migliorare le misure di governance e attenuare i conflitti d'interesse e che mira inoltre a rafforzare la trasparenza e all'implementazione dell'accesso a un'ampia varietà di valori applicando i requisiti di governance in modo proporzionato.

È opportuna infatti un'accresciuta, armonizzata e flessibile disponibilità di valori di riferimento per ridurre l'importanza sistemica di alcuni grandi valori, in modo da consentire in modo proporzionato e trasparente a tutti coloro che ogni giorno fanno affari, investono, corrono un rischio, ottengono un credito di decidere in modo consapevole.

  Νότης Μαριάς ( ECR). Κύριε Πρόεδρε, γνωστοί τραπεζικοί κολοσσοί, όπως η Deutsche Bank, τιμωρήθηκαν με πρόστιμα γιατί χειραγώγησαν τον δείκτη αναφοράς LIBOR κερδίζοντας έτσι παράνομα εκατοντάδες δισεκατομμύρια ευρώ. Όμως, αυτό δεν φτάνει αφού, μετά την οικονομική κρίση, οι τράπεζες που διασώθηκαν με χρήματα των φορολογουμένων, ασκούν τη σκληρή και ανάλγητη πολιτική τους ενάντια στους μικροδανειολήπτες και βγάζουν στο σφυρί χιλιάδες σπίτια στη Νότια Ευρώπη.

Μεγάλο πρόβλημα έχει επίσης δημιουργηθεί στην Ελλάδα για τους μικροδανειολήπτες στεγαστικών δανείων σε ελβετικό φράγκο. Έτσι, πάνω από 70.000 δανειολήπτες βρέθηκαν σε δυσχερέστατη θέση όσον αφορά το κόστος αποπληρωμής των δανείων τους μετά τη μετατροπή με βάση τη συναλλαγματική ισοτιμία ευρώ / ελβετικού φράγκου, αφού οι τράπεζες, κατά παράβαση του δικαίου της Ευρωπαϊκής Ένωσης για τους καταναλωτές, δεν τους ενημέρωσαν ότι κάθε καταβαλλόμενη μηνιαία δόση επιβαρύνεται με κόστος μετατροπής.

Πρέπει λοιπόν η Ευρωπαϊκή Ένωση, σε συνεργασία με τις ελληνικές αρχές, να λάβει άμεσα μέτρα για την προστασία των δανειοληπτών στεγαστικών δανείων σε ελβετικό φράγκο οι οποίοι, μόνο κατά το τελευταίο διάστημα, έχουν χάσει επιπλέον, λόγω της μεγάλης πτώσης του ευρώ, πάνω από 1 δισ. ευρώ.

Gospodine predsjedniče, želim potpuno jasno podržati ovaj izvještaj naše izvjestiteljice jer mislim da „gađa u sridu“, kao što bismo mi rekli u Hrvatskoj, i vjerujem da ćemo stati na kraj manipulacijama u bankama i vjerujem da ćemo stati na kraj svemu onome čemu smo bili svjedoci zadnjih mjeseci i godina. Posebno želim da zaštitimo naše potrošače, da jačamo stabilnost financijskog sustava i da stvorimo zaista jedinstveno tržište kapitala.

Moj kolega Marias je upravo malo prije govorio o nepravdi, ja bih rekao čak i o prijevari, koja se dogodila s tečajem švicarskog franka kada su banke došle do ekstra zarade, a mnogi naši sugrađani postali su robovi tih kredita. Mislim da i o tom problemu ovdje moramo razgovarati jer vjerujem da naši građani zaslužuju i našu solidarnost kao ljudi iz politike. I o takvim problemima moramo govoriti na ovim forumima jer se tiču zemalja čitave Europske unije.

  Εμμανουήλ Γλέζος ( GUE/NGL). Κύριε Πρόεδρε, το σκάνδαλο με τη Deutsche Bank μου θυμίζει τον επαίσχυντο ρόλο που έπαιξε τη Deutsche Bank κατά τη διάρκεια της κατοχής στην Ελλάδα όταν ξεζούμισε κυριολεκτικά τον ελληνικό λαό. Και επειδή η Γερμανία εξακολουθεί να μην εκπληρώνει τις οφειλές της προς την Ελλάδα, η Deutsche Bank συνεχίζει τον καταστρεπτικό της ρόλο.

Το άλλο θέμα που θέλω να θίξω είναι: μήπως ματαιοπονούμε για τη σωτηρία των τραπεζών με το χρηματοπιστωτικό κεφάλαιο τη στιγμή που ό,τι έγινε στην Ελλάδα αποδεικνύει ότι όλα αυτά τα χρόνια ο ελληνικός λαός ξεζουμίστηκε για να σωθεί το χρηματοπιστωτικό κεφάλαιο; Αναφέρω ένα συγκεκριμένο γεγονός: η Τράπεζα της Ελλάδος αποκάλυψε ότι, κατά την περίοδο από το 2010 έως το 2014, δανειστήκαμε 226 δισεκατομμύρια ευρώ και επιστρέψαμε 270 δισεκατομμύρια ευρώ, δηλαδή 33 δισεκατομμύρια παραπάνω. Αυτό και μόνο προσδιορίζει το επαίσχυντο όλων των προσπαθειών μας.

  Igor Šoltes (Verts/ALE). Pravzaprav končno, bi lahko rekli. Mislim, da je ta uredba mehanizem na pravo smer.

Od finančnih oziroma referenčnih vrednosti so odvisne cele vrste finančnih instrumentov v vrednosti več milijonov eurov, nanje pa se navezujejo tudi milijoni stanovanjskih hipotekarnih posojil, prihrankov državljanov in manipulacije z njimi lahko povzročijo velike izgube za potrošnike in vlagatelje. Zato je treba seveda zagotoviti njihovo točnost, trdnost in celovitost referenčnih vrednosti in postopkov njihovega določanja.

V preteklosti smo bili priča velikim špekulacijam in manipulacijam, je pa dejstvo seveda, da manipulacije in špekulacije sta sicer dva instrumenta, ki ustvarjata t.i. fiktivni finančni kapital, ki trenutno tudi upravlja svet.

Zato je potrebno na tem mestu zagotoviti s to uredbo večjo transparentnost, realnost in utemeljenost vhodnih podatkov in pa sankcioniranje ter ustrezne mehanizme nadzora.

Mr President, I welcome the fact that in this report the S&D Group has managed to ensure a fair balance of requirements between critical and non-critical benchmarks, as well as the inclusion of commodity benchmarks. Therefore, as I mentioned before, I truly oppose the fact that critical benchmarks are left to be established by each and every Member State of the European Union. At the same time, I believe it is very important that a European legislative framework is going to be established in order to avoid the scandals and the market abuses that took place in the past. I would like to thank the rapporteur and the shadow rapporteurs for the good balance reached in the text at the end.

  Jonathan Hill, Member of the Commission. Mr President, thanks to all the Members for the contributions they have made to what has been an excellent debate. First of all, there is clearly a lot of agreement: there is agreement on the need for us to take action to stop the kind of manipulation that we have seen too often in the past; there is agreement on the importance of transparency, and on the importance of better governance; agreement on the need to have better regulation and better supervision; and agreement that the rapporteur has come up with a good framework – although I recognise that some want to go further in some respects, whether on the question of supervision or on the definition of non-critical benchmarks.

Having listened to the debate, I am sure that we will find suitable common ground to make rapid progress on this file. That would be good for consumers, it would be good for investors, it would be good for confidence in markets and it would therefore be good for financial stability.

I think that we need these safeguards in place as soon as possible. A number of honourable Members have talked about the length of time it has taken to get where we are now. Now we have an opportunity to take this proposal forward with the wind in our sails that I believe we have. That will help us ensure that robust benchmarks are used in EU markets to take action against manipulation and to prevent any failure of critical benchmarks.

So I, on behalf of the Commission, would very much like to thank the rapporteur and the shadow rapporteurs for all their hard work, which I think has been successful in moving forward with this legislation, and I very much look forward to a constructive set of negotiations in the trilogue and, I hope, a swift resolution to an issue that needs to be gripped.

  Cora van Nieuwenhuizen, Rapporteur. Ik wil alle sprekers bedanken voor hun inbreng en hun waardevolle bijdrage van vandaag. Ik ben ontzettend blij met de brede steun. Natuurlijk hebben wij niet iedereen 100% gelukkig kunnen maken, maar ik ben toch blij dat het verslag als geheel door u allen breed gedragen wordt.

Ik wil de blijken van waardering en de complimenten graag in ontvangst nemen, maar ik wil ze ook heel graag delen met mijn medewerker, Koen ter Wal, die hier ontzettend veel hard werk in heeft gestoken. Ik wil ook de beleidsadviseur van de ALDE-Fractie, Petra, niet vergeten en de mensen van het secretariaat van de Commissie economische zaken. Want dit was mijn eerste verslag en dan is het toch een behoorlijke zoektocht om je in dit Parlement netjes door alle procedures heen te slaan. Dus ik ben iedereen die daaraan op die manier heeft bijgedragen ook bijzonder erkentelijk.

Aan mijnheer Monot wil ik nog wel even zeggen dat hij het echt verkeerd heeft gezien als hij denkt dat het bij de kritische benchmarks alleen maar om LIBOR en EURIBOR gaat, want dat is echt niet het geval. Wij hebben niet voor niets behalve de kwantitatieve criteria juist ook kwalitatieve criteria daaraan toegevoegd, zodat er altijd een evaluatie moet plaatsvinden om te kijken of iets al dan niet een kritische benchmark is.

Ik zal niet verder op de inhoud ingaan, want dan gaat het debat veel te lang duren. Ik kijk er erg naar uit om met de schaduwrapporteurs en uiteraard met de Commissie en de Raad straks de trialogen in te gaan, om daar zo snel mogelijk die belangrijke stappen te zetten naar een goede regulering van de benchmarks.

  Neena Gill (S&D), in writing. I welcome this regulation: the benchmark scandals in the recent past clearly demonstrate what unregulated benchmarks can lead to. Manipulating benchmarks amounts to stealing from investors and consumers and undermines confidence in markets. The Commission fined the banks EUR 1.7 billion.

This regulation impacts consumersʼ daily lives as financial benchmarks determine the level of mortgage payments of millions of households in the EU. Banks stating they cannot invest in the real economy had made buffers to pay fines amounting to billions for the benchmark manipulation.

The agreement we voted upon in the Committee on Economic and Monetary Affairs (ECON) is a balanced and proportional outcome: transparency and supervision on the benchmark process have been increased and conflicts of interest are tackled.

The difference between critical and non-critical benchmarks is key for me. The principal agreement on this that we reached in the ECON Committee is a first step, which still needs to be fine-tuned in the trilogues.

However, I have to say that the process where one national competent authority (NCA) can nominate a benchmark in another NCA’s jurisdiction is critical; the process could set a detrimental precedent concerning the jurisdictional rights of an NCA.

  Theodor Dumitru Stolojan (PPE), în scris. În ultimii ani am învăţat despre iresponsabilitatea unor bănci şi a altor instituţii financiare, care a stat la baza declanşării crizei financiare. Dar am avut şi surpriza că unele bănci au manipulat până şi o serie de indici (LIBOR), folosiţi ca referinţe în determinarea costurilor din contractele de credit și din alte instrumente financiare cum ar fi, de exemplu, creditele pentru locuinţe. Indignarea pentru astfel de manipulări nu poate fi măsurată. Este mult prea mare. De aceea, salutăm acest raport care vine să asigure acurateţea şi integritatea procesului de stabilire a acestor indici. Se va asigura o mai mare transparenţă pentru acest proces, prevenirea conflictelor de interese şi îmbunătăţirea guvernanţei.

Quiero empezar dando la enhorabuena a los ponentes de los distintos grupos políticos, principalmente al señor Ludek Niedermayer, ya que considero que, con esta propuesta legislativa, han hecho un gran trabajo y han sido ambiciosos en aspectos como la proporcionalidad. Los casos recientes de manipulación de los índices de referencia de tipos de interés, como el líbor y el euríbor, han puesto de relieve la importancia de los índices de referencia y su vulnerabilidad, y por tanto la necesidad de esta propuesta legislativa por parte de la Comisión Europea. Me alegra mucho ver que hemos logrado llegar a un acuerdo, teniendo en cuenta que las negociaciones comenzaron la legislatura pasada con Sharon Bowles como ponente. Las negociaciones con el Consejo y la Comisión deben garantizar que con esta propuesta logremos establecer un marco común para asegurar la exactitud e integridad de los índices utilizados como puntos de referencia en los instrumentos financieros y contratos financieros de la Unión, garantizando un alto nivel de protección de los consumidores y de los inversores y estableciendo la trasparencia como una de las grandes prioridades.
